			 <quote><short-title>Part-Time Reemployment of Annuitants
			 Act of 2009</short-title></quote>.</text>

			 reemployment</header>
			<subsection id="ID30eee1edbfc140979a6eb3d233d9b634"><enum>(a)</enum><header>Civil service
			 retirement system</header><text>Section 8344 of title 5, United States Code, is
			 amended—</text>
				<paragraph id="ID84b02a5fae764cde97ef46664445aeb6"><enum>(1)</enum><text>by redesignating
			 subsection (l) as subsection (m);</text>
				</paragraph><paragraph id="IDd415cdc59e83402a98857503c4057b48"><enum>(2)</enum><text>by inserting after
			 subsection (k) the following:</text>

						<subsection id="IDe007ca9f70ef4142adc52ed14fc6c2e9"><enum>(l)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id1FF0FDFC874C490FBB88767FA19D4BAC"><enum>(1)</enum><text>For purposes of this
				subsection—</text>
								<subparagraph changed="deleted" committee-id="SSGA00" id="idBDD7B2CE389C46C3A9DE2FC0E968A673" indent="up1" reported-display-style="strikethrough"><enum>(A)</enum><text>the term
				<term>head of an agency</term> means—</text>
									<clause id="id7354C30C9DB9413D978BC047526A3801"><enum>(i)</enum><text>the head of an
				Executive agency;</text>
									</clause><clause id="idD2BB8D6DC77046EAA0BCAEC8D6604589"><enum>(ii)</enum><text>the head of the
				United States Postal Service;</text>
									</clause><clause id="id14D012EF5AEB47DFA5A0AC9495C6127C"><enum>(iii)</enum><text>the Director of
				the Administrative Office of the United States Courts, with respect to
				employees of the judicial branch; and</text>
									</clause><clause id="idD3ACF18F9BAD42C3BD69A30D8F6C773C"><enum>(iv)</enum><text>any employing
				authority described under subsection (k)(2); and</text>
									</clause></subparagraph><subparagraph changed="deleted" committee-id="SSGA00" id="id34FF890021EC4FC6B5BA0C8FBFA99E6F" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text>the term
				<term>limited time appointee</term> means an annuitant appointed under a
				temporary appointment limited to 1 year or less.</text>
								</subparagraph></paragraph><paragraph changed="deleted" committee-id="SSGA00" id="id4A0D077B714944F4A568766F9F2F7E0D" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><text>The head of an
				agency may waive the application of subsection (a) or (b) with respect to any
				annuitant who is employed in such agency as a limited time appointee.</text>
							</paragraph><paragraph changed="deleted" committee-id="SSGA00" id="idAA14984772CE4BE988C8C1216855A416" indent="up1" reported-display-style="strikethrough"><enum>(3)</enum><text>The head of an
				agency may not waive the application of subsection (a) or (b) with respect to
				an annuitant—</text>
								<subparagraph id="id7A785E29DD5D4D4B8B996470091617FA"><enum>(A)</enum><text>for more than 520
				hours of service performed by that annuitant during the period ending 6 months
				following the individual’s annuity commencing date;</text>
								</subparagraph><subparagraph id="id5628E2E555BE4CF9A17BE8681132B4D6"><enum>(B)</enum><text>for more than 1040
				hours of service performed by that annuitant during any 12-month period;
				or</text>
								</subparagraph><subparagraph id="id97B4357144084F00AFF9FDCA72E1E5D5"><enum>(C)</enum><text>for more than a
				total of 3120 hours of service performed by that annuitant.</text>
								</subparagraph></paragraph><paragraph changed="deleted" committee-id="SSGA00" id="id3EFC75863B5F45419D1886872CEACB10" indent="up1" reported-display-style="strikethrough"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id8B8398333A394A95982A088F2AB48C36"><enum>(A)</enum><text>The total number of
				annuitants to whom a waiver by the head of an agency under this subsection or
				section 8468(i) applies may not exceed 2.5 percent of the total number of
				full-time employees of that agency.</text>
								</subparagraph><subparagraph changed="deleted" committee-id="SSGA00" id="id0F20C9EE68954D4F983347EFADD9F30C" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text>If the total
				number of annuitants to whom a waiver by the head of an agency under this
				subsection or section 8468(i) applies exceeds 1 percent of the total number of
				full-time employees of that agency, the head of that agency shall submit a
				report with an explanation that justifies the need for the waivers in excess of
