		<section id="idAF69E7A95D6449F7B6E6A61AA20F58C3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Strategic Petroleum Reserve
			 Modernization Act of 2009</short-title></quote>.</text>
		</section><section id="ID2792c07ab7f34792a8d8fedd38f7cba9" section-type="subsequent-section"><enum>2.</enum><header>Petroleum product
			 reserve</header>
			<subsection id="ID6723db8e493e4a3696b06ef314379b18"><enum>(a)</enum><header>Strategic
			 petroleum reserve</header><text>Section 154(a) of the Energy Policy and
			 Conservation Act (42 U.S.C. 6234(a)) is amended by striking <quote>1 billion
			 barrels of petroleum products</quote> and inserting <quote>1,000,000,000
			 barrels of petroleum products (including at least 30,000,000 barrels of refined
			 petroleum products)</quote>.</text>
			</subsection><subsection id="ID284873d2ceb1432a91838e035344ff36"><enum>(b)</enum><header>Plan</header><text>Title
			 I of the Energy Policy and Conservation Act is amended by inserting after
			 section 154 (42 U.S.C. 6234) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id11B1C422375A45D08AF8135082F4A6D3" style="OLC">
					<section id="ID4da21b2df23e48f7a06cd01f218f3a2a"><enum>155.</enum><header>Plan</header><text display-inline="no-display-inline">Not later than 180 days after the date of
				enactment of this section, the Secretary shall submit to the President and, if
				the President approves, to Congress, a plan to include refined petroleum
				products in the Strategic Petroleum Reserve, including a description of—</text>
						<paragraph id="ID7ab11c32b6384e45a451a52671d32c83"><enum>(1)</enum><text>the disposition
				of refined petroleum products that shall be stored in the Reserve, which shall
				be selected—</text>
							<subparagraph id="ID70589b592ec048c3a8e786c2c4701be6"><enum>(A)</enum><text>to alleviate
				shortages that might be expected to result from hurricanes, earthquakes, or
				other acts of nature; and</text>
							</subparagraph><subparagraph id="ID7ce66f7313394215b2f174dc0e9685fa"><enum>(B)</enum><text>to minimize the
				number of different kinds of refined petroleum products that shall be
				stored;</text>
							</subparagraph></paragraph><paragraph id="ID137937c47f2a473f987a4b9449137636"><enum>(2)</enum><text>the method of
				acquisition of refined petroleum products for storage in the Reserve, which
				shall—</text>
							<subparagraph id="id58E88B56526442DAA00D2CDF117E6CDF"><enum>(A)</enum><text>be intended to
				minimize both the cost and market disruption associated with the acquisition;
				and</text>
							</subparagraph><subparagraph id="id1D084B09F2F3493EB4DDC4FD6DBE7D64"><enum>(B)</enum><text>include—</text>
								<clause id="id40976805BAFF47F08E9DD773252B635F"><enum>(i)</enum><text>an analysis of
				the option of exchanging crude oil from the Reserve for refined petroleum
				products; and</text>
								</clause><clause id="id5CCC1530FB4140AE9AC4205CF80C8341"><enum>(ii)</enum><text>the anticipated
				time requirement for building the inventory of refined petroleum
				products;</text>
								</clause></subparagraph></paragraph><paragraph id="IDe2baaf2e51334cdfad9b31db3ac5c612"><enum>(3)</enum><text>storage facility
				options for the storage of refined petroleum products, including the
				anticipated location of existing or new facilities;</text>
						</paragraph><paragraph id="ID50f65956ad2b428297a90c348e54d57c"><enum>(4)</enum><text>the estimated
				costs of establishment, maintenance, and operation of the refined petroleum
				product component of the Reserve;</text>
						</paragraph><paragraph id="ID9783af56ef9f4cf5b2586c3710eef9c9"><enum>(5)</enum><text>efforts the
				Department will take to ensure that distributors and importers are not
				discouraged from maintaining and increasing supplies of refined petroleum
				products; and</text>
						</paragraph><paragraph id="ID179a66b7b5094f20bd8571735a1c9ecb"><enum>(6)</enum><text>actions that will
				be taken to ensure quality of refined petroleum products in the Reserve,
				including the rotation of products
				stored.</text>
						</paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID362ce2f66c9943c6b2bb4915484e4b93"><enum>(c)</enum><header>Drawdown and
			 sale</header><text>Section 161 of the Energy Policy and Conservation Act (42
			 U.S.C. 6241) is amended—</text>
				<paragraph id="id2FDE46FA12C4414199D0D2D3A54B7ED2"><enum>(1)</enum><text>by striking
			 subsection (d) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id833176A64F8043B7B82B17EBCDFB31F2" style="OLC">
						<subsection id="ID5365df9dbf044486a302bade8e5c6d3d"><enum>(d)</enum><header>Limitation on
				drawdown and sale</header>
							<paragraph id="id7581E5C096644EF996FA3929B0FE7658"><enum>(1)</enum><header>In
				general</header><text>The drawdown and sale of petroleum products from the
				Strategic Petroleum Reserve may not be made unless the Secretary determines
				that—</text>
								<subparagraph id="idBFCBC2928B0C48A5BD1BAABB2A94BB2B"><enum>(A)</enum><text>the drawdown and
				sale are required by—</text>
									<clause id="id6E6D8F2804424C8F92F81F61850F22D9"><enum>(i)</enum><text>a
				severe energy market supply interruption; or</text>
									</clause><clause id="id57C841E7CF964D799BAE8E3A8754B0BC"><enum>(ii)</enum><text>obligations of
				the United States under the international energy program; or</text>
									</clause></subparagraph><subparagraph id="id257E11A7EF3142B5B89C05144FE2CCD1"><enum>(B)</enum><text>in the case of
				the refined petroleum product component of the Reserve, a sale of refined
				petroleum products will mitigate the impacts of weather-related events or other
				acts of nature that have resulted in a severe energy market disruption.</text>
								</subparagraph></paragraph><paragraph id="id0298C704971342689294D587969138C0"><enum>(2)</enum><header>Severe energy
				market disruption</header><text>For purpose of this subsection, a severe energy
				market supply disruption shall be considered to exist if the Secretary
				determines that—</text>
								<subparagraph id="id857E0C8F5ACD4AD0BD97FF0F8CBBB355"><enum>(A)</enum><text>an emergency
				situation exists and there is a disruption in global oil markets of significant
				scope and duration;</text>
								</subparagraph><subparagraph id="id6CFEE9A2B01348CF84417C5A69012A17"><enum>(B)</enum><text>a severe increase
				in the price of petroleum products has resulted, or is likely to result, from
				the emergency situation; and</text>
								</subparagraph><subparagraph id="idC99628B07EE74C85A2ED13DD7257CCAE"><enum>(C)</enum><text>the price
				increase is likely to cause a major adverse impact on the national
				economy.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idF6338E6E14E7465E99173AB6BA36E46C"><enum>(2)</enum><text>in subsections
			 (h)(1) and (i), by striking <quote>President</quote> each place it appears and
			 inserting <quote>Secretary</quote>.</text>
