		<official-title>To direct the Secretary of Transportation to carry out
		  programs and activities to improve highway safety.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Surface Transportation Safety Act
			 of 2009</short-title></quote>.</text>
		</section><section id="id5CAE327488264523A850F4456500A5CE" section-type="subsequent-section"><enum>2.</enum><header>Worker injury
			 prevention and free flow of vehicular traffic</header><text display-inline="no-display-inline">The Secretary of Transportation shall modify
			 regulations issued pursuant to section 1402 of the Safe, Accountable, Flexible,
			 Efficient Transportation Equity Act: A Legacy for Users (23 U.S.C. 401 note;
			 119 Stat. 1227) to allow fire services personnel that are subject to the
			 regulations to wear apparel meeting the high visibility requirements set forth
			 in NFPA 1971–2007 (Standard on Protective Ensembles for Structural Fire
			 Fighting and Proximity Fire Fighting) in lieu of apparel meeting the
			 requirements set forth in ANSI/ISEA 107–2004.</text>
		</section><section id="id40DCE50C8A3C445CA3E80923E12F0411" section-type="subsequent-section"><enum>3.</enum><header>Positive protective
			 devices</header><text display-inline="no-display-inline">Not later than 60 days
			 after the date of enactment of this Act, the Secretary of Transportation shall
			 modify section 630.1108(a) of title 23, Code of Federal Regulations, to ensure
			 that—</text>
			<paragraph id="id1BC2B454EE054FA6BB991D613D915C9A"><enum>(1)</enum><text display-inline="yes-display-inline">at a minimum, positive protective measures
			 are used to separate workers on highway construction projects from motorized
			 traffic in all work zones conducted under traffic in areas that offer workers
			 no means of escape (e.g., tunnels, bridges, etc.), unless an engineering
			 analysis determines otherwise;</text>
			</paragraph><paragraph id="id281C80C62F464719894F1FF39D20CF7F"><enum>(2)</enum><text display-inline="yes-display-inline">temporary longitudinal traffic barriers are
			 used to protect workers on highway construction projects in stationary work
			 zones lasting 2 weeks or more when the project design speed is 45 miles per
			 hour or greater and the nature of the work requires workers to be within one
			 lane-width from the edge of a live travel lane, unless—</text>
				<subparagraph id="id4F05986A88B448BFB794E5719CEA7C9C"><enum>(A)</enum><text display-inline="yes-display-inline">an engineering analysis determines
			 otherwise, or</text>
				</subparagraph><subparagraph id="idAC18FCF0C5CC43C594B05DC465718287"><enum>(B)</enum><text display-inline="yes-display-inline">the project is located in a State with a
			 population density of 20 or fewer persons per square mile and the project is
			 outside of an urbanized area and the road’s annual average daily traffic (AADT)
			 load is less than 100 vehicles per hour; and</text>
				</subparagraph></paragraph><paragraph id="id4C0AF49E109347AF85E865159B3C68FD"><enum>(3)</enum><text display-inline="yes-display-inline">when positive protective devices are
			 necessary for highway construction projects, these devices are paid for on a
			 unit pay basis, unless doing so would create a conflict with innovative
			 contracting approaches, such as design-build or some performance-based
			 contracts where the contractor is paid to assume a certain risk allocation and
			 payment is generally made on a lump sum basis.</text>
			</paragraph></section><section id="id83EAA4EA34D54A7EA9C3F7D6C4A22475"><enum>4.</enum><header>Use of patented
			 or proprietary items to further state strategic highway safety
			 plans</header><text display-inline="no-display-inline">Section 112 of title 23,
			 United States Code, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id6FD11D832A6742D7BBB456C3A5729B0F" style="OLC">
				<subsection id="id8D19754DBCFA400F9607CFDBCEEE380C"><enum>(h)</enum><header>Use of patented
				or proprietary items To further state strategic highway safety plans</header>
					<paragraph id="idF19778486E384CE2A546FC79C376B899"><enum>(1)</enum><text>The Secretary
