<enum>I</enum><header>Amendments to the
Elementary and Secondary Education Act of 1965</header>
<section id="id56852C03E22E4922BAF7BC14BF343D06"><enum>101.</enum><header>American
history and civics education</header><text display-inline="no-display-inline">Title II of the Elementary and Secondary
Education Act of 1965 (20 U.S.C. 6601 et seq.) is amended by adding at the end
the following:</text>

<section id="IDd7fef4bb190a48d09ae53292c817db05"><enum>2511.</enum><header>Establishment
of program</header>
<subsection id="IDdf29658656804c659505341b819e8de8"><enum>(a)</enum><header>In
general</header><text>The Secretary may establish and implement a program to be
known as the <quote>Teaching Traditional American History Grant
Program</quote>, under which the Secretary shall award grants on a competitive
basis to local educational agencies—</text>
<paragraph id="ID2214ae572b1f4325a97a8bdee86f61f0"><enum>(1)</enum><text>to carry out
activities to promote the teaching of traditional American history in
elementary schools and secondary schools as a separate academic subject (not as
a component of social studies); and</text>
</paragraph><paragraph id="IDe99ed9d52f3540d39fda71f05507c70f"><enum>(2)</enum><text>for the
development, implementation, and strengthening of programs to teach traditional
American history as a separate academic subject (not as a component of social
studies) within elementary school and secondary school curricula, including the
implementation of activities—</text>
<subparagraph id="ID1b05c369eacf4bd5b0c3bc9aed088c5c"><enum>(A)</enum><text>to improve the
quality of instruction; and</text>
</subparagraph><subparagraph id="ID611fad702c92439789e659ad7e72fdf1"><enum>(B)</enum><text>to provide
professional development and teacher education activities with respect to
traditional American history.</text>
</subparagraph></paragraph></subsection><subsection id="ID05690f272f9c41ef8cae07097876bd8d"><enum>(b)</enum><header>Required
partnership</header><text>A local educational agency that receives a grant
under subsection (a) shall carry out activities under the grant in partnership
with 1 or more of the following:</text>
<paragraph id="IDc6cbe07984914a77a3135f2ade410345"><enum>(1)</enum><text>An institution of
higher education.</text>
</paragraph><paragraph id="ID6d01239cdf3c41c3bf9fdc041618798f"><enum>(2)</enum><text>A nonprofit
history or humanities organization.</text>
</paragraph><paragraph id="IDe0c24902f63d444eb3f441a98cdc7f46"><enum>(3)</enum><text>A library or
museum.</text>
</paragraph></subsection><subsection id="ID9f7fdeee94c4487f83bc5843ebd02bee"><enum>(c)</enum><header>Application</header><text>To
be eligible to receive a grant under this section, a local educational agency
shall submit an application to the Secretary at such time, in such manner, and
containing such information as the Secretary may require.</text>
</subsection></section><section id="IDd3b4eb6d7256421a96f921ebd0eeaf9a"><enum>2512.</enum><header>Authorization
of appropriations</header><text display-inline="no-display-inline">There are
authorized to be appropriated to carry out this subpart $150,000,000 for fiscal
year 2010 and such sums as may be necessary for each of the 5 succeeding fiscal
years.</text>
</section></subpart><subpart id="id69C31803DE514B659556B1261E7E718D"><enum>2</enum><header>Presidential and
congressional history and civics academies</header>
<section id="ID8ddf218a2e2f44f2abb444c78205df9b"><enum>2521.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subpart:</text>
<paragraph id="ID59af593ec9c849a79695976f261f1de7"><enum>(1)</enum><header>American
history and civics</header><text>The term <term>American history and
civics</term> means the events, persons, ideas, and documents that shaped the
institutions and democratic heritage of the United States of America.</text>
</paragraph><paragraph id="IDa4a5b7ab157b40078f13ccfd4c643a7e"><enum>(2)</enum><header>Eligible
entity</header><text>The term <term>eligible entity</term>—</text>
<subparagraph id="ID60837f22306644e3845c3864b19c2431"><enum>(A)</enum><text>means—</text>
<clause id="ID7489093348a44b19a9754b1e1cbef1ba"><enum>(i)</enum><text>an institution of
higher education;</text>
</clause><clause id="ID08f0fe3a0b1644268f944636f4fe038f"><enum>(ii)</enum><text>an educational
institution created by a legislative act of a State for the express purpose of
teaching American history and civics to elementary school and secondary school
students; or</text>
</clause><clause id="ID93f06539af034cc1b63761d2e7c33c98"><enum>(iii)</enum><text>a nonprofit
educational institution, museum, library, or research center; and</text>
</clause></subparagraph><subparagraph id="ID3a21103b4feb4681ae65e8581f23aaaa"><enum>(B)</enum><text>includes a
consortium of entities described in subparagraph (A).</text>
</subparagraph></paragraph><paragraph id="ID87d9e0b0b5d8452c99e11900aabf6c17"><enum>(3)</enum><header>State</header><text>The
term <term>State</term> means each of the 50 States and the District of
Columbia.</text>
</paragraph><paragraph id="ID93dd2c526cb44f598ff1b2aeea481320"><enum>(4)</enum><header>Teachers of
American history and civics</header><text>The term <term>teachers of American
history and civics</term> means kindergarten through grade 12 teachers who
teach American history, government, or civics, or who incorporate such subjects
into their teaching.</text>
</paragraph></section><section id="IDec4ede5ab99b47bb8829c5202bef4eba"><enum>2522.</enum><header>Presidential
academies for teaching of American history and civics</header>
<subsection id="ID3f4e418d627349739223fd9bc6efafd1"><enum>(a)</enum><header>Establishment</header><text>From
amounts appropriated under section 2524, the Secretary shall award grants, on a
competitive basis, to eligible entities to establish Presidential Academies for
Teaching of American History and Civics (in this section referred to as the
<term>Academies</term>) that offer seminars or institutes for teachers of
American history and civics—</text>
<paragraph id="ID0bbecac04e6e475f8c6cae9916f0b763"><enum>(1)</enum><text>to strengthen
such teachers' knowledge of the subjects of American history and civics;
and</text>
</paragraph><paragraph id="ID60b0e11bfeae4fcba8afe36717f1ead8"><enum>(2)</enum><text>to learn how
better to teach such subjects.</text>
</paragraph></subsection><subsection id="IDe73b41c98c6f4e29906f4f8d67a6d156"><enum>(b)</enum><header>Application</header>
<paragraph id="ID1f34d002ae364ab2adb04e52c2fdb0dc"><enum>(1)</enum><header>In
general</header><text>An eligible entity that desires to receive a grant under
this section shall submit an application to the Secretary at such time, in such
manner, and containing such information as the Secretary may reasonably
require.</text>
</paragraph><paragraph id="ID3f70ad626f0e41abb0937c8273d751bb"><enum>(2)</enum><header>Contents</header><text>An
application submitted under paragraph (1) shall—</text>
<subparagraph id="IDcaa39dbadbbc46e9930dec48af21a7be"><enum>(A)</enum><text>include the
criteria that will be used to determine which teachers will be selected to
attend a seminar or institute offered by the Academy;</text>
</subparagraph><subparagraph id="ID6e581e7e8a524946859ebd39ae819e90"><enum>(B)</enum><text>identify the
individual the eligible entity intends to appoint to be the primary scholar at
the Academy;</text>
</subparagraph><subparagraph id="ID97f261949640477aa657d66687aefdd3"><enum>(C)</enum><text>include a
description of the curriculum to be used at a seminar or institute offered by
the Academy; and</text>
</subparagraph><subparagraph id="ID88a65fb963ed41a6ae33d2508a42fd6a"><enum>(D)</enum><text>provide an
assurance that the recruitment plan for which teachers will be selected to
attend a seminar or institute offered by the Academy will include teachers from
high-need schools.</text>
