			<section commented="no" display-inline="no-display-inline" id="id5d6910c2-d802-4044-99ee-eb618a5eba3a" section-type="subsequent-section"><enum>101.</enum><header display-inline="yes-display-inline">Level-premium term life insurance for
			 veterans with service-connected disabilities</header>
				<subsection commented="no" display-inline="no-display-inline" id="id48b1a815-8918-4976-bd5e-5e010bf354f7"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Chapter 19 is amended by inserting after
			 section 1922A the following new section:</text>
					<quoted-block changed="deleted" committee-id="SSVA00" display-inline="no-display-inline" id="idc0303ad6-b630-4a58-aa0d-e0d4cfc1a8e6" reported-display-style="strikethrough" style="USC">
						<section commented="no" display-inline="no-display-inline" id="id3065694d-bcae-4ab8-bef1-5daf5f60da0f" section-type="subsequent-section"><enum>1922B.</enum><header display-inline="yes-display-inline">Level-premium term life insurance for
				veterans with service-connected disabilities</header>
							<subsection commented="no" display-inline="no-display-inline" id="id1e52a53d-dff0-437d-967b-93025f473eca"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In accordance with the provisions of this
				section, the Secretary shall grant insurance to each eligible veteran who seeks
				such insurance against the death of such veteran occurring while such insurance
				is in force.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id593f74de-26af-4b89-b4fb-20126a2f914e"><enum>(b)</enum><header display-inline="yes-display-inline">Eligible veterans</header><text display-inline="yes-display-inline">For purposes of this section, an eligible
				veteran is any veteran less than 65 years of age who has a service-connected
				disability.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idb02684eb-4052-45a2-8abf-76b9073ddbfa"><enum>(c)</enum><header display-inline="yes-display-inline">Amount of insurance</header><paragraph commented="no" display-inline="yes-display-inline" id="id102a2e45-d5d6-4b13-a7cd-b34c8f9d735d"><enum>(1)</enum><text display-inline="yes-display-inline">Subject to paragraph (2), the amount of
				insurance granted an eligible veteran under this section shall be $50,000 or
				such lesser amount as the veteran shall elect. The amount of insurance so
				elected shall be evenly divisible by $10,000.</text>
								</paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id4c93a2f7-af28-44a4-a9c2-10195baec447" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">The aggregate amount of insurance of an
				eligible veteran under this section, section 1922 of this title, and section
				1922A of this title may not exceed $50,000.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id97dc8370-90a8-4449-b3eb-0a261c4684f5"><enum>(d)</enum><header display-inline="yes-display-inline">Reduced amount for veterans age 70 or
				older</header><text display-inline="yes-display-inline">In the case of a
				veteran insured under this section who turns age 70, the amount of insurance of
				such veteran under this section after the date such veteran turns age 70 shall
				be the amount equal to 20 percent of the amount of insurance of the veteran
				under this section as of the day before such date.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="iddf7c80b4-8399-4281-85f1-7485bab012e9"><enum>(e)</enum><header display-inline="yes-display-inline">Premiums</header><paragraph commented="no" display-inline="yes-display-inline" id="id222a4808-318c-42b3-984f-7e8e9a847084"><enum>(1)</enum><text display-inline="yes-display-inline">Premium rates for insurance under this
				section shall be based on the 2001 Commissioners Standard Ordinary Basic Table
				of Mortality and interest at the rate of 4.5 per centum per annum.</text>
								</paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id021fc262-3232-400f-83b1-213f296d7739" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">The amount of the premium charged a veteran
				for insurance under this section may not increase while such insurance is in
				force for such veteran.</text>
								</paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idbbeee0ed-e05f-4fab-a23c-9ee420d12147" indent="up1" reported-display-style="strikethrough"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary may not charge a premium for
				insurance under this section for a veteran as follows:</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idc21e57e3-197b-4701-bafa-c7b58bfa8dc6"><enum>(A)</enum><text display-inline="yes-display-inline">A veteran who has a service-connected
				disability rated as total and is eligible for a waiver of premiums under
				section 1912 of this title.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id72a9d52c-f152-41f1-9664-326279c30823"><enum>(B)</enum><text display-inline="yes-display-inline">A veteran who is 70 years of age or
				older.</text>
									</subparagraph></paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id4ab03779-dc5e-4112-8aed-42c1d4d275ce" indent="up1" reported-display-style="strikethrough"><enum>(4)</enum><text display-inline="yes-display-inline">Insurance granted under this section shall
				be on a nonparticipating basis and all premiums and other collections therefor
				shall be credited directly to a revolving fund in the Treasury of the United
				States, and any payments on such insurance shall be made directly from such
				fund. Appropriations to such fund are hereby authorized.</text>
								</paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id0f617d21-a38e-4a65-9cab-a14da5804a94" indent="up1" reported-display-style="strikethrough"><enum>(5)</enum><text display-inline="yes-display-inline">Administrative costs to the Government for
				the costs of the program of insurance under this section shall be paid from
				premiums credited to the fund under paragraph (4), and payments for claims
				against the fund under paragraph (4) for amounts in excess of amounts credited
				to such fund under that paragraph (after such administrative costs have been
				paid) shall be paid from appropriations to the fund.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7a0f3381-01b0-4b5e-8b14-8c3bc622ca87"><enum>(f)</enum><header display-inline="yes-display-inline">Application required</header><text display-inline="yes-display-inline">An eligible veteran seeking insurance under
				this section shall file with the Secretary an application therefor. Such
				application shall be filed not later than the earlier of—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id584661b0-2712-47fc-8f10-f3881fada78b"><enum>(1)</enum><text display-inline="yes-display-inline">the end of the two-year period beginning on
				the date on which the Secretary notifies the veteran that the veteran has a
				service-connected disability; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb9d82ce0-7233-429f-864c-74b5d1a41012"><enum>(2)</enum><text display-inline="yes-display-inline">the end of the 10-year period beginning on
				the date of the separation of the veteran from the Armed Forces, whichever is
				earlier.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id7d70bcf4-859c-452c-b482-6a34b33184c2"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of
			 chapter 19 is amended by inserting after the item related to section 1922A the
			 following new item:</text>

