		<official-title>To amend the Federal Water Pollution Control Act to
		  authorize appropriations for sewer overflow control grants.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Water Quality Investment Act of
			 2009</short-title></quote>.</text>
		</section><section id="IDc2e0b09a8a1e46579c8a8793915e312a"><enum>2.</enum><header>Sewer overflow
			 control grants</header>
			<subsection id="id7CA888A9010644E39CBFC3D9693B63DE"><enum>(a)</enum><header>Sewer overflow
			 control grants</header><text display-inline="yes-display-inline">Section 221 of
			 the Federal Water Pollution Control Act (33 U.S.C. 1301) is amended—</text>
				<paragraph id="IDf9115ff958bc4d0abbef1e9c3dae534f"><enum>(1)</enum><text>in subsection
			 (a), by striking <quote><header-in-text level="subsection" style="OLC">In
			 general</header-in-text></quote> and all that follows through <quote>(2)
			 subject to subsection (g), the Administrator may</quote> and inserting the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="idF7B0F447B9824AAE81FFE6E1A52B485B" style="OLC">
						<subsection id="IDfac42dde473844ae8290a1567eca18f1"><enum>(a)</enum><header>In
				general</header><text>The Administrator may—</text>
							<paragraph id="ID8b64d7fd1f8b4a8787199432f2375165"><enum>(1)</enum><text>make grants to
				States for the purpose of providing grants to a municipality or municipal
				entity for planning, design, and construction of treatment works to intercept,
				transport, control, or treat municipal combined sewer overflows and sanitary
				sewer overflows; and</text>
							</paragraph><paragraph id="ID66e4fef6aa24427bb9a0fb55da5f0fef"><enum>(2)</enum><text>subject to
				subsection (g),</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDd84dc562a60843de82cab7f0ba35a581"><enum>(2)</enum><text>by striking
			 subsections (e) through (g) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id4FD2FF1C78FC4F19A0576977B9D0F8B5" style="OLC">
						<subsection id="ID2e88327fc2254ce0865214a35e664bd1"><enum>(e)</enum><header>Administrative
				requirements</header>
							<paragraph id="ID4b10c16b0dc64a14a53f01a20b015041"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), a project that receives grant
				assistance under subsection (a) shall be carried out subject to the same
				requirements as a project that receives assistance from a State water pollution
				control revolving fund established pursuant to title VI.</text>
							</paragraph><paragraph id="ID5fcf768789cf4a1faa38b87a29ae63b5"><enum>(2)</enum><header>Determination
				of Governor</header><text>The requirement described in paragraph (1) shall not
				apply to a project that receives grant assistance under subsection (a) to the
				extent that the Governor of the State in which the project is located
				determines that a requirement described in title VI is inconsistent with the
				purposes of this section.</text>
							</paragraph></subsection><subsection id="ID7655eab7267946529797d77ebe10dc4c"><enum>(f)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated to
				carry out this section, to remain available until expended—</text>
							<paragraph id="ID5993f96845454378ab63963e77abc1a4"><enum>(1)</enum><text>$250,000,000 for
				fiscal year 2010;</text>
							</paragraph><paragraph id="IDca6d9501cc68408d99368ff2c2794a75"><enum>(2)</enum><text>$300,000,000 for
				fiscal year 2011;</text>
							</paragraph><paragraph id="ID93ee83ea1fed487396206e17e47027ba"><enum>(3)</enum><text>$350,000,000 for
				fiscal year 2012;</text>
							</paragraph><paragraph id="ID87678bedaec44de6b12a7b1a70f56494"><enum>(4)</enum><text>$400,000,000 for
				fiscal year 2013; and</text>
							</paragraph><paragraph id="IDad18408c4ac145519e634003ea7f8bdb"><enum>(5)</enum><text>$500,000,000 for
				fiscal year 2014.</text>
							</paragraph></subsection><subsection id="ID57e22c9f4c9d4e6793cea3c5a5f58067"><enum>(g)</enum><header>Allocation of
				funds</header>
							<paragraph id="ID04593c6800ee425cac24f07dc00abe06"><enum>(1)</enum><header>Fiscal years
				2010 and 2011</header><text>For each of fiscal years 2010 and 2011, subject to
				subsection (h), the Administrator shall use the amounts made available to carry
				out this section to provide grants to municipalities and municipal entities
				under subsection (a)(2)—</text>
								<subparagraph id="ID999260c4f5df42afad8b9ac17772f89d"><enum>(A)</enum><text>in accordance
				with the priority criteria described in subsection (b); and</text>
								</subparagraph><subparagraph id="IDad6fddd4b4f54cf5ba1261132d6e7930"><enum>(B)</enum><text>with additional
				priority given to proposed projects that involve the use of—</text>
									<clause id="IDb23813d973624b26ac814b0446f7fb19"><enum>(i)</enum><text>nonstructural,
				low-impact development;</text>
									</clause><clause id="IDb27a43d1a9a94b378cb532d0044b1a10"><enum>(ii)</enum><text>water
				conservation, efficiency, or reuse; or</text>
									</clause><clause id="ID05161cca84b0464b9b190d5e89c0ae53"><enum>(iii)</enum><text>other
				decentralized stormwater or wastewater approaches to minimize flows into the
				sewer systems.</text>
									</clause></subparagraph></paragraph><paragraph id="ID5cc431e559ce467f8cfb840d3d6a5dcb"><enum>(2)</enum><header>Fiscal year
				2012 and thereafter</header><text>For fiscal year 2010 and each fiscal year
				thereafter, subject to subsection (h), the Administrator shall use the amounts
				made available to carry out this section to provide grants to States under
				subsection (a)(1) in accordance with a formula that—</text>
								<subparagraph id="ID7236b142e72348fca4713a55a882bdaa"><enum>(A)</enum><text>shall be
				established by the Administrator, after providing notice and an opportunity for
				public comment;</text>
								</subparagraph><subparagraph id="ID74d13b19ba5c4a6ba819e79d69e9ffdb"><enum>(B)</enum><text>allocates to each
				State a proportional share of the amounts based on the total needs of the State
				for municipal combined sewer overflow controls and sanitary sewer overflow
				controls, as identified in the most recent survey—</text>
									<clause id="IDa455b1143b4c4b5b892faeceaa2a740e"><enum>(i)</enum><text>conducted under
				section 210; and</text>
									</clause><clause id="ID142a89cf5cc84d43b32cfac8de77087a"><enum>(ii)</enum><text>included in a
				report required under section 516(b)(1)(B); and</text>
									</clause></subparagraph><subparagraph id="IDfb67bfc8c3f64ab682c70dc0177cebb7"><enum>(C)</enum><text>gives additional
				grant priority to States that propose to carry out projects that involve the
				use of—</text>
									<clause id="IDbffc315d363a4ed3a6719d0263a93aef"><enum>(i)</enum><text>nonstructural,
				low-impact development;</text>
									</clause><clause id="ID7b0edc96c107404e8ecc27ad505ad089"><enum>(ii)</enum><text>water
				conservation, efficiency, or reuse; or</text>
									</clause><clause id="IDe2b1906b231e4e7a9714ca329f004ea1"><enum>(iii)</enum><text>other
				decentralized stormwater or wastewater approaches to minimize flows into the
				sewer
				systems.</text>
									</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="IDf305a72b15d5450caeec568c190087e7"><enum>(b)</enum><header>Reports</header><text>Section
			 221(i) of the Federal Water Pollution Control Act (33 U.S.C. 1301(i)) is
			 amended in the first sentence by striking <quote>2003</quote> and inserting
			 <quote>2010</quote>.</text>
