			 petition process</header>
			<subsection id="idF9A5A6384FD44953B3517FC47A533591"><enum>(a)</enum><header>Consumer
			 products other than automobiles</header><text>Section 323(b)(1) of the Energy
			 Policy and Conservation Act (42 U.S.C. 6293(b)(1)) is amended—</text>
				<paragraph id="idA5F1C960A648474380BE90FD22567051"><enum>(1)</enum><text>in subparagraph
			 (A)(i), by striking <quote>amend</quote> and inserting <quote>publish in the
			 Federal Register amended</quote>; and</text>
				</paragraph><paragraph id="id8BFF546341C54695834E02635FD6EBF6"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idAE5621C3FC2645C38CB263C0D1940419" style="OLC">
						<subparagraph id="ID8c424472753f4a85b208cb12ed82a748"><enum>(B)</enum><header>Petitions</header>
							<clause id="ID0d54b59386fb4779a4277531952ed77e"><enum>(i)</enum><header>In
				general</header><text>In the case of any covered product, any person may
				petition the Secretary to conduct a rulemaking—</text>
								<subclause id="idA485BE5E3A60474A9348B60686CBDD0C"><enum>(I)</enum><text>to prescribe a
				test procedure for the covered product; or</text>
								</subclause><subclause id="id31491F515A3E4B1DB0A736F594DD6BEA"><enum>(II)</enum><text>to amend the
				test procedures applicable to the covered product to more accurately or fully
				comply with paragraph (3).</text>
								</subclause></clause><clause id="id188F49EFAECA4175943CE97BAB40F1E4"><enum>(ii)</enum><header>Determination</header><text>The
				Secretary shall—</text>
								<subclause id="id165CD8D62F23469DAF217FC6D3EF7308"><enum>(I)</enum><text>not later than 90
				days after the date of receipt of the petition, publish the petition in the
				Federal Register; and</text>
								</subclause><subclause id="idEE9B70E1C9F347C4B6ED0ED286282C2D"><enum>(II)</enum><text>not later than
				180 days after the date of receipt of the petition, grant or deny the
				petition.</text>
								</subclause></clause><clause id="idED1E0907EFF64E1FAB9C9F6FD251C349"><enum>(iii)</enum><header>Basis</header><text>The
				Secretary shall grant a petition if the Secretary finds that the petition
				contains evidence that, assuming no other evidence was considered, provides an
				adequate basis for determining that an amended test method would more
				accurately or fully comply with paragraph (3).</text>
							</clause><clause id="idD0860553CAFD4BEEACD1E2EC23A9D457"><enum>(iv)</enum><header>Effect on
				other requirements</header><text>The granting of a petition by the Secretary
				under this subparagraph shall create no presumption with respect to the
				determination of the Secretary that the proposed test procedure meets the
				requirements of paragraph (3).</text>
							</clause><clause id="ID494b80509128462aa242a76b97fcbc8c"><enum>(v)</enum><header>Rulemaking</header>
								<subclause id="id7AFB6EB575DC4D4F832535ABF6FD3F70"><enum>(I)</enum><header>In
				general</header><text>Except as provided in subclause (II), not later than the
				end of the 18-month period beginning on the date of granting a petition, the
				Secretary shall publish an amended test method or a determination not to amend
				the test method.</text>
								</subclause><subclause id="id886A2849EE924540A390A7E3B18DB896"><enum>(II)</enum><header>Extension</header><text>The
				Secretary may extend the period described in subclause (I) for 1 additional
				year.</text>
								</subclause><subclause id="ID77b4c498d220480e88f60473656a0cf7"><enum>(III)</enum><header>Direct final
				rule</header><text>The Secretary may adopt a consensus test procedure in
				accordance with the direct final rule procedure established under section
				325(p)(4).</text>