</subparagraph></paragraph></subsection><subsection id="IDf7ca97c9641241d3983e70e7ce6666c9"><enum>(c)</enum><header>Priority</header><text>In
awarding grants under this subpart, the Secretary shall give priority to
eligible entities that coordinate or align their activities with the National
Park Service National Centennial Parks initiative to develop innovative and
comprehensive programs using the resources of the National Parks.</text>
</subsection><subsection id="ID090226cb963c41e5bcb4fb8f8b06d16d"><enum>(d)</enum><header>Grant
terms</header><text>Grants awarded under this section shall be for a term of
not more than 5 years.</text>
</subsection><subsection id="ID7fc78b4652064281a0c35c01d5821f5a"><enum>(e)</enum><header>Use of
funds</header>
<paragraph id="idDB4C1EE972E141029AF5BB388C2E12FB"><enum>(1)</enum><header>In
general</header><text>Each eligible entity that receives a grant under this
section shall use the grant funds—</text>
<subparagraph id="idB5232DEBEF444A56906A6A0ED805BB11"><enum>(A)</enum><text>to establish an
Academy and a seminar or institute in accordance with paragraph (2);</text>
</subparagraph><subparagraph id="id1581095C962A4107B5954DCEB0933EDF"><enum>(B)</enum><text>for Academy staff
in accordance with paragraph (3);</text>
</subparagraph><subparagraph id="idC503F9CA114846E897DFC77A16C45E11"><enum>(C)</enum><text>for the selection
of teachers in accordance with paragraph (4); and</text>
</subparagraph><subparagraph id="id36FF61A3A70A4A8A9D965B0B5B46E3C4"><enum>(D)</enum><text>to pay teacher
stipends in accordance with paragraph (5).</text>
</subparagraph></paragraph><paragraph id="IDf022472eaced4fcf985f55cfb559ebe5"><enum>(2)</enum><header>Seminars and
institutes</header><text>An eligible entity that receives a grant under this
section shall establish an Academy that shall offer a seminar or institute for
teachers of American history and civics that—</text>
<subparagraph id="ID35722cd7674d4de5860745083b6d53e6"><enum>(A)</enum><text>provides
intensive professional development opportunities for teachers of American
history and civics to strengthen such teachers’ knowledge of the subjects of
American history and civics;</text>
</subparagraph><subparagraph id="ID0d4c38f8779248e480f89c12f137033c"><enum>(B)</enum><text>is led by a team
of primary scholars and core teachers;</text>
</subparagraph><subparagraph id="IDaba35910ccc34bb7aff9c8c953f5b482"><enum>(C)</enum><text>is conducted
during the summer or another appropriate time; and</text>
</subparagraph><subparagraph id="ID3d4a502faf894c4da8a354b2b880e884"><enum>(D)</enum><text>is of not less
than 2 weeks and not more than 6 weeks in duration.</text>
</subparagraph></paragraph><paragraph id="ID622ec8a5a7664595aea91268ac5e6bbe"><enum>(3)</enum><header>Academy
staff</header>
<subparagraph id="IDb773db0942de4376831f6d37ad6bc2e2"><enum>(A)</enum><header>Primary
scholar</header><text>Each Academy shall be headed by a primary scholar
identified in the application submitted under subsection (b) who shall—</text>
<clause id="ID003c8f1d4f6c4644ab385cadf0e984b5"><enum>(i)</enum><text>be accomplished
in the field of traditional American history and civics; and</text>
</clause><clause id="IDac761e0f3cae4f8ab9ae80caa19c4d6d"><enum>(ii)</enum><text>design the
curriculum for and lead the seminar or institute.</text>
</clause></subparagraph><subparagraph id="ID2231ad37983541b5b813e444566d7f1d"><enum>(B)</enum><header>Core
teachers</header><text>Each primary scholar shall appoint an appropriate number
of core teachers. At the direction of the primary scholar, the core teachers
shall teach and train the seminar or institute attendees.</text>
</subparagraph></paragraph><paragraph id="ID15c114784ee44ab5b8a67c52c2db899a"><enum>(4)</enum><header>Selection of
teachers</header>
<subparagraph id="ID3aae12e1a1bd4e208ed4f8935956be89"><enum>(A)</enum><header>In
general</header>
<clause id="IDe9026b33084c43968d08a36aef14f889"><enum>(i)</enum><header>Number of
teachers</header><text>Each year, each Academy shall select teachers of
American history and civics to attend the seminar or institute offered by the
Academy.</text>
</clause><clause id="IDfd674ded005d4d8ab0b91cb51b40fb3f"><enum>(ii)</enum><header>Flexibility in
number of teachers</header><text>Each Academy shall select not more than 300
and not less than 50 teachers under clause (i).</text>
</clause></subparagraph><subparagraph id="ID7c98b6d3560941168d14a99309256698"><enum>(B)</enum><header>Teachers from
public and private schools</header><text>An Academy may select teachers from
public schools and private schools to attend the seminar or institute offered
by the Academy.</text>
</subparagraph></paragraph><paragraph id="ID86c0d1c47d7e42fdbe744ed9e8499552"><enum>(5)</enum><header>Teacher
stipends</header><text>Each teacher selected to participate in a seminar or
institute funded under this section shall be awarded a fixed stipend based on
the length of the seminar or institute to help cover travel costs, books and
other study expenses, and meals and living expenses appropriate to the length
of the seminar or institute to ensure that such teacher does not incur personal
costs associated with the teacher's participation in the seminar or
institute.</text>
</paragraph></subsection><subsection id="IDdd450c1934c744619408194ddaafcc8f"><enum>(f)</enum><header>Evaluation</header>
<paragraph id="IDae9f899d772845b8b263d8ea054c73ca"><enum>(1)</enum><header>In
general</header><text>At the completion of all of the seminars and institutes
assisted in the third year grants are awarded under this section, the Secretary
shall conduct an evaluation and submit a report on its findings to the
Committee on Health, Education, Labor, and Pensions of the Senate and the
Committee on Education and Labor of the House of Representatives.</text>
</paragraph><paragraph id="ID470292be9ff74bc78ed93b051a45db60"><enum>(2)</enum><header>Content of
evaluation</header><text>The evaluation conducted pursuant to paragraph (1)
shall—</text>
<subparagraph id="ID041f62b462a54943ad97c9a3372f5c44"><enum>(A)</enum><text>determine the
overall success of the grant program authorized under this section; and</text>
</subparagraph><subparagraph id="IDdec9197924eb4f50be53b4e69f1ee375"><enum>(B)</enum><text>highlight the
best grantees' practices in order to become models for future grantees.</text>
</subparagraph></paragraph></subsection><subsection id="ID2a47e82ddd1a40df97aada111a3c9f73"><enum>(g)</enum><header>Match</header>
<paragraph id="ID6f646dc1de8347ed99d77d46b49cf067"><enum>(1)</enum><header>In
general</header><text>An eligible entity receiving Federal assistance under
this section shall provide, toward the cost of the activities assisted under
the grant, from non-Federal sources, an amount equal to 100 percent of the
amount of the grant.</text>
</paragraph><paragraph id="IDf43e53b019f24c35bb0cfdaaa80f7509"><enum>(2)</enum><header>Waiver</header><text>The
Secretary may waive all or part of the matching requirement described in
paragraph (1) for any fiscal year for an eligible entity if the Secretary
determines that applying the matching requirement would result in serious
hardship or an inability to carry out the activities described in subsection
(e).</text>
</paragraph></subsection></section><section id="ID71ba83c8eeed4f09a5deb56ce2c08598"><enum>2523.</enum><header>Congressional
academies for students of American history and civics</header>
<subsection id="ID9f59c19adc714f908d63489dfb4ce731"><enum>(a)</enum><header>Establishment</header><text>From
amounts appropriated under section 2524, the Secretary shall award grants, on a
competitive basis, to eligible entities to establish Congressional Academies
for Students of American History and Civics (in this section referred to as the
<term>Academies</term>) that shall offer seminars or institutes for outstanding
students of American history and civics to broaden and deepen such students'