				</subsection><subsection commented="no" display-inline="no-display-inline" id="id17b2a457-a9c2-47e8-a23b-ea848b1f5555"><enum>(c)</enum><header display-inline="yes-display-inline">Exchange of service disabled veterans'
			 insurance</header><text display-inline="yes-display-inline">During the one-year
			 period beginning on the effective date of this section under subsection (d),
			 any veteran insured under section 1922 of title 38, United States Code, who is
			 eligible for insurance under section 1922B of such title (as added by
			 subsection (a)), may exchange insurance coverage under such section 1922 for
			 insurance coverage under such section 1922B.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id4F45F4122D914288A3D5517523BFBF84"><enum>(d)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">This section, and the
			 amendments made by this section, shall take effect on April 1, 2010.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idB6726DAFA944401EBCC18E9FA7EE5065" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Supplemental insurance for totally disabled
			 veterans</header>
				<subsection commented="no" display-inline="no-display-inline" id="idDF00E9E730234B9E9C46ADC28CFE937A"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1922A(a) is amended by striking
			 <quote>$20,000</quote> and inserting <quote>$30,000</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idBB3ADBA6AFA144B49DA8CF4DAA7823C8"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 subsection (a) shall take effect on January 1, 2010.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id24F76C5E92B94D90AE6193DBAFF3ADFA" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Expansion of individuals qualifying for
			 retroactive benefits from traumatic injury protection coverage under
			 Servicemembers' Group Life Insurance</header>
				<subsection commented="no" display-inline="no-display-inline" id="id564FD92F34084764A990990951F73F21"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Paragraph (1) of section 501(b) of the
			 Veterans' Housing Opportunity and Benefits Improvement Act of 2006 (Public Law
			 109–233; 120 Stat. 414; 38 U.S.C. 1980A note) is amended by striking <quote>,
			 if, as determined by the Secretary concerned, that loss was a direct result of
			 a traumatic injury incurred in the theater of operations for Operation Enduring
			 Freedom or Operation Iraqi Freedom</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idE743CB43D4E84210A3C432D3E28EF8F4"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">The heading of such section is amended by
			 striking <quote><header-in-text level="subsection" style="OLC">in Operation
			 Enduring Freedom and Operation Iraqi Freedom</header-in-text></quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id96E1FBB50E2A497B8855A857CBCCEB15"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall take effect on January 1, 2010.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idb36485b0-10d2-4f54-8d50-a0caa43f66c2" section-type="subsequent-section"><enum>104.</enum><header display-inline="yes-display-inline">Enhancement of veterans' mortgage life
			 insurance</header><text display-inline="no-display-inline">Section 2106(b) is
			 amended by striking <quote>$90,000</quote> and inserting <quote>$150,000, or
			 $200,000 after January 1, 2012,</quote>.</text>
			</section><section commented="no" display-inline="no-display-inline" id="idB2A1567B9B634F9A8A1721CC5B276856" section-type="subsequent-section"><enum>105.</enum><header>Adjustment of
			 coverage of dependents under Servicemembers' Group Life Insurance</header><text display-inline="no-display-inline">Clause (ii) of section 1968(a)(5)(B) is
			 amended to read as follows:</text>

			<section commented="no" display-inline="no-display-inline" id="id7E587EB287B24B568C736CAF1F3FE081" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Cost-of-living increase for temporary
			 dependency and indemnity compensation payable for surviving spouses with
			 dependent children under the age of 18</header><text display-inline="no-display-inline">Section 1311(f) is amended by adding at the
			 end the following new paragraph:</text>
				<quoted-block changed="deleted" committee-id="SSVA00" display-inline="no-display-inline" id="id757B3209CBE04443BC4234C5FF6E0630" reported-display-style="strikethrough" style="USC">
					<paragraph commented="no" display-inline="no-display-inline" id="idF07CC90641F34E7B877692477297F420" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">Whenever there is an increase in benefit
				amounts payable under title II of the Social Security Act (42 U.S.C. 401 et
				seq.) as a result of a determination made under section 215(i) of such Act (42
				U.S.C. 415(i)), the Secretary shall, effective on the date of such increase in
				benefit amounts, increase the amount payable under paragraph (1), as such
				amount was in effect immediately prior to the date of such increase in benefit
				amounts, by the same percentage as the percentage by which such benefit amounts
				are increased. Any increase in a dollar amount under this paragraph shall be
				rounded down to the next lower whole dollar
				amount.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="idBBBB8DC86F4C41CBB48BBFAE8BA45B07" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Eligibility of veterans 65 years of age or
			 older for service pension for a period of war</header>
				<subsection commented="no" display-inline="no-display-inline" id="idBE242C3B92A6462789B8A3095C608E5A"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1513 is
			 amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idADFE5DE3CA724A1D810F9D24C5FAF57C"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>by
			 section 1521</quote> and all that follows and inserting <quote>by subsection
			 (b), (c), (f)(1), (f)(5), or (g) of that section, as the case may be and as
			 increased from time to time under section 5312 of this title.</quote>;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4DA2866558684611A8E61A0FF0129EB1"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsection (b) as
			 subsection (c); and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id902A281530254409971E5FD69BC07AA8"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the
			 following new subsection (b):</text>

				of section 1521 of this title shall apply to determinations of income and
				maximum payments of pension for purposes of this

					</paragraph></subsection><subsection id="id0559D2083E744C788757BF84723330AF"><enum>(b)</enum><header>Application</header><text>The
			 amendments made by this section shall apply with respect to claims for pensions
			 filed on or after the date of the enactment of this Act.</text>
				</subsection></section><section id="id7F1054B66944475F945980C2C57DDCB2" section-type="subsequent-section"><enum>203.</enum><header>Adjustments in

					<paragraph commented="no" display-inline="no-display-inline" id="id8547CE730BC1417F917E15C5DEEF9E4A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Chapter 23 is amended by inserting after
			 section 2302 the following new section:</text>