								</subclause></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id7F5B3E0903B1468CA5673FD1C0ABC22E"><enum>(b)</enum><header>Certain
			 industrial equipment</header><text>Section 343 of the Energy Policy and
			 Conservation Act (42 U.S.C. 6314) is amended—</text>
				<paragraph id="idA219EACA1B2B481A9BF88A35ABF8F5DD"><enum>(1)</enum><text>in subsection
			 (a), by striking paragraph (1) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id1109D36872944EF9ABF0CB8D6506F77F" style="OLC">
						<paragraph id="IDc908598c088140a7b253eb88faf57e48"><enum>(1)</enum><header>Amendment and
				petition process</header>
							<subparagraph id="IDb3adc8430b644da988b41f56fabf6bf3"><enum>(A)</enum><header>In
				general</header><text>At least once every 7 years, the Secretary shall review
				test procedures for all covered equipment and—</text>
								<clause id="IDd2e02c66e67746f59e6a90c763459ab1"><enum>(i)</enum><text>publish in the
				Federal Register amended test procedures with respect to any covered equipment,
				if the Secretary determines that amended test procedures would more accurately
				or fully comply with paragraphs (2) and (3); or</text>
								</clause><clause id="IDd941f9d85a6546a19251647e9e68a234"><enum>(ii)</enum><text>publish notice
				in the Federal Register of any determination not to amend a test
				procedure.</text>
								</clause></subparagraph><subparagraph id="IDdd0217d438b747e080a490c11f0e3b3a"><enum>(B)</enum><header>Petitions</header>
								<clause id="ID5eecde121eaa40d3871302357b97dedd"><enum>(i)</enum><header>In
				general</header><text>In the case of any class or category of covered
				equipment, any person may petition the Secretary to conduct a
				rulemaking—</text>
									<subclause id="id5DE9827416904EAEA40492402BCC9CFD"><enum>(I)</enum><text>to prescribe a
				test procedure for the covered equipment; or</text>
									</subclause><subclause id="idE7E327CD13064D8496ECF675A4048941"><enum>(II)</enum><text>to amend the
				test procedures applicable to the covered equipment to more accurately or fully
				comply with paragraphs (2) and (3).</text>
									</subclause></clause><clause id="idEC7414DC4747482FBCFBEF02596796E6"><enum>(ii)</enum><header>Determination</header><text>The
				Secretary shall—</text>
									<subclause id="id0831ADD4EB9D4EE49326EAFE32467468"><enum>(I)</enum><text>not later than 90
				days after the date of receipt of the petition, publish the petition in the
				Federal Register; and</text>
									</subclause><subclause id="id98ED82F323904C6490D25503B675C0A6"><enum>(II)</enum><text>not later than
				180 days after the date of receipt of the petition, grant or deny the
				petition.</text>
									</subclause></clause><clause id="idBB845CC302894C1B848423828D87B315"><enum>(iii)</enum><header>Basis</header><text>The
				Secretary shall grant a petition if the Secretary finds that the petition
				contains evidence that, assuming no other evidence was considered, provides an
				adequate basis for determining that an amended test method would more
				accurately promote energy or water use efficiency.</text>
								</clause><clause id="idAF428CB8C90A4477916042CA3D29D69D"><enum>(iv)</enum><header>Effect on
				other requirements</header><text>The granting of a petition by the Secretary
				under this paragraph shall create no presumption with respect to the
				determination of the Secretary that the proposed test procedure meets the
				requirements of paragraphs (2) and (3).</text>
								</clause><clause id="id57FBE0EDDF3943FB8A6A92D153DFD078"><enum>(v)</enum><header>Rulemaking</header>
									<subclause id="idF5EAF59F16A44881A2C3AED4A795DF9F"><enum>(I)</enum><header>In
				general</header><text>Except as provided in subclause (II), not later than the
