		  from certain practices in connection with the origination of consumer credit
		  transactions secured by the principal dwelling of the consumer, and for other

		<section id="HAE4EB6669CBB4BBCA92998DFB0716DE0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Fairness for Homeowners Act of
			 2009</short-title></quote>.</text>
		</section><section id="H0FBF04CBE0A64B369DB57AA7137FA0DC"><enum>2.</enum><header>Originations of
			 consumer credit transactions secured by the principal dwelling</header>
			<subsection id="HDE1966B213D5468E871A42B7B20D9485"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Truth in Lending
			 Act (15 U.S.C. 1601 et seq.) is amended by inserting after section 129A the
			 following new section:</text>
				<quoted-block display-inline="no-display-inline" id="HA29208D5A93D46B6AC015B6AB8FA5666" style="OLC">
					<section id="H8E4BC1D1850342DD95F6993A9768FAA8"><enum>129B.</enum><header>Originations
				of consumer credit transactions secured by the principal dwelling</header>
						<subsection id="H50FD20236E1842169038B322FD5078D2"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this section, the following
				definitions shall apply:</text>
							<paragraph id="HD5184344659146A697DA7981F73D9928"><enum>(1)</enum><header>Fully indexed
				rate</header><text display-inline="yes-display-inline">The term <term>fully
				indexed rate</term> means the index rate prevailing at the time that a consumer
				credit transaction secured by the principal dwelling of a consumer is
				originated, plus the margin that will apply after the expiration of any
				introductory interest rate.</text>
							</paragraph><paragraph id="H84B3259F83BD40D7B38C49A8625345CC"><enum>(2)</enum><header>Mortgage
				broker</header><text display-inline="yes-display-inline">The term
				<term>mortgage broker</term> means any person who is defined or licensed as a
				mortgage broker under applicable State law.</text>
							</paragraph></subsection><subsection id="HFC44343421A4415996523E9B1E54E218"><enum>(b)</enum><header>Requirements for
				originators</header>
							<paragraph id="HF1B86D6E072740CB9C65FDF40AF570C1"><enum>(1)</enum><header>Ability to
				pay</header>
								<subparagraph id="H1D7F43A23A8A4D83A8D0205FA69D88D7"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">No creditor or
				mortgage broker may make, provide, or arrange for any consumer credit
				transaction secured by the principal dwelling of a consumer without first
				verifying the reasonable ability of the consumer to pay the scheduled payments
				of, as applicable—</text>
									<clause id="H09D68F1794CC4685ABF6C281406BB1BC"><enum>(i)</enum><text>principal;</text>
									</clause><clause id="HF0DA5F023BD54AD19DBD77F77B3C6A45"><enum>(ii)</enum><text>interest;</text>
									</clause><clause id="HFADFF7EBA61F4472AB566F5B2DFFBB23"><enum>(iii)</enum><text>real estate
				taxes; and</text>
									</clause><clause id="H1E46DBFBEAF64458999192F20591EAD6"><enum>(iv)</enum><text>homeowner
				insurance, assessments, and mortgage insurance premiums.</text>
									</clause></subparagraph><subparagraph id="H2FFFAE4F1B244E639C2A26968A332BF7"><enum>(B)</enum><header>Variable
				interest rate</header><text display-inline="yes-display-inline">In the case of
				any consumer credit transaction secured by the principal dwelling of a consumer
				for which the applicable annual percentage rate may vary over the life of the
				credit, the reasonable ability to pay shall be determined, for purposes of this
				paragraph, on the basis of a fully indexed rate plus 200 basis points and a
				repayment schedule which achieves full amortization over the life of the
				extension of credit.</text>
								</subparagraph><subparagraph id="HFEDF75B0377B407AA09D325196BF7AEA"><enum>(C)</enum><header>Verification of
				consumer income and financial resources</header>
									<clause id="H1BF16A1E0E504BD7A512FF5EC873F7D6"><enum>(i)</enum><header>In
				general</header><text>In the case of any consumer credit transaction secured by
				the principal dwelling of a consumer, the income and financial resources of the
				consumer shall be verified for purposes of this paragraph by tax returns,
				payroll receipts, bank records, or other similarly reliable documents.</text>
									</clause><clause id="HEEDD757D410C4E5090160CF3C46CAF4E"><enum>(ii)</enum><header>Consumer
				statement insufficient</header><text>A statement by a consumer of income or
				financial resources shall not be sufficient to establish the existence of any
				income or financial resources when verifying the reasonable ability of the
				consumer to repay any consumer credit transaction secured by the principal
