		  improved benefits for veterans who are former prisoners of war, and for other

		<section id="HC7174D5107C4499CB32DC3058B41DAC2" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Prisoner of War Benefits Act of
			 2009</short-title></quote>.</text>
		</section><section id="H4C4E17AF31114351BEDC33CC1DDF0075"><enum>2.</enum><header>Improved
			 veterans’ benefits for former prisoners of war</header>
			<subsection id="HAD22EE1787554653A4D000D32D406391"><enum>(a)</enum><header>Repeal of
			 minimum period of internment for presumption of service connection for certain
			 diseases</header><text display-inline="yes-display-inline">Subsection (b) of
			 section 1112 of title 38, United States Code, is amended—</text>
				<paragraph id="H1E80CFAF49994CE5A2488326E5C47214"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
					<subparagraph id="idD0B26B3415E449B696CFC6A1202F7F50"><enum>(A)</enum><text>by striking
			 subparagraph (B);</text>
					</subparagraph><subparagraph id="idE066D82F626F4C9A8389E1E3068CDA01"><enum>(B)</enum><text>in subparagraph
			 (A), by striking <quote>; and</quote> and inserting a period; and</text>
					</subparagraph><subparagraph id="idE4327E44697F400BB819E794F414BE32"><enum>(C)</enum><text>by striking
			 <quote>a former prisoner of war—</quote> and all that follows through <quote>a
			 disease specified in paragraph (2)</quote> and inserting <quote>a former
			 prisoner of war, a disease specified in paragraph (2)</quote>; and</text>
					</subparagraph></paragraph><paragraph id="H61A01657DDB54EB200CC786E15534B2D"><enum>(2)</enum><text>in paragraph
			 (3)—</text>
					<subparagraph id="id2501FD10D6AC40CD808E804E4FE9B270"><enum>(A)</enum><text>by redesignating
			 subparagraphs (A) through (M) as subparagraphs (G) through (S); and</text>
					</subparagraph><subparagraph id="idA97DBA1AEF8D47768499C39D7B05AA6E"><enum>(B)</enum><text>by striking
			 <quote>(3) The diseases specified</quote> and all that follows through
			 <quote>the following:</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H8A85276EE65E4E119871E98CE4710000"><enum>(b)</enum><header>Additional
			 diseases presumed To be service connected</header><text>Paragraph (2) of
			 section 1112(b) of such title, as amended by subsection (a)(2), is further
			 amended—</text>
				<paragraph id="HA9B869FDF65E492CB573E21DEF8D5EC5"><enum>(1)</enum><text>in subparagraph
			 (F), by striking <quote>, if the Secretary determines that the veteran has
			 post-traumatic stress disorder (PTSD)</quote>; and</text>
				</paragraph><paragraph id="HF68EC3997196458180D35E8B8034163C"><enum>(2)</enum><text>by adding at the
			 end the following new subparagraphs:</text>
					<quoted-block display-inline="no-display-inline" id="H8D8BEC58DAFC4F2090CCAA628FDE2BA8" style="USC">
						<subparagraph id="HC7FDBF47D2AF424F9B5637349012DB6B" indent="up1"><enum>(T)</enum><text>Diabetes (type 2).</text>
						</subparagraph><subparagraph id="id1A2AC6B35F2B48898B23E6819EF669E5" indent="up1"><enum>(U)</enum><text>Such other diseases as the Secretary
				determines in regulations prescribed under subsection (d) warrants a
				presumption of
				service-connection.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H09EF62DC43784CFB84DAB2D34579449"><enum>(c)</enum><header>Authority for
			 administrative determination of presumption of service connection for
			 additional diseases</header><text>Section 1112 of title 38, United States Code,
			 as amended by subsections (a) and (b), is further amended by adding at the end
			 the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HF7F0B7B1FC1B41DD85B352CC8F822EC3" style="USC">
					<subsection id="H4B8802DDF1024134888CD95F2E4B600"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H24E85019C517432AB5F3B3AF39E536F"><enum>(1)</enum><text>The Secretary may
				determine in regulations prescribed under this subsection that a disease
				warrants a presumption of service-connection by reason of having positive
				association with the experience of being a prisoner of war.</text>
						</paragraph><paragraph display-inline="no-display-inline" id="HBA205D2B879E46B79B302936DB8F425F" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H73BF0D00ADC1423EBE0096A918F2A477"><enum>(A)</enum><text>Whenever the Secretary
				determines, on the basis of sound medical and scientific evidence, that a
				positive association exists between the experience of being a prisoner of war
				and the occurrence of a disease in humans, the Secretary shall prescribe
				regulations providing that a presumption of service connection is warranted for
				that disease for purposes of this section.</text>
							</subparagraph><subparagraph id="H4ACF9DF6F090451B97AFC1FAA2AEC0F" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id396DD0C2E0374B808E26729645521040"><enum>(i)</enum><text>In making a
				determination under this subsection, the Secretary shall take into
				account—</text>
