			 <quote><short-title>Federal Supervisor Training Act of
			 2009</short-title></quote>.</text>

			 programs for supervisors</header>
			<subsection id="id9A9A1016A1E24300B36F797C21E8D993"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/4121">Section 4121</external-xref> of title 5, United
			 States Code, is amended—</text>
				<paragraph id="idF6BFAE30D9A34FB4B0F59B37FC04FCC7"><enum>(1)</enum><text>by inserting
			 before <quote>In consultation with</quote> the following:</text>
					<quoted-block changed="deleted" committee-id="SSGA00" display-inline="no-display-inline" id="id57B5F3A734104B2F8355D272BE4E6614" reported-display-style="strikethrough" style="OLC">
						<subsection id="id2A25471DCB1E4DD9A6FB00F1BAB3EE1B"><enum>(a)</enum><text>In this section,
				the term <term>supervisor</term> means—</text>
							<paragraph id="id5CDB2388A70F4AA3BEFA79F9C1CF93CD"><enum>(1)</enum><text>a supervisor as
				defined under section 7103(a)(10);</text>
							</paragraph><paragraph id="idDB2685902796471F9EDA97E878C21ED1"><enum>(2)</enum><text>a management
				official as defined under section 7103(a)(11); and</text>
							</paragraph><paragraph id="id529CE29F7864444CBD9EC9AE110A8E1D"><enum>(3)</enum><text>any other employee
				as the Director of the Office of Personnel Management may by regulation
				prescribe.</text>
							</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDa2f88fc8ef744e5d920f9603c2ea5ec5"><enum>(2)</enum><text>by striking
			 <quote>In consultation with</quote> and inserting <quote>(b) Under operating
			 competencies promulgated by, and in consultation with,</quote>; and</text>
				</paragraph><paragraph id="ID375e6435d33942ee981e658c7e6cdefc"><enum>(3)</enum><text>by striking
			 paragraph (2) (of the matter redesignated as subsection (b) as a result of the
			 amendment under paragraph (2) of this subsection) and inserting the
			 following:</text>

						<paragraph id="ID02b5da16670642ebadef17b6ec8942c6"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id3FE2D832F7B1497FA06AFEB388D5824F"><enum>(A)</enum><text>a program to provide
				training to supervisors on actions, options, and strategies a supervisor may
				use in—</text>
								<clause changed="deleted" committee-id="SSGA00" id="ID3fe675e0e3224e37bb7e072da8074926" indent="up1" reported-display-style="strikethrough"><enum>(i)</enum><text>developing and
				discussing relevant goals and objectives together with the employee,
				communicating and discussing progress relative to performance goals and
				objectives and conducting performance appraisals;</text>
								</clause><clause changed="deleted" committee-id="SSGA00" id="ID4439a2409d88403187552eac356428af" indent="up1" reported-display-style="strikethrough"><enum>(ii)</enum><text>mentoring and
				motivating employees and improving employee performance and
				productivity;</text>
								</clause><clause changed="deleted" committee-id="SSGA00" id="id5F743D2076A04D64934AC43EBE3902B7" indent="up1" reported-display-style="strikethrough"><enum>(iii)</enum><text>fostering a work
				environment characterized by fairness, respect, equal opportunity, and
				attention paid to the merit of the work of employees;</text>
								</clause><clause changed="deleted" committee-id="SSGA00" id="IDcaebf5832d4f489a92f9f0552ca245ca" indent="up1" reported-display-style="strikethrough"><enum>(iv)</enum><text>effectively
				managing employees with unacceptable performance;</text>
								</clause><clause changed="deleted" committee-id="SSGA00" id="idFD0F2ECE88B64270807E251607F26261" indent="up1" reported-display-style="strikethrough"><enum>(v)</enum><text>addressing reports
				of a hostile work environment, reprisal, or harassment of, or by, another
				supervisor or employee; and</text>
								</clause><clause changed="deleted" committee-id="SSGA00" id="ID556f2ecce9264af7b7da7e6359572ff9" indent="up1" reported-display-style="strikethrough"><enum>(vi)</enum><text>otherwise
				carrying out the duties or responsibilities of a supervisor;</text>
								</clause></subparagraph><subparagraph changed="deleted" committee-id="SSGA00" id="IDf91d9ad0c1254cbfa2c9f7f56c0b917b" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text>a program to
