		<section id="H334E223F189342F69C47055389BA4220" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Marine Renewable Energy Promotion Act
			 of 2009</short-title></quote>.</text>
		</section><section id="H60B319E744F248B4A0AE18DD8AD53795" section-type="subsequent-section"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id7535A610C31B4AC08461817D3A9F175C"><enum>(1)</enum><header>Fund</header><text>The
			 term <term>Fund</term> means the Adaptive Management and Environmental Fund
			 established by section 3(c).</text>
			</paragraph><paragraph id="id2B8F1F40086A4D03BD33324E2D68CF20"><enum>(2)</enum><header>Marine
			 renewable energy</header><text display-inline="yes-display-inline">The term
			 <term>marine renewable energy</term> means energy from—</text>
				<subparagraph id="H36F36A6008E143F08385A0905B944760"><enum>(A)</enum><text>waves, tides, and
			 currents in oceans, estuaries, and tidal areas;</text>
				</subparagraph><subparagraph id="H66586C4AC5E6496BA9C1AB942060B4C3"><enum>(B)</enum><text>free flowing water
			 in rivers, lakes, man made channels, and streams; and</text>
				</subparagraph><subparagraph id="H5C145CCFEC0843A0B7A75305676BF062"><enum>(C)</enum><text>differentials in
			 ocean temperature or ocean thermal energy conversion.</text>
				</subparagraph></paragraph><paragraph id="id1B54F8A822FE44C08FABA7DA25829233"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Energy.</text>
			</paragraph></section><section id="H507F7130516846D1A06C1D00BA663BCD"><enum>3.</enum><header>Marine renewable
			 energy research and development</header>
			<subsection id="H3C24D22C4165444C9200A822EC965CF"><enum>(a)</enum><header>Research and
			 development program</header>
				<paragraph id="id7B14FBF3C8264B12938CFBEDD1D26E8C"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall establish a marine renewable energy
			 research and development program that is focused on—</text>
					<subparagraph id="H226BA39CEF7F4904B250A712CF308FC2"><enum>(A)</enum><text>developing new
			 marine renewable energy technologies;</text>
					</subparagraph><subparagraph id="H266032F9632140B09C55663316FD43D0"><enum>(B)</enum><text>reducing the
			 manufacturing and operation costs of marine renewable energy
			 technologies;</text>
					</subparagraph><subparagraph id="H28E46CAB8A7642EA8CBE46A67E34107D"><enum>(C)</enum><text>increasing the
			 reliability and survivability of marine renewable energy facilities;</text>
					</subparagraph><subparagraph id="H625415514FF047FDA34B26B7594BC697"><enum>(D)</enum><text>integrating marine
			 renewable energy into the national electric grid;</text>
					</subparagraph><subparagraph id="H0219F7F605BB4238AB5C7908ED435864"><enum>(E)</enum><text>identifying
			 opportunities for cross-pollination and development of economies of scale
			 between offshore wind and marine renewable energy sources;</text>
					</subparagraph><subparagraph id="H6135D92E36F246258EDFD87893939EC4"><enum>(F)</enum><text>identifying the
			 environmental impacts of marine renewable energy and ways to address any
			 negative impacts; and</text>
					</subparagraph><subparagraph id="H0361B5AC036646C2903CCE3BB96DF117"><enum>(G)</enum><clause commented="no" display-inline="yes-display-inline" id="id6EC31CA86C254D059C756F94EA2ED26D"><enum>(i)</enum><text>applying advanced
			 systems engineering and system integration methods to identify critical
			 interfaces and develop open standards for marine renewable energy;</text>
						</clause><clause id="idB233F9BBAB3A404E8A95A93F25E881A6" indent="up1"><enum>(ii)</enum><text>transferring the resulting
			 intellectual property to industry stakeholders as public information through
			 published interface definitions, standards, and demonstration projects;
			 and</text>
						</clause><clause id="idF7F7DC83AA1D437A995CA8A33288F110" indent="up1"><enum>(iii)</enum><text>developing incentives for