				end of the 18-month period beginning on the date of granting a petition, the
				Secretary shall publish an amended test method or a determination not to amend
				the test method.</text>

				</paragraph><paragraph id="id8F4AEF93A57F46F7B50CDF1B470486B8"><enum>(2)</enum><text>by striking
			 subsection (c); and</text>
				</paragraph><paragraph id="idAC86B72E8E4047CFAB003D0550EE6A8F"><enum>(3)</enum><text>by redesignating
			 subsections (d) and (e) as subsections (c) and (d), respectively.</text>
				</paragraph></subsection></section><section id="idD3B899AC5CE74F99B3ECB33E3B070DD7"><enum>3.</enum><header>Energy Star
			 program</header>
			<subsection id="id51080B8EEA1843A49719A3AEC0C8FE6B"><enum>(a)</enum><header>Division of
			 responsibilities</header><text>Section 324A(b) of the Energy Policy and
			 Conservation Act (42 U.S.C. 6294a(b)) is amended—</text>
				<paragraph id="id9A07E8F909D549558F53DF602AB16DF8"><enum>(1)</enum><text>by striking
			 <quote>Responsibilities</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="id7F06895880DC4C629639CF7012F94E33" style="OLC">
						<paragraph id="idD8C95F518E4140039543AFD2FF3C5D36"><enum>(1)</enum><header>In
				general</header><text>Responsibilities</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="idE4830C7512A14570A4DC0A87A1ABBC50"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idF26C1AFFFF75415DB1E74349E891C709" style="OLC">
						<paragraph id="idD77C9EC3188843728370AA7F1449E01A"><enum>(2)</enum><header>Update</header><text>Not
				later than 180 days after the date of enactment of this paragraph, the
				Secretary and the Administrator shall update the agreements described in
				paragraph (1), including agreements on provisions that provide—</text>
							<subparagraph id="ID409d6fdbd6aa4cfab568557e4ca4f071"><enum>(A)</enum><text>a clear
				delineation of the roles and responsibilities of each agency that is based on
				the resources and areas of expertise of each agency;</text>
							</subparagraph><subparagraph id="ID0bc64445fbe74df487140ab70f7f16ca"><enum>(B)</enum><text>a formal process
				for high-level decisionmaking that allows each agency to make specific
				programmatic decisions based on the program approaches of each agency;</text>
							</subparagraph><subparagraph id="ID9e57a9dfc0db480ab20eb40236a5dc36"><enum>(C)</enum><text>a facilitated
				annual planning meeting that establishes strategic priorities and goals for the
				coming year;</text>
							</subparagraph><subparagraph id="ID3f56875cf3974b3f80b2df5ed77e8e2d"><enum>(D)</enum><text>a prescribed
				course of action to work through differences and disagreements;</text>
							</subparagraph><subparagraph id="IDf828193a41f74f689bb838d6283906ba"><enum>(E)</enum><text>a facilitated
				biannual program review conducted by a third-party that—</text>
								<clause id="ID6b4a033c5b404b71bb9d37bbbf6dcaa2"><enum>(i)</enum><text>incorporates an
				assessment of program progress, partner acceptance, the achievement of program
				goals, and future strategic planning; and</text>
								</clause><clause id="ID19b0b51b15e743e29934bfb7e660053d"><enum>(ii)</enum><text>is evaluated by
				the Council on Environmental Quality, which shall appraise the findings in the
				review and work with the agencies to resolve any negative findings; and</text>
								</clause></subparagraph><subparagraph id="IDdbe7ac0302024d4fb8faa82ed7e9726f"><enum>(F)</enum><text>a sunset date for
				the new agreement and a timetable for establishing future agreements based on
				priorities at that
				time.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="idAE269F89917C40BABDD8D725EAE67604"><enum>(b)</enum><header>Duties</header><text>Section
