		<official-title display="yes">To amend the Consumer Credit Protection Act
		  to assure meaningful disclosures of the terms of rental-purchase agreements,
		  including disclosures of all costs to consumers under such agreements, to
		  provide certain substantive rights to consumers under such agreements, and for
		  other purposes.</official-title>

			 <quote><short-title>Consumer Rental-Purchase Agreement Act
			 of 2009</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="ID17524B836F2741BD86B70000EAA2449D" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings and declaration of
			 purposes</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDA334C6EE6ACC44E193EC41C63F310040"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress finds that—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID37CD785354164E839CE9CBFBD4CE6652"><enum>(1)</enum><text display-inline="yes-display-inline">the rental-purchase industry provides a
			 service that meets and satisfies the demands of many consumers;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5844EBE4473442DAA052A5D7912E0445"><enum>(2)</enum><text display-inline="yes-display-inline">each year, approximately 2,300,000 United
			 States households enter into rental-purchase transactions, and over a 5-year
			 period, approximately 4,900,000 United States households will do so;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID134A011330084D91AEE1D98559F27BD3"><enum>(3)</enum><text display-inline="yes-display-inline">competition among the various firms engaged
			 in the extension of rental-purchase transactions would be strengthened by
			 informed use of rental-purchase transactions; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2459AD94FF5648668B9800D1BB2C0321"><enum>(4)</enum><text display-inline="yes-display-inline">the informed use of rental-purchase
			 transactions results from an awareness of the cost thereof by consumers.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7D2171D8940443C79380A6C591EFEFDF"><enum>(b)</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="yes-display-inline">The purposes of this Act are to assure the
			 availability of rental-purchase transactions, to assure simple, meaningful, and
			 consistent disclosure of rental-purchase terms so that consumers will be able
			 to more readily compare the available rental-purchase terms and avoid
			 uninformed use of rental-purchase transactions, and to protect consumers
			 against unfair rental-purchase practices.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID9F0924A0BE97415C8C26173EEA254902" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline"><act-name parsable-cite="CCPA">Consumer
			 Credit Protection Act</act-name></header><text display-inline="no-display-inline">The <act-name parsable-cite="CCPA">Consumer
			 Credit Protection Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/1601">15 U.S.C. 1601</external-xref> et seq.) is amended
			 by adding at the end the following new title:</text>

						<subsection commented="no" display-inline="no-display-inline" id="IDCF32992B1A4C42DFB15550E6582832E1"><enum>(a)</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="yes-display-inline">This title may be cited as the
				<quote><act-name>Rental-Purchase Protections Act</act-name></quote>.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDEBC31C6A38374CDD00EF9B1C1E462E6B"><enum>(b)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">For purposes of this title, the following
				definitions shall apply:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID4232A65715274123A343A9B5AD83AA7B"><enum>(1)</enum><header display-inline="yes-display-inline">Advertisement</header><text display-inline="yes-display-inline">The term <term>advertisement</term> means a
				commercial message in any medium that promotes, directly or indirectly, a
				rental-purchase agreement, but does not include price tags, window signs, or
				other in-store merchandising aids.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID62B9843C18CA4DA1A512C721EFE2A2CF"><enum>(2)</enum><header display-inline="yes-display-inline">Agricultural purpose</header><text display-inline="yes-display-inline">The term <term>agricultural purpose</term>
				includes—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID0B8ACC3798F548A9801B10A5F014DA47"><enum>(A)</enum><text display-inline="yes-display-inline">the production, harvest, exhibition,
				marketing, transformation, processing, or manufacture of agricultural products
				by a natural person who cultivates plants or propagates or nurtures
				agricultural products; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE35EFEF8DEA44085B29B15152364EFB5"><enum>(B)</enum><text display-inline="yes-display-inline">the acquisition of farmlands, real property
				with a farm residence, or personal property and services used primarily in
				farming.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD62DED0F7F91489FAF4DAD3C68D7AD4F"><enum>(3)</enum><header display-inline="yes-display-inline">Board</header><text display-inline="yes-display-inline">The term <term>Board</term> means the Board
				of Governors of the Federal Reserve System.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0471C30DFE3B40F8A4EB8F9C00CFEE82"><enum>(4)</enum><header display-inline="yes-display-inline">Cash price</header><text display-inline="yes-display-inline">The term <term>cash price</term> means the
				price at which a merchant, in the ordinary course of business, offers to sell
				for cash the property that is the subject of the rental-purchase
				transaction.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5C680C742BF4492298B245F6C9BE67B7"><enum>(5)</enum><header display-inline="yes-display-inline">Consumer</header><text display-inline="yes-display-inline">The term <term>consumer</term> means a
				natural person who is offered or enters into a rental-purchase
				agreement.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5D104E3CF4A546409BC6CEEC91922C23"><enum>(6)</enum><header display-inline="yes-display-inline">Date of consummation</header><text display-inline="yes-display-inline">The term <term>date of consummation</term>
				means the date on which a consumer becomes contractually obligated under a
				rental-purchase agreement.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE61B43919CFD45139FE8892D466E436D"><enum>(7)</enum><header display-inline="yes-display-inline">Initial payment</header><text display-inline="yes-display-inline">The term <term>initial payment</term> means
				the amount to be paid before or at the time of consummation of the agreement,
				or the time of delivery of the property covered by the agreement if delivery
				occurs after consummation, including—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDE4EA85D0E0E94FCAB8E889B22CF146BB"><enum>(A)</enum><text display-inline="yes-display-inline">the rental payment;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID11EECDD3B1E348409C02FDB486DB1203"><enum>(B)</enum><text display-inline="yes-display-inline">service, processing, or administrative
				charges;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7FC8DF5B18EB407185114E6BE964D29D"><enum>(C)</enum><text display-inline="yes-display-inline">any delivery fee;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBA6AEBEA0B8C4822A28409A740407C45"><enum>(D)</enum><text display-inline="yes-display-inline">refundable security deposit;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9399EC2B52F44875B895F22C40EB94EF"><enum>(E)</enum><text display-inline="yes-display-inline">taxes;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0C3993C52184469E97F6EEC56873B27D"><enum>(F)</enum><text display-inline="yes-display-inline">mandatory fees or charges; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1E79C8EAA0C7404200AA3D75C1E1943E"><enum>(G)</enum><text display-inline="yes-display-inline">any optional fees or charges agreed to by
				the consumer.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5B85B8E28CED42DE8FB52C65A4519313"><enum>(8)</enum><header display-inline="yes-display-inline">Merchant</header><text display-inline="yes-display-inline">The term <term>merchant</term> means a
				person who provides the use of property through a rental-purchase agreement in
				the ordinary course of business and to whom the initial payment by the consumer
				under the agreement is payable.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB9F89CADE3C444B5889D4FF88D69223F"><enum>(9)</enum><header display-inline="yes-display-inline">Payment schedule</header><text display-inline="yes-display-inline">The term <term>payment schedule</term>
				means the amount and timing of the periodic payments and the total number of
				all periodic payments that the consumer will make if the consumer acquires
