<official-title display="yes">To provide for the establishment, administration, and funding of Federal Executive Boards, and for other purposes.</official-title>

<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Executive Board Authorization Act of 2009</short-title></quote>.</text> </section>
<section commented="no" display-inline="no-display-inline" id="ID0baa7ccd820c42739990e493581c1ce3" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Federal Executive Boards</header> 
<subsection commented="no" display-inline="no-display-inline" id="id25A71234BAB043DFB472B515A5211886"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Chapter 11 of title 5, United States Code, is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="id72FB8CA915CF4998B4895E6792C6B475" style="USC"> 
<section commented="no" display-inline="no-display-inline" id="ID540084f076a64f78877400e9b11907cf" section-type="subsequent-section"><enum>1106.</enum><header display-inline="yes-display-inline">Federal Executive Boards</header> 
<subsection commented="no" display-inline="no-display-inline" id="ID9d30509c92de40fea2e0946d18d3c1e1"><enum>(a)</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="yes-display-inline">The purposes of this section are to—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="ID650a6760021e4cf4a8d846b81225e2b4"><enum>(1)</enum><text display-inline="yes-display-inline">strengthen the coordination of Government activities;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID429342c436c54d2f9da2df80e4031fe1"><enum>(2)</enum><text display-inline="yes-display-inline">facilitate interagency collaboration to improve the efficiency and effectiveness of Federal programs;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID65c82d94067c470195c42e5cb88d6c06"><enum>(3)</enum><text display-inline="yes-display-inline">facilitate communication and collaboration on Federal emergency preparedness and continuity of operations for the Federal workforce in applicable geographic areas; and</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID7987ac2348394d42bcf31adc25b196a8"><enum>(4)</enum><text display-inline="yes-display-inline">provide stable funding for Federal Executive Boards.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="ID9a63c49abfe540ad90a5e6255920e9cd"><enum>(b)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph commented="no" display-inline="no-display-inline" id="ID09fce57e40474c7494d0578605812501"><enum>(1)</enum><header display-inline="yes-display-inline">Agency</header><text display-inline="yes-display-inline">The term <term>agency</term>—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="idEAC2B62FDDFF4241835B5C0713A2893A"><enum>(A)</enum><text display-inline="yes-display-inline">means an Executive agency as defined under section 105; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id1B304425BBD04D78A1D21AB2D8B3AA50"><enum>(B)</enum><text display-inline="yes-display-inline">shall not include the Government Accountability Office.</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID12a58e47be95491c869af88ca0930d54"><enum>(2)</enum><header display-inline="yes-display-inline">Director</header><text display-inline="yes-display-inline">The term <term>Director</term> means the Director of the Office of Personnel Management.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID4c9ba15710bc42f89de7f7291846e6ea"><enum>(3)</enum><header display-inline="yes-display-inline">Federal Executive Board</header><text display-inline="yes-display-inline">The term <term>Federal Executive Board</term> means an interagency entity established by the Director, in consultation with the headquarters of appropriate agencies, in a geographic area with a high concentration of Federal employees outside the Washington, D.C. metropolitan area to strengthen the management and administration of agency activities and coordination among local Federal officers to implement national initiatives in that geographic area.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="ID91a80eb8194c4f10b994e0cc7d7a5182"><enum>(c)</enum><header display-inline="yes-display-inline">Establishment</header> 
<paragraph commented="no" display-inline="no-display-inline" id="id769826218D2D49F0AEA82AC2848042A1"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Director shall establish Federal Executive Boards in geographic areas outside the Washington, D.C. metropolitan area. Before establishing Federal Executive Boards that are not in existence on the date of enactment of this section, the Director shall consult with the headquarters of appropriate agencies to determine the number and location of the Federal Executive Boards.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id96889D0B5C2848BC848DA43BA0E31EB9"><enum>(2)</enum><header display-inline="yes-display-inline">Membership</header><text display-inline="yes-display-inline">Each Federal Executive Board for a geographic area shall consist of an appropriate senior officer for each agency in that geographic area. The appropriate senior officer may designate, by title of office, an alternate representative who shall attend meetings and otherwise represent the agency on the Federal Executive Board in the absence of the appropriate senior officer. An alternate representative shall be a senior officer in the agency.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="IDcfca3df80ff14b8ca156d1cc2270b787"><enum>(3)</enum><header display-inline="yes-display-inline">Location of Federal Executive Boards</header><text display-inline="yes-display-inline">In determining the location for the establishment of Federal Executive Boards, the Director shall consider—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="ID0b9eedaa1f1c4020ac394a0999f9b9de"><enum>(A)</enum><text display-inline="yes-display-inline">whether a Federal Executive Board exists in a geographic area on the date of enactment of this section;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID3d722e5999134b89b6b23b6871b106d2"><enum>(B)</enum><text display-inline="yes-display-inline">whether a geographic area has a strong, viable, and active Federal Executive Association;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="IDd8b2c7abe7f5461b90c63dbbe76cc7b4"><enum>(C)</enum><text display-inline="yes-display-inline">whether the Federal Executive Association of a geographic area petitions the Director to become a Federal Executive Board; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="IDf934ed800a7a4772a7ffaee8dd33f74d"><enum>(D)</enum><text display-inline="yes-display-inline">such other factors as the Director and the headquarters of appropriate agencies consider relevant.</text> </subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="ID28c18db56f2f4408b315ae6ed51e1d35"><enum>(d)</enum><header display-inline="yes-display-inline">Administration and oversight</header> 
