		<section id="id43BC3A4C853241B0BFD505D83FB5AAA0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fee Repeal and Expanded Access Act of
			 2009</short-title></quote>.</text>
		</section><section id="id689E36B6DE6C477F9F49C165EE07AD50"><enum>2.</enum><header>Recreation fee
			 authorities</header><text display-inline="no-display-inline">The Federal Lands
			 Recreation Enhancement Act (16 U.S.C. 6801 et seq.) is amended—</text>
			<paragraph id="idDB094B9AF89246C8AA6BD0671A836A2E"><enum>(1)</enum><text>by striking
			 section 801 (16 U.S.C. 6801 note) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id4018339ED8F94A2DB5BC8B44D433C69D" style="OLC">
					<section id="idB11528331C9345E69E9C545D41332929"><enum>801.</enum><header>Short
				title</header>
						<subsection id="id29036A8A05F44C46861DAD4458F9D500"><enum></enum><text>This Act may
				be cited as the <quote><short-title>Federal Lands
				Recreation Enhancement
				Act</short-title></quote>.</text>
						</subsection></section><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id9887445CB54B4D5DBE15C0983F7D1690"><enum>(2)</enum><text display-inline="yes-display-inline">by striking sections 802 through 812 (16
			 U.S.C. 6801 through 6811) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id8B8F9583B8754547BFD7CCF0DE343108" style="OLC">
					<section id="id5D870A9A08BE4D448100B5FE18CAB568"><enum>802.</enum><header>Recreation fee
				authority</header>
						<subsection id="id065CBB807D6547DAB68D5F96026CDDAB"><enum>(a)</enum><header>In
				general</header><text>Beginning January 1, 2010, subject to subsections (c) and
				(d), the Secretary of the Interior (referred to in this section as the
				<quote>Secretary</quote>) may establish and collect any fee from individuals or
				groups for—</text>
							<paragraph id="idC27A25D4DD1342E88A7C280263F242BF"><enum>(1)</enum><text>admission to a
				unit of the National Park System, including a commercial vehicle admission fee
				for a National Park at a level determined by the Secretary; and</text>
							</paragraph><paragraph id="idCFCE3FB22A3340CDA320948033AD951B"><enum>(2)</enum><text>the use of only
				the facilities or services described in subsection (b) at Federal recreational
				land or water under the jurisdiction of the Director of the National Park
				Service.</text>
							</paragraph></subsection><subsection id="IDef75d57db38e4e88986afd460c13231e"><enum>(b)</enum><header>Authorized
				facilities and services</header><text>The facilities and services referred to
				in subsection (a)(2) are the following:</text>
							<paragraph id="id8358F2E3E4684498BE6F8E12B4F67742"><enum>(1)</enum><text>Use of developed
				campgrounds that provide at least a majority of the following:</text>
								<subparagraph id="ID340035d82b4d4027ac4cd78a7ad0da05"><enum>(A)</enum><text>Tent or trailer
				spaces.</text>
								</subparagraph><subparagraph id="ID378d3ec8540d433e9a0ef09a6b0814f3"><enum>(B)</enum><text>Picnic
				tables.</text>
								</subparagraph><subparagraph id="IDc843a00c6a5645de9f40745ef39b64c2"><enum>(C)</enum><text>Drinking
				water.</text>
								</subparagraph><subparagraph id="ID98ac6227eab249dbb44faf28fdb822a3"><enum>(D)</enum><text>Access
				roads.</text>
								</subparagraph><subparagraph id="IDea6f649edcd54274ad6126f10f769c8f"><enum>(E)</enum><text>The collection of
				the fee by an employee or agent of the Federal land management agency.</text>
								</subparagraph><subparagraph id="IDa8da9fed9fe0461689c0ce8216b277ef"><enum>(F)</enum><text>Reasonable
				visitor protection.</text>
								</subparagraph><subparagraph id="ID1ac062b00a574f3e81b2f355c36f4016"><enum>(G)</enum><text>Refuse
				containers.</text>
								</subparagraph><subparagraph id="ID2a5c81b2e0ba4229b9b819c3838861df"><enum>(H)</enum><text>Toilet