				that percentage to the Committee on Homeland Security and Governmental Affairs
				of the Senate, the Committee on Oversight and Government Reform of the House of
				Representatives, and the Office of Personnel Management.</text>
								</subparagraph></paragraph><paragraph changed="deleted" committee-id="SSGA00" id="id706BB058581547708C930208D9882618" indent="up1" reported-display-style="strikethrough"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idC50EC78C8DA94AB5B4F8B5AF268D167F"><enum>(A)</enum><text>The Director of the
				Office of Personnel Management may promulgate regulations providing for the
				administration of this subsection.</text>
								</subparagraph><subparagraph changed="deleted" committee-id="SSGA00" id="id6C63734B09D4422D86F85E1135908E50" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text>Any regulations
				promulgated under subparagraph (A) may—</text>
									<clause id="id3C934CA36F1D4DABBC1DBB9090871F4D" indent="down1"><enum>(i)</enum><text>provide standards
				for the maintenance and form of necessary records of employment under this
				subsection;</text>
									</clause><clause id="idFB403B05147A45F794ED8D130BBD361B" indent="down1"><enum>(ii)</enum><text>to the extent not
				otherwise expressly prohibited by law, require employing agencies to provide
				records of such employment to the Office of Personnel Management or other
				employing agencies as necessary to ensure compliance with paragraph (3);</text>
									</clause><clause id="idE5F11404FEC4449782B77E89B3E1E231" indent="down1"><enum>(iii)</enum><text>authorize other
				administratively convenient periods substantially equivalent to 12 months, such
				as 26 pay periods, to be used in determining compliance with paragraph (3)(B);
				and</text>
									</clause><clause id="idF7874966B5E74FC9AA381661C9350C48" indent="down1"><enum>(iv)</enum><text>include such
				other administrative requirements as the Director of the Office of Personnel
				Management may find appropriate to provide for the effective operation of, or
				to ensure compliance with, this subsection.</text>
									</clause></subparagraph></paragraph><paragraph changed="deleted" commented="no" committee-id="SSGA00" display-inline="no-display-inline" id="id54BF5776DD684BCE8A0C474A1B5E989D" indent="up1" reported-display-style="strikethrough"><enum>(6)</enum><text display-inline="yes-display-inline">The authority of the head of an agency
				under this subsection to waive the application of subsection (a) or (b) shall
				terminate 5 years after the date of enactment of the
				<short-title>Part-Time Reemployment of Annuitants Act of
				2009</short-title>.</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="IDb778f274a9534ec0b51614d2139a919a"><enum>(3)</enum><text>in subsection (m)
			 (as so redesignated)—</text>
					<subparagraph id="IDc114859cce83440cb5c30f1a1e7ed6e7"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>(k)</quote> and inserting <quote>(l)</quote>; and</text>
					</subparagraph><subparagraph id="IDdad2e331f1b044809b97c5222ac0a9e5"><enum>(B)</enum><text>in paragraph (2),
			 by striking <quote>or (k)</quote> and inserting <quote>(k), or
			 (l)</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="IDa93a863aa5c1439e8c22775ae9fab187"><enum>(b)</enum><header>Federal employee
			 retirement system</header><text>Section 8468 of title 5, United States Code, is
			 amended—</text>
				<paragraph id="ID23a23fc5ecba4663ba4f46c0ce247756"><enum>(1)</enum><text>by redesignating
			 subsection (i) as subsection (j);</text>
				</paragraph><paragraph id="ID4ac0300eb9a447258e8f0aae5864792d"><enum>(2)</enum><text>by inserting after
			 subsection (h) the following:</text>
					<quoted-block changed="deleted" committee-id="SSGA00" display-inline="no-display-inline" id="idA7DFC9CC291641C395F5D15C4ABE34CE" reported-display-style="strikethrough" style="OLC">
						<subsection id="ID98e176a579214c9a8f5686af5bfeaf10"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id153CDC4180AD4741B9753A2187B0C1A4"><enum>(1)</enum><text>For purposes of this
				subsection—</text>
								<subparagraph changed="deleted" committee-id="SSGA00" id="id9365F237AB7F4916B9B7C377DA6B84B2" indent="up1" reported-display-style="strikethrough"><enum>(A)</enum><text>the term
				<term>head of an agency</term> means—</text>
									<clause id="id8F0CC41E66BB47F4A1B2D8E578278C25"><enum>(i)</enum><text>the head of an
