		<section commented="no" display-inline="no-display-inline" id="id31A7C6BDC49F475383C9D9949778446C" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Telework Enhancement Act of
			 2010</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id400B528377D4467DA3B94DB9F6382936" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id5AF01725B1884FB9AC390350407B8CB3"><enum>(1)</enum><header display-inline="yes-display-inline">Employee</header><text display-inline="yes-display-inline">The term <term>employee</term> has the
			 meaning given that term under section 2105 of title 5, United States
			 Code.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA9D6A2236C0449A6B3E992C32FFF92A1"><enum>(2)</enum><header display-inline="yes-display-inline">Executive agency</header><text display-inline="yes-display-inline">Except as provided in section 7, the term
			 <term>executive agency</term> has the meaning given that term under section 105
			 of title 5, United States Code.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id11766EE9344F4CE3B06DD61D73856DF1"><enum>(3)</enum><header display-inline="yes-display-inline">Telework</header><text display-inline="yes-display-inline">The term <term>telework</term> means a work
			 arrangement in which an employee performs officially assigned duties at home or
			 other worksites geographically convenient to the residence of the
			 employee.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDe5a05e6effd0491bb2f97478cc8a9a9d" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Executive Agencies telework
			 requirement</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID754dedc91af44f9ca838a082ed52b24d"><enum>(a)</enum><header display-inline="yes-display-inline">Telework Eligibility</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the head of each executive agency shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id87BB239E398745DC8B780C2275463E16"><enum>(1)</enum><text display-inline="yes-display-inline">establish a policy under which eligible
			 employees of the agency may be authorized to telework;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3579E8B719B54D988AFAB87FDCE229CA"><enum>(2)</enum><text display-inline="yes-display-inline">determine the eligibility for all employees
			 of the agency to participate in telework; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA702FEBF807042349A47D9E56E3E88F0"><enum>(3)</enum><text display-inline="yes-display-inline">notify all employees of the agency of their
			 eligibility to telework.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDd5ba7b796edd4b2b8fffe43dfefb9a09"><enum>(b)</enum><header display-inline="yes-display-inline">Participation</header><text display-inline="yes-display-inline">The policy described under subsection (a)
			 shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id9D4B9A65F37D4FAEAB5BF0CA0F0728C3"><enum>(1)</enum><text display-inline="yes-display-inline">ensure that telework does not diminish
			 employee performance or agency operations;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf905c7bf312d4d4692178b9550137a3b"><enum>(2)</enum><text display-inline="yes-display-inline">require a written agreement that—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id7AB3F5B380084D83965FC365095BB122"><enum>(A)</enum><text display-inline="yes-display-inline">is entered into between an agency manager
			 and an employee authorized to telework, that outlines the specific work
			 arrangement that is agreed to; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id95FA6C288CEE41FF95F8F0A6607C4550"><enum>(B)</enum><text display-inline="yes-display-inline">is mandatory in order for any employee to
			 participate in telework;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID992e6139513b4b33bb021beb76e404cf"><enum>(3)</enum><text display-inline="yes-display-inline">provide that an employee may not be
			 authorized to telework if the performance of that employee does not comply with
			 the terms of the written agreement between the agency manager and that
			 employee;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5a9c6179a87344d99db0e6f9aefc4aeb"><enum>(4)</enum><text display-inline="yes-display-inline">except in emergency situations as
			 determined by the head of an agency, not apply to any employee of the agency
			 whose official duties require on a daily basis (every work day)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id7355622303B24DC09B41670741832801"><enum>(A)</enum><text display-inline="yes-display-inline">direct handling of secure materials;
			 or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB741536612A3496FAFF5C005B6E923FC"><enum>(B)</enum><text display-inline="yes-display-inline">on-site activity that cannot be handled
			 remotely or at an alternate worksite; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8fd860ded9254169bb27baea77f52537"><enum>(5)</enum><text display-inline="yes-display-inline">be incorporated as part of the continuity
			 of operations plans of the agency in the event of an emergency.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID750c43c7f46a4850a3b12c6ac9af8bdc" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Training and monitoring</header>
			<subsection commented="no" display-inline="no-display-inline" id="id1204438232EE46A4B30807D9398D108E"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The head of each executive agency shall
