		  Policies Act of 1978 to promote energy independence, increase competition,
		  democratize energy generation, and provide for the connection of certain small
		  electric energy generation systems, and for other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Grid Access Act of
			 2009</short-title></quote>.</text>
		</section><section id="id592C9EC5DC37421992AB03B3F5489F27"><enum>2.</enum><header>Definition of
			 combined heat and power facility</header><text display-inline="no-display-inline">Section 3 of the Public Utility Regulatory
			 Policies Act of 1978 (16 U.S.C. 2602) is amended by adding at the end the
			 following:</text>

				<paragraph commented="no" id="ID3b875a84552a428e8ab5850187766b4b"><enum>(22)</enum><header>Combined heat
				and power facility</header>
					<subparagraph commented="no" id="id269C61F5B5954A3E8E82567F2BA5372B"><enum>(A)</enum><header>In
				general</header><text>The term <term>combined heat and power facility</term>
				means a facility that—</text>
						<clause commented="no" id="ID35a7a96a954f4586a5702ada2f163d57"><enum>(i)</enum><text>uses the same
				energy source for the simultaneous or sequential generation of electrical power
				or mechanical shaft power, or both, in combination with the generation of steam
				or other forms of useful thermal energy (including heating and cooling
				applications);</text>
						</clause><clause commented="no" id="ID118de8b7d0544d638c7f571b195d3240"><enum>(ii)</enum><text>has—</text>
							<subclause commented="no" id="IDc81fc1101be14756821e8f0a887ef543"><enum>(I)</enum><text>an electrical
				capacity of not more than 10 megawatts;</text>
							</subclause><subclause commented="no" id="IDbba0dd3820464aabb998797d2fd71326"><enum>(II)</enum><text>a mechanical
				energy capacity of not more than 7,000 horsepower; or</text>
							</subclause><subclause commented="no" id="IDedb18dcd150c4e05a4fcd60568048b59"><enum>(III)</enum><text>an equivalent
				combination of electrical and mechanical energy capacities;</text>
							</subclause></clause><clause commented="no" id="ID7dedc8186cf4490b9306216d70ee2d85"><enum>(iii)</enum><text>produces at
				least 20 percent of the total useful energy of the facility in the form of
				thermal energy that is not used to produce electrical or mechanical power, or
				both; and</text>
						</clause><clause commented="no" id="IDa598e8cd89514f7aa00ff9224e127ea7"><enum>(iv)</enum><text>achieves an
				energy efficiency of not less than 60 percent.</text>
						</clause></subparagraph><subparagraph commented="no" id="ID67b80991de2b4a42a6c25ff90a2469f5"><enum>(B)</enum><header>Inclusions</header><text>The
				term <term>combined heat and power facility</term> includes—</text>
						<clause commented="no" id="IDb1077616bff647748dd76e9c675cc24c"><enum>(i)</enum><text>a recovered waste
				energy system that produces electricity from—</text>
							<subclause commented="no" id="ID8dfef8445a404c8fb7aaf11277918555"><enum>(I)</enum><text>exhaust heat or
				flared gas from any industrial process;</text>
							</subclause><subclause commented="no" id="ID3b412294aa0b46ffb2c6133f1bb34032"><enum>(II)</enum><text>waste gas or
				industrial tail gas that would otherwise be flared, incinerated, or vented;
				or</text>
							</subclause><subclause commented="no" id="IDa7160a5d58f74876a03cd7b600ae5002"><enum>(III)</enum><text>a pressure drop
				in any gas, other than any pressure drop to a condenser that subsequently vents
				the resulting heat; and</text>
							</subclause></clause><clause commented="no" id="ID970d3205b10945cdaed9c0296ea851d8"><enum>(ii)</enum><text>a facility that
				produces electricity from such other forms of waste energy, as are determined
				by the
				Secretary.</text>
						</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="HB33BC574989449978907EE0077D1143" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Net metering and interconnection
			 standards</header>
			<subsection commented="no" display-inline="no-display-inline" id="idD91ADF5B1A9E4AE4B741ED45A474AE1D"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 113 of the Public Utility
			 Regulatory Policies Act of 1978 (16 U.S.C. 2623) is amended by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H8860411FE87A497682DA16501C10D4A0" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="H733439B468384E979C00C4183352447D"><enum>(d)</enum><header display-inline="yes-display-inline">Net metering</header>
						<paragraph commented="no" display-inline="no-display-inline" id="HE03B4EBE83F14582ABC7307573C17000"><enum>(1)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this subsection and subsection
				(e):</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="HC428412446764ED08D91BD1D5C2FE653"><enum>(A)</enum><header display-inline="yes-display-inline">Customer-generator</header><text display-inline="yes-display-inline">The term <term>customer-generator</term>
				means the owner or operator of a qualified generation unit.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id37C8500491CB4B83BF296490EE774CAA"><enum>(B)</enum><header display-inline="yes-display-inline">Electric generation unit</header><text display-inline="yes-display-inline">The term <term>electric generation
				unit</term> means—</text>
								<clause commented="no" display-inline="no-display-inline" id="id0CE78389664242C780A4C21A86FE3ED7"><enum>(i)</enum><text display-inline="yes-display-inline">a qualified generation unit; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id144A980CE8A849AD96439C89338EB30C"><enum>(ii)</enum><text display-inline="yes-display-inline">any electric generation unit that qualifies
				for net metering under a net metering tariff or rule approved by a
				State.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H47EE5D920ACB4521BB23B1CAED1201C1"><enum>(C)</enum><header display-inline="yes-display-inline">Local distribution system</header><text display-inline="yes-display-inline">The term <term>local distribution
				system</term> means any system for the distribution of electric energy to the
				ultimate consumer of the electricity, whether or not the owner or operator of
				the system is a retail electric supplier.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H07533B1B4B694081824233C1C4141F6B"><enum>(D)</enum><header display-inline="yes-display-inline">Net metering</header><text display-inline="yes-display-inline">The term <term>net metering</term> means
				the process of—</text>
								<clause commented="no" display-inline="no-display-inline" id="id9105955CDC6646D0A1BC7864B49E1FF1"><enum>(i)</enum><text display-inline="yes-display-inline">measuring the difference between the
				electricity supplied to a customer-generator and the electricity generated by