				Executive agency;</text>
									</clause><clause id="id877FC725C1BA4D97B686D272033E0261"><enum>(ii)</enum><text>the head of the
				United States Postal Service;</text>
									</clause><clause id="idDEEE2E148C7949338012120C64EABFB8"><enum>(iii)</enum><text>the Director of
				the Administrative Office of the United States Courts, with respect to
				employees of the judicial branch; and</text>
									</clause><clause id="id991B0EE591294DE6ACBF510C4E922FE6"><enum>(iv)</enum><text>any employing
				authority described under subsection (h)(2); and</text>
									</clause></subparagraph><subparagraph changed="deleted" committee-id="SSGA00" id="idA71513F92A7842F0A30F0EE362DF6453" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text>the term
				<term>limited time appointee</term> means an annuitant appointed under a
				temporary appointment limited to 1 year or less.</text>
								</subparagraph></paragraph><paragraph changed="deleted" committee-id="SSGA00" id="idC73D9F9461D047E5ACDC96652E3C72D9" indent="up1" reported-display-style="strikethrough"><enum>(2)</enum><text>The head of an
				agency may waive the application of subsection (a) with respect to any
				annuitant who is employed in such agency as a limited time appointee.</text>
							</paragraph><paragraph changed="deleted" committee-id="SSGA00" id="idD3310EE503154C06AEEE96E92DD45632" indent="up1" reported-display-style="strikethrough"><enum>(3)</enum><text>The head of an
				agency may not waive the application of subsection (a) with respect to an
				annuitant—</text>
								<subparagraph id="idA5DD7AEB096648B38664FD49369D6A10"><enum>(A)</enum><text>for more than 520
				hours of service performed by that annuitant during the period ending 6 months
				following the individual’s annuity commencing date;</text>
								</subparagraph><subparagraph id="id1B72E93960044B869FF9C40F4C0A3CF2"><enum>(B)</enum><text>for more than 1040
				hours of service performed by that annuitant during any 12-month period;
				or</text>
								</subparagraph><subparagraph id="idEA91BA8FCD1F49A8BDF51D41C6A99754"><enum>(C)</enum><text>for more than a
				total of 3120 hours of service performed by that annuitant.</text>
								</subparagraph></paragraph><paragraph changed="deleted" committee-id="SSGA00" id="idE16B5A1D2CFE4D54A14C81104495984D" indent="up1" reported-display-style="strikethrough"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idD83CA24217BE406A8C49E235375CD21B"><enum>(A)</enum><text>The total number of
				annuitants to whom a waiver by the head of an agency under this subsection or
				section 8344(l) applies may not exceed 2.5 percent of the total number of
				full-time employees of that agency.</text>
								</subparagraph><subparagraph changed="deleted" committee-id="SSGA00" id="idC559DC343BE145BAAE9C8080950CA1B3" indent="up1" reported-display-style="strikethrough"><enum>(B)</enum><text>If the total
				number of annuitants to whom a waiver by the head of an agency under this
				subsection or section 8344(l) applies exceeds 1 percent of the total number of
				full-time employees of that agency, the head of that agency shall submit a
				report with an explanation that justifies the need for the waivers in excess of

									</clause><clause id="id1C968A51394840B9ABC51B2846E833FF"><enum>(iii)</enum><text>authorize other
				administratively convenient periods substantially equivalent to 12 months, such
				as 26 pay periods, to be used in determining compliance with paragraph (3)(B);
				and</text>
									</clause><clause id="id6BF6019904E84E52A43DB413AC5F2A49"><enum>(iv)</enum><text>include such
				other administrative requirements as the Director of the Office of Personnel
				Management may find appropriate to provide for effective operation of, or to
				ensure compliance with, this subsection.</text>
									</clause></subparagraph></paragraph><paragraph changed="deleted" committee-id="SSGA00" id="idAC4D1CD1965B4919B604BF525167D973" indent="up1" reported-display-style="strikethrough"><enum>(6)</enum><text>The authority of
				the head of an agency under this subsection to waive the application of
				subsection (a) shall terminate 5 years after the date of enactment of the
				<short-title>Part-Time Reemployment of Annuitants Act of
				2009</short-title>.</text>

				</paragraph><paragraph id="IDb0edd00e484347a3b799867191fad889"><enum>(3)</enum><text>in subsection (j)