			 industry to comply with the standards.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id80398843C96A49FCB5064741FDDB7840"><enum>(2)</enum><header>Administration</header><text>The
			 program established under paragraph (1) shall be separate from any wind and
			 hydropower program carried out by the Secretary.</text>
				</paragraph></subsection><subsection commented="no" id="HEC325A8594F744689548897CA6922527"><enum>(b)</enum><header>Marine-based
			 energy device verification program</header>
				<paragraph id="HAD14EAB0CBA544C48156BFB5FC377600"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a
			 marine-based energy device verification program to provide a bridge from the
			 wave, tidal, current, or thermal energy capture device design and development
			 efforts underway across the industry to commercial deployment of marine
			 renewable energy devices.</text>
				</paragraph><paragraph id="HA839CF8EFA034DBAB24B12A4FBF698A9"><enum>(2)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of the program are to fund,
			 facilitate the development and installation of, and evaluate marine renewable
			 energy projects, in partnership with the Electric Power Research Institute, the
			 National Renewable Energy Laboratory, the Pacific Northwest National Laboratory
			 Marine Sciences Laboratory, and the Sandia National Laboratories, and in
			 conjunction with universities and other institutions of higher education,
			 private business entities, and other appropriate organizations, in
			 order—</text>
					<subparagraph id="H833829C683EA419384684C95D7DB69E5"><enum>(A)</enum><text>to increase marine
			 renewable energy experience; and</text>
					</subparagraph><subparagraph id="HBD1EB891BE1745AF801555FF39ABB8E7"><enum>(B)</enum><text>to build and
			 operate enough candidate devices to obtain statistically significant operating
			 and maintenance data.</text>
					</subparagraph></paragraph><paragraph id="HAF0287A3EC9C48AD9C00DDB8338C59EB"><enum>(3)</enum><header>Objectives</header><text display-inline="yes-display-inline">The objectives of the program
			 include—</text>
					<subparagraph id="H6ECFA7024FD64BB0B0B57090856A175"><enum>(A)</enum><text>verifying the
			 performance, reliability, maintainability, and cost of new marine renewable
			 energy device designs and system components in an operating environment;</text>
					</subparagraph><subparagraph id="HA64839687C71403CB4D5510150EC9B01"><enum>(B)</enum><text>providing States,
			 regulators, utilities, and other stakeholders with a valid opportunity to test
			 and evaluate marine renewable energy technology in new areas;</text>
					</subparagraph><subparagraph id="HFA00159734BE4C9DB0AE30800E01766"><enum>(C)</enum><text>documenting and
			 communicating the experience from those projects for the benefit of utilities,
			 independent power producers, other nonutility generators, device suppliers, and
			 others in the marine renewable energy development community; and</text>
					</subparagraph><subparagraph id="id54DFF8DCE65940CFBE06C349F7839E82"><enum>(D)</enum><text>resolving
			 environmental issues through robust characterization, reliable impact
			 prediction, effective monitoring, development and use of adaptive management,
			 and informing engineering design to improve environmental performance.</text>
					</subparagraph></paragraph></subsection><subsection id="H36B90584917F49CCA7844BADA7B679EA"><enum>(c)</enum><header>Adaptive
			 Management and Environmental Fund</header>
				<paragraph id="HA0A4D025615148ACA5D9F2892F96343D"><enum>(1)</enum><header>Findings</header><text>Congress
			 finds that—</text>
					<subparagraph id="H86CA616B395A4B08949DC39D59F2433F"><enum>(A)</enum><text>the use of marine
			 renewable energy technologies can reduce contributions to global
			 warming;</text>
					</subparagraph><subparagraph id="id8C07244CE9454E3C86F8B546F99134AC"><enum>(B)</enum><text>marine renewable