				ownership of the property by making all periodic payments.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7EA3689F4EFD4866949CE8A21FC93033"><enum>(10)</enum><header display-inline="yes-display-inline">Periodic payment</header><text display-inline="yes-display-inline">The term <term>periodic payment</term>
				means the total payment that a consumer will make for a specific rental period
				after the initial payment, including the rental payment, taxes, mandatory fees
				or charges, and any optional fees or charges agreed to by the consumer.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4FBBBF294ABE42A1B88D41128E002BB1"><enum>(11)</enum><header display-inline="yes-display-inline">Property</header><text display-inline="yes-display-inline">The term <term>property</term> means
				property that is not real property under the laws of the State in which the
				property is located when it is made available under a rental-purchase
				agreement.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6CE672FB722D45888300725E08C231B0"><enum>(12)</enum><header display-inline="yes-display-inline">Rental
				payment</header><text display-inline="yes-display-inline">The term <term>rental
				payment</term> means rent required to be paid by a consumer for the possession
				and use of property for a specific rental period, but does not include taxes or
				any fees or charges.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID959D931A88ED465A8DC9E6BBD48C5793"><enum>(13)</enum><header display-inline="yes-display-inline">Rental period</header><text display-inline="yes-display-inline">The term <term>rental period</term> means a
				week, month, or other specific period of time, during which the consumer has a
				right to possess and use property that is the subject of a rental-purchase
				agreement after paying the rental payment and any applicable taxes for such
				period.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID08EA1A86FE52485BB3599086EE911D88"><enum>(14)</enum><header display-inline="yes-display-inline">Rental-Purchase agreement</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID3DC7814A3E8646068F2200B1DC833CF2"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>rental-purchase
				agreement</term> means a contract in the form of a bailment or lease for the
				use of property by a consumer for an initial period of 4 months or less, that
				is renewable with each payment by the consumer, and that permits but does not
				obligate the consumer to become the owner of the property.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDAE7DA9603A1C45CEBC18E4BEF09E243E"><enum>(B)</enum><header display-inline="yes-display-inline">Exclusions</header><text display-inline="yes-display-inline">The term <term>rental-purchase
				agreement</term> does not include—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDC70E8E18D9524C699D0714B2A16DE7EF"><enum>(i)</enum><text display-inline="yes-display-inline">a credit sale (as defined in section 103(g)
				of the Truth in Lending Act);</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDFC934A75B15D42BB8F374B7E3D499CB7"><enum>(ii)</enum><text display-inline="yes-display-inline">a consumer lease (as defined in section
				181(1) of the Truth in Lending Act); or</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDCA5BA13B45EF44E9B40038BB4459A981"><enum>(iii)</enum><text display-inline="yes-display-inline">a transaction giving rise to a debt
				incurred in connection with the business of lending money or a thing of
				value.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD82C1D6674F7476F8C17D50602EC1DBD"><enum>(15)</enum><header display-inline="yes-display-inline">Rental-Purchase cost</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDC0DEAC3273AA4B63B7F5C7D866C73B23"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For purposes of sections 1010 and 1011, the
				term <term>rental-purchase cost</term> means the sum of all rental payments and
				mandatory fees or charges imposed by the merchant as a condition of entering
				into a rental-purchase agreement or acquiring ownership of property under a
				rental-purchase agreement, including—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID9BED76CA3D2347010021D5A5E25CD484"><enum>(i)</enum><text display-inline="yes-display-inline">any service, processing, or administrative
				charge;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID701B31C7C78244E79E223ED55C7223C2"><enum>(ii)</enum><text display-inline="yes-display-inline">any fee for an investigation or credit
				report; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDF623ABF6A40F4CA2A5D17D08A56DB48C"><enum>(iii)</enum><text display-inline="yes-display-inline">any charge for delivery required by the
				merchant.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7D60E42581AE402C887B00F37CAF1F25"><enum>(B)</enum><header display-inline="yes-display-inline">Excluded
				items</header><text display-inline="yes-display-inline">The following fees or
				charges shall not be taken into account in determining the rental-purchase cost
				with respect to a rental-purchase transaction:</text>
									<clause commented="no" display-inline="no-display-inline" id="ID77A1CB77C2474D28B0C05024DDEECABE"><enum>(i)</enum><text display-inline="yes-display-inline">Fees and charges prescribed by law, which
				actually are or will be paid to public officials or government entities, such
				as sales tax.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDE328EB5083C345BFABFE4300249F5E5F"><enum>(ii)</enum><text display-inline="yes-display-inline">Fees and charges for optional products and
				services offered in connection with a rental-purchase agreement.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1910987A4EB54E2EA5EDB1FEA2632300"><enum>(16)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> means any State
				of the United States, the District of Columbia, any territory of the United
				States, Puerto Rico, Guam, American Samoa, the Trust Territory of the Pacific
				Islands, the Virgin Islands, and the Northern Mariana Islands.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID88E20B6B790B4989999D04163097306D"><enum>(17)</enum><header display-inline="yes-display-inline">Total cost</header><text display-inline="yes-display-inline">The term <term>total cost</term> means the
				sum of the initial payment and all periodic payments in the payment schedule to
				be paid by the consumer to acquire ownership of the property that is the
				subject of the rental-purchase agreement.</text>
							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID4FE2EB96E4ED4B0694CD369E1500DBF5" section-type="subsequent-section"><enum>1002.</enum><header display-inline="yes-display-inline">Exempted transactions</header><text display-inline="no-display-inline">This title does not apply to rental-purchase
				agreements primarily for business, commercial, or agricultural purposes, or
				those made with agencies or instrumentalities of the Federal Government or a
				State or political subdivision thereof.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID35CCF5306FFD45C79EAB104DDA247C00" section-type="subsequent-section"><enum>1003.</enum><header display-inline="yes-display-inline">General disclosure requirements</header>
						<subsection commented="no" display-inline="no-display-inline" id="IDA5755157C00C4FD78B8CCF7679B380E7"><enum>(a)</enum><header display-inline="yes-display-inline">Recipient of disclosure</header><text display-inline="yes-display-inline">A merchant shall disclose to any person who
				will be a signatory to a rental-purchase agreement the information required by
				sections 1004 and 1005.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDD708A01ABA7440DFB477E86342722088"><enum>(b)</enum><header display-inline="yes-display-inline">Timing of disclosure</header><text display-inline="yes-display-inline">The disclosures required under sections
				1004 and 1005 shall be made before the consummation of the rental-purchase
				agreement, and clearly and conspicuously in writing as part of the
				rental-purchase agreement to be signed by the consumer.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDBE6472D702DB4C33AF9600745530009F"><enum>(c)</enum><header display-inline="yes-display-inline">Clearly and conspicuously</header><text display-inline="yes-display-inline">As used in this section, the term
				<term>clearly and conspicuously</term> means that information required to be
				disclosed to the consumer shall be worded plainly and simply, and appear in a
				type size, prominence, and location as to be readily noticeable, readable, and
				comprehensible to an ordinary consumer.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="ID618DC828FBF7425392AFE7DBC3D96D21" section-type="subsequent-section"><enum>1004.</enum><header display-inline="yes-display-inline">Rental-Purchase disclosures</header>