<paragraph commented="no" display-inline="no-display-inline" id="idD7BBD6BF471440B1A2D6EF0A5045D1A4"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Director shall provide for the administration and oversight of Federal Executive Boards, including—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="IDe1465a6e1d744d2784cb3e2b036bc19f"><enum>(A)</enum><text display-inline="yes-display-inline">establishing staffing policies in consultation with the headquarters of agencies participating in Federal Executive Boards;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID7c69f64a9f354bb7b7c573b66a52c036"><enum>(B)</enum><text display-inline="yes-display-inline">designating an agency to staff each Federal Executive Board based on recommendations from that Federal Executive Board;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID3ada862c9eae4c19a7de847804467f07"><enum>(C)</enum><text display-inline="yes-display-inline">establishing communications policies for the dissemination of information to agencies;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="IDcd6ff7ac1e274ca4af9e41abab9a905a"><enum>(D)</enum><text display-inline="yes-display-inline">in consultation with the headquarters of appropriate agencies, establishing performance standards for the Federal Executive Board staff;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="IDa6b280871470467aa25da6ff701b7c96"><enum>(E)</enum><text display-inline="yes-display-inline">developing accountability initiatives to ensure Federal Executive Boards are meeting performance standards; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID4a091e036e5048229ec9e71e241777b8"><enum>(F)</enum><text display-inline="yes-display-inline">administering Federal Executive Board funding through the fund established in subsection (f).</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id808563B7EA204C92AB93172A622148C8"><enum>(2)</enum><header display-inline="yes-display-inline">Staffing</header><text display-inline="yes-display-inline">In making designations under paragraph (1)(B), the Director shall give preference to agencies staffing Federal Executive Boards.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="ID6a7ec97d66a4404da4342fb2868c855c"><enum>(e)</enum><header display-inline="yes-display-inline">Governance and activities</header> 
<paragraph commented="no" display-inline="no-display-inline" id="id99741EDD067A401DB442B4AF44A027E0"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each Federal Executive Board shall—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="IDcded01252fec413ca7a334b557ab0abf"><enum>(A)</enum><text display-inline="yes-display-inline">subject to the approval of the Director, adopt by-laws or other rules for the internal governance of the Federal Executive Board;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID0a22d6e209414d21af4e046bead8d2ab"><enum>(B)</enum><text display-inline="yes-display-inline">elect a Chairperson from among the members of the Federal Executive Board, who shall serve for a set term;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID443b6ae9edac43fa8f12d820573a2d29"><enum>(C)</enum><text display-inline="yes-display-inline">serve as an instrument of outreach for the national headquarters of agencies relating to agency activities in the geographic area;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID73be72b7abdf4c7eab5d0b39de755bc0"><enum>(D)</enum><text display-inline="yes-display-inline">provide a forum for the exchange of information relating to programs and management methods and problems—</text> 
<clause commented="no" display-inline="no-display-inline" id="idBE409D9C836F4CBA8D82874789E78805"><enum>(i)</enum><text display-inline="yes-display-inline">between the national headquarters of agencies and the field; and</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="idFB8B4B72D5B147F3BA7C0649980A6DB4"><enum>(ii)</enum><text display-inline="yes-display-inline">among field elements in the geographic area;</text> </clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID68a51e097008427ca826059c6e265da3"><enum>(E)</enum><text display-inline="yes-display-inline">develop local coordinated approaches to the development and operation of programs that have common characteristics;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="IDb51d9eb3ec2a42049e3b74ebfd457903"><enum>(F)</enum><text display-inline="yes-display-inline">communicate management initiatives and other concerns from Federal officers and employees in the Washington, D.C. area to Federal officers and employees in the geographic area to achieve better mutual understanding and support;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID2fadd37d86014ac0b18b838ac9efa5c6"><enum>(G)</enum><text display-inline="yes-display-inline">develop relationships with State and local governments and nongovernmental organizations to help fulfill the roles and responsibilities of that Board;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID10296d2848e344dfb09c4b0b8cab00d8"><enum>(H)</enum><text display-inline="yes-display-inline">in coordination with appropriate agencies and consistent with any relevant memoranda of understanding between the Office of Personnel Management and such agencies, facilitate communication, collaboration, and training to prepare the Federal workforce for emergencies and continuity of operations; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID931369b409cd49fcab47f71e2535570d"><enum>(I)</enum><text display-inline="yes-display-inline">take other actions as agreed to by the Federal Executive Board and the Director.</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id3290A18C372746B0BE311075C82D4B86"><enum>(2)</enum><header display-inline="yes-display-inline">Coordination of certain activities</header><text display-inline="yes-display-inline">The facilitation of communication, collaboration, and training described under paragraph (1)(H) shall, when appropriate, be coordinated and defined through memoranda of understanding entered into between the Director and headquarters of appropriate agencies.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="ID04063c0867444edb846dc81f7b33df8d"><enum>(f)</enum><header display-inline="yes-display-inline">Funding</header> 
