		<official-title>To amend the Public Health Service Act to improve the
		  National Program of Cancer Registries by expanding data collection and allowing
		  data sharing for public health objectives, while preserving the confidentiality
		  of patients, and for other purposes. </official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Improvement of the National
			 Program of Cancer Registries Act</short-title></quote>.</text>
		</section><section id="idDDBC0D198C6F4EE9A81E6A4DBDC4C61E"><enum>2.</enum><header>Findings and
			 purpose</header>
			<subsection id="id84E5C617B04941A68B65696E9020B2B8"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds as follows:</text>
				<paragraph id="id77BDFF8A92FC45C6BE06C4C8C6254A76"><enum>(1)</enum><text>The National
			 Program of Cancer Registries, established in 1992 by the Cancer Registries
			 Amendment Act (Public Law 102–515; 106 Stat. 3372), has enabled each of the 50
			 States to maintain a functioning cancer registry.</text>
				</paragraph><paragraph id="idAF5F77050B384BB980B182BF46E85AF7"><enum>(2)</enum><text>Over the past 15
			 years, the Centers for Disease Control and Prevention has enhanced central
			 cancer registries and helped to establish standards for quality and
			 completeness of such registries.</text>
				</paragraph><paragraph id="idB17128A4E4CA4AA78C295EC9A57D3090"><enum>(3)</enum><text>The statewide,
			 population-based cancer registries collect information on cancer incidence and
			 mortality rates, which may be used for identifying cancer patterns and trends
			 and for directing cancer control interventions.</text>
				</paragraph><paragraph id="idEE213D9746354060AA78D9DA27CA1591"><enum>(4)</enum><text>The States rely
			 on electronic records, especially electronic laboratory records, for the
			 majority of data collection for the cancer registries.</text>
				</paragraph><paragraph id="id4B9AFBB3D6704F878D6A4F63E6651477"><enum>(5)</enum><text>The States do not
			 have adequate resources to access all of the records of physicians, hospitals,
			 outpatient clinics, nursing homes, and other agencies providing services to
			 cancer patients that would assist in identifying characteristics of each
			 patient and treatment of the cancer.</text>
				</paragraph><paragraph id="id1E083C1F76F3420E87685ADDB707B1C6"><enum>(6)</enum><text>Laboratories do
			 not systematically collect or record essential data, including information on
			 the occupation, socioeconomic status, or treatments of, or environmental
			 factors affecting, cancer patients, and thus cancer registries, which depend in
			 part upon records of laboratories, do not have essential data that would help
			 determine causes or contributory causes of cancers.</text>
				</paragraph><paragraph id="id3D6FFBB8936A47488E073B6A6923415C"><enum>(7)</enum><text>The National
			 Program of Cancer Registries has established standards for collecting
			 information but has not established standards that allow data exchange with
			 other disease registries.</text>
				</paragraph><paragraph id="id54147F1276384A53A3F225765D475F5A"><enum>(8)</enum><text>Information
			 collected by cancer registries must be exchanged with other disease registries
			 in a confidential and secure manner in order to prevent information about
			 patients from being used for purposes other than medical treatment, medical
			 research, or public health.</text>
				</paragraph></subsection><subsection id="id6AF5E31D0D8B4B88AB8F76C9DEEA24E3"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of this Act is to improve the National Program of Cancer Registries by
			 expanding the data elements collected, enhancing the quality of information
			 collected, and collecting data such that the National Program of Cancer
			 Registries preserves the confidentiality of patients while allowing data
			 sharing for public health objectives.</text>
			</subsection></section><section id="id872CFAB67DDB442D8EF17C0FC4DFD8AB"><enum>3.</enum><header>Amendments to
			 the National Program of Cancer Registries</header>
			<subsection id="id5811EB9A1DDC49C8911EE81F397B00C3"><enum>(a)</enum><header>Enhancing data
			 collection</header><text>Section 399B(a)(1) of title III of the Public Health
			 Service Act (42 U.S.C. 280e(a)(1)) is amended—</text>
				<paragraph id="id5F332026DEA249F49F22BDC036878584"><enum>(1)</enum><text>in the matter
			 preceding subparagraph (A), by striking <quote>registries to collect, for each
			 condition specified in paragraph (2)(A), data concerning</quote>, and inserting
			 <quote>cancer registries in order to collect, for each form of in-situ and
			 invasive cancer (with the exception of basal cell and squamous cell carcinoma
			 of the skin), data in a standardized manner concerning</quote>;</text>
