		<official-title>To amend title 10, United States Code, to modify certain
		  retirement pay and grade authorities for service performed after eligibility
		  for retirement, and for other purposes.</official-title>

		<section id="idD5DBC71972FC4F6BA40E6F6081977B42" section-type="section-one"><enum>1.</enum><header>Election to receive retired
			 pay for non-regular service upon retirement for service in an active reserve
			 status performed after attaining eligibility for regular retirement</header>
			<subsection id="HA294AAAC808E45E8979174DF92B2A39C"><enum>(a)</enum><header>Election
			 authority; requirements</header><text display-inline="yes-display-inline">Subsection (a) of section 12741 of title
			 10, United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H325D886F04354FB8A262EADF7EFE59C6" style="OLC">
					<subsection id="H96F99468462A4CFCB32B5D13A7719463"><enum>(a)</enum><header>Authority To
				elect To receive reserve retired pay</header><paragraph commented="no" display-inline="yes-display-inline" id="HFA6F5C1F399949CA85AA71A1D0A31CF0"><enum>(1)</enum><text display-inline="yes-display-inline">A person may elect to receive retired pay
				under this chapter, instead of receiving retired or retainer pay under chapter
				65, 367, 571, or 867 of this title, if—</text>
							<subparagraph id="H935E425373D6411BB15D38C4EB639E00" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">the person satisfies the requirements
				specified in paragraphs (1) and (2) of section 12731(a) of this title for
				entitlement to retired pay under this chapter;</text>
							</subparagraph><subparagraph id="HA43B1A5E5E9C434B947890A07D2D486E" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">the person served in an active status in
				the Selected Reserve of the Ready Reserve after becoming eligible for
				retirement under chapter 65, 367, 571, or 867 of this title (without regard to
				whether the person actually retired or received retired or retainer pay under
				one of those chapters);</text>
							</subparagraph><subparagraph id="HC57DDEC0F1014EDB94DAEFD74D55959" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">the person completed not less than two
				years of service in such active status (excluding any period of active
				service); and</text>
							</subparagraph><subparagraph id="H0A489780CD774D8B809B8300FAE6D086" indent="up1"><enum>(D)</enum><text display-inline="yes-display-inline">the service of the person in such active
				status is determined by the Secretary concerned to have been
				satisfactory.</text>
							</subparagraph></paragraph><paragraph id="H49FD479FBD8B4AC0AE80F9AEAAE04767" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary concerned may reduce the
				two-year service requirement specified in paragraph (1)(C) in the case of a
				person who—</text>
							<subparagraph id="H8E32F483D3E34D3EA024858684153943"><enum>(A)</enum><text display-inline="yes-display-inline">completed at least six months of service in
				a position of adjutant general required under section 314 of title 32 or in a
				position of assistant adjutant general subordinate to such a position of
				adjutant general; and</text>
							</subparagraph><subparagraph id="HD6F586D7FCC94C9A9F539EB335F9B455"><enum>(B)</enum><text>failed to complete the minimum two
				years of service solely because the appointment of the person to such position
				was terminated or vacated as described in section 324(b) of title
				32.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H91000B6AA25149D99687BB952317A018"><enum>(b)</enum><header>Actions To
			 effectuate election</header><text>Subsection (b) of such section is amended by
			 striking paragraph (1) and inserting the following new paragraph:</text>
				<quoted-block display-inline="no-display-inline" id="H9C883D1D44504C43A1FE8965AB74368F" style="OLC">
					<paragraph id="H48DA6FBD6AB4452580BC1B36ACEA42D0"><enum>(1)</enum><text display-inline="yes-display-inline">terminate the eligibility of the person to
				retire under chapter 65, 367, 571, or 867 of this title, if the person is not
				already retired under one of those chapters, and terminate entitlement of the
				person to retired or retainer pay under one of those chapters, if the person
				was already receiving retired or retainer pay under one of those chapters;
				and</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H5F54AFD777A64DABB5F32654BCCEBF4B"><enum>(c)</enum><header>Conforming
			 amendment To reflect new variable age requirement for
			 retirement</header><text>Subsection (d) of such section is amended—</text>
				<paragraph id="H278ED66D7DE74EEC988D30EECDDC43B2"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>attains 60 years of age</quote> and inserting <quote>attains
			 the eligibility age applicable to the person under section 12731(f) of this
			 title</quote>; and</text>
				</paragraph><paragraph id="HDB98A60056664804A1637856B759EA"><enum>(2)</enum><text>in
			 paragraph (2)(A), by striking <quote>attains 60 years of age</quote> and
			 inserting <quote>attains the eligibility age applicable to the person under
			 such section</quote>.</text>
				</paragraph></subsection><subsection id="HD709BE0111B24DFE8269FAB88E5A781"><enum>(d)</enum><header>Repeal of
			 restriction on election To receive reserve retired pay</header><text>Section
			 12731(a) of such title is amended—</text>
				<paragraph id="HFA7F217C9E7C478EA63CBBF043F2D782"><enum>(1)</enum><text>by inserting
			 <quote>and</quote> at the end of paragraph (2);</text>
				</paragraph><paragraph id="HE364D7B506A24A41B2C501D3F7663BF4"><enum>(2)</enum><text>by striking
			 <quote>; and</quote> at the end of paragraph (3) and inserting a period;
			 and</text>
				</paragraph><paragraph id="HF3C651763DCC4F63A7AAB3A4381EE221"><enum>(3)</enum><text>by striking
			 paragraph (4).</text>
				</paragraph></subsection><subsection id="H42034DE0CA2D4500A1578E67928C00F3"><enum>(e)</enum><header>Clerical
			 amendments</header>
				<paragraph id="H8368296352C940C39B641DA0CBCA1215"><enum>(1)</enum><header>Section
			 heading</header><text display-inline="yes-display-inline">The heading for
			 section 12741 of such title is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H2E4A7C98A1294E94AD2612755BE02E13" style="USC">

