		<official-title>To award competitive grants to eligible partnerships to
		  enable the partnerships to implement innovative strategies at the secondary
		  school level to improve student achievement and prepare at-risk students for
		  postsecondary education and the workforce.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Secondary School Innovation Fund
			 Act</short-title></quote>.</text>
		</section><section id="id21E9095C6AE84342B9E833536CF3AE06" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="IDbd02e368b252448ebef3eff85b3fc8d6"><enum>(1)</enum><text>Since almost 90
			 percent of the fastest growing and best paying jobs now require some
			 postsecondary education, a secondary school diploma and the skills to succeed
			 in postsecondary education and the modern workplace are essential.</text>
			</paragraph><paragraph id="id97352CC4CA874945A12F8F353EA69654"><enum>(2)</enum><text>Only
			 <fraction>1/3</fraction> of all high school students in the United States
			 graduate in 4 years prepared for a 4-year institution of higher education.
			 Another <fraction>1/3</fraction> graduate, but without the skills and
			 qualifications necessary for success in postsecondary education or the
			 workplace, and the rest will not graduate from high school in 4 years, if at
			 all.</text>
			</paragraph><paragraph id="id98C9FF59955F463DBFA596AF8AC9AB9E"><enum>(3)</enum><text>Dropouts from the
			 class of 2008 will cost the United States more that $319,000,000,000 in reduced
			 earnings.</text>
			</paragraph><paragraph id="id6731887B7CF44EC199A582A3FE7DB28F"><enum>(4)</enum><text>The Nation’s
			 failure to meet the increasing demand for skilled workers means that American
			 companies cannot fill a large number of jobs. 81 percent of American
			 manufacturing companies report experiencing a moderate to severe shortage of
			 qualified workers.</text>
			</paragraph><paragraph id="ID45d3a007acd641758f42c3f83b7d3f5a"><enum>(5)</enum><text>The education
			 system of the United States should support critical thinking, creativity, and
			 innovative approaches to problem-solving—all skills that cannot easily be
			 outsourced. The Program for International Student Assessment is an
			 international assessment that measures these high-demand skills. Unfortunately,
			 when the results on this assessment of students from the United States are
			 compared to those of students from 27 other countries, many of which are
			 economic competitors of the United States, the United States students rank 24th
			 in problem-solving, 21st in scientific literacy, and 25th in mathematical
			 literacy.</text>
			</paragraph><paragraph id="IDb3292470277741e7a2c4c73dc5d031a8"><enum>(6)</enum><text>As the bar for
			 success continues to be raised, the responsibility to engender these attributes
			 with progressive programs and original models lies squarely with the education
			 system. It is imperative that the United States develop and implement new,
			 innovative approaches to fully prepare every student for the 21st
			 century.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID97a135c12b3e4ba9b077b0bb5eb6bd8e"><enum>(7)</enum><text>Realigning the
			 education system to meet new, demanding requirements and face intensifying
			 competition requires effective, systemic reform. Identifying effective,
			 replicable models that achieve this goal is a critical step towards enhancing
			 the prospects of all students entering the modern workforce.</text>
			</paragraph></section><section id="idD87F1271B32E4B6B8464282150F698AC"><enum>3.</enum><header>Secondary school
			 innovation fund</header>
			<subsection id="id270C0CDBE4BC4C3497773B7D954A25F8"><enum>(a)</enum><header>Secondary
			 school innovation fund</header><text display-inline="yes-display-inline">Title
			 I of the Elementary and Secondary Education Act of 1965 (20 U.S.C. 6301 et
			 seq.) is amended—</text>
				<paragraph id="id93EEF9E293EA48969B23AE867F447C81"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating part I as part J;
			 and</text>
				</paragraph><paragraph id="id65125E37FE1F44F8A8A1C81D9C29BE4E"><enum>(2)</enum><text>by inserting
			 after section 1830 the following:</text>
					<quoted-block display-inline="no-display-inline" id="id6B392FC9C16944DBBA95850A8C84879D" style="OLC">
						<part id="idF6E4170E27784343A50AC7250447B454"><enum>I<?LEXA-Enum I?></enum><header>Secondary school innovation fund</header>
							<section id="idFED40A525C0B43E089EB0A5854E61191"><enum>1851.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this part are—</text>
								<paragraph id="id7C3CC76419AB44A0BA4A87C23EA7B1C0"><enum>(1)</enum><text display-inline="yes-display-inline">to improve the achievement of at-risk
				secondary school students and prepare such students for postsecondary education
				and the workforce;</text>
								</paragraph><paragraph id="id58669636CCB74A95B206DB5E7EA2F19A"><enum>(2)</enum><text>to create
				evidence-based, replicable models of innovation in secondary schools at the
				State and local level; and</text>
								</paragraph><paragraph id="id3D8A46AB1CA94DD38359135C2C51DD55"><enum>(3)</enum><text>to support
				partnerships to create and inform innovation at the State and local level to
				improve learning outcomes and transitions for secondary school students.</text>
								</paragraph></section><section id="id546116ADADB942FFBC7FCE58CDD29627"><enum>1852.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text>
								<paragraph id="id57D3A1F85F574FAB8B520692475D914A"><enum>(1)</enum><header>Eligible
