		<official-title>To amend the Federal Water Pollution Control Act to
		  include a definition of fill material.</official-title>

		<section id="id3C74E5D5A7084A0A82751F053B08565A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Appalachia Restoration
			 Act</short-title></quote>.</text>
		</section><section id="id350C187F95664208834B6A63851493EC"><enum>2.</enum><header>Fill
			 material</header><text display-inline="no-display-inline">Section 502 of the
			 Federal Water Pollution Control Act (33 U.S.C. 1362) is amended by adding at
			 the end the following:</text>

				<paragraph id="ID4327e97f9bb4413fb16302ae64d188f2"><enum>(26)</enum><header>Fill
				material</header>
					<subparagraph id="id052DB81F99C64E1DAACA329D394CD5B7"><enum>(A)</enum><header>In
				general</header><text>The term <term>fill material</term> means any pollutant
				that—</text>
						<clause id="id1972B4E53B54480EA4E81CD158A4D55D"><enum>(i)</enum><text>replaces a
				portion of the waters of the United States with dry land; or</text>
						</clause><clause id="id2B9564DE372441C79CD0532B9A905BEE"><enum>(ii)</enum><text>modifies the
				bottom elevation of a body of water for any purpose.</text>
						</clause></subparagraph><subparagraph id="id03743B2F0A2D4AD992923FE339CAD6A5"><enum>(B)</enum><header>Exclusions</header><text>The
				term <term>fill material</term> does not include—</text>
						<clause id="idB908733F89ED464C9C6C7D2200D676FE"><enum>(i)</enum><text>the disposal of
				excess spoil material (as described in section 515(b)(22) of the Surface Mining
				Control and Reclamation Act (30 U.S.C. 1265(b)(22))) in waters of the United
				States; or</text>
						</clause><clause id="id01CAD4AE90D04CB3859123D08CDF806B"><enum>(ii)</enum><text>trash or
				garbage.</text>
