		<legis-type>A BILL</legis-type>
		<official-title>To provide Federal assistance to States, local
		  jurisdictions, and Indian tribes to prosecute hate crimes, and for other
		  purposes.</official-title>

		<section display-inline="no-display-inline" id="H34B74ECE35C1481391FC53D17B934B9E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Matthew Shepard Hate Crimes Prevention
			 Act</short-title></quote>.</text>
		</section><section id="H10FE94F62A214CF8B9297347E6F69DB4"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="H0F27FCFDB51D48AE80262685A8769C02"><enum>(1)</enum><text>The incidence of
			 violence motivated by the actual or perceived race, color, religion, national
			 origin, gender, sexual orientation, gender identity, or disability of the
			 victim poses a serious national problem.</text>
			</paragraph><paragraph id="HCCFE75F5676347DEAF24B224DB573291"><enum>(2)</enum><text>Such violence
			 disrupts the tranquility and safety of communities and is deeply
			 divisive.</text>
			</paragraph><paragraph id="H66926F18150F42AA97A6CE004064078D"><enum>(3)</enum><text>State and local
			 authorities are now and will continue to be responsible for prosecuting the
			 overwhelming majority of violent crimes in the United States, including violent
			 crimes motivated by bias. These authorities can carry out their
			 responsibilities more effectively with greater Federal assistance.</text>
			</paragraph><paragraph id="H6C0CDBF64D3448A1A56C1C8E669C72E4"><enum>(4)</enum><text>Existing Federal
			 law is inadequate to address this problem.</text>
			</paragraph><paragraph id="H1C85060E037248529E26298F013590B4"><enum>(5)</enum><text>A
			 prominent characteristic of a violent crime motivated by bias is that it
			 devastates not just the actual victim and the family and friends of the victim,
			 but frequently savages the community sharing the traits that caused the victim
			 to be selected.</text>
			</paragraph><paragraph id="H1F0512E2A292457E8493F5163F5398C"><enum>(6)</enum><text>Such violence
			 substantially affects interstate commerce in many ways, including the
			 following:</text>
				<subparagraph id="H971433B929A8404691C043F00A0C1C8"><enum>(A)</enum><text>The movement of
			 members of targeted groups is impeded, and members of such groups are forced to
			 move across State lines to escape the incidence or risk of such
			 violence.</text>
				</subparagraph><subparagraph id="H75C96FA69AF246AD99B692CBB61F23"><enum>(B)</enum><text>Members of targeted
			 groups are prevented from purchasing goods and services, obtaining or
			 sustaining employment, or participating in other commercial activity.</text>
				</subparagraph><subparagraph commented="no" id="H50B511FA97E447668B7BEB6064E8DE9"><enum>(C)</enum><text>Perpetrators cross
			 State lines to commit such violence.</text>
				</subparagraph><subparagraph commented="no" id="H55657CBD658447ADA993E19500759F3F"><enum>(D)</enum><text>Channels,
			 facilities, and instrumentalities of interstate commerce are used to facilitate
			 the commission of such violence.</text>
				</subparagraph><subparagraph commented="no" id="H5B8F317DB5BC4486B4DA004440015FC1"><enum>(E)</enum><text>Such violence is
			 committed using articles that have traveled in interstate commerce.</text>
				</subparagraph></paragraph><paragraph id="H23723C8E64454D51826F83FDD3CEF5D7"><enum>(7)</enum><text>For generations,
			 the institutions of slavery and involuntary servitude were defined by the race,
			 color, and ancestry of those held in bondage. Slavery and involuntary servitude
			 were enforced, both prior to and after the adoption of the 13th amendment to
			 the Constitution of the United States, through widespread public and private
			 violence directed at persons because of their race, color, or ancestry, or
			 perceived race, color, or ancestry. Accordingly, eliminating racially motivated
			 violence is an important means of eliminating, to the extent possible, the
			 badges, incidents, and relics of slavery and involuntary servitude.</text>
			</paragraph><paragraph id="H9725E8638E8441E2BF4959AF5DE46782"><enum>(8)</enum><text>Both at the time
			 when the 13th, 14th, and 15th amendments to the Constitution of the United
			 States were adopted, and continuing to date, members of certain religious and
			 national origin groups were and are perceived to be distinct
			 <quote>races</quote>. Thus, in order to eliminate, to the extent possible, the