				dwelling of the consumer for purposes of this paragraph.</text>
									</clause></subparagraph><subparagraph id="HC4725D68F0CE42A5826DC9B539A607DC"><enum>(D)</enum><header>Other
				criteria</header><text display-inline="yes-display-inline">A creditor or
				mortgage broker may rely on additional criteria other than income and financial
				resources to establish the reasonable ability of a consumer to repay any
				consumer credit transaction secured by the principal dwelling of the consumer,
				to the extent such other criteria are also verified through reasonably reliable
				methods and documentation.</text>
								</subparagraph><subparagraph id="H05D61BE0762F478F9CFE4D295760F010"><enum>(E)</enum><header>Equity in
				dwelling not to be taken into account</header><text display-inline="yes-display-inline">The consumer’s equity in the principal
				dwelling that secures or would secure the consumer credit transaction may not
				be used to establish the ability to make the payments described in subparagraph
				(A) with respect to such transaction.</text>
								</subparagraph></paragraph><paragraph id="H55D625E6EC1A4251A213E2D0A896A34B"><enum>(2)</enum><header>Prohibition on
				steering</header>
								<subparagraph id="H5C920FD47CD744CFBFB031B9ED7294D3"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">In connection with a
				credit transaction secured by the principal dwelling, a mortgage broker or
				creditor may not—</text>
									<clause id="HBAD7844646354C5DB17ED49B7ABBBA4A"><enum>(i)</enum><text>steer, counsel, or
				direct a consumer to rates, charges, principal amount, or prepayment terms that
				are more expensive for that which the consumer qualifies; or</text>
									</clause><clause id="H82D18221117948A68BA4DAF458C832B2"><enum>(ii)</enum><text>make, provide, or
				arrange for any consumer credit transaction secured by the principal dwelling
				of a consumer that is more expensive than that for which the consumer
				qualifies.</text>
									</clause></subparagraph><subparagraph id="H6B224E7737974203A1AE5A32B52C1E86"><enum>(B)</enum><header>Duties to
				consumers</header><text display-inline="yes-display-inline">If unable to
				suggest, offer, or recommend to a consumer a home loan that is not more
				expensive than that for which the consumer qualifies, a mortgage originator
				shall—</text>
									<clause id="HB5CBF62C3F3347EC87C304B1236F94C1"><enum>(i)</enum><text display-inline="yes-display-inline">based on the information reasonably
				available and using the skill, care, and diligence reasonably expected for a
				mortgage originator, originate or otherwise facilitate a suitable home mortgage
				loan by another creditor to a consumer, if permitted by and in accordance with
				all otherwise applicable law; or</text>
									</clause><clause id="HFA991212B016414A91D1D6CC51AAF6A6"><enum>(ii)</enum><text display-inline="yes-display-inline">disclose to the consumer—</text>
										<subclause id="H9CBA93D5E07B4CF5B3302A02330E36DF"><enum>(I)</enum><text display-inline="yes-display-inline">that the creditor does not offer a home
				mortgage loan that is not more expensive than a loan for which the consumer
				qualifies, but that other creditors may offer such a loan; and</text>
										</subclause><subclause id="H0A81FE002EDD463CB9456288A39D35C4"><enum>(II)</enum><text display-inline="yes-display-inline">the reasons that the products and services
				offered by the mortgage originator are not available to or reasonably
				advantageous for the consumer.</text>
										</subclause></clause></subparagraph><subparagraph id="H77BBAC25C73D4730A9556F2F978AC721"><enum>(C)</enum><header>Prohibited
				conduct</header><text display-inline="yes-display-inline">In connection with a
				credit transaction secured by the principal dwelling, a mortgage originator may
				not—</text>
									<clause id="H0B8F375A75EC49D0910B926CC498FABF"><enum>(i)</enum><text display-inline="yes-display-inline">mischaracterize the credit history of a
				consumer or the home loans available to a consumer;</text>
									</clause><clause id="HE1BE302ECA0C4D30822AA1ACABFA9EFF"><enum>(ii)</enum><text display-inline="yes-display-inline">mischaracterize or suborn the
				mischaracterization of the appraised value of the property securing the
				extension of credit; and</text>
									</clause><clause id="HD233C4CE75154746A668E082DD4C80FA"><enum>(iii)</enum><text display-inline="yes-display-inline">if unable to suggest, offer, or recommend
				to a consumer a loan that is not more expensive than a loan for which the
				consumer qualifies, discourage a consumer from seeking a home mortgage loan
				from another creditor or with another mortgage originator.</text>