				partnership</header><text display-inline="yes-display-inline">The term
				<term>eligible partnership</term> means a partnership that includes—</text>
									<subparagraph id="id075671DD7956410D993C0192F76D9DA6"><enum>(A)</enum><text>not less than
				1—</text>
										<clause id="id7492F76409F14D4997677756257AC743"><enum>(i)</enum><text>State educational
				agency; or</text>
										</clause><clause id="id02D4BE08062A4A5A863BF8B06980543D"><enum>(ii)</enum><text>local
				educational agency that is eligible for assistance under part A; and</text>
										</clause></subparagraph><subparagraph id="idE30AE4B4994445D8893E9ED8195443F0"><enum>(B)</enum><text>not less than
				1—</text>
										<clause id="id2E310E2E71A84BE38CEF7558B0FEE71D"><enum>(i)</enum><text>institution of
				higher education;</text>
										</clause><clause id="id3D582BB136C744528961D276D369D864"><enum>(ii)</enum><text>nonprofit
				organization;</text>
										</clause><clause id="id586F46C6AF3C492FBA1CFAF7FC1DF528"><enum>(iii)</enum><text>community-based
				organization;</text>
										</clause><clause id="id114F2AF2F83840CDA3BEC621F1275737"><enum>(iv)</enum><text>business;
				or</text>
										</clause><clause id="idC1569A97E2674A81AAF9249E1CC0B6B9"><enum>(v)</enum><text>school
				development organization or intermediary.</text>
										</clause></subparagraph></paragraph><paragraph id="idC4F42EAA3CC34DBF808AD4D0757E8208"><enum>(2)</enum><header>Eligible
				school</header><text>The term <term>eligible school</term> means a public
				secondary school served by a local educational agency that is eligible for
				assistance under part A.</text>
								</paragraph><paragraph id="id42447F0F783B4CFE8EC61BB3809A609C"><enum>(3)</enum><header>High
				school</header><text>The term <term>high school</term> means a public school,
				including a public charter high school, that provides secondary education, as
				determined under State law, in 1 or more of grades 9 through 12.</text>
								</paragraph><paragraph id="idB0256E0EE5884D30884E823724856D6A"><enum>(4)</enum><header>Middle
				school</header><text>The term <term>middle school</term> means a public school,
				including a public charter middle school, that provides middle or secondary
				education, as determined under State law, in 1 or more of grades 5 through
				8.</text>
								</paragraph></section><section id="id5BC7425D8EF247289D443D7162294073"><enum>1853.</enum><header>Secondary
				school innovation fund</header>
								<subsection id="id830E43F7F73544089CD9EE13B004101C"><enum>(a)</enum><header>Program
				authorized</header>
									<paragraph id="idE6C57342EF9A42C3B39C620FBBCE125F"><enum>(1)</enum><header>Grants to
				eligible partnerships</header><text>The Secretary is authorized to award
				grants, on a competitive basis, to eligible partnerships to enable the eligible
				partnerships to pay the Federal share of the costs of implementing innovative
				strategies described in subsection (f) to improve the achievement of at-risk
				students in secondary schools.</text>
									</paragraph><paragraph id="id2307BB18947A40D7B6581EAB11628844"><enum>(2)</enum><header>Subgrants to
				eligible schools</header><text>An eligible partnership that receives a grant
				under this part may use the grant funds to award a subgrant to an eligible
				school to enable the eligible school to implement innovative strategies
				described in subsection (f) to improve the achievement of at-risk students at
				the eligible school.</text>
									</paragraph><paragraph id="id8B822CA6DCF248228A990AFA6BD80EA2"><enum>(3)</enum><header>Duration of
				grant period</header><text>A grant awarded under paragraph (1) shall be for not
				longer than a 5-year period.</text>
									</paragraph></subsection><subsection id="idF499E0E6B36A4FE0BB3C15EC5308E9ED"><enum>(b)</enum><header>Reservation of
				funds</header><text>The Secretary shall reserve 5 percent of the amounts
				appropriated under this part for a fiscal year for the evaluation described in
				subsection (h).</text>
								</subsection><subsection id="id0A74826BA9FB461B90BDA283C077D491"><enum>(c)</enum><header>Application</header>
									<paragraph id="id4687A69A3DAA48F78E50A10C8AC60797"><enum>(1)</enum><header>In
				general</header><text>An eligible partnership desiring a grant under this part
				shall submit an application to the Secretary at such time, in such manner, and
				containing such information as the Secretary may require.</text>
									</paragraph><paragraph id="id3451B501D1B84DF497FBC6CB913ECE9B"><enum>(2)</enum><header>Contents</header><text>The
				application described in paragraph (1) shall include—</text>
										<subparagraph id="id5638152D045A415F8E5389BA565D82B0"><enum>(A)</enum><text>a description of
				the eligible partnership, the partners forming the eligible partnership, and
				the roles and responsibilities of each partner, and a demonstration of each
				partner's capacity to support the outlined roles and responsibilities;</text>
										</subparagraph><subparagraph id="IDe64c8ef1f43149babdbcf1e576cc1dc0"><enum>(B)</enum><text>a description of
				how funds will be used to improve the achievement of at-risk students in
				secondary schools;</text>
										</subparagraph><subparagraph id="ID31393012ac8b4b3ea7a7fa5bf57a5c2d"><enum>(C)</enum><text>a description of
				how the activities funded by the grant will be innovative, systemic,
				evidence-based, and replicable;</text>
