		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Transparency for Homeowners Act of
			 2009</short-title></quote>.</text>
		</section><section id="ID753814af6df8441580e01ff1247125d3"><enum>2.</enum><header>Prohibition on
			 yield spread premiums</header>
			<subsection id="id07F08763176D45419C92EE9EEB7AD9C8"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">No person shall
			 provide, and no mortgage originator shall receive, directly or indirectly, any
			 compensation that is based on, or varies with, the terms of any home mortgage
			 loan (other than the amount of the loan).</text>
			</subsection><subsection id="id1D121BE07E6846FD8416DAB3A21CB0D5"><enum>(b)</enum><header>Definitions</header><text>For
			 purposes of this Act—</text>
				<paragraph id="id9684FE5990A8485E860F1129D924F017"><enum>(1)</enum><text>the term
			 <quote>home mortgage loan</quote> means a loan secured by a mortgage or lien on
			 residential property;</text>
				</paragraph><paragraph id="id0D2311BD150F4DD98E35F968D1AA4F35"><enum>(2)</enum><text>the term
			 <quote>mortgage originator</quote> means any creditor or other person,
			 including a mortgage broker or bank lender, who, for compensation or in
			 anticipation of compensation, engages either directly or indirectly in
			 the—</text>
					<subparagraph id="IDd24336059fec43c98de94fdab36cb48d"><enum>(A)</enum><text>acceptance of
			 applications for home mortgage loans;</text>
					</subparagraph><subparagraph id="ID18aa68d073bf4e2dab4dbe18fd27f655"><enum>(B)</enum><text>solicitation of
			 home mortgage loans on behalf of borrowers;</text>
					</subparagraph><subparagraph id="IDba5dd88b6d084ac0939f4b2a74b773d4"><enum>(C)</enum><text>negotiation of
			 terms or conditions of home mortgage loans on behalf of borrowers or lenders;
			 or</text>
					</subparagraph><subparagraph id="ID4c2ed26cf3f94ca2baeb8e9c29a50ce0"><enum>(D)</enum><text>negotiation of
			 sales of existing home mortgage loans to institutional or noninstitutional
			 lenders; and</text>
					</subparagraph></paragraph><paragraph id="ID0bd252759ed94fb5aa692521e53a70ab"><enum>(3)</enum><text>the term
			 <quote>residential property</quote> means a 1–4 family, owner-occupied
			 residence, including a 1-family unit in a condominium project, a membership
			 interest and occupancy agreement in a cooperative housing project, and a
			 manufactured home and the lot on which the home is situated.</text>
				</paragraph></subsection></section></legis-body>