				shall approve the use of Federal funds made available to carry out this chapter
				in the payment of patented or proprietary items if the State transportation
				department certifies, based on the documented analysis and professional
				judgment of qualified State transportation officials, that—</text>
						<subparagraph id="id6CF5D1BDF77F4BBF8BDE3A005E245698"><enum>(A)</enum><text>the patented or
				proprietary item will contribute to the accomplishment of one or more goals set
				forth in the State's strategic highway safety plan;</text>
						</subparagraph><subparagraph id="id3A554C3C5485446C8426C1A735A54B7A"><enum>(B)</enum><text>no equally
				suitable alternative item exists;</text>
						</subparagraph><subparagraph id="idA30ABBF3A06C4F218B4273A7DAA2A9FA"><enum>(C)</enum><text>any specified
				patented or proprietary item will be clearly identified as a patented or
				proprietary item in bid documents; and</text>
						</subparagraph><subparagraph id="id2C7F5BA7DF2E4CE69CA13AFE5D2C52A4"><enum>(D)</enum><text>any patented or
				proprietary item specified pursuant to this certification will be available in
				sufficient quantity to complete any project identified in bid documents.</text>
						</subparagraph></paragraph><paragraph id="id8DF4CE356B3F495AA777B33438477FAD"><enum>(2)</enum><text>The authority to
				utilize patented or proprietary items provided in paragraph (1) is in addition
				to authority to utilize such products that exists under this section and under
				23 CFR 635.411 as in effect on March 2, 2009. The Secretary may not revise said
				regulation to reduce authority to utilize patented or proprietary
				items.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id7BD4F6B4943E4E96B92484391AC94886"><enum>5.</enum><header>Minimum level or
			 retroreflectivity for pavement markings</header><text display-inline="no-display-inline">Not later than October 1, 2010, the
			 Secretary of Transportation shall revise the Manual on Uniform Traffic Control
			 Devices to include a standard for a minimum level of retroreflectivity that
			 must be maintained for pavement markings, which shall apply to all roads open
			 to public travel.</text>
		</section><section id="id9AFBA15AA00E463CAAEBF62381A471FC"><enum>6.</enum><header>Highway safety
			 improvement program</header>
			<subsection id="idB9AB4CCFC626480A81439BD3271892D6"><enum>(a)</enum><header>Highway Signs
			 and Pavement Markings</header><text>Section 148(a)(3)(B)(xi) of title 23,
			 United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id146D96007AE4423A8D62287B76F6AEDC" style="OLC">
					<clause id="id9BBAF8C8AD1B4174BEE5932044A89966"><enum>(xi)</enum><text>Installation,
				replacement, and upgrade of highway signs and pavement markings, including any
				upgrade of materials and the implementation of any assessment or management
				method designed to meet a State-established performance standard, Federal
				regulation, or requirement contained in the Manual on Uniform Traffic Control
				Devices relating to minimum levels of
				retroreflectivity.</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idF3081AD74A2941F58EE2A686734717DF"><enum>(b)</enum><header>Maintaining
			 Minimum Levels of Retroreflectivity</header>
				<paragraph id="id6EC17F94082F49A09783BFD4E7BF907F"><enum>(1)</enum><text>23 U.S.C. 148(a)
			 is amended by adding at the end thereof the following paragraph—</text>
					<quoted-block display-inline="no-display-inline" id="id806B7BE365914401922427BD1E349A82" style="OLC">
						<paragraph id="idFA01CDD057134D4C894D783EA84D796B"><enum>(7)</enum><header>Project To
				maintain minimum levels of retroreflectivity</header><text>The term
				<term>project to maintain minimum levels of retroreflectivity</term> means a
				project undertaken pursuant to provisions of the Manual on Uniform Traffic
				Control Devices requiring public agencies to use an assessment or management
				method that is designed to maintain highway sign or pavement marking
				retroreflectivity at or above prescribed minimum
				levels.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id58F03D0ADE2F4666AF08AB3FDF6FBB1C"><enum>(2)</enum><text>23 U.S.C.