understanding of American history and civics.</text>
</subsection><subsection id="IDc703f15267c840e5a2928c278fb4b2f2"><enum>(b)</enum><header>Application</header>
<paragraph id="IDa0dbf8ce2fc844e1be87866820bb47be"><enum>(1)</enum><header>In
general</header><text>An eligible entity that desires to receive a grant under
this section shall submit an application to the Secretary at such time, in such
manner, and containing such information as the Secretary may reasonably
require.</text>
</paragraph><paragraph id="IDc399ad64a7ae40469830f3c1a21ca388"><enum>(2)</enum><header>Contents</header><text>An
application submitted under paragraph (1) shall—</text>
<subparagraph id="IDfd5a1bb1d392464c9cd51e1ecd7f4f2d"><enum>(A)</enum><text>include the
criteria that will be used to determine which students will be selected to
attend a seminar or institute offered by the Academy;</text>
</subparagraph><subparagraph id="IDd02cc593671c470882d36bfacaf6eb8d"><enum>(B)</enum><text>identify the
individual the eligible entity intends to appoint to be the primary scholar at
the Academy;</text>
</subparagraph><subparagraph id="IDfd460ef1f5454de2bc1348bcef2c3f28"><enum>(C)</enum><text>include a
description of the curriculum to be used at a seminar or institute offered by
the Academy; and</text>
</subparagraph><subparagraph id="ID7713a70275e84774b65d8f7e23c242c0"><enum>(D)</enum><text>include a
description of how the eligible entity will—</text>
<clause id="ID265a7cd0cde94b869c8eaf53107b5c4c"><enum>(i)</enum><text>inform students
served by local educational agencies receiving assistance under part A of title
I, particularly students enrolled in schools with high percentages of students
described as children to be counted under section 1124(c), of the Academy;
and</text>
</clause><clause id="IDb095c6152f244128845e1f2d66001635"><enum>(ii)</enum><text>provide such
students with information on how to apply to attend a seminar or institute
offered by the Academy so that such students may attend the seminar or
institute.</text>
</clause></subparagraph></paragraph></subsection><subsection id="IDdea162ff8e6a4e348b8c64224c262db7"><enum>(c)</enum><header>Grant
terms</header><text>Grants awarded under this section shall be for a term of
not more than 5 years.</text>
</subsection><subsection id="IDf761d6fe40a14f42ab12234fc249972a"><enum>(d)</enum><header>Use of
funds</header>
<paragraph id="id5E124B7FEAA3412591EA9419A94B19DB"><enum>(1)</enum><header>In
general</header><text>Each eligible entity that receives a grant under this
section shall use the grant funds—</text>
<subparagraph id="id83BA21D6FE4B4A9099349361E4C24D5F"><enum>(A)</enum><text>to establish an
Academy and a seminar or institute in accordance with paragraph (2);</text>
</subparagraph><subparagraph id="idCC55E58EE3DB41E1983511D3552C9A65"><enum>(B)</enum><text>for Academy staff
in accordance with paragraph (3);</text>
</subparagraph><subparagraph id="idDA0D8223F12E4F9292FB6E2C04EB0D48"><enum>(C)</enum><text>for the selection
of students in accordance with paragraph (4); and</text>
</subparagraph><subparagraph id="idDF7B11875299470CB8D23772A47ACD38"><enum>(D)</enum><text>to pay student
stipends in accordance with paragraph (5).</text>
</subparagraph></paragraph><paragraph id="IDf9571c04d1ff4556b1a6f831cbecc3dd"><enum>(2)</enum><header>Seminars and
institutes</header><text>An eligible entity that receives a grant under this
section shall establish an Academy that shall offer a seminar or institute
during the summer for outstanding students of American history and civics
that—</text>
<subparagraph id="ID70d39a65dffd4561a5060d0f61597347"><enum>(A)</enum><text>broadens and
deepens such students’ understanding of American history and civics;</text>
</subparagraph><subparagraph id="IDd904bfb7875e4d8c9b74aa11ba57b485"><enum>(B)</enum><text>is led by a team
of primary scholars and core teachers; and</text>
</subparagraph><subparagraph id="IDae9a7f8eefb14be98d82c7a3a812e3d1"><enum>(C)</enum><text>is of not less
than 2 weeks and not more than 6 weeks in duration.</text>
</subparagraph></paragraph><paragraph id="IDbc5d4a8b2fbc44f5a93737cb638997b2"><enum>(3)</enum><header>Academy
staff</header>
<subparagraph id="ID7919a5fdf2064efabf290fb994afcd00"><enum>(A)</enum><header>Primary
scholar</header><text>Each Academy shall be headed by a primary scholar
identified in the application submitted under subsection (b) who shall—</text>
<clause id="IDd2d3eb77f8744aaeb7c8ee423e715a6f"><enum>(i)</enum><text>be accomplished
in the field of American history and civics; and</text>
</clause><clause id="ID43fe613c0dce4e349cac06d7172e1745"><enum>(ii)</enum><text>design the
curriculum for and lead the seminar or institute.</text>
</clause></subparagraph><subparagraph id="ID6eca751375a147f8bd0bed5f964df962"><enum>(B)</enum><header>Core
teachers</header><text>Each primary scholar shall appoint an appropriate number
of core teachers. At the direction of the primary scholar, the core teachers
shall teach the seminar or institute attendees.</text>
</subparagraph></paragraph><paragraph id="ID28b9e847bb154f798e013f45457030ac"><enum>(4)</enum><header>Selection of
students</header>
<subparagraph id="ID6c90e0233686481b8af3334b3cc13caf"><enum>(A)</enum><header>Number of
students</header><text>Each year, each Academy shall select between 100 and 300
eligible students to attend the seminar or institute offered by the
Academy.</text>
</subparagraph><subparagraph id="IDfb821ffb9c634a638341015fa69983fd"><enum>(B)</enum><header>Eligible
students</header><text>A student shall be eligible to attend a seminar or
institute offered by an Academy if the student—</text>
<clause id="IDb2da1d5d3b194f00a8ba6f49bd57dc2a"><enum>(i)</enum><text>is recommended by
the student's secondary school principal (or other head of such student's
academic program) to attend the seminar or institute; and</text>
</clause><clause id="ID7b88f1a093824d899cbe4d1a1ca937ff"><enum>(ii)</enum><text>will be a junior
or senior in the academic year following attendance at the seminar or
institute.</text>
</clause></subparagraph></paragraph><paragraph id="ID215a63cb98fa40f896b4896be24056cb"><enum>(5)</enum><header>Student
stipends</header><text>Each student selected to participate in a seminar or
institute funded under this section shall be awarded a fixed stipend based on
the length of the seminar or institute to help cover travel costs, books and
other study expenses, and meals and living expenses appropriate to the length
of the seminar or institute to ensure that such student does not incur personal
costs associated with the student's participation in the seminar or
institute.</text>
</paragraph></subsection><subsection id="ID3f05ddbb030e42bca7e89c1508c88c3e"><enum>(e)</enum><header>Evaluation</header>
<paragraph id="IDf78a2bef6ad940d7938490355877997c"><enum>(1)</enum><header>In
general</header><text>At the completion of all of the seminars and institutes
assisted in the third year grants are awarded under this section, the Secretary
shall conduct an evaluation and submit a report on its findings to the
Committee on Health, Education, Labor, and Pensions of the Senate and the
Committee on Education and Labor of the House of Representatives.</text>
</paragraph><paragraph id="ID97a2180f358e4253ab9eb63212884a82"><enum>(2)</enum><header>Content of
evaluation</header><text>The evaluation conducted pursuant to paragraph (1)
shall—</text>
<subparagraph id="ID61e257ce39be483c91fbca562ce20271"><enum>(A)</enum><text>determine the
overall success of the grant program authorized under this section; and</text>
</subparagraph><subparagraph id="ID30d840700b5643ea8f72ac626b3ca384"><enum>(B)</enum><text>highlight the
best grantees' practices in order to become models for future grantees.</text>
</subparagraph></paragraph></subsection><subsection id="ID8e79bc80137c4f59beae98a291c786e5"><enum>(f)</enum><header>Match</header>