										</subparagraph><subparagraph id="id3C564DF365FC4E94B45A24EC19AE83CF"><enum>(D)</enum><text>a description of
				each subgrant the eligible partnership will award to an eligible school,
				including a description of the eligible school;</text>
										</subparagraph><subparagraph id="id50C4CD10C11145DCA1CB5EAA26177DBE"><enum>(E)</enum><text>a description of
				how the eligible partnership will measure and report improvement using the data
				collected under subsection (g) and additional indicators of improvement
				proposed by the partnership, such as—</text>
											<clause id="id16861CA151E840E18B9ED1B9B4B45B4D"><enum>(i)</enum><text>student
				attendance or participation;</text>
											</clause><clause id="id749C87E9DB084BBFA757767E5C316817"><enum>(ii)</enum><text>credit
				accumulation rates;</text>
											</clause><clause id="id6AE230FF97A5474B9640BD7349B5A3F0"><enum>(iii)</enum><text>core course
				completion rates;</text>
											</clause><clause id="id6B73171C4DA248D18B84357E6B8D654B"><enum>(iv)</enum><text>college
				enrollment and persistence rates; or</text>
											</clause><clause id="idAFB2C5C38AE8479E92A01EEFC0852291"><enum>(v)</enum><text>number or
				percentage of students taking—</text>
												<subclause id="id242F1AB383B74810854DAD032E346608"><enum>(I)</enum><text>Advanced
				Placement (AP), International Baccalaureate (IB), or other postsecondary
				education courses;</text>
												</subclause><subclause id="id76780BB4DF2740F4824FAA75C67EF8B4"><enum>(II)</enum><text>rigorous
				postsecondary education preparatory courses; or</text>
												</subclause><subclause id="id36750D9FA6764F9881C43AB2453C0D28"><enum>(III)</enum><text>registered
				apprenticeship and workforce training programs; and</text>
												</subclause></clause></subparagraph><subparagraph id="IDc3677be4319c41448f4c727dbebcf62a"><enum>(F)</enum><text>a description of
				the planning phase of not more than 90 days that the eligible partnership will
				undertake for the grant, including—</text>
											<clause id="id09ECD9AE7AD4451AA56257433FEACB93"><enum>(i)</enum><text>the activities
				and goals of the planning phase; and</text>
											</clause><clause id="id2DA39BCB5FC543DA8AB4B36DD29FA613"><enum>(ii)</enum><text>how each partner
				in the eligible partnership will participate in the planning phase.</text>
											</clause></subparagraph></paragraph></subsection><subsection id="IDc202f95643e74decb9372030ea4e4f4e"><enum>(d)</enum><header>Application
				review and award basis</header>
									<paragraph id="idF4F0874449584C108687367207141B2F"><enum>(1)</enum><header>Grant review
				and approval</header><text>The Secretary shall—</text>
										<subparagraph id="ID4f80c5a66d0e4df9900529cbbba3665d"><enum>(A)</enum><text>establish a peer
				review process to assist in the review of the grant applications and approval
				of the grants under this section; and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDbd5225fc6e4d4d40b76b6509d227813a"><enum>(B)</enum><text>appoint to the
				peer review process—</text>
											<clause commented="no" display-inline="no-display-inline" id="id46EC74912B6148FFAA4F5163FDFF7C4F"><enum>(i)</enum><text>individuals who
				are educators and experts in—</text>
												<subclause commented="no" display-inline="no-display-inline" id="idD6AA253DD4F342C2958012919D597439"><enum>(I)</enum><text>secondary school
				reform;</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="id83D91645617E443BAA5B29BB9BF1A0CC"><enum>(II)</enum><text>accountability;</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="idC9EDBD24F9F548B3B5034CFB9A4B4EE2"><enum>(III)</enum><text>secondary
				school improvement;</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="idE730CEB362314B29921D9E2572C7A2DC"><enum>(IV)</enum><text>innovative
				education models;</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="idB533A3C00B004415903E6E5BB5CC9172"><enum>(V)</enum><text>postsecondary
				education preparation and access; and</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="id1188E03ED7D146538D9308F923E13BA2"><enum>(VI)</enum><text>workforce
				preparation; and</text>
												</subclause></clause><clause commented="no" display-inline="no-display-inline" id="id483667B33BDD4FDCAF9D2163103C1716"><enum>(ii)</enum><text>not less than 1
				parent or community representative; and</text>
											</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD26F6AF273724D49B1EAA12E50C76790"><enum>(C)</enum><text>ensure that each
				grant award is of sufficient size and scope to carry out the activities
				proposed in the grant application, including the evaluation required under
				subsection (g)(3).</text>
										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC7C44110178C4CD2A7EEC823D9C9DE64"><enum>(2)</enum><header>Award
				basis</header><text>In awarding grants under this part, the Secretary shall
				ensure, to the extent practicable—</text>
										<subparagraph id="idB954FCE9A1C44D9183FE33D3D7122822"><enum>(A)</enum><text>diversity in the
				type of activities funded under the grants, including statewide and local
				initiatives;</text>
										</subparagraph><subparagraph id="id250D4FD543CA4D6C838F815B05FF5D21"><enum>(B)</enum><text>an equitable
				geographic distribution of the grants, including urban and rural areas and
				small and large school districts; and</text>
										</subparagraph><subparagraph id="id39BE62D11E12440481350CFFFBDA5F50"><enum>(C)</enum><text>that the grants
				support activities—</text>