						<subsection commented="no" display-inline="no-display-inline" id="IDABB222C9C7284C2CB04446261F2E3C06"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For each rental-purchase agreement, the
				merchant shall disclose to the consumer, to the extent applicable—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="IDAE0241F2F3CC4901BB93D479AD35DF1D"><enum>(1)</enum><text display-inline="yes-display-inline">the date of consummation of the
				rental-purchase transaction and the identities of the merchant and the
				consumer;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFC62C60D2FEE4A83B1941D8197508360"><enum>(2)</enum><text display-inline="yes-display-inline">a brief description of the rental property,
				which shall be sufficient to identify the property to the consumer, including
				an identification or serial number, if applicable, and a statement indicating
				whether the property is new or used;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDA197BA128FC497D90A06FA441839339"><enum>(3)</enum><text display-inline="yes-display-inline">a description of any fee, charge, or
				penalty, in addition to the periodic payment, that the consumer may be required
				to pay under the agreement, which shall be separately identified by type and
				amount;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID902EEC4DF17747FCBDD4A281043692AD"><enum>(4)</enum><text display-inline="yes-display-inline">a clear and conspicuous statement that the
				transaction is a rental-purchase agreement and that the consumer will not
				obtain ownership of the property until the consumer has paid the total dollar
				amount necessary to acquire ownership;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8E51DE73D7CB49DFAF7EEB2EAA39054D"><enum>(5)</enum><text display-inline="yes-display-inline">the amount of any initial payment, which
				includes the first periodic payment, and the total amount of any fees, taxes,
				or other charges, required to be paid by the consumer;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID76727824670D4635A2F3840000713500"><enum>(6)</enum><text display-inline="yes-display-inline">the amount of the cash price of the
				property that is the subject of the rental-purchase agreement, and, if the
				agreement involves the rental of 2 or more items as a set (as may be defined by
				the Board in regulation) a statement of the aggregate cash price of all items
				shall satisfy this requirement;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6DF1563929D246939B1BA99C083B4510"><enum>(7)</enum><text display-inline="yes-display-inline">the amount and timing of periodic payments,
				and the total number of periodic payments necessary to acquire ownership of the
				property under the rental-purchase agreement;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID32ABF48F203C4D998F4C32E3AFB6416D"><enum>(8)</enum><text display-inline="yes-display-inline">the total cost, using that term, and a
				brief description, such as <quote>This is the amount that you will pay the
				merchant if you make all periodic payments to acquire ownership of the
				property.</quote>;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBC9A7723D5FC4AABB8A679AE7F968F17"><enum>(9)</enum><text display-inline="yes-display-inline">a statement of the right of the consumer to
				terminate the agreement without paying any fee or charge not previously due
				under the agreement by voluntarily surrendering or returning the property in
				good repair upon expiration of any lease term; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID308D5374454740579057919D9EBD8294"><enum>(10)</enum><text display-inline="yes-display-inline">substantially the following statement:
				<quote><header-in-text level="section" style="OLC">OTHER IMPORTANT
				TERMS</header-in-text>: See your rental-purchase agreement for additional
				important information on early termination procedures, purchase option rights,
				responsibilities for loss, damage, or destruction of the property, warranties,
				maintenance responsibilities, and other charges or penalties you may
				incur.</quote>.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDC9706DFE32AC4A01B1FB9D4D3DD98926"><enum>(b)</enum><header display-inline="yes-display-inline">Form of disclosure</header><text display-inline="yes-display-inline">The disclosures required by paragraphs (4)
				through (10) of subsection (a) shall—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID2D0A08FA5B5C47D49466D129E2CB2452"><enum>(1)</enum><text display-inline="yes-display-inline">be segregated from other information at the
				beginning of the rental-purchase agreement;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2381828874004943A2ED35000013AAF0"><enum>(2)</enum><text display-inline="yes-display-inline">contain only directly related information;
				and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFDD1BCB7C7F34CFD9369EF79244399A5"><enum>(3)</enum><text display-inline="yes-display-inline">be identified in boldface, upper-case
				letters as follows: <quote><header-in-text level="section" style="OLC">IMPORTANT RENTAL-PURCHASE
				DISCLOSURES</header-in-text></quote>.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID773F48B7CB2B4AF5A130D7792E63E0C6"><enum>(c)</enum><header display-inline="yes-display-inline">Disclosure requirements relating to
				insurance premiums and liability waivers</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID46D492C98821409A90234BA29712CB68"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A merchant shall clearly and conspicuously
				disclose in writing to the consumer before the consummation of a
				rental-purchase agreement that the purchase of leased property insurance or
				liability waiver coverage is not required as a condition for entering into the
				rental-purchase agreement.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7121B5717677416482659800185CCECA"><enum>(2)</enum><header display-inline="yes-display-inline">Affirmative written request after cost
				disclosure</header><text display-inline="yes-display-inline">A merchant may
				provide insurance or liability waiver coverage, directly or indirectly, in
				connection with a rental-purchase transaction only if—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID87E49D8F45B3448F8F71C33C5B2EC5F8"><enum>(A)</enum><text display-inline="yes-display-inline">the merchant clearly and conspicuously
				discloses to the consumer the cost of each component of such coverage before
				the consummation of the rental-purchase agreement; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID819C51EAB1EB4617B6DED73ECEF0F28E"><enum>(B)</enum><text display-inline="yes-display-inline">the consumer signs an affirmative written
				request for such coverage after receiving the disclosures required under
				paragraph (1) and subparagraph (A) of this paragraph.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID09BE36C6E7054C4281CBB0619BE8748E"><enum>(d)</enum><header display-inline="yes-display-inline">Accuracy of disclosure</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID418F9B8049664185A7D035772E866F3E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The disclosures required to be made under
				subsection (a) shall be accurate as of the date on which the disclosures are
				made, based on the information available to the merchant.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID492C8B214C8F499D9500C856C9E935A5"><enum>(2)</enum><header display-inline="yes-display-inline">Information subsequently rendered
				inaccurate</header><text display-inline="yes-display-inline">If information
				required to be disclosed under subsection (a) is subsequently rendered
				inaccurate as a result of any agreement between the merchant and the consumer
				subsequent to the delivery of the required disclosures, the resulting
				inaccuracy shall not constitute a violation of this title.</text>
							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID849D7BFE583649F3B4DD253619736561" section-type="subsequent-section"><enum>1005.</enum><header display-inline="yes-display-inline">Other agreement provisions</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID4CA528F90C16430087F4FB557C49DF65"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each rental-purchase agreement
				shall—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID8A449B4037A648EA84B9C6158F890757"><enum>(1)</enum><text display-inline="yes-display-inline">provide a statement specifying whether the
				merchant or the consumer is responsible for loss, theft, damage, or destruction
				of the property;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID64AC44F91AA4405CB4090887CC3FE7E5"><enum>(2)</enum><text display-inline="yes-display-inline">provide a statement specifying whether the
				merchant or the consumer is responsible for maintaining or servicing the