<paragraph id="IDe2dbca81646549d7a9fdfba0f7d6a3a7"><enum>(1)</enum><header>In
general</header><text>An eligible entity receiving Federal assistance under
this section shall provide, toward the cost of the activities assisted under
the grant, from non-Federal sources, an amount equal to 100 percent of the
amount of the grant.</text>
</paragraph><paragraph id="IDdbaf8c10791e4b719948fdaa29d9af45"><enum>(2)</enum><header>Waiver</header><text>The
Secretary may waive all or part of the matching requirement described in
paragraph (1) for any fiscal year for an eligible entity if the Secretary
determines that applying the matching requirement would result in serious
hardship or an inability to carry out the activities described in subsection
(d).</text>
</paragraph></subsection></section><section id="ID1d074be9d4e1458ca89bb9cec6024d92"><enum>2524.</enum><header>Authorization
of appropriations</header><text display-inline="no-display-inline">There is
authorized to be appropriated to carry out this subpart $50,000,000 for each of
fiscal years 2010 through 2015.</text>
</section></subpart><subpart id="id22B13AE5BF744B298BC9AAB973C95E68"><enum>3</enum><header>Civic
education</header>
<section id="ID9a8cc17c461147e79a233a18e8c1ce81"><enum>2531.</enum><header>Short
title</header><text display-inline="no-display-inline">This subpart may be
cited as the <quote><short-title>Education for Democracy
Act</short-title></quote>.</text>
</section><section id="IDcb992306bf5a4144aa3df369963410f4"><enum>2532.</enum><header>Purpose</header><text display-inline="no-display-inline">It is the purpose of this subpart—</text>
<paragraph id="ID405d9730a39c449985fb6a31e076e592"><enum>(1)</enum><text>to improve the
quality of civics and government education by educating students about the
history and principles of the Constitution of the United States, including the
Bill of Rights;</text>
</paragraph><paragraph id="ID732aa9168dc649d5a45aba68b4bf5af1"><enum>(2)</enum><text>to foster civic
competence and responsibility; and</text>
</paragraph><paragraph id="IDae413c8e995f4b0ba35d7a1d99a91052"><enum>(3)</enum><text>to improve the
quality of civic education and economic education through cooperative civic
education and economic education exchange programs with emerging
democracies.</text>
</paragraph></section><section id="ID6c406cdf95df4060bdac1338a4d3c543"><enum>2533.</enum><header>General
authority</header>
<subsection id="IDa47733e84ef44890bd7a7941ecec4db3"><enum>(a)</enum><header>Authority</header><text>The
Secretary is authorized to award grants to, or enter into contracts
with—</text>
<paragraph id="IDbb3cf4374b264fbb85a79de56055547f"><enum>(1)</enum><text>the Center for
Civic Education, to carry out civic education activities under sections 2534
and 2535;</text>
</paragraph><paragraph id="IDd53d20f454cd44d29b76d01d07c12e9f"><enum>(2)</enum><text>the National
Council on Economic Education, to carry out economic education activities under
section 2535; and</text>
</paragraph><paragraph id="IDdad805d7c8994188b01713995b350691"><enum>(3)</enum><text>organizations
experienced in the development of curricula and programs in civics and
government education or economic education for students in elementary schools
and secondary schools in countries other than the United States, to carry out
civic education or economic education activities under section 2535.</text>
</paragraph></subsection><subsection id="IDb498a86ffd554bd284acc9437a3fd83a"><enum>(b)</enum><header>Distribution
for cooperative civic education and economic education exchange
programs</header>
<paragraph id="IDd66b1b4ea3de4cb2bb43dae8687fea70"><enum>(1)</enum><header>Limitation</header><text>Not
more than 40 percent of the amount appropriated under section 2536 for a fiscal
year shall be used to carry out section 2555.</text>
</paragraph><paragraph id="ID9bc4e6bdf6374729a07824070e563559"><enum>(2)</enum><header>Distribution</header><text>Of
the amount used to carry out section 2535 for a fiscal year (consistent with
paragraph (1)), the Secretary shall use—</text>
<subparagraph id="IDf146539c012346a7a620c0cf1ede6426"><enum>(A)</enum><text>37.5 percent for
a grant or contract for the Center for Civic Education;</text>
</subparagraph><subparagraph id="IDfeadab6259a8411ea22d35330a0f5609"><enum>(B)</enum><text>37.5 percent for
a grant or contract for the National Council on Economic Education; and</text>
</subparagraph><subparagraph id="ID2939166ec7cb4f228738db5ffc7c61a6"><enum>(C)</enum><text>25 percent for
not less than 1, but not more than 3, grants or contracts for organizations
described in subsection (a)(3).</text>
</subparagraph></paragraph></subsection></section><section id="ID14dac520092444bda6c5044000465a62"><enum>2534.</enum><header>We the people
program</header>
<subsection id="ID13c7f98676bc4cf78ffd04729537343f"><enum>(a)</enum><header>The citizen and
the constitution</header>
<paragraph id="ID1f6cfdc5a9194095a79114f64382e3ef"><enum>(1)</enum><header>Educational
activities</header><text>The Center for Civic Education—</text>
<subparagraph id="ID347a9eb29075461aa6e838ec6e14aa30"><enum>(A)</enum><text>shall use funds
made available under grants or contracts under section 2533(a)(1)—</text>
<clause id="IDa2451be2c8da44b282605900dcd1b3a0"><enum>(i)</enum><text>to continue and
expand the educational activities of the program entitled the We the People …
The Citizen and the Constitution program administered by such center;</text>
</clause><clause id="ID15d0a6f1bda446c4aacd4a013c4b6db3"><enum>(ii)</enum><text>to carry out
activities to enhance student attainment of challenging academic content
standards in civics and government;</text>
</clause><clause id="IDe585c1d9da23461f9bef1090f797228e"><enum>(iii)</enum><text>to provide a
course of instruction on the basic principles of the Nation's constitutional
democracy and the history of the Constitution of the United States, including
the Bill of Rights;</text>
</clause><clause id="ID24205114660c48b4a9e3d51e4f806514"><enum>(iv)</enum><text>to provide, at
the request of a participating school, school and community simulated
congressional hearings following the course of instruction described in clause
(iii); and</text>
</clause><clause id="ID595164002b1c45669d173743bf6aeb8a"><enum>(v)</enum><text>to provide an
annual national competition of simulated congressional hearings for secondary
school students who wish to participate in such a program; and</text>
</clause></subparagraph><subparagraph id="ID85f80d55b70f491fa462dea12b919992"><enum>(B)</enum><text>may use funds
made available under grants or contracts under section 2533(a)(1)—</text>
<clause id="ID148c047376714d73a98b91a9048dfd50"><enum>(i)</enum><text>to provide
advanced, sustained, and ongoing training of teachers about the Constitution of
the United States and the political system of the United States;</text>
</clause><clause id="ID2dabfd9a31cb42638a04ea5beff4be38"><enum>(ii)</enum><text>to implement a
comprehensive program to improve public knowledge, understanding, and support
of American democratic institutions; and</text>
</clause><clause id="ID78eaa9c34ddc4adca118f9f3d2c8da40"><enum>(iii)</enum><text>to provide
materials and methods of instruction, including teacher training, that utilize
the latest advancements in educational technology.</text>
</clause></subparagraph></paragraph><paragraph id="ID91a593d720324af3ab2192c0d452c1db"><enum>(2)</enum><header>Availability of
program</header><text>The education program authorized under this subsection
shall be made available to public and private elementary schools and secondary
schools, including Bureau-funded schools, in the 435 congressional districts,
and in the District of Columbia, the Commonwealth of Puerto Rico, the United
States Virgin Islands, Guam, American Samoa, and the Commonwealth of the
