		</action>
		<legis-type>A BILL</legis-type>
		<official-title>To require the Secretary of Defense to establish
		  registries of members and former members of the Armed Forces exposed in the
		  line of duty to occupational and environmental health chemical hazards, to
		  amend title 38, United States Code, to provide health care to veterans exposed
		  to such hazards, and for other purposes.</official-title>

		<section id="id4A8DFBBF7AD042569E0A5D146AF8926D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Health Care for Members of the Armed
			 Forces Exposed to Chemical Hazards Act of 2009</short-title></quote>.</text>
		</section><section id="idB35125F45C58446092FDB9382EDACB15" section-type="subsequent-section"><enum>2.</enum><header>Establishment of
			 registries of members and former members of the Armed Forces exposed in line of
			 duty to occupational and environmental health chemical hazards</header>
			<subsection id="id3CEF2B5B85814D9982669D74E4BEED54"><enum>(a)</enum><header>Establishment</header><text>For
			 each occupational and environmental health chemical hazard of particular
			 concern, the Secretary of Defense shall establish and administer a registry of
			 members and former members of the Armed Forces who were exposed in the line of
			 duty to such hazard on or after September 11, 2001.</text>
			</subsection><subsection id="id3BC98C9CF5FD40B5A4A0CC4D69AEC7EC"><enum>(b)</enum><header>Registration</header><text>For
			 every member and former member of the Armed Forces who was exposed in the line
			 of duty to a hazard described in subsection (a), the Secretary shall—</text>
				<paragraph id="id261DFD30BB4B41D984765E90043D23C4"><enum>(1)</enum><text>register such
			 member or former member in such registry; and</text>
				</paragraph><paragraph id="idC082A1A1DEAE448AA14E6ACD11262153"><enum>(2)</enum><text>collect such
			 information about such member or former member as the Secretary considers
			 appropriate for purposes of establishing and administering such
			 registry.</text>
				</paragraph></subsection><subsection id="id339702BD21444FE5A158719F5B88D62B"><enum>(c)</enum><header>Notification</header><text>In
			 the case that the Secretary learns that a member or former member of the Armed
			 Forces may have been exposed in the line of duty to a hazard described in
			 subsection (a), the Secretary shall—</text>
				<paragraph id="id748EBFCD331B4DBDA73C10EC8556B70E"><enum>(1)</enum><text>notify of such
			 exposure—</text>
					<subparagraph id="id627743CDE504475A9F22A65BE8E7953A"><enum>(A)</enum><text>such member or
			 former member;</text>
					</subparagraph><subparagraph id="id6D2392AE349A40018CB882BEFB3EC79E"><enum>(B)</enum><text>the commanding
			 officer of the unit to which such member or former member belonged at the time
			 of such exposure; and</text>
					</subparagraph><subparagraph id="idC3573BE9754A4BCB8026C30DA2C0C183"><enum>(C)</enum><text>in the case of a
			 member of the National Guard, the Adjutant General of the State concerned;
			 and</text>
					</subparagraph></paragraph><paragraph id="id53BAB9C920C24CD2B1060AEAEC72ED57"><enum>(2)</enum><text>inform such
			 member or former member that such member or former member may be included in
			 the registry required by subsection (a) for such hazard.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3E158F0691304D10AE829A803115D8E6"><enum>(d)</enum><header>Examination</header><text>Not
			 later than 30 days after the date on which the Secretary becomes aware of an
			 exposure of a member or former member of the Armed Forces to a hazard described
			 in subsection (a) and annually thereafter, the Secretary shall provide such
			 member or former member—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id45B344DC4EE34C12B44AA0E52B2CD473"><enum>(1)</enum><text>a complete
			 physical and medical examination;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0D281E0A862E4AB18EA84E59DCD28854"><enum>(2)</enum><text>consultation and
			 counseling with respect to the results of such physical and examination;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF890BC1FFB324C0A9910E4E0BB40A0B6"><enum>(3)</enum><text>a copy of the
			 documentation of such exposure in the member's or former member's medical
			 record maintained by the Department of Defense.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7303567A53A54C548974781AC52EE459"><enum>(e)</enum><header>Occupational