				the customer-generator that is delivered to a local distribution system at the
				same point of interconnection during an applicable billing period; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idBDE64EDB51CE48CAAB9FFA3807A68BB1"><enum>(ii)</enum><text display-inline="yes-display-inline">providing an energy credit to the
				customer-generator based on the electricity produced by the customer-generator
				from a qualified generation unit.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3D2DA0392CEF4D8B817300F4F86C50AE"><enum>(E)</enum><header display-inline="yes-display-inline">Qualified generation unit</header><text display-inline="yes-display-inline">The term <term>qualified generation
				unit</term> means an electric energy generation unit that—</text>
								<clause commented="no" display-inline="no-display-inline" id="H157368910C304FC0BEB68573796F15F3"><enum>(i)</enum><text display-inline="yes-display-inline">is a fuel cell or microturbine or uses as
				the energy source of the unit solar energy, wind, biomass, geothermal energy,
				anaerobic digestion, or landfill gas, or a combination of the any of those
				sources;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H482BC6551C31473793496293CBAC6E7F"><enum>(ii)</enum><text display-inline="yes-display-inline">has a generating capacity of not more than
				10 megawatts;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H2C840FC44AC44B88B7CFC7B0C4628D6E"><enum>(iii)</enum><text display-inline="yes-display-inline">is located on premises that are owned,
				operated, leased, or otherwise controlled by the customer-generator; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H958472DCE3CB4067A8526FB57DB4ED10"><enum>(iv)</enum><text display-inline="yes-display-inline">is intended to offset all or part of the
				requirements of the customer-generator for electric energy.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H593C300FEE8646029935A65562E08B59"><enum>(F)</enum><header display-inline="yes-display-inline">Retail electric supplier</header><text display-inline="yes-display-inline">The term <term>retail electric
				supplier</term> means any electric utility that sells electric energy to the
				ultimate consumer of the energy.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H7676BF6D56BB4CE2BAC8C918C25311CE"><enum>(2)</enum><header display-inline="yes-display-inline">Adoption</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
				enactment of this subsection, each State regulatory authority (with respect to
				each electric utility for which the State regulatory authority has ratemaking
				authority), and each nonregulated electric utility, shall—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idA9C5BDD8A70749BF8416151D6011ED1A"><enum>(A)</enum><text display-inline="yes-display-inline">provide public notice and conduct a hearing
				with respect to the standards established under paragraph (3); and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0C6CBAB9AAC54191800C7C7F95DE587D"><enum>(B)</enum><text display-inline="yes-display-inline">on the basis of the hearing, adopt the net
				metering standard.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAACCD0E61EAF48DBB123A13422DF1D9D"><enum>(3)</enum><header display-inline="yes-display-inline">Establishment of net metering
				standard</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id461019369B2F42F3A792F2FBCB981993"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each retail electric supplier shall offer
				to arrange (either directly or through a local distribution company or other
				third party) to make net metering available, on a first-come, first-served
				basis, to each of the retail customers of the retail electric supplier in
				accordance with the requirements described in subparagraph (B) and other
				provisions of this subsection.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H43A400570E2B41648DDCDEE0D59B542"><enum>(B)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The requirements referred to in
				subparagraph (A) are, with respect to a retail electric supplier, that—</text>
								<clause commented="no" display-inline="no-display-inline" id="id4D302FA5AE4F41F5AB9A405D4CE447D4"><enum>(i)</enum><text display-inline="yes-display-inline">rates and charges and contract terms and
				conditions for the sale of electric energy to customer-generators shall be the
				same as the rates and charges and contract terms and conditions that would be
				applicable if the customer-generator did not own or operate a qualified
				generation unit and use a net metering system; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H6D470854B77D42079DE5C5005547ACEA"><enum>(ii)</enum><text display-inline="yes-display-inline">each retail electric supplier shall notify
				all of the retail customers of the retail electric supplier of the standard
				established under this paragraph as soon as practicable after the adoption of
				the standard.</text>
								</clause></subparagraph><subparagraph id="ID9b2086f319c049f4b5bc5b99c8cc1c7c"><enum>(C)</enum><header>Modifications</header><text>Nothing
				in this subsection prevents a retail electric supplier from petitioning the
				Commission for modifications to a standard established under this subsection to
				ensure that the equipment, services, and system of the supplier function in a
				safe and efficient manner.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H70D1AFE219A34D6D9028866B644DEC55"><enum>(4)</enum><header display-inline="yes-display-inline">Net energy measurement</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id97F6148EFC6F4117B22A3853A82AF279"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each retail electric supplier shall arrange
				to provide to customer-generators who qualify for net metering under subsection
				(b) an electrical energy meter capable of net metering and measuring, to the
				maximum extent practicable, the flow of electricity to or from the customer,
				using a single meter and single register.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEE3AFC3B589B42F4B83F0F39B9781284"><enum>(B)</enum><header display-inline="yes-display-inline">Impracticability</header><text display-inline="yes-display-inline">In a case in which it is not practicable to
				provide a meter to a customer-generator under subparagraph (A), a retail
				electric supplier (either directly or through a local distribution company or
				other third party) shall, at the expense of the retail electric supplier,
				install 1 or more of those electric energy meters for the customer-generators
				concerned that accomplishes what the single meter described in subparagraph (A)
