		  agency, to sponsor promising translational research to bridge the gap between
		  laboratory discoveries and life-saving therapies, to reauthorize the National

		<section id="ID98A9ECE41EBA4E479CCD146501F97404" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Cures Acceleration Network and
			 National Institutes of Health Reauthorization Act of
			 2009</short-title></quote>.</text>
		</section><section id="idF66BFDAB3CF74841B10DDF1D9ACABF23"><enum>2.</enum><header>Cures
			 Acceleration Network</header>
			<subsection id="id26702A9EED854FFEB1FE6A6652B8C2F2"><enum>(a)</enum><header>Definitions</header><text>In
			 this section—</text>
				<paragraph id="id469E05BEADB749ACA16D87F49AA60B7A"><enum>(1)</enum><text>the term
			 <term>medical product</term> means a drug, device, biological product, or
			 product that is a combination of drugs, devices, and biological
			 products;</text>
				</paragraph><paragraph id="id70B8D8DFC1D549C9AD02ADF271682785"><enum>(2)</enum><text>the terms
			 <term>drug</term> and <term>device</term> have the meanings given such terms in
			 section 201 of the Federal Food, Drug, and Cosmetic Act; and</text>
				</paragraph><paragraph id="id0B54219007BB4CFBB6B35872CEFB0D11"><enum>(3)</enum><text>the term
			 <term>biological product</term> has the meaning given such term in section 351
			 of the Public Health Service Act.</text>
				</paragraph></subsection><subsection id="id0699F42C9BD748FFA15D8D99DE74B977"><enum>(b)</enum><header>Establishment
			 of the Cures Acceleration Network</header><text>There is established an
			 independent agency to be known as the Cures Acceleration Network (referred to
			 in this section as <quote>CAN</quote>), which shall—</text>
				<paragraph id="idB29E9A1C336C4298ACA247BBFA0EF269"><enum>(1)</enum><text>be under the
			 direction of a CAN Review Board (referred to in this section as the
			 <quote>Board</quote>), described in subsection (d); and</text>
				</paragraph><paragraph id="idC9BADC52F55B4894B94B5BB79F0E204D"><enum>(2)</enum><text>award grants and
			 contracts to eligible entities, as described in subsection (e), to accelerate
			 the development of cures and treatments of diseases, including through the
			 development of medical products and behavioral therapies.</text>
				</paragraph></subsection><subsection id="id2DCD5979832E4E02AB39817531943813"><enum>(c)</enum><header>Functions</header><text>The
			 functions of the CAN are to—</text>
				<paragraph id="id220401582D23434F905BFADAAE8C35EB"><enum>(1)</enum><text>identify and
			 promote revolutionary advances in basic research, translating scientific
			 discoveries from bench to bedside;</text>
				</paragraph><paragraph id="id4A54D8F075E54C199612611AE36330A7"><enum>(2)</enum><text>award grants and
			 contracts to eligible entities;</text>
				</paragraph><paragraph id="id96EEA699E761466899F86DCC7F460F08"><enum>(3)</enum><text>provide the
			 resources through grants and contracts necessary for independent investigators,
			 research organizations, biotechnology companies, academic research
			 institutions, and other entities to develop medical products for the treatment
			 and cure of diseases and disorders;</text>
				</paragraph><paragraph id="id9687226B0C63499188090EF0D2C4D511"><enum>(4)</enum><text>reduce the
			 barriers between laboratory discoveries and clinical trials for new
			 therapies;</text>
				</paragraph><paragraph id="id093144C1BBB14039AF085E81754FD598"><enum>(5)</enum><text>facilitate
			 priority review in the Food and Drug Administration for the medical products
			 funded by the CAN; and</text>
				</paragraph><paragraph commented="no" id="id7D294B252F444DC9AD4234522829F2ED"><enum>(6)</enum><text>accept donations,
			 bequests, and gifts to the CAN.</text>
				</paragraph></subsection><subsection id="id538BD88481EB4B38B115ECD2B67507BE"><enum>(d)</enum><header>CAN
			 Board</header>
				<paragraph id="id85C86897E6754775BEC365C1AB7DEEA8"><enum>(1)</enum><header>Establishment</header><text>There
			 is established a Cures Acceleration Network Review Board (referred to in this
			 section as the <quote>Board</quote>), which shall direct the activities of the
			 Cures Acceleration Network.</text>
				</paragraph><paragraph id="id32C077F277B549B19E5AA8579B95EACC"><enum>(2)</enum><header>Membership</header>