			 324A(c) of the Energy Policy and Conservation Act (42 U.S.C. 6294a(c)) is
			 amended—</text>
				<paragraph id="id2A3DB38DC6B14B46BFF351F393115F7D"><enum>(1)</enum><text>in paragraph (6),
			 by striking <quote>and</quote> after the semicolon at the end;</text>
				</paragraph><paragraph id="id30729B7FDBE641459E4214018A26CFE2"><enum>(2)</enum><text>in paragraph (7),
			 by striking the period at the end and inserting a semicolon; and</text>
				</paragraph><paragraph id="id39441DA8B0F84843B2A6DB41259A1E07"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id30B5508005A94E688C576E6F20121185" style="OLC">
						<paragraph id="id4C9F4A0B893440BA91DB4546B8CC3DAE"><enum>(8)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id906E6BD431D94893B5EFBA05E09A3478"><enum>(A)</enum><text>review each product
				category—</text>
								<clause id="id64AC665934104DC6A4D1E71AA4FFB752" indent="up1"><enum>(i)</enum><text>at least once every 3 years;
				or</text>
								</clause><clause id="id76E04D20245048B1857CB4364AD22FEF" indent="up1"><enum>(ii)</enum><text>when market share for an Energy
				Star product category reaches 35 percent;</text>
								</clause></subparagraph><subparagraph id="idF1A94AB0866D403CABA2F29B8EDF47A1" indent="up1"><enum>(B)</enum><text>based on the review—</text>
								<clause id="id0FFDEFC05C01491EBE4BD8B918142A2A"><enum>(i)</enum><text>update and publish the Energy Star
				product criteria for the category; or</text>
								</clause><clause id="idC7BAA9BAB5034B50A47D9EAB4A19F118"><enum>(ii)</enum><text>publish a finding that no update
				is justified with the explanation for the finding; and</text>
								</clause></subparagraph><subparagraph id="ID4a142ebad5184e14bafa9e595330cd6a" indent="up1"><enum>(C)</enum><text>during the initial review for each
				product category, establish an alternative market share to trigger subsequent
				reviews, based on product-specific technology and market attributes;</text>
							</subparagraph></paragraph><paragraph id="idCF976CF6420342D093F0D92C83A3FF3F"><enum>(9)</enum><text>require a
				demonstration of compliance with the Energy Star criteria by qualified
				products, except that—</text>
							<subparagraph id="id0890EFED53EA4AE2B74B90FF4B965704"><enum>(A)</enum><text>the demonstration
				shall be conducted in accordance with appropriate methods determined for each
				product type by the Secretary or the Administrator of the Environmental
				Protection Agency (as appropriate), including—</text>
								<clause id="idACCCA4F64636424882D6C85C48B2A6C2"><enum>(i)</enum><text>third-party
				verification;</text>
								</clause><clause id="id6814A8450CCB4376A67CC20A320E06B8"><enum>(ii)</enum><text>third-party
				certification;</text>
								</clause><clause id="idD662A367DB644370A6D9FD2576F4D99F"><enum>(iii)</enum><text>purchase and
				testing of products from the market; or</text>
								</clause><clause id="id291A53A35B4745B0A483BA653ACB41E2"><enum>(iv)</enum><text>other verified
				testing and compliance approaches; and</text>
								</clause></subparagraph><subparagraph id="id03D08D24088B4108A4F313409304F972"><enum>(B)</enum><text>the Secretary or
				Administrator may exempt specific types of products from the requirements of
				this subparagraph if the Secretary or Administrator finds that—</text>
								<clause id="idB98C8E26C29F4877BC1D6809EF5BA410"><enum>(i)</enum><text>the benefits to
				the Energy Star program of verifying product performance are substantially
				exceeded by the burdens; or</text>
								</clause><clause id="id82097694B03844278A12F0573998435A"><enum>(ii)</enum><text>there are no
				benefits to the Energy Star program; and</text>