											<clause id="id280D0429EA9E4F15875BA600F280FF1C"><enum>(i)</enum><text>that target
				different grade levels of students at the secondary school level;</text>
											</clause><clause id="idE695F25C3C7846D9BDA5A27DE8248390"><enum>(ii)</enum><text>in a variety of
				types of secondary schools, including middle schools and high schools;
				and</text>
											</clause><clause commented="no" id="idD67B1772C082443D84CBE504256A4365"><enum>(iii)</enum><text>in secondary
				schools of varying sizes, including small and large schools.</text>
											</clause></subparagraph></paragraph></subsection><subsection id="id53BAB694FA684A61953D0B46920C92BF"><enum>(e)</enum><header>Federal share,
				non-Federal share</header>
									<paragraph id="id02E310BD4192491CBFB5B7D98AA4D9B6"><enum>(1)</enum><header>Federal
				share</header><text>The Federal share of a grant under this part shall be not
				more than 75 percent of the costs of the activities assisted under the
				grant.</text>
									</paragraph><paragraph id="id6399BB484182496FBC05D50CD5534ECE"><enum>(2)</enum><header>Non-Federal
				share</header><text>The non-Federal share shall be not less than 25 percent of
				the costs of the activities assisted under the grant, of which not more than 10
				percent of the costs of the activities assisted under the grant may be provided
				in-kind, fairly evaluated.</text>
									</paragraph></subsection><subsection id="id25140F4A6FAF4D289FAF71F1ECC7DCA3"><enum>(f)</enum><header>Use of
				funds</header><text>An eligible partnership receiving a grant under this part,
				or an eligible school receiving a subgrant under this part, shall use grant or
				subgrant funds, respectively, to carry out 1 or more of the following effective
				models or innovative programs:</text>
									<paragraph id="ID12a21bde5a694116883c6128a8451835"><enum>(1)</enum><header>Effective
				school models</header>
										<subparagraph id="IDa605cb8df47d4d5e8a81a49dc1bdcbd6"><enum>(A)</enum><header>Multiple
				education pathways</header><text>A model creating a range of academically
				rigorous multiple education pathways, based on the analysis of student data,
				that lead to a secondary school diploma, that are consistent with readiness for
				postsecondary education and the workforce, and that offer students a range of
				educational options designed to meet the students’ needs and interests,
				including through the creation of new schools. Such pathways may
				include—</text>
											<clause id="IDc6aafa98f4ab4274936201792ba4dd81"><enum>(i)</enum><text>an effective
				dropout prevention and recovery model that—</text>
												<subclause id="id698A38085A154597893B4265910C2422"><enum>(I)</enum><text>prepares students
				for postsecondary education and career readiness;</text>
												</subclause><subclause id="IDdb24cd0388e84bc3b54a686f8ba870e7"><enum>(II)</enum><text>uses
				re-engagement and recuperative strategies based in youth development;</text>
												</subclause><subclause id="ID801f6cf49972403789e68c2aaef215be"><enum>(III)</enum><text>uses innovative
				strategies for credit recovery and acceleration, such as flexible hours or
				online access to curricula, courses, assessments, resources, and
				supports;</text>
												</subclause><subclause id="IDc64d0ca15b0244058fc3a4ec70473819"><enum>(IV)</enum><text>provides
				competency-based instruction and performance-based assessment to improve
				educational outcomes for various populations of overaged or undercredited
				students or students who have previously dropped out of secondary school, such
				as—</text>
													<item id="ID61b235080bfe4c5189aade86a34c4ec8"><enum>(aa)</enum><text>students not
				making sufficient progress to graduate with a regular secondary school diploma
				in the standard number of years;</text>
													</item><item id="ID236003186bd943d6a53d1bce7690f9d2"><enum>(bb)</enum><text>students who
				need to work to support themselves or their families;</text>
													</item><item id="IDdbc656abf1e94be4ac248189bbdf3c3d"><enum>(cc)</enum><text>pregnant and
				parenting teens; and</text>
													</item><item id="IDc66ebcc570b54ed5bb527d1353afbfc4"><enum>(dd)</enum><text>students
				returning from the juvenile justice system; and</text>
													</item></subclause><subclause id="IDf47048e9f2964aa594e402f2e0cc56bc"><enum>(V)</enum><text>combines rigorous
				academic education with career training for students that are not making
				sufficient progress to graduate from secondary school in the standard number of
				years;</text>
												</subclause></clause><clause id="ID782ea4faa0b540d9a6ac8b01309cd6a1"><enum>(ii)</enum><text>a career and
				technical education program;</text>
											</clause><clause id="IDa1e6237108cf4618b28949c8355ce8ca"><enum>(iii)</enum><text>a career
				academy or other model that delivers high quality, college preparatory
				curriculum in the context of a rigorous technical core; and</text>
											</clause><clause id="IDe5bb45b5b39a4ee394f6720937d133e5"><enum>(iv)</enum><text>creating a more
				personalized and engaging learning environment for secondary school students,
				such as—</text>
												<subclause id="ID9bf2be78eeb1444c868453882fb41e13"><enum>(I)</enum><text>establishing
				smaller learning communities;</text>
												</subclause><subclause id="IDcfa0ebc335034fbda2fe01bd77adce36"><enum>(II)</enum><text>creating student
				advisories and developing peer engagement strategies;</text>