					<subparagraph id="idEA9DC6142AE842AEAEDE41C0DA775A38"><enum>(A)</enum><header>In
			 general</header>
						<clause id="id645D060FA58A4C15BCE4BFB156D0BFC9"><enum>(i)</enum><header>Appointment</header><text>The
			 Board shall be comprised of 24 members who are appointed by the President and
			 who serve at the pleasure of the President.</text>
						</clause><clause id="idA03D7D0BA2BF49A287F2A3486C6F6FF5"><enum>(ii)</enum><header>Chairperson
			 and Vice Chairperson</header><text>The President, by and with the advice and
			 consent of the Senate, shall designate, from among the 24 members appointed
			 under clause (i), one Chairperson of the Board (referred to in this section as
			 the <quote>Chairperson</quote>) and one Vice Chairperson.</text>
						</clause></subparagraph><subparagraph id="idFE43BE54DF5944AEAF691FE51A0524F0"><enum>(B)</enum><header>Terms</header>
						<clause id="id640A21CA593E47E5A14F980701CB6AAB"><enum>(i)</enum><header>In
			 general</header><text>Each member shall be appointed to serve a 4-year term,
			 except that any member appointed to fill a vacancy occurring prior to the
			 expiration of the term for which the member's predecessor was appointed shall
			 be appointed for the remainder of such term.</text>
						</clause><clause id="id8BFCA45FB98D49A5A2AB368E8954F54B"><enum>(ii)</enum><header>Consecutive
			 appointments; maximum terms</header><text>A member may be appointed to serve
			 not more than 3 terms on the Board, and may not serve more than 2 such terms
			 consecutively.</text>
						</clause></subparagraph><subparagraph id="idD622BADFC7534FA1979C87C9430F5395"><enum>(C)</enum><header>Qualifications</header>
						<clause id="id93F635FD69234CD193169B0A081F2664"><enum>(i)</enum><header>In
			 general</header><text>The President shall appoint individuals to the Board
			 based solely upon the individual's established record of distinguished service
			 in one of the areas of expertise described in clause (ii). Each individual
			 appointed to the Board shall be of distinguished achievement and have a broad
			 range of disciplinary interests.</text>
						</clause><clause id="id9E4B3917076E402DA78D1F334440C8DA"><enum>(ii)</enum><header>Expertise</header><text>The
			 President shall select individuals based upon the following
			 requirements:</text>
							<subclause id="id3F697EF0A9B141A180D259AA10AC629D"><enum>(I)</enum><text>For each of the
			 fields of—</text>
								<item id="idDE56CB149AF6449E96EE58DD6B901FF6"><enum>(aa)</enum><text>basic
			 research;</text>
								</item><item id="id3D17D7F0696D4F0489D6E63BAD5B41E5"><enum>(bb)</enum><text>medicine;</text>
								</item><item id="idB2E345D2DA314B17A83A780D9D11CFA7"><enum>(cc)</enum><text>biopharmaceuticals;</text>
								</item><item id="id9FB4874F6BFB449C9B10D6E8830E5997"><enum>(dd)</enum><text>discovery and
			 delivery of medical products;</text>
								</item><item id="idEFC7F06F2E644125B58E096505EC944F"><enum>(ee)</enum><text>bioinformatics
			 and gene therapy;</text>
								</item><item id="id8B200F625D9E468FB4A09E688887D839"><enum>(ff)</enum><text>medical
			 instrumentation; and</text>
								</item><item id="id7B064A76D55D4CD78AB4127068E8F0FC"><enum>(gg)</enum><text>regulatory
			 review and approval of medical products,</text>
								</item><continuation-text continuation-text-level="subclause">the
			 President shall select at least 1 individual who is eminent in such
			 fields.</continuation-text></subclause><subclause id="idDA65D1C09FAF47118643290D11B6AAC4"><enum>(II)</enum><text>At least 4
			 individuals shall be recognized leaders in professional venture capital or
			 private equity organizations and have demonstrated experience in private equity
			 investing.</text>
							</subclause><subclause id="idD5F1BB5C5FAD451C8ABCFACD12BB76B5"><enum>(III)</enum><text>At least 8
			 individuals shall represent disease advocacy organizations.</text>
							</subclause></clause></subparagraph></paragraph><paragraph id="id639103D113B943E495AB1B59B4C0B2F4"><enum>(3)</enum><header>Ex-officio
			 members</header>
					<subparagraph id="idB06D1204F7634C30A21957823FD8FB3C"><enum>(A)</enum><header>Appointment</header><text>In
			 addition to the 24 Board members described in paragraph (2), the President
			 shall appoint as ex-officio members of the Board—</text>