				specifically provided for purposes of this subsection in advance in an
				appropriations Act, whenever the Secretary makes a payment for the burial and
				funeral of a veteran under section 2302(a) of this title, the Secretary is also
				authorized and directed to pay the recipient of such payment a supplemental
				payment under this section for the cost of such burial and funeral.</text>
									</paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id8BA38F4C9A274FC7B679A54CDC4A5306" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">No supplemental payment shall be made under
				this subsection if the Secretary has expended all funds that were specifically
				provided for purposes of this subsection in an appropriations Act.</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id17BDA7CEF4234098AF422BDA5742E180"><enum>(b)</enum><header display-inline="yes-display-inline">Amount</header><text display-inline="yes-display-inline">The amount of the supplemental payment
				required by subsection (a) for any death is $900 (as adjusted from time to time
				under subsection (c)).</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="idA337A59755F6455D9A32E64CAF30C465"><enum>(c)</enum><header display-inline="yes-display-inline">Adjustment</header><text display-inline="yes-display-inline">With respect to deaths that occur in any
				fiscal year after fiscal year 2009, the supplemental payment described in
				subsection (b) shall be equal to the sum of—</text>
									<paragraph commented="no" display-inline="no-display-inline" id="id4291BFB5DA32441BB3099D7900AC3008"><enum>(1)</enum><text display-inline="yes-display-inline">the supplemental payment in effect under
				subsection (b) for the preceding fiscal year (determined after application of
				this subsection), plus</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id558BA5FE5EC24CB9A1283094C191C12B"><enum>(2)</enum><text display-inline="yes-display-inline">the sum of the amount described in section
				2302(a) of this title and the amount under paragraph (1), multiplied by the
				percentage by which—</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="id6708741BB8CA4383AE4392C7EA8F3B1C"><enum>(A)</enum><text display-inline="yes-display-inline">the Consumer Price Index (all items, United
				States city average) for the 12-month period ending on the June 30 preceding
				the beginning of the fiscal year for which the increase is made, exceeds</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7A925CF7352D40E88E80B722DB350184"><enum>(B)</enum><text display-inline="yes-display-inline">such Consumer Price Index for the 12-month
				period preceding the 12-month period described in subparagraph (A).</text>
										</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6514C15A29654C48873605DE2F7E7140"><enum>(d)</enum><header display-inline="yes-display-inline">Estimates</header><paragraph commented="no" display-inline="yes-display-inline" id="id030C40E017374447BDB3E6F904F28FF9"><enum>(1)</enum><text display-inline="yes-display-inline">From time to time, the Secretary shall make
				an estimate of—</text>
										<subparagraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id5A79EE2174B2425BB95446154BDFC37A" indent="up1" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">the amount of funding that would be
				necessary to provide supplemental payments under this section to all eligible
				recipients for the remainder of the fiscal year in which such an estimate is
				made; and</text>
										</subparagraph><subparagraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idCBE3A23D0E974C768D6AAF9C79217DF6" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">the amount that Congress would need to
				appropriate to provide all eligible recipients with supplemental payments under
				this section in the next fiscal year.</text>
										</subparagraph></paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idFCAE56E1CC4345599BAB23C78B860231" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">On the dates described in paragraph (3),
				the Secretary shall submit to the appropriate committees of Congress the
				estimates described in paragraph (1).</text>

				2307(1) of this title and the amount under paragraph (1), multiplied by the
				percentage by which—</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="id077258832F7D4D72A3B29ED75BCCCEAA"><enum>(A)</enum><text display-inline="yes-display-inline">the Consumer Price Index (all items, United
				States city average) for the 12-month period ending on the June 30 preceding
				the beginning of the fiscal year for which the increase is made, exceeds</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC416B0C947B74CEEBA149C874038F8FB"><enum>(B)</enum><text display-inline="yes-display-inline">such Consumer Price Index for the 12-month
				period preceding the 12-month period described in subparagraph (A).</text>
										</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3B41C1036C4A45F9B7B470887ACEB780"><enum>(d)</enum><header display-inline="yes-display-inline">Estimates</header><paragraph commented="no" display-inline="yes-display-inline" id="idA577D6C371014534912C53909FC36E04"><enum>(1)</enum><text display-inline="yes-display-inline">From time to time, the Secretary shall make
				an estimate of—</text>
										<subparagraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idB9B91F97C35E4DE0B2B587D5BF3C5642" indent="up1" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">the amount of funding that would be
				necessary to provide supplemental payments under this section to all eligible
				recipients for the remainder of the fiscal year in which such an estimate is
				made; and</text>
										</subparagraph><subparagraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id55E106E8852E4185A73BA61EE8492663" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">the amount that Congress would need to
				appropriate to provide all eligible recipients with supplemental payments under
				this section in the next fiscal year.</text>
										</subparagraph></paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id9CA037741BDD4386AE01A4E94CCC66CA" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">On the dates described in paragraph (3),
				the Secretary shall submit to the appropriate committees of Congress the
				estimates described in paragraph (1).</text>

			 section 2303 the following new section:</text>

				specifically provided for purposes of this subsection in advance in an
				appropriations Act, whenever the Secretary makes a payment for the burial and
				funeral of a veteran under section 2303(a)(1)(A) of this title, or for the
				burial of a veteran under paragraph (1) or (2) of section 2303(b) of this
				title, the Secretary is also authorized and directed to pay the recipient of
				such payment a supplemental payment under this section for the cost of such
				burial and funeral or burial, as applicable.</text>
								</paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idE7770692239643BCB6AA0987B9C56796" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">No supplemental plot allowance payment
				shall be made under this subsection if the Secretary has expended all funds
				that were specifically provided for purposes of this subsection in an

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idBB9DC251362F435D9E3224DF85BAB7CE"><enum>(b)</enum><header display-inline="yes-display-inline">Amount</header><text display-inline="yes-display-inline">The amount of the supplemental payment
				required by subsection (a) for any death is $445 (as adjusted from time to time
				under subsection (c)).</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idE3648AE1CFE84234974C0157B5C0FD0E"><enum>(c)</enum><header display-inline="yes-display-inline">Adjustment</header><text display-inline="yes-display-inline">With respect to deaths that occur in any
				fiscal year after fiscal year 2009, the supplemental payment described in
				subsection (b) shall be equal to the sum of—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="idC173B3568C2A4B22B84C8ECC60F598CA"><enum>(1)</enum><text display-inline="yes-display-inline">the supplemental payment in effect under
				subsection (b) for the preceding fiscal year (determined after application of
				this subsection), plus</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC7AF90D1803A4E2C91F4B582F61B9A87"><enum>(2)</enum><text display-inline="yes-display-inline">the sum of the amount described in section
				2303(a)(1)(A) of this title and the amount under paragraph (1), multiplied by