												</subclause><subclause id="ID26d1b7cc84f948b78fd27503e5a7cb03"><enum>(III)</enum><text>creating
				mechanisms for increased educator collaboration around individual student
				needs;</text>
												</subclause><subclause id="IDa9e600f1e60b4657bf16e724cf3180e8"><enum>(IV)</enum><text>involving
				students and parents in the development of individualized student plans for
				secondary school success and graduation and transition to postsecondary
				education; and</text>
												</subclause><subclause id="IDdbbe25e8b6634d138a9e8c816e1b0d34"><enum>(V)</enum><text>creating
				mechanisms for increased student participation in school improvement efforts
				and in decisions affecting the students' own learning, including students
				leading guidance activities, mentoring, or tutoring efforts.</text>
												</subclause></clause></subparagraph><subparagraph id="ID86ad31e80a124a409845cd742e07659b"><enum>(B)</enum><header>Early college
				and dual enrollment schools</header><text>An early college high school or other
				dual enrollment learning opportunity that provides a course of study that
				enables a student to earn a secondary school diploma and either an associate
				degree or not more than 2 years of transferable postsecondary education credit
				toward a postsecondary degree or credential.</text>
										</subparagraph><subparagraph id="ID99f95ed88b8340c081c1212d74fcd195"><enum>(C)</enum><header>Secondary
				schools using early warning systems</header><text>A secondary school that
				enables at-risk students to graduate from secondary school ready to succeed in
				postsecondary education and the workforce, through use of an early warning
				indicator and intervention system that combines—</text>
											<clause id="IDafaba0b1c0554c1bbdf7019267828f92"><enum>(i)</enum><text>research-based
				whole school reform focused on improving attendance, behavior, and course
				performance;</text>
											</clause><clause id="IDe191ebf4da3542c0bcc32d4f76115519"><enum>(ii)</enum><text>targeted
				interventions provided by trained teams of adults working full-time in the
				school, which may include—</text>
												<subclause id="IDad4c94696da440ff8292e0d3b9418bb4"><enum>(I)</enum><text>participants or
				volunteers under the National and Community Service Act of 1990 (42 U.S.C.
				12501 et seq.) or the Domestic Volunteer Service Act of 1973 (42 U.S.C. 4950 et
				seq.);</text>
												</subclause><subclause id="ID06506d0492c2445789db67caa993bc51"><enum>(II)</enum><text>student and
				family advocates; and</text>
												</subclause><subclause id="IDfc56212737f244e6ae82b58e66fc988d"><enum>(III)</enum><text>college and
				career access and success counselors;</text>
												</subclause></clause><clause id="IDd2a2c91ae7eb48fe8c314739ac5f6d56"><enum>(iii)</enum><text>integrated
				student services and case-managed interventions for students requiring
				intensive supports; and</text>
											</clause><clause id="IDa3e6fab9fb4840e4bca99ef1577f95b5"><enum>(iv)</enum><text>an on-track
				indicator system to identify students in need of additional support and to
				monitor the effectiveness of the interventions described in clause (ii).</text>
											</clause></subparagraph></paragraph><paragraph id="ID13d404ee753f4c49aa0ae0b17e6f7d39"><enum>(2)</enum><header>Innovative
				programs</header>
										<subparagraph id="ID488863d3be2f4b82b319ec2d19694023"><enum>(A)</enum><header>Expanded
				learning-time opportunities</header><text>The creation of an expanded
				learning-time opportunity, which may include—</text>
											<clause id="ID255366bf903f46f6a1c0bb8348231e75"><enum>(i)</enum><text>establishing a
				mandatory expanded day, for all students transitioning into the first year of
				high school, for academic catch-up and enrichment;</text>
											</clause><clause id="IDad61367db2be419eb302d69e5f019e4c"><enum>(ii)</enum><text>providing arts,
				service-learning (as defined in section 101 of the National and Community
				Service Act of 1990 (42 U.S.C. 12511)), or youth development opportunities with
				community-based cultural and civic organizations;</text>
											</clause><clause id="ID26897df28cfc4e4fb0258b643dba5852"><enum>(iii)</enum><text>providing
				higher education and work-based exposure, experience, and credit-bearing
				learning opportunities in partnership with postsecondary education institutions
				and the workforce;</text>
											</clause><clause id="IDd6442a22ff56490899a6e4f8dab2c428"><enum>(iv)</enum><text>providing
				technology-enabled collaboration and access for students to receive assistance
				from content experts, instructors, and peers and to utilize resources for
				remediation and enrichment; or</text>
											</clause><clause id="IDc7ceb678a21b4841bf96097634ece153"><enum>(v)</enum><text>providing quality
				summer experiences, which may include youth development.</text>
											</clause></subparagraph><subparagraph id="ID3e412c9e6307431e803a29a4cc0aa1d1"><enum>(B)</enum><header>Successful
				transitions to high school</header><text>A program improving student
				transitions from middle school to high school and ensuring successful entry
				into high school, which may include—</text>
											<clause id="IDec309b33a4b44bb5a44671961721543e"><enum>(i)</enum><text>establishing
				summer transition programs for students transitioning from middle school to
				high school to ensure the students' connection to the students' new high school
				and to orient the students to the study skills and social skills necessary for