				facilities.</text>
								</subparagraph><subparagraph id="IDc929e39314104a7b89840f5de2ac2972"><enum>(I)</enum><text>Simple devices
				for containing a campfire.</text>
								</subparagraph></paragraph><paragraph id="ID7214d51001f14e46a95d714dba482f74"><enum>(2)</enum><text>Use of highly
				developed boat launches with specialized facilities or services, such as
				mechanical or hydraulic boat lifts or facilities, multilane paved ramps, paved
				parking, restrooms, and other improvements, such as boarding floats, loading
				ramps, or fish cleaning stations.</text>
							</paragraph><paragraph id="IDd8eaee59313744e4b2157777728d6159"><enum>(3)</enum><text>Rental of cabins,
				boats, stock animals, lookouts, historic structures, group day-use or overnight
				sites, audio tour devices, portable sanitation devices.</text>
							</paragraph><paragraph id="ID3277f20245394e1fa7b92578607be238"><enum>(4)</enum><text>Use of hookups
				for electricity, cable, or sewer.</text>
							</paragraph><paragraph id="ID57bc940e3d01478a9b4f14d261237970"><enum>(5)</enum><text>Use of sanitary
				dump stations.</text>
							</paragraph><paragraph id="ID89df5afcb2e8408eb9440a9122b6eaff"><enum>(6)</enum><text>Use of
				transportation services.</text>
							</paragraph><paragraph id="ID89d51d22566446f88fd328746e84a919"><enum>(7)</enum><text>Use of developed
				swimming sites that provide at least a majority of the following:</text>
								<subparagraph id="IDbddb2480e8294b28b51b8c22709954cb"><enum>(A)</enum><text>Bathhouses with
				showers and flush toilets.</text>
								</subparagraph><subparagraph id="ID067d3541ebbb4af6b4f2c756968282a9"><enum>(B)</enum><text>Refuse
				containers.</text>
								</subparagraph><subparagraph id="ID5d418bba994142f7a204b429ab227161"><enum>(C)</enum><text>Picnic
				areas.</text>
								</subparagraph><subparagraph id="ID10cb295166bd439f9f147a73ad822c87"><enum>(D)</enum><text>Paved
				parking.</text>
								</subparagraph><subparagraph id="ID95c05e022e7044c99412c4f2f8b0b314"><enum>(E)</enum><text>Attendants,
				including lifeguards.</text>
								</subparagraph><subparagraph id="ID0081716ef920473b8ebead287502de7d"><enum>(F)</enum><text>Floats
				encompassing the swimming area.</text>
								</subparagraph><subparagraph id="IDbc07f6ebe7f3400db07a892df6e3cd50"><enum>(G)</enum><text>Swimming
				decks.</text>
								</subparagraph></paragraph></subsection><subsection id="id4415C3D693564CF2A402FB3CD72E2585"><enum>(c)</enum><header>Prohibition on
				fees for certain persons or places</header><text>The Secretary shall not charge
				an admission fee under subsection (a) for—</text>
							<paragraph id="ID07c28ad2d355448fa81d674d3e03c9cc"><enum>(1)</enum><text>a person under 16
				years of age;</text>
							</paragraph><paragraph id="IDe560f33287f6488cb0f8b2ff38f3bf67"><enum>(2)</enum><text>an outing
				conducted for a noncommercial educational purpose by a school or other academic
				institution;</text>
							</paragraph><paragraph id="ID2221a3dc02f64abd8b75bd8f93999a8e"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id00CAE8E4177A4E849D5987E01A5B1B10"><enum>(A)</enum><text>the USS Arizona
				Memorial;</text>
								</subparagraph><subparagraph id="idDF78071544804813B7DA0C2A73896FE4" indent="up1"><enum>(B)</enum><text>the Independence National Historical
				Park;</text>
								</subparagraph><subparagraph id="id3622C6DDFD4948E09ED7EE507B9C6117" indent="up1"><enum>(C)</enum><text>any unit of the National Park System
				within the District of Columbia; or</text>
								</subparagraph><subparagraph id="idAE2D31CF0C60434198ECF4E1F9C685DD" indent="up1"><enum>(D)</enum><text>the Arlington House—Robert E. Lee
				National Memorial;</text>
