		<official-title>To authorize the Secretary of the Interior to establish
		  the Waco Mammoth National Monument in the State of Texas.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Waco Mammoth National Monument
			 Establishment Act of 2009</short-title></quote>.</text>
		</section><section id="id678D8106D5F44F3C843149FD8FC38655" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="id732B4D6BB7F84D7C908BD5D6DC1B21EB"><enum>(1)</enum><text display-inline="yes-display-inline">the Waco Mammoth Site area is located near
			 the confluence of the Brazos River and the Bosque River in Central Texas, near
			 the city of Waco;</text>
			</paragraph><paragraph id="id7457A2FF356A44B4A55B71055277030C"><enum>(2)</enum><text display-inline="yes-display-inline">after the discovery of bones emerging from
			 eroding creek banks leading to the uncovering of portions of 5 mammoths, Baylor
			 University began investigating the site in 1978;</text>
			</paragraph><paragraph id="id01DA2E51DD2F4D88BC617A89DFC6F386"><enum>(3)</enum><text display-inline="yes-display-inline">several additional mammoth remains have
			 been uncovered making the site the largest known concentration of mammoths
			 dying from the same event;</text>
			</paragraph><paragraph id="id9F03F50D3A164BBAB0028354BFFB0880"><enum>(4)</enum><text display-inline="yes-display-inline">the mammoth discoveries have received
			 international attention; and</text>
			</paragraph><paragraph id="idB50CB862650B4B1BA98DB4C8190B82BF"><enum>(5)</enum><text display-inline="yes-display-inline">Baylor University and the City of Waco,
			 Texas, have been working together—</text>
				<subparagraph id="idC06C01B2B47448599D869BE28D23BD40"><enum>(A)</enum><text display-inline="yes-display-inline">to protect the site; and</text>
				</subparagraph><subparagraph id="idCED7E657FE9D4E3EB1E865498CF4C2B3"><enum>(B)</enum><text display-inline="yes-display-inline">to develop further research and educational
			 opportunities at the site.</text>
				</subparagraph></paragraph></section><section id="idEDC3AC6346C14700822927A928E29CBA"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id54FE616282304FCCAE12243B1EFCEB6C"><enum>(1)</enum><header>City</header><text>The
			 term <quote>City</quote> means the city of Waco, Texas.</text>
			</paragraph><paragraph id="id3DACFE8B73D649FF8287656A596074BC"><enum>(2)</enum><header>Management
			 plan</header><text>The term <quote>management plan</quote> means the management
			 plan for the Monument prepared under section 5(c)(1).</text>
			</paragraph><paragraph id="id07A1A9B525AB48309B7AC2C5AB336C62"><enum>(3)</enum><header>Map</header><text display-inline="yes-display-inline">The term <quote>map</quote> means the map
			 entitled <quote><inline-comment>_____</inline-comment></quote>, numbered
			 <quote><inline-comment>____</inline-comment></quote>, and dated
			 <quote><inline-comment>____</inline-comment></quote>.</text>
			</paragraph><paragraph id="idAEA8669098044225B2BB247BBF40C7DB"><enum>(4)</enum><header>Monument</header><text display-inline="yes-display-inline">The term <quote>Monument</quote> means the
			 Waco Mammoth National Monument established by section 4(a).</text>
			</paragraph><paragraph id="id792F1CC2F6FE4684891A5245A0203D81"><enum>(5)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the
			 Secretary of the Interior.</text>
			</paragraph><paragraph id="id0CCA55559C4D46D78504A5A1FA74B068"><enum>(6)</enum><header>State</header><text>The
			 term <quote>State</quote> means the State of Texas.</text>
			</paragraph><paragraph id="idE76B4FF198FF4E5D91E099A4B5AAECB2"><enum>(7)</enum><header>University</header><text>The
			 term <quote>University</quote> means Baylor University in the State.</text>
			</paragraph></section><section id="idB26C2CBAFA2F4C3C9ACDCD64417FBC0E"><enum>4.</enum><header>Waco mammoth
			 national monument, texas</header>
			<subsection id="idA7D26CA3483A47B79670BF887098C8A3"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the State, as a
			 unit of the National Park System, the Waco Mammoth National Monument, as
			 generally depicted on the map.</text>
			</subsection><subsection id="idD3B2C437F2904C93895CA3C6BC528498"><enum>(b)</enum><header>Availability of
			 map</header><text display-inline="yes-display-inline">The map shall be on file
			 and available for public inspection in the appropriate offices of the National
			 Park Service.</text>
			</subsection></section><section id="id38EF3F20DCF6403897CB77BBA870FBF0"><enum>5.</enum><header>Administration
			 of monument</header>
			<subsection id="idCACAFB245B80470DB388D3B951E47CD1"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary shall
			 administer the Monument in accordance with—</text>
				<paragraph id="id5EBC934A05A5446C931C02C8FC7D5FDB"><enum>(1)</enum><text display-inline="yes-display-inline">this Act;</text>
				</paragraph><paragraph id="idB24027FCC46942D7B115980B3AFF9EB4"><enum>(2)</enum><text display-inline="yes-display-inline">any cooperative agreements entered into