								</clause></subparagraph></paragraph><paragraph id="id1A77BEE8D9104F9B831F6071869E7C94"><enum>(10)</enum><text>develop and
				publish standardized building energy audit
				methods.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id9A9D3F5C1E07407EBB7FC65B5604F0DE"><enum>(c)</enum><header>Funding</header><text>Section
			 324A of the Energy Policy and Conservation Act (42 U.S.C. 6294a) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idB3C0BD8256004E638B09F24409922A6F" style="OLC">
					<subsection id="idD8CA0A3839F54CB2A51E8803895C36A5"><enum>(e)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated to
				carry out this section—</text>
						<paragraph id="id4F1594D818C44AB3AD723D2B8A468F34"><enum>(1)</enum><text>to the Department
				of Energy $25,000,000 for each fiscal year; and</text>
						</paragraph><paragraph id="idECE73CD6B81B4633977C979B0166E486"><enum>(2)</enum><text>to the
				Environmental Protection Agency $100,000,000 for each fiscal
				year.</text>
						</paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block>
			</subsection></section><section id="IDe07afd6d6ada43b88a602bec6c7d7d35"><enum>4.</enum><header>Petition for
			 amended standards</header><text display-inline="no-display-inline">Section
			 325(n) of the Energy Policy and Conservation Act (42 U.S.C. 6295(n)) is
			 amended—</text>
			<paragraph id="idCF6A460DA0FB4B8ABB043EAA849754D9"><enum>(1)</enum><text>by redesignating
			 paragraph (3) as paragraph (5); and</text>
			</paragraph><paragraph id="IDb3fc6d6fa48346a59c88d7e35e1b9425"><enum>(2)</enum><text>by inserting
			 after paragraph (2) the following:</text>
				<quoted-block display-inline="no-display-inline" id="id40D1737C954E4A12A077D1D9662C2ED6" style="OLC">
					<paragraph id="idCCFBE5522FFC497DBA8B3E74C54D2408"><enum>(3)</enum><header>Notice of
				decision</header><text>Not later than 180 days after the date of receiving a
				petition, the Secretary shall publish in the Federal Register a notice of, and
				explanation for, the decision of the Secretary to grant or deny the
				petition.</text>
					</paragraph><paragraph id="ID874fd3219af140deae73e35dfa0d8009"><enum>(4)</enum><header>New or amended
				standards</header><text>Not later than 3 years after the date of granting a
				petition for new or amended standards, the Secretary shall publish in the
				Federal Register—</text>
						<subparagraph id="id41B6F8E133C54321A07CDE45096E5C16"><enum>(A)</enum><text>a final rule that
				contains the new or amended standards; or</text>
						</subparagraph><subparagraph id="id3BD35AA5518A44A1A988B5821C0ECDC4"><enum>(B)</enum><text>a determination
				that no new or amended standards are
				necessary.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID719680d8768b4092af63cd18c8a6366d"><enum>5.</enum><header>Portable light
			 fixtures</header>
			<subsection id="IDf0f06e870e7441e98f6134bb002cc431"><enum>(a)</enum><header>Definitions</header><text>Section
			 321 of the Energy Policy and Conservation Act (42 U.S.C. 6291) is amended by
			 adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idCB0B1A8A49584999BBE1085AD1417434" style="OLC">
					<paragraph id="IDb3cb815eeb1943a48c29272802c25ffe"><enum>(67)</enum><header>Art work light
				fixture</header><text>The term <term>art work light fixture</term> means a
				light fixture designed only to be mounted directly to an art work and for the
				purpose of illuminating that art work.</text>
					</paragraph><paragraph id="ID9f7dc58dd08443629ff7966ab2075282"><enum>(68)</enum><header>LED light
				engine</header><text>The term <term>LED light engine</term> or <term>LED light
				engine with integral heat sink</term> means a subsystem of an LED light fixture
				that—</text>