				would accomplish.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HFCBC2C577C3043CD86ED3474BFFE067E"><enum>(5)</enum><header display-inline="yes-display-inline">Billing</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id45BAD1F1CCBD407D903D51F055A11B2E"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each retail electric supplier subject to
				subsection (b) shall calculate the electric energy consumption for a customer
				using a net metering system in accordance with subparagraphs (B) through
				(D).</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H6391B6D2032A4BAE808D00B0339B0026"><enum>(B)</enum><header display-inline="yes-display-inline">Measurement of electricity</header><text display-inline="yes-display-inline">The retail electric supplier shall measure
				the net electricity produced or consumed during the billing period using the
				metering installed in accordance with paragraph (4).</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H575F1888B4B74F189D394980DB6D77E7"><enum>(C)</enum><header display-inline="yes-display-inline">Billing and crediting</header>
								<clause commented="no" display-inline="no-display-inline" id="id8F947AC14CDD4445952FC266B17CBCA5"><enum>(i)</enum><header display-inline="yes-display-inline">Billing</header><text display-inline="yes-display-inline">If the electricity supplied by the retail
				electric supplier exceeds the electricity generated by the customer-generator
				during the billing period, the customer-generator shall be billed for the net
				electric energy supplied by the retail electric supplier in accordance with
				normal billing practices.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H15213D5E9D31467D8D32176607582205"><enum>(ii)</enum><header display-inline="yes-display-inline">Crediting</header>
									<subclause commented="no" display-inline="no-display-inline" id="id7FC85B0A76584B4F97335F354A04D349"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If electric energy generated by the
				customer-generator exceeds the electric energy supplied by the retail electric
				supplier during the billing period, the customer-generator shall be billed for
				the appropriate customer charges for that billing period and credited for the
				excess electric energy generated during the billing period, with the credit
				appearing as a kilowatt-hour credit on the bill for the following billing
				period.</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="idCE0EED6AC6FF4386A8E5DDB3C2A88D68"><enum>(II)</enum><header display-inline="yes-display-inline">Application of credits</header><text display-inline="yes-display-inline">Any kilowatt-hour credits provided to a
				customer-generator under this clause shall be applied to customer-generator
				electric energy consumption on the following billing period bill (except for a
				billing period that ends in the next calendar year).</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="idDB22E20D8E054DD6AC220B6B026CCA0B"><enum>(III)</enum><header display-inline="yes-display-inline">Carryover of unused credits</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
				enactment of this subsection, the Commission shall promulgate a rule
				establishing procedures for carrying over unused credits from the preceding
				year.</text>
									</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE89BD46B1A7446B5B6BD061BACEEB32"><enum>(D)</enum><header display-inline="yes-display-inline">Use of time-differentiated rates</header>
								<clause commented="no" display-inline="no-display-inline" id="idD95D8F5DD72E4D38A3BB949AB30F0642"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in clause (ii), if a
				customer-generator is using a meter and retail billing arrangement that has
				time-differentiated rates—</text>
									<subclause commented="no" display-inline="no-display-inline" id="idB4887C65FA0941D095A048AF62E7765B"><enum>(I)</enum><text display-inline="yes-display-inline">the kilowatt-hour credit shall be based on
				the ratio representing the difference in retail rates for each time-of-use
				rate; or</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id1D5870BCE6974A048D5D751B72382F44"><enum>(II)</enum><text display-inline="yes-display-inline">the credits shall be reflected on the bill
				of the customer-generator as a monetary credit reflecting retail rates at the
				time of generation of the electric energy by the customer-generator.</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id7186B8D4F5B74A83806171DD3B318EAF"><enum>(ii)</enum><header display-inline="yes-display-inline">Different tariffs or services</header><text display-inline="yes-display-inline">A retail electric supplier shall offer a
				customer-generator the choice of a time-differentiated energy tariff rate or a
				nontime-differentiated energy tariff rate, if the retail electric supplier
				offers the choice to customers in the same rate class as the
				customer-generator.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1F299172710B4413BCCFC294874E35CE"><enum>(6)</enum><header display-inline="yes-display-inline">Percent limitation</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="HD0D56FC9D8B148FF98495CE9EFA06411"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The standard established under this
				subsection shall not apply for a calendar year in the case of a
				customer-generator served by a local distribution company if the total
				generating capacity of all customer-generators with net metering systems served
				by the local distribution company in the calendar year is equal to or more than
				4 percent of the capacity necessary to meet the average forecasted aggregate
				customer peak demand of the company for the calendar year.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD519C0F69750490BBBA8BA625CE5241D"><enum>(B)</enum><header display-inline="yes-display-inline">Records and notice</header>
								<clause commented="no" display-inline="no-display-inline" id="id8BC966643C4D4CB8B0FFC94619958283"><enum>(i)</enum><header display-inline="yes-display-inline">Records</header><text display-inline="yes-display-inline">Each retail electric supplier shall
				maintain, and make available to the public, records of—</text>
									<subclause commented="no" display-inline="no-display-inline" id="idEE434F1E02CD45F68FFE6690FEA55B07"><enum>(I)</enum><text display-inline="yes-display-inline">the total generating capacity of
				customer-generators of the system of the retail electric supplier that are
				using net metering; and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id5CFAE51DA17C4673AAFA082332DF3065"><enum>(II)</enum><text display-inline="yes-display-inline">the type of generating systems and energy