Northern Mariana Islands.</text>
</paragraph></subsection><subsection id="IDc1c88cae88e24b078940f94322a67985"><enum>(b)</enum><header>Project
citizen</header>
<paragraph id="IDc58f5300c1194093bb01144c604d92fd"><enum>(1)</enum><header>Educational
activities</header><text>The Center for Civic Education—</text>
<subparagraph id="IDf5722d5d5efe463aa3dee55f1f4e81b9"><enum>(A)</enum><text>shall use funds
made available under grants or contracts under section 2533(a)(1)—</text>
<clause id="IDe4b2775b2d5d4dd0879faf154ee3676b"><enum>(i)</enum><text>to continue and
expand the educational activities of the program entitled the We the People …
Project Citizen program administered by the Center;</text>
</clause><clause id="IDafc8da31f62c4cbb861b8a22fc0315d3"><enum>(ii)</enum><text>to carry out
activities to enhance student attainment of challenging academic content
standards in civics and government;</text>
</clause><clause id="IDaea101e344eb4b70b1ac0f0e37a735ce"><enum>(iii)</enum><text>to provide a
course of instruction at the middle and high school levels on the roles of
State and local governments in the Federal system established by the
Constitution of the United States;</text>
</clause><clause id="ID78e5cc76770740c09d676f7ca507ff4d"><enum>(iv)</enum><text>to provide an
annual national showcase or competition; and</text>
</clause><clause id="ID67f6760ade934b29a032a0cd1a4ef29b"><enum>(v)</enum><text>to provide civic
education materials and services to address the needs of immigrants, new
citizens, and other postsecondary and adult populations; and</text>
</clause></subparagraph><subparagraph id="ID9a16755bf125446193fe05a22ab5110c"><enum>(B)</enum><text>may use funds
made available under grants or contracts under section 2533(a)(1)—</text>
<clause id="IDf07cbefc64a94ba086dced1499ac578b"><enum>(i)</enum><text>to provide
optional school and community simulated State legislative hearings;</text>
</clause><clause id="IDf34d0be35a7b4bd1ac02de087d7f73e5"><enum>(ii)</enum><text>to provide
advanced, sustained, and ongoing training of teachers on the roles of State and
local governments in the Federal system established by the Constitution of the
United States; and</text>
</clause><clause id="ID083862c325ac4584beb732c25b94f27a"><enum>(iii)</enum><text>to provide
materials and methods of instruction, including teacher training, that utilize
the latest advancements in educational technology.</text>
</clause></subparagraph></paragraph><paragraph id="ID01152331788649a7a7ae1e3085ea30a1"><enum>(2)</enum><header>Availability of
program</header><text>The education program authorized under this subsection
shall be made available to public and private middle schools, including
Bureau-funded schools, in the 50 States of the United States, the District of
Columbia, the Commonwealth of Puerto Rico, the United States Virgin Islands,
Guam, American Samoa, and the Commonwealth of the Northern Mariana
Islands.</text>
</paragraph></subsection><subsection id="IDfebfd2cd68d34a578fcd31269bb0d73a"><enum>(c)</enum><header>Bureau-funded
school defined</header><text>In this section, the term <term>Bureau-funded
school</term> has the meaning given such term in section 1141 of the Education
Amendments of 1978 (25 U.S.C. 2021).</text>
</subsection></section><section id="ID014beaa458e54194a5f32523d9159c85"><enum>2535.</enum><header>Cooperative
civic education and economic education exchange programs</header>
<subsection id="ID99638492f889469794540cf20db91a3c"><enum>(a)</enum><header>Cooperative
education exchange programs</header><text>The Center for Civic Education, the
National Council on Economic Education, and organizations described in section
2533(a)(3) shall use funds made available under grants or contracts under
section 2533 to carry out cooperative education exchange programs in accordance
with this section.</text>
</subsection><subsection id="ID178170b0e22d4fe2bd5d757ab037e332"><enum>(b)</enum><header>Purpose</header><text>The
purpose of the cooperative education exchange programs carried out under this
section shall be—</text>
<paragraph id="ID872476669beb483b931d1bf6e4651718"><enum>(1)</enum><text>to make available
to educators from eligible countries exemplary curriculum and teacher training
programs in civics and government education, and economics education, developed
in the United States;</text>
</paragraph><paragraph id="ID9a5a3e4c60a446b18cbc657fe5d6655e"><enum>(2)</enum><text>to assist
eligible countries in the adaptation, implementation, and institutionalization
of such programs;</text>
</paragraph><paragraph id="IDfe9788ebbae34f95bbdd18001c1c8917"><enum>(3)</enum><text>to create and
implement civics and government education, and economic education, programs for
students that draw upon the experiences of the participating eligible
countries;</text>
</paragraph><paragraph id="ID1f4f45a2d82141f0ae3bf46879fb06b2"><enum>(4)</enum><text>to provide a
means for the exchange of ideas and experiences in civics and government
education, and economic education, among political, educational, governmental,
and private sector leaders of participating eligible countries; and</text>
</paragraph><paragraph id="IDa4ab4d4f95cb495aa5674ae136efe17a"><enum>(5)</enum><text>to provide
support for—</text>
<subparagraph id="IDeb0ba7e16f67425a9b05765857964473"><enum>(A)</enum><text>independent
research and evaluation to determine the effects of educational programs on
students' development of the knowledge, skills, and traits of character
essential for the preservation and improvement of constitutional democracy;
and</text>
</subparagraph><subparagraph id="ID347bfa4bb9054e329ee462a03788acf7"><enum>(B)</enum><text>effective
participation in, and the preservation and improvement of, an efficient market
economy.</text>
</subparagraph></paragraph></subsection><subsection id="ID215e0b6fcbc24b63bf3dbbf126a8de07"><enum>(c)</enum><header>Activities</header><text>In
carrying out the cooperative education exchange programs assisted under this
section, the Center for Civic Education, the National Council on Economic
Education, and organizations described in section 2533(a)(3) shall—</text>
<paragraph id="ID61906c57f47345a8aa8e2e40f9bf3f51"><enum>(1)</enum><text>provide to the
participants from eligible countries—</text>
<subparagraph id="ID29deb658833d47d895676a87a22b1cc7"><enum>(A)</enum><text>seminars on the
basic principles of United States constitutional democracy and economic system,
including seminars on the major governmental and economic institutions and
systems in the United States, and visits to such institutions;</text>
</subparagraph><subparagraph id="ID29fd2d69bded488c8e81cc24d710a616"><enum>(B)</enum><text>visits to school
systems, institutions of higher education, and nonprofit organizations
conducting exemplary programs in civics and government education, and economic
education, in the United States;</text>
</subparagraph><subparagraph id="ID4ee23ed4d0174e14b773a8add271f929"><enum>(C)</enum><text>translations and
adaptations with respect to United States civics and government education, and
economic education, curricular programs for students and teachers, and in the
case of training programs for teachers, translations and adaptations into forms
useful in schools in eligible countries, and joint research projects in such
areas; and</text>
</subparagraph><subparagraph id="ID4a1af5fe06fb401f9814ab1c15138c1b"><enum>(D)</enum><text>independent
research and evaluation assistance—</text>
<clause id="ID03b0af6c1e4d452eb47fa5302a0e5587"><enum>(i)</enum><text>to determine the
effects of the cooperative education exchange programs on students' development
of the knowledge, skills, and traits of character essential for the
preservation and improvement of constitutional democracy; and</text>
</clause><clause id="IDfb6e3e0e6dfa435ca63812796e46b183"><enum>(ii)</enum><text>to identify