			 (as so redesignated)—</text>
					<subparagraph id="ID2ba9dfd3c20a4c7d9321c149a871f17b"><enum>(A)</enum><text>in paragraph (1),
			 by striking <quote>(h)</quote> and inserting <quote>(i)</quote>; and</text>
					</subparagraph><subparagraph id="ID18c33954838c4c04bc5ea32cd20c1556"><enum>(B)</enum><text>in paragraph (2),
			 by striking <quote>or (h)</quote> and inserting <quote>(h), or
			 (i)</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="id626B4037E8AC4819807DEE25DB92249F"><enum>(c)</enum><header>Rule of
			 construction</header><text>Nothing in the amendments made by this section may
			 be construed to authorize the waiver of the hiring preferences under chapter 33
			 of title 5, United States Code in selecting annuitants to employ in an
			 appointive or elective position.</text>
			</subsection><subsection id="IDf05fe1667f084590a7821116874ab111"><enum>(d)</enum><header>Technical and
			 conforming amendments</header><text>Section 1005(d)(2) of title 39, United
			 States Code, is amended—</text>
				<paragraph id="ID92b638df9c3a4b9fbae165c9e0cefcf1"><enum>(1)</enum><text>by striking
			 <quote>(l)(2)</quote> and inserting <quote>(m)(2)</quote>; and</text>
				</paragraph><paragraph id="ID06ebbd7e046e4067903f9aac35d03c84"><enum>(2)</enum><text>by striking
			 <quote>(i)(2)</quote> and inserting <quote>(j)(2)</quote>.</text>
				</paragraph></subsection></section><section changed="deleted" committee-id="SSGA00" id="idCB33183E5BB14FCCB3821896202E4000" reported-display-style="strikethrough"><enum>3.</enum><header>GAO
			 report</header>
			<subsection id="id7FA2CDF9EB954E2EA423A03C6EC1C6ED"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 3
			 years after the date of enactment of this Act, the Comptroller General of the
			 United States shall submit to the Committee on Homeland Security and
			 Governmental Affairs of the Senate and the Committee on Oversight and
			 Government Reform of the House of Representatives a report regarding the use of
			 the authority under the amendments made by section 2.</text>
			</subsection><subsection id="id8A2C139945294175AF9873A76A734238"><enum>(b)</enum><header>Contents</header><text>The
			 report submitted under subsection (a) shall—</text>
				<paragraph id="idF8D9195F63F94496AE86D6D6D6D9D349"><enum>(1)</enum><text>include the number
			 of annuitants for whom a waiver was made under subsection (l) of section 8344
			 of title 5, United States Code, as amended by this Act, or subsection (i) of
			 section 8468 of title 5, United States Code, as amended by this Act; and</text>
				</paragraph><paragraph id="idA63A6735A3B64F75985E599EF192E6C5"><enum>(2)</enum><text>identify each
			 agency that used the authority described in paragraph (1).</text>
				</paragraph></subsection></section></legis-body>

				agency</term> means—</text>
									<clause id="id03679ada-0489-4cc0-a3cb-dfdf2aed5087"><enum>(i)</enum><text>the head of an Executive
				agency, other than the Government Accountability Office;</text>
									</clause><clause id="idebe2bae8-1b27-4e47-8e2a-804f07c81822"><enum>(ii)</enum><text>the head of the United
				States Postal Service;</text>
									</clause><clause id="id9b64053d-aafd-40d9-ac35-967ef2a6c277"><enum>(iii)</enum><text>the Director of the
				Administrative Office of the United States Courts, with respect to employees of
				the judicial branch; and</text>
									</clause><clause id="ide7a43495-7e95-455a-adb9-160a32d0c486"><enum>(iv)</enum><text>any employing authority
				described under subsection (k)(2), other than the Government Accountability
				Office; and</text>
									</clause></subparagraph><subparagraph changed="added" committee-id="SSGA00" id="id98aa4661-72df-4eb2-ba19-adb4a329c878" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>the term <term>limited
				time appointee</term> means an annuitant appointed under a temporary
				appointment limited to 1 year or less.</text>
								</subparagraph></paragraph><paragraph changed="added" committee-id="SSGA00" id="id24ba4f81-1068-4bd2-81c2-cfc6a6f66bc5" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The head of an agency may
				waive the application of subsection (a) or (b) with respect to any annuitant
				who is employed in such agency as a limited time appointee, if the head of the
				agency determines that the employment of the annuitant is necessary to—</text>