							</subsection><subsection commented="no" display-inline="no-display-inline" id="id69D4AE91ACC940BDAB63881918C1BCCD"><enum>(d)</enum><header display-inline="yes-display-inline">Adjustment</header><paragraph commented="no" display-inline="yes-display-inline" id="idC4FFF07E51EA4563B7E5C3CC4C5754F9"><enum>(1)</enum><text display-inline="yes-display-inline">Effective on October 1 of each year
				(beginning in 2009), the Secretary shall increase the adjusted amount described
				in subsection (c) to an amount equal to 80 percent of the average retail cost
				of new automobiles for the preceding calendar year.</text>

				subsection. The Secretary may use data developed in the private sector if the

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id20BB6BBC24B94A1E8A2303BFB1FA9584"><enum>(e)</enum><header display-inline="yes-display-inline">Estimates</header><paragraph commented="no" display-inline="yes-display-inline" id="id1884FBB97B5D4B4EB303E5F7D1F3BC52"><enum>(1)</enum><text display-inline="yes-display-inline">From time to time, the Secretary shall make
				an estimate of—</text>
									<subparagraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="idDC44A9B5454C44469BBEC3E02FD6ACD1" indent="up1" reported-display-style="strikethrough"><enum>(A)</enum><text display-inline="yes-display-inline">the amount of funding that would be
				necessary to provide supplemental payment under this section for every eligible
				person for the remainder of the fiscal year in which such an estimate is made;
				and</text>
									</subparagraph><subparagraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id55BC9D5AB55C4082890C97AC66710CA4" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text display-inline="yes-display-inline">the amount that Congress would need to
				appropriate to provide every eligible person with supplemental payment under
				this section in the next fiscal year.</text>
									</subparagraph></paragraph><paragraph changed="deleted" commented="no" committee-id="SSVA00" display-inline="no-display-inline" id="id8C68AA7D71F9431BA7A06CE52CA67007" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><text display-inline="yes-display-inline">On the dates described in paragraph (3),
				the Secretary shall submit to the appropriate committees of Congress the
				estimates described in paragraph (1).</text>

			 second sentence of subsection (b)(1) of section 1980A of title 38, United
			 States Code; and</text>

			 dependency and indemnity compensation payable for surviving spouses with
			 dependent children under the age of 18</header><text display-inline="no-display-inline">Section 1311(f) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id7286473A68CC4C5FBD33D23F98A2544B"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>(as

				benefit amounts, increase the amount payable under paragraph (1), as such
				amount was in effect immediately prior to the date of such increase in benefit
				amounts, by the same percentage as the percentage by which such benefit amounts
				are increased. Any increase in a dollar amount under this paragraph shall be
				rounded down to the next lower whole dollar
				amount.</text>

				</paragraph></section><section commented="no" display-inline="no-display-inline" id="idc6930e38-1140-485f-9487-c979dacbb3b4" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Eligibility of veterans 65 years of age or
			 older for service pension for a period of war</header>
				<subsection commented="no" display-inline="no-display-inline" id="idde73a6e2-4a90-4b52-b88f-86c5f9246d99"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1513 is
			 amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id4190c616-dde4-453c-a409-351eaa593774"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>by
			 section 1521</quote> and all that follows and inserting <quote>by subsection
			 (b), (c), (f)(1), (f)(5), or (g) of that section, as the case may be and as
			 increased from time to time under section 5312 of this title.</quote>;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfe2e9a93-2691-48b9-8a12-21a6fcd05e6e"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsection (b) as
			 subsection (c); and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9c526233-5495-4591-86b0-76116ea37f32"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the
			 following new subsection (b):</text>

					</paragraph></subsection><subsection id="id3b171253-acb6-4299-b149-9d3c18f24b24"><enum>(b)</enum><header>Applicability</header><text>The
			 amendments made by this section shall apply with respect to any claim for
			 pension filed on or after the date of the enactment of this Act.</text>
				</subsection></section><section id="idE3B53F84464342B88021D1544EE8303D" section-type="subsequent-section"><enum>203.</enum><header>Clarification of
			 additional requirements for consideration to be afforded time, place, and
			 circumstances of service in determinations regarding service-connected
			 disabilities</header>
				<subsection id="idCB9E52D7C0614F69B36D4A6F6C2ED14E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subsection (a) of
			 section 1154 is amended to read as follows:</text>
					<quoted-block changed="added" display-inline="no-display-inline" id="idA0EB4B2ED2924805B8B795A7F93EDA21" reported-display-style="italic" style="OLC">
						<subsection id="idDE62CA93C2094DCBB5084F0AB2320459"><enum>(a)</enum><text>The Secretary shall
				include in the regulations pertaining to service-connection of disabilities the
				following:</text>
							<paragraph id="id28C8EEFA3ED642159CE0ECD7924ED12C"><enum>(1)</enum><text>Provisions requiring
				that, in each case where a veteran is seeking service-connection for any
				disability, due consideration shall be given to the places, types, and
				circumstances of such veteran's service as shown by—</text>
								<subparagraph id="id0FF09902018546CDB7AACAB524BB3763"><enum>(A)</enum><text>such veteran's service
				record;</text>
								</subparagraph><subparagraph id="id76A174BD690B46FABFB2548B1135E9BF"><enum>(B)</enum><text>the official history of
				each organization in which such veteran served;</text>
								</subparagraph><subparagraph id="id942E5D8E74C243CCB7EADE003F5FC076"><enum>(C)</enum><text>such veteran's medical
				records; and</text>
								</subparagraph><subparagraph id="idFDBAF777623949F5BF1395E1212817E0"><enum>(D)</enum><text>all pertinent medical and
				lay evidence.</text>
								</subparagraph></paragraph><paragraph id="ID2dd99709a23e448e98ae6968180118ed"><enum>(2)</enum><text>Provisions generally
				recognizing circumstances in which lay evidence consistent with the place,
				conditions, dangers, or hardships associated with particular military service
				does not require confirmatory official documentary evidence in order to
				establish the occurrence of an event or exposure during active military, naval,
				or air service.</text>
							</paragraph><paragraph id="idAC02252E3F484313B7E73BD0AA6E8249"><enum>(3)</enum><text>The provisions required
				by section 5 of the Veterans' Dioxin and Radiation Exposure Compensation
				Standards Act (Public Law 98–542; 98 Stat.
				2727).</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="id8531256AF6354F10A76A52C36D1212E6"><enum>(b)</enum><header>Regulations</header>
					<paragraph id="id921FCF91B3F144E98F6519DC5C300DE6"><enum>(1)</enum><header>In
			 general</header><text>Not later than 210 days after the date of the enactment
			 of this Act, the Secretary of Veterans Affairs shall promulgate regulations to
			 implement section 1154(a)(2) of title 38, United States Code, as added by
			 subsection (a).</text>
					</paragraph><paragraph id="id361E479D610F43FEBBCBD64B6882B4A0"><enum>(2)</enum><header>Interim
			 regulations</header><text>In the case that the Secretary is unable to
			 promulgate final regulations under paragraph (1) on or before the date that is
			 210 days after the date of the enactment of this Act, the Secretary shall
			 promulgate interim regulations on or before such date to be in effect until
			 such time as the Secretary promulgates final regulations.</text>
					</paragraph></subsection></section><section id="idE5ED1446FFC5435DBCE2C88DC264B278" section-type="subsequent-section"><enum>204.</enum><header>Extension of reduced
			 pension for certain veterans covered by Medicaid plans for services furnished
			 by nursing facilities</header><text display-inline="no-display-inline">Section
			 5503(d)(7) is amended by striking <quote>September 30, 2011</quote> and
			 inserting <quote>September 30, 2014</quote>.</text>
			</section><section id="idB051B42EB5A544E6BF9A61E51D53A5E0" section-type="subsequent-section"><enum>205.</enum><header>Enhancement of
			 disability compensation for certain disabled veterans with difficulties using
			 prostheses and disabled veterans in need of regular aid and attendance for
			 residuals of traumatic brain injury</header>
				<subsection id="id2C9E60191CA540639538A9B3AC7A5E72"><enum>(a)</enum><header>Veterans Suffering
			 Anatomical Loss of Hands, Arms, or Legs</header><text display-inline="yes-display-inline">Section 1114 is amended—</text>
					<paragraph id="id2EDBEF9BE1BC4BD4A69E4A4A6361EC88"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (m)—</text>
						<subparagraph id="idEEC2352B4E4840DA9F4030FA88DA4193"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>at a level, or with
			 complications,</quote> and inserting <quote>with factors</quote>; and</text>
						</subparagraph><subparagraph id="idA29F4BBE887D45B387F69AAA79F67A6B"><enum>(B)</enum><text>by striking <quote>at