effective participation in, and the preservation and improvement of, an
efficient market economy;</text>
</clause></subparagraph></paragraph><paragraph id="ID7b8659e304014a159f67cc7f4ad85fd2"><enum>(2)</enum><text>provide to the
participants from the United States—</text>
<subparagraph id="ID0df71db306f6419884a0029008013939"><enum>(A)</enum><text>seminars on the
histories, economies, and systems of government of eligible countries;</text>
</subparagraph><subparagraph id="ID64bce16466ae46389aee2f9b817967d4"><enum>(B)</enum><text>visits to school
systems, institutions of higher education, and organizations conducting
exemplary programs in civics and government education, and economic education,
located in eligible countries;</text>
</subparagraph><subparagraph id="ID559fa4045d7c48989628ccc3fbe65c19"><enum>(C)</enum><text>assistance from
educators and scholars in eligible countries in the development of curricular
materials on the history, government, and economy of such countries that are
useful in United States classrooms;</text>
</subparagraph><subparagraph id="ID711954d1904a467cb65e02dc1a3d6447"><enum>(D)</enum><text>opportunities to
provide onsite demonstrations of United States curricula and pedagogy for
educational leaders in eligible countries; and</text>
</subparagraph><subparagraph id="ID5601ae156eba4661b2651955d81820bb"><enum>(E)</enum><text>independent
research and evaluation assistance to determine—</text>
<clause id="IDac599a6d6c1f43d59517ccf4d5b5d545"><enum>(i)</enum><text>the effects of
the cooperative education exchange programs assisted under this section on
students' development of the knowledge, skills, and traits of character
essential for the preservation and improvement of constitutional democracy;
and</text>
</clause><clause id="ID8d57bedbe01446028eaa4ea1ef145211"><enum>(ii)</enum><text>effective
participation in, and improvement of, an efficient market economy; and</text>
</clause></subparagraph></paragraph><paragraph id="IDd394c7e86f8f4bc984fe60c24cd87f24"><enum>(3)</enum><text>assist
participants from eligible countries and the United States to participate in
international conferences on civics and government education, and economic
education, for educational leaders, teacher trainers, scholars in related
disciplines, and educational policymakers.</text>
</paragraph></subsection><subsection id="ID325cca085b78438a8047fee28776542c"><enum>(d)</enum><header>Participants</header><text>The
primary participants in the cooperative education exchange programs assisted
under this section shall be educational leaders in the areas of civics and
government education, and economic education, including teachers, curriculum
and teacher training specialists, scholars in relevant disciplines, and
educational policymakers, and government and private sector leaders from the
United States and eligible countries.</text>
</subsection><subsection id="IDa683a8178fdc45e39f4eeaea0d31f70f"><enum>(e)</enum><header>Consultation</header><text>The
Secretary may award a grant to, or enter into a contract with, the entities
described in section 2533 to carry out programs assisted under this section
only if the Secretary of State concurs with the Secretary that such grant, or
contract, respectively, is consistent with the foreign policy of the United
States.</text>
</subsection><subsection id="ID5340fcea117846c3a36b0842998e4636"><enum>(f)</enum><header>Avoidance of
duplication</header><text>With the concurrence of the Secretary of State, the
Secretary shall ensure that—</text>
<paragraph id="IDf75228b646ee4534b65e4978654bd5bd"><enum>(1)</enum><text>the activities
carried out under the programs assisted under this section are not duplicative
of other activities conducted in eligible countries; and</text>
</paragraph><paragraph id="IDa937b53265b9466ea3d06ee607ed2d81"><enum>(2)</enum><text>any institutions
in eligible countries, with which the Center for Civic Education, the National
Council on Economic Education, or organizations described in section 2533(a)(3)
may work in conducting such activities, are credible.</text>
</paragraph></subsection><subsection id="ID97f5e78a0e804f508377298473613058"><enum>(g)</enum><header>Eligible
country defined</header><text>In this section, the term <term>eligible
country</term> means a Central European country, an Eastern European country,
Lithuania, Latvia, Estonia, the independent states of the former Soviet Union
as defined in section 3 of the FREEDOM Support Act (22 U.S.C. 5801), the
Republic of Ireland, the province of Northern Ireland in the United Kingdom,
and any developing country (as such term is defined in section 209(d) of the
Education for the Deaf Act) if the Secretary, with the concurrence of the
Secretary of State, determines that such developing country has a democratic
form of government.</text>
</subsection></section><section id="IDce588296912547519746d500d6c24777"><enum>2536.</enum><header>Authorization
of appropriations</header><text display-inline="no-display-inline">There are
authorized to be appropriated to carry out this subpart $30,000,000 for fiscal
year 2010 and such sums as may be necessary for each of the 5 succeeding fiscal
years.</text>
</section></subpart><subpart id="id1C91ECFC457F4664B27D0A45C1F4E3B1"><enum>4</enum><header>National History
Day</header>
<section id="ID6713a0b79cd844178b88a6aec0b7279c"><enum>2541.</enum><header>National
History Day programs</header>
<subsection id="ID37460b5bd49f441488d6980181832256"><enum>(a)</enum><header>In
general</header><text>The Secretary is authorized to award a grant to, or enter
into a contract with the National History Day, Inc. to carry out activities
under subsection (b) to promote the study of history and improve instruction in
history.</text>
</subsection><subsection id="ID5a6ee4213fc0405697c6917dac17715f"><enum>(b)</enum><header>Activities</header><text>In
carrying out the activities assisted under this section, the National History
Day, Inc. shall—</text>
<paragraph id="IDe86fdad68e5b4690a63e0e5166bf0e40"><enum>(1)</enum><text>develop a
framework for hands-on, student-centered learning that guides classroom
teaching as well as continuous professional development;</text>
</paragraph><paragraph id="ID75dabbf7918d4478aa9e15b46cc823e8"><enum>(2)</enum><text>enable students
to conduct extensive primary and secondary research through libraries,
archives, museums, oral history interviews, and historic sites;</text>
</paragraph><paragraph id="IDed4c9b0cef6f45ca8a6bbcbfdd64af93"><enum>(3)</enum><text>provide students
an opportunity to present their work in original papers, exhibits,
performances, and documentaries;</text>
</paragraph><paragraph id="ID7779f6b2bf8546a9b94fbd43f47040f0"><enum>(4)</enum><text>enable students,
through educational opportunities, training, and mentoring, to develop—</text>
<subparagraph id="IDd71b1676c3224661a4097a945830e2a4"><enum>(A)</enum><text>critical thinking
and problem-solving skills;</text>
</subparagraph><subparagraph id="ID57ba55c5ef7e4a9fa6f0c425a27886b3"><enum>(B)</enum><text>research and
reading skills;</text>
</subparagraph><subparagraph id="ID3fa652d7d7c24569a8147874972a44b1"><enum>(C)</enum><text>oral and written
communication and presentation skills; and</text>
</subparagraph><subparagraph id="ID47cf8d3e46404854a77007a632a0ab6d"><enum>(D)</enum><text>a sense of
responsibility for and involvement in the democratic process;</text>
</subparagraph></paragraph><paragraph id="ID506634eaacf4492299798e46e4272f02"><enum>(5)</enum><text>provide students
with the opportunity to work with and analyze historical documents and other
primary source material;</text>
</paragraph><paragraph id="IDb8adb1ae6ae24465ad832c68a3852a65"><enum>(6)</enum><text>conduct
competitions at local, State, and national levels where entries are evaluated
by professional historians and educators; and</text>