				provide training to supervisors on the prohibited personnel practices under
				section 2302 (particularly with respect to such practices described under
				subsection (b) (1) and (8) of that section), employee collective bargaining and
				union participation rights, and the procedures and processes used to enforce
				employee rights; and</text>
							</subparagraph><subparagraph changed="deleted" committee-id="SSGA00" id="ID4098421104c64782879d36965a29896a" indent="up1" reported-display-style="strikethrough"><enum>(C)</enum><text>a program under
				which experienced supervisors mentor new supervisors by—</text>
								<clause id="id562631EB1C57457D837108E7AF888355"><enum>(i)</enum><text>transferring
				knowledge and advice in areas such as communication, critical thinking,
				responsibility, flexibility, motivating employees, teamwork, leadership, and
				professional development; and</text>
								</clause><clause id="idD4FF352D59494B518BD3851BA7D83BC2"><enum>(ii)</enum><text>pointing out
				strengths and areas for development.</text>
								</clause></subparagraph></paragraph><subsection id="idB2B6AC32A484423B8DB002E2743E06DB"><enum>(c)</enum><text>Training in
				programs established under subsection (b)(2) (A) and (B) shall be interactive
				instructor-based for managers in their first year as a supervisor.</text>
						</subsection><subsection id="ID018c34ba22a24d9d97f079352603b859"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id0B403BD33CBF4DE9BFF77B3FF17BA90F"><enum>(1)</enum><text>Not later than 1 year
				after the date on which an individual is appointed to the position of
				supervisor, that individual shall be required to have completed each program
				established under subsection (b)(2).</text>
							</paragraph><paragraph changed="deleted" committee-id="SSGA00" id="id7A1A7011FC8F4E749ED31E2AAE64833C" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><text>After completion
				of a program under subsection (b)(2) (A) and (B), each supervisor shall be
				required to complete a program under subsection (b)(2) (A) and (B) at least
				once every 3 years.</text>
							</paragraph><paragraph changed="deleted" committee-id="SSGA00" id="IDa1a9f38391af4248abad59da370dc9c5" indent="up1" reported-display-style="strikethrough"><enum>(3)</enum><text>Each program
				established under subsection (b)(2) shall include provisions under which credit
				shall be given for periods of similar training previously completed.</text>
							</paragraph></subsection><subsection id="IDadd7b48aef754913b89f7630e042d7b3"><enum>(e)</enum><text>Notwithstanding
				section 4118(c), the Director of the Office of Personnel Management shall
				prescribe regulations to carry out this section, including the monitoring of
				agency compliance with this section. Regulations prescribed under this
				subsection shall include measures by which to assess the effectiveness of
				agency supervisor training
				programs.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id5CE2AE522D85448D903AE921339410F0"><enum>(b)</enum><header>Regulations</header><text>Not
			 later than 180 days after the date of enactment of this Act, the Director of
			 the Office of Personnel Management shall prescribe regulations in accordance
			 with subsection (e) of
			 <external-xref legal-doc="usc" parsable-cite="usc/5/4121">section
			 4121</external-xref> of title 5, United States Code, as added by subsection (a)
			 of this section.</text>
			</subsection><subsection id="ID41e440ebaca3456aa106fbd7f4dc0309"><enum>(c)</enum><header>Effective date
			 and application</header>
				<paragraph id="idAFA69FE3F46E4DD3A25A61285AE549F5"><enum>(1)</enum><header>In
			 general</header><text>The amendments made by this section shall take effect 180
			 days after the date of enactment of this Act and apply to—</text>
					<subparagraph id="idFF3F7D6D26CD406DB2391A2AB37BB792"><enum>(A)</enum><text>each individual
			 appointed to the position of a supervisor, as defined under section 4121(a) of
			 title 5, United States Code (as added by subsection (a) of this section), on or
			 after that effective date; and</text>
					</subparagraph><subparagraph id="id67CC494A1D7A47F9AB5BD5CF85FE2799"><enum>(B)</enum><text>each individual