								<subparagraph id="ID7dcb4f2372984ab9ae1d22bafa51d9ff"><enum>(A)</enum><text>fulfill functions
				critical to the mission of the agency, or any component of that agency;</text>
								</subparagraph><subparagraph id="ID2437be8dbba84603a507de5732aa7f70"><enum>(B)</enum><text>assist in the
				implementation or oversight of the American Recovery and Reinvestment Act of
				2009 (Public Law 111–5) or the Troubled Asset Relief Program under title I of
				the Emergency Economic Stabilization Act of 2008 (12 U.S.C. 5201 et
				seq.);</text>
								</subparagraph><subparagraph id="ID291bca09c7d94c3da915ace8a2cab0ed"><enum>(C)</enum><text>assist in the
				development, management, or oversight of agency procurement actions;</text>
								</subparagraph><subparagraph id="ID4c2efff4ded040229608726eec7314bb"><enum>(D)</enum><text>assist the Inspector
				General for that agency in the performance of the mission of that Inspector
				General;</text>
								</subparagraph><subparagraph id="IDe089f428708649eaa64d10fc8eecb3e2"><enum>(E)</enum><text>promote appropriate
				training or mentoring programs of employees;</text>
								</subparagraph><subparagraph id="idBCC98A815E0C4A8F930BD968A1CDD6D7"><enum>(F)</enum><text>assist in the recruitment
				or retention of employees; or</text>
								</subparagraph><subparagraph id="ID9da3614bc0594aab848a147a1cd72dfc"><enum>(G)</enum><text>respond to an emergency
				involving a direct threat to life of property or other unusual
				circumstances.</text>
								</subparagraph></paragraph><paragraph changed="added" committee-id="SSGA00" id="idaf72bdb1-d7f9-4e2e-85f3-62388a08c783" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>The head of an agency may
				not waive the application of subsection (a) or (b) with respect to an
				annuitant—</text>
								<subparagraph id="id02e4003e-81ca-4769-b5db-0bab55c36770"><enum>(A)</enum><text>for more than 520 hours
				of service performed by that annuitant during the period ending 6 months
				following the individual’s annuity commencing date;</text>
								</subparagraph><subparagraph id="id5fcc15a0-a490-4b2e-a07d-a5a7754da3e9"><enum>(B)</enum><text>for more than 1040 hours
				of service performed by that annuitant during any 12-month period; or</text>
								</subparagraph><subparagraph id="id5edef22e-b2ae-44c0-8829-20ee7a35707c"><enum>(C)</enum><text>for more than a total of
				3120 hours of service performed by that annuitant.</text>
								</subparagraph></paragraph><paragraph changed="added" committee-id="SSGA00" id="ida8467ebe-30d5-4887-baae-eb36a6b3e8f1" indent="up1" reported-display-style="italic"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="iddc3e7d4b-6e60-49bd-b396-676c6296f37b"><enum>(A)</enum><text>The total number of
				annuitants to whom a waiver by the head of an agency under this subsection or
				section 8468(i) applies may not exceed 2.5 percent of the total number of
				full-time employees of that agency.</text>
								</subparagraph><subparagraph changed="added" committee-id="SSGA00" id="ida65154c7-f9cf-46c5-8814-f28d37c16efa" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>If the total number of
				annuitants to whom a waiver by the head of an agency under this subsection or
				section 8468(i) applies exceeds 1 percent of the total number of full-time
				employees of that agency, the head of that agency shall submit a report with an
				explanation that justifies the need for the waivers in excess of that
				percentage to the Committee on Homeland Security and Governmental Affairs of
				the Senate, the Committee on Oversight and Government Reform of the House of
				Representatives, and the Office of Personnel Management.</text>
								</subparagraph></paragraph><paragraph changed="added" committee-id="SSGA00" id="id0fcb46a2-a0c1-46ac-b17c-a550386766aa" indent="up1" reported-display-style="italic"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id6e6177eb-516e-4e72-9460-767908a3672c"><enum>(A)</enum><text>The Director of the
				Office of Personnel Management may promulgate regulations providing for the
				administration of this subsection.</text>
								</subparagraph><subparagraph changed="added" committee-id="SSGA00" id="id4cf99522-e814-492c-8f8f-a9d60246fd11" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>Any regulations
				promulgated under subparagraph (A) may—</text>
