		<section id="HE336828D0EFC4CA2BD177D2F210C2241" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Equal Access to COBRA Act of
			 2011</short-title></quote>.</text>
		</section><section id="HDDADD101E6D740999D7D3AC9D79D00BF"><enum>2.</enum><header>Amendments to the
			 Internal Revenue Code of 1986</header>
			<subsection id="HA7DF4A333ABD47F3AF6E153F1CC714DC"><enum>(a)</enum><header>Qualified
			 beneficiary</header><text>Section 4980B(g)(1)(A) of the Internal Revenue Code
			 of 1986 is amended—</text>
				<paragraph id="H34E1899EC68D438B9D77D4B462A3057E"><enum>(1)</enum><text>in clause (i), by
			 striking <quote>or</quote> at the end thereof;</text>
				</paragraph><paragraph id="H5F93E5C5AFCD4360910B26C21F23D7EB"><enum>(2)</enum><text>in clause (ii), by
			 striking the period and inserting a comma; and</text>
				</paragraph><paragraph id="HF0BDB02FADB643C1B37E15FB0C5FD5B4"><enum>(3)</enum><text>by inserting after
			 clause (ii), the following:</text>
					<quoted-block display-inline="no-display-inline" id="H6CBD67D57F964768B539CFD46433ECBA" style="OLC">
						<clause id="HD4A4ABC90FDB45FDBA780A498DFBB0B3"><enum>(iii)</enum><text>as the domestic
				partner of the employee, as such term is defined by the group health plan,
				or</text>
						</clause><clause id="H382162F71D3041CB810F2EF5BD765CB8"><enum>(iv)</enum><text>as the dependent
				child of the domestic partner (as defined in clause
				(iii)).</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HA57B5659E78C40BD89226D2B1066F94B"><enum>(b)</enum><header>Special rule for
			 retirees and widows</header><text>Section 4980B(g)(1)(D) of the Internal
			 Revenue Code of 1986 is amended by striking clauses (i) through (iii), and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="H0B17FB6328324A67B8A9F99834615D5F" style="OLC">
					<clause id="H8783504EF06F4A62981981B3B71488C5"><enum>(i)</enum><text>as
				the spouse or domestic partner (described in subparagraph (A)(iii)) of the
				covered employee,</text>
					</clause><clause id="H575AD92F0222445DA610E77357C5EC7B"><enum>(ii)</enum><text>as the dependent
				child of the covered employee or the covered employee’s domestic partner
				(described in clause (i)), or</text>
					</clause><clause id="H691567BCA132487BB6E9FD3AF4758A35"><enum>(iii)</enum><text>as the surviving
				spouse or surviving domestic partner (described in clause (i)) of the covered
				employee.</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HF372ECE4676B4B9CA57004BC557DC34C"><enum>(c)</enum><header>Special rule for
			 certain bankruptcy proceedings</header><text>Section 4980B(f)(2)(B)(i)(III) of
			 the Internal Revenue Code of 1986 is amended by striking <quote>or dependent
			 children of the covered employee</quote> and inserting <quote>, surviving
			 domestic partner (described in subsection (g)(1)(A)(iii)), or dependent
			 children of the covered employee or such surviving domestic
			 partner</quote>.</text>
			</subsection><subsection id="H6E89D9656AD7459B858CCB988B648C3D"><enum>(d)</enum><header>Qualifying
			 event</header><text>Section 4980B(f)(3)(C) of the Internal Revenue Code of 1986
			 is amended by inserting before the period the following: <quote>, or the
			 covered employee’s domestic partner (described in subsection (g)(1)(A)(iii))
			 ceasing to be such covered employee’s domestic partner under the terms of the
			 group health plan</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H4821DA98FB5548E1A8CC70653BCED714"><enum>(e)</enum><header>Notice
			 requirements</header><text>Section 4980B(f)(6)(A) of the Internal Revenue Code
			 of 1986 is amended by striking <quote>and spouse of the employee (if
			 any)</quote> and inserting <quote>and, if any, such covered employee's
			 qualified beneficiaries who are age 19 or older</quote>.</text>
			</subsection></section><section id="H9FC3173F32D44C1D8734DF45E70B3D9B"><enum>3.</enum><header>Amendments to the
			 Employee Retirement Income Security Act of 1974</header>