			 and environmental health chemical hazard of particular concern
			 defined</header><text>In this section, the term <term>occupational and
			 environmental health chemical hazard of particular concern</term> means an
			 occupational and environmental health chemical hazard that the Secretary of
			 Defense determines is of particular concern after considering appropriate
			 guidelines and standards for exposure, including the following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id872523D493B14D0799C2D8FF042B326C"><enum>(1)</enum><text>The military
			 exposure guidelines specified in the January 2002 Chemical Exposure Guidelines
			 for Deployed Military Personnel, United States Army Center for Health Promotion
			 and Preventive Medicine Technical Guide 230 (or any successor technical guide
			 that establishes military exposure guidelines for the assessment of the
			 significance of field exposures to occupational and environmental health
			 chemical hazards during deployments).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id79A78B5E4E294B3C9E1A8DE2C4B18B81"><enum>(2)</enum><text>Occupational and
			 environmental health chemical exposure standards promulgated by the
			 Occupational Safety and Health Administration.</text>
				</paragraph></subsection></section><section id="id86237DBB825349C9A8CB6C80020BCADA"><enum>3.</enum><header>Scientific
			 review of association of incidents of exposure to occupational and
			 environmental health chemical hazards with health consequences</header>
			<subsection id="idD490D45EA3DE421A9A849E147D81572E"><enum>(a)</enum><header>Agreement</header>
				<paragraph id="id3F2BFA391ECA4E6194148FA3E75CB973"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Defense shall seek to enter into an
			 agreement with the Institute of Medicine of the National Academies for the
			 Institute of Medicine to perform the services covered by this section.</text>
				</paragraph><paragraph id="id551A9A7CE13B4BD3B92BF2A42D13C7A4"><enum>(2)</enum><header>Timing</header><text>The
			 Secretary shall seek to enter into the agreement described in paragraph (1) not
			 later than two months after the date of the enactment of this Act.</text>
				</paragraph></subsection><subsection id="idB16B939123D548C5956732E460A2BD7A"><enum>(b)</enum><header>Review of
			 scientific evidence</header><text>Under an agreement between the Secretary of
			 Defense and the Institute of Medicine under this section, the Institute of
			 Medicine shall, for each incident of exposure involving one or more members of
			 the Armed Forces reported in a registry established under section 2(a) to an
			 occupational and environmental health chemical hazard of particular concern,
			 review and summarize the scientific evidence, and assess the strength thereof,
			 concerning the association between the exposure to such hazard and acute and
			 long-term health consequences of such exposure.</text>
			</subsection><subsection id="id473656F5AC02441AA8E844A0CCE2483D"><enum>(c)</enum><header>Scientific
			 determinations concerning health consequences</header>
				<paragraph id="id944953CB26364846A43CAFFF394F2CEB"><enum>(1)</enum><header>In
			 general</header><text>For each incident of exposure reviewed under subsection
			 (b), the Institute of Medicine shall determine (to the extent that available
			 scientific data permit meaningful determinations)—</text>
					<subparagraph id="id2708A1EA38734E7D9B2B1F124BCE6453"><enum>(A)</enum><text>whether a
			 statistical association with the acute and long-term health consequences
			 exists, taking into account the strength of the scientific evidence and the
			 appropriateness of the statistical and epidemiological methods used to detect
			 the association; and</text>
					</subparagraph><subparagraph id="idEA89A22350584C40B49A5CF5E5489FF0"><enum>(B)</enum><text>whether there
			 exists a plausible biological mechanism or other evidence of a causal
			 relationship between the occupational and environmental health chemical hazard
			 and the health consequences.</text>
					</subparagraph></paragraph><paragraph id="id6065EEAA40F847449681E6BAA4E732EC"><enum>(2)</enum><header>Discussion and
			 reasoning</header><text>The Institute of Medicine shall include in its reports
			 under subsection (f) a full discussion of the scientific evidence and reasoning
			 that led to its conclusions under this subsection.</text>
