<official-title>To prohibit unsolicited mobile text message spam.</official-title>

<section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>m-SPAM Act of 2009</short-title></quote>.</text> </section> 
<section id="ID8ace35976ca640d585272f6703bcb85b"><enum>2.</enum><header>Exemption of certain qualifying messages from the definition of mobile service commercial message</header> 
<subsection id="ID116fcdca4bfe467a8ca4bcef0d241bc0"><enum>(a)</enum><header>In general</header><text>Section 14(d) of the CAN–SPAM Act of 2003 (15 U.S.C. 7712(d)) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="id7ABDD0866D8B48DCBD3288A085609B4B" style="OLC"> 
<subsection id="ID774af8e1065d4ed78636800f36029a57"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="ID49e0c36cc3174939a39e36764bec94c8"><enum>(1)</enum><header>Commercial mobile service</header><text>The term <term>commercial mobile service</term> has the same meaning given such term in section 332(d) of the Communications Act of 1934 (47 U.S.C. 332(d)).</text> </paragraph> 
<paragraph id="ID28aca9b60299422185fdfcdf66649739"><enum>(2)</enum><header>Mobile service commercial message</header><text>The term <term>mobile service commercial message</term>—</text> 
<subparagraph id="ID604292efabc74729803fb17586752506"><enum>(A)</enum><text>means—</text> 
<clause id="idD9329E2AE3324D34993E7258C397C897"><enum>(i)</enum><text>a commercial electronic mail message that is transmitted directly to a wireless device that is utilized by a subscriber of commercial mobile service in connection with such service; and</text> </clause> 
<clause id="idD7FD4A8FE3F44490A97F92E04C4BFDD1"><enum>(ii)</enum><text>an unsolicited short message or a short message where the recipient of such message has not previously agreed to enter or exercised an option to enter into an agreement with the sender of such message to receive such messages; and</text> </clause></subparagraph> 
<subparagraph id="ID574f5fc3f4f04474b505e8e3c920ec26"><enum>(B)</enum><text>does not include any such commercial electronic mail message or short message, if the primary purpose of such message is to—</text> 
<clause id="IDa527d2446f3f4577a77aba1a5ef00874"><enum>(i)</enum><text>facilitate, complete, or confirm a commercial transaction that the recipient of such message has previously agreed to enter into with the sender of such message;</text> </clause> 
<clause id="ID67e3cad1ce504de2ad81309f414e8b73"><enum>(ii)</enum><text>provide warranty information, product recall information, or safety or security information with respect to a commercial product or service used or purchased by the recipient of such message;</text> </clause> 
<clause id="ID0c5c73da55154696b9f6adb582fa6746"><enum>(iii)</enum><text>provide, with respect to a subscription, membership, account, loan, or comparable ongoing commercial relationship involving the ongoing purchase or use by the recipient of such message of products or services offered by the sender of such message—</text> 
<subclause id="IDc076697fa77e4f5fae6b6e70699cba35"><enum>(I)</enum><text>notice concerning a change in the terms or features of such subscription, membership, account, loan, or comparable ongoing commercial relationship;</text> </subclause> 
<subclause id="IDebae68cfd1b84f8595dcd48990e6bdd9"><enum>(II)</enum><text>notice of a change in the standing or status of the recipient with respect to such subscription, membership, account, loan, or comparable ongoing commercial relationship; or</text> </subclause> 
<subclause id="IDdc604dbd252048ed942b86a4f595b2ce"><enum>(III)</enum><text>at regular periodic intervals, account balance information or other types of account statements with respect to such subscription, membership, account, loan, or comparable ongoing commercial relationship;</text> </subclause></clause> 
<clause id="IDc883d4edff8e4948bea801d4e6742989"><enum>(iv)</enum><text>provide information directly related to an employment relationship or related benefit plan in which the recipient of such message is eligible for, currently involved, participating, or enrolled; or</text> </clause> 
<clause id="ID12bd187145f845bcb50852e530460cba"><enum>(v)</enum><text>deliver goods or services, including product updates or upgrades, that the recipient of such message is entitled to receive under the terms of a transaction that the recipient has previously agreed to enter into with the sender of such message.</text> </clause></subparagraph></paragraph> 