			 ensure that—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDcc72d56e1c4a4fc18c9fc432ea335def"><enum>(1)</enum><text display-inline="yes-display-inline">an interactive telework training program is
			 provided to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idFB4055ADABCC48518962041E5CF957DE"><enum>(A)</enum><text display-inline="yes-display-inline">employees eligible to participate in the
			 telework program of the agency; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id361E5FB06B5E46B4A8F10C69ECCFD632"><enum>(B)</enum><text display-inline="yes-display-inline">all managers of teleworkers;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7D6F835199904416A16C492EA78D2ED0"><enum>(2)</enum><text display-inline="yes-display-inline">except as provided under subsection (b), an
			 employee has successfully completed the interactive telework training program
			 before that employee enters into a written agreement to telework described
			 under section 3(b)(2);</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID25c926ffb84840be9c11a696d55d3343"><enum>(3)</enum><text display-inline="yes-display-inline">teleworkers and nonteleworkers are treated
			 the same for purposes of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idE8C207AA71C049BBA444CE6AF397B93C"><enum>(A)</enum><text display-inline="yes-display-inline">periodic appraisals of job performance of
			 employees;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDcb467c56d1ac4972a886c07679a86890"><enum>(B)</enum><text display-inline="yes-display-inline">training, rewarding, reassigning,
			 promoting, reducing in grade, retaining, and removing employees;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6bf9e55e0fe14c7697b260eefe7f498a"><enum>(C)</enum><text display-inline="yes-display-inline">work requirements; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2cc5935f0a964017bcd83dd34ac18fdc"><enum>(D)</enum><text display-inline="yes-display-inline">other acts involving managerial discretion;
			 and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID43c8703e81cc4549a3647ced7c2a6f0c"><enum>(4)</enum><text display-inline="yes-display-inline">when determining what constitutes
			 diminished employee performance, the agency shall consult the performance
			 management guidelines of the Office of Personnel Management.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id2074E65F5F6C4F2BB3074CAE6C5CADC4"><enum>(b)</enum><header display-inline="yes-display-inline">Training requirement
			 exemptions</header><text display-inline="yes-display-inline">The head of an
			 executive agency may provide for an exemption from the training requirements
			 under subsection (a), if the head of that agency determines that the training
			 would be unnecessary because the employee is already teleworking under a work
			 arrangement in effect before the date of enactment of this Act.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDe2e5564279734200b2f54ea8cb2f94ec" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Policy and support</header>
			<subsection commented="no" display-inline="no-display-inline" id="id755C213D81BC45EEB50ACE8194369498"><enum>(a)</enum><header display-inline="yes-display-inline">Agency consultation with the Office of
			 Personnel Management</header><text display-inline="yes-display-inline">Each
			 executive agency shall consult with the Office of Personnel Management in
			 developing telework policies.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID58eec9dc870d4a38ac53e2811f510164"><enum>(b)</enum><header display-inline="yes-display-inline">Guidance and consultation</header><text display-inline="yes-display-inline">The Office of Personnel Management
			 shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idCE5AE33AD438462084789229ECC2F560"><enum>(1)</enum><text display-inline="yes-display-inline">provide policy and policy guidance for
			 telework in the areas of pay and leave, agency closure, performance management,
			 official worksite, recruitment and retention, and accommodations for employees
			 with disabilities;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB980E53B6F9540C8B99F7156E5F1F73B"><enum>(2)</enum><text display-inline="yes-display-inline">assist each agency in establishing
			 appropriate qualitative and quantitative measures and teleworking goals;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE395E9C129BA409E93083C54A5B78918"><enum>(3)</enum><text display-inline="yes-display-inline">consult with—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID61cf216622cb45fab52d0d60112c5181"><enum>(A)</enum><text display-inline="yes-display-inline">the Federal Emergency Management Agency on
			 policy and policy guidance for telework in the areas of continuation of
			 operations and long-term emergencies; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDdece4936aa1a49fdb31df3443553df02"><enum>(B)</enum><text display-inline="yes-display-inline">the General Services Administration on
			 policy and policy guidance for telework in the areas of telework centers,
			 travel, technology, equipment, and dependent care.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE915E65996374B148D6D2E435F4AB3B2"><enum>(c)</enum><header display-inline="yes-display-inline">Continuity of operations plans</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id7F6CD79835334938B5B21C88019ACF51"><enum>(1)</enum><header display-inline="yes-display-inline">Incorporation into continuity of operations