			 who is employed in the position of a supervisor on that effective date as
			 provided under paragraph (2).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id905C325BB3AD4F5F9EA620E67D7F8B95"><enum>(2)</enum><header>Supervisors on
			 effective date</header><text>Each individual who is employed in the position of
			 a supervisor on the effective date of this section shall be required to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idDDBD81C4E47049728FDD54B9DC22E42F"><enum>(A)</enum><text>complete each
			 program established under
			 <external-xref legal-doc="usc" parsable-cite="usc/5/4121">section
			 4121(b)(2)</external-xref> of title 5, United States Code (as added by
			 subsection (a) of this section), not later than 3 years after the effective
			 date of this section; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA6E51FC5196047829C62456DF233BD31"><enum>(B)</enum><text>complete programs
			 every 3 years thereafter in accordance with section 4121(d) (2) and (3) of such
			 title.</text>
					</subparagraph></paragraph></subsection></section><section changed="deleted" commented="no" committee-id="SSGA00" display-inline="no-display-inline" id="idA150717D67A54B669C9A8F14786CB156" reported-display-style="strikethrough"><enum>3.</enum><header>Management
			 <added-phrase reported-display-style="italic"></added-phrase>competencies<added-phrase reported-display-style="italic"></added-phrase></header>
			<subsection id="id2214AA18510243D29C52E9136805F61C"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/43">Chapter 43</external-xref> of title 5, United
			 States Code, is amended—</text>
				<paragraph id="id07700F79C6ED46838B1C42BBDE905FC2"><enum>(1)</enum><text>by redesignating
			 section 4305 as section 4306; and</text>
				</paragraph><paragraph id="idEEBD21A7757C48879D2AC2DC825698E2"><enum>(2)</enum><text>inserting after
			 section 4304 the following:</text>
					<quoted-block changed="deleted" committee-id="SSGA00" display-inline="no-display-inline" id="id26F91890233E4C55B47244BA7E5EF676" reported-display-style="strikethrough" style="USC">
						<section id="id411E1248C9DF4EA084C27B3C8A65024C"><enum>4305.</enum><header>Management
				competencies</header>
							<subsection id="id2DE3C85DB2084E5E87E22D71C4C86E72"><enum>(a)</enum><text>In this section,
				the term <term>supervisor</term> means—</text>
								<paragraph id="idF2063B23D2CF451E8A789A9E5385F681"><enum>(1)</enum><text>a supervisor as
				defined under section 7103(a)(10);</text>
								</paragraph><paragraph id="idEDFED19CEBF240A4BFC83AD3A3F755AD"><enum>(2)</enum><text>a management
				official as defined under section 7103(a)(11); and</text>
								</paragraph><paragraph id="id0960D69481F04459B38E0E274CB87BA6"><enum>(3)</enum><text>any other employee
				as the Director of the Office of Personnel Management may by regulation
				prescribe.</text>
								</paragraph></subsection><subsection id="id6CD297BAF6FD40E0B2710ECD9C17C42E"><enum>(b)</enum><text>The Director of
				the Office of Personnel Management shall issue guidance to agencies on
				competencies supervisors are expected to meet in order to effectively manage,
				and be accountable for managing, the performance of employees.</text>
							</subsection><subsection id="idCE5B37CE365048D5BE8CEDB0D9C3BF9D"><enum>(c)</enum><text>Each agency
				shall—</text>
								<paragraph id="idE00B6EEE61C249608847A19B20A2461F"><enum>(1)</enum><text>develop
				competencies to assess the performance of each supervisor and in developing
				such competencies shall consider the guidance developed by the Director of the
				Office of Personnel Management under subsection (b) and any other
				qualifications or factors determined by the agency;</text>
								</paragraph><paragraph id="idDB9B3E377F034958A973786857CC2429"><enum>(2)</enum><text>assess the overall
				capacity of the supervisors in the agency to meet the guidance developed by the
				Director of the Office of Personnel Management issued under subsection
				(b);</text>
								</paragraph><paragraph id="id0EA13DCA776B486EA495827AF115CAB2"><enum>(3)</enum><text>develop and
				implement a supervisor training program to strengthen issues identified during
				such assessment; and</text>