			<subsection id="HB92C4D9B8AD14898961566103A93FDB3"><enum>(a)</enum><header>Qualified
			 beneficiary</header><text>Section 607(3)(A) of the Employee Retirement Income
			 Security Act of 1974 (29 U.S.C. 1167(3)(A)) is amended—</text>
				<paragraph id="H33E2FC9F075040388871410FB26E686A"><enum>(1)</enum><text>in clause (i), by
			 striking <quote>or</quote> at the end thereof;</text>
				</paragraph><paragraph id="H8B147589F7374E5E8B93146D2E8BB154"><enum>(2)</enum><text>in clause (ii), by
			 striking the period and inserting a comma; and</text>
				</paragraph><paragraph id="HBB03390B958A4BB19EF468B7E29057CC"><enum>(3)</enum><text>by inserting after
			 clause (ii), the following:</text>
					<quoted-block display-inline="no-display-inline" id="H52A1AA4580E74D75A3FFBDC98CF8460C" style="OLC">
						<clause id="H8084DC6348324E4F862A064810F452C5"><enum>(iii)</enum><text>as the domestic
				partner of the employee, as such term is defined by the group health plan,
				or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H215988FAE89545BB850E3B5CC459C006"><enum>(iv)</enum><text>as the dependent
				child of the domestic partner (as defined in clause
				(iii)).</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="HFCCC2B96C39D43B8BDA5631CB813A2FA"><enum>(b)</enum><header>Special rule for
			 retirees and widows</header><text>Section 607(3)(C) of the Employee Retirement
			 Income Security Act of 1974 (29 U.S.C. 1167(3)(C)) is amended by striking
			 clauses (i) through (iii) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="HEA0671C59737450F8946B3A48CF1A670" style="OLC">
					<clause id="H5FB569EF4A3243838285DCC3F12A58A9"><enum>(i)</enum><text>as
				the spouse or domestic partner (described in paragraph (3)(A)(iii)) of the
				covered employee,</text>
					</clause><clause id="H7101A34180C2475AAC86F2F8C57A9A8E"><enum>(ii)</enum><text>as the dependent
				child of the covered employee or the covered employee’s domestic partner
				(described in clause (i)), or</text>
					</clause><clause id="HEDCBA954B596430D918FC6650AD8AE46"><enum>(iii)</enum><text>as the surviving
				spouse or surviving domestic partner (described in clause (i)) of the covered
				employee.</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H94291E38B3E84F59BC12526EB7DDAE18"><enum>(c)</enum><header>Special rule for
			 certain bankruptcy proceedings</header><text>Section 602(2)(A)(iii) of the
			 Employee Retirement Income Security Act of 1974 (29 U.S.C. 1162(2)(A)(iii)) is
			 amended by striking <quote>or dependent children of the covered
			 employee</quote> and inserting <quote>, surviving domestic partner (described
			 in section 607(3)(A)(iii)), or dependent children of the covered employee or
			 such surviving domestic partner</quote>.</text>
			</subsection><subsection id="HA3A533FCADC0484BA262A709BD0CA4CF"><enum>(d)</enum><header>Qualifying
			 event</header><text>Section 603(3) of the Employee Retirement Income Security
			 Act of 1974 (29 U.S.C. 1163) is amended by inserting before the period the
			 following: <quote>, or the covered employee’s domestic partner (described in
			 section 607(3)(A)(iii)) ceasing to be such covered employee’s domestic partner
			 under the terms of the group health plan</quote>.</text>
			</subsection><subsection id="HE8DCC3FF776548FBACBEA088748FB17E"><enum>(e)</enum><header>Notice
			 requirements</header><text>Section 606(a)(1) of the Employee Retirement Income
			 Security Act of 1974 (29 U.S.C. 1166(a)(1)) is amended by striking <quote>and
			 spouse of the employee (if any)</quote> and inserting <quote>and, if any, such
			 covered employee's qualified beneficiaries who are age 19 or
			 older</quote>.</text>
			</subsection></section><section id="HB753D0B448434BB9BA1C53AE33D92E4C"><enum>4.</enum><header>Amendments to the
			 Public Health Service Act</header>
			<subsection id="HFA212E66C6694100922D94301C2D8F3F"><enum>(a)</enum><header>Qualified