			 plans</header><text display-inline="yes-display-inline">Each executive agency
			 shall incorporate telework into the continuity of operations plan of that
			 agency.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id341BD3F04D78465296A6B0D5136CF512"><enum>(2)</enum><header display-inline="yes-display-inline">Continuity of operations plans supersede
			 telework policy</header><text display-inline="yes-display-inline">During any
			 period that an executive agency is operating under a continuity of operations
			 plan, that plan shall supersede any telework policy.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5CAF71D450404862A31A6D44BB5D4BC2"><enum>(d)</enum><header display-inline="yes-display-inline">Telework website</header><text display-inline="yes-display-inline">The Office of Personnel Management
			 shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDa78863ca7cf6472581eff7a799377321"><enum>(1)</enum><text display-inline="yes-display-inline">maintain a central telework website;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4ABEE5BBBD964AA9BFD97B27F5B37EC2"><enum>(2)</enum><text display-inline="yes-display-inline">include on that website related—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id4A7EFD7B0C6A49998BB4878537518F38"><enum>(A)</enum><text display-inline="yes-display-inline">telework links;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id21BB50475E4A43659AF4A019C696EC6F"><enum>(B)</enum><text display-inline="yes-display-inline">announcements;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6AF299B53A9142B09363953A25B4522B"><enum>(C)</enum><text display-inline="yes-display-inline">guidance developed by the Office of
			 Personnel Management; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE93AE754561A47089000E7366DAEC305"><enum>(D)</enum><text display-inline="yes-display-inline">guidance submitted by the Federal Emergency
			 Management Agency, and the General Services Administration to the Office of
			 Personnel Management not later than 10 business days after the date of
			 submission.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID0edef82a621c4467a8519729f844e09c" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Telework Managing Officer</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID11152c379c77401a81c681f8e7129e22"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id601AC9ACBAC74966A57427173946414C"><enum>(1)</enum><header display-inline="yes-display-inline">Designation</header><text display-inline="yes-display-inline">The head of each executive agency shall
			 designate an employee of the agency as the Telework Managing Officer. The
			 Telework Managing Officer shall be established within the Office of the Chief
			 Human Capital Officer or a comparable office with similar functions.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4B91FD3C46B145D7A2F8FF5D45D3DEA9"><enum>(2)</enum><header display-inline="yes-display-inline">Telework Coordinators</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id54475624732848D5A325035AC4359E95"><enum>(A)</enum><header display-inline="yes-display-inline">Appropriations Act, 2003</header><text display-inline="yes-display-inline">Section 623 of the Departments of Commerce,
			 Justice, and State, the Judiciary, and Related Agencies Appropriations Act,
			 2003 (Public Law 108–7; 117 Stat. 103) is amended by striking <quote>designate
			 a <quote>Telework Coordinator</quote> to be</quote> and inserting
			 <quote>designate a Telework Managing Officer to be</quote>.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id82BDF9443C924C948DD6AE5AB1E5D1F6"><enum>(B)</enum><header display-inline="yes-display-inline">Appropriations Act, 2004</header><text display-inline="yes-display-inline">Section 627 of the Departments of Commerce,
			 Justice, and State, the Judiciary, and Related Agencies Appropriations Act,
			 2004 (Public Law 108–199; 118 Stat. 99) is amended by striking <quote>designate
			 a <quote>Telework Coordinator</quote> to be</quote> and inserting
			 <quote>designate a Telework Managing Officer to be</quote>.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id90E9E5AC9FD9469690F3C340B6B68C86"><enum>(C)</enum><header display-inline="yes-display-inline">Appropriations Act, 2005</header><text display-inline="yes-display-inline">Section 622 of the Departments of Commerce,
			 Justice, and State, the Judiciary, and Related Agencies Appropriations Act,
			 2005 (Public Law 108–447; 118 Stat. 2919) is amended by striking
			 <quote>designate a <quote>Telework Coordinator</quote> to be</quote> and
			 inserting <quote>designate a Telework Managing Officer to be</quote>.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id31F6271F080D4B63892E372ADD173D11"><enum>(D)</enum><header display-inline="yes-display-inline">Appropriations Act, 2006</header><text display-inline="yes-display-inline">Section 617 of the Science, State, Justice,
			 Commerce, and Related Agencies Appropriations Act, 2006 (Public Law 109–108;
			 119 Stat. 2340) is amended by striking <quote>maintain a <quote>Telework
			 Coordinator</quote> to be</quote> and inserting <quote>maintain a Telework
			 Managing Officer to be</quote>.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID669739b5439b41d280374d722dc26db1"><enum>(b)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The Telework Managing Officer shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDd8fa100b2cf44c36b63d968ebc424e2c"><enum>(1)</enum><text display-inline="yes-display-inline">be devoted to policy development and