								</subparagraph></paragraph><paragraph id="ID83ec4bf270f34a0b90755a6fbe610e98"><enum>(4)</enum><text>the Flight 93
				National Memorial;</text>
							</paragraph><paragraph id="IDde98f3c4f84e4e4b9a2cd8def578c915"><enum>(5)</enum><text>an entrance on
				other route into the Great Smoky Mountains National Park or any part of the
				Park unless fees are charged for entrance into the Park on main highways and
				thoroughfares;</text>
							</paragraph><paragraph id="ID21cac5022b98435bbb26d250e407734f"><enum>(6)</enum><text>an entrance to a
				unit of the National Park System containing a deed restriction on charging
				fees; or</text>
							</paragraph><paragraph id="ID5b0d1c00d4e54cbcbe213c2ec68e1587"><enum>(7)</enum><text>an area or unit
				covered under section 203 of the Alaska National Interest Lands Conservation
				Act (16 U.S.C. 410hh–2), other than the Denali National Park and
				Preserve.</text>
							</paragraph></subsection><subsection id="IDe9cd206de963433d853d8ecf27bfff9e"><enum>(d)</enum><header>Prohibited
				sites</header><text>The Secretary shall not charge a fee under subsection (a)
				for Federal recreational land or water managed by—</text>
							<paragraph id="id7B28AEBFC85E4DC38DD68163E6AC8571"><enum>(1)</enum><text>the Director of
				the Bureau of Land Management; or</text>
							</paragraph><paragraph id="idCCD5FA99DABB4788863EFDD3E28A2F56"><enum>(2)</enum><text>the Commissioner
				of Reclamation.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id98E2936CEE6B4BD78C71D4FA8A421644"><enum>(e)</enum><header>Requirements</header><text>In
				establishing fees pursuant to this section, the Secretary shall—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id8C13E745F9C34921AE4FFDB92BB9FE6C"><enum>(1)</enum><text>establish the
				minimum practicable number of fees; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF1D158F3EC3B4E95850A15050FBA2B1C"><enum>(2)</enum><text>avoid, to the
				maximum extent practicable, collection of multiple or layered fees for a
				variety of activities or programs.</text>
							</paragraph></subsection><subsection id="id0D40EDAACF1A4CE6B081960CE4BA7528"><enum>(f)</enum><header>Analysis</header>
							<paragraph id="idA7BD313D774840E89957CC08F2F67DA9"><enum>(1)</enum><header>In
				general</header><text>Before establishing a fee under subsection (a), the
				Secretary shall analyze—</text>
								<subparagraph id="IDe395cbd440d442ef8eb0fdd6bcd57077"><enum>(A)</enum><text>the benefits and
				services provided to visitors to National Parks;</text>
								</subparagraph><subparagraph id="ID1b1cf15330b349c7bb269007c08524d2"><enum>(B)</enum><text>the cumulative
				effect of the assessment of the fee;</text>
								</subparagraph><subparagraph id="ID6b9b421a05bd43ab8342031d1678a646"><enum>(C)</enum><text>the direct and
				indirect cost and benefit to the Federal Government with respect to the
				fee;</text>
								</subparagraph><subparagraph id="IDcbfc16af3cc4425281e0f9fba3aa04f9"><enum>(D)</enum><text>applicable public
				policy and management objectives;</text>
								</subparagraph><subparagraph id="IDa39c2e2230734040bd54dedb2f412150"><enum>(E)</enum><text>the economic and
				administrative feasibility of fee collection; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID50691de3b2404eb6b7ae5f0a2f78857f"><enum>(F)</enum><text>such other
				factors as the Secretary determines to be appropriate.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4F0997192CB54735A1D9719465B76BB7"><enum>(2)</enum><header>Submission to
				Congress</header><text>Not later than the date that is 90 days before the date
				on which a fee established under subsection (a) is published in the Federal
				Register, the Secretary shall submit to Congress—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id6876E0C95E13463EA3B87EDBC55919BD"><enum>(A)</enum><text>the analysis