			 levels, or with complications,</quote> and inserting <quote>with
			 factors</quote>;</text>

					</paragraph></subsection><subsection id="idC97B6BA2C75C452CBFA25FFA7717C8E5"><enum>(b)</enum><header>Veterans with
			 service-Connected disabilities in need of regular aid and attendance for
			 residuals of traumatic brain injury</header>
					<paragraph id="idF60A55E4D62949D69089D2C628082E78"><enum>(1)</enum><header>In
			 general</header><text>Such section is further amended—</text>
						<subparagraph id="id9C395899996D477ABCDED55BB2E3E954"><enum>(A)</enum><text>in subsection (p), by

				disability, is in need of regular aid and attendance for the residuals of
				traumatic brain injury, is not eligible for compensation under subsection
				(r)(2), and in the absence of such regular aid and attendance would require
				hospitalization, nursing home care, or other residential institutional care,
				the veteran shall be paid, in addition to any other compensation under this
				section, a monthly aid and attendance allowance equal to the rate described in
				subsection (r)(2), which for purposes of section 1134 of this title shall be
				considered as additional compensation payable for disability. An allowance
				authorized under this subsection shall be paid in lieu of any allowance
				authorized by subsection
				(r)(1).</text>
								</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</subparagraph></paragraph><paragraph id="idAAB15BFA1FC64F72B5786906C4C91EF1"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 5503(c) is amended by striking <quote>in
			 section 1114(r)</quote> and inserting <quote>in subsection (r) or (t) of
			 section 1114</quote>.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id38477FC366814CCAB0BC28CA227B568D"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect on
			 August 31, 2010.</text>
				</subsection></section><section id="idACEC82FAF94246438F47B5731A254B4A" section-type="subsequent-section"><enum>206.</enum><header>Commencement of
			 period of payment of original awards of compensation for veterans retired or
			 separated from the uniformed services for catastrophic disability</header>
				<subsection id="id2C098B2B686442ED82838D74D9050A63"><enum>(a)</enum><header>Commencement of period
			 of payment</header><text>Subsection (a) of section 5111 is amended—</text>
					<paragraph id="idA85A0FF375804ECE8D2734D5B65BA847"><enum>(1)</enum><text>by inserting
			 <quote>(1)</quote> after <quote>(a)</quote>;</text>
					</paragraph><paragraph id="id750D4F6297374CA0A14F1878F60A6DA8"><enum>(2)</enum><text>in paragraph (1), as
			 designated by paragraph (1) of this subsection, by striking <quote>in
			 subsection (c) of this section</quote> and inserting <quote>in paragraph (2) of

				veteran who is retired or separated from the active military, naval, or air
				service for a catastrophic disability or disabilities, payment of monetary
				benefits based on an award of compensation based on an original claim shall be
				made as of the date on which such award becomes effective as provided under
				section 5110 of this title or another applicable provision of law.</text>
								</subparagraph><subparagraph changed="added" id="idC651A5DE055D43649C4D483372436643" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>In
				this paragraph, the term <term>catastrophic disability</term>, with respect to
				a veteran, means a permanent, severely disabling injury, disorder, or disease
				that compromises the ability of the veteran to carry out the activities of
				daily living to such a degree that the veteran requires personal or mechanical
				assistance to leave home or bed, or requires constant supervision to avoid
				physical harm to self or
				others.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id905D5165D44E427381D8EF6054421526"><enum>(b)</enum><header>Effective
			 date</header><text>The amendments made by subsection (a) shall take effect on
			 the date of the enactment of this Act and shall apply with respect to awards of
			 compensation based on original claims that become effective on or after that
			 date.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id219EF99E3B534F24BB2D59133028398F"><enum>(c)</enum><header>Technical correction
			 regarding waiver of retired pay</header><text display-inline="yes-display-inline">Section 5305 is amended by striking
			 <quote>section 1414</quote> and inserting <quote>sections 1212(d)(2) and
			 1414</quote>.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idBEDE45A1C1FF4F9691B08826073749EA"><enum>207.</enum><header>Applicability of
			 limitation to pension payable to certain children of veterans of a period of
			 war</header><text display-inline="no-display-inline">Section 5503(d)(5) is
			 amended—</text>

			 allowance</header><text>Subsection (a) of section 3902 is amended by striking
			 <quote>$11,000</quote> and inserting <quote>$22,500 (as adjusted from time to
			 time under subsection (e))</quote>.</text>
				</subsection><subsection id="id1E87E636881B47BC9F1026E70BDF92DA"><enum>(b)</enum><header>Annual
			 adjustment</header><text>Such section is further amended by adding at the end
			 the following new subsection:</text>

				of each year (beginning in 2011), the Secretary shall increase the dollar
				amount in effect under subsection (a) to an amount equal to 80 percent of the
				average retail cost of new automobiles for the preceding calendar year.</text>
							</paragraph><paragraph changed="added" id="id64D97018ABB9473A97639D7EA52C25AF" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The
				Secretary shall establish the method for determining the average retail cost of
				new automobiles for purposes of this subsection. The Secretary may use data
				developed in the private sector if the Secretary determines the data is
				appropriate for purposes of this
				subsection.</text>

				only upon the assignment, transfer, and delivery to the Secretary (in a form
				and manner satisfactory to the Secretary) of all rights, interest, claims,
				evidence, and records with respect to the housing
				loan.</text>