						<clause id="id19688521CC294224954E52FDEA1E16C1"><enum>(i)</enum><text>a
			 representative of the National Institutes of Health, recommended by the
			 Secretary of the Department of Health and Human Services;</text>
						</clause><clause id="id5CAD1AE031C748F5820B70255817AD26"><enum>(ii)</enum><text>a
			 representative of the Office of the Assistant Secretary of Defense for Health
			 Affairs, recommended by the Secretary of Defense;</text>
						</clause><clause id="idF07A60842CD74E4BAF1EF1D812EA0DFE"><enum>(iii)</enum><text>a
			 representative of the Office of the Under Secretary for Health for the Veterans
			 Health Administration, recommended by the Secretary of Veterans Affairs;</text>
						</clause><clause id="id09BC22B518854E5780FCC90B45E2AA02"><enum>(iv)</enum><text>a
			 representative of the National Science Foundation, recommended by the Chair of
			 the National Science Board; and</text>
						</clause><clause id="idF679503D7249436CA2A55B65F3BBEDF6"><enum>(v)</enum><text>a
			 representative of the Food and Drug Administration, recommended by the
			 Commissioner of Food and Drugs.</text>
						</clause></subparagraph><subparagraph commented="no" id="idEDC324B6237D47408E40C408A2919EBC"><enum>(B)</enum><header>Terms</header><text>Each
			 ex-officio member shall serve a 3-year term on the Board, except that the
			 Chairperson may adjust the terms of the initial ex-officio members in order to
			 provide for a staggered term of appointment for all such members.</text>
					</subparagraph></paragraph><paragraph id="id4776DD7CFCF64011BAC91E6C13F2B597"><enum>(4)</enum><header>Responsibilities
			 of the Board</header><text>The Board shall—</text>
					<subparagraph id="id1F0E9353570C4EAC8D64369C48759BDF"><enum>(A)</enum><text>advise the
			 Chairperson with respect to policies, programs, and procedures for carrying out
			 the Chairperson's duties; and</text>
					</subparagraph><subparagraph id="id71376F2C4396401C9AE5FE8BF37ABD0D"><enum>(B)</enum><text>review
			 applications for grants and contracts under subsection (e) and make
			 recommendations to the Chairperson.</text>
					</subparagraph></paragraph><paragraph id="id0F66021C657247389DAA09040936A0C4"><enum>(5)</enum><header>Authority of
			 the Chairperson</header><text>The Chairperson may—</text>
					<subparagraph id="id8A97EB37B7824D129CA09C661BF5BD57"><enum>(A)</enum><text>prescribe
			 regulations regarding the manner in which the Chairperson's duties shall be
			 carried out, as the Chairperson determines necessary;</text>
					</subparagraph><subparagraph id="id240BA2FCE5934687937D6F475FA3BC9C"><enum>(B)</enum><text>appoint
			 employees, subject to civil service laws, as necessary to carry out the
			 Chairperson’s functions;</text>
					</subparagraph><subparagraph id="id5800C734324D4235ADCAF0F312961877"><enum>(C)</enum><text>define the
			 duties, and supervise and direct the activities, of any employees appointed
			 under subparagraph (B);</text>
					</subparagraph><subparagraph id="id1D4820A45B3A41C693CE77999948179C"><enum>(D)</enum><text>use experts and
			 consultants, including a panel of experts who may be employed as authorized by
			 section 3109 of title 5, United States Code;</text>
					</subparagraph><subparagraph id="idF5C53C31BD854633BCC6425D57CFE918"><enum>(E)</enum><text>accept and
			 utilize the services of voluntary and uncompensated personnel and reimburse
			 such personnel for travel expenses, as described in paragraph (7)(B);</text>
					</subparagraph><subparagraph id="id6B1C66F434E94A23A0ECCE41FBD9D371"><enum>(F)</enum><text>make advance,
			 progress, or other payments without regard to section 3324 of title 31, United
			 States Code;</text>
					</subparagraph><subparagraph id="idBA7464E283AC44129BBC4FDD76063F01"><enum>(G)</enum><text>rent office space
			 in the District of Columbia for use by the CAN;</text>
					</subparagraph><subparagraph id="id4FF5F0B805F54AE89FCF0F25DD3FA4AC"><enum>(H)</enum><text>enter into
			 agreements with other Federal agencies to carry out oversight of the grant
			 program under subsection (e), which agreements may include provisions for
			 financial reimbursement for the oversight provided by such agencies; and</text>
					</subparagraph><subparagraph id="idDF06768575A4441D948390B0599F4B46"><enum>(I)</enum><text>make other