				property, together with a brief description of the responsibility;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5C4EEDFEEB7444F4956381CF648592D9"><enum>(3)</enum><text display-inline="yes-display-inline">provide that the consumer may terminate the
				agreement without paying any charges not previously due under the agreement by
				voluntarily surrendering or returning the property that is the subject of the
				agreement upon expiration of any rental period;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFB30F9FE34024AE6B8002F126D61CEC8"><enum>(4)</enum><text display-inline="yes-display-inline">contain a provision for reinstatement of
				the agreement, which at a minimum—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDDAFCE6EC07B24EFD945CE856F956E98B"><enum>(A)</enum><text display-inline="yes-display-inline">permits a consumer who fails to make a
				timely rental payment to reinstate the agreement, without losing any rights or
				options which exist under the agreement, by the payment of all past due rental
				payments and any other charges then due under the agreement and a payment for
				the next rental period within 7 business days after failing to make a timely
				rental payment if the consumer pays monthly, or within 3 business days after
				failing to make a timely rental payment if the consumer pays more frequently
				than monthly;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID725D088DFD3A47C7B71927E92CFD2157"><enum>(B)</enum><text display-inline="yes-display-inline">if the consumer returns or voluntarily
				surrenders the property covered by the agreement, other than through judicial
				process, during the applicable reinstatement period set forth in subparagraph
				(A), permits the consumer to reinstate the agreement during a period of at
				least 60 days after the date of the return or surrender of the property by the
				payment of all amounts previously due under the agreement, any applicable fees,
				and a payment for the next rental period;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID499593D271DB4723A2F300FB56C102E8"><enum>(C)</enum><text display-inline="yes-display-inline">if the consumer has paid 50 percent or more
				of the total cost necessary to acquire ownership and returns or voluntarily
				surrenders the property, other than through judicial process, during the
				applicable reinstatement period set forth in subparagraph (A), permits the
				consumer to reinstate the agreement during a period of at least 120 days after
				the date of the return of the property by the payment of all amounts previously
				due under the agreement, any applicable fees, and a payment for the next rental
				period; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9F7987621F5B4D0BAF598269E252D3AA"><enum>(D)</enum><text display-inline="yes-display-inline">permits the consumer, upon reinstatement of
				the agreement, to receive the same property, if available, that was the subject
				of the rental-purchase agreement, or if the same property is not available, a
				substitute item of comparable quality and condition, except that the Board may,
				by regulation or order, exempt any independent small business (as defined by
				regulation of the Board) from the requirement of providing the same or
				comparable product during the extended reinstatement period provided in
				subparagraph (C), if the Board determines, taking into account such standards
				as the Board determines appropriate, that the reinstatement right provided in
				subparagraph (C) would provide excessive hardship for the independent small
				business;</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID537C37B32FEB48EDBD00298D3FDBC31F"><enum>(5)</enum><text display-inline="yes-display-inline">provide a statement specifying the terms
				under which the consumer shall acquire ownership of the property that is the
				subject of the rental-purchase agreement either by payment of the total cost to
				acquire ownership, as provided in section 1006, or by exercise of any early
				purchase option provided in the rental-purchase agreement;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA5FDB5DFCBFB4857B1B6A7F578B30049"><enum>(6)</enum><text display-inline="yes-display-inline">provide a statement disclosing that if any
				part of a manufacturer’s express warranty covers the property at the time the
				consumer acquires ownership of the property, the warranty will be transferred
				to the consumer if allowed by the terms of the warranty; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE79F65A6A976480D820029601F9B5345"><enum>(7)</enum><text display-inline="yes-display-inline">provide, to the extent applicable, a
				description of any grace period for making any periodic payment, the amount of
				any security deposit, if any, to be paid by the consumer upon initiation of the
				rental-purchase agreement, and the terms for refund of such security deposit to
				the consumer upon return, surrender or purchase of the property.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID160EC1A0E50A425F8BB5B1077EC07B85"><enum>(b)</enum><header display-inline="yes-display-inline">Repossession during reinstatement
				period</header><text display-inline="yes-display-inline">Subsection (a)(4)
				shall not be construed so as to prevent a merchant from attempting to repossess
				property during the reinstatement period pursuant to subsection (a)(4)(A), but
				such a repossession does not affect the right of the consumer to reinstatement
				under subsection (a)(4).</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="IDAE0E163DE0E544798E9E274BD5C99340" section-type="subsequent-section"><enum>1006.</enum><header display-inline="yes-display-inline">Right to acquire ownership</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID1566C494F3854D659974CE67002509EF"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The consumer shall acquire ownership of the
				property that is the subject of the rental-purchase agreement, and the
				rental-purchase agreement shall terminate, upon compliance by the consumer with
				the requirements of subsection (b) or any early payment option provided in the
				rental purchase agreement, and upon payment of any past due payments and fees,
				as permitted by regulation of the Board.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID45E853A65B654BF699B1EA4FF7070043"><enum>(b)</enum><header display-inline="yes-display-inline">Payment of total cost</header><text display-inline="yes-display-inline">The consumer shall acquire ownership of the
				rental property upon payment of the total cost of the rental-purchase
				agreement, as defined in section 1001(17), and as disclosed to the consumer in
				the rental-purchase agreement pursuant to section 1004(a).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID38AB7850DEBA4ACB8F005C4EACBC5534"><enum>(c)</enum><header display-inline="yes-display-inline">Additional fees prohibited</header><text display-inline="yes-display-inline">A merchant shall not require the consumer
				to pay, as a condition for acquiring ownership of the property that is the
				subject of the rental-purchase agreement, any fee or charge in addition to, or
				in excess of, the regular periodic payments required by subsection (b), or any
				early purchase option amount provided in the rental-purchase agreement, as
				applicable. A requirement that the consumer pay an unpaid late charge or other
				fee or charge which the merchant has previously billed to the consumer shall
				not constitute an additional fee or charge for purposes of this
				subsection.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID1FB2CC6959C740FF94CB8E00BD2800AB"><enum>(d)</enum><header display-inline="yes-display-inline">Transfer of ownership rights</header><text display-inline="yes-display-inline">Upon payment by the consumer of all
				payments necessary to acquire ownership under subsection (b) or any early
				purchase option amount provided in the rental-purchase agreement, as
				applicable, the merchant shall—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="IDBC5CDFBEA3EE4821A0C5DAF6867C8961"><enum>(1)</enum><text display-inline="yes-display-inline">deliver, or mail to the last known address
				of the consumer, such documents or other instruments which the Board has
				determined, by regulation, are necessary to acknowledge full ownership by the
				consumer of the property acquired pursuant to the rental-purchase agreement;
				and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID43E55BD02DB04CA7BEE163F142D63942"><enum>(2)</enum><text display-inline="yes-display-inline">transfer to the consumer the unexpired
				portion of any warranties provided by the manufacturer, distributor, or seller
				of the property, which shall apply as if the consumer were the original
				purchaser of the property, except where such transfer is prohibited by the
				terms of the warranty.</text>