									<clause id="id75de9d54-5891-40a9-ad5d-feb0afadbce3" indent="down1"><enum>(i)</enum><text>provide standards for the
				maintenance and form of necessary records of employment under this
				subsection;</text>
									</clause><clause id="id27498155-9a09-4cc9-9d22-5b1f06e8c104" indent="down1"><enum>(ii)</enum><text>to the extent not
				otherwise expressly prohibited by law, require employing agencies to provide
				records of such employment to the Office of Personnel Management or other
				employing agencies as necessary to ensure compliance with paragraph (3);</text>
									</clause><clause id="idc855a607-c442-4604-b556-81511148d35d" indent="down1"><enum>(iii)</enum><text>authorize other
				administratively convenient periods substantially equivalent to 12 months, such
				as 26 pay periods, to be used in determining compliance with paragraph
				(3)(B);</text>
									</clause><clause id="idf036b4f0-072f-401a-a191-6973c3838d83" indent="down1"><enum>(iv)</enum><text>include such other
				administrative requirements as the Director of the Office of Personnel
				Management may find appropriate to provide for the effective operation of, or
				to ensure compliance with, this subsection; and</text>
									</clause><clause id="idE603455F96544F3F8DCD0AFA111C7AFB" indent="down1"><enum>(v)</enum><text>encourage the training
				and mentoring of employees by any limited time appointee employed under this
				subsection, except that any hours of that training or mentoring shall not be
				included in the hours of service performed for purposes of paragraph
				(3).</text>
									</clause></subparagraph></paragraph><paragraph changed="added" commented="no" committee-id="SSGA00" display-inline="no-display-inline" id="id1e2845af-d029-4b2f-9073-0d77fafd734d" indent="up1" reported-display-style="italic"><enum>(6)</enum><text display-inline="yes-display-inline">The authority of the head of an agency
				under this subsection to waive the application of subsection (a) or (b) shall
				terminate 5 years after the date of enactment of the
				<short-title>Part-Time Reemployment of Annuitants Act of
				2009</short-title>.</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="id7117c0a7-14d8-4e80-bc88-ca857ce7349d"><enum>(3)</enum><text>in subsection (m) (as so
			 redesignated)—</text>
					<subparagraph id="id6ea6a866-61d9-4919-8d11-5ab836b48293"><enum>(A)</enum><text>in paragraph (1), by
			 striking <quote>(k)</quote> and inserting <quote>(l)</quote>; and</text>
					</subparagraph><subparagraph id="ide82f6032-da3b-4438-875e-25f84d1e7e96"><enum>(B)</enum><text>in paragraph (2), by
			 striking <quote>or (k)</quote> and inserting <quote>(k), or (l)</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="idd7278c32-115b-4552-b6e0-c60c30eed608"><enum>(b)</enum><header>Federal employee
			 retirement system</header><text>Section 8468 of title 5, United States Code, is
			 amended—</text>
				<paragraph id="id176b7a72-f738-47e5-aa64-b34cdf03ec34"><enum>(1)</enum><text>by redesignating
			 subsection (i) as subsection (j);</text>
				</paragraph><paragraph id="id19ec1750-0834-4496-9690-c25d302e2193"><enum>(2)</enum><text>by inserting after
			 subsection (h) the following:</text>
					<quoted-block changed="added" committee-id="SSGA00" display-inline="no-display-inline" id="idceba7686-dd7d-4570-9ad2-bc4ce800ce80" reported-display-style="italic" style="OLC">
						<subsection id="ided333a3d-9642-484a-810a-f93cb8d1ef8f"><enum>(i)</enum><paragraph commented="no" display-inline="yes-display-inline" id="idbd5c70ef-61d3-43ce-89bf-fbf5843a053f"><enum>(1)</enum><text>For purposes of
				this subsection—</text>
								<subparagraph changed="added" committee-id="SSGA00" id="id044dcc97-20f1-42d7-9f39-cdb88e066ca9" indent="up1" reported-display-style="italic"><enum>(A)</enum><text>the term <term>head of an
				agency</term> means—</text>
									<clause id="id015d7a02-0b98-43a2-9ce9-78cf08f76645"><enum>(i)</enum><text>the head of an Executive
				agency, other than the Government Accountability Office;</text>
									</clause><clause id="idd57ef7d2-a256-4e18-a202-9dab8df706d2"><enum>(ii)</enum><text>the head of the United
				States Postal Service;</text>
									</clause><clause id="id727d3ada-41ea-4b2c-be23-a6aaff5bf1b3"><enum>(iii)</enum><text>the Director of the
				Administrative Office of the United States Courts, with respect to employees of