			 under subsection (b)(1); and</text>
				</paragraph><paragraph id="idDDBF27745A99463DAC589CDEFFD81293"><enum>(3)</enum><text display-inline="yes-display-inline">the laws (including regulations) generally
			 applicable to units of the National Park System, including the National Park
			 Service Organic Act (16 U.S.C. 1 et seq.).</text>
				</paragraph></subsection><subsection id="id61AFB597FBD64E8980E8B6EB99CEB890"><enum>(b)</enum><header>Authorities of
			 Secretary</header>
				<paragraph id="id9932FD854E204AC9ABD0A021E6C8CC56"><enum>(1)</enum><header>Cooperative
			 Agreements</header><text display-inline="yes-display-inline">The Secretary may
			 enter into cooperative management agreements with the University and the City,
			 in accordance with section 3(<italic>l</italic>) of Public Law 91–383 (16
			 U.S.C. 1a–2(<italic>l</italic>)).</text>
				</paragraph><paragraph id="id21D4116FC4464C93B1B7A9D967DE0633"><enum>(2)</enum><header>Acquisition of
			 land</header>
					<subparagraph id="id645E3B738DB641478E89B8E07524BC4C"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary may
			 acquire from willing sellers any land or interest in land within the proposed
			 boundary of the Monument that is necessary for effective management of the
			 Monument.</text>
					</subparagraph><subparagraph id="id9D199EDDF7CF40D8A3A2F25A6C578567"><enum>(B)</enum><header>Method of
			 acquisition</header>
						<clause id="id44E1AD79156C42B69DB20896142BAEFB"><enum>(i)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The land described in
			 subparagraph (A) may be acquired by donation, purchase with donated or
			 appropriated funds, transfer from another Federal agency, or exchange.</text>
						</clause><clause id="id04DF215BE12C4050BD70FB3512A93ACF"><enum>(ii)</enum><header>State
			 land</header><text display-inline="yes-display-inline">Land or interests in
			 land owned by the State or a political subdivision of the State may only be
			 acquired by donation or exchange.</text>
						</clause></subparagraph></paragraph><paragraph id="id0979E0D5733D478A8FA84B5CA215379C"><enum>(3)</enum><header>Construction of
			 facilities on non-Federal land</header>
					<subparagraph id="id70FDCFC27FFE41D7BCF206D2DE755661"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary may,
			 subject to the availability of appropriations, construct essential
			 administrative or visitor use facilities on non-Federal land within the
			 boundary of the Monument.</text>
					</subparagraph><subparagraph id="idB12A982221CB4D13B391131294D63D1E"><enum>(B)</enum><header>Donations</header><text display-inline="yes-display-inline">In addition to the use of Federal funds
			 authorized under subparagraph (A), the Secretary may use donated funds,
			 property, and services to carry out that subparagraph.</text>
					</subparagraph></paragraph></subsection><subsection id="idD04A9F11379F4B18B832C8EB554539DC"><enum>(c)</enum><header>General
			 Management plan</header>
				<paragraph id="idAC93900A723448BC9C8A59BE16FE029A"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 3
			 years after the date on which funds are made available to carry out this Act,
			 the Secretary, in consultation with the University and the City, shall complete
			 a general management plan for the Monument.</text>
				</paragraph><paragraph id="idA165E9523DE743BE88CC5E4506C2489D"><enum>(2)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The management plan shall include, at a
			 minimum—</text>
					<subparagraph id="id2CAB9E164C944E588EF2179671F4BBA3"><enum>(A)</enum><text display-inline="yes-display-inline">measures for the preservation of the
			 resources of the Monument;</text>
					</subparagraph><subparagraph id="idD6065E3C47F140698D25236B5A94F669"><enum>(B)</enum><text display-inline="yes-display-inline">requirements for the type and extent of
			 development and use of the Monument;</text>
					</subparagraph><subparagraph id="idBB8A175A09E6477289FC64F270300AED"><enum>(C)</enum><text display-inline="yes-display-inline">identification of the capacity of the
			 Monument for accommodating visitors; and</text>
					</subparagraph><subparagraph id="id8814D7099B68488C8EA4EBABAAA1EB80"><enum>(D)</enum><text display-inline="yes-display-inline">opportunities for involvement by the
			 University, City, State, and other local and national entities in—</text>
						<clause id="idDD0E1552524E496CA2F31A3D904D58A5"><enum>(i)</enum><text display-inline="yes-display-inline">developing educational programs for the
			 Monument; and</text>
						</clause><clause id="id6AF18107FDD44796A458A50D8693B032"><enum>(ii)</enum><text display-inline="yes-display-inline">developing and supporting the
			 Monument.</text>
						</clause></subparagraph></paragraph></subsection></section><section id="idC9981F02401B4FCBA63B860277824AB8"><enum>6.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as are necessary to carry out this
			 Act.</text>