			 energy technologies can be produced domestically;</text>
					</subparagraph><subparagraph id="HCAC8A7F84FE9402EAC35DAD6D651892F"><enum>(C)</enum><text>marine renewable
			 energy is a nascent industry; and</text>
					</subparagraph><subparagraph id="H1A357A4B0C5B48A49319D4B2CB76DAB8"><enum>(D)</enum><text>the United States
			 must work to promote new renewable energy technologies that reduce
			 contributions to global warming gases and improve domestic energy
			 production.</text>
					</subparagraph></paragraph><paragraph id="H67A26F87EB4F4123801326ED930539F3"><enum>(2)</enum><header>Fund</header>
					<subparagraph id="IDB87E6EB3E15A423C9459B522069F2D1F"><enum>(A)</enum><header>Establishment</header><text>There
			 is established in the Treasury of the United States a revolving fund, to be
			 known as the <quote>Adaptive Management and Environmental Fund</quote>,
			 consisting of such amounts as are appropriated to the Fund under subsection
			 (d).</text>
					</subparagraph><subparagraph id="ID72CBA45BD1F440E4B3F4FD55F33AAC30"><enum>(B)</enum><header>Expenditures
			 from Fund</header>
						<clause id="ID1475BB464CDB4E84B16FFDF76CB44B9B"><enum>(i)</enum><header>In
			 general</header><text>Subject to clause (ii), on request by the Secretary, the
			 Secretary of the Treasury shall transfer from the Fund to the Secretary such
			 amounts as the Secretary determines are necessary to provide grants to eligible
			 entities to assist the entities in complying with Federal, State, or local
			 regulatory permit requirements through assessment and demonstration of the
			 environmental effects of marine renewable energy projects (including
			 environmental studies, design, fabrication, deployment, operating, monitoring,
			 environmental mitigation, and decommissioning costs).</text>
						</clause><clause id="ID9724CABDFFA844AE9AEFD47A75CBECA6"><enum>(ii)</enum><header>Administrative
			 expenses</header><text>An amount not exceeding 10 percent of the amounts in the
			 Fund shall be available for each fiscal year to pay the administrative expenses
			 necessary to carry out this subsection.</text>
						</clause></subparagraph><subparagraph id="ID990781DF86FA4B5A8ADACB8C3C4C49B3"><enum>(C)</enum><header>Transfers of
			 amounts</header>
						<clause id="IDEA15210E59234B4AB0176880E4E2B3F6"><enum>(i)</enum><header>In
			 general</header><text>The amounts required to be transferred to the Fund under
			 this paragraph shall be transferred at least monthly from the general fund of
			 the Treasury to the Fund on the basis of estimates made by the Secretary of the
			 Treasury.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDCF3824F211E742E7A61FAAF06623B01E"><enum>(ii)</enum><header>Adjustments</header><text>Proper
			 adjustment shall be made in amounts subsequently transferred to the extent
			 prior estimates were in excess of or less than the amounts required to be
			 transferred.</text>
						</clause></subparagraph></paragraph><paragraph id="H867D889B06C34E759CD75E006E373BEF"><enum>(3)</enum><header>Eligibility</header>
					<subparagraph id="id24BB2EEDD43B4113B883CD5F0ABF97C0"><enum>(A)</enum><header>In
			 general</header><text>To be eligible for a grant under this subsection, an
			 entity shall provide to the Secretary a regulatory permit that includes
			 conditions for the removal of the marine renewable energy project supported by
			 the grant if the permitting authority finds that the marine renewable energy
			 project has an unacceptable adverse impact on the environment.</text>
					</subparagraph><subparagraph id="idE7036BEB7A6E48E396FF2E3E02CC32DD"><enum>(B)</enum><header>Administration</header><text>A
			 marine renewable energy project shall not be required to be removed in the
			 absence of a finding by the permitting authority that the project has an
			 unacceptable adverse impact.</text>