</paragraph><paragraph id="IDcbe8411618724f5aa43c191143a5ae4d"><enum>(7)</enum><text>assist teachers
and schools in meeting State educational standards.</text>
</paragraph></subsection></section><section id="IDbba98c11137d49b099092fd7691dea14"><enum>2542.</enum><header>Authorization
of appropriations</header><text display-inline="no-display-inline">There are
authorized to be appropriated to carry out this subpart such sums as may be
necessary for fiscal year 2010 and for each of the 5 succeeding fiscal
years.</text>
</section></subpart><subpart id="id131B1191D266437D93DB1CAD2EFC7307"><enum>5</enum><header>Close Up
fellowship program</header>
<section commented="no" display-inline="no-display-inline" id="ID34185EBB5F83409F9498DF497FAF1583" section-type="subsequent-section"><enum>2551.</enum><header display-inline="yes-display-inline">Close Up fellowship program</header>
<subsection commented="no" display-inline="no-display-inline" id="ID731265EFAA4C4C5CBEA94AA87608B1B0"><enum>(a)</enum><header>Program for
middle school and secondary school students</header>
<paragraph id="ID21939EB9C5F948D19C156520858712EB"><enum>(1)</enum><header>Establishment</header>
<subparagraph id="ID5FDDC00D4B4E47D0A046531CB56401E2"><enum>(A)</enum><header>General
authority</header><text>In accordance with this subsection, the Secretary may
make grants to the Close Up Foundation of Washington, District of Columbia, a
nonpartisan, nonprofit foundation, for the purpose of assisting the Close Up
Foundation in carrying out its programs of increasing civic responsibility and
understanding of the Federal Government among middle school and secondary
school students.</text>
</subparagraph><subparagraph id="ID4C67E678EDAA4CA4B3117C9DED5C1FE6"><enum>(B)</enum><header>Use of
funds</header><text>Grants under this subsection shall be used only to provide
financial assistance to economically disadvantaged students who participate in
the programs described in subparagraph (A).</text>
</subparagraph><subparagraph id="ID6E7DAD62A7B24172BAB1F9D74502B312"><enum>(C)</enum><header>Name of
fellowships</header><text>Financial assistance received by students pursuant to
this subsection shall be known as Close Up fellowships.</text>
</subparagraph></paragraph><paragraph id="IDD458E096C97243C28F04084B83B185F5"><enum>(2)</enum><header>Applications</header>
<subparagraph id="IDF585F8CA2B484813B83CBF6A974E903D"><enum>(A)</enum><header>Application
required</header><text>No grant under this subsection may be made except upon
an application at such time, in such manner, and accompanied by such
information as the Secretary may reasonably require.</text>
</subparagraph><subparagraph id="IDA111139675EA421593CF1E9BDE4EE4A7"><enum>(B)</enum><header>Contents of
application</header><text>Each application submitted under this paragraph shall
contain assurances that—</text>
<clause id="ID8B37F9843E5D48EDB3C09C72FDAA2D3B"><enum>(i)</enum><text>Close Up
fellowships provided under this subsection shall be made to economically
disadvantaged middle school and secondary school students;</text>
</clause><clause id="IDA7C5EA89BFBC4206B859B162A76FB9DF"><enum>(ii)</enum><text>every effort
shall be made to ensure the participation of students from rural, small town,
and urban areas;</text>
</clause><clause id="ID82E7E3E420C14B1AA1B01A100DF57871"><enum>(iii)</enum><text>in awarding the
fellowships to economically disadvantaged students, special consideration shall
be given to the participation of those students with special educational needs,
including students with disabilities, ethnic minority students, and students
with migrant parents; and</text>
</clause><clause id="ID95F4002898E0480CACC6D267CE7AEFBA"><enum>(iv)</enum><text>the funds
received under this subsection shall be properly disbursed.</text>
</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7846031DA5FC45258B89E8C92C8C1C90"><enum>(b)</enum><header>Program for
middle school and secondary school teachers</header>
<paragraph id="ID6D79CD7D7BA94DB68341A6D2120D605B"><enum>(1)</enum><header>Establishment</header>
<subparagraph id="ID2E27BD4051B94D94A221745DC53AD73F"><enum>(A)</enum><header>General
authority</header><text>In accordance with this subsection, the Secretary may
make grants to the Close Up Foundation of Washington, District of Columbia, a
nonpartisan, nonprofit foundation, for the purpose of assisting the Close Up
Foundation in carrying out its programs of professional development for middle
school and secondary school teachers and its programs to increase civic
responsibility and understanding of the Federal Government among the teachers'
students.</text>
</subparagraph><subparagraph id="ID876FE5A0BCAC4AE88549B77086509A3B"><enum>(B)</enum><header>Use of
funds</header><text>Grants under this subsection shall be used only to provide
financial assistance to teachers who participate in the programs described in
subparagraph (A).</text>
</subparagraph><subparagraph id="ID0F8DE884D03041C39E8FE4B2BAA47835"><enum>(C)</enum><header>Name of
fellowships</header><text>Financial assistance received by teachers pursuant to
this subsection shall be known as Close Up fellowships.</text>
</subparagraph></paragraph><paragraph id="ID490A5EDA384442B2A3E4D2FD621B61A6"><enum>(2)</enum><header>Applications</header>
<subparagraph id="ID031B317393704C80861F2190C5B25742"><enum>(A)</enum><header>Application
required</header><text>No grant under this subsection may be made except upon
an application at such time, in such manner, and accompanied by such
information as the Secretary may reasonably require.</text>
</subparagraph><subparagraph id="IDA84E6DFD363E4942898CD6FF240AB4EC"><enum>(B)</enum><header>Contents of
application</header><text>Each application submitted under this paragraph shall
contain assurances that—</text>
<clause id="ID92A81D136C9E43EE8DA6863A2301D1B3"><enum>(i)</enum><text>Close Up
fellowships provided under this subsection shall be made only to a teacher who
has worked with at least 1 student from such teacher's school who participates
in a program described in subsection (a)(1)(A);</text>
</clause><clause id="IDC21538630F4E47E29C1C96D191697798"><enum>(ii)</enum><text>no teacher shall
receive more than 1 such fellowship in any fiscal year; and</text>
</clause><clause id="ID332392AB69854FB49BDCD0C4AEC82AEB"><enum>(iii)</enum><text>the funds
received under this subsection shall be properly disbursed.</text>
</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDEEDCB23F0BF548BA9FBD2F7B4A3ED33D"><enum>(c)</enum><header>Programs for
new americans</header>
<paragraph id="ID92C362D03AEE4915B02766B0004A102E"><enum>(1)</enum><header>Establishment</header>
<subparagraph id="ID660303338D4A4AA880A3DEDC693EDB59"><enum>(A)</enum><header>General
authority</header><text>In accordance with this subsection, the Secretary may
make grants to the Close Up Foundation of Washington, District of Columbia, a
nonpartisan, nonprofit foundation, for the purpose of assisting the Close Up
Foundation in carrying out its programs of increasing civic responsibility and
understanding of the Federal Government among economically disadvantaged middle
school and secondary school recent immigrant students.</text>
</subparagraph><subparagraph id="ID0D47392D28944055B3DF85D9C9FCE423"><enum>(B)</enum><header>Definition</header><text>In
this subsection, the term <term>recent immigrant student</term> means a student
who is a member of a family that immigrated to the United States within 5 years
of the student's participation in such a program.</text>
</subparagraph><subparagraph id="ID29CC441388B84CAF8C2BD41D44F47DF7"><enum>(C)</enum><header>Use of
funds</header><text>Grants under this subsection shall be used only to provide
financial assistance to economically disadvantaged recent immigrant students
and their teachers who participate in the programs described in subparagraph
(A).</text>