				</paragraph></subsection><subsection id="id508D3A57CFEF49D2AFFEB7C53D6F8327"><enum>(d)</enum><header>Recommendations
			 for additional scientific studies</header>
				<paragraph id="id6D355AB5192D4515B9FDC6B68A79BB51"><enum>(1)</enum><header>In
			 general</header><text>The Institute of Medicine shall make any recommendations
			 it has for additional scientific studies to resolve areas of continuing
			 scientific uncertainty relating to exposure to occupational and environmental
			 health chemical hazards of particular concern.</text>
				</paragraph><paragraph id="id821DA7C58B1949BDB91393055D271517"><enum>(2)</enum><header>Considerations</header><text>In
			 making recommendations for further study, the Institute of Medicine shall
			 consider the following:</text>
					<subparagraph id="id17A16F121C184E7AB5B2F2F0E518B55D"><enum>(A)</enum><text>The scientific
			 information that is currently available.</text>
					</subparagraph><subparagraph id="idFD3F896AE78B46F18CBE2277AF638C16"><enum>(B)</enum><text>The value and
			 relevance of the information that could result from additional studies.</text>
					</subparagraph></paragraph></subsection><subsection id="id4AE5BE5C5016486FBAD2764550319317"><enum>(e)</enum><header>Subsequent
			 reviews</header><text>The agreement under subsection (a) shall require the
			 Institute of Medicine—</text>
				<paragraph id="id6DDF25DD775743DCAC9D4EFE037DC29B"><enum>(1)</enum><text>to conduct
			 periodically as comprehensive a review as is practicable of the evidence
			 referred to in subsection (b) that has become available since the last review
			 of such evidence under this section; and</text>
				</paragraph><paragraph id="idBEFCB6BE0C7C4E288229A92D211D2AF2"><enum>(2)</enum><text>to make its
			 determinations and estimates on the basis of the results of such review and all
			 other reviews conducted for the purposes of this section.</text>
				</paragraph></subsection><subsection id="id1DC5ECDDA61E453C9263C663E422D197"><enum>(f)</enum><header>Reports</header>
				<paragraph id="id3EC85701074C4A2CAADE14089877B397"><enum>(1)</enum><header>Reports to
			 Congress</header>
					<subparagraph id="id0435959D283F4D668EF145D932ACDDBE"><enum>(A)</enum><header>In
			 general</header><text>The agreement under subsection (a) shall require the
			 Institute of Medicine to submit, not later than the end of the 18-month period
			 beginning on the date of the enactment of this Act and not less frequently than
			 once every two years thereafter, to the appropriate committees of Congress a
			 report on the activities of the Institute of Medicine under the
			 agreement.</text>
					</subparagraph><subparagraph id="id26461582CF1642C5A5B4B5CA21553F02"><enum>(B)</enum><header>Contents</header><text>The
			 report described in subparagraph (A) shall include the following:</text>
						<clause id="id7C5498484E1247609B57A618743470EB"><enum>(i)</enum><text>The
			 determinations and discussion referred to in subsection (c).</text>
						</clause><clause id="idA6A4DDAEF84D4408AF8DBE7DD927AB62"><enum>(ii)</enum><text>Any
			 recommendations of the Institute of Medicine under subsection (d).</text>
						</clause></subparagraph></paragraph><paragraph id="idD483CDE6AF844E2C908D0EFB6798FC0C"><enum>(2)</enum><header>Reports to
			 Secretary of Defense</header><text>The agreement under subsection (a) shall
			 require the Institute of Medicine, in the case that the Institute of Medicine
			 makes any conclusive determination under subsection (c)(1) with respect to any
			 incident of exposure studied under subsection (b), to submit, not later than 30
			 days after the date of such determination, to the Secretary of Defense a report
			 describing such determination.</text>
				</paragraph></subsection><subsection id="idF51FAC516C164BF5B5636AD7EA03FF83"><enum>(g)</enum><header>Notice to
			 members and former members of the Armed Forces</header><text>The Secretary of
			 Defense shall notify members and former members of the Armed Forces listed in a
			 registry established under section 2(a) for exposure to an occupational and
			 environmental health chemical hazard of particular concern of—</text>
				<paragraph id="id38D62E579F8940DB96519AEC6D044F8F"><enum>(1)</enum><text>any conclusive
			 determinations made with respect to such exposure under subsection (c)(1);
			 and</text>
				</paragraph><paragraph id="idE07ED7334FF947F8A9293C23A028F84A"><enum>(2)</enum><text>any other
			 significant developments in research on the health consequences of exposure to
