		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Nonprofit Capacity Building Act of
			 2009</short-title></quote>.</text>
		</section><section id="idD88FA986B9C746ED86CAFCDA811359BE" section-type="subsequent-section"><enum>2.</enum><header>Nonprofit Capacity
			 Building Program</header><text display-inline="no-display-inline">Title III of
			 the National and Community Service Act of 1990 (42 U.S.C. 12501 et seq.) is
			 amended—</text>
			<paragraph id="id755379C97CD940B2BD822F3CBEA44F1C"><enum>(1)</enum><text display-inline="yes-display-inline">by striking the title heading and inserting
			 the following:</text>

				Charitable Activities</header>

				Foundation</header>
						</subtitle></title><after-quoted-block>;
				</after-quoted-block></quoted-block>
				<continuation-text continuation-text-level="paragraph">and</continuation-text></paragraph><paragraph id="id371A89D2C014482997E2E78FCDD4B0CA"><enum>(2)</enum><text>by adding at the
			 end the following:</text>

					<subtitle id="idBBA5812990724344A1FEAF1E28989AA0"><enum>B</enum><header>Nonprofit
				Capacity Building Program</header>
						<section id="id77A15B6CB87348D2B03BD00A5CF4DC3C"><enum>311.</enum><header>Program</header>
							<subsection id="id57703520D198494198AAEF55C325D64D"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
								<paragraph id="idB0F05853B33D487A9501C99204B60E38"><enum>(1)</enum><header>Intermediary
				nonprofit grantee</header><text>The term <term>intermediary nonprofit
				grantee</term> means an intermediary nonprofit organization that receives a
				grant under subsection (b).</text>
								</paragraph><paragraph id="ID4abd23ce07af4ffba818c8634606f6b8"><enum>(2)</enum><header>Intermediary
				nonprofit organization</header><text>The term <term>intermediary nonprofit
				organization</term> means an experienced and capable nonprofit training and
				technical assistance entity with meaningful prior experience in providing
				organizational development assistance, or capacity building assistance, focused
				on small and midsize nonprofit organizations.</text>
								</paragraph><paragraph id="ID7b6e4383878b4b8c8c50e0ab7672328e"><enum>(3)</enum><header>Nonprofit</header><text>The
				term <term>nonprofit</term>, used with respect to an entity or organization,
				means an entity or organization described in section 501(c)(3) of the Internal
				Revenue Code of 1986 and exempt from taxation under section 501(a) of such
				Code.</text>
								</paragraph><paragraph id="id11CE5480475E4B7AA767B46344FB1AD1"><enum>(4)</enum><header>State</header><text>The
				term <term>State</term> means each of the several States, and the District of
				Columbia.</text>
								</paragraph></subsection><subsection id="ID14f9c2d2bbb248be807eeb856b76511e"><enum>(b)</enum><header>Grants</header><text>The
				Corporation shall establish a Nonprofit Capacity Building Program to make
				grants to intermediary nonprofit organizations to serve as intermediary
				nonprofit grantees. The Corporation shall make the grants to enable the
				intermediary nonprofit grantees to pay for the Federal share of the cost of
				delivering organizational development assistance for small and midsize
				nonprofit organizations, especially those nonprofit organizations facing
				resource hardship challenges. Each of the grantees shall match the grant funds
				by providing a non-Federal share as described in subsection (f).</text>
							</subsection><subsection id="id9849212F25064337BBE6E9DF144BAECE"><enum>(c)</enum><header>Periods and
				amount</header><text>The Corporation shall make such a grant for a period of 3
				years, unless the Corporation, in the Corporation's discretion, provides for a
				different period, for an initial or renewed grant. To the extent practicable,
				the Corporation shall make such a grant to an intermediary nonprofit
				organization in each State, and shall make such grant in an amount of not less
				than $200,000.</text>
							</subsection><subsection id="id1A361C4E4BE8474F822AC1F8D5436795"><enum>(d)</enum><header>Application</header><text>To
				be eligible to receive a grant under this section, an intermediary nonprofit
				organization shall submit an application to the Corporation at such time, in
				such manner, and containing such information as the Corporation may require.
				The intermediary nonprofit organization shall submit in the application
				information demonstrating that the organization has secured sufficient
				resources to meet the requirements of subsection (f).</text>
							</subsection><subsection id="id23E708B0F39842FCB73F7A629B8B94D2"><enum>(e)</enum><header>Preference and
				considerations</header>
								<paragraph id="idC922B2F2E7F14A32AC7930D20597C623"><enum>(1)</enum><header>Preference</header><text>In
				making such grants, the Corporation shall give preference to intermediary
