		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Dry-Redwater Regional Water
			 Authority System Act of 2009</short-title></quote>.</text>
		</section><section id="ID4d6e4d0a577b40e0b785eda9d8426b9c"><enum>2.</enum><header>Findings;
			 purpose</header>
			<subsection id="ID289b5931ba9d4d6a8fd4ec1d59384104"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="ID08f8d54b00c84bd5b36d8133d8962b74"><enum>(1)</enum><text>there are
			 insufficient available supplies of safe water to meet the minimum health and
			 safety standards of the citizens of—</text>
					<subparagraph id="id1714971B563B4E21B6CBA1425D6D8AC6"><enum>(A)</enum><text>Dawson, Garfield,
			 McCone, Prairie, and Richland Counties of the State; and</text>
					</subparagraph><subparagraph id="id5754DB562C13489C86516A0261EF87FA"><enum>(B)</enum><text>McKenzie County,
			 North Dakota;</text>
					</subparagraph></paragraph><paragraph id="ID566d964b57884537aee050c961313a86"><enum>(2)</enum><text>McCone and
			 Garfield Counties of the State were—</text>
					<subparagraph id="id06429EED6CEF4E399CAB2892C46A9C91"><enum>(A)</enum><text>directly and
			 physically impacted when the Fort Peck Dam was constructed; and</text>
					</subparagraph><subparagraph id="idBB2642D2C5F04FBA934DFD457154AB8A"><enum>(B)</enum><text>to receive
			 certain impact benefits as a result of the Pick-Sloan program; and</text>
					</subparagraph></paragraph><paragraph id="id1FF65BB1896344EC8ED6F1CA58B6F56A"><enum>(3)</enum><text>the water that is
			 contained in the Fort Peck Dam reservoir is managed for purposes relating
			 to—</text>
					<subparagraph id="id859AEDBB9922424384D6B9A0A717AC84"><enum>(A)</enum><text>flood
			 control;</text>
					</subparagraph><subparagraph id="id73EE996E73324169B2BFC7580DC656B5"><enum>(B)</enum><text>the production of
			 hydroelectric power;</text>
					</subparagraph><subparagraph id="idCD96F39158D44A1892C0880EC6E659E3"><enum>(C)</enum><text>irrigation;</text>
					</subparagraph><subparagraph id="id9DB672361D3B444E94CE43915469F9F0"><enum>(D)</enum><text>the maintenance
			 of a public water supply;</text>
					</subparagraph><subparagraph id="idB5C8472632CB478CAEFC5FDCD57365AA"><enum>(E)</enum><text>the conservation
			 of fish and wildlife;</text>
					</subparagraph><subparagraph id="id23BC9856DCAD426EA5EF6FCB08E18D4A"><enum>(F)</enum><text>recreation;
			 and</text>
					</subparagraph><subparagraph id="id1AC47881EEBF4467B16B476C168302AB"><enum>(G)</enum><text>the improvement
			 of water quality.</text>
					</subparagraph></paragraph></subsection><subsection id="ID0ba58aa65cbc4a31997c49ffd3129315"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of this Act is to ensure a safe and adequate municipal, rural, and
			 industrial water supply for the citizens of—</text>
				<paragraph id="idB0B03C55A3D84EB2B4FA3ED6D7818651"><enum>(1)</enum><text>Dawson, Garfield,
			 McCone, Prairie, and Richland Counties of the State; and</text>
				</paragraph><paragraph id="idF2F30490BED84E7482731770A26918D5"><enum>(2)</enum><text>McKenzie County,
			 North Dakota.</text>
				</paragraph></subsection></section><section id="ID4110673e6b0f4c91a4518435c667e138"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID91f862fd980043a8aaa88988ff2f0f82"><enum>(1)</enum><header>Administrator</header><text>The
			 term <term>Administrator</term> means the Administrator of the Western Area
			 Power Administration.</text>
			</paragraph><paragraph id="id95FE0F5137CF4E13BC720D3463EED789"><enum>(2)</enum><header>Authority</header><text>The
			 term <term>Authority</term> means—</text>
				<subparagraph id="id0CAF7E6135584296A9F35044662E6779"><enum>(A)</enum><text>the Dry-Redwater
			 Regional Water Authority, which is a publicly owned nonprofit water authority
			 formed in accordance with Mont. Code Ann. § 75–6–302 (2007); and</text>
				</subparagraph><subparagraph id="id68E4C1E34A834623891E6A372B221998"><enum>(B)</enum><text>any nonprofit
			 successor entity.</text>
				</subparagraph></paragraph><paragraph id="idA7CB9370FF1F4E92B66332F810B1E2A1"><enum>(3)</enum><header>Firm power
			 rate</header><text>The term <term>firm power rate</term> means the rate charged