			 such hazard.</text>
				</paragraph></subsection><subsection id="idDC764833F66D4689BCA17D3068A1B973"><enum>(h)</enum><header>Limitation on
			 authority</header><text>The agreement under this section shall be effective for
			 a fiscal year to the extent that appropriations are available to carry out the
			 agreement.</text>
			</subsection><subsection id="id7C569585CB214B84A60B3632AC317909"><enum>(i)</enum><header>Sunset</header><text>This
			 section shall cease to be effective 10 years after the last day of the fiscal
			 year in which the Institute of Medicine submits to the Secretary of Defense the
			 first report under subsection (f).</text>
			</subsection><subsection id="id0AD8FFF463DC447AB887D8B46279AA48"><enum>(j)</enum><header>Alternative
			 contract scientific organization</header>
				<paragraph id="idAAB4550C65A948899EE70210B9E31BC5"><enum>(1)</enum><header>In
			 general</header><text>If the Secretary of Defense is unable within the time
			 period prescribed in subsection (a)(2) to enter into an agreement described in
			 subsection (a)(1) with the Institute of Medicine on terms acceptable to the
			 Secretary, the Secretary shall seek to enter into such an agreement with
			 another appropriate scientific organization that—</text>
					<subparagraph id="idB50E1ED6F86E49D8B71AE82A4FD9D52A"><enum>(A)</enum><text>is not part of
			 the Government;</text>
					</subparagraph><subparagraph id="id3F9C76A5FFAF46D6BF41B01126ECA21B"><enum>(B)</enum><text>operates as a
			 not-for-profit entity; and</text>
					</subparagraph><subparagraph id="id567D2B46C9A949DAA747EC3627002ED5"><enum>(C)</enum><text>has expertise and
			 objectivity comparable to that of the Institute of Medicine.</text>
					</subparagraph></paragraph><paragraph id="id091431AF2C8D435FB2077EEA8C663443"><enum>(2)</enum><header>Treatment</header><text>If
			 the Secretary enters into an agreement with another organization as described
			 in paragraph (1), any reference in this section to the Institute of Medicine
			 shall be treated as a reference to the other organization.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3550596DC3D34EAFB27882B35CDACA86"><enum>(k)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id1A2776AD92E3450E88B0F75CFFD23470"><enum>(1)</enum><header>Appropriate
			 committees of Congress</header><text display-inline="yes-display-inline">The
			 term <term>appropriate committees of Congress</term> means—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id755DFDFC41554DCCB795FCCFF7E77089"><enum>(A)</enum><text>the Committee on
			 Armed Services, the Committee on Veterans' Affairs, and the Committee on
			 Appropriations of the Senate; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id96EABC5D4DDF48BEAA5A075ED7B98A39"><enum>(B)</enum><text>the Committee on
			 Armed Services, the Committee on Veterans' Affairs, and the Committee on
			 Appropriations of the House of Representatives.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id589A18AA76D845BFBACD38897C97C856"><enum>(2)</enum><header>Occupational
			 and environmental health chemical hazard of particular
			 concern</header><text>The term <term>occupational and environmental health
			 chemical hazard of particular concern</term> means an occupational and
			 environmental health chemical hazard that the Secretary of Defense determines
			 is of particular concern after considering appropriate guidelines and standards
			 for exposure, including the following:</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id837C0D5280C4482EA4B309C02C8251A7"><enum>(A)</enum><text>The military
			 exposure guidelines specified in the January 2002 Chemical Exposure Guidelines
			 for Deployed Military Personnel, United States Army Center for Health Promotion
			 and Preventive Medicine Technical Guide 230 (or any successor technical guide
			 that establishes military exposure guidelines for the assessment of the
			 significance of field exposures to occupational and environmental health
			 chemical hazards during deployments).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id26D2C23BD1B442318662D3B984AB8191"><enum>(B)</enum><text>Occupational and
			 environmental health chemical exposure standards promulgated by the
			 Occupational Safety and Health Administration.</text>
					</subparagraph></paragraph></subsection></section><section id="idC47C6B83EF504827A9EA3616437D18D5"><enum>4.</enum><header>Revision in