			 implementation related to agency telework programs;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id823FB4A494304A74B06A1DFB40431ECC"><enum>(2)</enum><text display-inline="yes-display-inline">serve as—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id247CE4A672D94A33A84D2E1665A4F222"><enum>(A)</enum><text display-inline="yes-display-inline">an advisor for agency leadership, including
			 the Chief Human Capital Officer;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id193BFBB5744E40CA8DE08A34102389C0"><enum>(B)</enum><text display-inline="yes-display-inline">a resource for managers and employees;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD578DBD927F8495B95C5F7BA70552EC6"><enum>(C)</enum><text display-inline="yes-display-inline">a primary agency point of contact for the
			 Office of Personnel Management on telework matters; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2b9b251e2c5a4777850dbe596710a129"><enum>(3)</enum><text display-inline="yes-display-inline">perform other duties as the applicable
			 delegating authority may assign.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDa5220ee859cd42eea81259e67297fe43" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Reports</header>
			<subsection commented="no" display-inline="no-display-inline" id="idBDBFE50041434256A845744CCBE8DD78"><enum>(a)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">In this section, the term <term>executive
			 agency</term> shall not include the Government Accountability Office.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id55E90E4C6E1E416C84E44FF3B1ACA774"><enum>(b)</enum><header display-inline="yes-display-inline">Reports by the Office of Personnel
			 Management</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID9ee722428fe84cf6af9b50a62c4f2a03"><enum>(1)</enum><header display-inline="yes-display-inline">Submission of reports</header><text display-inline="yes-display-inline">Not later than 18 months after the date of
			 enactment of this Act and on an annual basis thereafter, the Director of the
			 Office of Personnel Management, in consultation with Chief Human Capital
			 Officers Council, shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id38EF3BD0430A42C1836D5C8912063AAA"><enum>(A)</enum><text display-inline="yes-display-inline">submit a report addressing the telework
			 programs of each executive agency to—</text>
						<clause commented="no" display-inline="no-display-inline" id="idD459076822264EB2B5C8322268AC6E48"><enum>(i)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and
			 Governmental Affairs of the Senate; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idECCC28D2261E46A08675309C91327724"><enum>(ii)</enum><text display-inline="yes-display-inline">the Committee on Oversight and Government
			 Reform of the House of Representatives; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1DA0A6C0386145379BB54DFC6EB9D121"><enum>(B)</enum><text display-inline="yes-display-inline">transmit a copy of the report to the
			 Comptroller General and the Office of Management and Budget.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6068b81962114e718d02deb31b2fb985"><enum>(2)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Each report submitted under this subsection
			 shall include—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDc1c854ba084f49e892e83224e0f0155c"><enum>(A)</enum><text display-inline="yes-display-inline">the degree of participation by employees of
			 each executive agency in teleworking during the period covered by the report
			 (and for each executive agency whose head is referred to under section 5312 of
			 title 5, United States Code, the degree of participation in each bureau,
			 division, or other major administrative unit of that agency), including—</text>
						<clause commented="no" display-inline="no-display-inline" id="IDc60e77033ef14cab96ea604bafc0e198"><enum>(i)</enum><text display-inline="yes-display-inline">the total number of employees in the
			 agency;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID873e2a73126a4da288bf8c5dd80c0803"><enum>(ii)</enum><text display-inline="yes-display-inline">the number and percent of employees in the
			 agency who are eligible to telework; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDfd192eb777bd4515917620d70a1acf84"><enum>(iii)</enum><text display-inline="yes-display-inline">the number and percent of eligible
			 employees in the agency who are teleworking—</text>
							<subclause commented="no" display-inline="no-display-inline" id="ID156a6a41c04c43108a0ddc829bd5b7a9"><enum>(I)</enum><text display-inline="yes-display-inline">3 or more days per pay period;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="ID396e2926cb064ed9bac8be9bf1cd16da"><enum>(II)</enum><text display-inline="yes-display-inline">1 or 2 days per pay period;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="IDbbc7b4adbbef46eebc6121aededac968"><enum>(III)</enum><text display-inline="yes-display-inline">once per month; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="idDE4787083AF042E9969FDB60A995863B"><enum>(IV)</enum><text display-inline="yes-display-inline">on an occasional, episodic, or short-term
			 basis;</text>