<paragraph id="ID4c2cb0d65d6b468a9281f052fdd21a66"><enum>(3)</enum><header>Short message</header><text>The term <term>short message</term> means a text or other message sent to a telephone number or an identifier other than an electronic mail address assigned to a wireless device.</text> </paragraph> 
<paragraph id="IDafdce59dfee446ec9ddce55c4265e93c"><enum>(4)</enum><header>Wireless device</header><text>The term <term>wireless device</term> means a phone or other device utilized by a user of commercial mobile service in connection with such service.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="ID82bbf316bf4b454f83fda0b003ff382f"><enum>(b)</enum><header>Certain messages</header> 
<paragraph id="IDe09bb70bd8874a758943f2ad599923f3"><enum>(1)</enum><header>Applicability of Act</header><text>Section 14 of the CAN–SPAM Act of 2003 (15 U.S.C. 7712) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="id8114AB3518204F8B947A62D4A77DE767" style="OLC"> 
<subsection id="IDa28693700e064bce8913c8260e5294c3"><enum>(e)</enum><header>Applicability regarding short messaging services and mobile service commercial messages</header><text>This section shall not prohibit—</text> 
<paragraph id="IDba77b68ae4f440348ce64a44f05ddd28"><enum>(1)</enum><text>the sending of short messages—</text> 
<subparagraph id="ID4ab9e60897954c7cbdd5833d7dccbaa5"><enum>(A)</enum><text>from one wireless device to another; or</text> </subparagraph> 
<subparagraph id="ID57472768d0b442de934a3ba6fc5a5268"><enum>(B)</enum><text>from a provider of commercial mobile service to its subscribers at no charge to its subscribers; and</text> </subparagraph></paragraph> 
<paragraph id="IDf3d8e08d24c54a05b8f9f71deae24c8a"><enum>(2)</enum><text>the sending of mobile service commercial messages by a provider of commercial mobile service to its subscribers at no charge to its subscribers unless a subscriber has expressed his or her desire not to receive such messages from the provider.</text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph> 
<paragraph id="ID956f31b843ea43fda61151a758e3d675"><enum>(2)</enum><header>Conforming amendment</header><text>Section 14(b) of the CAN–SPAM Act of 2003 (15 U.S.C. 7712(b)) is amended—</text> 
<subparagraph id="IDb4d7fbc4829b484c922107dbd973af79"><enum>(A)</enum><text>in paragraph (1), by striking <quote>paragraph (3)</quote> and inserting <quote>subsection (e)(2)</quote>; and</text> </subparagraph> 
<subparagraph id="ID80927f02f4924205a4223ee61e9151de"><enum>(B)</enum><text>in paragraph (3), by striking <quote>take into consideration</quote> and all that follows through <quote>such providers,</quote> and inserting <quote>shall require providers of commercial mobile service,</quote>.</text> </subparagraph></paragraph></subsection></section> 
<section id="ID9006b7773a6f4cf39e73535feba745ed"><enum>3.</enum><header>Prohibition on unauthorized mobile service commercial messages containing unsolicited advertisements</header> 
<subsection id="IDb4bf33a7b902427bb040694b4c7c19c5"><enum>(a)</enum><header>Prohibition</header><text>Section 227(b)(1) of the Communications Act of 1934 (47 U.S.C. 227(b)(1)) is amended—</text> 
<paragraph id="ID33e500d4562641f7a0348a3b46462db6"><enum>(1)</enum><text>in subparagraph (C)(iii), by striking <quote>; or</quote> and inserting a semicolon;</text> </paragraph> 
<paragraph id="ID7244796163654b4ba3af4b8b257dd997"><enum>(2)</enum><text>in subparagraph (D), by striking the period at the end and inserting <quote>; or</quote>; and</text> </paragraph> 
<paragraph id="ID47fdfe6abdbc4bba88c9c3a57f3361cd"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="idAC858CF279B143E89936108ABA6B2A7F" style="OLC"> 
<subparagraph id="IDb3ad344e6a924a0eb2461138d49af84f"><enum>(E)</enum><text>to send a mobile service commercial message to any person who has not provided express prior authorization for the receipt of such message to the sender of such message.</text> </subparagraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="IDe88d17ff4c264de08da4007117979e3f"><enum>(b)</enum><header>Definitions</header><text>Section 227(a) of the Communications Act of 1934 (47 U.S.C. 227(a)) is amended—</text> 
<paragraph id="IDee60533f82474e929c94753684d272e6"><enum>(1)</enum><text>by redesignating paragraphs (3) through (5) as paragraphs (5) through (7), respectively; and</text> </paragraph> 
<paragraph id="IDcc0112aca7cd4ed68bfc25eb942acedc"><enum>(2)</enum><text>by inserting after paragraph (2) the following:</text> 