				source used by the electric generating systems used by the
				customer-generators.</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idE780217C2E1A4F4B9D3785B6028DA729"><enum>(ii)</enum><header display-inline="yes-display-inline">Notice</header><text display-inline="yes-display-inline">Each such retail electric supplier shall
				notify the State regulatory authority and the Commission at each time at which
				the total generating capacity of the customer-generators of the retail electric
				supplier reaches a level that equals or exceeds—</text>
									<subclause commented="no" display-inline="no-display-inline" id="id81DE28B5043A4F878BD178D77498EE96"><enum>(I)</enum><text display-inline="yes-display-inline">75 percent of the limitation specified in
				subparagraph (A); or</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="idBE7A3331B0934B45813EE5F98829FBFC"><enum>(II)</enum><text display-inline="yes-display-inline">the limitation specified in subparagraph
				(A).</text>
									</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H97920473A0B74F8BAA92C8A0DB6806ED"><enum>(7)</enum><header display-inline="yes-display-inline">Ownership of credits</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id5C450F6606C7475080C8E1F9D881746B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For purposes of Federal and State laws
				providing renewable energy credits or greenhouse gas credits, a
				customer-generator with a qualified generation unit and net metering shall be
				treated as owning and having title to the renewable energy attributes,
				renewable energy credits and greenhouse gas emission credits relating to any
				electricity produced by the qualified generation unit.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFAEFD973A7C14F09A97B0CA2729A7E90"><enum>(B)</enum><header display-inline="yes-display-inline">Retail electric suppliers</header><text display-inline="yes-display-inline">No retail electric supplier shall claim
				title to or ownership of any renewable energy attributes, renewable energy
				credits, or greenhouse gas emission credits of a customer-generator as a result
				of interconnecting the customer-generator or providing or offering the
				customer-generator net metering.</text>
							</subparagraph></paragraph><paragraph id="ID757f30cfd1654c7c84bd017bfca773e6"><enum>(8)</enum><header>Safety and
				performance standards</header>
							<subparagraph id="ID180fa3d58bea4b57adfa4e35d87ec6b3"><enum>(A)</enum><header>In
				general</header><text>A qualified generation unit and net metering system used
				by a customer-generator shall meet all applicable safety and performance and
				reliability standards established under the interconnection standards required
				under subsection (e).</text>
							</subparagraph><subparagraph id="ID5fa1dbbd167742e48e326e1eefd7468b"><enum>(B)</enum><header>Additional
				charges</header><text>After consultation with State regulatory authorities and
				nonregulated local distribution systems and notice and opportunity for comment,
				the Commission shall prohibit by regulation the imposition of additional
				charges by retail electric suppliers and local distribution systems for
				equipment or services for safety or performance that are in addition to the
				charges required under subsection (e).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H258DDED4CA3F4958925C643397A400B"><enum>(9)</enum><header display-inline="yes-display-inline">Determination of compliance</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id66197A577D764FC2B1E5A1EBFE7F7029"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Any State regulatory authority (with
				respect to each electric utility for which the authority has ratemaking
				authority), and each nonregulated electric utility, may apply to the Commission
				for a determination that any State net metering requirement or regulations
				complies with this subsection.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0C4F3F3CB63942899F066CE3B0DC5073"><enum>(B)</enum><header display-inline="yes-display-inline">Orders</header><text display-inline="yes-display-inline">In the absence of a determination under
				subparagraph (A), the Commission, on the motion of the Commission or pursuant
				to the petition of any interested person, may, after notice and opportunity for
				a hearing on the record, issue an order requiring against any retail electric
				supplier or local distribution company to require compliance with this
				subsection.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF46CC3A69B2B48328FBDEF3521BE4973"><enum>(e)</enum><header display-inline="yes-display-inline">Interconnection standards</header>
						<paragraph commented="no" display-inline="no-display-inline" id="HD59BD4674EBF41FC962573AF95E01D4D"><enum>(1)</enum><header display-inline="yes-display-inline">Model standards</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id082CCB4A09994684B8C48C64AA841285"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
				enactment of this subsection, the Commission shall publish model standards for
				the physical connection between local distribution systems and qualified
				generation units and electric generation units that are—</text>
								<clause commented="no" display-inline="no-display-inline" id="idF94F4406893048C5B032E82FE43E9D56"><enum>(i)</enum><text display-inline="yes-display-inline">qualified generation units (as defined in
				subsection (d)(1)(E) (other than clause (ii) of subsection (d)(1)(E)));
				or</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idD34CE2A28AEB4A32BEE9863890B25DCC"><enum>(ii)</enum><text display-inline="yes-display-inline">combined heat and power facilities.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id00EDAA7CBD754CF7B206AAB05B357F1A"><enum>(B)</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="yes-display-inline">The model standards shall be designed
				to—</text>
								<clause commented="no" display-inline="no-display-inline" id="id6879490FE3DA4556A369E768B71D6412"><enum>(i)</enum><text display-inline="yes-display-inline">encourage the use of qualified generation
				units and combined heat and power facilities; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id0E83B7468FE544F5B4EE7010962EC2EB"><enum>(ii)</enum><text display-inline="yes-display-inline">ensure the safety and reliability of the
				qualified generation units and the local distribution systems interconnected
				with the qualified generation units.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H180B4C36BF274127AAD9205732008916"><enum>(C)</enum><header display-inline="yes-display-inline">Expedited procedures</header>