							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID63C0CA6F14C24FC7A74421442FA19118" section-type="subsequent-section"><enum>1007.</enum><header display-inline="yes-display-inline">Prohibited provisions</header><text display-inline="no-display-inline">A rental-purchase agreement may not
				contain—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="ID54E6D0BF30544FE68634F22D05F15874"><enum>(1)</enum><text display-inline="yes-display-inline">a confession of judgment;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3551B2AB0B6E4DA7BDE149C28CD25C5E"><enum>(2)</enum><text display-inline="yes-display-inline">a negotiable instrument;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF5936B1BB2314C3298CDA41CB2E0AC60"><enum>(3)</enum><text display-inline="yes-display-inline">a security interest or any other claim of a
				property interest in any goods, except those goods, the use of which is
				provided by the merchant pursuant to the agreement;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9DD9DBA9E58C4966AAA160AE80AD9418"><enum>(4)</enum><text display-inline="yes-display-inline">a wage assignment;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC0FAF9957EE244C08986C3829F74DC13"><enum>(5)</enum><text display-inline="yes-display-inline">a provision requiring the waiver of any
				legal claim or remedy created by this title or other provision of Federal or
				State law;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0E7549505A5C421997B2E12043A5771B"><enum>(6)</enum><text display-inline="yes-display-inline">a provision requiring the consumer, in the
				event that the property subject to the rental-purchase agreement is lost,
				stolen, damaged, or destroyed, to pay an amount in excess of the least
				of—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID98547EC3BA7F4173B0E7B2F986E43291"><enum>(A)</enum><text display-inline="yes-display-inline">the fair market value of the property, as
				determined by regulation of the Board;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDEDB2EF6010604432A3DAE5792E6BD6D8"><enum>(B)</enum><text display-inline="yes-display-inline">any early purchase option amount provided
				in the rental-purchase agreement; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE7EC0F16A9CB4D4600BB31FBBFDC0932"><enum>(C)</enum><text display-inline="yes-display-inline">the actual cost of repair, as
				appropriate;</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1D40583DF6AA4839BD00EEC5630093E9"><enum>(7)</enum><text display-inline="yes-display-inline">a provision authorizing the merchant, or a
				person acting on behalf of the merchant, to enter the dwelling of the consumer
				or other premises without obtaining the consent of the consumer, or to commit
				any breach of the peace in connection with the repossession of the rental
				property or the collection of any obligation or alleged obligation of the
				consumer arising out of the rental-purchase agreement;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF597E9B2C1B4408C8F42F4C933688C57"><enum>(8)</enum><text display-inline="yes-display-inline">a provision requiring the purchase of
				insurance or liability damage waiver to cover the property that is the subject
				of the rental-purchase agreement, except as permitted by regulation of the
				Board; or</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1A0F7ECF81084FB8AEE8D2C44C901441"><enum>(9)</enum><text display-inline="yes-display-inline">a provision requiring the consumer to pay
				more than 1 late fee or charge for an unpaid or delinquent periodic payment,
				regardless of the period in which the payment remains unpaid or delinquent, or
				to pay a late fee or charge for any periodic payment because a previously
				assessed late fee has not been paid in full.</text>
						</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDE60B5B0605CF440EA0D000F72DF38780" section-type="subsequent-section"><enum>1008.</enum><header display-inline="yes-display-inline">Statement of accounts</header><text display-inline="no-display-inline">Upon request of a consumer, a merchant shall
				provide a statement of the account of the consumer. If a consumer requests a
				statement for an individual account more than 4 times in any 12-month period,
				the merchant may charge a reasonable fee for the additional statements
				requested in excess of 4 times during that 12-month period.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID9A67E069B6E848CDBB27916D378574E3" section-type="subsequent-section"><enum>1009.</enum><header display-inline="yes-display-inline">Renegotiations and extensions</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID73BBF45615234D4DAB3F184C8F3E8575"><enum>(a)</enum><header display-inline="yes-display-inline">Renegotiations</header><text display-inline="yes-display-inline">For purposes of this section, a
				<term>renegotiation</term> occurs when a rental-purchase agreement is satisfied
				and replaced by a new agreement undertaken by the same consumer. A
				renegotiation requires new disclosures under this title, except as provided in
				subsection (c).</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDFA77E001498B4FC3BEA1F82937034500"><enum>(b)</enum><header display-inline="yes-display-inline">Extensions</header><text display-inline="yes-display-inline">For purposes of this section, an
				<term>extension</term> is an agreement by the consumer and the merchant to
				continue an existing rental-purchase agreement beyond the original end of the
				payment schedule, but does not include a continuation that is the result of a
				renegotiation.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDF62BB56D7CE54F74BC797DB9785000FC"><enum>(c)</enum><header display-inline="yes-display-inline">Exceptions</header><text display-inline="yes-display-inline">New disclosures under this title are not
				required for the following, even if they meet the definition of a renegotiation
				or an extension under this section:</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID4DE2A5D6F234436D93CA6ED113A909C8"><enum>(1)</enum><text display-inline="yes-display-inline">A reduction in payments.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID210647B120704C2C9D898BC773C0CA06"><enum>(2)</enum><text display-inline="yes-display-inline">A deferment of 1 or more payments.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC7712D81423B41DF99CE4662FC194FC0"><enum>(3)</enum><text display-inline="yes-display-inline">The extension of a rental-purchase
				agreement.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID47CC3C2046634728B6341B97E593FB21"><enum>(4)</enum><text display-inline="yes-display-inline">The substitution of property with property
				that has a substantially equivalent or greater economic value, provided that
				the rental-purchase cost does not increase.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID53A205197E5F4B7FAAD936F7075356C2"><enum>(5)</enum><text display-inline="yes-display-inline">The deletion of property in a multiple-item
				agreement.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4F26B355CC1246ABB8F8509D1BBC7466"><enum>(6)</enum><text display-inline="yes-display-inline">A change in the rental period, provided
				that the rental-purchase cost does not increase.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB2F620E767EA410CAF369D007497A400"><enum>(7)</enum><text display-inline="yes-display-inline">An agreement resulting from a court
				proceeding.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA00DF9A781CC4E79A379A2003FD896F0"><enum>(8)</enum><text display-inline="yes-display-inline">Any other event described in regulations
				prescribed by the Board.</text>
							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID7F592AA66540464EA475D8F27E7E5E1F" section-type="subsequent-section"><enum>1010.</enum><header display-inline="yes-display-inline">Point-of-rental disclosures</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID2AA1553C89BF46BA97E39076A596E5DC"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For any item of property or set of items
				displayed or offered for rental-purchase, the merchant shall display on or next
				to the item or set of items a card, tag, or label that clearly and
				conspicuously discloses—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID2C8901AD1984438386A6FA00F8CC422D"><enum>(1)</enum><text display-inline="yes-display-inline">a brief description of the property;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCAD28DCA2EFA4E7BB4EBDF845FAF17AB"><enum>(2)</enum><text display-inline="yes-display-inline">whether the property is new or used;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE36A7AA6CD144B6E85E0BE00659C8613"><enum>(3)</enum><text display-inline="yes-display-inline">the cash price of the property;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFC022C8816C94208BD7053D68D52E875"><enum>(4)</enum><text display-inline="yes-display-inline">the amount of each rental payment;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFB4B9F27311D4ED39B44BF7674A49937"><enum>(5)</enum><text display-inline="yes-display-inline">the total number of rental payments