				</paragraph><paragraph id="idC95C46CA6C704ACCAC58A0BF15E7BBB5"><enum>(2)</enum><text>by striking
			 subparagraph (B) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id3E821F813AB74F338B5AE6037AA205E8" style="OLC">
						<subparagraph id="idB8EB9F03F6C2424CAD8FBDE7D517C2A7"><enum></enum><text>(B)
				information on the industrial or occupational history of adult individuals with
				the cancers, using the Federal Standard Occupational Classification
				system;</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id52BD7C470F274D1E85BF0A5BF37C9A95"><enum>(3)</enum><text>in subparagraph
			 (D), by striking <quote>and</quote> after the semicolon;</text>
				</paragraph><paragraph id="id16578EE19CB449CE94BF0D613C2AF2DC"><enum>(4)</enum><text>by inserting
			 after subparagraph (D) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id36A66A0F0AFB4D23947BF9837CAB0B94" style="OLC">
						<subparagraph id="idBFB559DB0A4A444DA4D7DC077A9BDE00"><enum>(E)</enum><text>the highest level
				of education attained by adult individuals with the cancers;</text>
						</subparagraph><subparagraph id="id24BDAD760BB140A78FB1C820B1BCFA45"><enum>(F)</enum><text>sources of
				payment by individuals with cancer for costs associated with cancer diagnosis
				and treatment;</text>
						</subparagraph><subparagraph id="id291F85805FFA4967A8D069A922A0A97D"><enum>(G)</enum><text>history of
				alcohol and tobacco use by individuals with cancer;
				and</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id53DA27E754E640F2AE690F7A6B4E46B3"><enum>(5)</enum><text>by redesignating
			 subparagraph (E) as subparagraph (H).</text>
				</paragraph></subsection><subsection id="idF14A32C0F4BA4AE1B609357594AEE1F6"><enum>(b)</enum><header>Establishing
			 data collection standards</header><text>Section 399B of title III of the Public
			 Health Service Act (42 U.S.C. 280e) is amended by inserting at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idEA24454136254E7CABD7D5525167F5D9" style="OLC">
					<subsection id="idE3F707CD4A304CBD929FB58C37B6AA04"><enum>(f)</enum><header>Data collection
				standards</header>
						<paragraph id="id725EB7A0AD124B5ABECD204C08B02EA4"><enum>(1)</enum><header>In
				general</header><text>The Secretary, acting through the Director of the Centers
				for Disease Control and Prevention, shall—</text>
							<subparagraph id="idB14903A389944BFA873588542DAB89C0"><enum>(A)</enum><text>develop standards
				for collection of each data element for the State cancer registries assisted
				under this section;</text>
							</subparagraph><subparagraph id="idD8ECAED581C446D1AF6070A77B314534"><enum>(B)</enum><text>develop
				inter-operability and security standards for data exchange and integration
				between—</text>
								<clause id="idD5F5D9C18A5F4C008A5E4DD9EF1B754A"><enum>(i)</enum><text>the cancer
				registries of 2 or more States; and</text>
								</clause><clause id="idD2C90DECCE004637AD9C9029654D07D2"><enum>(ii)</enum><text>any cancer
				registry and another Federal registry for non-cancer diseases that contains
				data concerning individual patients; and</text>
								</clause></subparagraph><subparagraph id="id15CB038DE4E44304B93B43676FEB8B05"><enum>(C)</enum><text>provide a basic
				electronic collection tool, to facilitate standardized data collection,
				available to each State to use for cancer registries.</text>
							</subparagraph></paragraph><paragraph id="id8D350F83DDF94B8A812F6093818085E2"><enum>(2)</enum><header>Assurances</header><text>Each
				applicant, prior to receiving Federal funds under the
				<short-title>Improvement of the National Program of Cancer
				Registries Act</short-title>, shall provide assurances satisfactory to the
				Secretary that the applicant will comply with standards developed under
				paragraph (1).</text>
						</paragraph><paragraph id="idFAD0992283ED41E384361D917B436D42"><enum>(3)</enum><header>Coordination
				with other Federal programs</header><text>To promote the greatest possible
				efficiency and effectiveness in the collection of data for federally-supported
				cancer registries, the Secretary shall facilitate appropriate coordination of
				the National Program of Cancer Registries under this part with other
				federally-supported registry programs, including infectious disease registries,
				environmental disease registries, and other non-cancer, chronic disease
				registries.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="idCFB343BE287C4396995D8DB28F8870AD"><enum>4.</enum><header>Authorization</header><text display-inline="no-display-inline">To carry out this Act, there are authorized
			 to be appropriated $100,000,000 for each of the fiscal years 2010, 2011, 2012,
			 and 2013.</text>