<paragraph commented="no" display-inline="no-display-inline" id="IDb7e09a671b05447b92d831aca5726c10"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment of fund</header><text display-inline="yes-display-inline">The Director shall establish a fund within the Office of Personnel Management for financing essential Federal Executive Board functions—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="idD1ADF5A3FDE742CF92BEF736F4B303D7"><enum>(A)</enum><text display-inline="yes-display-inline">including basic staffing and operating expenses; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idB093801A2B84450BA0CF6520654370BC"><enum>(B)</enum><text display-inline="yes-display-inline">excluding the costs of the Office of Personnel Management relating to administrative and oversight activities conducted under subsection (d).</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID069dabdfd5ef4f08bf6c6b43eea7dd1b"><enum>(2)</enum><header display-inline="yes-display-inline">Deposits</header><text display-inline="yes-display-inline">There shall be deposited in the fund established under paragraph (1) contributions from the headquarters of each agency participating in Federal Executive Boards, in an amount determined by a formula established by the Director, in consultation with the headquarters of such agencies and the Office of Management and Budget.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id2D67D86E10A74B71B674B982468E85F2"><enum>(3)</enum><header display-inline="yes-display-inline">Contributions</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="idAA2D2839AF2244BE9E0F9E7834128205"><enum>(A)</enum><header display-inline="yes-display-inline">Formula</header><text display-inline="yes-display-inline">The formula for contributions established by the Director shall consider the number of employees in each agency in all geographic areas served by Federal Executive Boards. The contribution of the headquarters of each agency to the fund shall be recalculated at least every 2 years.</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="IDc8879d5b772c4040a09ca5e86dff37aa"><enum>(B)</enum><header display-inline="yes-display-inline">In-kind contributions</header><text display-inline="yes-display-inline">At the sole discretion of the Director, the headquarters of an agency may provide in-kind contributions instead of providing monetary contributions to the fund.</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="IDa902b290a5a14f839b1a4cb66e377be3"><enum>(4)</enum><header display-inline="yes-display-inline">Use of excess amounts</header><text display-inline="yes-display-inline">Any unobligated and unexpended balances in the fund which the Director determines to be in excess of amounts needed for essential Federal Executive Board functions shall be allocated by the Director, in consultation with the headquarters of agencies participating in Federal Executive Boards, among the Federal Executive Boards for the activities under subsection (e) and other priorities, such as conducting training.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id68927CB5951143CCA314FF67DB0BA196"><enum>(5)</enum><header display-inline="yes-display-inline">Administrative and oversight costs</header><text display-inline="yes-display-inline">The Office of Personnel Management shall pay for costs relating to administrative and oversight activities conducted under subsection (d) from appropriations made available to the Office of Personnel Management.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="ID5e35f54fb90145129e19e59b63dd979b"><enum>(g)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">The Director shall submit annual reports to Congress and agencies on Federal Executive Board program outcomes and budget matters.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="IDee410addbb9c49228c2f71dee8709859"><enum>(h)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The Director shall prescribe regulations necessary to carry out this section.</text> </subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="idAE2FB20DBD2046B0808417C270218F20"><enum>(b)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Director of the Office of Personnel Management shall submit a report to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Government Reform of the House of Representatives that includes—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="id26A46FE6BF8E4F7C98A02002BB3A73F2"><enum>(1)</enum><text display-inline="yes-display-inline">a description of essential Federal Executive Board functions;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id897E343311954F1B80E77DC105AB6A23"><enum>(2)</enum><text display-inline="yes-display-inline">details of basic staffing requirements for each Federal Executive Board;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id97A450562EF74AC5A7F153D06DD88188"><enum>(3)</enum><text display-inline="yes-display-inline">estimates of basic staffing and operating expenses for each Federal Executive Board; and</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id97BDCA7044264EE9BA0DC16318639761"><enum>(4)</enum><text display-inline="yes-display-inline">a comparison of basic staffing and operating expenses for Federal Executive Boards operating before the date of enactment of this Act and such expenses for Federal Executive Boards after the implementation of this Act.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="ID869601896cc14de7b4044e7714b93857"><enum>(c)</enum><header display-inline="yes-display-inline">Technical and conforming amendments</header><text display-inline="yes-display-inline">The table of sections for chapter 11 of title 5, United States Code, is amended by inserting after the item relating to section 1105 the following:</text>
