		  Fund and the Multilateral Debt Relief Initiative, to require budgetary
		  disclosures by multilateral development banks, to encourage multilateral
		  development banks to endorse the principles of the Extractive Industries
		  Transparency Initiative, and for other purposes.</official-title>

		<section id="idBA1A6278172443AD87A80946F82E5B23" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title></short-title><short-title>African Development Fund Replenishment Act of
			 2009</short-title></quote>.</text>
		</section><section id="id8FE628F27E9945A9AAABE3316813B7E8" section-type="subsequent-section"><enum>2.</enum><header>African Development
			 Fund</header><text display-inline="no-display-inline">The African Development
			 Fund Act (22 U.S.C. 290g et seq.) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="idF8FF0016A9E64065819C6F43104BD438" style="OLC">
				<section id="id1C8CD1D1D8F7453E8B612834741E8EAF"><enum>219.</enum><header>Eleventh
				Replenishment</header>
					<subsection id="id25B6F5153CB14BA0B876BCF1CD0891BB"><enum>(a)</enum><header>In
				general</header><text>The United States Governor of the Fund is authorized to
				contribute on behalf of the United States $468,165,000 to the eleventh
				replenishment of the resources of the Fund, subject to obtaining the necessary
				appropriations.</text>
					</subsection><subsection id="id7E6D9C58A9974767804FF6F13AD9E71A"><enum>(b)</enum><header>Authorization
				of appropriations</header><text>In order to pay for the United States
				contribution provided for in subsection (a), there are authorized to be
				appropriated, without fiscal year limitation, $468,165,000 for payment by the
				Secretary of the Treasury.</text>
					</subsection></section><section id="ID509ebccf8a4c42ec9ca1a3048ec686a0"><enum>220.</enum><header>Multilateral
				Debt Relief Initiative</header>
					<subsection id="ID008f59ff99414deca6e1f6e05047ec2d"><enum>(a)</enum><header>In
				general</header><text>The Secretary of the Treasury is authorized to
				contribute, on behalf of the United States, not more than $26,000,000 to the
				African Development Fund for the purpose of funding debt relief under the
				Multilateral Debt Relief Initiative, subject to obtaining the necessary
				appropriations and without prejudice to any funding arrangements in existence
				on the date of the enactment of this section.</text>
					</subsection><subsection id="ID708d276812bc495b8bcbd1341d933324"><enum>(b)</enum><header>Authorization
				of appropriations</header><text>In order to pay for the United States
				contribution provided for in subsection (a), there are authorized to be
				appropriated, without fiscal year limitation, not more than $26,000,000 for
				payment by the Secretary of the Treasury.</text>
					</subsection><subsection id="ID2940463aee09415998b6dbdb06dd3d08"><enum>(c)</enum><header>Multilateral
				Debt Relief Initiative defined</header><text>In this section, the term
				<term>Multilateral Debt Relief Initiative</term> means the proposal set out in
				the G8 Finance Ministers’ Joint Communiqué entitled <quote>Conclusions on
				Development</quote>, London, June 11, 2005, and reaffirmed by G8 Heads of State
				at the Gleneagles Summit on July 8,
				2005.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idB8B5D7EEB42148F6843FB8CD95C9F14E"><enum>3.</enum><header>Budget
			 disclosure and endorsement of Extractive Industries Transparency Initiative by
			 multilateral development banks</header>
			<subsection id="id1E2F3708F6304A7B99083FBF792023D6"><enum>(a)</enum><header>Budgetary
			 disclosure</header>
				<paragraph id="ID5985a399dac74bbb84ddc39aa101bf1b"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of the Treasury shall seek to ensure that
			 each multilateral development bank discloses to member countries the operating
			 budget of the bank, including expenses for staff, consultants, travel, and
			 facilities.</text>
				</paragraph><paragraph id="IDee600dfeea48494cb391a0921d0462f9"><enum>(2)</enum><header>Report</header><text>Not
			 later than December 1, 2009, the Secretary of the Treasury shall submit to
			 Congress a report describing the status of the budget disclosure of each
			 multilateral development bank required by paragraph (1). The report shall
			 contain an assessment of—</text>
					<subparagraph id="idC143ADB93832420DB608C819CB100EB7"><enum>(A)</enum><text>the degree to
			 which each such bank has disclosed the budget of the bank; and</text>
					</subparagraph><subparagraph id="id5D232333A94F4DCB99F99C9355B3FD0A"><enum>(B)</enum><text>how the budget
			 disclosure of each such bank may be improved in order to permit the evaluation
			 of the budget by member countries.</text>
					</subparagraph></paragraph></subsection><subsection id="idDFF4D92C2BE948F29ABEC618CA3A5352"><enum>(b)</enum><header>Endorsement of
			 Extractive Industries Transparency Initiative</header>
				<paragraph id="ID693a98b19e104c799549a448325801c1"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of the Treasury shall direct the United
			 States Executive Director of each multilateral development bank to use the
			 voice and vote of the United States to ensure that the bank—</text>
					<subparagraph id="id758820E9DCD647CEBEA60DF88F6E148E"><enum>(A)</enum><text>endorses the
			 principles of the Extractive Industry Transparency Initiative; and</text>
					</subparagraph><subparagraph id="idC6E23A41FE3E49E29D76DC6E882540FC"><enum>(B)</enum><text>integrates such
			 principles into any project funded by the bank that is related to an extractive
			 industry.</text>
					</subparagraph></paragraph><paragraph id="IDbe33688766d048899cf1217991435901"><enum>(2)</enum><header>Report</header><text>Not
			 later than December 1, 2009, the Secretary of the Treasury shall submit to
			 Congress a report—</text>
					<subparagraph id="idB8CDFCE202AA48D384806E0C164EA41A"><enum>(A)</enum><text>listing each
			 multilateral development bank that has endorsed the principles of the
			 Extractive Industry Transparency Initiative; and</text>
					</subparagraph><subparagraph id="idA4ED5221831949C5AC872EE8388D0D05"><enum>(B)</enum><text>assessing the
			 extent to which each such bank has integrated such principles into the projects
			 of the bank.</text>
					</subparagraph></paragraph></subsection><subsection id="IDdde6dfcb016d4e088f2d207a45a5b2b1"><enum>(c)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="id046729F5C95644FB8C6C086E34B2CD3D"><enum>(1)</enum><header>Multilateral
			 development bank</header><text>The term <term>multilateral development
			 bank</term> has the meaning given that term in section 1307(g) of the
			 International Financial Institutions Act (22 U.S.C. 262m–7(g)).</text>
				</paragraph><paragraph id="idC9E253C00CF94D758F237E4FF3E4B6F9"><enum>(2)</enum><header>Principles of
			 the Extractive Industry Transparency Initiative</header><text>The term
			 <term>principles of the Extractive Industry Transparency Initiative</term>
			 means the principles contained in the Statement of Principles and Agreed
			 Actions of the Extractive Industries Transparency Initiative, agreed to in
			 London June 17, 2003.</text>