									</clause></subparagraph></paragraph><paragraph id="HF3BB004E75394CE8947D4D5185C74BCB"><enum>(3)</enum><header>Prohibition on
				prepayment penalties</header><text display-inline="yes-display-inline">In the
				case of any consumer credit transaction secured by the principal dwelling of a
				consumer, the transaction may not contain terms under which a consumer is
				required to pay a prepayment penalty for paying all or part of the principal
				before the date on which the principal is due.</text>
							</paragraph></subsection><subsection id="HB8E76C8845F34D289921F59288938CB1"><enum>(c)</enum><header>Limitation on
				financed points, charges, and fees</header>
							<paragraph id="H2D9D304710FD420197007143966C6901"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">No creditor or
				mortgage broker may, in connection with any consumer credit transaction secured
				by the principal dwelling of a consumer, include in the principal amount of
				such transaction any portion of any qualified finance charge in excess of the
				amount which is equal to 5 percent of the principal amount of the
				transaction.</text>
							</paragraph><paragraph id="H3F8199BE50D34B3FA2663114A9676972"><enum>(2)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this subsection, the
				following definitions shall apply:</text>
								<subparagraph id="H54D8A75EEEDE43249D75E2F5EE0B15B2"><enum>(A)</enum><header>Qualified
				finance charge</header><text display-inline="yes-display-inline">The term
				<term>qualified finance charge</term> means the sum of—</text>
									<clause id="H4AD994D0675440D9A782F5020CF4BA18"><enum>(i)</enum><text display-inline="yes-display-inline">the finance charge, as determined under
				section 103(aa)(4); and</text>
									</clause><clause id="H3FB39BC04FFA4B0F9B29FCAD31F9DBCD"><enum>(ii)</enum><text display-inline="yes-display-inline">all compensation paid to a mortgage broker
				from any source in connection with the transaction.</text>
									</clause></subparagraph><subparagraph id="H133858F6A9D649D3AC28F6EAE6BFF110"><enum>(B)</enum><header>Principal
				amount</header><text display-inline="yes-display-inline">The term
				<quote>principal amount</quote> means—</text>
									<clause id="H3A06E6086B7E4CDD8CC14D25C241C3C1"><enum>(i)</enum><text>in
				the case of any consumer credit transaction under an open end credit plan
				secured by the principal dwelling of the consumer, the maximum amount of credit
				that may be extended under the terms of such plan, as determined without taking
				into account any amount included in determining the finance charge under
				section 106; and</text>
									</clause><clause id="H8F3032DCD1184FE68A0FFC24D7F79B01"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of any other consumer credit
				transaction secured by the principal dwelling of a consumer, the face amount of
				the obligation on the note.</text>
									</clause></subparagraph></paragraph><paragraph id="H75F12127ADFA4D0C9A7706010AA3F7B6"><enum>(3)</enum><header>Prohibition on
				excessive finance charges</header>
								<subparagraph id="H7A2EE07C21924C189E50384C3F965149"><enum>(A)</enum><header>Limitation based
				on amount of transaction</header><text display-inline="yes-display-inline">No
				person may, in connection with any consumer credit transaction secured by the
				principal dwelling of a consumer, impose or receive any amount included in
				determining the qualified finance charge for such transaction that exceeds the
				amount which is equal to 5 percent of the principal amount of the
				transaction.</text>
								</subparagraph><subparagraph id="H54F17702438F4792B38A9C6029B0D0E0"><enum>(B)</enum><header>Limitation on
				fee for providing less beneficial terms for consumer</header><text display-inline="yes-display-inline">Except as provided in subparagraph (C), no
				person may provide, and no mortgage originator may receive, directly or
				indirectly, any compensation for originating a consumer credit transaction
				secured by the principal dwelling of a consumer that is more costly than that
				for which the consumer qualifies, or that is based on, or varies with, the
				terms of any home mortgage loan (other than the amount of loan
				principal).</text>
								</subparagraph><subparagraph id="H327D894627F54E11AE527F16FD465F88"><enum>(C)</enum><header>Exception</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (B), a
				mortgage broker may receive compensation in the form of an increased rate, but
				only if—</text>
									<clause id="HD17B516A3CF94922B2B9857DF7011598"><enum>(i)</enum><text display-inline="yes-display-inline">the mortgage broker receives no other