							</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID69ecc6fdc6d04eaca01ccda0be173505"><enum>(B)</enum><text display-inline="yes-display-inline">the method for gathering telework data in
			 each agency;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa5bac13cb8b04e4ca91cd307a8ac93ed"><enum>(C)</enum><text display-inline="yes-display-inline">if the total number of employees
			 teleworking is 10 percent higher or lower than the previous year in any agency,
			 the reasons for the positive or negative variation;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5c734a5b328b4ef9887d219dae2a6223"><enum>(D)</enum><text display-inline="yes-display-inline">the agency goal for increasing
			 participation to the extent practicable or necessary for the next reporting
			 period, as indicated by the percent of eligible employees teleworking in each
			 frequency category described under subparagraph (A)(iii);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe805c86fdf75432385b84d6cb73a3561"><enum>(E)</enum><text display-inline="yes-display-inline">an explanation of whether or not the agency
			 met the goals for the last reporting period and, if not, what actions are being
			 taken to identify and eliminate barriers to maximizing telework opportunities
			 for the next reporting period;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5FDFC54CE35744A8938FB4B952131082"><enum>(F)</enum><text display-inline="yes-display-inline">an assessment of the progress each agency
			 has made in meeting agency participation rate goals during the reporting
			 period, and other agency goals relating to telework, such as the impact of
			 telework on—</text>
						<clause commented="no" display-inline="no-display-inline" id="id7162181F7EC44575B194F1C9CE356B83"><enum>(i)</enum><text display-inline="yes-display-inline">emergency readiness;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id94897793566F49029F8195FB54533299"><enum>(ii)</enum><text display-inline="yes-display-inline">energy use;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id12A5A41321F24F1CBA2C38C26E05A41E"><enum>(iii)</enum><text display-inline="yes-display-inline">recruitment and retention;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id9AC23E059DE7492BA2C462CB997F873B"><enum>(iv)</enum><text display-inline="yes-display-inline">performance;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idF5763E8893584CF3B7EFEB0B441B13D5"><enum>(v)</enum><text display-inline="yes-display-inline">productivity; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id9089EF7F0EDF40B398AA4A5B10E82F5E"><enum>(vi)</enum><text display-inline="yes-display-inline">employee attitudes and opinions regarding
			 telework; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDdf381be94f6c4cc4bdcce55182f51ad5"><enum>(G)</enum><text display-inline="yes-display-inline">the best practices in agency telework
			 programs.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9c2655402818461e9b7b749912ede41c"><enum>(c)</enum><header display-inline="yes-display-inline">Comptroller General reports</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id9E396D9F76734FD6B57B9BE60579448B"><enum>(1)</enum><header display-inline="yes-display-inline">Report on Government Accountability Office
			 telework program</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID8ca3e639ced242b09187c2d96ff655e5"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of
			 enactment of this Act and on an annual basis thereafter, the Comptroller
			 General shall submit a report addressing the telework program of the Government
			 Accountability Office to—</text>
						<clause commented="no" display-inline="no-display-inline" id="idAD07690CFB254091AF00236D4DA689C8"><enum>(i)</enum><text display-inline="yes-display-inline">the Committee on Homeland Security and
			 Governmental Affairs of the Senate; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idDEE028E968B143BB812ADCAA36A3A446"><enum>(ii)</enum><text display-inline="yes-display-inline">the Committee on Oversight and Government
			 Reform of the House of Representatives.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9f57c08f34f04183b2748c6dcfcc1439"><enum>(B)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">Each report submitted by the Comptroller
			 General shall include the same information as required under subsection (b)
			 applicable to the Government Accountability Office.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0d2785705a5d4d78a3bf2842f934bd68"><enum>(2)</enum><header display-inline="yes-display-inline">Report to congress on office of personnel
			 management report</header><text display-inline="yes-display-inline">Not later
			 than 6 months after the submission of the first report to Congress required
			 under subsection (b), the Comptroller General shall review that report required
			 under subsection (b) and submit a report to Congress on the progress each
			 executive agency has made towards the goals established under section
			 5(b)(2).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID4e459f07f4134c6296b7a5fc0ac488eb"><enum>(d)</enum><header display-inline="yes-display-inline">Chief Human Capital Officer
			 Reports</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id175068938DA84346B529BD01CBE6E520"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each year the Chief Human Capital Officer
			 of each executive agency, in consultation with the Telework Managing Officer of