			 badges, incidents, and relics of slavery, it is necessary to prohibit assaults
			 on the basis of real or perceived religions or national origins, at least to
			 the extent such religions or national origins were regarded as races at the
			 time of the adoption of the 13th, 14th, and 15th amendments to the Constitution
			 of the United States.</text>
			</paragraph><paragraph id="H65ED74D4E623491CBBB13C903E632D97"><enum>(9)</enum><text>Federal
			 jurisdiction over certain violent crimes motivated by bias enables Federal,
			 State, and local authorities to work together as partners in the investigation
			 and prosecution of such crimes.</text>
			</paragraph><paragraph id="H1C4ED0EBE1FF4A5CACF5B28C32A17DCA"><enum>(10)</enum><text>The problem of
			 crimes motivated by bias is sufficiently serious, widespread, and interstate in
			 nature as to warrant Federal assistance to States, local jurisdictions, and
			 Indian tribes.</text>
			</paragraph></section><section id="H478562BF518F48F0AE605DFE9BD2DDCA"><enum>3.</enum><header>Definition of
			 hate crime</header><text display-inline="no-display-inline">In this Act—</text>
			<paragraph id="H96348C5B940B4C59A3493E4B185EDC03"><enum>(1)</enum><text>the term
			 <term>crime of violence</term> has the meaning given that term in section 16,
			 title 18, United States Code;</text>
			</paragraph><paragraph id="H249CE39444BA416095138931BD31B852"><enum>(2)</enum><text>the term
			 <term>hate crime</term> has the meaning given such term in section 280003(a) of
			 the <act-name parsable-cite="VCCLEA94">Violent Crime Control and Law
			 Enforcement Act of 1994</act-name> (28 U.S.C. 994 note); and</text>
			</paragraph><paragraph id="H6C805171C9EE440395BBC5F8F746D6E"><enum>(3)</enum><text>the term
			 <term>local</term> means a county, city, town, township, parish, village, or
			 other general purpose political subdivision of a State.</text>
			</paragraph></section><section id="H56FE0E3BE43B460B9FDDB00D04D368B"><enum>4.</enum><header>Support for
			 criminal investigations and prosecutions by State, local, and tribal law
			 enforcement officials</header>
			<subsection id="HCC3B6E61009F4E68A003C076A0023BB7"><enum>(a)</enum><header>Assistance other
			 than financial assistance</header>
				<paragraph id="H47E7597F1F754BD9BD2E4F141BA8E023"><enum>(1)</enum><header>In
			 general</header><text>At the request of State, local, or tribal law enforcement
			 agency, the Attorney General may provide technical, forensic, prosecutorial, or
			 any other form of assistance in the criminal investigation or prosecution of
			 any crime that—</text>
					<subparagraph id="H510A77AC8DD1435189C600F36D78D05"><enum>(A)</enum><text>constitutes a crime
			 of violence;</text>
					</subparagraph><subparagraph id="H2BFB6FBB71E9415DBDA9C9E2F1CC497"><enum>(B)</enum><text>constitutes a
			 felony under the State, local, or tribal laws; and</text>
					</subparagraph><subparagraph id="HFC4A704F2FEE4D6C8696026C275522E2"><enum>(C)</enum><text>is motivated by
			 prejudice based on the actual or perceived race, color, religion, national
			 origin, gender, sexual orientation, gender identity, or disability of the
			 victim, or is a violation of the State, local, or tribal hate crime
			 laws.</text>
					</subparagraph></paragraph><paragraph id="H1B60FC872AFA4E0C001F10D72381BE24"><enum>(2)</enum><header>Priority</header><text>In
			 providing assistance under
			 <internal-xref idref="H47E7597F1F754BD9BD2E4F141BA8E023" legis-path="4.(a)(1)">paragraph (1)</internal-xref>, the Attorney General shall
			 give priority to crimes committed by offenders who have committed crimes in
			 more than one State and to rural jurisdictions that have difficulty covering
			 the extraordinary expenses relating to the investigation or prosecution of the
			 crime.</text>
				</paragraph></subsection><subsection id="H85D47A9EBFC741C185A19483001FF77B"><enum>(b)</enum><header>Grants</header>
				<paragraph id="H4B23F0AF60F64C918D9E9084885B22F4"><enum>(1)</enum><header>In
			 general</header><text>The Attorney General may award grants to State, local,
			 and tribal law enforcement agencies for extraordinary expenses associated with
			 the investigation and prosecution of hate crimes.</text>
				</paragraph><paragraph id="HD899CC194D0D4914ACD51C13063082A"><enum>(2)</enum><header>Office of Justice