<quoted-block display-inline="no-display-inline" id="idEDFF0B501B0343D2895606AAF1C5F4EB" style="OLC"> 
<paragraph id="IDe3b754b748964c6d917322a20930784f"><enum>(3)</enum><text>The term <term>commercial mobile service</term> has the same meaning given such term in section 332(d).</text> </paragraph> 
<paragraph id="IDdd1be257445e4377bd38f665046b31bd"><enum>(4)</enum><text>The terms <term>mobile service commercial message</term>, <term>short message</term>, and <term>wireless device</term> have the same meanings given such terms, respectively, in section 14(d) of the CAN–SPAM Act of 2003 (15 U.S.C. 7712(d)).</text> </paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="ID3f9fccd7d9e84395abcffbe8415e390e"><enum>(c)</enum><header>Applicability</header><text>Section 227(d) of the Communications Act of 1934 (47 U.S.C. 227(d)) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="id464933511FCA4910B901CA86C6589A8E" style="OLC"> 
<paragraph id="IDaa0d99c56b0f41c3935f8de86fe092e6"><enum>(4)</enum><header>Applicability of prohibition on mobile service commercial messages</header><text>The prohibition prescribed under subsection (b)(1)(E) shall not prohibit—</text> 
<subparagraph id="ID9fdda4dde55c4600b3e1740d90d46a6a"><enum>(A)</enum><text>the sending of short messages—</text> 
<clause id="ID2d97469fdf714591878a947b450830cd"><enum>(i)</enum><text>from one wireless device to another; or</text> </clause> 
<clause id="ID0d9267182d5a4096a594fc4e47d4caa2"><enum>(ii)</enum><text>from a provider of commercial mobile service to its subscribers at no charge to its subscribers; and</text> </clause></subparagraph> 
<subparagraph id="ID1521568c7d5849e59bb600bf2522d1d0"><enum>(B)</enum><text>the sending of mobile service commercial messages by a provider of commercial mobile service to its subscribers at no charge to its subscribers unless a subscriber has expressed his or her desire not to receive such messages from the provider.</text> </subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="ID21dd917229f249658fe189010d6cd893"><enum>(d)</enum><header>Effect on State law</header><text>Nothing in this Act or the amendments made by this Act shall be construed to give a State any greater authority over mobile service commercial messages than the authority accorded to the States with respect to commercial electronic mail messages or the information attached thereto under the CAN–SPAM Act of 2003 (15 U.S.C. 7701 et seq.).</text> </subsection></section> 
<section id="ID19a1f6a095c342349977085fc355972a"><enum>4.</enum><header>Mobile service commercial messages containing unsolicited advertisements sent to cellular telephones explicitly prohibited</header> 
<subsection id="ID07195588a0c240b4917d168fc7d78b06"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Federal Trade Commission shall revise the do-not-call registry provisions of the Telemarketing Sales Rule (16 C.F.R. 310.4(b)(1)(iii))—</text> 
<paragraph id="ID365ebf0fe82147468a2d9c2ba5560b1a"><enum>(1)</enum><text>to consider commercial mobile service messaging practices that are costly or a nuisance to consumers; and</text> </paragraph> 
<paragraph id="ID054d5d6ceb6a4787b021933c37b1dedb"><enum>(2)</enum><text>to explicitly prohibit, as an abusive telemarketing act or practice, the sending of any mobile service commercial message to a telephone number that is—</text> 
<subparagraph id="ID24c43f11349245ccaff69f1b8570e245"><enum>(A)</enum><text>assigned to a commercial mobile service; and</text> </subparagraph> 
<subparagraph id="ID63903887ed834fe09128c3fff1d9fbea"><enum>(B)</enum><text>listed on the do-not-call registry,</text> </subparagraph><continuation-text continuation-text-level="paragraph">except for such messages sent by a provider of commercial mobile service to its subscribers at no charge to the subscriber.</continuation-text></paragraph></subsection> 
<subsection id="ID6eff382398994deea64d03cb1a9fd02f"><enum>(b)</enum><header>Definitions</header><text>As used in this section—</text> 
<paragraph id="IDcaf7e10c1b674a93bd08989a6664a6b3"><enum>(1)</enum><text>the term <term>mobile service commercial message</term> has the same meaning given such term in section 14(d) of the CAN–SPAM Act of 2003 (15 U.S.C. 7712(d)); and</text> </paragraph> 
<paragraph id="IDc0c22370386e427998f5f98d9d1af308"><enum>(2)</enum><text>the term <term>commercial mobile service</term> has the same meaning given such term in section 332(d) of the Communications Act of 1934 (47 U.S.C. 332(d)).</text> </paragraph></subsection></section>