			 that agency, shall submit a report to the Chair and Vice Chair of the Chief
			 Human Capital Officers Council on agency management efforts to promote
			 telework.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4DCA077D9C7F4F6CA2F4C43EAB67C619"><enum>(2)</enum><header display-inline="yes-display-inline">Review and inclusion of relevant
			 information</header><text display-inline="yes-display-inline">The Chair and
			 Vice Chair of the Chief Human Capital Officers Council shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idCBFA73122A78489AAAE6E2D637917F82"><enum>(A)</enum><text display-inline="yes-display-inline">review the reports submitted under
			 paragraph (1);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCD087D7541A04901A69A221B1AF86C77"><enum>(B)</enum><text display-inline="yes-display-inline">include relevant information from the
			 submitted reports in the annual report to Congress required under subsection
			 (b); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id99AD32279FF64056AAC0C6340CF20FFB"><enum>(C)</enum><text display-inline="yes-display-inline">use that relevant information for other
			 purposes related to the strategic management of human capital.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idCE5786BA2C3745FCBC5FCAFF3A41D8DC" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Authority for telework travel expenses test
			 programs</header>
			<subsection commented="no" display-inline="no-display-inline" id="HDA3AADD52F524EE1A3FEF1A0C54FCBC5"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Chapter 57 of title 5, United States Code,
			 is amended by inserting after section 5710 the following:</text>
				<quoted-block act-name="" display-inline="no-display-inline" id="HAB6B7BB6FDC74A0CAE9C7CA393776A" style="USC">
					<section commented="no" display-inline="no-display-inline" id="H2788C43F52A6440000323B80B481E000" section-type="subsequent-section"><enum>5711.</enum><header display-inline="yes-display-inline">Authority for telework travel expenses test
				programs</header>
						<subsection commented="no" display-inline="no-display-inline" id="id6D34B8F1E5DC4AB1B1FEFFFE877C9404"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id09954E1E110E4E149BA15031A690CF2E"><enum>(1)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				subchapter, under a test program which the Administrator of General Services
				determines to be in the interest of the Government and approves, an employing
				agency may pay through the proper disbursing official any necessary travel
				expenses in lieu of any payment otherwise authorized or required under this
				subchapter for employees participating in a telework program. An agency shall
				include in any request to the Administrator for approval of such a test program
				an analysis of the expected costs and benefits and a set of criteria for
				evaluating the effectiveness of the program.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5B5C360D58AE465E85EC5F096A342319" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Any test program conducted under this
				section shall be designed to enhance cost savings or other efficiencies that
				accrue to the Government.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1A5CFDEBA046464592BB96132F9F5168" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Under any test program, if an agency
				employee voluntarily relocates from the pre-existing duty station of that
				employee, the Administrator may authorize the employing agency to establish a
				reasonable maximum number of occasional visits to the pre-existing duty station
				before that employee is eligible for payment of any accrued travel expenses by
				that agency.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF56342E0E1EB4E60A123EB3D2677C765" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Nothing in this section is intended to
				limit the authority of any agency to conduct test programs.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idBB2099AF4EF746BAB0F15A8348CF4EA1"><enum>(b)</enum><text display-inline="yes-display-inline">The Administrator shall transmit a copy of
				any test program approved by the Administrator under this section, and the
				rationale for approval, to the appropriate committees of Congress at least 30
				days before the effective date of the program.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id714C4D0AEA3843C7A17BE39E596077EC"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id1E4E08BC88AB488A8C6A7034F80D52F9"><enum>(1)</enum><text display-inline="yes-display-inline">An agency authorized to conduct a test
				program under subsection (a) shall provide to the Administrator, the Telework
				Managing Officer of that agency, and the appropriate committees of Congress a
				report on the results of the program not later than 3 months after completion
				of the program.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF44F10E9C5C5446D9526A5CCF5D1A140" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The results in a report described under
				paragraph (1) may include—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id08B7EC20A0D64CFEA842255733C5501F"><enum>(A)</enum><text display-inline="yes-display-inline">the number of visits an employee makes to
				the pre-existing duty station of that employee;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7C82D4181871430EADEA14D0AA9D42AC"><enum>(B)</enum><text display-inline="yes-display-inline">the travel expenses paid by the