			 beneficiary</header><text>Section 2208(3)(A) of the Public Health Service Act
			 (42 U.S.C. 300bb–8(3)(A)) is amended—</text>
				<paragraph id="HA567D1FB5E234F6695BDE037F993B511"><enum>(1)</enum><text>in clause (i), by
			 striking <quote>or</quote> at the end thereof;</text>
				</paragraph><paragraph id="H90CEAD7C681F4ABFB7DF5BEB8BA1D365"><enum>(2)</enum><text>in clause (ii), by
			 striking the period and inserting a comma; and</text>
				</paragraph><paragraph id="H69AD4A672A0E4478A56E3A888C71FD68"><enum>(3)</enum><text>by inserting after
			 clause (ii), the following:</text>
					<quoted-block display-inline="no-display-inline" id="H23B7DD606DCB4EAF88FC04E7EBCA2584" style="OLC">
						<clause id="H825987886A1748899A8381902091B1B0"><enum>(iii)</enum><text>as the domestic
				partner of the employee, as such term is defined by the group health plan,
				or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="H17B012D5212F4BFF8693ECA7B62FFE36"><enum>(iv)</enum><text>as the dependent
				child of the domestic partner (as defined in clause
				(iii)).</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H66411D1A3CE5425283638B1927AA4D40"><enum>(b)</enum><header>Qualifying
			 event</header><text>Section 2203(3) of the Public Health Service Act (42 U.S.C.
			 300bb–3(3)) is amended by inserting before the period the following: <quote>,
			 or the covered employee’s domestic partner (described in section
			 2208(3)(A)(iii)) ceasing to be such covered employee’s domestic partner under
			 the terms of the group health plan</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HC0335D37AD454C2E8726E2C8B3D3080B"><enum>(c)</enum><header>Notice
			 requirements</header><text>Section 2206(1) of the Public Health Service Act (42
			 U.S.C. 300bb–6(1)) is amended by striking <quote>and spouse of the employee (if
			 any)</quote> and inserting <quote>and, if any, such covered employee's
			 qualified beneficiaries who are age 19 or older</quote>.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H84A741849B8149888E6E983F7D78E41E"><enum>5.</enum><header>Effective
			 date</header>
			<subsection commented="no" display-inline="no-display-inline" id="HECDA8D0C4052437DB635B091B3D6D405"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Except as provided in
			 subsection (b), the amendments made by this Act shall apply with respect to
			 plan years beginning after 180 days after the date of the enactment of this
			 Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H80EF44BE497E4E22A1DA2C54E8A24EF6"><enum>(b)</enum><header>Special rule for
			 collective bargaining agreements</header><text display-inline="yes-display-inline">In the case of a group health plan
			 maintained pursuant to one or more collective bargaining agreements between
			 employee representatives and one or more employers ratified before the date of
			 the enactment of this Act, the amendments made by this Act shall not apply to
			 plan years beginning before the earlier of—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H927EA6F128554268B5625ECC28EC20F8"><enum>(1)</enum><text display-inline="yes-display-inline">the date on which the last of the
			 collective bargaining agreements relating to the plan terminates (determined
			 without regard to any extension thereof agreed to after the date of the
			 enactment of this Act); or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF902F1FEF1BE4C42BA274D5222A1E595"><enum>(2)</enum><text display-inline="yes-display-inline">3 years after the date of the enactment of
			 this Act.</text>
				</paragraph><continuation-text continuation-text-level="subsection">For
			 purposes of paragraph (1), any plan amendment made pursuant to a collective
			 bargaining agreement relating to the plan which amends the plan solely to
			 conform to any requirement added by this Act shall not be treated as a
			 termination of such collective bargaining agreement.</continuation-text></subsection></section></legis-body>