				success in the high school;</text>
											</clause><clause id="ID548bc40c77ab4f8c83eb6bde02b62d81"><enum>(ii)</enum><text>providing for
				the sharing of data between high schools and feeder middle schools;</text>
											</clause><clause id="ID32bfed659d1a48a6b65dbaef214ca923"><enum>(iii)</enum><text>establishing
				early warning indicator and intervention programs in high school for students
				transitioning into the students' first year of high school so that such
				students do not become truant or fall too far behind in academics;</text>
											</clause><clause id="ID9ab0f984b67d41cbb829e713bf2a1c95"><enum>(iv)</enum><text>increasing the
				level of student supports, including academic and nonacademic supports that
				meet the comprehensive needs of struggling students;</text>
											</clause><clause id="IDf110937ff27b4e1ca9fc85b1e3d58a75"><enum>(v)</enum><text>aligning academic
				standards, curricula, and assessments between middle and high schools;
				and</text>
											</clause><clause id="ID9a83c46de06a410b94dc5f6e750f28e0"><enum>(vi)</enum><text>providing
				electronic access to detailed information on student performance and all
				content and skill areas to students transitioning into high school and their
				parents.</text>
											</clause></subparagraph><subparagraph id="ID802856c964d14f89b7ad9fb2369021c4"><enum>(C)</enum><header>Successful
				transitions to postsecondary education and the
				workforce</header><text>Improvements to assist student transition from
				secondary school to postsecondary education and the workforce, which may
				include—</text>
											<clause id="IDd54c4d2d2e22462db492cf236740fa08"><enum>(i)</enum><text>providing for the
				sharing of data between secondary schools and institutions of higher education,
				including data on remediation and completion rates;</text>
											</clause><clause id="IDb34c2c2303874a1fac5a902794874973"><enum>(ii)</enum><text>enabling dual
				enrollment and post-secondary credit-bearing learning opportunities;</text>
											</clause><clause id="ID0fd12f1addce4878bd1404aec954579c"><enum>(iii)</enum><text>creating new
				opportunities to better utilize grades 11 and 12 and creating better
				connections to postsecondary education, which may include internships,
				externships, job shadowing, and technology-enabled collaboration;</text>
											</clause><clause id="IDbf689613d39642ad830c2c9ba0a4835e"><enum>(iv)</enum><text>providing
				enhanced planning and counseling for postsecondary education, including
				financial aid counseling; and</text>
											</clause><clause id="IDa1aeab7e8e9b4b5086b45efd0df4b2bb"><enum>(v)</enum><text>aligning the
				academic standards of secondary school with the academic standards of
				postsecondary education and the requirements and expectations of the workforce,
				including partnering with local industry to align technical curricula to
				workforce needs.</text>
											</clause></subparagraph><subparagraph id="ID66f7f6f2ce5c4e6689908a2d33357f1d"><enum>(D)</enum><header>Increased
				school autonomy and flexibility</header><text>A program of providing secondary
				schools with increased autonomy and flexibility, which may include—</text>
											<clause id="ID4cb5e7d52e4a4326b930745f9b43013e"><enum>(i)</enum><text>establishing a
				process whereby existing schools can apply for flexibility in such areas as
				scheduling, curricula, budgeting, and governance; and</text>
											</clause><clause id="ID6b9b8c6643f640b1a988a012dd30d6ea"><enum>(ii)</enum><text>starting new
				small public secondary schools that are guaranteed such autonomy.</text>
											</clause></subparagraph><subparagraph id="ID28e136598dce4271bdc2e301113d687c"><enum>(E)</enum><header>Rural
				opportunities</header><text>A program to improve learning opportunities for
				secondary school students in rural schools, including through the use of
				distance-learning opportunities and other technology-based tools.</text>
										</subparagraph><subparagraph id="ID7453cb40fde649a099f1194a388d03df"><enum>(F)</enum><header>Middle grade
				improvements</header><text>A program to improve learning opportunities for
				students in the middle grades—</text>
											<clause id="IDf36bf8a6f80147aa8ec5a679241be663"><enum>(i)</enum><text>to prevent
				student disengagement and improve achievement; and</text>
											</clause><clause id="ID1639715f579b47859c66dbc3c4604727"><enum>(ii)</enum><text>to better
				respond to early warning signs that students are at risk of dropping out of
				school, such as poor attendance, poor behavior, or course failure, through the
				use of an early warning indicator system and interventions.</text>
											</clause></subparagraph><subparagraph id="ID1cb454f8b817484686c1c52d95d6ffa9"><enum>(G)</enum><header>Improving
				teaching and academics</header><text>A program of improving teaching and
				increasing academic rigor at the secondary school level, which may
				include—</text>
											<clause id="IDef79547dbdc44104858d2c8e90d06c12"><enum>(i)</enum><text>improving the
				alignment of academic standards with the requirements and expectations of
				postsecondary education and the workforce;</text>
											</clause><clause id="ID4593199d0c23430e9629298b6f5fe024"><enum>(ii)</enum><text>improving the
				teaching and assessment of 21st century skills, including through the
				development of formative assessment models;</text>
											</clause><clause id="ID6a328f2c2bcf43e2ba0b3d4411b5ddee"><enum>(iii)</enum><text>providing
