		<section id="id5AD01EE0316845D4B24F1417627820AB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>TARP Accountability Act of
			 2009</short-title></quote>.</text>
		</section><section id="idFF1C23BF8B104C40A261332E79219500"><enum>2.</enum><header>Enhanced
			 reporting on use of TARP funds</header><text display-inline="no-display-inline">Section 105 of the Emergency Economic
			 Stabilization Act of 2008 (12 U.S.C. 5215(a)) is amended—</text>
			<paragraph id="id82AA4FBA323443829FECBE4A3B86D5DC"><enum>(1)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="IDcc263601b1c84483899ce7adcd736c59"><enum>(A)</enum><text>in paragraph (2),
			 by striking <quote>and</quote> at the end;</text>
				</subparagraph><subparagraph id="IDd8282d3205b94f1a92c8e1df631548e5"><enum>(B)</enum><text>in paragraph (3),
			 by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
				</subparagraph><subparagraph id="IDfec4723fbf424972b324c5b2ef706b9a"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id2A62838BE6C94D46857DED29B069C83F" style="OLC">
						<paragraph id="ID6405cdfd96b84c09896b9f2fe29e95de"><enum>(4)</enum><text>a detailed report
				on the use of capital investments by each financial institution,
				including—</text>
							<subparagraph id="ID3d80ee80d3c044feb23fb3dc6b3c11b7"><enum>(A)</enum><text>a narrative
				response, in a form and on a date to be established by the Secretary,
				specifically outlining, with respect to the financial institution—</text>
								<clause id="ID3bfcfe6e6a184526a43af2c7390ea0e7"><enum>(i)</enum><text>the original
				intended use of the TARP funds;</text>
								</clause><clause id="ID7f9e66acad704f59bc888666cfbcba28"><enum>(ii)</enum><text>whether the TARP
				funds are segregated from other institutional funds;</text>
								</clause><clause id="ID9ea3918c4c4d41529db4b88dd7d4cf8a"><enum>(iii)</enum><text>the actual use
				of the TARP funds to date;</text>
								</clause><clause id="IDdee9546912e845cd91f47e3cf283cbb5"><enum>(iv)</enum><text>the amount of
				TARP funds retained for the purpose of recapitalization; and</text>
								</clause><clause id="ID869fc2646c884e7abbbb5c58379bbf29"><enum>(v)</enum><text>the expected use
				of the remainder of the TARP funds;</text>
								</clause></subparagraph><subparagraph id="ID71b524e9fff04732827c2a2fb0cd9c51"><enum>(B)</enum><text>information
				compiled by the Secretary under subsection (b); and</text>
							</subparagraph><subparagraph id="IDa91cd2adc4ed405595c41793231c16eb"><enum>(C)</enum><text>a report, in a
				form and on a date to be established by the Secretary, on the compliance by the
				financial institution with the restrictions on dividends, stock repurchases,
				and executive compensation under the Security Purchase Agreement and executive
				compensation guidelines of the Department of
				Treasury.</text>
							</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="id1425938D67494CDA98097A035AE51F21"><enum>(2)</enum><text>by redesignating
			 subsections (b) through (e) as subsections (c) through (f), respectively;
			 and</text>
			</paragraph><paragraph id="id606D796294B5408D90C171EEFBD218F2"><enum>(3)</enum><text>by inserting
			 after subsection (a) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id3D0737A75F734AC4B596F8519C624077" style="OLC">
					<subsection id="id6B31CABE8E2A468A8EAE10A91357EB24"><enum>(b)</enum><header>Information
				provided by financial institutions</header>
						<paragraph id="id00B79B297FE84E59B96BEC9B4BA26510"><enum>(1)</enum><header>In
				general</header><text>For purposes of the report of the Secretary required by
				subsection (a)(4), financial institutions assisted under this title shall
				provide to the Secretary the information required by paragraph (2), at such
				times and in such manner as the Secretary shall establish.</text>
						</paragraph><paragraph id="id427EF2E257E845BB9559F41E0831F65A"><enum>(2)</enum><header>Information
				required</header><text>Information required by this paragraph is—</text>
							<subparagraph id="id4C5180DED5F24525806A68390C7E87A4"><enum>(A)</enum><text>for those
				financial institutions receiving $1,000,000,000 or more from the Capital
				Purchase Program established by the Secretary (or any successor thereto), a
				monthly lending and intermediation snapshot, as of a date to be established by
				the Secretary, which shall include—</text>
								<clause id="ID304bbdacd326482f8496a4f619cec60a"><enum>(i)</enum><text>quantitative
				information, as well as commentary, to explain changes in lending levels for
				each category on consumer lending, including first mortgages, home equity lines
				of credit, open end credit plans (as that term is defined in section 103 of the
				Truth in Lending Act (15 U.S.C. 1602)), and other consumer lending;</text>
								</clause><clause id="ID74743fb12fc04a879cd8c2b42f86e5dc"><enum>(ii)</enum><text>quantitative
				information, as well as commentary, to explain changes in lending levels for
				each category on commercial lending, including commercial and industrial
				(C&amp;I) lending and real estate;</text>
								</clause><clause id="IDb6d79b4d7b524253950916f528229aeb"><enum>(iii)</enum><text>quantitative
				information, as well as commentary, to explain changes in lending levels for
				each category on other lending activities, including mortgage-backed
				securities, asset-backed securities, and other secured lending; and</text>
								</clause><clause id="ID1ee94b362cd5400a8a7f945981b64b41"><enum>(iv)</enum><text>a narrative
				report of the intermediation activity during the reporting period, including a
				general commentary on the lending environment, loan demand, any changes in
				lending standards and terms, and any other intermediation activity; and</text>
								</clause></subparagraph><subparagraph id="IDa544a4589f06422a8426b41f1f5daeb3"><enum>(B)</enum><text>for those
				financial institutions receiving less than $1,000,000,000 from the Capital
				Purchase Program established by the Secretary (or any successor thereto), a
				lending and intermediation snapshot, as of a date to be established by the
				Secretary, but not more frequently than once every 90 days, including the
				information described in clauses (i) through (iv) of subparagraph (A).</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7C3D26E5F4084B87ABACF95D3B355E2F"><enum>(3)</enum><header>Certification
				required</header><text display-inline="yes-display-inline">The information
				submitted to the Secretary under this subsection shall be signed by a duly
				authorized senior executive officer of the financial institution, including a
				statement certifying the accuracy of all statements, representations, and
				supporting information provided, and such certifications shall be included in
				the reports submitted by the Secretary under subsection
				(a)(4).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