				</paragraph><paragraph id="H4D57827D107847F789D0B874DA1762E2"><enum>(2)</enum><header>Table of
			 sections</header><text>The table of sections at the beginning of chapter 1223
			 of such title is amended by striking the item relating to section 12741 and
			 inserting the following new item:</text>

							<toc-entry level="section">12741. Retirement for service in an active

						<after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H9B09F2E721A14A35A752D1965B11CCDB"><enum>(f)</enum><header>Retroactive
			 applicability</header><text>The amendments made by this section shall take
			 effect as of January 1, 2008.</text>
			</subsection></section><section id="HC6195584B3C44877B3C4B0F1E5ABF8FE" section-type="subsequent-section"><enum>2.</enum><header>Recomputation of
			 retired pay and adjustment of retired grade of Reserve retirees to reflect
			 service after retirement</header>
			<subsection id="H4E2483FC3FFF41C3AA7FBA1700D6F5FB"><enum>(a)</enum><header>Recomputation</header><text display-inline="yes-display-inline">Section 10145 of title 10, United States
			 Code, is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="HE40672DE88754501A0A8C0AEA29EB09F" style="OLC">
					<subsection id="H2BA00EEB58344C5592F3D178C6B0009F"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H76DC5023ADC64A1A98316246D9EBF767"><enum>(1)</enum><text>If a member of the
				Retired Reserve is recalled to an active status under subsection (d) in the
				Selected Reserve of the Ready Reserve and completes not less than two years of
				service in such active status, the member is entitled to—</text>
							<subparagraph id="HD18BEBA69B6849788C2ED838C75813AA" indent="up1"><enum>(A)</enum><text>the recomputation of the retired pay
				of the member determined under section 12739 of this title; and</text>
							</subparagraph><subparagraph id="HC20440A9C9D541D5905D4EBDC4273DC" indent="up1"><enum>(B)</enum><text>in the case of a commissioned officer,
				an adjustment in the retired grade of the member in the manner provided in
				section 1370 of this title.</text>
							</subparagraph></paragraph><paragraph id="HDD5D4C3C81FD4C3AAAA187B85073D6F0" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary concerned may reduce the
				two-year service requirement specified in paragraph (1) in the case of a member
				who—</text>
							<subparagraph id="H001E89941834489480A5C687F6004803"><enum>(A)</enum><text>is recalled to serve in a position of
				adjutant general required under section 314 of title 32 or in a position of
				assistant adjutant general subordinate to such a position of adjutant
				general;</text>
							</subparagraph><subparagraph id="H51A2696D86D8491AAFCB8465ACED851E"><enum>(B)</enum><text>completes at least six months of
				service in such position; and</text>
							</subparagraph><subparagraph id="H2E50685AFF8E45FDB400D7F6AE8114E8"><enum>(C)</enum><text>fails to complete the minimum two
				years of service solely because the appointment of the member to such position
				is terminated or vacated as described in section 324(b) of title
				32.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H80EDF89B56444DA48953A600219D443B"><enum>(b)</enum><header>Retroactive
			 applicability</header><text>The amendment made by this section shall take
			 effect as of January 1, 2008.</text>