			 by the Administrator for the Pick-Sloan Missouri Basin Program—Eastern
			 Division.</text>
			</paragraph><paragraph id="ID47fd058a8ccb4749acf0176e65e59170"><enum>(4)</enum><header>Pick-Sloan
			 program</header><text>The term <term>Pick-Sloan program</term> means the
			 Pick-Sloan Missouri River Basin Program (authorized by section 9 of the Act of
			 December 22, 1944 (commonly known as the <quote>Flood Control Act of
			 1944</quote>) (58 Stat. 891, chapter 665)).</text>
			</paragraph><paragraph id="ID4d221c574cd040baaa7fa293172d019b"><enum>(5)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="id126775BE7CC74A43868D2F99882CC071"><enum>(6)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Montana.</text>
			</paragraph><paragraph id="idF5B6D9FE9705435889319FA0FB348126"><enum>(7)</enum><header>Water
			 System</header><text>The term <term>Water System</term> means the Dry-Redwater
			 Regional Water Authority System authorized under section 4 for—</text>
				<subparagraph id="id15AAB7CEF9E8411C9B571B7214CFA5AC"><enum>(A)</enum><text>Dawson, Garfield,
			 McCone, Prairie, and Richland Counties of the State; and</text>
				</subparagraph><subparagraph id="idDC3F23C7965F4AFAA1D96B65DF6182AB"><enum>(B)</enum><text>McKenzie County,
			 North Dakota.</text>
				</subparagraph></paragraph></section><section id="IDf7028b199df947ec90edf238916c3656"><enum>4.</enum><header>Dry-Redwater
			 Regional Water Authority System</header>
			<subsection id="ID88571e1948ae40c99bc68531d92789fa"><enum>(a)</enum><header>Cooperative
			 agreement</header>
				<paragraph id="IDfa0ae669f4534785935f013c487bbf2c"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall enter into a cooperative agreement
			 with the Authority to provide Federal assistance for the planning, design, and
			 construction of the Water System.</text>
				</paragraph><paragraph id="IDcd3e396b8ca1429c9d629df0b2898bae"><enum>(2)</enum><header>Requirements</header><text>A
			 cooperative agreement entered into under paragraph (1) shall specify, in a
			 manner that is acceptable to the Secretary and the Authority—</text>
					<subparagraph id="ID630afe347a11466ba6fc523e40cecaa0"><enum>(A)</enum><text>the
			 responsibilities of each party to the cooperative agreement relating to the
			 Water System, including—</text>
						<clause id="ID63cca3341f974763b1e156a0a912b5be"><enum>(i)</enum><text>the
			 final engineering report;</text>
						</clause><clause id="id0D81DD0FC48A4FADAF5CFE9D0197B1EA"><enum>(ii)</enum><text>an
			 environmental and cultural resource study;</text>
						</clause><clause id="IDa9f8de9284cd4c57bfce870124a94748"><enum>(iii)</enum><text>engineering and
			 design;</text>
						</clause><clause id="IDf7c1256cbc7f4af2b4c15f6e66baef32"><enum>(iv)</enum><text>construction;</text>
						</clause><clause id="ID5934db5198bc4cc69d8fd625f09650a5"><enum>(v)</enum><text>water
			 conservation measures; and</text>
						</clause><clause id="IDe800cee3f9e5433a9d1ca33efd2a513c"><enum>(vi)</enum><text>administration
			 of contracts relating to the performance of the activities described in clauses
			 (i) through (v);</text>
						</clause></subparagraph><subparagraph id="IDcc2b0de8e0374dd5a21e052995e83dbe"><enum>(B)</enum><text>any procedure or
			 requirement relating to—</text>
						<clause id="id78656D5036C84F1882EC4DA96D9EC139"><enum>(i)</enum><text>the
			 carrying out of each activity described in subparagraph (A); and</text>
						</clause><clause id="id84BA83463C0343678CBB41F0D955ED00"><enum>(ii)</enum><text>the approval and
			 acceptance of the design and construction of the Water System; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID41b7b79d29e842ef9bbe9305f4896eea"><enum>(C)</enum><text>the rights,
			 responsibilities, and liabilities of each party to the cooperative
			 agreement.</text>
					</subparagraph></paragraph></subsection><subsection id="IDf38337475e3f4f85898d90676cd98754"><enum>(b)</enum><header>Use of Federal
			 funds</header>
				<paragraph id="ID9934954a1b9b49268043f5994096ea80"><enum>(1)</enum><header>Federal
			 share</header>
					<subparagraph id="idD30DF6BB5CFC4D6BB6BDB8F32C5A48DB"><enum>(A)</enum><header>In
			 general</header><text>The Federal share of the costs relating to the planning,