</subparagraph><subparagraph id="ID1C38CC6C2E05473186D96EA368F685C1"><enum>(D)</enum><header>Name of
fellowships</header><text>Financial assistance received by students and
teachers pursuant to this subsection shall be known as Close Up Fellowships for
New Americans.</text>
</subparagraph></paragraph><paragraph id="IDC4BEA12E3D364DFD9FEE7574A58629AB"><enum>(2)</enum><header>Applications</header>
<subparagraph id="IDD003530E5DFB45A3A1D43AC2B3BBB394"><enum>(A)</enum><header>Application
required</header><text>No grant under this subsection may be made except upon
an application at such time, in such manner, and accompanied by such
information as the Secretary may reasonably require.</text>
</subparagraph><subparagraph id="IDE2331D09E21A4023BEA1A9DEF181D0DF"><enum>(B)</enum><header>Contents of
application</header><text>Each application submitted under this paragraph shall
contain assurances that—</text>
<clause id="ID0D487F9A978740CFB3966F1BE2861576"><enum>(i)</enum><text>Close Up
Fellowships for New Americans shall be made to economically disadvantaged
middle school and secondary school recent immigrant students;</text>
</clause><clause id="ID584158218DE3414FB569FE5B43E344D3"><enum>(ii)</enum><text>every effort
shall be made to ensure the participation of recent immigrant students from
rural, small town, and urban areas;</text>
</clause><clause id="ID3D33AD9C9139499CBB051872E6184DDE"><enum>(iii)</enum><text>in awarding the
fellowships to economically disadvantaged recent immigrant students, special
consideration shall be given to the participation of those students with
special educational needs, including students with disabilities, students with
migrant parents, and ethnic minority students;</text>
</clause><clause id="IDD6FE598654524625A9B3E5F339E24BAA"><enum>(iv)</enum><text>fully describe
the activities to be carried out with the proceeds of the grant made under
paragraph (1); and</text>
</clause><clause id="ID3D84D58AE63C4EBF9DFE9362576F2956"><enum>(v)</enum><text>the funds
received under this subsection shall be properly disbursed.</text>
</clause></subparagraph></paragraph></subsection><subsection id="IDD5AC046534C843FB9983921288042B6F"><enum>(d)</enum><header>Administrative
provisions</header>
<paragraph id="IDDBE88BA8C0B04C8092DEB789AA4E9F18"><enum>(1)</enum><header>Accountability</header><text>In
consultation with the Secretary, the Close Up Foundation shall devise and
implement procedures to measure the efficacy of the programs authorized in
subsections (a), (b), and (c) in attaining objectives that include the
following:</text>
<subparagraph id="ID481638F17D664D3FB3FE54C349526460"><enum>(A)</enum><text>Providing young
people with an increased understanding of the Federal Government.</text>
</subparagraph><subparagraph id="ID2CBA8624CAFB495A99E358A330B0E172"><enum>(B)</enum><text>Heightening a
sense of civic responsibility among young people.</text>
</subparagraph><subparagraph id="IDD61FE4E0A42D4E828702AA2469626DD7"><enum>(C)</enum><text>Enhancing the
skills of educators in teaching young people about civic responsibility, the
Federal Government, and attaining citizenship competencies.</text>
</subparagraph></paragraph><paragraph id="ID59FD6A97CAA24AF28C53AABCA4B9C2A2"><enum>(2)</enum><header>General
rule</header><text>Payments under this section may be made in installments, in
advance, or by way of reimbursement, with necessary adjustments on account of
underpayments or overpayments.</text>
</paragraph><paragraph id="ID15E75BF2CD8F41C0BFC3C7BEB61C43BA"><enum>(3)</enum><header>Audit
rule</header><text>The Comptroller General of the United States or any of the
Comptroller General's duly authorized representatives shall have access for the
purpose of audit and examination to any books, documents, papers, and records
that are pertinent to any grant under this section.</text>
</paragraph></subsection><subsection id="idE59550C2A7ED452782BFFBB7F88C4AFA"><enum>(e)</enum><header>Authorization
of appropriations</header><text>There are authorized to be appropriated to
carry out this section such sums as may be necessary for fiscal year 2010 and
for each of the 5 succeeding fiscal
years.</text>

</section><section id="id169C7900745C4D8AAD29FA70D80A6D40"><enum>102.</enum><header>Standards and
assessments in United States history</header>
<subsection id="id4C775BBAC8E8434E93BE3C4444FA03B1"><enum>(a)</enum><header>Challenging
academic standards</header><text display-inline="yes-display-inline">Section
1111(b)(1)(C) of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
6311(b)(1)(C)) is amended by striking <quote>and (beginning in the 2005–2006
school year) science,</quote> and inserting <quote>(beginning in the 2005–2006
school year) science, and (beginning in the 2011–2012 school year) United
States history,</quote>.</text>
</subsection><subsection id="id206635746BA64A0BA14086262FB6F99B"><enum>(b)</enum><header>Academic
assessments</header><text display-inline="yes-display-inline">Section
1111(b)(3)(A) of the Elementary and Secondary Education Act of 1965 (20 U.S.C.
6311(b)(3)(A)) is amended—</text>
<paragraph id="id5A3153F073DD45EB8E682A16B7EE690E"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>and science</quote> and
inserting <quote>science, and United States history</quote>; and</text>
</paragraph><paragraph id="idF32127A2081E4E40A20C166912FB3AA9"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting before the period at the end
the following: <quote>and no State shall be required to meet the requirements
of this part relating to United States history assessments until the beginning
of the 2012–2013 school year</quote>.</text>
</paragraph></subsection><subsection id="id308C9F342B9B42ABB3C228509ABF4600"><enum>(c)</enum><header>Assessment
requirements</header><text display-inline="yes-display-inline">Section
1111(b)(3)(C)(v) of the Elementary and Secondary Education Act of 1965 (20
U.S.C. 6311(b)(3)(C)(v)) is amended by adding at the end the following:</text>

explain how the fall of the Berlin Wall affected United States foreign policy;

</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9A4F7EF8F32B4C559A2B0AE3F587029D"><enum>(E)</enum><text display-inline="yes-display-inline">76 percent of students in grade 4 could not
explain why early American pioneers settled on the western frontier;</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id84FDBE23656449BC9AE84617B36620EF"><enum>(3)</enum><text>in the 2006
National Assessment of Educational Progress assessment in the United States
civics—</text>
<subparagraph commented="no" display-inline="no-display-inline" id="id9721F64D40024B08A7EC58ACC1FE0D57"><enum>(A)</enum><text>27 percent of
students in grade 4 scored below basic, 30 percent of students in grade 8
scored below basic, and 34 percent of students in grade 12 scored below

achievement gap exists for students in grade 4 who are from low-income

a 25 point achievement gap exists between Black and White students in grade 4,
and a 26 point achievement gap exists between White and Hispanic students in
grade 4;</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD03B9475B23E4A148F32184441202D10"><enum>(C)</enum><text display-inline="yes-display-inline">72 percent of students in grade 8 could not
explain the historical purpose of the Declaration of Independence; and</text>
</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDAB842F6E9404CCD8AF4B3920766116C"><enum>(D)</enum><text display-inline="yes-display-inline">57 percent of students in grade 12 were
unable to describe the meaning of federalism in the United States;</text>
</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id444604B441B84F7987D8505B60D30539"><enum>(4)</enum><text display-inline="yes-display-inline">America’s past encompasses great leaders
and great ideas that contribute to our shared heritage and to the principles of
freedom, equality, justice, and opportunity for all;</text>