			 authorities for provision of health care for certain veterans exposed to
			 occupational and environmental health chemical hazards</header>
			<subsection id="idB888E5CC1BFF486A8ED383667E7AC6FE"><enum>(a)</enum><header>Authorized
			 inpatient care</header><text>Section 1710(e) of title 38, United States Code,
			 is amended—</text>
				<paragraph id="idE1FC02DE209A4836B5DC217FB58BBC6B"><enum>(1)</enum><text>in paragraph (1),
			 by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id7379F1C90CAC486D948BEC4D645829A5" style="OLC">
						<subparagraph id="id37BFD55F5F4E4AC7934AAE84E4841FFD" indent="up2"><enum>(F)</enum><text>A veteran who was exposed in the line
				of duty to an occupational and environmental health chemical hazard of
				particular concern is eligible (subject to paragraph (2)) for hospital care,
				medical services, and nursing home care under subsection (a)(2)(F) for any
				disability, notwithstanding that there is insufficient medical evidence to
				conclude that such disability may be associated with such
				exposure.</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idE44DD5A0DC894E6C8C543DF2DCDD0C7D"><enum>(2)</enum><text>in paragraph (2),
			 by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id786A0B4A52A449B58DC91BE421D311DF" style="OLC">
						<subparagraph id="id05C29E34847A47979DA3C63A90FF8467" indent="up2"><enum>(C)</enum><text>In the case of a veteran described in
				paragraph (1)(F), hospital care, medical services, and nursing home care may
				not be provided under subsection (a)(2)(F) with respect to—</text>
							<clause id="id26C610A133BB4E94BA3E46248790B3D7"><enum>(i)</enum><text>a disability that is found, in
				accordance with guidelines issued by the Under Secretary for Health, to have
				resulted from a cause other than an exposure described in paragraph (1)(F);
				or</text>
							</clause><clause id="id90BA6CCEB00A4B59B53CDF01F35F1B3D"><enum>(ii)</enum><text>a health effect for which the
				National Academy of Sciences, in a report issued in accordance with section 3
				of the <short-title>Health Care for Members of the Armed
				Forces Exposed to Chemical Hazards Act of 2009</short-title>, has determined
				that there is limited or suggestive evidence of the lack of a positive
				association between occurrence of the health consequences in humans and
				exposure to an occupational and environmental health chemical hazard of
				particular concern.</text>
							</clause></subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idC8D24BD61FB144AE8BDC65F9299389C1"><enum>(3)</enum><text>in paragraph (4),
			 by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idBDDD3EDC4288453DB556F8C689165C11" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="idAAFDDC31210540A4946B53A03B69BD49" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">The term <term>occupational and
				environmental health chemical hazard of particular concern</term> means an
				occupational and environmental health chemical hazard that the Secretary of
				Defense determines is of particular concern after considering appropriate
				guidelines and standards for exposure, including the following:</text>
							<clause commented="no" display-inline="no-display-inline" id="id5615CB39E26148B3B9895B31E75FE275"><enum>(i)</enum><text display-inline="yes-display-inline">The military exposure guidelines specified
				in the January 2002 Chemical Exposure Guidelines for Deployed Military
				Personnel, United States Army Center for Health Promotion and Preventive
				Medicine Technical Guide 230 (or any successor technical guide that establishes
				military exposure guidelines for the assessment of the significance of field
				exposures to occupational and environmental health chemical hazards during
				deployments).</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id689589E1D2054673BBE4BCA9E2C84CB1"><enum>(ii)</enum><text display-inline="yes-display-inline">Occupational and environmental health
				chemical exposure standards promulgated by the Occupational Safety and Health
				Administration.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id5AB266E0A08C4778B7531025B4B46E27"><enum>(b)</enum><header>Technical
			 amendment</header><text>Section 1710(e)(4) of such title is amended in the
			 matter before subparagraph (A) by striking <quote>For purposes of this
			 subsection—</quote> and inserting <quote>In this subsection:</quote>.</text>