			 Programs</header><text>In implementing the grant program under this subsection,
			 the Office of Justice Programs shall work closely with grantees to ensure that
			 the concerns and needs of all affected parties, including community groups and
			 schools, colleges, and universities, are addressed through the local
			 infrastructure developed under the grants.</text>
				</paragraph><paragraph id="HBB2EF99430244891ACC29D7BC1737FCC"><enum>(3)</enum><header>Application</header>
					<subparagraph id="H52CFC06A87674E24AEF44CD6AB207924"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Each State, local,
			 and tribal law enforcement agency that desires a grant under this subsection
			 shall submit an application to the Attorney General at such time, in such
			 manner, and accompanied by or containing such information as the Attorney
			 General shall reasonably require.</text>
					</subparagraph><subparagraph id="HF6553A24560841C9B3D41B9BA20223CE"><enum>(B)</enum><header>Date for
			 submission</header><text>Applications submitted pursuant to
			 <internal-xref idref="H52CFC06A87674E24AEF44CD6AB207924" legis-path="4.(b)(3)(A)">subparagraph (A)</internal-xref> shall be submitted
			 during the 60-day period beginning on a date that the Attorney General shall
			 prescribe.</text>
					</subparagraph><subparagraph id="HC8C2E6A1947045DB9641E4772C111F3B"><enum>(C)</enum><header>Requirements</header><text display-inline="yes-display-inline">A State, local, and tribal law enforcement
			 agency applying for a grant under this subsection shall—</text>
						<clause id="HD8A4D09B40F6402A96B6A4290416FCBC"><enum>(i)</enum><text>describe the
			 extraordinary purposes for which the grant is needed;</text>
						</clause><clause id="H74EA6D2254144CD9BFADBB038BC8D1"><enum>(ii)</enum><text display-inline="yes-display-inline">certify that the State, local government,
			 or Indian tribe lacks the resources necessary to investigate or prosecute the
			 hate crime;</text>
						</clause><clause id="H109AE767A63143AC00DBB0CD7EA82597"><enum>(iii)</enum><text display-inline="yes-display-inline">demonstrate that, in developing a plan to
			 implement the grant, the State, local, and tribal law enforcement agency has
			 consulted and coordinated with nonprofit, nongovernmental victim services
			 programs that have experience in providing services to victims of hate crimes;
			 and</text>
						</clause><clause id="HD04D3BBF99454B469B5F35853EEBC422"><enum>(iv)</enum><text>certify that any
			 Federal funds received under this subsection will be used to supplement, not
			 supplant, non-Federal funds that would otherwise be available for activities
			 funded under this subsection.</text>
						</clause></subparagraph></paragraph><paragraph id="H3F7839940F1F44E68589DE711CC30000"><enum>(4)</enum><header>Deadline</header><text>An
			 application for a grant under this subsection shall be approved or denied by
			 the Attorney General not later than 180 business days after the date on which
			 the Attorney General receives the application.</text>
				</paragraph><paragraph id="H9DE41499B0014A309519F5E701A72430"><enum>(5)</enum><header>Grant
			 amount</header><text>A grant under this subsection shall not exceed $100,000
			 for any single jurisdiction in any 1-year period.</text>
				</paragraph><paragraph id="H1CFCB2DF974D493F8CC9C3FCC39E23B7"><enum>(6)</enum><header>Report</header><text>Not
			 later than December 31, 2010, the Attorney General shall submit to Congress a
			 report describing the applications submitted for grants under this subsection,
			 the award of such grants, and the purposes for which the grant amounts were
			 expended.</text>
				</paragraph><paragraph id="H596D99264E8E4A3993305BB1B9B8A750"><enum>(7)</enum><header>Authorization of
			 appropriations</header><text>There is authorized to be appropriated to carry
			 out this subsection $5,000,000 for each of fiscal years 2010 and 2011.</text>
				</paragraph></subsection></section><section id="H45705E72918D48BD933CE7C5ADEC276F"><enum>5.</enum><header>Grant
			 program</header>
			<subsection id="H9AEDAC11074442909042D88375F041E9"><enum>(a)</enum><header>Authority To
			 award grants</header><text display-inline="yes-display-inline">The Office of
			 Justice Programs of the Department of Justice may award grants, in accordance
			 with such regulations as the Attorney General may prescribe, to State, local,
			 or tribal programs designed to combat hate crimes committed by juveniles,
