		<section id="HFFD2E0A0D18C46F59F1A1907B0D89925" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Patent Continuing Disclosure
			 Act</short-title></quote>.</text>
		</section><section id="HCA67E364AAF7443993085B516ED42696" section-type="subsequent-section"><enum>2.</enum><header>False
			 marking</header><text display-inline="no-display-inline">Section 292 of title
			 35, United States Code, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="H2D4B4C772A5E4ED6BD5B5D4D0A46A769" style="OLC">
				<subsection id="H7A58F8851ED447CAB721761737E197CB"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H16198ACBDE2845C184AC7C8EC653E5D9"><enum>(1)</enum><text display-inline="yes-display-inline">Any person who makes, uses, offers for
				sale, or sells within the United States, or imports into the United States, an
				item that is affixed with the word <quote>patent</quote> and is accompanied by
				a number for a patent that has been granted by the Patent and Trademark Office
				to that person for that item shall not be fined under this section after the
				patent expires if—</text>
						<subparagraph id="HEE6FAF6F61534A3395EA75A17A16F902" indent="up1"><enum>(A)</enum><text>no change in the manufacturing or
				production process of the item occurs after the expiration of the patent; or</text>
						</subparagraph><subparagraph id="H351808BCE84840FA8CCC2676F0332176" indent="up1"><enum>(B)</enum><text>in a case in which a change in the
				manufacturing or production process of the item occurs after the expiration of
				the patent, the word <quote>expired</quote> is placed before the word
				<quote>patent</quote> or the patent number.</text>
						</subparagraph></paragraph><paragraph id="H7D0B8E220E004023933D2751B62EE62D" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">For purposes of this subsection, the term
				<quote>change in the manufacturing or production process</quote> of an item
				means an intentional expansion, enhancement, improvement, or repair, that
				suspends, for a period of at least 24 hours, the normal operating procedures
				through which the item is assembled, made, crafted, manufactured, built, or
				fabricated from individual components or raw materials, or
				both.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="HD95D5E1D8C514EEB807A6F23FF711C80"><enum>3.</enum><header>Applicability</header><text display-inline="no-display-inline">The amendment made by section 2 shall apply
			 to any case pending on the date of the enactment of this Act and to any case
			 commenced on or after such date of enactment.</text>
