		<legis-type>A BILL</legis-type>
		<official-title>To amend section 552(b)(3) of title 5, United States Code
		  (commonly referred to as the Freedom of Information Act) to provide that
		  statutory exemptions to the disclosure requirements of that Act shall
		  specifically cite to the provision of that Act authorizing such exemptions, to
		  ensure an open and deliberative process in Congress by providing for related
		  legislative proposals to explicitly state such required citations, and for
		  other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>OPEN FOIA Act of
			 2009</short-title></quote>.</text>
		</section><section id="idAF22F95F2C214A7CB589A3F19DC557FD"><enum>2.</enum><header>Specific
			 citations in statutory exemptions</header><text display-inline="no-display-inline">Section 552(b) of title 5, United States
			 Code, is amended by striking paragraph (3) and inserting the following:</text>
			<quoted-block display-inline="no-display-inline" id="id0627392207A440EB95144CFAC312026B" style="OLC">
				<paragraph id="id5D8B633E1C324F9EB0B63A8E95B9B120"><enum>(3)</enum><text>specifically
				exempted from disclosure by statute (other than section 552b of this title), if
				that statute—</text>
					<subparagraph id="id9CAB34DD12914CC7A6997112D9986844"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="idBC7793865E1344CBA5B22D22F2EC2C2D"><enum>(i)</enum><text>requires that the
				matters be withheld from the public in such a manner as to leave no discretion
				on the issue; or</text>
						</clause><clause id="id445B192EBA7648449CE97331E895AA2A" indent="up1"><enum>(ii)</enum><text>establishes particular criteria
				for withholding or refers to particular types of matters to be withheld;
				and</text>
						</clause></subparagraph><subparagraph id="id4E6C2DE8172D48FC8D28C6F1CA655B58"><enum>(B)</enum><text>if enacted after
				the date of enactment of the OPEN FOIA Act of 2009, specifically cites to this
				paragraph.</text>