				waiver of sovereign immunity, under the 11th amendment to the Constitution or
				otherwise, to a suit brought by—</text>
									<subparagraph changed="added" id="HF2ED98B2E3A148B280D0928E34004611" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>a
				person who is or was an employee in that program or activity for the rights or
				benefits authorized the person by this chapter;</text>
									</subparagraph><subparagraph changed="added" id="H0093CC8161324369A8B4EA6D21D600F7" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>a
				person applying to be such an employee in that program or activity for the
				rights or benefits authorized the person by this chapter; or</text>
									</subparagraph><subparagraph changed="added" id="H22176078772B4D34AC25512E44C898EF" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>a
				person seeking reemployment as an employee in that program or activity for the
				rights or benefits authorized the person by this chapter.</text>
									</subparagraph></paragraph><paragraph changed="added" id="H135637C1F01444DEB65C1ED5256700F" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>In this subsection, the
				term <term>program or activity</term> has the meaning given that term in
				section 309 of the <act-name parsable-cite="ADA75">Age Discrimination Act of
				1975</act-name> (42 U.S.C.

								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="idD18870348DDC498798C58B230398A3F2"><enum>(b)</enum><header>Application</header><text>The
			 amendments made by subsection (a) shall apply to—</text>
					<paragraph id="id793FAD2741B641039F671DEEEA9505CD"><enum>(1)</enum><text>any failure to comply
			 with a provision of or any violation of chapter 43 of title 38, United States
			 Code, that occurs before, on, or after the date of the enactment of this Act;
			 and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAD4B58AA787543BB93870116AC512D1C"><enum>(2)</enum><text>all actions or complaints
			 filed under such chapter 43 that are commenced after the date of the enactment
			 of this Act.</text>
					</paragraph></subsection></section><section id="HB321A45F253449E589B46E49C29733D5"><enum>402.</enum><header>Clarifying the
			 definition of <quote>successor in interest</quote></header>
				<subsection id="id9A9C3155E5FB4336BF91E55AE996F522"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 4303(4) is
			 amended by adding at the end the following new subparagraph:</text>

				business operations.</text>
								</subclause><subclause changed="added" id="H94B51821BDC74681B288C7C9124736AD" indent="up1" reported-display-style="italic"><enum>(II)</enum><text>Use of the same or
				similar facilities.</text>
								</subclause><subclause changed="added" id="H73A79E6307354B558482F417F24E887B" indent="up1" reported-display-style="italic"><enum>(III)</enum><text>Continuity of work
				force.</text>
								</subclause><subclause changed="added" id="H18A5458D9CF5425A9F48D88B8F30FD4B" indent="up1" reported-display-style="italic"><enum>(IV)</enum><text>Similarity of jobs and
				working conditions.</text>
								</subclause><subclause changed="added" id="HE5AAFE83068642EDA4443ED7FF001C7E" indent="up1" reported-display-style="italic"><enum>(V)</enum><text>Similarity of supervisory
				personnel.</text>
								</subclause><subclause changed="added" id="H0A8A2F6BB80041B8007529BC386BE65D" indent="up1" reported-display-style="italic"><enum>(VI)</enum><text>Similarity of machinery,
				equipment, and production methods.</text>
								</subclause><subclause changed="added" id="H5273B3BA003F4F9798FFD8BD53D74CB0" indent="up1" reported-display-style="italic"><enum>(VII)</enum><text>Similarity of products
				or services.</text>
								</subclause></clause><clause changed="added" id="HE0877AEA56E6402786CC1234E375954" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>The
				entity's lack of notice or awareness of a potential or pending claim under this
				chapter at the time of a merger, acquisition, or other form of succession shall
				not be considered when applying the multi-factor test under clause
				(i).</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="idC351CFC392E440FCBD563692FF2F530F"><enum>(b)</enum><header>Application</header><text>The
			 amendment made by subsection (a) shall apply to—</text>
					<paragraph id="id82E17F007F1F48768C03219F15DE5A26"><enum>(1)</enum><text>any failure to comply
			 with a provision of or any violation of chapter 43 of title 38, United States
			 Code, that occurs before, on, or after the date of the enactment of this Act;

			 required</header><text>The Comptroller General of the United States shall
			 conduct a study on the effectiveness of Federal programs of education and
			 outreach on employer obligations under chapter 43 of title 38, United States
			 Code.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idDAE1457007304DFD8C99EF41B7ABB651"><enum>(b)</enum><header>Contents of
			 study</header><text>In carrying out the study required by subsection (a), the
			 Comptroller General shall—</text>
					<paragraph id="idD57E19B322264EDA8F5D482FD7E75A0D"><enum>(1)</enum><text>assess current practices
			 and procedures of Federal agencies for educating employers about their
			 obligations under chapter 43 of title 38, United States Code;</text>
					</paragraph><paragraph id="idCF3A8256FDAC4AE8BBC863C84C321522"><enum>(2)</enum><text>identify best practices
			 for bringing the employment practices of small businesses into compliance with
			 such chapter;</text>
					</paragraph><paragraph id="id6D2AEB3E44324762B9CA90107B2F2279"><enum>(3)</enum><text>determine whether the
			 Employer Support for the Guard and Reserve, the Small Business Administration,
			 or other agencies could collaborate to develop a program to educate employers
			 regarding their obligations under such chapter; and</text>
					</paragraph><paragraph id="id042215DB98AF4DCABA3899EBB4B9AFFE"><enum>(4)</enum><text>determine the effect on
			 recruitment and retention in the National Guard and Reserves of the failure of
			 employers to meet their reemployment obligations under such chapter.</text>
					</paragraph></subsection><subsection id="idA6F5B2EE55FA46469CD6453EF1537B88"><enum>(c)</enum><header>Report to
			 Congress</header><text>Not later than June 30, 2010, the Comptroller General
			 shall submit to Congress a report on the study conducted under subsection (a),
			 including the following:</text>
					<paragraph id="idDB714EEA2D2A4CCBA832D534A4A70FEC"><enum>(1)</enum><text>The findings of the
			 Comptroller General with respect to such study.</text>

			 the Comptroller General for the improvement of education and outreach for
			 employers with respect to their obligations under chapter 43 of title 38,

			 amendments</header>
				<subsection id="id96A8A87DE6644A62AE3A7040EABFE628"><enum>(a)</enum><header>Amendment to

				authorized and directed to pay the recipient of such payment a supplemental
				payment under this section for the cost of such burial and funeral.</text>

				this subsection if the Secretary has expended all funds that were specifically
				provided for purposes of this subsection in an appropriations Act.</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ide0c881d7-f00d-4d9d-8e80-5f954a227865"><enum>(b)</enum><header display-inline="yes-display-inline">Amount</header><text display-inline="yes-display-inline">The amount of the supplemental payment
				required by subsection (a) for any death is $900 (as adjusted from time to time
				under subsection (c)).</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="idf1c4b059-1def-4c3b-a666-d8020735fcbb"><enum>(c)</enum><header display-inline="yes-display-inline">Adjustment</header><text display-inline="yes-display-inline">With respect to deaths that occur in any
				fiscal year after fiscal year 2010, the supplemental payment described in
				subsection (b) shall be equal to the sum of—</text>