			 necessary expenditures.</text>
					</subparagraph></paragraph><paragraph id="id840F7F6DF7D04CC9885D83A2F2FF1143"><enum>(6)</enum><header>Meetings</header>
					<subparagraph id="id0326C39E6D7548169F9B9F5BE4C297FC"><enum>(A)</enum><header>In
			 general</header><text>The Board shall meet 4 times per calendar year, at the
			 call of the Chairperson.</text>
					</subparagraph><subparagraph id="id113169CF2A6149DDA3A579B09BDDBD6D"><enum>(B)</enum><header>Quorum;
			 requirements; limitations</header>
						<clause id="id6C0BDAAB5022499CB15623CF9554CFE8"><enum>(i)</enum><header>Quorum</header><text>A
			 quorum shall consist of a total of 13 members of the Board, excluding
			 ex-officio members, with diverse representation as described in clause
			 (iv).</text>
						</clause><clause id="id93E9EBD478C841979DD9AD6BA1E9F8E2"><enum>(ii)</enum><header>Chairperson or
			 Vice Chairperson</header><text>Each meeting of the Board shall be attended by
			 either the Chairperson or the Vice Chairperson.</text>
						</clause><clause id="id79F3881BBB4B4BBE878DC17B409F165E"><enum>(iii)</enum><header>Limitation</header><text>No
			 member or ex-officio member of the Board may attend more than 2 meetings of the
			 Board each calendar year with the exceptions of the Chairperson and Vice
			 Chairperson, who may attend all such meetings.</text>
						</clause><clause id="id87D1BB18FA8645E4B9121332CA177A67"><enum>(iv)</enum><header>Diverse
			 representation</header><text>At each meeting of the Board, there shall be not
			 less than one scientist, one representative of a disease advocacy organization,
			 and one representative of a professional venture capital or private equity
			 organization.</text>
						</clause></subparagraph></paragraph><paragraph id="idBBE7F3770C6242C1BAED2B037DA9FCC2"><enum>(7)</enum><header>Compensation
			 and travel expenses</header>
					<subparagraph id="idAB0D5AF2551A4AE78716C5DDFCE7EF2F"><enum>(A)</enum><header>Compensation</header><text>Members
			 shall receive compensation at a rate to be fixed by the Chairperson but not to
			 exceed a rate equal to the daily equivalent of the annual rate of basic pay
			 prescribed for level IV of the Executive Schedule under section 5315 of title
			 5, United States Code, for each day (including travel time) during which the
			 member is engaged in the performance of the duties of the Board. All members of
			 the Board who are officers or employees of the Untied States shall serve
			 without compensation in addition to that received for their services as
			 officers or employees of the United States.</text>
					</subparagraph><subparagraph id="idDA7E0D37E088477BBB38FE155A0C4564"><enum>(B)</enum><header>Travel
			 expenses</header><text>Members of the Board shall be allowed travel expenses,
			 including per diem in lieu of subsistence, at rates authorized for persons
			 employed intermittently by the Federal Government under section 5703(b) of
			 title 5, United States Code, while away from their homes or regular places of
			 business in the performance of services for the Board.</text>
					</subparagraph></paragraph></subsection><subsection id="id2027817A1C3C409D9B765C0107C66B2A"><enum>(e)</enum><header>Grant
			 program</header>
				<paragraph id="id247D94D3356A46D298A955D1D5EAAC17"><enum>(1)</enum><header>Grants and
			 contracts</header><text>The Chairperson shall, through the Board of the CAN,
			 award grants and contracts to eligible entities to assist such entities in
			 carrying out projects described in paragraph (3).</text>
				</paragraph><paragraph id="id879C2716852D4A2F94F84C2FE90A4F8E"><enum>(2)</enum><header>Award
			 process</header><text>The Chairperson of the Board may award a grant or
			 contract under this subsection to an eligible entity only upon the approval of
			 a majority of a quorum of the Board.</text>
				</paragraph><paragraph id="id3A8DB24F0E424568ADCD04CB79F0211F"><enum>(3)</enum><header>Use of
			 funds</header><text>Funds awarded under this subsection shall be used—</text>
					<subparagraph id="idB1B4BB3E80244EA6B8504EFC7A4EBA76"><enum>(A)</enum><text>to accelerate the
			 development of cures and treatments, including through the development of
			 medical products, behavioral therapies, and biomarkers that demonstrate the