				conducted with respect to the fee under paragraph (1); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3BD9296E06DF4A36B0F30E8D44F4A48D"><enum>(B)</enum><text>a description of
				the level of the fee.</text>
								</subparagraph></paragraph></subsection><subsection id="id385700DDDF5F4CEC9A6B19826F63E93B"><enum>(g)</enum><header>Publication</header>
							<paragraph id="idAF363939C72A4546B426D04C60BA8795"><enum>(1)</enum><header>In
				general</header><text>The Secretary shall publish in the Federal Register a
				notice of—</text>
								<subparagraph id="idA9FC5193CEBB461AB0EB2F0450E30C09"><enum>(A)</enum><text>any new fee
				established pursuant to this section; and</text>
								</subparagraph><subparagraph id="id08B2D48865AA4B0C8B1CF0A21CE99C4C"><enum>(B)</enum><text>any change in the
				amount of such a fee.</text>
								</subparagraph></paragraph><paragraph id="idDD0630BD1F7141BEB8B9BC34993016E4"><enum>(2)</enum><header>Effective
				date</header><text>A fee established pursuant to this section, and any
				modification to such a fee, shall not take effect until the date that is 1 year
				after the date on which a notification regarding the fee or modification is
				published in the Federal Register under paragraph (1).</text>
							</paragraph></subsection><subsection id="id2C2165C6E10F45C3AD5BBA6714D285C4"><enum>(h)</enum><header>Administration</header>
							<paragraph id="id9D52DC10F8144871B28CB8596CC8528C"><enum>(1)</enum><header>In
				general</header><text>The Secretary—</text>
								<subparagraph id="idCA30DCB584614A87AB36D70AF9311685"><enum>(A)</enum><text>may waive or
				discount a fee established pursuant to this section, as the Secretary
				determines to be appropriate; and</text>
								</subparagraph><subparagraph id="idE9D6AF2C39CC4C73881A726A572D7ACC"><enum>(B)</enum><text>shall provide
				information to the public regarding any fee program under this section,
				including a description of the costs and benefits of the program.</text>
								</subparagraph></paragraph><paragraph id="id5FF197E90E87492188D0FAED985591E0"><enum>(2)</enum><header>Administrative
				costs</header><text>The Secretary may use not more than 15 percent of the total
				amount of fees collected pursuant to this section for administrative costs of
				the recreation fee program, including—</text>
								<subparagraph id="id8246159375A34DF0923CE3C28EDBEE7A"><enum>(A)</enum><text>direct operating
				or capital costs;</text>
								</subparagraph><subparagraph id="idD1FC45FAB8BB4D6796A1EFFE3C9723E8"><enum>(B)</enum><text>the costs of fee
				collection;</text>
								</subparagraph><subparagraph id="id29B56ACA863C411EBCF5D3EB14619ECF"><enum>(C)</enum><text>the costs of
				notification of fee requirements;</text>
								</subparagraph><subparagraph id="idDF9A796852804BED88EC3F1BD8CFFA88"><enum>(D)</enum><text>the costs of
				direct infrastructure;</text>
								</subparagraph><subparagraph id="id04B747802F0C41B29C850A7AADC158F0"><enum>(E)</enum><text>fee program
				management costs;</text>
								</subparagraph><subparagraph id="id3B871B5D433343ECB7EBF368C9E31B07"><enum>(F)</enum><text>the costs of
				bonding of volunteers;</text>
								</subparagraph><subparagraph id="id8A5A173656CA4007BA29E04E6BB48070"><enum>(G)</enum><text>start-up costs;
				and</text>
								</subparagraph><subparagraph id="id2ECAFDF4979C4A85B3960175E0E96F3E"><enum>(H)</enum><text>the costs of
				analyzing and reporting on program success and effects.</text>
								</subparagraph></paragraph></subsection><subsection id="idF493CC1767474E5CB9C5A1C9DBBB4D2C"><enum>(i)</enum><header>Distribution of
				receipts</header><text>Of amounts received by the Secretary as a result of a
