<official-title>To amend title 38, United States Code, to provide authority for certain members of the Armed Forces who have served 20 years on active duty to transfer entitlement to Post-9/11 Educational Assistance to their dependents.</official-title>

<section id="HB314E372C59349E1ABE283E0A47441A2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Education Assistance to Realign New Eligibilities for Dependents (EARNED) Act of 2011</short-title></quote>.</text></section> 
<section id="H9A8F032FC2A740A1AE3309E1D5424B2F"><enum>2.</enum><header>Authority of certain members of the Armed Forces who have served 20 years on active duty to transfer entitlement to Post-9/11 Educational Assistance to their dependents</header> 
<subsection id="HA0E8B4E38934436AB7DD3D62BBC41790"><enum>(a)</enum><header>Transfer authorized</header><text display-inline="yes-display-inline">Section 3319(b) of title 38, United States Code, is amended—</text> 
<paragraph id="H082F3A6ACBD04A14A9983CDC488BD1E3"><enum>(1)</enum><text>in paragraph (1), by striking <quote>or</quote>;</text></paragraph> 
<paragraph id="HCA492E26D52B4D9886478C7C18E1D62D"><enum>(2)</enum><text>in paragraph (2), by striking the period and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="HF7739EC2AB864D40AE92B9F22A0F13C8"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="H8D7CDD98D21D439693F51FC33503F50D" style="USC"> 
<paragraph id="H0FFDF7F6094C4D1CAAC188673B29A109"><enum>(3)</enum><text display-inline="yes-display-inline">20 years of active duty service in the Armed Forces, as of any date between September 11, 2001, and September 30, 2011, including at least 90 days of such service after September 10, 2001.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HAA2D6EAFC948429AAD6B45D3C92F76D8"><enum>(b)</enum><header>Opportunity To transfer entitlement</header><text>Notwithstanding any other provision of law, during the period beginning on the date of the enactment of this Act and ending on December 31, 2012, an individual who is entitled to educational assistance under chapter 33 of title 38, United States Code, and who completed at least 20 years of active duty service in the Armed Forces and was discharged or released from such service under honorable conditions before September 30, 2011, may transfer all or part of the individual’s entitlement to an eligible dependent under section 3319 of title 38, United States Code.</text></subsection> 
<subsection id="H65E45D7E2667448DA802C46BAE3A4916"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this Act shall take effect as if included in the enactment of the Post-9/11 Veterans Educational Assistance Act of 2008 (title V of Public Law 110–252).</text></subsection></section>