			 safety or effectiveness of medical products; or</text>
					</subparagraph><subparagraph id="id265A2F89BC904526B2B35370F051E38D"><enum>(B)</enum><text>to help the award
			 recipient establish protocols that comply with Food and Drug Administration
			 standards and otherwise permit the recipient to meet regulatory requirements at
			 all stages of development, manufacturing, review, approval, and safety
			 surveillance of a medical product.</text>
					</subparagraph></paragraph><paragraph id="id4DEC2D555C5D46CAB37B4B0BC257866B"><enum>(4)</enum><header>Eligible
			 entities</header><text>To receive a grant or contract under this subsection, an
			 entity shall—</text>
					<subparagraph id="idCD52D25EE0704E959143CC1295E1305B"><enum>(A)</enum><text>be—</text>
						<clause commented="no" id="id0F69F541BDD746D581EA99E7DED8991B"><enum>(i)</enum><text>an
			 individual;</text>
						</clause><clause commented="no" id="id834A4635BE6F492595CE3711BA672B69"><enum>(ii)</enum><text>a group of
			 individuals; or</text>
						</clause><clause id="id0ADE6C3F7A58423EACDD28935FD5CA0B"><enum>(iii)</enum><text>a
			 public or private entity, which may include a private or public research
			 institution, an institution of higher education, a medical center, a
			 biotechnology company, a pharmaceutical company, a disease advocacy
			 organization, a patient advocacy organization, or an academic research
			 institution;</text>
						</clause></subparagraph><subparagraph id="idFC1EB1F6573842CF8EC89E7A5FE53AC2"><enum>(B)</enum><text>submit an
			 application containing—</text>
						<clause id="id03D9AF396E4E4A8ABD77A41AE0C7B59E"><enum>(i)</enum><text>a
			 detailed description of the project for which the entity seeks such grant or
			 contract;</text>
						</clause><clause id="idC45B88ABA9EE45B0ACF870EC2F793CBF"><enum>(ii)</enum><text>a
			 timetable for such project;</text>
						</clause><clause id="id6C82A1BD9BCC43F2BF7B802024DACB1D"><enum>(iii)</enum><text>an assurance
			 that the entity will submit—</text>
							<subclause id="idD8ED08F9B14B47748EC2A649B9E9AFBD"><enum>(I)</enum><text>interim reports
			 describing the entity's—</text>
								<item id="id4F9CF1D6949B41CC9798B67BDA3FCB24"><enum>(aa)</enum><text>progress in
			 carrying out the project; and</text>
								</item><item id="idB3BBE0B0E392404EB2213903FBAD81BB"><enum>(bb)</enum><text>compliance with
			 all provisions of this section and conditions of receipt of such grant or
			 contract; and</text>
								</item></subclause><subclause id="id138C95AB24894AD6B8941BE98F85DB81"><enum>(II)</enum><text>a final report
			 at the conclusion of the grant period, describing the outcomes of the project;
			 and</text>
							</subclause></clause><clause id="id0F5760E9C9864F1FBC971319554955D6"><enum>(iv)</enum><text>a
			 description of the protocols the entity will follow to comply with Food and
			 Drug Administration standards and regulatory requirements at all stages of
			 development, manufacturing, review, approval, and safety surveillance of a
			 medical product; and</text>
						</clause></subparagraph><subparagraph id="id03C6B6FC8AEE4CB8B7A3259910408AE7"><enum>(C)</enum><text>provide such
			 additional information as the Chairperson may require.</text>
					</subparagraph></paragraph><paragraph id="id689BD4508CCB434DB8FAD6AF9B058707"><enum>(5)</enum><header>Study sections
			 of the Center for Scientific Review</header>
					<subparagraph id="id7BA8E7BCA5094CE5860BDDC70F3EEA25"><enum>(A)</enum><header>In
			 general</header><text>The Chairperson may enter into an interagency agreement
			 with the Center for Scientific Review within the National Institutes of Health
			 to use the study sections of such Center to review applications submitted under
			 paragraphs (4)(B) and additional information submitted under (4)(C) and to make
			 recommendations to the Board. The Chairperson shall promulgate regulations and
			 procedures to—</text>
						<clause id="id8722B99521EE45F08BBCB7C78393B4C7"><enum>(i)</enum><text>ensure that each
			 study section reviewing applications is composed of diverse members, as
			 described in subparagraph (B);</text>
						</clause><clause id="id9CD656BB9F2246CAAAC95149B9748AF7"><enum>(ii)</enum><text>require such
			 study sections to create written records summarizing—</text>