				the judicial branch; and</text>
									</clause><clause id="id8c7c907a-6160-45b3-9142-0da6146c2fe3"><enum>(iv)</enum><text>any employing authority
				described under subsection (h)(2), other than the Government Accountability
				Office; and</text>
									</clause></subparagraph><subparagraph changed="added" committee-id="SSGA00" id="ideb646336-729e-44bb-b978-0c02d86fd4fc" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>the term <term>limited
				time appointee</term> means an annuitant appointed under a temporary
				appointment limited to 1 year or less.</text>
								</subparagraph></paragraph><paragraph changed="added" committee-id="SSGA00" id="idd35b6806-e907-4778-a855-5258d1baddd7" indent="up1" reported-display-style="italic"><enum>(2)</enum><text>The head of an agency may
				waive the application of subsection (a) with respect to any annuitant who is
				employed in such agency as a limited time appointee, if the head of the agency
				determines that the employment of the annuitant is necessary to—</text>
								<subparagraph id="id5F692D256C1F4542B8F07C0A27A74D16"><enum>(A)</enum><text>fulfill functions
				critical to the mission of the agency, or any component of that agency;</text>
								</subparagraph><subparagraph id="id4A9698D411C947DB9379C9F64FC1F979"><enum>(B)</enum><text>assist in the
				implementation or oversight of the American Recovery and Reinvestment Act of
				2009 (Public Law 111–5) or the Troubled Asset Relief Program under title I of
				the Emergency Economic Stabilization Act of 2008 (12 U.S.C. 5201 et
				seq.);</text>
								</subparagraph><subparagraph id="id9723C791495240D887652EC4C705150F"><enum>(C)</enum><text>assist in the
				development, management, or oversight of agency procurement actions;</text>
								</subparagraph><subparagraph id="idF5B72B384D534060A20768649731714E"><enum>(D)</enum><text>assist the Inspector
				General for that agency in the performance of the mission of that Inspector
				General;</text>
								</subparagraph><subparagraph id="id2B79D442DDB642368EB5440715D68E04"><enum>(E)</enum><text>promote appropriate
				training or mentoring programs of employees;</text>
								</subparagraph><subparagraph id="idF755EB99440F44AEAF08DAB401133C9A"><enum>(F)</enum><text>assist in the recruitment
				or retention of employees; or</text>
								</subparagraph><subparagraph id="id1B351D530BB94E16A9FD4E73E03211F9"><enum>(G)</enum><text>respond to an emergency
				involving a direct threat to life of property or other unusual
				circumstances.</text>
								</subparagraph></paragraph><paragraph changed="added" committee-id="SSGA00" id="id29cc32c9-fe9b-4fe9-a638-886f9411ab85" indent="up1" reported-display-style="italic"><enum>(3)</enum><text>The head of an agency may
				not waive the application of subsection (a) with respect to an
				annuitant—</text>
								<subparagraph id="idbc0b1d89-8078-4f9b-9347-5eb9f05e23a6"><enum>(A)</enum><text>for more than 520 hours
				of service performed by that annuitant during the period ending 6 months
				following the individual’s annuity commencing date;</text>
								</subparagraph><subparagraph id="id74f5a02c-0282-452f-8c86-748fc3f43032"><enum>(B)</enum><text>for more than 1040 hours
				of service performed by that annuitant during any 12-month period; or</text>
								</subparagraph><subparagraph id="id01b51aa0-3e02-4f3f-a8a7-7770b0409da4"><enum>(C)</enum><text>for more than a total of
				3120 hours of service performed by that annuitant.</text>
								</subparagraph></paragraph><paragraph changed="added" committee-id="SSGA00" id="id4e29953d-96e2-4f9c-9e5a-9b6ac92e5759" indent="up1" reported-display-style="italic"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idf7b47554-c124-40c6-bca9-e778dd7c0eb2"><enum>(A)</enum><text>The total number of
				annuitants to whom a waiver by the head of an agency under this subsection or
				section 8344(l) applies may not exceed 2.5 percent of the total number of
				full-time employees of that agency.</text>
								</subparagraph><subparagraph changed="added" committee-id="SSGA00" id="id54b93e39-d1bd-4e8c-839d-5c0957657b20" indent="up1" reported-display-style="italic"><enum>(B)</enum><text>If the total number of
				annuitants to whom a waiver by the head of an agency under this subsection or
				section 8344(l) applies exceeds 1 percent of the total number of full-time