			 including programs to train local law enforcement officers in identifying,
			 investigating, prosecuting, and preventing hate crimes.</text>
			</subsection><subsection id="HA947F069A6D44F7E8668F25B3BEEF6B"><enum>(b)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated such sums
			 as may be necessary to carry out this section.</text>
			</subsection></section><section id="H55B363171B9A4983B4FB12CAD55C3222"><enum>6.</enum><header>Authorization for
			 additional personnel to assist State, local, and tribal law
			 enforcement</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to the Department of Justice, including the
			 Community Relations Service, for fiscal years 2010, 2011, and 2012 such sums as
			 are necessary to increase the number of personnel to prevent and respond to
			 alleged violations of section 249 of title 18, United States Code, as added by
			 <internal-xref idref="H54EE982795AC456CAC14FD8431BD5391" legis-path="7.">section 7</internal-xref> of this Act.</text>
		</section><section id="H54EE982795AC456CAC14FD8431BD5391"><enum>7.</enum><header>Prohibition of
			 certain hate crime acts</header>
			<subsection id="H5E6F1B8E9D4B49A49484D02CD96DE247"><enum>(a)</enum><header>In
			 general</header><text>Chapter 13 of title 18, United States Code, is amended by
			 adding at the end the following:</text>
				<quoted-block id="HBBA368FF62D94D9D9F41C3044D13DB46" style="USC">
					<section id="H00EB9F095C8F4341835889AD1EF0C2D4"><enum>249.</enum><header>Hate crime
				acts</header>
						<subsection id="H679FAA10F73F472C905733B36E6003FD"><enum>(a)</enum><header>In
				general</header>
							<paragraph id="H80713788CABC4F4CA95C9827DEA66962"><enum>(1)</enum><header>Offenses
				involving actual or perceived race, color, religion, or national
				origin</header><text>Whoever, whether or not acting under color of law,
				willfully causes bodily injury to any person or, through the use of fire, a
				firearm, a dangerous weapon, or an explosive or incendiary device, attempts to
				cause bodily injury to any person, because of the actual or perceived race,
				color, religion, or national origin of any person—</text>
								<subparagraph id="H4CBF5C4F351C44D4BBC4C20FB816F60"><enum>(A)</enum><text>shall be imprisoned
				not more than 10 years, fined in accordance with this title, or both;
				and</text>
								</subparagraph><subparagraph id="H679EF0EBDD4742F2BBB3ABEDD43076BC"><enum>(B)</enum><text>shall be
				imprisoned for any term of years or for life, fined in accordance with this
				title, or both, if—</text>
									<clause id="H23F9D960E0E8477D9CA7A43F54AA16C6"><enum>(i)</enum><text>death results from
				the offense; or</text>
									</clause><clause id="H83CFF1B6BA9B4685AAC95D511374A186"><enum>(ii)</enum><text>the offense
				includes kidnapping or an attempt to kidnap, aggravated sexual abuse or an
				attempt to commit aggravated sexual abuse, or an attempt to kill.</text>
									</clause></subparagraph></paragraph><paragraph id="H8D1CDFFF9F5545AEA122B9D6815D3637"><enum>(2)</enum><header>Offenses
				involving actual or perceived religion, national origin, gender, sexual
				orientation, gender identity, or disability</header>
								<subparagraph id="H0682F4A5699548C9B2DFDBBAB62D3D75"><enum>(A)</enum><header>In
				general</header><text>Whoever, whether or not acting under color of law, in any
				circumstance described in subparagraph (B) or paragraph (3), willfully causes
				bodily injury to any person or, through the use of fire, a firearm, a dangerous
				weapon, or an explosive or incendiary device, attempts to cause bodily injury
				to any person, because of the actual or perceived religion, national origin,
				gender, sexual orientation, gender identity or disability of any person—</text>
									<clause id="HBA6B88910F2B4794BAACFE7381FB849D"><enum>(i)</enum><text>shall be
				imprisoned not more than 10 years, fined in accordance with this title, or
				both; and</text>
									</clause><clause id="H630F8767C6EA469CBB51BD3043F1FBD2"><enum>(ii)</enum><text>shall be
				imprisoned for any term of years or for life, fined in accordance with this
				title, or both, if—</text>
										<subclause id="H18A6228996B94BBCA368B3E2365BF300"><enum>(I)</enum><text>death results from
				the offense; or</text>
										</subclause><subclause id="H40AF8FC46F9B4359AD7B1DC7EDAFB64E"><enum>(II)</enum><text>the offense