				agency;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id967B0B4903A142B9BBE55A65E75BC866"><enum>(C)</enum><text display-inline="yes-display-inline">the travel expenses paid by the employee;
				or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB5ECE3E99FF44345992B1EE22238F4BC"><enum>(D)</enum><text display-inline="yes-display-inline">any other information the agency determines
				useful to aid the Administrator, Telework Managing Officer, and Congress in
				understanding the test program and the impact of the program.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5F9995AB55444C6CA22C3D5B6D3F29CE"><enum>(d)</enum><text display-inline="yes-display-inline">No more than 10 test programs under this
				section may be conducted simultaneously.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id5AE1E4902BA84A909CC339F369A2574D"><enum>(e)</enum><text display-inline="yes-display-inline">The authority to conduct test programs
				under this section shall expire 7 years after the date of the enactment of the
				Telework Enhancement Act of
				2010.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			 test program</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID4bdafc0fa6f64623b48ca40c262b9ab2"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 5710 of title 5, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID965502edd4fc40f9b0659dcd90ea4efe"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(1), by striking “for a
			 period not to exceed 24 months”; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1ac2849b488d4466be02280ee51c6e34"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (e) and inserting
			 the following:</text>
					<quoted-block display-inline="no-display-inline" id="id9F74D65677C44078BB5733D7DFD4BBCF" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="idE5C56B4D77204014A34FEB39A70BF790"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idC8AEBCD8AEFE495FA5F2C5670DDE2DA8"><enum>(1)</enum><text display-inline="yes-display-inline">The Patent and Trademark Office shall
				conduct a test program under this section.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD00FECC3143D4AD8B6C6D0D4190DA409" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In conducting the program under this
				subsection, the Patent and Trademark Office may pay any travel expenses of an
				employee for travel to and from a Patent and Trademark Office worksite,
				if—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="id0519B11511B14971AC4B9B009EF90FB9"><enum>(A)</enum><text display-inline="yes-display-inline">the employee is employed at a Patent and
				Trademark Office worksite and enters into an approved telework
				arrangement;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF8287C58CD3A43718837590501B12658"><enum>(B)</enum><text display-inline="yes-display-inline">the employee requests to telework from a
				location beyond the local commuting area of the Patent and Trademark Office
				worksite; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5D315ED312384CAC86A79A8A9186A47F"><enum>(C)</enum><text display-inline="yes-display-inline">the Patent and Trademark Office approves
				the requested arrangement for reasons of employee convenience instead of an
				agency need for the employee to relocate in order to perform duties specific to
				the new location.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB8A34C99811440EF95AD64EEC8CEB252" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idCC86F6161BCE48CEBF650AECF79240D0"><enum>(A)</enum><text display-inline="yes-display-inline">The Patent and Trademark Office shall
				establish an oversight committee comprising an equal number of members
				representing management and labor, including representatives from each
				collective bargaining unit.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id021809C94C164D4CAA98DE918038A83A" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The oversight committee shall develop the
				operating procedures for the program under this subsection to—</text>
									<clause commented="no" display-inline="no-display-inline" id="idF3B7A023896C44DDA21D49170CFD6F25"><enum>(i)</enum><text display-inline="yes-display-inline">provide for the effective and appropriate
				functioning of the program; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id4D047F3650814D158DE32395DB0AE044"><enum>(ii)</enum><text display-inline="yes-display-inline">ensure that—</text>
										<subclause commented="no" display-inline="no-display-inline" id="id4037CE7F774B4BC7B780BEC657588161"><enum>(I)</enum><text display-inline="yes-display-inline">reasonable technological or other
				alternatives to employee travel are used before requiring employee travel,
				including teleconferencing, videoconferencing or internet-based
				technologies;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="idECEE2C6FDA3448DC9DD78208FE60B037"><enum>(II)</enum><text display-inline="yes-display-inline">the program is applied consistently and
				equitably throughout the Patent and Trademark Office; and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="id307C53CD633C417B89237DC1F1061A50"><enum>(III)</enum><text display-inline="yes-display-inline">an optimal operating standard is developed
				and implemented for maximizing the use of the telework arrangement described