								</paragraph><paragraph id="id87E9E92AFAAD4BFEB9F857D2D8F8BEE4"><enum>(4)</enum><text>measure the
				effectiveness of the supervisor training program established under paragraph
				(3) in improving supervisor competence.</text>
								</paragraph></subsection><subsection id="id81B89F8076DC4ADC9D29BBE5895430D2"><enum>(d)</enum><text>Every year, or on
				any basis requested by the Director of the Office of Personnel Management, each
				agency shall submit a report to the Office on the progress of the agency in
				implementing this section, including measures used to assess program
				effectiveness.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id4090111E68244E66B7FF2DB9EC1D9FEA"><enum>(b)</enum><header>Technical and
			 conforming amendments</header>

				employees with unacceptable performance;</text>
								</clause><clause changed="added" committee-id="SSGA00" id="id6c70794d-3951-42c1-a514-78ec80316164" indent="up1" reported-display-style="italic"><enum>(v)</enum><text>addressing reports of a
				hostile work environment, reprisal, or harassment of, or by, another supervisor
				or employee;</text>
								</clause><clause changed="added" committee-id="SSGA00" id="id72DAC935F8F24936A5FC35C8889F3C11" indent="up1" reported-display-style="italic"><enum>(vi)</enum><text>meeting supervisor
				competencies established by the Office of Personnel Management or the employing
				agency of the supervisor; and</text>
								</clause><clause changed="added" committee-id="SSGA00" id="id0708d3ac-d0a5-469a-8434-956e1d2da18b" indent="up1" reported-display-style="italic"><enum>(vii)</enum><text>otherwise carrying out
				the duties or responsibilities of a supervisor;</text>
								</clause></subparagraph><subparagraph changed="added" committee-id="SSGA00" id="id49e761f5-cc16-4924-8c12-e4c582830270" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>a program to provide
				training to supervisors on the prohibited personnel practices under section
				2302 (particularly with respect to such practices described under subsection
				(b) (1) and (8) of that section), employee collective bargaining and union
				participation rights, and the procedures and processes used to enforce employee
				rights; and</text>
							</subparagraph><subparagraph changed="added" committee-id="SSGA00" id="id6ac6d95a-2d01-4abd-80e6-47e2acee1f9d" indent="up1" reported-display-style="italic"><enum>(C)</enum><text>a program under which
				experienced supervisors mentor new supervisors by—</text>
								<clause id="id504920e3-c2d1-48d4-bdd0-a58c48f6ef40"><enum>(i)</enum><text>transferring knowledge
				and advice in areas such as communication, critical thinking, responsibility,
				flexibility, motivating employees, teamwork, leadership, and professional
				development; and</text>
								</clause><clause id="ida0c18f78-e1b2-498a-8515-c87e78b28cf3"><enum>(ii)</enum><text>pointing out strengths
				and areas for development.</text>
								</clause></subparagraph></paragraph><subsection id="idBAEEB2A838694289BE6BEC5E8B84FBAE"><enum>(c)</enum><text>Training in programs
				established under subsection (b)(2) (A) and (B) shall be—</text>
							<paragraph id="id1D4A278EC10D4ACD9B6821F2516A8472"><enum>(1)</enum><text>interactive training
				which may include computer-based training; and</text>
							</paragraph><paragraph id="id0316994CD3FE4A859224AF54EF2CEB67"><enum>(2)</enum><text>to the extent practicable
				as determined by the head of the agency, training that is
				instructor-based.</text>
							</paragraph></subsection><subsection id="id535d228b-e823-47bc-ac1a-978d5dd9a3c0"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idac734c0f-3b24-4782-b23e-0158020d09bd"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idDA3F78B4C29C449380D9692BE37767F0"><enum>(A)</enum><text>Not later than 1 year
				after the date on which an individual is appointed to the position of
				supervisor, that individual shall be required to have completed each program
				established under subsection (b)(2).</text>
								</subparagraph><subparagraph changed="added" committee-id="SSGA00" id="id7DAEDF5123C64F45AFFF775A17044B99" indent="up2" reported-display-style="italic"><enum>(B)</enum><text>The Director of the