			 design, and construction of the Water System shall not exceed 75 percent of the
			 total cost of the Water System.</text>
					</subparagraph><subparagraph id="idD914C48F2389419CB338369039E47766"><enum>(B)</enum><header>Limitation</header><text>Amounts
			 made available under subparagraph (A) shall not be returnable or reimbursable
			 under the reclamation laws.</text>
					</subparagraph></paragraph><paragraph id="IDc1697274a4374ff1ba00c5e2aa670986"><enum>(2)</enum><header>Compliance with
			 cooperative agreement</header><text>Federal funds made available to carry out
			 this section shall be obligated and expended in accordance with a cooperative
			 agreement entered into by the Secretary under subsection (a)(1).</text>
				</paragraph></subsection><subsection id="ID6d89b5f0cf664a938f7147bd4b198e03"><enum>(c)</enum><header>Components</header><text>Components
			 of the Water System facilities for which Federal funds may be obligated and
			 expended under this section shall include—</text>
				<paragraph id="IDc125f439c85b486eb57e083b4f9f8b83"><enum>(1)</enum><text>facilities
			 relating to—</text>
					<subparagraph id="id2E06A220290244A2BCA903829A28B5F7"><enum>(A)</enum><text>water
			 intake;</text>
					</subparagraph><subparagraph id="idDE209D393CC0434D9EE8091550D601EF"><enum>(B)</enum><text>water
			 pumping;</text>
					</subparagraph><subparagraph id="id943672777E304B8BA7AF590FF24E3555"><enum>(C)</enum><text>water treatment;
			 and</text>
					</subparagraph><subparagraph id="id62EB9E4BF679496DB0822D77325419A5"><enum>(D)</enum><text>water
			 storage;</text>
					</subparagraph></paragraph><paragraph id="ID45ba7cf0149b47c29724b1365eea5f80"><enum>(2)</enum><text>transmission
			 pipelines and pumping stations;</text>
				</paragraph><paragraph id="ID09ae8abbf36f4a3e9dc24e3e3010a3c2"><enum>(3)</enum><text>appurtenant
			 buildings, maintenance equipment, and access roads;</text>
				</paragraph><paragraph id="ID49c63c2a6e964a4f90d4c2756956d7f0"><enum>(4)</enum><text>any
			 interconnection facility that connects a pipeline of the Water System to a
			 pipeline of a public water system;</text>
				</paragraph><paragraph id="ID436e157ec9644bf197319d1aba2d1e4a"><enum>(5)</enum><text>distribution,
			 pumping, and storage facilities that—</text>
					<subparagraph id="idB597F5D54FA7406C9852EF35157ECEDA"><enum>(A)</enum><text>serve the needs
			 of citizens who use public water systems;</text>
					</subparagraph><subparagraph id="id74BB95276BE9482EB2511C7AC715BC1F"><enum>(B)</enum><text>are in existence
			 on the date of enactment of this Act; and</text>
					</subparagraph><subparagraph id="idF7BA7C81023644D0B1C98EF7BE946D45"><enum>(C)</enum><text>may be purchased,
			 improved, and repaired in accordance with a cooperative agreement entered into
			 by the Secretary under subsection (a)(1);</text>
					</subparagraph></paragraph><paragraph id="ID8d01dab99ee64e138ca5f3f5d5f99a4e"><enum>(6)</enum><text>electrical power
			 transmission and distribution facilities required for the operation and
			 maintenance of the Water System;</text>
				</paragraph><paragraph id="IDc6424e9d5e5f413f9c2e02c599997dc9"><enum>(7)</enum><text>any other
			 facility or service required for the development of a rural water distribution
			 system, as determined by the Secretary; and</text>
				</paragraph><paragraph id="ID9824bd73d61347269776d36264a4e788"><enum>(8)</enum><text>any property or
			 property right required for the construction or operation of a facility
			 described in this subsection.</text>
				</paragraph></subsection><subsection id="IDa091a41ec355495fa161668c0c92c425"><enum>(d)</enum><header>Service
			 area</header><text>The service area of the Water System shall be—</text>
				<paragraph id="idC68E474CBA1C4145A5043A6A8BD03825"><enum>(1)</enum><text>the area of
			 Garfield and McCone Counties in the State;</text>
				</paragraph><paragraph id="idB829D40152E44E33AC31FB61FD3BF3F1"><enum>(2)</enum><text>the area west of
			 the Yellowstone River in Dawson and Richland Counties in the State;</text>
				</paragraph><paragraph id="id88A85AE6E8A64A4A8F6E5E163B5CE2FF"><enum>(3)</enum><text>the area