				fee collected at a specific area, site, or facility pursuant to this
				section—</text>
							<paragraph id="idB50A52C9D20D4F5EA1635AA2BB6ABA35"><enum>(1)</enum><text>not less than 80
				percent shall be used at the specific area, site, or facility in accordance
				with subsection (j); and</text>
							</paragraph><paragraph id="id68F3DF4AE588405CBE9C1C37C6367F44"><enum>(2)</enum><text>not more than 20
				percent shall be used for other activities or facilities of the National Park
				Service, as the Secretary determines to be appropriate.</text>
							</paragraph></subsection><subsection id="id8217E5AEEDE24D60A47F78679C6502D8"><enum>(j)</enum><header>Use of
				funds</header><text>Amounts described in subsection (i)(1) may be used at an
				area, site, or facility for—</text>
							<paragraph id="IDb5b17e9272ba48f8ac89bf07257028f1"><enum>(1)</enum><text>repair,
				maintenance, facility enhancement, media services, and infrastructure,
				including projects relating to visitor enjoyment, visitor access, environmental
				compliance, and health and safety;</text>
							</paragraph><paragraph id="IDd0ff12e0b2d1402b8654a1bbae46e445"><enum>(2)</enum><text>interpretation,
				visitor information, visitor service, visitor needs assessments, monitoring,
				and signs;</text>
							</paragraph><paragraph id="ID82381bb9984f41b88fbfde594bacd75a"><enum>(3)</enum><text>habitat
				enhancement, resource assessment, preservation, protection, and restoration
				relating to recreational uses; and</text>
							</paragraph><paragraph id="ID285587970fff4ce0a3e9b7ecdb480707"><enum>(4)</enum><text>law enforcement
				relating to public use and recreation.</text>
							</paragraph></subsection><subsection id="id55238430137844A5A9B67E4C32820104"><enum>(k)</enum><header>Reports</header><text>On
				January 1, 2014, and every 3 years thereafter, the Secretary shall submit to
				Congress a report describing the status of the recreation fee program under
				this section, including—</text>
							<paragraph id="id2CEB774237BF4780A07DC7151C802F9E"><enum>(1)</enum><text>an evaluation of
				the program as conducted at each unit of the National Park System;</text>
							</paragraph><paragraph id="id04CE6F46CC964397AE40DBBCB1B08806"><enum>(2)</enum><text>a description of
				projects funded, activities accomplished, and future projects and programs
				proposed to be conducted using the fees; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE2CD491D6EE74210B0C0ACA3A3D26BDD"><enum>(3)</enum><text>any
				recommendations for modifications to the fee system of the
				Secretary.</text>
							</paragraph></subsection></section><after-quoted-block></after-quoted-block></quoted-block>
			</paragraph><paragraph id="idA83F9EE2C5744529BCE4934DFB9D1280"><enum>(3)</enum><text>in section 813
			 (16 U.S.C. 6812), by striking subsections (e) and (f); and</text>
			</paragraph><paragraph id="idA933AE7A6FE04966817C172075A51A08"><enum>(4)</enum><text>by striking
			 section 814 (16 U.S.C. 6813).</text>
			</paragraph></section><section id="idAFB4C53F275145BAA9EB230873CE902F"><enum>3.</enum><header>Reinstatement of
			 certain admission and use fee authorities</header>
			<subsection id="idF90CAF6C0D2949A9BFBD510235F2EE9D"><enum>(a)</enum><header>Repeal</header><text>Subsections
			 (a), (c), and (d) of section 813 of the Federal Lands Recreation Enhancement
			 Act (16 U.S.C. 6812) are repealed effective December 8, 2004.</text>
			</subsection><subsection id="id942E7B4726544A2499B7400F5DD26CCA"><enum>(b)</enum><header>Applicability</header>
				<paragraph id="id5797D2953FC34BD9A572646A9E3A50F0"><enum>(1)</enum><header>Land and Water
			 Conservation Fund Act of 1965</header><text>Subsections (a) through (f), and
			 (g) of section 4 of the Land and Water Conservation Fund Act of 1965 (16 U.S.C.