				necessary to acquire ownership of the property; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF259275778D14204AA00B259CED4DE53"><enum>(6)</enum><text display-inline="yes-display-inline">the rental-purchase cost.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID8DC5B3AA854447E10007BFE4E7453682"><enum>(b)</enum><header display-inline="yes-display-inline">Form of disclosure</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID69CAC6BDFDF0404200CAAE7C5EFC7651"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">A merchant may make the disclosures
				required by subsection (a) in the form of a list or catalog which is readily
				available to the consumer at the point of rental if the merchandise is not
				displayed in the showroom of the merchant, or if displaying a card, tag, or
				label would be impractical due to the size of the merchandise.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID68870F3B5F2C4DFAB5A3E0937F684B16"><enum>(2)</enum><header display-inline="yes-display-inline">Clearly and conspicuously</header><text display-inline="yes-display-inline">As used in this section, the term
				<term>clearly and conspicuously</term> means that information required to be
				disclosed to the consumer shall appear in a type size, prominence, and location
				as to be noticeable, readable, and comprehensible to an ordinary
				consumer.</text>
							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID7B3B92FFAAC54662B4FDBFFDA2735DA4" section-type="subsequent-section"><enum>1011.</enum><header display-inline="yes-display-inline">Rental-Purchase advertising</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID6EA9D3CFC0DB4045994356136694B029"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">If an advertisement for a rental-purchase
				transaction refers to or states the amount of any payment for any specific item
				or set of items, the merchant making the advertisement shall also clearly and
				conspicuously state in the advertisement for the item or set of items
				advertised—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID33811A01986D4B14A7DD3D9725ADCFD9"><enum>(1)</enum><text display-inline="yes-display-inline">that the transaction advertised is a
				rental-purchase agreement;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF6FE3375884B4BFB00C0637817AD3039"><enum>(2)</enum><text display-inline="yes-display-inline">the amount, timing, and total number of
				rental payments necessary to acquire ownership under the rental-purchase
				agreement;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC9801B93D02D439D915F902B58E0C2CE"><enum>(3)</enum><text display-inline="yes-display-inline">the amount of the rental-purchase
				cost;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID162EF1802F2A4D47805701518CF616C7"><enum>(4)</enum><text display-inline="yes-display-inline">that to acquire ownership of the property,
				the consumer must pay the rental-purchase cost plus applicable taxes;
				and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9A214F96C2734C6FB100F33FA7CB2181"><enum>(5)</enum><text display-inline="yes-display-inline">whether the stated payment amount and
				advertised rental-purchase cost is for new or used property.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID07729EBA10974D87B36C9E002C04D200"><enum>(b)</enum><header display-inline="yes-display-inline">Prohibition</header><text display-inline="yes-display-inline">An advertisement for a rental-purchase
				agreement shall not state or imply that a specific item or set of items is
				available at specific amounts or terms, unless the merchant usually and
				customarily offers, or will offer, the item or set of items at the stated
				amounts or terms.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDC73AF852DE21487EA5CC6F23A051C895"><enum>(c)</enum><header display-inline="yes-display-inline">Clearly and conspicuously</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID6E4FADFE325B47809D86573B13D37840"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">For purposes of this section, the term
				<term>clearly and conspicuously</term> means that required disclosures shall be
				presented in a type, size, shade, contrast, prominence, location, and manner,
				as applicable to different media for advertising, so as to be readily
				noticeable and comprehensible to the ordinary consumer.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDABE9DE23CBF64E69ACD88D30D62B3382"><enum>(2)</enum><header display-inline="yes-display-inline">Regulatory guidance</header><text display-inline="yes-display-inline">The Board shall prescribe regulations on
				principles and factors to meet the clear and conspicuous standard, as
				appropriate to print, video, audio, and computerized advertising, reflecting
				the principles and factors typically applied in each medium by the Federal
				Trade Commission.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID22BDB793FDE74FB3A2C0938566065211"><enum>(3)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">Nothing contrary to, inconsistent with, or
				in mitigation of, the disclosures required by this section shall be used in any
				advertisement in any medium, and no audio, video, or print technique shall be
				used that is likely to obscure or detract significantly from the communication
				of the required disclosures.</text>
							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDDC0F649CD9344CD785F1F04C5326957D" section-type="subsequent-section"><enum>1012.</enum><header display-inline="yes-display-inline">Civil liability</header>
						<subsection commented="no" display-inline="no-display-inline" id="IDF0F18EF3E4F04F4999A35FDD8F00A987"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as otherwise provided in section
				1013, any merchant who fails to comply with any requirement of this title with
				respect to any consumer is liable to such consumer as provided for leases in
				section 130. For purposes of this section, the term <term>creditor</term> as
				used in section 130 shall include a <term>merchant</term>, as defined in
				section 1001.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID9CF9C65E415542689BD5816207095D38"><enum>(b)</enum><header display-inline="yes-display-inline">Jurisdiction of courts; limitation on
				actions</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID4A1D8520F28B4D5C90272959A4AEBF00"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding section 130(e), any action
				under this section may be brought in any United States district court, or in
				any other court of competent jurisdiction, before the end of the 1-year period
				beginning on the date on which the last payment was made by the consumer under
				the rental-purchase agreement.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA411ADA9680444F8934BC4A01E24B0BF"><enum>(2)</enum><header display-inline="yes-display-inline">Recoupment or set-off</header><text display-inline="yes-display-inline">This subsection shall not bar a consumer
				from asserting a violation of this title in an action to collect an obligation
				arising from a rental-purchase agreement, which was brought after the end of
				the 1-year period described in paragraph (1) as a matter of defense by
				recoupment or set-off in such action, except as otherwise provided by State
				law.</text>
							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID22D3BD055C474A7BB08C6139F4772400" section-type="subsequent-section"><enum>1013.</enum><header display-inline="yes-display-inline">Additional grounds for civil
				liability</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID76B96458656445C2A96FEBA83316E208"><enum>(a)</enum><header display-inline="yes-display-inline">Individual cases with actual
				damages</header><text display-inline="yes-display-inline">Any merchant who
				fails to comply with any requirement imposed under section 1010 or 1011 with
				respect to any consumer who suffers actual damage from the violation shall be
				liable to such consumer as provided in section 130.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDD364CC039E984F7389FF30137E9CB1B0"><enum>(b)</enum><header display-inline="yes-display-inline">Pattern or practice of
				violations</header><text display-inline="yes-display-inline">If a merchant
				engages in a pattern or practice of violating any requirement imposed under
				section 1010 or 1011, the Federal Trade Commission or an appropriate State
				attorney general, in accordance with section 1016, may initiate an action to