			 including, and north of, Township 15N in Prairie County in the State;
			 and</text>
				</paragraph><paragraph id="idE6E9A5D7F7114ACBB243F2D177C94036"><enum>(4)</enum><text>the portion of
			 McKenzie County, North Dakota, that includes all land that is located west of
			 the Yellowstone River in the State of North Dakota.</text>
				</paragraph></subsection><subsection id="IDe690015ea80c4d6c8687aac385c661cd"><enum>(e)</enum><header>Limitation on
			 availability of construction funds</header><text>The Secretary shall not
			 obligate funds for construction of the Water System until the date—</text>
				<paragraph id="IDe5a3f54ca87b41f6a6210450adf5c5c3"><enum>(1)</enum><text>on which the
			 Water System complies with each requirement under the
			 <act-name parsable-cite="NEPA69">National Environmental Policy Act of
			 1969</act-name> (42 U.S.C. 4321 et seq.);</text>
				</paragraph><paragraph id="ID19253f6318d44035930ef14f96c6f1a9"><enum>(2)</enum><text>that is 90 days
			 after the date of receipt by Congress of the final engineering report described
			 in subsection (a)(2)(A)(i) that is approved by the Secretary; and</text>
				</paragraph><paragraph id="ID3af58727bb3a4ba8a0a64b1469abb069"><enum>(3)</enum><text>on which the
			 Secretary publishes a written finding that the water conservation plan
			 developed pursuant to section 6 contains water conservation measures for the
			 operation of the Water System that are—</text>
					<subparagraph id="id2F8375AA37294CD88711D96E517DD6CD"><enum>(A)</enum><text>prudent;</text>
					</subparagraph><subparagraph id="id7115DDDBCF034FFEBE7A66C017464925"><enum>(B)</enum><text>reasonable;
			 and</text>
					</subparagraph><subparagraph id="id6069CC5FF4CB428C821B29397C2091D5"><enum>(C)</enum><text>economically and
			 financially feasible.</text>
					</subparagraph></paragraph></subsection><subsection id="ID6ea3fcc3561d4e22b6d33ee9719171b6"><enum>(f)</enum><header>Limitation on
			 use of Federal funds</header>
				<paragraph id="IDffec52e3673549c2bd7b4c7a89602c26"><enum>(1)</enum><header>In
			 general</header><text>Any cost relating to the operation, maintenance, or
			 replacement of the Water System—</text>
					<subparagraph id="id21CFBA784B514C9B8A41345BC6DB29CC"><enum>(A)</enum><text>shall not be a
			 Federal responsibility; and</text>
					</subparagraph><subparagraph id="idC0E848992DE54D85990068B087446009"><enum>(B)</enum><text>shall be paid by
			 the Water System.</text>
					</subparagraph></paragraph><paragraph id="ID1748c90bb3654afd9de7f76676780caa"><enum>(2)</enum><header>Federal
			 funds</header><text>The Secretary shall not obligate or expend Federal funds
			 for the operation, maintenance, or replacement of the Water System.</text>
				</paragraph></subsection><subsection id="IDee893c67d5134fffab4a0c7ac962e8f9"><enum>(g)</enum><header>Title to the
			 Water System</header><text>Title to the Water System shall be held by the
			 Authority.</text>
			</subsection></section><section id="IDb54a39083bb542a2b19a63c63149fe0e"><enum>5.</enum><header>Use of power
			 from Pick-Sloan program</header>
			<subsection id="IDc5aad2ca1bf346ff9f4aaa0ea2604a41"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that McCone and Garfield Counties in the State were designated—</text>
				<paragraph id="id8BF198A9073A4E62A9551C5E189310B2"><enum>(1)</enum><text>as impact
			 counties during the period in which the Fort Peck Dam was constructed;
			 and</text>
				</paragraph><paragraph id="id2EB328E1068D4FAEAB7846739E4EFEF5"><enum>(2)</enum><text>to receive impact
			 mitigation benefits in accordance with the Pick-Sloan program.</text>
				</paragraph></subsection><subsection id="idF4FEE9547B734CA3A49E482EA01ECE70"><enum>(b)</enum><header>Availability of
			 power</header>
				<paragraph id="id489F64EC344D489F9D184D842B90F8F7"><enum>(1)</enum><header>In
			 general</header><text>Subject to paragraph (2), the Administrator shall make
			 available to the Water System a quantity of power required to meet the pumping
			 and incidental operation requirements of the Water System—</text>
					<subparagraph id="idCD442D15273C40A185BA2DD3DB1D8475"><enum>(A)</enum><text>from the water
			 intake facilities; and</text>