								<clause commented="no" display-inline="no-display-inline" id="id634AFE7B669241CAAC8BA643D16D60B6"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The model standards shall have separate
				expedited procedures, including—</text>
									<subclause id="ID019b54047c6f470691f8ae7779d458d2"><enum>(I)</enum><text>a standard for
				interconnecting qualified generation units, and combined heat and power
				facilities, of not more than 15 kilowatts;</text>
									</subclause><subclause id="ID3512620cae85426b9eb5a8a073dad6b5"><enum>(II)</enum><text>a separate
				standard that expedites interconnection for qualified generation units, and
				combined heat and power facilities, of more than 15 kilowatts but not more than
				10 megawatts; and</text>
									</subclause><subclause id="IDc643fbdf3e3746109f4ffff7a623adc7"><enum>(III)</enum><text>a separate
				standard that expedites interconnection for qualified generation units, and
				combined heat and power facilities, of more than 15 kilowatts but not more than
				10 megawatts that do not export energy past the point of
				interconnection.</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id87F923A89EBC4DF1803E9CA696AA98FD"><enum>(ii)</enum><header display-inline="yes-display-inline">Best
				practices</header><text display-inline="yes-display-inline">The expedited
				procedures shall be based on the best practices that have been used in States
				that have adopted interconnection standards.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idF9D7F43525044626A08C09CFECA7C4CA"><enum>(iii)</enum><header display-inline="yes-display-inline">Model Rule</header>
									<subclause commented="no" display-inline="no-display-inline" id="id6F38D527F98A43DC80A7E34E6040F2AB"><enum>(I)</enum><header>In
				general</header><text display-inline="yes-display-inline">In designing the
				expedited procedures, the Commission shall consider Interstate Renewable Energy
				Council Model Rule MR–I2005.</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="idDD18F5B952044F2088827B74306D7C91"><enum>(II)</enum><header>Other
				generators</header><text display-inline="yes-display-inline">Nothing in this
				subsection precludes the Commission from adopting or enforcing interconnection
				requirements for generators that are not qualified generation units.</text>
									</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7B91E60703114BEA00B19BFDDFD48550"><enum>(D)</enum><header display-inline="yes-display-inline">Adoption of standards</header>
								<clause commented="no" display-inline="no-display-inline" id="id4D75B97E2D70423F85B9811CDB5988D2"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				enactment of this subsection, each State shall—</text>
									<subclause commented="no" display-inline="no-display-inline" id="id04DA4E7D7F2F485FBC44FE3FFAC38227"><enum>(I)</enum><text display-inline="yes-display-inline">adopt the model standards established under
				this paragraph, with or without modification; and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="idD1913DB282ED411789E9BBB78CE6A3B4"><enum>(II)</enum><text display-inline="yes-display-inline">submit the standards to the Commission for
				approval.</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="idC2596AAFD85E4179B656B643DA080C9F"><enum>(ii)</enum><header display-inline="yes-display-inline">Approval of modification</header><text display-inline="yes-display-inline">The Commission shall approve a modification
				of the model standards only if the Commission determines that the modification
				is—</text>
									<subclause commented="no" display-inline="no-display-inline" id="id1A4E8A5C66FB404CAD2634151FEF6AB3"><enum>(I)</enum><text display-inline="yes-display-inline">consistent with or superior to the purpose
				of the standards; and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id8D6A9A382D2B496AB68D13870137E2AC"><enum>(II)</enum><text display-inline="yes-display-inline">required by reason of local
				conditions.</text>
									</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3632BF9EB43D4DFC8926FB9B198917EE"><enum>(E)</enum><header display-inline="yes-display-inline">Nonapproval of standards for a
				State</header><text display-inline="yes-display-inline">If standards have not
				been approved under this paragraph by the Commission for any State during the
				2-year period beginning on the date of enactment of this subsection, the
				Commission shall, by rule or order, enforce the model standards of the
				Commission in the State until such time as State standards are approved by the
				Commission.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC12006867B284876BBC41EA26D2DAC44"><enum>(F)</enum><header display-inline="yes-display-inline">Updates</header>
								<clause commented="no" display-inline="no-display-inline" id="id7FB0F9AA26CB4F63AD3AE7B9E783D277"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				enactment of this subsection and after notice and opportunity for comment, the
				Commission shall publish an update of the model standards, after considering
				changes in the underlying standards and technologies.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idA98A6016A9004CF6855B9669CAC7CD26"><enum>(ii)</enum><header display-inline="yes-display-inline">Availability</header><text display-inline="yes-display-inline">The updates shall be made available to
				State regulatory authorities for the consideration of the authorities.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA13EE61CDFA949AD006985E7AFC45EE2"><enum>(2)</enum><header display-inline="yes-display-inline">Safety, reliability, performance, and
				cost</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="idEDA4AD3DB52642ADA29683C119B51DAD"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The standards under this subsection shall
				establish such measures for the safety and reliability of the affected
				equipment and local distribution systems as are appropriate.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCB391D8BA147432A9630796A98B65DAE"><enum>(B)</enum><header display-inline="yes-display-inline">Administration</header><text display-inline="yes-display-inline">The standards shall—</text>
								<clause commented="no" display-inline="no-display-inline" id="id0D49A96E6548415490CAAEB125668866"><enum>(i)</enum><text display-inline="yes-display-inline">be consistent with all applicable safety
				and performance standards established by—</text>
									<subclause commented="no" display-inline="no-display-inline" id="id31FE5108F3B44382801654F0AA0EA60B"><enum>(I)</enum><text display-inline="yes-display-inline">the national electrical code;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="idF0F86BF86E914A3AB5F8F4B56A4D7B1A"><enum>(II)</enum><text display-inline="yes-display-inline">the Institute of Electrical and Electronics