				includes kidnapping or an attempt to kidnap, aggravated sexual abuse or an
				attempt to commit aggravated sexual abuse, or an attempt to kill.</text>
										</subclause></clause></subparagraph><subparagraph id="H5A9FD016AB074B7B8FDF8957239E1D19"><enum>(B)</enum><header>Circumstances
				described</header><text>For purposes of subparagraph (A), the circumstances
				described in this subparagraph are that—</text>
									<clause id="HD41F4CD5CE7846BF9C9F99BEC4C83BC2"><enum>(i)</enum><text>the conduct
				described in subparagraph (A) occurs during the course of, or as the result of,
				the travel of the defendant or the victim—</text>
										<subclause id="H59F5B9BADFF74BB9B12B7DFAEC9901DA"><enum>(I)</enum><text>across a State
				line or national border; or</text>
										</subclause><subclause id="H93D44D6DF1E748DAAD71D9C82BAE7B7"><enum>(II)</enum><text>using a channel,
				facility, or instrumentality of interstate or foreign commerce;</text>
										</subclause></clause><clause id="H40BAD0C3B4A14C3F864BCB35733DD8F4"><enum>(ii)</enum><text>the defendant
				uses a channel, facility, or instrumentality of interstate or foreign commerce
				in connection with the conduct described in subparagraph (A);</text>
									</clause><clause id="H330BFAD3F3634D7BBE97DB91FABC8097"><enum>(iii)</enum><text>in connection
				with the conduct described in subparagraph (A), the defendant employs a
				firearm, dangerous weapon, explosive or incendiary device, or other weapon that
				has traveled in interstate or foreign commerce; or</text>
									</clause><clause id="H0E7DF9869F9B4509ABF3D468AA949293"><enum>(iv)</enum><text>the conduct
				described in subparagraph (A)—</text>
										<subclause id="H4AD7FD34DFA146408FC970AA24A8D300"><enum>(I)</enum><text>interferes with
				commercial or other economic activity in which the victim is engaged at the
				time of the conduct; or</text>
										</subclause><subclause id="H833D0FEAF18D4D4FB5F23479E3006FB9"><enum>(II)</enum><text>otherwise affects
				interstate or foreign commerce.</text>
										</subclause></clause></subparagraph></paragraph><paragraph id="id0A6C1D45803E4633933A540C7A792A01"><enum>(3)</enum><header>Offenses
				occurring in the special maritime or territorial jurisdiction of the United
				States</header><text>Whoever, within the special maritime or territorial
				jurisdiction of the United States, commits an offense described in paragraph
				(1) or (2) shall be subject to the same penalties as prescribed in those
				paragraphs.</text>
							</paragraph></subsection><subsection id="H8FD2164D01E0498B82C3504AE97000"><enum>(b)</enum><header>Certification
				requirement</header>
							<paragraph id="id09E1925B643A477D94941FC58F2AEC35"><enum>(1)</enum><header>In
				general</header><text>No prosecution of any offense described in this
				subsection may be undertaken by the United States, except under the
				certification in writing of the Attorney General, or his designee, that—</text>
								<subparagraph id="id05711AD4C4B141A8939CC52B2D50684E"><enum>(A)</enum><text>the State does
				not have jurisdiction;</text>
								</subparagraph><subparagraph id="IDd7c8a2f8f59b40108cc867aa7fc408b7"><enum>(B)</enum><text>the State has
				requested that the Federal Government assume jurisdiction;</text>
								</subparagraph><subparagraph id="IDbcc34b8f2e6c47d48418c8ed9dc88c45"><enum>(C)</enum><text>the verdict or
				sentence obtained pursuant to State charges left demonstratively unvindicated
				the Federal interest in eradicating bias-motivated violence; or</text>
								</subparagraph><subparagraph id="IDab52d3cc90e2467c9dfbf064492cc201"><enum>(D)</enum><text>a prosecution by
				the United States is in the public interest and necessary to secure substantial
				justice.</text>
								</subparagraph></paragraph><paragraph id="id120C9E4BB83F495FA833854A81EBC86B"><enum>(2)</enum><header>Rule of
				construction</header><text>Nothing in this subsection shall be construed to
				limit the authority of Federal officers, or a Federal grand jury, to
				investigate possible violations of this section.</text>
							</paragraph></subsection><subsection id="H2D73CB8A2CAA479D89CEA5549B5B47DD"><enum>(c)</enum><header>Definitions</header><text>In
				this section—</text>
							<paragraph id="idCD2A0BAEC93C4A118173B64E57EC90D6"><enum>(1)</enum><text>the term