				under paragraph (2) while minimizing agency travel expenses and employee travel
				requirements.</text>
										</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id258515A71933465CA36BE01F3A171828" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id369A9F40E3114B14B05A4FFE10B31868"><enum>(A)</enum><text display-inline="yes-display-inline">The test program under this subsection
				shall be designed to enhance cost savings or other efficiencies that accrue to
				the Government.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9DFABA98351846B4B3CF9EB13ABFDF7A" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The Director of the Patent and Trademark
				Office shall—</text>
									<clause commented="no" display-inline="no-display-inline" id="idE6B39FC122204B4CA7F019F93A598FA8" indent="down1"><enum>(i)</enum><text display-inline="yes-display-inline">prepare an analysis of the expected costs
				and benefits and a set of criteria for evaluating the effectiveness of the
				program; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id0E18C21943E343989EBA2B51DE3D8332" indent="down1"><enum>(ii)</enum><text display-inline="yes-display-inline">before the test program is implemented,
				submit the analysis and criteria to the Administrator of General Services and
				to the appropriate committees of Congress.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8C5EA7D169A3442EAC3CA1C4681290BD" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">With respect to an employee of the Patent
				and Trademark Office who voluntarily relocates from the pre-existing duty
				station of that employee, the operating procedures of the program may include a
				reasonable maximum number of occasional visits to the pre-existing duty station
				before that employee is eligible for payment of any accrued travel expenses by
				the Office.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3529782ADEA646F5BADDCE2F5682C173" indent="up1"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="idB9ACA17A9922419CA2F08BECD445E9ED"><enum>(i)</enum><text display-inline="yes-display-inline">Not later than 3 months after completion of
				the test program under this subsection, the Director of the Patent and
				Trademark Office shall provide a report on the results of the program to the
				Administrator of General Services and to the appropriate committees of
				Congress.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id47D7F038C81B4770B640C44DC2BF3377" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">The results in the report described under
				paragraph (1) may include—</text>
										<subclause commented="no" display-inline="no-display-inline" id="idAB68949D152C40E5B09D851BF073D3D0"><enum>(I)</enum><text display-inline="yes-display-inline">the number of visits an employee makes to
				the pre-existing duty station of that employee;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="id954218733CD54F09B52C8295FFA23A90"><enum>(II)</enum><text display-inline="yes-display-inline">the travel expenses paid by the
				Office;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="id58736C71FCAE4E97A1D7C4552986B564"><enum>(III)</enum><text display-inline="yes-display-inline">the travel expenses paid by the employee;
				or</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="id6577D60E072F422BBB505A9268E30C81"><enum>(IV)</enum><text display-inline="yes-display-inline">any other information that the Director
				determines may be useful to aid the Administrator and Congress in understanding
				the test program and the impact of the program.</text>
										</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDD77CF43AC2F4171B03844384C7BF1E8" indent="up1"><enum>(E)</enum><text display-inline="yes-display-inline">In this paragraph, the term
				<term>appropriate committees of Congress</term> means—</text>
									<clause commented="no" display-inline="no-display-inline" id="id1D813CF5721C4D26961D528D780918F2"><enum>(i)</enum><text display-inline="yes-display-inline">the Committees on Homeland Security and
				Governmental Affairs and on the Judiciary of the Senate; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id7F19EDB803D740A7908313578086E543"><enum>(ii)</enum><text display-inline="yes-display-inline">the Committees on Government Oversight and
				Reform and on the Judiciary of the House of Representatives.</text>
									</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1DC475F2530742C4A13F3BD81A703DB9"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id559050928D02428AB2E0601805F30AE9"><enum>(1)</enum><text display-inline="yes-display-inline">Except as provided under paragraph (2), the
				authority to conduct test programs under this section shall expire 7 years
				after the date of the enactment of the Travel and Transportation Reform Act of
				1998.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1FCE8AF04F054969BF8DAC0DA2C82DB5" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The authority to conduct a test program by
				the Patent and Trademark Office under this section shall expire 20 years after
				the date of the enactment of the Travel and Transportation Reform Act of
				1998.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID73fe2bbb77354117a47e12d3d5c28621"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall take effect as though enacted as part of the Travel and
			 Transportation Reform Act of 1998 (Public Law 105–264; 112 Stat. 2350).</text>