			 148(d)(1) is amended by striking <quote>(B)</quote> and inserting in lieu
			 thereof <quote>(C)</quote> and by inserting between subparagraphs (A) and (C),
			 as redesignated herein, the following—</text>
					<quoted-block display-inline="no-display-inline" id="id6A33BE319E4F413697CBD30ECEF29254" style="OLC">
						<subparagraph id="id9004AB92DCF5427C8462C15284BB9D9F"><enum>(B)</enum><text>any project to
				maintain minimum levels of retroreflectivity on any public road, whether or not
				such project is included in the State strategic highway safety plan;
				or</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id1AABD3D0F1104CE995B07D885C5E1F97"><enum>(3)</enum><text>23 U.S.C.
			 120(c)(1) is amended by inserting after <quote>signalization,</quote> the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id605899F5966B49499BBE302E5EAF37C0" style="OLC">
						<quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">maintaining minimum levels of
				retroreflectivity of highway signs or pavement
				markings,</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="idF5B4566FEE4443DABC190CCFBBE9D517"><enum>7.</enum><header>Roadway safety
			 improvement program for older drivers and pedestrians</header>
			<subsection id="idC17F213E2AC149CB807E21CF7B01F707"><enum>(a)</enum><header>In
			 General</header><text>The Secretary of Transportation shall carry out a program
			 to improve traffic signs and pavement markings in all States (as such term is
			 defined in section 101 of title 23, United States Code) in a manner consistent
			 with the recommendations included in the publication of the Federal Highway
			 Administration entitled <quote>Guidelines and Recommendations to Accommodate
			 Older Drivers and Pedestrians (FHWA–RD–01–103)</quote> and dated October
			 2001.</text>
			</subsection><subsection id="id27291A0E42E649FCB89B07FA186B56FE"><enum>(b)</enum><header>Apportionment
			 of Funds</header><text>On October 1 of each fiscal year, the Secretary shall
			 apportion sums authorized to be appropriated to carry out this section for such
			 fiscal year among the several States using the overall formula share for each
			 State for fiscal year 2009 for all funds subject to section 105 of title 23,
			 United States Code, including equity bonus funds, obtained after application of
			 said section 105 for such fiscal year.</text>
			</subsection><subsection id="id85EC52156F9E43EC98642970832030F7"><enum>(c)</enum><header>Federal
			 Share</header><text>The Federal share of the cost of a project carried out
			 under this section shall be determined in accordance with section 120 of title
			 23, United States Code.</text>
			</subsection><subsection id="id21C92AD68DAA442AA6F51191F0CCF7F6"><enum>(d)</enum><header>Authorization
			 of Appropriations</header><text>There is authorized to be appropriated out of
			 the Highway Trust Fund (other than the Mass Transit Account) $90,000,000 to
			 carry out this section for each of fiscal years 2010 through 2014.</text>
			</subsection><subsection id="id1DACA96C17AA405385F691264D90D961"><enum>(e)</enum><header>Applicability
			 of Title 23</header><text>Funds made available to carry out this section shall
			 be available for obligation in the same manner as if such funds were
			 apportioned under chapter 1 of title 23, United States Code.</text>
			</subsection></section><section id="id20C749ADE3DA4097B4A00A438DA3AAEA"><enum>8.</enum><header>Rail-Highway
			 grade crossings</header>
			<subsection id="idBB8A5705EE22409BBE97CFD77F201B2A"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idA2B9CD9690884C28AF2DF66905C018A2"><enum>(1)</enum><header>Transparency of State
			 Survey and Schedule of Railway-Highway Grade Crossings</header><text>Section
			 130(d) of title 23, United States Code, is amended by adding at the end the
			 following: <quote>Each State shall make surveys and schedules compiled under
			 this subsection available to the public through the Internet Web site of the
			 State.</quote>.</text>
				</paragraph><paragraph id="id090FFFF4AA6D4AF8B5448C13F92F26C1" indent="up1"><enum>(2)</enum><text>The effective date of this subsection
			 shall be 180 days after the date of enactment of this subsection.</text>
				</paragraph></subsection><subsection id="idCB3BC429485B43ABB59A64DA922B9F96"><enum>(b)</enum><header>Authorization