							<subclause id="id9B9BBB8DCC4C4864B5E45737F450E3D1"><enum>(I)</enum><text>all meetings and
			 discussions of the study section; and</text>
							</subclause><subclause id="id77AA16F6B1A74E108AAA61A49E166FDB"><enum>(II)</enum><text>the
			 recommendations made by such study section to the Board; and</text>
							</subclause></clause><clause id="id85EC8EFF490D4233BD5E7BF34D17F219"><enum>(iii)</enum><text>make the
			 records described in clause (ii) available to the public in a manner that
			 protects the privacy of applicants and panel members and any proprietary
			 information from applicants.</text>
						</clause></subparagraph><subparagraph id="id9A528560F8AA4FD7AC20DCEE8F374B8E"><enum>(B)</enum><header>Membership</header><text>The
			 Chairperson shall ensure that the study sections of the Center for Scientific
			 Review that review applications submitted under this subsection are selected
			 solely on the basis of established records of distinguished service and
			 include—</text>
						<clause id="id2AD36C344FAB4DE8AE0C567AC42B109F"><enum>(i)</enum><text>for
			 each of the fields of—</text>
							<subclause id="id3C631CD62D1D4C9C82CC746F95E8442E"><enum>(I)</enum><text>basic
			 research;</text>
							</subclause><subclause id="id6D90CC967347498B94FC4D2AF5233753"><enum>(II)</enum><text>medicine;</text>
							</subclause><subclause id="id504E17B1EE14472EA6D8F3C21580B406"><enum>(III)</enum><text>biopharmaceuticals;</text>
							</subclause><subclause id="idD1AA48BAD71C4C17942298C887B5FE7A"><enum>(IV)</enum><text>discovery and
			 delivery of medical products;</text>
							</subclause><subclause id="id1C1A183262984A448761F8847E782908"><enum>(V)</enum><text>bioinformatics
			 and gene therapy; and</text>
							</subclause><subclause id="id7438F7D4D7AD46B08646590D3EFA6855"><enum>(VI)</enum><text>medical
			 instrumentation,</text>
							</subclause><continuation-text continuation-text-level="clause">at least 2
			 individuals with expertise in such fields;</continuation-text></clause><clause id="id78CD206E5F54487A8D70E3409452DFCB"><enum>(ii)</enum><text>at
			 least 3 representatives of professional venture capital or private equity
			 organizations with demonstrated experience in private equity investing;
			 and</text>
						</clause><clause id="idBA127005178D434DAB36D97F0AA70938"><enum>(iii)</enum><text>at least 3
			 representatives of disease advocacy organizations.</text>
						</clause></subparagraph><subparagraph id="id24ADACD3BBD14F58BC001E688E65DA2C"><enum>(C)</enum><header>Financial
			 compensation</header><text>Any agreement under subparagraph (A) shall include
			 an arrangement whereby the Chairperson reimburses the Center for Scientific
			 Review for the services provided under such subparagraph.</text>
					</subparagraph></paragraph><paragraph id="id4879514F2FE84C139A084B3151ACC608"><enum>(6)</enum><header>Awards</header>
					<subparagraph id="id9E896A8CDBB14CD38E8E6469040DC1D6"><enum>(A)</enum><header>The Cures
			 Acceleration Partnership Awards</header>
						<clause id="idF3CD566134AF47AA88605D8F81D5A06A"><enum>(i)</enum><header>Initial award
			 amount</header><text>Each award under this subparagraph shall be not more than
			 $15,000,000 per project for the first fiscal year for which the project is
			 funded, which shall be payable in one payment, except that the Chairperson of
			 the Board may increase the award amount for an eligible entity if the Board so
			 determines by a majority vote.</text>
						</clause><clause id="id2925C275C05A49A7AE93CD92851CA901"><enum>(ii)</enum><header>Funding in
			 subsequent fiscal years</header><text>An eligible entity receiving an award
			 under clause (i) may apply for additional funding for such project by
			 submitting to the Board the information required under subparagraphs (B) and
			 (C) of paragraph (4). The Chairperson may fund a project of such eligible
			 entity in an amount not to exceed $15,000,000 for a fiscal year subsequent to
			 the initial award under clause (i) if the Board so determines by majority
			 vote.</text>
						</clause><clause id="id9E3707A15AC2449F816BCABD44D7B57F"><enum>(iii)</enum><header>Matching
			 funds</header><text>As a condition for receiving a grant or contract under this