				high-quality professional development on data literacy, including on use of
				data to inform classroom instruction;</text>
											</clause><clause id="ID3fc437bc4a4a40a0b213501cc0bf3189"><enum>(iv)</enum><text>addressing the
				learning needs of various student populations, including students who are
				limited English proficient, late entrant English language learners, and
				students with disabilities; and</text>
											</clause><clause id="IDfb465b075951411c9dbb2af582b50436"><enum>(v)</enum><text>developing
				value-added measures for use in determining teacher ability and effectiveness,
				including for use in recruitment and hiring decisions.</text>
											</clause></subparagraph><subparagraph id="IDa86741c432124b0a978381a7250a049d"><enum>(H)</enum><header>Improved
				community and parental involvement</header><text>A program improving community
				and parental involvement, which may include—</text>
											<clause id="ID5246e846b8e94bed8b40b8c41d9c4bdd"><enum>(i)</enum><text>increasing
				community involvement, including leveraging community-based services and
				opportunities to provide every student with the academic and comprehensive
				nonacademic supports necessary for academic success; and</text>
											</clause><clause id="IDafe7be8c78e745b0baebdbfa15844fc7"><enum>(ii)</enum><text>increasing
				parental involvement, including providing parents with the tools to navigate,
				support, and influence their child’s academic career and choices through
				secondary school graduation and into postsecondary education and the workforce,
				including through electronic access to student data.</text>
											</clause></subparagraph></paragraph></subsection><subsection id="IDcdb61bfcab4e427ab8c2d2b1e5f4f24b"><enum>(g)</enum><header>Data collection
				and evaluation</header>
									<paragraph id="id2634DAD31F3F4E36BAC8C067DFA25EFA"><enum>(1)</enum><header>Collection of
				data</header><text display-inline="yes-display-inline">Each eligible
				partnership receiving a grant under this part shall collect and report annually
				to the Secretary such information on the results of the activities assisted
				under the grant as the Secretary may reasonably require, including information
				on—</text>
										<subparagraph id="ID745c9213881f40d1ae7e38f109be59aa"><enum>(A)</enum><text>the number and
				percentage of students who—</text>
											<clause id="idBB3FC93A224C4704A30F430F8F31216C"><enum>(i)</enum><text>are served by the
				eligible partnership;</text>
											</clause><clause id="id8708B4390E7F47378349CE9581AB9620"><enum>(ii)</enum><text>are assisted
				under this part; and</text>
											</clause><clause id="id11ED86535C9D4017B40376F5A2D14698"><enum>(iii)</enum><text>graduate from
				secondary school with a regular secondary school diploma in the standard number
				of years;</text>
											</clause></subparagraph><subparagraph id="IDe19c4d4d48014069a847b897b74dc012"><enum>(B)</enum><text>the number and
				percentage of students, at each grade level, who are—</text>
											<clause id="id5DE54130425547C596E2736D91FA15F1"><enum>(i)</enum><text>served by the
				eligible partnership;</text>
											</clause><clause id="idE2DDE27BE25D4DCD8ED170CBFF0CB6D6"><enum>(ii)</enum><text>assisted under
				this part; and</text>
											</clause><clause id="id9C783894FF0C42AAA61C0A9159EB1BE2"><enum>(iii)</enum><text>on track to
				graduate from secondary school with a regular secondary school diploma in the
				standard number of years;</text>
											</clause></subparagraph><subparagraph id="ID5321d5da97774874b28c2da12c354aa7"><enum>(C)</enum><text>the number and
				percentage of students, at each grade level, who—</text>
											<clause id="id4EC0A74805D3498D98AED57028297C83"><enum>(i)</enum><text>are served by the
				eligible partnership;</text>
											</clause><clause id="idC9BE35BB11F1424699B7C37C741E1755"><enum>(ii)</enum><text>are assisted
				under this part; and</text>
											</clause><clause id="id3F108666BCB14DEB9A43549ED6CF45A8"><enum>(iii)</enum><text>meet or exceed
				State challenging student academic achievement standards in mathematics,
				reading or language arts, or science, as measured by the State academic
				assessments under section 1111(b)(3);</text>
											</clause></subparagraph><subparagraph id="IDf4d1bf1bcaed4b8281cc2226c86ef124"><enum>(D)</enum><text>information
				consistent with the additional indicators of improvement proposed by the
				eligible partnership in the grant application; and</text>
										</subparagraph><subparagraph id="ID965bda0427254a37b1298f4f20dd647f"><enum>(E)</enum><text>other information
				the Secretary may require as necessary for the evaluation described in
				subsection (h).</text>
										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID40a4732280a141749c480c4797124220"><enum>(2)</enum><header>Reporting of
				data</header><text>Each eligible partnership receiving a grant under this part
				shall disaggregate the information required under paragraph (1) in the same
				manner as information is disaggregated under section 1111(h)(1)(C)(i).</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1D4CAB2F2AF44A77B749E32EA40B20F9"><enum>(3)</enum><header>Evaluation</header>
										<subparagraph commented="no" display-inline="no-display-inline" id="id6F6BD95819E44C6A83030EF8A3DA4BCB"><enum>(A)</enum><header>In
				general</header><text>Each eligible partnership receiving a grant under this