				States city average) for the 12-month period ending on the June 30 preceding
				the beginning of the fiscal year for which the increase is made, exceeds</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7d270aec-f9ac-442d-8c00-65869006a63f"><enum>(B)</enum><text display-inline="yes-display-inline">such Consumer Price Index for the 12-month
				period preceding the 12-month period described in subparagraph (A).</text>
										</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idf980721e-baac-4cc0-9e2d-ef5adedfdfa0"><enum>(d)</enum><header display-inline="yes-display-inline">Estimates</header><paragraph commented="no" display-inline="yes-display-inline" id="ide818e586-e4da-4adf-8427-42a396028d37"><enum>(1)</enum><text display-inline="yes-display-inline">From time to time, the Secretary shall make
				an estimate of—</text>
										<subparagraph changed="added" commented="no" display-inline="no-display-inline" id="idb4ca63c0-b4a9-4836-9a8a-4f24a9da29ce" indent="up1" reported-display-style="italic"><enum>(A)</enum><text display-inline="yes-display-inline">the amount of funding that would be
				necessary to provide supplemental payments under this section to all eligible
				recipients for the remainder of the fiscal year in which such an estimate is
				made; and</text>
										</subparagraph><subparagraph changed="added" commented="no" display-inline="no-display-inline" id="id7793c1f0-6f93-4c25-9414-b52e70bc9d3f" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">the amount that Congress would need to
				appropriate to provide all eligible recipients with supplemental payments under
				this section in the next fiscal year.</text>
										</subparagraph></paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="id57f71371-e296-4990-80e1-361d8ff777f6" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">On the dates described in paragraph (3),
				the Secretary shall submit to the appropriate committees of Congress the
				estimates described in paragraph (1).</text>

				specifically provided for purposes of this subsection in advance in an
				appropriations Act, whenever the Secretary makes a payment for the burial and
				funeral of a veteran under section 2307(1) of this title, the Secretary is also
				authorized and directed to pay the recipient of such payment a supplemental
				payment under this section for the cost of such burial and funeral.</text>
									</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="id8a5a9c3d-be28-4320-9110-72c3f299333f" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">No supplemental payment shall be made under
				this subsection if the Secretary has expended all funds that were specifically
				provided for purposes of this subsection in an appropriations Act.</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id90715e40-8771-4161-87e5-620e9976ce9e"><enum>(b)</enum><header display-inline="yes-display-inline">Amount</header><text display-inline="yes-display-inline">The amount of the supplemental payment
				required by subsection (a) for any death is $2,100 (as adjusted from time to
				time under subsection (c)).</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="id84c54552-aa62-4a61-a4d4-cca1dc49aadf"><enum>(c)</enum><header display-inline="yes-display-inline">Adjustment</header><text display-inline="yes-display-inline">With respect to deaths that occur in any
				fiscal year after fiscal year 2010, the supplemental payment described in
				subsection (b) shall be equal to the sum of—</text>
									<paragraph commented="no" display-inline="no-display-inline" id="id5ea29194-c0af-4a2a-9eca-9bf04623b49d"><enum>(1)</enum><text display-inline="yes-display-inline">the supplemental payment in effect under

				recipients for the remainder of the fiscal year in which such an estimate is

										</subparagraph><subparagraph changed="added" commented="no" display-inline="no-display-inline" id="id3718fa10-ab60-4330-b54d-83fbe0526c4d" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">the amount that Congress would need to
				appropriate to provide all eligible recipients with supplemental payments under
				this section in the next fiscal year.</text>
										</subparagraph></paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="id092205cc-9958-4d4d-869d-66af8b7e5bc1" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">On the dates described in paragraph (3),

			 section 2303 the following new section:</text>

				specifically provided for purposes of this subsection in advance in an
				appropriations Act, whenever the Secretary makes a payment for the burial and
				funeral of a veteran under section 2303(a)(1)(A) of this title, or for the
				burial of a veteran under paragraph (1) or (2) of section 2303(b) of this
				title, the Secretary is also authorized and directed to pay the recipient of
				such payment a supplemental payment under this section for the cost of such
				burial and funeral or burial, as applicable.</text>
								</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="idd567786e-85ec-4971-8a84-97e863b065aa" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">No supplemental plot allowance payment
				shall be made under this subsection if the Secretary has expended all funds
				that were specifically provided for purposes of this subsection in an
				appropriations Act.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id761b78b1-4654-4bf9-a9c5-4df1fa880d55"><enum>(b)</enum><header display-inline="yes-display-inline">Amount</header><text display-inline="yes-display-inline">The amount of the supplemental payment
				required by subsection (a) for any death is $445 (as adjusted from time to time
				under subsection (c)).</text>