				nonprofit organizations seeking to become intermediary nonprofit grantees in
				areas where nonprofit organizations face significant resource hardship
				challenges.</text>
								</paragraph><paragraph id="id1CC65BC47C4B41E983B24991B37E673D"><enum>(2)</enum><header>Considerations</header><text>In
				determining whether to make a grant the Corporation shall consider—</text>
									<subparagraph id="ID32b36b9ec15d4caea22c04f62a8a218d"><enum>(A)</enum><text>the number of
				small and midsize nonprofit organizations that will be served by the
				grant;</text>
									</subparagraph><subparagraph id="ID72dd0012299f43028647b4c172ac8975"><enum>(B)</enum><text>the degree to
				which the activities proposed to be provided through the grant will assist a
				wide number of nonprofit organizations within a State, relative to the proposed
				amount of the grant; and</text>
									</subparagraph><subparagraph id="ID74f5cb044f3d4d89a56fef9cb22c81d2"><enum>(C)</enum><text>the quality of
				the organizational development assistance to be delivered by the intermediary
				nonprofit grantee, including the qualifications of its administrators and
				representatives, and its record in providing services to small and midsize
				nonprofit organizations.</text>
									</subparagraph></paragraph></subsection><subsection id="id244998A9E5424B428B17B918E145C85E"><enum>(f)</enum><header>Federal
				share</header>
								<paragraph id="ID9e20d921eb9240b8ba39cd5d41dbdbc4"><enum>(1)</enum><header>In
				general</header><text>The Federal share of the cost as referenced in subsection
				(b) shall be 50 percent.</text>
								</paragraph><paragraph id="id22513C6C2F7C42DDA711711287AEAFE5"><enum>(2)</enum><header>Non-Federal
				share</header>
									<subparagraph id="idDFED939185414BF49048FD4883B3BEEB"><enum>(A)</enum><header>In
				general</header><text>The non-Federal share of the cost as referenced in
				subsection (b) shall be 50 percent and shall be provided in cash.</text>
									</subparagraph><subparagraph id="id9B8778A312C946E6BF964BE64F2CC523"><enum>(B)</enum><header>Third party
				contributions</header>
										<clause id="id41069C144B8E450EBE79436A33325444"><enum>(i)</enum><header>In
				general</header><text>Except as provided in clause (ii), an intermediary
				nonprofit grantee shall provide the non-Federal share of the cost through
				contributions from third parties. The third parties may include charitable
				grantmaking entities and grantmaking vehicles within existing organizations,
				entities of corporate philanthropy, corporations, individual donors, and
				regional, State, or local government agencies, or other non-Federal
				sources.</text>
										</clause><clause id="id08D8D18617E6404B9359090DDE561322"><enum>(ii)</enum><header>Exception</header><text>If
				the intermediary nonprofit grantee is a private foundation (as defined in
				section 509(a) of the Internal Revenue Code of 1986), a donor advised fund (as
				defined in section 4966(d)(2) of such Code), an organization which is described
				in section 4966(d)(4)(A)(i) of such Code, or an organization which is described
				in section 4966(d)(4)(B) of such Code, the grantee shall provide the
				non-Federal share from within that grantee's own funds.</text>
										</clause><clause id="id9A4F823205B0449D93F61AFEBC3E01F6"><enum>(iii)</enum><header>Maintenance
				of effort, prior year third-party funding levels</header><text>For purposes of
				maintaining private sector support levels for the activities specified by this
				program, a non-Federal share that includes donations by third parties shall be
				composed in a way that does not decrease prior levels of funding from the same
				third parties granted to the nonprofit intermediary grantee in the preceding
				year.</text>
										</clause></subparagraph></paragraph></subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="idD9305C50E9E64C5A98BD716FF7DD5DDA"><enum>3.</enum><header>Conforming
			 amendment</header><text display-inline="no-display-inline">Section 501(b) of
			 the National and Community Service Act of 1990 (42 U.S.C. 12681(b)) is
			 amended—</text>

			 <quote>There are</quote> and inserting the following:</text>

			</paragraph><paragraph id="id3537C469A0394D048E47062052C49FB6"><enum>(2)</enum><text>by striking
			 <quote>title III</quote> and inserting <quote>subtitle A of title III</quote>;
			 and</text>
			</paragraph><paragraph id="id66C523FCE7494D96A2897AFCE1C04E59"><enum>(3)</enum><text>by adding at the
			 end the following:</text>

				capacity building program</header><text>There are authorized to be appropriated
				to carry out subtitle B of title III $25,000,000 for fiscal year 2010 and such
				sums as may be necessary for each of the 2 succeeding fiscal
				years.</text>