				part shall, immediately after the receipt of grant funds, enter into a contract
				with an outside evaluator to enable the evaluator to conduct—</text>
											<clause commented="no" display-inline="no-display-inline" id="id63CB3F1163B64160B448EFFF2BCA3868"><enum>(i)</enum><text>an evaluation of
				the effects of the grant after the third year of implementation of the grant;
				and</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="id467E0F625A8B49768BF995A0E1B2BD02"><enum>(ii)</enum><text>an evaluation of
				the effects of the grant after the final year of the grant period.</text>
											</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4E26A8ED64A642DE9C85C84B55B2CCB7"><enum>(B)</enum><header>Distribution</header><text>Upon
				completion of an evaluation described in subparagraph (A), the eligible
				partnership shall submit a copy of the evaluation to the Secretary in a timely
				manner.</text>
										</subparagraph></paragraph></subsection><subsection id="idB0C6C4011D8A498CBB1349891DFA9BDA"><enum>(h)</enum><header>Evaluation;
				best practices</header>
									<paragraph id="id8268CE5ED652437DA8B9F32283FE40BC"><enum>(1)</enum><header>In
				general</header><text>From amounts reserved under subsection (b), the Secretary
				shall—</text>
										<subparagraph id="id69467BC7EBDA4FF094D756EE25EE7B1A"><enum>(A)</enum><text>enter into a
				contract with an outside evaluator to enable the evaluator to conduct—</text>
											<clause id="id132C4ED612C74A618CFEB359E026DF33"><enum>(i)</enum><text>a
				comprehensive evaluation after the third year of implementation on the
				effectiveness of all grants awarded under this part; and</text>
											</clause><clause id="id9A0B812F870E404D889AD6B90F8D39CB"><enum>(ii)</enum><text>a final
				evaluation following the final year of the grant period—</text>
												<subclause id="id4E70C810947748BA9EA672DDC0B23D1F"><enum>(I)</enum><text>with a focus on
				the improvement in student achievement and the indicators described in
				subsection (g)(1) as a result of innovative strategies; and</text>
												</subclause><subclause id="id38FE1E3CD16447618BB1518EE8F69CFD"><enum>(II)</enum><text>to the extent
				practicable, that compares the relative effectiveness of different types of
				programs and compares the relative effectiveness of variations in
				implementation within types of programs; and</text>
												</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6C37904BD66C448F85A0424F7F9E8C01"><enum>(B)</enum><text>disseminate, and
				provide technical assistance regarding, best practices in improving the
				achievement of secondary school students.</text>
										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA8223E7C459D44DDA2AF31097F714B13"><enum>(2)</enum><header>Peer
				review</header>
										<subparagraph commented="no" display-inline="no-display-inline" id="idE3996D4B0A084A13BE5D249ED4ACC908"><enum>(A)</enum><header>In
				general</header><text>An evaluator receiving a contract under this subsection
				shall—</text>
											<clause id="id408B1F6D7AEB4F41910D86A756236FA4"><enum>(i)</enum><text>establish a
				peer-review process to assist in the review and approval of the evaluations
				conducted under this subsection; and</text>
											</clause><clause commented="no" display-inline="no-display-inline" id="ID4fba8bd8db6e403f9117d797a9e11bd8"><enum>(ii)</enum><text>appoint
				individuals to the peer-review process who are educators and experts in—</text>
												<subclause commented="no" display-inline="no-display-inline" id="idF08BCB8CDF6D4E099CA3347E425D8B21"><enum>(I)</enum><text>research and
				evaluation; and</text>
												</subclause><subclause commented="no" display-inline="no-display-inline" id="idF1BDE59FD0F8418FAA9B8CE885D8D14C"><enum>(II)</enum><text>the areas of
				expertise described in subclauses (I) through (VI) of subsection
				(d)(1)(B)(i).</text>
												</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE67F153600364A2EACEB42D50F5AEC6A"><enum>(B)</enum><header>Restrictions on
				use</header><text>The Secretary shall not distribute or use the results of any
				evaluation described in paragraph (1)(A) until the results are peer-reviewed in
				accordance with subparagraph (A).</text>
										</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id24E0C7818ABB42AA92104351D2257D7B"><enum>(i)</enum><header>Continuation of
				funding</header><text>An eligible partnership that receives a grant under this
				part shall only be eligible to receive a grant payment for a fourth or fifth
				year of the grant if the Secretary determines, on the basis of the evaluation
				of the grant under subsection (h)(1)(A)(i), that the performance of the
				eligible partnership under the grant has been satisfactory.</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="id2EA9E7A149AC41DEBC553B84DA4F65A3"><enum>(j)</enum><header>Rule of
				construction regarding discrimination</header><text>Nothing in this section
				shall be construed to permit discrimination on the basis of race, color,
				religion, sex, national origin, or disability in any program or activity funded
				under this part.</text>
								</subsection></section><section id="idE8B43FDC668F4C9A80B26562FC0177CB"><enum>1854.</enum><header>Authorization
				of appropriations</header><text display-inline="no-display-inline">There is
				authorized to be appropriated to carry out this part $500,000,000 for fiscal
				year 2010 and for each of the succeeding 5
				years.</text>