				‘<term>bodily injury</term>’ has the meaning given such term in section
				1365(h)(4) of this title, but does not include solely emotional or
				psychological harm to the victim;</text>
							</paragraph><paragraph id="H6DBBAD302C5C4DC7BAE17B1B4F6DF3B3"><enum>(2)</enum><text>the term
				<term>explosive or incendiary device</term> has the meaning given such term in
				section 232 of this title;</text>
							</paragraph><paragraph id="H6943D702AEFF42D992F1E8A773847852"><enum>(3)</enum><text>the term
				<term>firearm</term> has the meaning given such term in section 921(a) of this
				title; and</text>
							</paragraph><paragraph id="H509903CA22D44973A6A22F534BB7967C"><enum>(4)</enum><text>the term
				<term>gender identity</term> for the purposes of this chapter means actual or
				perceived gender-related
				characteristics.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H1FEE49A586A8464D966CFF6500397C57"><enum>(b)</enum><header>Technical and
			 conforming amendment</header><text>The analysis for chapter 13 of title 18,
			 United States Code, is amended by adding at the end the following:</text>

			</subsection></section><section id="H13C8C3D6445A4A21A3E9FF7875F13433"><enum>8.</enum><header>Statistics</header>
			<subsection id="H31C192F32B734BE491C2FB436DC2BF4B"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (b)(1) of
			 the first section of the Hate Crime Statistics Act (28 U.S.C. 534 note) is
			 amended by inserting <quote>gender and gender identity,</quote> after
			 <quote>race,</quote>.</text>
			</subsection><subsection id="H82B273027C6A4F2098700082EEF8A1B1"><enum>(b)</enum><header>Data</header><text>Subsection
			 (b)(5) of the first section of the Hate Crime Statistics Act (28 U.S.C. 534
			 note) is amended by inserting <quote>, including data about crimes committed
			 by, and crimes directed against, juveniles</quote> after <quote>data acquired
			 under this section</quote>.</text>
			</subsection></section><section id="HF57D61FAE8A34D3A97025FBF7B48705"><enum>9.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act, an amendment
			 made by this Act, or the application of such provision or amendment to any
			 person or circumstance is held to be unconstitutional, the remainder of this
			 Act, the amendments made by this Act, and the application of the provisions of
			 such to any person or circumstance shall not be affected thereby.</text>
		</section><section id="idF643BDE12EDC4BFEA0A3E4F4C48933BC"><enum>10.</enum><header>Rule of
			 construction</header><text display-inline="no-display-inline">For purposes of
			 construing this Act and the amendments made by this Act the following shall
			 apply:</text>
			<paragraph id="id0277FEE67A6240E9A16F092615BC084B"><enum>(1)</enum><header>Relevant
			 evidence</header><text>Courts may consider relevant evidence of speech,
			 beliefs, or expressive conduct to the extent that such evidence is offered to
			 prove an element of a charged offense or is otherwise admissible under the
			 Federal Rules of Evidence. Nothing in this Act is intended to affect the
			 existing rules of evidence.</text>
			</paragraph><paragraph id="idF3A87B68B2874A8ABA87F1FDE1B32195"><enum>(2)</enum><header>Violent
			 acts</header><text>This Act applies to violent acts motivated by actual or
			 perceived race, color, religion, national origin, gender, sexual orientation,
			 gender identity or disability of a victim.</text>
			</paragraph><paragraph id="idB04E1C7DBC024FC981543694839D285E"><enum>(3)</enum><header>Constitutional
			 protections</header><text>Nothing in this Act shall be construed to prohibit
			 any constitutionally protected speech, expressive conduct or activities
			 (regardless of whether compelled by, or central to, a system of religious
			 belief), including the exercise of religion protected by the First Amendment
			 and peaceful picketing or demonstration. The Constitution does not protect
			 speech, conduct or activities consisting of planning for, conspiring to commit,
			 or committing an act of violence.</text>
			</paragraph><paragraph id="idDC0AB623724048B8A6A2D9AC55CBFB14"><enum>(4)</enum><header>Free
			 expression</header><text>Nothing in this Act shall be construed to allow
			 prosecution based solely upon an individual's expression of racial, religious,
			 political, or other beliefs or solely upon an individual's membership in a
			 group advocating or espousing such beliefs.</text>