			 subparagraph, an eligible entity shall contribute to the project non-Federal
			 funds in the amount of $1 for every $3 awarded under clauses (i) and (ii),
			 except that the Chairperson may waive or modify such matching requirement by a
			 majority vote of the Board.</text>
						</clause></subparagraph><subparagraph id="id6D57C0745F1944A1B5B1CE845D8C490F"><enum>(B)</enum><header>The Cures
			 Acceleration Grant Awards</header>
						<clause id="id308D8A98C67744EC8009D15BB8628611"><enum>(i)</enum><header>Initial award
			 amount</header><text>Each award under this subparagraph shall be not more than
			 $15,000,000 per project for the first fiscal year for which the project is
			 funded, which shall be payable in one payment, except that the Chairperson of
			 the Board may increase the award amount for an eligible entity if the Board so
			 determines by a majority vote.</text>
						</clause><clause id="id87BE3A95F4BA4E55BE34551EC40B74C9"><enum>(ii)</enum><header>Funding in
			 subsequent fiscal years</header><text>An eligible entity receiving an award
			 under clause (i) may apply for additional funding for such project by
			 submitting to the Board the information required under subparagraphs (B) and
			 (C) of paragraph (4). The Chairperson may fund a project of such eligible
			 entity in an amount not to exceed $15,000,000 for a fiscal year subsequent to
			 the initial award under clause (i) if the Board so determines by majority
			 vote.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" id="idB9E20E2998164E07ACDF2C75978D10A6"><enum>(7)</enum><header>Suspension of
			 awards for defaults, noncompliance with provisions and plans, and diversion of
			 funds; repayment of funds</header><text>The Chairperson may suspend the award
			 to any entity upon noncompliance by such entity with provisions and plans under
			 this section or diversion of funds.</text>
				</paragraph><paragraph id="id55BEF0611B2246C0B974E573E526950E"><enum>(8)</enum><header>Audits</header><text>The
			 Chairperson may enter into agreements with other entities to conduct periodic
			 audits of the projects funded by grants or contracts awarded under this
			 subsection.</text>
				</paragraph><paragraph id="idBE807CCDCB424094AC844FCFC11B4134"><enum>(9)</enum><header>Closeout
			 procedures</header><text>At the end of a grant or contract period, a recipient
			 shall follow the closeout procedures under section 74.71 of title 45, Code of
			 Federal Regulations (or any successor regulation).</text>
				</paragraph></subsection><subsection id="id6EC2285C32944039BE5643C45E5E323C"><enum>(f)</enum><header>Staff</header><text>The
			 CAN may employ such officers and employees (including experts and consultants),
			 appointed by the Chairperson, as may be necessary to enable the CAN to carry
			 out its functions under this section, and may employ and fix the compensation
			 of such officers and employees.</text>
			</subsection><subsection id="idEC9D06EBAE3E414B990F79CC961B4783"><enum>(g)</enum><header>Gifts,
			 bequests, and devises</header>
				<paragraph id="id94135D8C2D2F4C1F9D23D20433ABD3F5"><enum>(1)</enum><header>In
			 general</header><text>The CAN may accept donations, bequests, and devises, with
			 or without conditions, and transfers for tax purposes, for the purpose of
			 aiding or facilitating the work of the CAN subject to the following:</text>
					<subparagraph id="idE8F860C9BA8344C19D25F4EC5688E99C"><enum>(A)</enum><text>In any case in
			 which money or other property is donated, bequeathed, or devised to the CAN
			 without designation for the benefit of which such property is intended, and
			 without condition or restriction other than that such property be used for the
			 purposes of the CAN, such property shall be deemed to have been donated,
			 bequeathed, or devised to the CAN and the Chairperson shall have authority to
			 receive such property.</text>
					</subparagraph><subparagraph id="idD49A8881518F465B8CD63D486992D67C"><enum>(B)</enum><text>In any case in
			 which any money or other property is donated, bequeathed, or devised to the CAN
			 with a condition or restriction, such property shall be deemed to have been
			 donated, bequeathed, or devised to the CAN whose function it is to carry out
			 the purpose or purposes described, or referred to, by the terms of such