					</subparagraph></paragraph><paragraph id="HAACF040876C249E8B51BEE1CD632E9DF"><enum>(4)</enum><header>Public
			 availability</header><text>The results of any assessment or demonstration
			 conducted under this subsection shall be made available to the public, except
			 to the extent that the assessment or demonstration contains information that is
			 protected from disclosure under section 552(b) of title 5, United States
			 Code.</text>
				</paragraph><paragraph id="HB90C7DA617294CDB93C6D4276BF4285D"><enum>(5)</enum><header>Audit
			 requirements</header>
					<subparagraph id="id18F38E8CAC2A430E8400F2D531F6BD80"><enum>(A)</enum><header>In
			 general</header><text>Any entity that receives a grant under this subsection
			 shall—</text>
						<clause id="id5C2D3333587341339609D98429C62518"><enum>(i)</enum><text>track the use of
			 grant funds from the Fund; and</text>
						</clause><clause id="id4954FD173A444F7CB1004855CF9D6F9D"><enum>(ii)</enum><text>certify annually
			 to the Secretary that the grant funds were used only for purposes authorized
			 under this subsection.</text>
						</clause></subparagraph><subparagraph id="id47CB0B507A56450785996ECC8432E6AE"><enum>(B)</enum><header>Procedures</header><text>The
			 Secretary shall establish procedures to ensure that the Secretary is able to
			 oversee and audit the use of funds by eligible entities.</text>
					</subparagraph><subparagraph id="idCD29BB6362E54F8EA2C68483F728E96C"><enum>(C)</enum><header>Annual
			 audits</header><text>The Secretary shall conduct an audit, at least annually,
			 of the use of grant funds received under this subsection by each eligible
			 entity.</text>
					</subparagraph><subparagraph id="id70395E5F7F7F495AB783DE74F424D35E"><enum>(D)</enum><header>Ineligibility</header><text>The
			 Secretary may declare an entity ineligible for a grant under this subsection on
			 a finding of inappropriate use of funding.</text>
					</subparagraph></paragraph><paragraph id="H4EC24418108F42E7BA035122B918E4E9"><enum>(6)</enum><header>Sunset
			 provision</header>
					<subparagraph id="id1859221A8C4443C395910B9E3E586EF4"><enum>(A)</enum><header>Report</header><text>The
			 Secretary shall submit a report to the appropriate committees of Congress if
			 the Secretary determines that the technologies and activities supported under
			 this subsection have achieved a level of maturity that is sufficient to enable
			 the program authorized under this subsection to cease.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3D8E7A5E425242CBA78AEDB4F1C85FFA"><enum>(B)</enum><header>Termination</header><text>The
			 program authorized under this subsection and the Fund shall cease to exist
			 effective on the date of submission of a report described in subparagraph
			 (A).</text>
					</subparagraph></paragraph><paragraph id="HDD80532B19E14681A06B44ABA4C54C6E"><enum>(7)</enum><header>Administration</header><text>The
			 Secretary may use amounts in the Fund to provide assistance to State resource
			 agencies that are processing applications for permits required for marine
			 renewables projects that have received assistance from the Fund to assist staff
			 with understanding and evaluating applications and participating in the
			 applicable Federal Energy Regulatory Commission or Minerals Management Service
			 regulatory process.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HC2944BD01DD94DA2913443AC7B935B8"><enum>(8)</enum><header>Environmental
			 requirement</header><text>Nothing in this section eliminates or otherwise
			 affects any requirement imposed under the <act-name parsable-cite="NEPA69">National Environmental Policy Act of 1969</act-name> (42
			 U.S.C. 4321 et seq.).</text>
				</paragraph></subsection><subsection id="IDfc8b909e231e4d18b5ad838ae52c7d99"><enum>(d)</enum><header>Authorization
			 of appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $250,000,000 for each of fiscal years 2010 through
			 2021.</text>