				Office of Personnel Management may establish and administer procedures under
				which the head of an agency may extend the 1-year period described under
				subparagraph (A) with respect to an individual.</text>
								</subparagraph></paragraph><paragraph changed="added" committee-id="SSGA00" id="id3413860f-e32c-4e11-b8f9-de486d36fbca" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>After completion of a
				program under subsection (b)(2) (A) and (B), each supervisor shall be required
				to complete a program under subsection (b)(2) (A) and (B) at least once every 3
				years.</text>
							</paragraph><paragraph changed="added" committee-id="SSGA00" id="ide6b46271-a835-494b-b528-bf4e2af7e0e6" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>Each program established
				under subsection (b)(2) shall include provisions under which credit shall be
				given for periods of similar training previously completed.</text>
							</paragraph><paragraph changed="added" committee-id="SSGA00" id="id6E395CCD023A44FEA78F276F5C20E2B2" indent="up1" reported-display-style="italic"><enum>(4)</enum><text>Each agency shall measure
				the effectiveness of training programs established under subsection
				(b)(2).</text>
							</paragraph></subsection><subsection id="idc28cd589-fbca-41d0-82d5-a6ab0eec0dff"><enum>(e)</enum><text>Notwithstanding section
				4118(c), the Director of the Office of Personnel Management shall prescribe
				regulations to carry out this section, including the monitoring of agency
				compliance with this section. Regulations prescribed under this subsection
				shall include measures by which to assess the effectiveness of agency
				supervisor training
				programs.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="ID52b57804c1ca421ba6c02b5163310d9a"><enum>(b)</enum><header>Report on extensions
			 for training requirements</header>
				<paragraph id="id6E2EACDE9F0B4AAFB2365FEBBCEDD430"><enum>(1)</enum><header>Appropriate
			 congressional committees</header><text>In this subsection, the term
			 <term>appropriate congressional committees</term>means—</text>
					<subparagraph id="id33E1C5848B8248A88FB6FFDC4E45B38F"><enum>(A)</enum><text>the Committee on Homeland
			 Security and Governmental Affairs of the Senate; and</text>
					</subparagraph><subparagraph id="id0448FAFAFF2640FABFCEA3270230BC36"><enum>(B)</enum><text>the Committee on
			 Oversight and Government Reform of the House of Representatives.</text>
					</subparagraph></paragraph><paragraph id="id0E9D4150D64745E48220F89E4DAC60AC"><enum>(2)</enum><header>Report</header><text>Not
			 later than November 1 of the first full fiscal year following the date of
			 enactment of this Act and not later than November 1 of each fiscal year
			 thereafter, the Director of the Office of Personnel Management shall submit a
			 report with respect to the preceding fiscal year to the appropriate
			 congressional committees on—</text>
					<subparagraph id="id1AA4BBD75353474FB792A20F3D5A4DDE"><enum>(A)</enum><text>the number of extensions
			 granted under section 4121(d)(1)(B) of title 5, United States Code, as added by
			 subsection (a) of this section; and</text>
					</subparagraph><subparagraph id="id959F336B83FF49D2AFE0C94662E7D500"><enum>(B)</enum><text>the number of individuals
			 completing the requirements of section 4121(d)(1)(A) of title 5, United States
			 Code, as added by subsection (a) of this section.</text>
					</subparagraph></paragraph></subsection><subsection id="id40d933a0-ae43-4779-a662-eafb0c45bf94"><enum>(c)</enum><header>Regulations</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Director of the
			 Office of Personnel Management shall prescribe regulations under section
			 4121(e) of title 5, United States Code, as added by subsection (a) of this
			 section.</text>
			</subsection><subsection id="ida907f7b6-4ebc-46fd-b453-7b6ca0061f0b"><enum>(d)</enum><header>Effective date and
			 application</header>
				<paragraph id="id0c334a2b-9f54-4617-b2c4-ebcdefc78f67"><enum>(1)</enum><header>In
			 general</header><text>The amendments made by this section shall take effect 1
			 year after the date of enactment of this Act and apply to—</text>