				compensation, however denominated, directly or indirectly, from the consumer,
				creditor, or other mortgage originator;</text>
									</clause><clause id="HCD49F5F5A80D4CF297261261C346A68F"><enum>(ii)</enum><text display-inline="yes-display-inline">the loan does not include discount points,
				origination points, or rate reduction points, however denominated, or any
				payment reduction fee, however denominated;</text>
									</clause><clause id="HEE32A2DED67642AE8D387B67675EB9B4"><enum>(iii)</enum><text display-inline="yes-display-inline">the loan does not include a prepayment
				penalty; and</text>
									</clause><clause id="H6753B035A87F4659A96A540A26DFAB17"><enum>(iv)</enum><text display-inline="yes-display-inline">there are no other closing costs associated
				with the loan, except for fees to government officials or amounts to fund
				escrow accounts for taxes and insurance.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="H642C7B92AA544617A0C57FC95AA75CC8"><enum>(d)</enum><header>Mortgage broker
				duties</header>
							<paragraph id="H664E82EEC08E437882EAB977AC148F2C"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">Any mortgage broker
				acting to obtain or arrange for any consumer credit transaction secured by the
				principal dwelling of a consumer shall owe a duty to the borrower to comply
				with the requirements of paragraph (2).</text>
							</paragraph><paragraph id="id2A37773161B94BE09D8F05B78C00DA67"><enum>(2)</enum><header>Requirements</header><text>Mortgage
				brokers shall—</text>
								<subparagraph id="H8F654C496C07459E9A074C07D1B0A010"><enum>(A)</enum><text display-inline="yes-display-inline">act in the best interest of the consumer
				and in the utmost good faith toward each consumer and shall not compromise a
				consumer’s right or interest in favor of another’s right or interest, including
				a right or interest of the mortgage broker;</text>
								</subparagraph><subparagraph id="HC250BBB4FA514F549F02FB9622BA109F"><enum>(B)</enum><text display-inline="yes-display-inline">not accept, give, or charge any undisclosed
				compensation or realize any undisclosed remuneration, either through direct or
				indirect means, that inures to the benefit of the mortgage broker on an
				expenditure made for the consumer;</text>
								</subparagraph><subparagraph id="H90223B16C6A44616911718E401D155DE"><enum>(C)</enum><text display-inline="yes-display-inline">carry out all lawful instructions given by
				the consumer;</text>
								</subparagraph><subparagraph id="HB3EC369E90DD40988287F82525A90074"><enum>(D)</enum><text display-inline="yes-display-inline">disclose to consumers all material facts of
				which the mortgage broker has knowledge which might reasonably affect the
				rights, interests, or ability of the consumer to receive the intended benefit
				from the consumer credit transaction, but not facts which are reasonably
				susceptible to the knowledge of the consumer;</text>
								</subparagraph><subparagraph id="H2D7AD7BD48A24EA38217397D59F4BD73"><enum>(E)</enum><text display-inline="yes-display-inline">use reasonable care in performing duties;
				and</text>
								</subparagraph><subparagraph id="HA7CE9419794244008D241C0E9F97B863"><enum>(F)</enum><text display-inline="yes-display-inline">account to a consumer for all the money and
				property of the consumer received as agent.</text>
								</subparagraph></paragraph><paragraph id="H60AA675D8C7D4BBB9D83E7E2A01C6422"><enum>(3)</enum><header>Scope</header><text display-inline="yes-display-inline">The duties of the mortgage broker to the
				consumer apply when the mortgage broker is acting in the capacity of mortgage
				broker providing mortgage brokerage services with respect to any consumer
				credit transaction secured by the principal dwelling of the consumer for which
				the broker is not the creditor.</text>
							</paragraph><paragraph id="H59DEDAC105CB4F7E8BE9C67521BADB1E"><enum>(4)</enum><header>Rules of
				construction</header>
								<subparagraph id="HA76FABCDEC0442AA9F6683CCE2DC71E9"><enum>(A)</enum><header>Fees for
				services rendered</header><text display-inline="yes-display-inline">No
				provision of this subsection shall be construed as prohibiting a mortgage
				broker from contracting for or collecting a fee for services actually rendered,
				to the extent that the fee has been disclosed to the consumer in advance of the
				provision of such services and complies with subsection (c)(3).</text>
								</subparagraph><subparagraph id="HDDD010B223AE4A8094F915AC548CDB5C"><enum>(B)</enum><header>Duty of
				broker</header><text display-inline="yes-display-inline">Except as required by