				Engineers;</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id01D9F4156BAA406AB9F58DA2A1AE994F"><enum>(III)</enum><text display-inline="yes-display-inline">Underwriters Laboratories; and</text>
									</subclause><subclause commented="no" display-inline="no-display-inline" id="id4E9FB8685469412294A8A43910CCFE40"><enum>(IV)</enum><text display-inline="yes-display-inline">the American National Standards Institute;
				and</text>
									</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id028048D358CF4D67BFFFA0C04DA7B194"><enum>(ii)</enum><text display-inline="yes-display-inline">impose not more than such minimum cost and
				technical burdens to the interconnecting customer generator as the Commission
				determines, by rule, are practicable.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H91D784BB59174D56B33B217B6D9CF770"><enum>(3)</enum><header display-inline="yes-display-inline">Additional charges</header><text display-inline="yes-display-inline">The model standards under this subsection
				shall prohibit the imposition of additional charges by local distribution
				systems for equipment or services for interconnection that are in excess
				of—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id9B37A89E80E94E7EA556E0BE1CE41834"><enum>(A)</enum><text display-inline="yes-display-inline">the charges necessary to meet the
				standards; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5B1904D0E23A4803BB735B8E146FBD29"><enum>(B)</enum><text display-inline="yes-display-inline">the charges and equipment requirements
				identified in the best practices of States with interconnection
				standards.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE824F70B707B411093CDDB1612000038"><enum>(4)</enum><header display-inline="yes-display-inline">Relationship to existing law regarding
				interconnection</header><text display-inline="yes-display-inline">Nothing in
				this subsection affects the application of section 111(d)(15) relating to
				interconnection.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF38EBB7DF7E54F94B8DF2EB1EDF062A6"><enum>(5)</enum><header display-inline="yes-display-inline">Consumer-friendly contracts</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="id10B31F01EC784EECB3786928713012F8"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission shall—</text>
								<clause commented="no" display-inline="no-display-inline" id="id266E3E4CEDD84B5D96641078B6889FAA"><enum>(i)</enum><text display-inline="yes-display-inline">promulgate regulations that ensure that
				simplified contracts will be used for the interconnection of electric energy by
				electric energy transmission or local distribution systems and generating
				facilities that have a power production capacity of not greater than 10
				megawatts; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idA9F16468B1084371ABDA2D4CB9DB0710"><enum>(ii)</enum><text display-inline="yes-display-inline">consider the best practices for
				consumer-friendly contracts that are used by States or national associations of
				State regulators.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0BBFAEA6E373466787E56EAB9417D55F"><enum>(B)</enum><header display-inline="yes-display-inline">Liability or insurance</header><text display-inline="yes-display-inline">The contracts shall not require liability
				or other insurance in excess of the liability or insurance that is typically
				carried by customer-generators for general
				liability.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idADD32847F8FD4DE38795ABD83F609A22"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Section 1262 of the Public Utility Holding
			 Company Act of 2005 (42 U.S.C. 16451) is amended by striking paragraph (5) and
			 inserting the following:</text>

				section 113(d) of the Public Utility Regulatory Policies Act of
				1978).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id8B0DD891698A4A578B152646425BEA19" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Improved siting for combined heat and power
			 facilities</header>
			<subsection id="ID96ef1a62a7cd43b492aade6e4cb0fee8"><enum>(a)</enum><header>In
			 general</header><text>Section 111(d) of the Public Utility Regulatory Policies
			 Act of 1978 (16 U.S.C. 2621(d)) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="id30904E54209146A79CCE33FDDBAB2CDF" style="OLC">
					<paragraph id="id0FD815E566C747C8BADEB257DCDC7728"><enum>(20)</enum><header>Improved
				siting for combined heat and power facilities</header>
						<subparagraph id="idE8767302E4EE40748B1F1E6827CDD6D8"><enum>(A)</enum><header>Distribution
				lines</header><text>Notwithstanding any State or local law (including
				regulations) that restrict independent power producers from siting private
				power lines (including a law that allows only a regulated electric utility
				company to site electric power lines across public rights-of-way), each
				electric utility shall allow a combined heat and power facility to site
				distribution lines on and across public rights-of-way for the purpose of
				interconnecting with contiguous end use customers.</text>
						</subparagraph><subparagraph id="id78A432D8BDD54D08A30EDD5FA8339734"><enum>(B)</enum><header>Contiguous end
				use customers</header><text>For purposes of this paragraph, an end use customer
				shall be considered to be contiguous to a combined heat and power facility if
				the end use customer—</text>
							<clause id="idA8FF8C4EB17C4F13924EE97A2F141B42"><enum>(i)</enum><text>is located
				on—</text>
								<subclause id="id23AFDD4F1AB04DF195CDC50DD0E28D5F"><enum>(I)</enum><text>the same property
				as the combined heat and power facility; or</text>
								</subclause><subclause id="IDbaa89369689b4ca0bd8410c30e26a669"><enum>(II)</enum><text>property
				immediately adjacent to the combined heat and power facility; or</text>
								</subclause></clause><clause id="IDb573d6e675564c9b889cdf60f5b2cb29"><enum>(ii)</enum><text>in the case of
				an end-use customer that purchases useful thermal output from the combined heat
				and power facility, is otherwise separated by an easement, public thoroughfare,
				or transportation or utility-owned
				right-of-way.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID76f6aa3236bd4158b4fabcf00f0b1073"><enum>(b)</enum><header>Compliance</header>
				<paragraph id="ID018722e1c5304f38879ea3244e9bb1fc"><enum>(1)</enum><header>Time
			 limitations</header><text>Section 112(b) of the Public Utility Regulatory
			 Policies Act of 1978 (16 U.S.C. 2622(b)) is amended by adding at the end the
			 following:</text>

				later than 2 years after the date of enactment of this paragraph, each State