					</subparagraph><subparagraph id="id34E57D1ECFD2448EB8E511074C20D7C8"><enum>(B)</enum><text>through—</text>
						<clause id="id1962897F517F42FCA11FD5A33E71A69B"><enum>(i)</enum><text>the
			 water treatment facilities; and</text>
						</clause><clause id="idD1FE4A1317B24CA292B08012DEA4FD1E"><enum>(ii)</enum><text>all first water
			 distribution pumping facilities.</text>
						</clause></subparagraph></paragraph><paragraph id="id326A59E9C4B247F09B1CD37760E5A923"><enum>(2)</enum><header>Eligibility</header><text>The
			 Water System shall be eligible to receive power under paragraph (1) if the
			 Water System—</text>
					<subparagraph id="idBC12709FC7154F2399972B780E4A1B79"><enum>(A)</enum><text>operates on a
			 not-for-profit basis; and</text>
					</subparagraph><subparagraph id="idE1E56088B0B04E2ABDD851A6EDF67EFB"><enum>(B)</enum><text>is constructed
			 pursuant to a cooperative agreement entered into by the Secretary under section
			 4(a)(1).</text>
					</subparagraph></paragraph><paragraph id="id897E4166DB1146E6B82A0A929EDDE4B2"><enum>(3)</enum><header>Rate</header><text>The
			 Administrator shall establish the cost of the power described in paragraph (1)
			 at the firm power rate.</text>
				</paragraph><paragraph id="ID15842016c3c24971980da0e78a1c6daa"><enum>(4)</enum><header>Recovery of
			 expenses</header><text>The Administrator shall recover the costs associated
			 with the quantity of power used by the Authority under paragraph (1).</text>
				</paragraph><paragraph id="id81A4CA14911F40A08B5A1DC843519166"><enum>(5)</enum><header>Responsibility
			 for expenses</header><text>The Authority shall be responsible for the payment
			 of the costs described in paragraph (4).</text>
				</paragraph></subsection></section><section id="ID362779088a5c450abd39685738d6578c"><enum>6.</enum><header>Water
			 conservation plan</header>
			<subsection id="ID4c37c91cc7bb40bd8ab24c2bf075971c"><enum>(a)</enum><header>In
			 general</header><text>The Authority shall develop a water conservation plan
			 containing—</text>
				<paragraph id="ID6712bdbed3d14c32aadbe0f452743143"><enum>(1)</enum><text>a description of
			 water conservation objectives;</text>
				</paragraph><paragraph id="IDac8b6b2b900e46baa88037c391e960b2"><enum>(2)</enum><text>a description of
			 appropriate water conservation measures; and</text>
				</paragraph><paragraph id="ID09cf95557bdc4a80b0bbe28044927f1a"><enum>(3)</enum><text>a time schedule
			 for carrying out the measures described in paragraph (2) and this Act to meet
			 the water conservation objectives described in paragraph (1).</text>
				</paragraph></subsection><subsection id="ID41f36ac070ed463e9b383508a166ce2b"><enum>(b)</enum><header>Design
			 requirement</header><text>The water conservation plan developed under
			 subsection (a) shall be designed to ensure that users of water provided by the
			 Water System will use the best practical technology and management techniques
			 to conserve water.</text>
			</subsection><subsection id="IDf3366f9730014d958bfde201c3b9b5e5"><enum>(c)</enum><header>Public
			 participation</header><text>Section 210(c) of the Reclamation Reform Act of
			 1982 (43 U.S.C. 390jj(c)) shall apply to each activity carried out under this
			 Act.</text>
			</subsection></section><section id="ID1f3c9d00a3684bdd9696d654f53a067e"><enum>7.</enum><header>Authorization of
			 appropriations</header>
			<subsection id="ID0329f98fd2334399a3efc9c41f244e36"><enum>(a)</enum><header>Water
			 System</header><text>There is authorized to be appropriated to carry out the
			 planning, design, and construction of the Water System $115,116,000 for the
			 period of fiscal years 2010 through 2020.</text>
			</subsection><subsection id="ID7045b8317c954d0dac7521afc2a8e116"><enum>(b)</enum><header>Cost
			 indexing</header><text>The amount authorized to be appropriated under
			 subsection (a) may be increased or decreased in accordance with ordinary
			 fluctuations in development costs incurred after January 1, 2008, as indicated
			 by any available engineering cost indices applicable to construction activities
			 that are similar to the construction of the Water System.</text>
			</subsection></section></legis-body>