			 of Appropriations</header><text>There is authorized to be appropriated out of
			 the Highway Trust Fund (other than the Mass Transit Account) to carry out
			 section 130 of title 23, United States Code, $220,000,000 for each of fiscal
			 years 2010 through 2014.</text>
			</subsection><subsection id="idB0CD1A8B61EE476EB97CA3528CB2D219"><enum>(c)</enum><header>Conforming
			 Amendments</header><text>Section 130 of title 23, United States Code, is
			 amended—</text>
				<paragraph id="id5CAF9EC9C3B84D97A63B94336FC26363"><enum>(1)</enum><text>in subsection
			 (e)(1) by striking the first sentence; and</text>
				</paragraph><paragraph id="id99EB467325864944B5B12008F4415F92"><enum>(2)</enum><text>in subsections
			 (f)(1) and (f)(3) by striking <quote>set aside</quote> and inserting
			 <quote>made available</quote>.</text>
				</paragraph></subsection></section><section id="idB6A046EED369493592B5524CFB1AB96D"><enum>9.</enum><header>Review of safety
			 of rail-highway grade crossings</header>
			<subsection id="id187578CD0560460E801155894681EA94"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">The Secretary of
			 Transportation shall conduct a comprehensive review of the safety of all
			 highway-rail grade crossings in the United States.</text>
			</subsection><subsection id="id2A005D65B7CE46D8893D6632A2C7C2B8"><enum>(b)</enum><header>Method</header><text display-inline="yes-display-inline">In reviewing the safety of a highway-rail
			 grade crossing under subsection (a), the Secretary shall—</text>
				<paragraph id="idA048866A3EEB4E39ADC2DF7052970B92"><enum>(1)</enum><text display-inline="yes-display-inline">assess, at a minimum, safety conditions,
			 average daily traffic, proximity to schools, past accidents, fatalities, and
			 possible safety improvements; and</text>
				</paragraph><paragraph id="id2E8F2264827E47D5B43C3D67F3A38581"><enum>(2)</enum><text display-inline="yes-display-inline">determine the best method for making the
			 crossing safer, including closings, grade separations, installation of
			 protective devices, or other methods.</text>
				</paragraph></subsection><subsection id="id79CC9A7A06994A028277AD21AF05E684"><enum>(c)</enum><header>Priority
			 List</header><text display-inline="yes-display-inline">Based on the information
			 collected in conducting the comprehensive review under subsection (a), the
			 Secretary shall compile, maintain, and submit to Congress a list of the 10
			 highway-rail grade crossings in each State that have the greatest need for
			 safety improvements.</text>
			</subsection><subsection id="id5C568DFB719C4895B78EAD76D0A78267"><enum>(d)</enum><header>Inclusion in
			 Rail-Highway Grade Crossing Database</header><text display-inline="yes-display-inline">The Secretary shall include the information
			 collected in conducting the comprehensive review under subsection (a), and the
			 priority list submitted under subsection (c), in the national database on the
			 safety of highway-rail grade crossings required under section 20156(a) of title
			 49, United States Code, as added by section 10 of this Act.</text>
			</subsection><subsection id="id769F58F8E3A64D5F97246EC3DC70725E"><enum>(e)</enum><header>Update</header><text display-inline="yes-display-inline">The Secretary shall update the
			 comprehensive review under subsection (a) at least once every 4 years.</text>
			</subsection><subsection id="id2D82AD410C5E4272A7E84E3AEF862C4A"><enum>(f)</enum><header>Availability of
			 Information</header><text display-inline="yes-display-inline">The Secretary
			 shall make priority lists and databases compiled under this section available
			 to the public through the Internet Web site of the Department of
			 Transportation.</text>
			</subsection><subsection id="idA63D8F20846E4CF1A682060F748EE092"><enum>(g)</enum><header>Limitation on
			 Use of Data in Judicial Proceedings</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 any report, review, survey, schedule, list, data, or information or document of
			 any kind compiled or collected pursuant to this section, including but not
			 limited to for the purpose of identifying, evaluating, or planning the safety
			 enhancement of a potential accident site or railway-highway crossing pursuant