				regulatory authority (with respect to each electric utility for which the State

				utility shall complete the consideration, and shall make the determination,
				referred to in section 111 with respect to each standard established by
				paragraph (20) of section
				111(d).</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>

				has conducted a proceeding to consider implementation of the standard concerned
				(or a comparable standard) for the electric utility; or</text>
								</paragraph><paragraph id="ID6600627fb6d941f9bfd483870cb2b237"><enum>(3)</enum><text>the State
				legislature has voted on the implementation of the standard (or a comparable
				standard) for the electric
				utility.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="IDd4957050881f44738bfd85fb4472eb6f"><enum>(B)</enum><header>Cross-reference</header><text>Section
			 124 of the Public Utility Regulatory Policies Act of 1978 (16 U.S.C. 2634) is
			 amended—</text>
						<clause id="id012D71A1FB2B4A35B825D416497F569B"><enum>(i)</enum><text>by
			 designating the first through fifth sentences as subsections (a) through (e),

			<subsection commented="no" display-inline="no-display-inline" id="idE724EBA6722D42BE878E631DBACE60B4"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subtitle B of title I of the Public Utility
			 Regulatory Policies Act of 1978 (16 U.S.C. 2621 et seq.) is amended by adding
			 at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id7B0BDEF737D947D08213C0B52DD56512" style="OLC">
					<section id="ID8d57a6fef801443bbc2bbe00a391d24d"><enum>118.</enum><header>Energy
				tariffs</header>
						<subsection id="ID359d8e4a4e6f47449d8d6fbcee4693cd"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph id="ID242776f0e7be49c990bd451f2630f982"><enum>(1)</enum><header>Clean
				distributed energy resource</header>
								<subparagraph id="id962AF85CA0584D21BDEB07A979C2846D"><enum>(A)</enum><header>In
				general</header><text>The term <term>clean distributed energy resource</term>
				means a combined heat and power facility or a qualified generation unit (as
				defined in section 113(d)(1)) that is used by a facility to generate
				electricity.</text>
								</subparagraph><subparagraph id="id597BB42CB0434CFCA50FCD0FC436D3C0"><enum>(B)</enum><header>Inclusions</header><text>The
				term <term>clean distributed energy resource</term> includes a renewable energy
				system that is not eligible for net metering under section 113.</text>
								</subparagraph></paragraph><paragraph id="id060D744F3C77402D923E7C7EDD686C2C"><enum>(2)</enum><header>Covered
				facility</header><text>The term <term>covered facility</term> means a customer
				facility that uses electricity produced from a clean distributed energy
				resource.</text>
							</paragraph><paragraph id="ID8c6bafb240b64223bfc72b00f522b5cf"><enum>(3)</enum><header>Electric
				utility regulatory entity</header>
								<subparagraph id="id84EDEB7C01CF4EC69682372B275A4A1C"><enum>(A)</enum><header>In
				general</header><text>The term <term>electric utility regulatory entity</term>
				means a State or local governing body that is responsible for the regulation of
				electric utilities that provide retail electrical power.</text>
								</subparagraph><subparagraph id="idB1EA766CAB1345D78CEB541788BD7DCF"><enum>(B)</enum><header>Inclusions</header><text>The
				term <term>electric utility regulatory entity</term> includes—</text>
									<clause id="idD7DDE99D627A452DB7BCDA45E5AEC82D"><enum>(i)</enum><text>an investor-owned
				utility;</text>
									</clause><clause id="idA68510C1640F4942B3E241906D8BFF78"><enum>(ii)</enum><text>a municipal
				utility;</text>
									</clause><clause id="idE4FB451F60B3460393D8020E0B7DD98D"><enum>(iii)</enum><text>an electric
				membership cooperative; and</text>
									</clause><clause id="id219BEF84CD6149E8A9989D7D796A63EA"><enum>(iv)</enum><text>a State power
				authority.</text>
									</clause></subparagraph></paragraph><paragraph id="ID7bbcf132eb9444f686da426f242e8719"><enum>(4)</enum><header>Excess
				power</header><text>The term <term>excess power</term> means the quantity of
				electricity produced by a clean distributed energy resource that is in excess
				of the electrical requirements of a covered facility.</text>
							</paragraph><paragraph id="ID8457a68ff8d943b3a93edc4e12816a7e"><enum>(5)</enum><header>Supplemental
				power</header><text>The term <term>supplemental power</term> mean the quantity
				of electricity required by a covered facility that exceeds the quantity of
				electricity produced by clean distributed energy resources that is available to
				the covered facility.</text>
							</paragraph></subsection><subsection id="IDdfeb69e8708a4248bedb29e22f170f9a"><enum>(b)</enum><header>Establishment
				of tariffs</header><text>Not later than 2 years after the date of enactment of
				this section, each electric utility regulatory entity shall establish a tariff
				for electricity produced by clean distributed energy resources that provides
				for the efficient and effective use of clean distributed energy resources by
				covered facilities in accordance with this section.</text>
						</subsection><subsection id="id54C7A36B1666408A9F193AD25993AEEF"><enum>(c)</enum><header>Tariff
				requirements</header>
							<paragraph id="ID058208ee874145ed99362239900208ae"><enum>(1)</enum><header>Supplemental
				power</header><text>The tariffs shall establish rates for supplemental power
				provided to covered facilities that are consistent with the rates charged for
				supplemental power by customer facilities that do not use clean distributed
				energy resources.</text>
							</paragraph><paragraph id="IDb2ab206f8ca941a7a4923fd5e9f3279e"><enum>(2)</enum><header>Backup
				power</header>
								<subparagraph id="idAA8A2D855F9A4815A33655EE507582A2"><enum>(A)</enum><header>In
				general</header><text>The tariffs shall establish rates for backup power
				provided to covered facilities that reflect the actual cost of providing backup
				power to the covered facilities.</text>
								</subparagraph><subparagraph id="id76F2DE631317416FBA45EB9052BECEEC"><enum>(B)</enum><header>Applicability</header><text>Subparagraph
				(A) shall not apply to a case in which backup power is available through a
				wholesale market tariff.</text>
								</subparagraph></paragraph><paragraph id="IDf39529a00bef4fe8a974850ea0369eda"><enum>(3)</enum><header>Standby
				power</header>
								<subparagraph id="idE9A42D0EA6284182A3F3FDB626120288"><enum>(A)</enum><header>In
				general</header><text>The tariffs shall establish rates for standby power
				provided to covered facilities that reflect the actual cost of providing