				employees of that agency, the head of that agency shall submit a report with an

				(3)(B);</text>
									</clause><clause id="idd2831a50-f749-4497-bc11-7a08b7ac728b"><enum>(iv)</enum><text>include such other
				administrative requirements as the Director of the Office of Personnel
				Management may find appropriate to provide for effective operation of, or to
				ensure compliance with, this subsection; and</text>
									</clause><clause id="idE07B27757F4F49F488993CD4350654CF"><enum>(v)</enum><text>encourage the training
				and mentoring of employees by any limited time appointee employed under this
				subsection, except that any hours of that training or mentoring shall not be
				included in the hours of service performed for purposes of paragraph
				(3).</text>
									</clause></subparagraph></paragraph><paragraph changed="added" committee-id="SSGA00" id="id187ae9b2-b16a-4db4-be5f-830930e40501" indent="up1" reported-display-style="italic"><enum>(6)</enum><text>The authority of the head
				of an agency under this subsection to waive the application of subsection (a)

					</subparagraph><subparagraph id="id7875270d-654e-4f12-986f-c24a41621265"><enum>(B)</enum><text>in paragraph (2), by
			 striking <quote>or (h)</quote> and inserting <quote>(h), or (i)</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="id9cc41e39-c784-40c8-9cf4-f37fda1bd900"><enum>(c)</enum><header>Rule of
			 construction</header><text>Nothing in the amendments made by this section may
			 be construed to authorize the waiver of the hiring preferences under chapter 33
			 of title 5, United States Code in selecting annuitants to employ in an
			 appointive or elective position.</text>
			</subsection><subsection id="ida3794c9d-257f-4397-8fb2-5f4d617a2049"><enum>(d)</enum><header>Technical and
			 conforming amendments</header><text>Section 1005(d)(2) of title 39, United
			 States Code, is amended—</text>
				<paragraph id="id37cbf97f-207b-4e75-8041-e58d108f9024"><enum>(1)</enum><text>by striking
			 <quote>(l)(2)</quote> and inserting <quote>(m)(2)</quote>; and</text>
				</paragraph><paragraph id="id970f7d73-2ce2-4602-9f8a-9ba4b94083f3"><enum>(2)</enum><text>by striking
			 <quote>(i)(2)</quote> and inserting <quote>(j)(2)</quote>.</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSGA00" id="id6caf7456-adec-4a8f-af13-2f0ed4e20192" reported-display-style="italic"><enum>3.</enum><header>General Accountability
			 Office report</header>
			<subsection id="id922fba7e-9166-4fb7-bf00-b1ec37d4ebd6"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 3
			 years after the date of enactment of this Act, the Comptroller General of the
			 United States shall submit to the Committee on Homeland Security and
			 Governmental Affairs of the Senate and the Committee on Oversight and
			 Government Reform of the House of Representatives a report regarding the use of
			 the authority under the amendments made by section 2.</text>
			</subsection><subsection id="id41ef90be-f35e-401a-a52d-7295c4ddb2c3"><enum>(b)</enum><header>Contents</header><text>The
			 report submitted under subsection (a) shall—</text>
				<paragraph id="ida918d474-288c-4763-87b6-cc571d1af1f8"><enum>(1)</enum><text>include the number of
			 annuitants for whom a waiver was made under subsection (l) of section 8344 of
			 title 5, United States Code, as amended by this Act, or subsection (i) of
			 section 8468 of title 5, United States Code, as amended by this Act; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3e9978af-5983-455b-b45e-0d3bb6e2bcd2"><enum>(2)</enum><text>identify each agency that
			 used the authority described in paragraph (1).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idC051A4B2CE8B47FA87E2E2A78E272A00"><enum>(c)</enum><header>Agency
			 data</header><text>Each head of an agency (as defined under sections 8344(l)(1)
			 and 8468(i)(1)(A) of title 5, United States Code, as added by section 2 of this
			 Act) shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id4427B6EBC5884982B6446480E09DF048"><enum>(1)</enum><text>collect and maintain data
			 necessary for purposes of the Comptroller General report submitted under
			 subsection (a); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD99066A2ABC54810A6DDCE0EBF629580"><enum>(2)</enum><text>submit to the Comptroller
			 General that data as the Comptroller General requires in a timely
			 fashion.</text>