			 to this section shall not be subject to discovery or admitted into evidence in
			 a Federal or State court proceeding or considered for other purposes in any
			 action for damages arising from any occurrence at a location mentioned or
			 addressed in such report, review, survey, schedule, list, or data.</text>
			</subsection></section><section id="idE5D53A34C891427E83471CF0F0BADAD2"><enum>10.</enum><header>Rail-Highway
			 grade crossing safety</header>
			<subsection id="id0506A3E592A14DC8B45A45CCDEA56D67"><enum>(a)</enum><header>Highway-Rail
			 Grade Crossing Safety</header><text display-inline="yes-display-inline">Subchapter II of chapter 201 of title 49,
			 United States Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id3E86DC1080674848A38CD063C30AD4CB" style="OLC">
					<section id="idF72E83BF057D469688CEFB96EE049B19"><enum>20156.</enum><header>Rail-Highway
				grade crossing safety information</header>
						<subsection id="id96D4C77997F94A92AD37676A20CCB538"><enum>(a)</enum><header>Establishment
				of Database</header><text>The Secretary of Transportation shall establish and
				maintain a national database of information on the safety of highway-rail grade
				crossings in the United States.</text>
						</subsection><subsection id="idFEAF3F8D7E0849718FC8A0BC9CDD1C69"><enum>(b)</enum><header>Accident and
				Incident Reports To Be Included in Database</header><text>The Secretary shall
				include in the database under subsection (a) information from incident reports
				filed with the Federal Railroad Administration regarding accidents and other
				safety-related incidents that have occurred at highway-rail grade
				crossings.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id096D49C45A24472DBED9D9F4D8DE1BA4"><enum>(b)</enum><header>Clerical
			 Amendment</header><text>The analysis for subchapter II of such chapter is
			 amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id91BA8B4678B446DF85488C0E1C8E3DDD" style="OLC">
					<toc>
						<toc-entry bold="off" level="section">20156. Rail-highway grade
				crossing safety
				information.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section id="id628E4338464147E585E0802E0E17F4F3"><enum>11.</enum><header>Rural state
			 initiative</header>
			<subsection id="id4B237CDE42E84477A7412DFAA5B548EC"><enum>(a)</enum><header>In
			 General</header><text>To address the problem of a significant portion of
			 traffic fatalities occurring on highways in rural areas, the Secretary of
			 Transportation shall, for each fiscal year beginning with fiscal year 2010,
			 allocate $20 million to each State with a population density of less than 20
			 persons per square mile (based on the most recent decentennial census), for use
			 by such States for projects and programs and activities eligible under 23
			 U.S.C. 148 and not located in an urbanized area as defined in section
			 134(b)(6), title 23, United States Code.</text>
			</subsection><subsection id="idE8745FE915004509837A73F426134C82"><enum>(b)</enum><text>Such allocations
			 shall not be considered an apportionment within the meaning of section 105 of
			 title 23, United States Code, or considered a <quote>specific program</quote>
			 within the meaning of said section 105.</text>
			</subsection><subsection id="id3E1E283936BC4D119B04F288D10133A1"><enum>(c)</enum><header>Federal
			 Share</header><text>The Federal share of the cost of a project carried out
			 under this section shall be determined in accordance with section 120 of title
			 23, United States Code.</text>
			</subsection><subsection id="id9FCF6220391F4907AC9C729EBCB1476A"><enum>(d)</enum><header>Authorization
			 of Appropriations</header><text>There is authorized to be appropriated out of
			 the Highway Trust Fund (other than the Mass Transit Account) such sums as may
			 be necessary to carry out this section for each of fiscal years 2010 through
			 2014.</text>
			</subsection><subsection id="id66DD2B4680A74562AF4B34F6AE962163"><enum>(e)</enum><header>Applicability
			 of Title 23</header><text>Except as provided by subsection (b) of this section,
			 funds made available to carry out this section shall be available for
			 obligation in the same manner as if such funds were apportioned under chapter 1
			 of title 23, United States Code.</text>