				enforce sanctions against the merchant, including—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID6FCE9A08A4CA487EAF749B3C4432B88D"><enum>(1)</enum><text display-inline="yes-display-inline">an order to cease and desist from such
				practices; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID52AB63408B5A4DB1AF0496E071CEFDB3"><enum>(2)</enum><text display-inline="yes-display-inline">a civil money penalty of such amount as the
				court may impose, based on such factors as the court may determine to be
				appropriate.</text>
							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDC7CEBC266FEE46239200E0F9A56E8949" section-type="subsequent-section"><enum>1014.</enum><header display-inline="yes-display-inline">Liability of assignees</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID83F5EADD41BC4B92B50062DEEFF5BA7B"><enum>(a)</enum><header display-inline="yes-display-inline">Assignees included</header><text display-inline="yes-display-inline">For purposes of section 1013 and this
				section, the term <term>merchant</term> includes an assignee of a
				merchant.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID777374D7E1A34A82A4DDE4AC71B12FEF"><enum>(b)</enum><header display-inline="yes-display-inline">Liabilities of assignees</header>
							<paragraph commented="no" display-inline="no-display-inline" id="IDAE8759EA087E40B68147E7C8A13F37C4"><enum>(1)</enum><header display-inline="yes-display-inline">Apparent violation</header><text display-inline="yes-display-inline">An action under section 1012 or 1013 for a
				violation of this title may be brought against an assignee only if the
				violation is apparent on the face of the rental-purchase agreement to which it
				relates.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF88EB4692D63421DB800186D5122F1B8"><enum>(2)</enum><header display-inline="yes-display-inline">Apparent violation defined</header><text display-inline="yes-display-inline">For purposes of this subsection, a
				violation that is apparent on the face of a rental-purchase agreement includes,
				but is not limited to, a disclosure that can be determined to be incomplete or
				inaccurate from the face of the agreement.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9EFD9170A3E8491EAAB738BA9401FD58"><enum>(3)</enum><header display-inline="yes-display-inline">Involuntary assignment</header><text display-inline="yes-display-inline">An assignee has no liability under this
				section in a case in which the assignment is involuntary.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5505F857956045609F6829658FA750F9"><enum>(4)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">No provision of this section shall be
				construed as limiting or altering the liability under section 1012 or 1013 of a
				merchant assigning a rental-purchase agreement.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID01F873D1D591466C90C700B28E491C66"><enum>(c)</enum><header display-inline="yes-display-inline">Proof of disclosure</header><text display-inline="yes-display-inline">In an action by or against an assignee, the
				consumer’s written acknowledgment of receipt of a disclosure, made as part of
				the rental-purchase agreement, shall be conclusive proof that the disclosure
				was made, if the assignee had no knowledge that the disclosure had not been
				made when the assignee acquired the rental-purchase agreement to which it
				relates.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="IDE10F2DEE856646038E6672265EAED771" section-type="subsequent-section"><enum>1015.</enum><header display-inline="yes-display-inline">Regulations</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID401F12ACAFB04DC4AD926062C8704445"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Board shall prescribe regulations, as
				necessary to carry out this title, to prevent its circumvention, and to
				facilitate compliance with its requirements.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDAA613D6B9C8C4F94AE454677A2DF858E"><enum>(b)</enum><header display-inline="yes-display-inline">Model disclosure forms</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID2D9EB8F92AA74BCBB639AEEC3EB1CE03"><enum>(1)</enum><header display-inline="yes-display-inline">Board authority</header><text display-inline="yes-display-inline">The Board may publish model disclosure
				forms and clauses for common rental-purchase agreements to facilitate
				compliance with the disclosure requirements of this title and to aid the
				consumer in understanding the transaction by utilizing readily understandable
				language to simplify the technical nature of the disclosures.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0AC958E5FD154F5A8D21376D7100DED9"><enum>(2)</enum><header display-inline="yes-display-inline">Content</header><text display-inline="yes-display-inline">In devising forms described in paragraph
				(1), the Board shall consider the use by merchants of data processing or
				similar automated equipment.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBE4582E6F21A480C8EB8F0AA39EFAC30"><enum>(3)</enum><header display-inline="yes-display-inline">Use not mandatory</header><text display-inline="yes-display-inline">Nothing in this title may be construed to
				require a merchant to use any model form or clause published by the Board under
				this section.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCC9A9CBBA5A948B4A49F9EF7C366DE15"><enum>(4)</enum><header display-inline="yes-display-inline">Determination of compliance</header><text display-inline="yes-display-inline">A merchant shall be deemed to be in
				compliance with the requirement to provide disclosure under section 1003(a) if
				the merchant—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDAC04A0246E4B4D20ABFDEE93BC00E2E8"><enum>(A)</enum><text display-inline="yes-display-inline">uses any appropriate model form or clause
				published by the Board under this section; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBA95E9F4B8EA497990CC9F8783C07BF8"><enum>(B)</enum><text display-inline="yes-display-inline">uses any such model form or clause, and
				changes it by deleting any information which is not required by this title or
				rearranging the format, if in making such deletion or rearranging the format,
				the merchant does not affect the substance, clarity, or meaningful sequence of
				the disclosure.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDB4208F007AD24E4CBF0408838B7DBC33"><enum>(c)</enum><header display-inline="yes-display-inline">Effective date of regulations</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID42A4E0E68180450C8DDD09A4B0F27099"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Any regulation prescribed by the Board, or
				any amendment or interpretation thereof, shall not be effective before the
				October 1 that follows the date of publication of the regulation in final form
				by at least 6 months.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE29F2D36A2294CD0BA7C85DCD0E3AD01"><enum>(2)</enum><header display-inline="yes-display-inline">Authority to modify</header><text display-inline="yes-display-inline">The Board may, at its discretion—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID23DA1042DB58407492CCC009C8F9AD8C"><enum>(A)</enum><text display-inline="yes-display-inline">lengthen the period of time described in
				paragraph (1) to permit merchants to adjust to accommodate new requirements;
				or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID83B73E5BCF25424092008BF7496E774B"><enum>(B)</enum><text display-inline="yes-display-inline">shorten that period of time, if the Board
				makes a specific finding that such action is necessary to comply with the
				findings of a court or to prevent unfair or deceptive practices.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4E8B0EDCAC104144AEE32E36BEBA6119"><enum>(3)</enum><header display-inline="yes-display-inline">Voluntary compliance</header><text display-inline="yes-display-inline">Notwithstanding paragraph (1) or (2), a
				merchant may comply with any newly prescribed disclosure requirement prior to
				its effective date.</text>
							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID430E4649C0684E5496E826BF9F696891" section-type="subsequent-section"><enum>1016.</enum><header display-inline="yes-display-inline">Enforcement</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID48325BF6BF7748E98895F7B2DB926E63"><enum>(a)</enum><header display-inline="yes-display-inline">Federal enforcement</header><text display-inline="yes-display-inline">Compliance with this title shall be
				enforced under the <act-name parsable-cite="FTCA">Federal Trade Commission
				Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15
				U.S.C. 41</external-xref> et seq.), and a violation of any requirement imposed
				under this title shall be deemed a violation of a requirement imposed under
				that Act. All of the functions and powers of the Federal Trade Commission under