				subsection (b)(2), no provision of this subsection shall be construed as
				requiring a mortgage broker—</text>
									<clause id="H4EC84EB9437C42FDAD90090D72D6195F"><enum>(i)</enum><text display-inline="yes-display-inline">to obtain or arrange for any consumer
				credit transaction secured by the principal dwelling of the consumer on behalf
				of a consumer that contains terms or conditions not available to the mortgage
				broker in the usual course of the business of the mortgage broker; or</text>
									</clause><clause id="H2387F7D55A974AB7815A8DC24C33D286"><enum>(ii)</enum><text display-inline="yes-display-inline">to obtain or arrange for any consumer
				credit transaction secured by the principal dwelling of the consumer from a
				creditor with whom the mortgage broker does not have a business
				relationship.</text>
									</clause></subparagraph></paragraph></subsection><subsection id="HA258EC1166C541F5984246F8B0585C0E"><enum>(e)</enum><header>Independent
				verification of consumer counseling before refinancing special
				mortgages</header>
							<paragraph id="H32A21401DAE24F59A07EA0E56F18170E"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">No creditor or
				mortgage broker may make, provide, or arrange for any consumer credit
				transaction secured by the principal dwelling of the consumer all or a portion
				of the proceeds of which are used to fully or partially pay off a special
				mortgage, unless the borrower has obtained a written certification from an
				authorized independent loan counselor that the borrower has received counseling
				on the advisability of the transaction.</text>
							</paragraph><paragraph id="HD283A643DB534219A152FBC152BA8EA0"><enum>(2)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this subsection, the
				following definitions shall apply:</text>
								<subparagraph id="HAD0FCC4AF3EB426E85E39C989ECBFD79"><enum>(A)</enum><header>Special
				mortgage</header><text display-inline="yes-display-inline">The term
				<term>special mortgage</term> means any consumer credit transaction secured by
				the principal dwelling of a consumer that was originated, subsidized, funded,
				or guaranteed by or through a State, tribal, or local government, or nonprofit
				organization, and that bears 1 or more of the following nonstandard payment
				terms which substantially benefit the consumer:</text>
									<clause id="H9A7E6C4E566C44119CEF971DAD797F2B"><enum>(i)</enum><text display-inline="yes-display-inline">Payments vary with income.</text>
									</clause><clause id="HA8F42E47DE0749C489C160F670CE3CFA"><enum>(ii)</enum><text display-inline="yes-display-inline">Payments of principal or interest are not
				required or can be deferred under specified conditions.</text>
									</clause><clause id="HA9815D345C2342B3A78FDEE6822FA6B9"><enum>(iii)</enum><text display-inline="yes-display-inline">Principal or interest is forgivable under
				specified conditions.</text>
									</clause><clause id="HC1FDC43CD8904AE29D4F72C4C54A91EE"><enum>(iv)</enum><text display-inline="yes-display-inline">Either no interest or an annual interest
				rate of 2 percent or less is charged in connection with the loan.</text>
									</clause></subparagraph><subparagraph id="HADD8A01765854B4CACEDFB37BC1688C8"><enum>(B)</enum><header>Authorized loan
				counselor</header><text display-inline="yes-display-inline">The term
				<term>authorized independent loan counselor</term> means any nonprofit,
				third-party individual or organization providing homebuyer education programs,
				foreclosure prevention services, mortgage loan counseling, or credit counseling
				that is certified by the Secretary of Housing and Urban Development, or
				certified by any State housing agency or nonprofit organization designated by
				such Secretary, for such purposes.</text>
								</subparagraph></paragraph></subsection><subsection id="H06A35A6E6A044B2E8C9ED12F7EDC268E"><enum>(f)</enum><header>Minimum
				financial requirements for mortgage brokers</header><text display-inline="yes-display-inline">No mortgage broker may obtain or arrange
				for any consumer credit transaction secured by the principal dwelling of the
				consumer unless, at all times, the mortgage broker—</text>
							<paragraph id="H82831BF27A2F49A2843226841553E26F"><enum>(1)</enum><text display-inline="yes-display-inline">maintains a minimum net worth, net of
				intangibles, of at least $500,000, as determined in accordance with generally
				accepted accounting principles; or</text>
							</paragraph><paragraph id="H936C48108C594DF09628B2B3C0E77DCB"><enum>(2)</enum><text display-inline="yes-display-inline">maintains a surety bond or irrevocable