									<subclause id="id8B5400C1A0BD47BAAD706BC557EF12E0" indent="up1"><enum>(I)</enum><text>recommendations received by the
				Secretary from the Advisory Committee on Former Prisoners of War under section
				541 of this title; and</text>
									</subclause><subclause id="idDC1FF0BB9E6046A8AC1E3ADF978A4F4F" indent="up1"><enum>(II)</enum><text>all other sound medical and
				scientific information and analyses available to the Secretary.</text>
									</subclause></clause><clause id="id08146CB9B2A24DCCB19E30AD47645460" indent="up1"><enum>(ii)</enum><text>In evaluating any study for the
				purpose of making a determination under this subsection, the Secretary shall
				take into consideration whether the results of the study are—</text>
									<subclause id="id73DC121400A442FBB65F5575AD48E4A8"><enum>(I)</enum><text>statistically significant;</text>
									</subclause><subclause id="id4539D62E11034F86B408E51F8C395292"><enum>(II)</enum><text>capable of replication; and</text>
									</subclause><subclause id="id00D1B72236BF4337A53559B613F8782E"><enum>(III)</enum><text>withstand peer review.</text>
									</subclause></clause></subparagraph><subparagraph id="H2D350A2904EE4CDAA9A5704F864189DF" indent="up1"><enum>(C)</enum><text>An association between the occurrence
				of a disease in humans and the experience of being a prisoner of war shall be
				considered to be positive for the purposes of subparagraph (A) if the credible
				evidence for the association is equal to or outweighs the credible evidence
				against the association.</text>
							</subparagraph></paragraph><paragraph id="H6A5A2260A4E9491FAB61BFB286741035" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H0C94815D191E4473952DD017E08C78FD"><enum>(A)</enum><text>Not later than 60 days
				after the date on which the Secretary receives a recommendation from the
				Advisory Committee on Former Prisoners of War that a presumption of service
				connection be established under this subsection for any disease, the Secretary
				shall determine whether a presumption of service connection under this
				subsection is warranted for that disease.</text>
							</subparagraph><subparagraph id="id6616DD99B9EB475284A5BB83DAB511DB" indent="up1"><enum>(B)</enum><text>If the Secretary determines under
				this subsection that a presumption of service connection is warranted for a
				disease, the Secretary shall, not later than 60 days after making the
				determination, issue proposed regulations setting forth the Secretary’s
				determination.</text>
							</subparagraph><subparagraph id="H9C48E1BE61E44E6FBA73FFC390C3CBDE" indent="up1"><enum>(C)</enum><text>If the Secretary determines under
				this subsection that a presumption of service connection is not warranted for a
				disease—</text>
								<clause id="idD86CDC4F2F6C4C19B82B2AA486AD0E81"><enum>(i)</enum><text>the Secretary shall, not later than 60
				days after making the determination, publish in the Federal Register a notice
				of such determination that includes an explanation of the scientific basis for
				such determination; and</text>
								</clause><clause id="id877B165AB5164118B4C52520A036E67A"><enum>(ii)</enum><text>if the disease is already included in
				regulations providing for a presumption of service connection, the Secretary
				shall, not later than 60 days after publication of notice under clause (i),
				issue proposed regulations removing the presumption for the disease.</text>
								</clause></subparagraph><subparagraph id="H42CC9D6395EE4678BB007C339E8530EC" indent="up1"><enum>(D)</enum><text>Not later than 90 days after the date
				on which the Secretary issues a proposed regulation under this subsection, the
				Secretary shall issue a final regulation that is effective on the date of
				issuance.</text>
							</subparagraph></paragraph><paragraph id="HAA836A074FCB4BD8AC1908313299C61D" indent="up1"><enum>(4)</enum><text>Whenever a presumption is removed
				from a disease under paragraph (3)—</text>
							<subparagraph id="HE79920B5D2F34FD99161F31CC8553CC2"><enum>(A)</enum><text>a veteran who was awarded compensation
				for such disease on the basis of the presumption provided in subsection (a)
				before the effective date of the removal shall continue to be entitled to
				receive compensation on that basis; and</text>
							</subparagraph><subparagraph id="HF84C84734FD6466EBC7DF7AF06CB3D14"><enum>(B)</enum><text>a survivor of a veteran who was
				awarded dependency and indemnity compensation for the death of a veteran
				resulting from such disease on the basis of such presumption shall continue to
				be entitled to receive dependency and indemnity compensation on such
				basis.</text>
							</subparagraph></paragraph><paragraph id="HFCF2FFA9D4DF4907AC89A6F3BE431483" indent="up1"><enum>(5)</enum><text>The Secretary shall carry out this
				subsection in consultation with, and after taking into consideration the views
				of, the Advisory Committee on Former Prisoners of War under section 541 of this
				title.</text>