			 condition or restriction, and the Chairperson shall have authority to receive
			 such property.</text>
					</subparagraph><subparagraph id="id3F570C3B64D14000928946600025FD6F"><enum>(C)</enum><text>For the purposes
			 of subparagraph (B), if one or more of the purposes of such a condition or
			 restriction is covered by the functions of the CAN, or if some of the purposes
			 of such a condition or restriction are covered by the CAN, the Board shall
			 determine an equitable manner for distribution by the CAN of the property so
			 donated, bequeathed, or devised.</text>
					</subparagraph><subparagraph id="id93C27288D81C48FD97F025BBED2C7977"><enum>(D)</enum><text>For the purpose
			 of Federal income tax, gift tax, and estate tax laws, any money or other
			 property donated, bequeathed, or devised to the Chairperson pursuant to
			 authority derived under this subsection shall be deemed to have been donated,
			 bequeathed, or devised to, or for the use of, the United States.</text>
					</subparagraph></paragraph></subsection><subsection id="idB824AA6721754A15B63A895603676E67"><enum>(h)</enum><header>Conflicts of
			 interest</header>
				<paragraph id="id31667BADCEB940B5A7F7FA2AD320E01E"><enum>(1)</enum><header>In
			 general</header><text>The Chairperson shall develop and enforce conflict of
			 interest policies for the CAN and shall respond in a timely manner when such
			 policies have been violated by a recipient of funds provided under a grant or
			 contract awarded under this section.</text>
				</paragraph><paragraph id="idF89578A857234FD6A6AD5F839C14B772"><enum>(2)</enum><header>Information</header>
					<subparagraph id="id1F0C95DF53FA4AD0BB021F7ED077833B"><enum>(A)</enum><header>In
			 general</header><text>In the case in which the principal investigator for a
			 recipient described under subparagraph (B) has a conflict of interest, the
			 Chairperson shall require the recipient to provide to the Chairperson the
			 following information:</text>
						<clause id="idDDF037B126AB4BEDA468423CA2E5FC10"><enum>(i)</enum><text>The
			 degree of the primary investigator's financial interest, estimated to the
			 nearest $1,000.</text>
						</clause><clause id="idBFE66402AF6F4B4AB9AA9142DB146B4D"><enum>(ii)</enum><text>A
			 detailed report explaining how the recipient will manage the primary
			 investigator's conflict of interest.</text>
						</clause></subparagraph><subparagraph id="idBFF70D45DA04452CB52C9A91B9B7E674"><enum>(B)</enum><header>Recipient</header><text>A
			 recipient described in this subparagraph is a recipient—</text>
						<clause id="id0608E2EBFE2B4043B736B2A538438152"><enum>(i)</enum><text>of
			 a grant or contract awarded under subsection (e); and</text>
						</clause><clause id="idFC3795863CC844A9BFAB6C72AD8914D9"><enum>(ii)</enum><text>that receives
			 more than $250,000 under such grant or contract.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="idC0161ECDB2434FB1A680E1B6EF282C3D"><enum>(i)</enum><header>Authorization
			 of appropriations</header><text>For purposes of carrying out this section,
			 there are authorized to be appropriated—</text>
				<paragraph id="id53848B82670140FC8A73889D019F3523"><enum>(1)</enum><text>for fiscal year
			 2010, $1,000,000,000 for awards described under subsection (e)(6)(A), including
			 associated administrative costs;</text>
				</paragraph><paragraph id="idABB847E151854C9CB23AA408588A74BB"><enum>(2)</enum><text>for fiscal year
			 2010, $1,000,000,000 for awards described under subsection (e)(6)(B), including
			 associated administrative costs; and</text>
				</paragraph><paragraph id="id50FC316ABD3C40A8A996722C019EAC7F"><enum>(3)</enum><text>such sums as may
			 be necessary for subsequent fiscal years.</text>
				</paragraph></subsection></section><section id="id3EC1DD6EED664903888C8CA774213CE8"><enum>3.</enum><header>Organization of
			 national institutes of health</header>
			<subsection id="id077DD98E5E984E8F86E8A272087053BA"><enum>(a)</enum><header>Redesignation
			 of center on minority health and health disparities</header><text>Title IV of
			 the Public Health Service Act (42 U.S.C. 281 et seq.) is amended—</text>
				<paragraph id="idEB3B6E77B5F44A9A8BC3C47120FC26FB"><enum>(1)</enum><text>by redesignating
			 subpart 6 of part E as subpart 20;</text>