				standby power to the covered facilities.</text>
								</subparagraph><subparagraph id="id5A46B618B7824E049E2FAEBFF25F77D8"><enum>(B)</enum><header>Existing
				standby power rules</header><text>If a Regional Transmission Organization or
				Independent System Operator has standby power rules in effect on the date of
				enactment of this section and the clean distributed energy resource has access
				to standby power, the rules shall apply in the event of a conflict with this
				section.</text>
								</subparagraph><subparagraph id="IDad83476db4254b939a78548c883248b6"><enum>(C)</enum><header>Firm backup
				service</header><text>Standby power provided under this paragraph shall reserve
				capacity on transmission and distribution systems for the delivery of firm
				backup service to covered facilities.</text>
								</subparagraph></paragraph><paragraph id="IDe8d352aafcb748acb926f025cdc1359e"><enum>(4)</enum><header>Firm backup
				service</header><text>The tariffs shall ensure that covered facilities are
				provided with a right to purchase a firm supply of electrical power and energy
				if the generating facilities of the covered facilities are not in operation or
				are operating at less than full capacity.</text>
							</paragraph><paragraph id="IDe55670bbca364984b51d462a320a114b"><enum>(5)</enum><header>Excess
				power</header>
								<subparagraph id="idB1F0E6A5E6B14114A93B592A8DB1132F"><enum>(A)</enum><header>In
				general</header><text>The tariffs shall require electric utilities to purchase
				excess power produced by covered facilities at a rate that is equal to at least
				85 percent of the cost of electrical power to the electric utilities from the
				most efficient electric-only power plants.</text>
								</subparagraph><subparagraph id="id9B85A8FC7B5045EFB518FA4575A4C62C"><enum>(B)</enum><header>Existing excess
				power rules</header><text>If a Regional Transmission Organization or
				Independent System Operators has excess power rules in effect on the date of
				enactment of this section, the rules shall apply in the event of a conflict
				with this section.</text>
								</subparagraph></paragraph><paragraph id="id3F4E579CDC1B4CC58F7F7AAC66D26218"><enum>(6)</enum><header>Public
				availability</header><text>An electric utility shall make the tariffs available
				to the customers of the utility and the public.</text>
							</paragraph></subsection><subsection id="IDf80680d831894eca9f4f37e16b1afc71"><enum>(d)</enum><header>Bilateral
				tariff agreements</header><text>Nothing in this section—</text>
							<paragraph id="id63C6807A9B98449F8CAFC02462849637"><enum>(1)</enum><text>restricts an
				electric utility from entering into a bilateral tariff agreement with a
				customer; or</text>
							</paragraph><paragraph id="id6AEF5742FB094B888AE2D6D082BED594"><enum>(2)</enum><text>requires that any
				tariffs provided under the agreement be made public.</text>
							</paragraph></subsection><subsection id="ID400dc33924504fb7be8a932864dae5a9"><enum>(e)</enum><header>Reports</header><text>Each
				electric utility regulatory entity shall submit to the Secretary—</text>
							<paragraph id="idFFCA2108059E4D51B2A60CFCB1DA5C5B"><enum>(1)</enum><text>a report on the
				establishment of tariffs in accordance with this section; and</text>
							</paragraph><paragraph id="idA926DC02B38742CBA38C465B3E2FD879"><enum>(2)</enum><text>annual reports
				that include a description of—</text>
								<subparagraph id="idC55F057F294146FF866B6E870E1F7168"><enum>(A)</enum><text>the number of
				customers that make use of the tariffs; and</text>
								</subparagraph><subparagraph id="id7101A41FAC7F430EB4153ED012CCCCB5"><enum>(B)</enum><text>the quantity of
				excess power that is sold to electric utilities under the tariffs.</text>
								</subparagraph></paragraph></subsection><subsection id="idF40C57171CEF4FB2A0BCA320A0ED1380"><enum>(f)</enum><header>Regulations</header><text>Not
				later than 120 days after the date of enactment of this section, the Secretary
				shall promulgate such regulations as are necessary to carry out this
				section.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="H26545A673F004D27AA049316C945E6D2" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Relationship to State law</header><text display-inline="no-display-inline">Section 117(b) of the Public Utility
			 Regulatory Policies Act of 1978 (16 U.S.C. 2627(b)) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idF08327E1C26B4006A12697E8CA750FE6"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Nothing</quote> and
			 inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id914CDC7F01F3445CAFEFF24554E25B24" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="id0F5EE6624734427EBE01C29105BD67D9"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2),

			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB63F60F9758E406F9A76EDCAD401694E"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H6CDCA9E8B15C4150ABB0EE82AB035933" style="traditional">
					<paragraph commented="no" display-inline="no-display-inline" id="HED63AAE8BCA3428D80C5C2265CF024A7"><enum>(2)</enum><header display-inline="yes-display-inline">Net metering and interconnection
				standards</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="idC2DE78F3B8A64B598793F05F3D2F5D9B"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), no State or
				nonregulated utility may adopt or enforce any standard or requirement
				concerning net metering or interconnection that restricts access to the
				electric power transmission or local distribution system by qualified
				generators beyond those standards and requirements established under section
				113.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6DDB38C581714A5C8616BD8D0327125E"><enum>(B)</enum><header display-inline="yes-display-inline">Equivalent or greater access</header><text display-inline="yes-display-inline">Nothing in this Act precludes a State from
				adopting or enforcing incentives or requirements to encourage qualified
				generation and net metering that—</text>
							<clause commented="no" display-inline="no-display-inline" id="idE4D6C66F0AD94665B61784088C5F754F"><enum>(i)</enum><text display-inline="yes-display-inline">are in addition to or equivalent to
				incentives or requirements under section 113; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id0075FCADC2B1445D99A6189E07617A58"><enum>(ii)</enum><text display-inline="yes-display-inline">afford greater access to the electric power
				transmission and local distribution systems by qualified generation units (as
				defined in section 113(d)(1)) or afford greater compensation or credit for
				electricity generated by the qualified generation
				units.</text>