				letter of credit in the amount of $50,000.</text>
							</paragraph></subsection><subsection id="H5B072DEBE6C4457F9DE8AD7329CA9116"><enum>(g)</enum><header>Enforcement</header><text display-inline="yes-display-inline">For purposes of providing a cause of action
				for any failure by a mortgage broker to comply with any requirement imposed
				under this section, section 130(a) shall be applied with respect to any such
				failure—</text>
							<paragraph id="HFB884BC6DC4A40B2AC085568A0C32D7D"><enum>(1)</enum><text display-inline="yes-display-inline">by substituting <quote>mortgage
				broker</quote> for <quote>creditor</quote> each place such term appears in such
				section; and</text>
							</paragraph><paragraph id="HD015E6C9F6374F998F850F09483B5168"><enum>(2)</enum><text display-inline="yes-display-inline">by treating all qualified finance charges
				(as defined in subsection (c)(2)(A)) incurred in the origination of any
				consumer credit transaction secured by the principal dwelling of the consumer
				and any compensation paid or payable in violation of subsection (c)(3) as
				actual damages sustained by the consumer as a result of the failure.</text>
							</paragraph></subsection><subsection id="H2E69A933D5354E628D427AA2A33E58FB"><enum>(h)</enum><header>Exclusion of

				section shall not apply with respect to any reverse mortgage

			</subsection><subsection id="HE2E1D8EC8A104238BDDE124EA3C047E2"><enum>(b)</enum><header>Technical and
			 conforming amendments</header><text display-inline="yes-display-inline">The
			 Truth in Lending Act (15 U.S.C. 1601 et seq.) is amended—</text>
				<paragraph id="H6092005D1C1444668F8F790F90663E96"><enum>(1)</enum><text display-inline="yes-display-inline">in section 103(u) (15 U.S.C. 1602(u)), by
			 striking <quote>and the disclosures required by section 129(a)</quote> and
			 inserting <quote>and the provisions of sections 129 and 129B</quote>;</text>
				</paragraph><paragraph id="HEABA5289550B45E4AFDF744185677EE2"><enum>(2)</enum><text display-inline="yes-display-inline">in section 130 (15 U.S.C. 1640), by
			 inserting <quote>or 129B</quote> after <quote>section 129</quote> each place
			 that term appears;</text>
				</paragraph><paragraph id="H1E8279FEC19345B9B1E0B5085F49635B"><enum>(3)</enum><text display-inline="yes-display-inline">in the subsection heading of section 131(d)

				damages</header><text display-inline="yes-display-inline">In a consumer credit
				transaction secured by a principal dwelling, other than a mortgage referred to
				in section 103(aa), an assignee or holder shall be liable for violations of
				this chapter or, of section 129B in a civil action for monetary damages under
				section 130(a), notwithstanding paragraph (1), except that any relief made
				permissible by this subparagraph may not exceed the sum of the amount of any
				remaining indebtedness and the total amount paid by the consumer in connection
				with the transaction.</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HD9361D26334440BAAB170E3A1F176D59"><enum>(5)</enum><text display-inline="yes-display-inline">in section 131 (15 U.S.C. 1641) by adding
			 at the end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HFF9508B135264DEFA15CDE2526322F7C" style="OLC">
						<subsection id="H4B1F727F78AB48DFBD22D228C2CEB969"><enum>(g)</enum><header>Remedy in Lieu
				of Rescission for Certain Violations</header><text display-inline="yes-display-inline">At the election of a consumer entitled to
				rescission for violations of section 129B, any person, including a creditor,
				who holds, purchases, or is otherwise assigned a mortgage or similar security
				interest in connection with a mortgage on a principal dwelling—</text>
							<paragraph id="HF02AFBA5D97944BEA9E0DB6A739184BD"><enum>(1)</enum><text display-inline="yes-display-inline">may be required to make such adjustments to
				the balance of the obligation as are required under section 125, and to reflect
				any other relief pursuant to section 130 and any other legal claims; and</text>
							</paragraph><paragraph id="HA14DF7DD32614507B718CB3C04372D48"><enum>(2)</enum><text display-inline="yes-display-inline">shall modify or refinance the loan, at no
				cost to the consumer, the resulting balance of which shall provide terms that
				would have satisfied the requirements of section 129B at the origination of the
				loan and to pay costs and reasonable attorney
				fees.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H479385479B1E4F34B80CF086BE1C6F67"><enum>(c)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections for chapter 2 of the Truth in Lending Act is amended by inserting
			 after the item relating to section 129A the following new items:</text>