					<subparagraph id="ide679d80f-1564-4357-af7a-76c0dcd33f96"><enum>(A)</enum><text>each individual appointed
			 to the position of a supervisor, as defined under section 4121(a) of title 5,
			 United States Code (as added by subsection (a) of this section), on or after
			 that effective date; and</text>
					</subparagraph><subparagraph id="ideef438c3-8aea-4b66-b030-488a1b7d361a"><enum>(B)</enum><text>each individual who is
			 employed in the position of a supervisor on that effective date as provided
			 under paragraph (2).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3b64de06-3bbc-41ca-97fd-099c74a529ac"><enum>(2)</enum><header>Supervisors on
			 effective date</header><text>Each individual who is employed in the position of
			 a supervisor on the effective date of this section shall be required to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idfa8b4154-6e8d-4457-935e-6862d1b8b169"><enum>(A)</enum><text>complete each program
			 established under <external-xref legal-doc="usc" parsable-cite="usc/5/4121">section 4121(b)(2)</external-xref> of title 5,
			 United States Code (as added by subsection (a) of this section), not later than
			 3 years after the effective date of this section; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idbe38233b-4207-4b84-8c7f-4bd8c46d5796"><enum>(B)</enum><text>complete programs every 3
			 years thereafter in accordance with section 4121(d) (2) and (3) of such
			 title.</text>
					</subparagraph></paragraph></subsection></section><section changed="added" commented="no" committee-id="SSGA00" display-inline="no-display-inline" id="id3493d152-bf76-42b9-afe2-04f4e17d0b16" reported-display-style="italic"><enum>3.</enum><header>Management
			 <added-phrase reported-display-style="italic"></added-phrase>competencies<added-phrase reported-display-style="italic"></added-phrase></header>
			<subsection id="id60dce1f9-8077-422d-b1bd-c5932a103fe4"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/43">Chapter 43</external-xref> of title 5, United
			 States Code, is amended—</text>
				<paragraph id="id5d0bd6d2-dc0b-4c57-805f-f25098eba715"><enum>(1)</enum><text>by redesignating section
			 4305 as section 4306; and</text>
				</paragraph><paragraph id="id71a312ef-ecc5-4587-99f7-de9c1045846d"><enum>(2)</enum><text>inserting after section
			 4304 the following:</text>

							<subsection commented="no" id="id8A5902B08A454F0AA9E2D71A0B7F83D1"><enum>(a)</enum><text>In this section, the term
				<quote>supervisor</quote> means—</text>
								<paragraph commented="no" id="id0929E9B232B947B3AC8020EBEBFF0E71"><enum>(1)</enum><text>a supervisor as defined
				under section 7103(a)(10);</text>
								</paragraph><paragraph commented="no" id="idA2AF7D8A8DA64E379745478F09D061FB"><enum>(2)</enum><text>a management official as
				defined under section 7103(a)(11); and</text>
								</paragraph><paragraph commented="no" id="idF19BFB9CC3944001BA2BDEA20005D11B"><enum>(3)</enum><text>any other employee as the
				Director of the Office of Personnel Management may by regulation
				prescribe.</text>
								</paragraph></subsection><subsection id="id859c84a7-75b1-469f-8f3f-ff56d4460286"><enum>(b)</enum><text>The Director of the
				Office of Personnel Management shall issue guidance to agencies on competencies
				supervisors are expected to meet in order to effectively manage, and be
				accountable for managing, the performance of employees.</text>
							</subsection><subsection id="idfac470bf-14c7-4eb9-806c-2ca8b7aa5799"><enum>(c)</enum><text>Based on guidance issued
				under subsection (b) and on any additional competencies developed by an agency,
				each agency shall assess the performance of the supervisors and the overall
				capacity of the supervisors in that agency.</text>
							</subsection><subsection id="idc6b43659-1d5e-44ba-b171-a7f234bce256"><enum>(d)</enum><text>Every year, or on any
				basis requested by the Director of the Office of Personnel Management, each
				agency shall submit a report to the Office of Personnel Management on the
				progress of the agency in implementing this section, including measures used to
				assess program
				effectiveness.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id91487d70-ece6-4c04-90c7-550bebd042ed"><enum>(b)</enum><header>Technical and