			<section commented="no" display-inline="no-display-inline" id="idBD38FBC25BD64FF9852A904DDC723F2B" section-type="subsequent-section"><enum>601.</enum><header display-inline="yes-display-inline">National Academies review of best
			 treatments for Gulf War Illness</header>
				<subsection commented="no" display-inline="no-display-inline" id="id6FAA506AD692421AB6F919F177F596FD"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall
			 enter into a contract with the Institute of Medicine of the National Academies
			 to conduct a comprehensive review of the best treatments for Gulf War
			 Illness.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id36E3BFCEA2CC442BA793EAF6CA65FA60"><enum>(b)</enum><header display-inline="yes-display-inline">Group of medical
			 professionals</header><text display-inline="yes-display-inline">In conducting
			 the study required under subsection (a), the Institute of Medicine shall
			 convene a group of medical professionals who are experienced in treating
			 individuals diagnosed with Gulf War illness as follows:</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id63489D04107844DEB1FDBAD69E4E185F"><enum>(1)</enum><text display-inline="yes-display-inline">Members of the Armed Forces who served
			 during the Persian Gulf War in the Southwest Asia theater of operations.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id22CBCA001532452097B0553A36C11576"><enum>(2)</enum><text display-inline="yes-display-inline">Members of the Armed Forces who served in
			 the Post 9/11 Global Operations theaters.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA7E7046C703946DCA9F167D2F6460FFC"><enum>(c)</enum><header display-inline="yes-display-inline">Reports</header><text>The contract required
			 by subsection (a) shall require the Institute of Medicine to submit to the
			 Secretary and to the appropriate committees of Congress a report on the review
			 required under subsection (a) not later than December 31, 2011. The final
			 report shall include such recommendations for legislative or administrative
			 action as the Institute considers appropriate in light of the results of the
			 review.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id38EB1966EC954243AB16ABCFE476F9B8"><enum>(d)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">The Secretary shall provide the Institute
			 of Medicine with such funds as are necessary to ensure the timely completion of
			 the review required under subsection (a).</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id4726763E6AE24D65881BBC1D5713EC2A"><enum>(e)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id852259C81B284AA3849F5E7EA57D44B4"><enum>(1)</enum><header>Appropriate committees
			 of Congress</header><text display-inline="yes-display-inline">The term
			 <term>appropriate committees of Congress</term> means—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id9836FCC5A61D453C8CDC56700889CD03"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Veterans' Affairs of the
			 Senate; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1DC2132918ED4CED8C813CD4C408C9B0"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Veterans' Affairs of the
			 House of Representatives.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id528F75A5DBD14F0AA3A34AD7DFF25637"><enum>(2)</enum><header>Gulf War
			 Illness</header><text>The term <term>Gulf War Illness</term> means a medically
			 unexplained chronic multisymptom illness, such as chronic fatigue syndrome,
			 fibromyalgia, and irritable bowel syndrome, that is defined by a cluster of
			 signs or symptoms relating to service in the Persian Gulf War or Post 9/11
			 Global Operations theaters.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id137A9F116B22453097C75D43B0646070"><enum>(3)</enum><header>Persian Gulf
			 War</header><text display-inline="yes-display-inline">The term <term>Persian
			 Gulf War</term> has the meaning given that term in section 101(33) of title 38,
			 United States Code.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2ED2B58234DC4CFF8E6EE1412EE969E4"><enum>(4)</enum><header>Post 9/11 Global
			 Operations theaters</header><text display-inline="yes-display-inline">The term
			 <term>Post 9/11 Global Operations theaters</term> means Afghanistan, Iraq, or
			 any other theater in which the Global War on Terrorism Expeditionary Medal is
			 awarded for service.</text>
					</paragraph></subsection></section><section id="id9A577C98EF2E40EEA7203E393B2F59A3" section-type="subsequent-section"><enum>602.</enum><header>Extension of
			 National Academy of Sciences reviews and evaluations regarding illness and
			 service in Persian Gulf War</header>
				<subsection id="idA2E0CA072F26443A814F94DF3FDAC665"><enum>(a)</enum><header>Review and evaluation
			 of toxic drugs and illnesses associated with Persian Gulf War</header><text display-inline="yes-display-inline">Section 1603(j) of the Persian Gulf War
			 Veterans Act of 1998 (38 U.S.C. 1117 note) is amended by striking
			 <quote>October 1, 2010</quote> and inserting <quote>October 1,
			 2015</quote>.</text>
				</subsection><subsection id="id8BEC088146844512B54590B0D19D61C9"><enum>(b)</enum><header>Review and evaluation
			 of available evidence regarding illness and service in Persian Gulf
			 War</header>
					<paragraph id="id696B8CB7E64F4B89BF64F63FA6DBEEE8"><enum>(1)</enum><header>In
			 general</header><text>Section 101(j) of the Veterans Programs Enhancement Act
			 of 1998 (Public Law 105–368; 112 Stat. 3321) is amended by striking <quote>11
			 years after</quote> and all that follows through <quote>under subsection
			 (b)</quote> and inserting <quote>on October 1, 2018</quote>.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1EB71BC47E0B4CBB824084CF71D63C7E"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 1604 of the Persian Gulf War Veterans Act of
			 1998 (Public Law 105–277; 38 U.S.C. 1117 note) is repealed.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idE8C80ABF78B74982A392FA5C6421716F" section-type="subsequent-section"><enum>603.</enum><header>Extension of
			 authority for regional office in Republic of the Philippines</header><text display-inline="no-display-inline">Section 315(b) is amended by striking
			 <quote>December 31, 2009</quote> and inserting <quote>December 31,
			 2011</quote>.</text>
			</section><section id="id4856EA51619E458FA1322C940FF526A4"><enum>604.</enum><header>Aggregate amount of
			 educational assistance available to individuals who receive both survivors' and
			 dependents educational assistance and other veterans and related educational
			 assistance</header>
				<subsection id="idF7FA1983E9504AEDB738BFF37CE918CD"><enum>(a)</enum><header>Aggregate amount
			 available</header><text>Section 3695 is amended—</text>
					<paragraph id="id30F11373024646509CDF2964920FBF54"><enum>(1)</enum><text>in subsection (a)(4), by
			 striking <quote>35,</quote>; and</text>
					</paragraph><paragraph id="id1FCFE476772D4234A620A743FAE256EF"><enum>(2)</enum><text>by adding at the end the
			 following new subsection:</text>

				the other hand, may not exceed 81 months (or the part-time equivalent
				thereof).</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="id16BA3E4DE6DB41CD95C2B3148DB80241"><enum>(b)</enum><header>Applicability</header><text>The
			 amendment made by subsection (a) shall take effect on October 1, 2010, and
			 shall not operate to revive any entitlement to assistance under chapter 35 of
			 title 38, United States Code, or the provisions of law referred to in section
			 3695(a) of such title, as in effect on the day before such date, that was
			 terminated by reason of the operation of section 3695(a) of such title, as so
			 in effect, before such date.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idF68828F5F0044511A1D2CEC4EB30CD53"><enum>(c)</enum><header>Revival of entitlement
			 reduced by prior utilization of chapter 35 assistance</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idD6C8FD5E14FA44B18AC0097E727D0D04"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), in the case of an individual
			 whose period of entitlement to assistance under a provision of law referred to
			 in section 3695(a) of title 38, United States Code (other than chapter 35 of
			 such title), as in effect on September 30, 2010, was reduced under such section
			 3695(a), as so in effect, by reason of the utilization of entitlement to
			 assistance under chapter 35 of such title before October 1, 2010, the period of
			 entitlement to assistance of such individual under such provision shall be
			 determined without regard to any entitlement so utilized by the individual
			 under chapter 35 of such title.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDFF85BDE530B466FA178B19E5BF867D6"><enum>(2)</enum><header>Limitation</header><text>The
			 maximum period of entitlement to assistance of an individual under paragraph
			 (1) may not exceed 81 months.</text>