			 460<added-phrase reported-display-style="italic">l</added-phrase>–6a) shall be
			 applied and administered as if section 813(a) of the Federal Lands Recreation
			 Enhancement Act (16 U.S.C. 6812(a)) had not been enacted.</text>
				</paragraph><paragraph id="ID4a5e046cc51a41bca8ae4aec543b1f7e"><enum>(2)</enum><header>Admission
			 permits for refuge units</header><text>Section 201 of the Emergency Wetlands
			 Resources Act of 1986 (16 U.S.C. 3911) shall be applied and administered as if
			 section 813(c) of the Federal Lands Recreation Enhancement Act (16 U.S.C.
			 6812(c)) had not been enacted.</text>
				</paragraph><paragraph id="ID19e2a0a28fe44b6b890e20e4603c0238"><enum>(3)</enum><header>Golden eagle
			 passport</header><text>Section 502 of the National Parks Omnibus Management Act
			 of 1998 (16 U.S.C. 5982) shall be applied and administered as if section 813(d)
			 of the Federal Lands Recreation Enhancement Act (16 U.S.C. 6812(d)) had not
			 been enacted.</text>
				</paragraph><paragraph id="IDab404e36f1ed46a7a9d9eb717de7dcfd"><enum>(4)</enum><header>National park
			 passport program</header>
					<subparagraph id="idD52C6D8F592B4AC9A81C599EAC774BDA"><enum>(A)</enum><header>In
			 general</header><text>Title VI of the National Parks Omnibus Management Act of
			 1998 (16 U.S.C. 5991 et seq.) shall be applied and administered as if section
			 813(d) of the Federal Lands Recreation Enhancement Act (16 U.S.C. 6812(d)) had
			 not been enacted.</text>
					</subparagraph><subparagraph id="id01152022F1844F2FBAAB4E45353EB671"><enum>(B)</enum><header>Conforming
			 amendment</header><text>Section 603(c) of the National Parks Omnibus Management
			 Act of 1998 (16 U.S.C. 5993(c)) is amended by striking paragraph (2) and
			 inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="id8EB9FC2769BE4B67A1981641B454C081" style="OLC">
							<paragraph id="id5A5BD32058244B9397F2260291440946"><enum>(2)</enum><header>General
				use</header><text>Of amounts received by the Secretary as a result of sales of
				national park passports at a specific area, site, or facility—</text>
								<subparagraph id="idE375233FF1414982B0FB3751605AA534"><enum>(A)</enum><text>not less than 50
				percent shall remain available for use at the specific area, site, or facility
				at which the sales occurred; and</text>
								</subparagraph><subparagraph id="id13155B5B629D40649123E58A4BB76F2C"><enum>(B)</enum><text>not more than 50
				percent shall be used for other activities or facilities of the National Park