				the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> are
				available to the Commission to enforce compliance by any person with the
				requirements of this title, irrespective of whether that person is engaged in
				commerce or meets any other jurisdictional test under the
				<act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name>.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="IDCD0DC6446D5249119800B57B5E0067A3"><enum>(b)</enum><header display-inline="yes-display-inline">State enforcement</header>
							<paragraph commented="no" display-inline="no-display-inline" id="IDE2554ADC2A444E2B9CD6F0C5D4522FCD"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An action to enforce the requirements
				imposed by this title may also be brought by the appropriate State attorney
				general in any appropriate United States district court, or any other court of
				competent jurisdiction.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8D7C4366F4F648CEBE09999F5B609D05"><enum>(2)</enum><header display-inline="yes-display-inline">Prior written notice</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDB654C8DCB38847FF99F193DA25621400"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The State attorney general shall provide
				prior written notice of any civil action described in paragraph (1) to the
				Federal Trade Commission, and shall provide the Commission with a copy of the
				complaint.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3E246E38D5A04F4486B5F3C906D9B2CC"><enum>(B)</enum><header display-inline="yes-display-inline">Emergency action</header><text display-inline="yes-display-inline">If prior notice required by this paragraph
				is not feasible, the State attorney general shall provide notice to the
				Commission immediately upon instituting the action.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDE8DE5ACB7404D76B363D5CF2997651F"><enum>(3)</enum><header display-inline="yes-display-inline">FTC intervention</header><text display-inline="yes-display-inline">The Commission may—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID19DF178B6108431089E9841B892F7D29"><enum>(A)</enum><text display-inline="yes-display-inline">intervene in an action described in
				paragraph (1);</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID26BDE60F0A5E4041909BDBC378F469BD"><enum>(B)</enum><text display-inline="yes-display-inline">upon intervening—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID1A394A7FEDF94225AD24E3787407DE96"><enum>(i)</enum><text display-inline="yes-display-inline">remove the action to the appropriate United
				States district court, if it was not originally brought there; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID5D60C4DC2BFE41208589AA2E3C959000"><enum>(ii)</enum><text display-inline="yes-display-inline">be heard on all matters arising in the
				action; and</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID99DEA6921ED643B6AED03C86413631A4"><enum>(C)</enum><text display-inline="yes-display-inline">file a petition for appeal.</text>
								</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDEB815F950CA944F580BCAB73F617994D" section-type="subsequent-section"><enum>1017.</enum><header display-inline="yes-display-inline">Criminal liability for willful and knowing
				violation</header><text display-inline="no-display-inline">Whoever willfully
				and knowingly gives false or inaccurate information, or fails to provide
				information which that person is required to disclose under the provisions of
				this title or any regulation issued under this title shall be subject to the
				penalty provisions as provided in section 112.</text>
					</section><section commented="no" display-inline="no-display-inline" id="IDDCE3A5ED8E2746728433B2C845994F07" section-type="subsequent-section"><enum>1018.</enum><header display-inline="yes-display-inline">Relation to other laws</header>
						<subsection commented="no" display-inline="no-display-inline" id="ID1E43D96D15214E00B2CC854500F65E68"><enum>(a)</enum><header display-inline="yes-display-inline">Relation to State law</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID4E4887EFCDF24746A4D37BE361E4AE00"><enum>(1)</enum><header display-inline="yes-display-inline">No effect on consistent State
				laws</header><text display-inline="yes-display-inline">Except as otherwise
				provided in subsection (b), this title does not annul, alter, or affect in any
				manner the meaning, scope, or applicability of the laws of any State relating
				to rental-purchase agreements, except to the extent that those laws are
				inconsistent with any provision of this title, and then only to the extent of
				the inconsistency.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID79165279F4F2462DA1F2B0C388580023"><enum>(2)</enum><header display-inline="yes-display-inline">Determination of
				inconsistency</header><text display-inline="yes-display-inline">Upon its own
				motion or upon the request of an interested party, which is submitted in
				accordance with procedures prescribed by regulation of the Board, the Board
				shall determine whether any such inconsistency exists. If the Board determines
				that a term or provision of a State law is inconsistent with a provision of
				this title, merchants located in that State shall not be required to comply
				with that term or provision, and shall incur no liability under the law of that
				State for failure to follow such term or provision, notwithstanding that such
				determination is subsequently amended, rescinded, or determined by judicial or
				other authority to be invalid for any reason.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDC016B26A22546028C1CD83564CA7997"><enum>(3)</enum><header display-inline="yes-display-inline">Greater protection under State
				law</header><text display-inline="yes-display-inline">Except as provided in
				subsection (b), for purposes of this section, a term or provision of a State
				law is not inconsistent with the provisions of this title if the term or
				provision affords greater protection and benefit to the consumer than the
				protection and benefit provided under this title, as determined by the Board,
				on its own motion or upon the petition of any interested party.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID77F1A6A2D94E4D8D9908692714A6DFC8"><enum>(b)</enum><header display-inline="yes-display-inline">State laws relating to characterization of
				transaction</header><text display-inline="yes-display-inline">Notwithstanding
				subsection (a), this title shall supersede any State law, to the extent that
				such law—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID8777427B993940928D9FA41E3B605520"><enum>(1)</enum><text display-inline="yes-display-inline">regulates a rental-purchase agreement as a
				security interest, credit sale, retail installment sale, conditional sale, or
				any other form of consumer credit, or that imputes to a rental-purchase
				agreement the creation of a debt or extension of credit; or</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1D4C79362F5C4B25BB91AC9C84A2F750"><enum>(2)</enum><text display-inline="yes-display-inline">requires the disclosure of a percentage
				rate calculation, including a time-price differential, an annual percentage
				rate, or an effective annual percentage rate.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID808B9C9D64A9406BA176BF5102338B31"><enum>(c)</enum><header display-inline="yes-display-inline">Relation to <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name></header><text display-inline="yes-display-inline">No provision of this title shall be
				construed as limiting, superseding, or otherwise affecting the applicability of
				the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> to
				any merchant or rental-purchase transaction.</text>
						</subsection></section><section commented="no" display-inline="no-display-inline" id="ID8D7A7E0DD86E4B26B940BB863EE24DC5" section-type="subsequent-section"><enum>1019.</enum><header display-inline="yes-display-inline">Effect on Government agencies</header><text display-inline="no-display-inline">No civil liability or criminal penalty under
				this title may be imposed on the United States or any of its departments or
				agencies, any State or political subdivision thereof, or any agency of a State
				or political subdivision thereof.</text>
					</section><section commented="no" display-inline="no-display-inline" id="ID5BB226DFAD3F4898AF35A230307BA1BA" section-type="subsequent-section"><enum>1020.</enum><header display-inline="yes-display-inline">Compliance date</header><text display-inline="no-display-inline">Compliance with this title shall not be
				required until 6 months after the date of enactment of this title. In any case,
				a merchant may comply with this title at any time after such date of
				enactment.</text>