						<subparagraph id="id510C36EC69304FE2B950B77B873939A9"><enum>(A)</enum><text>includes 1 or
				more LED components, including—</text>
							<clause id="id388E541C54B645CB91F4FFA1995FAC3C"><enum>(i)</enum><text>an LED driver
				power source with electrical and mechanical interfaces; and</text>
							</clause><clause id="id5B265CA56E4545AD837D4560495F4056"><enum>(ii)</enum><text>an integral heat
				sink to provide thermal dissipation; and</text>
							</clause></subparagraph><subparagraph id="id90F7B2AE2AA0498582C0621C1353B186"><enum>(B)</enum><text>may be designed
				to accept additional components that provide aesthetic, optical, and
				environmental control.</text>
						</subparagraph></paragraph><paragraph id="IDc6794cfd59344980ad77ece4c7f05f96"><enum>(69)</enum><header>LED light
				fixture</header><text>The term <term>LED light fixture</term> means a complete
				lighting unit consisting of—</text>
						<subparagraph id="idC858D8DC7B74439ABAE95538D8FFED1C"><enum>(A)</enum><text>an LED light
				source with 1 or more LED lamps or LED light engines; and</text>
						</subparagraph><subparagraph id="idB2609770F1384C4EBB6356E72B3D0E12"><enum>(B)</enum><text>parts—</text>
							<clause id="idC82A8325F39846679689B39ABBD03C02"><enum>(i)</enum><text>to distribute the
				light;</text>
							</clause><clause id="id26212E85178145CBA17E7007B35AA4CB"><enum>(ii)</enum><text>to position and
				protect the light source; and</text>
							</clause><clause id="idA17D80223B2E4FC8BC081C64EEDF5D8C"><enum>(iii)</enum><text>to connect the
				light source to electrical power.</text>
							</clause></subparagraph></paragraph><paragraph id="ID869877d40fad4d4c98a1af92fed33564"><enum>(70)</enum><header>Light
				fixture</header><text>The term <term>light fixture</term> means a product
				designed to provide light that includes—</text>
						<subparagraph id="id0437CA22DF9C47D584F5A6006C6911ED"><enum>(A)</enum><text>at least 1 lamp
				socket; and</text>
						</subparagraph><subparagraph id="id4C78D11EC3AE40C59476F3ADF06ED3B7"><enum>(B)</enum><text>parts—</text>
							<clause id="id91DD4E7B0DB14B1A89EFFE15D69E1DBC"><enum>(i)</enum><text>to distribute the
				light;</text>
							</clause><clause id="id3C180B19A40F49E9BC8CFDAAC657DC53"><enum>(ii)</enum><text>position and
				protect 1 or more lamps; and</text>
							</clause><clause id="id65910CF1D31B4B4592C760D1A6DCBCE4"><enum>(iii)</enum><text>to connect 1 or
				more lamps to a power supply.</text>
							</clause></subparagraph></paragraph><paragraph id="ID07f647dbc758429c9661a6dd356524a3"><enum>(71)</enum><header>Portable light
				fixture</header>
						<subparagraph id="id8AE50539B9ED4BE5BD2914D47DE944F1"><enum>(A)</enum><header>In
				general</header><text>The term <term>portable light fixture</term> means a
				light fixture that has a flexible cord and an attachment plug for connection to
				a nominal 120-volt circuit that—</text>
							<clause id="id4FD8C35602954E0C801554A2690EEEA5"><enum>(i)</enum><text>allows the user
				to relocate the product without any rewiring; and</text>
							</clause><clause id="id189052F0402342379BCBEFF973F82086"><enum>(ii)</enum><text>typically can be
				controlled with a switch located on the product or the power cord of the
				product.</text>
							</clause></subparagraph><subparagraph id="idD762304929014ED59FFE585CBD26C105"><enum>(B)</enum><header>Exclusions</header><text>The
				term <term>portable light fixture</term> does not include—</text>
							<clause id="id14745E09171940F1A396AAB17270A03F"><enum>(i)</enum><text>direct plug-in
				night lights, sun or heat lamps, medical or dental lights, portable electric
				hand lamps, signs or commercial advertising displays, photographic lamps,
				germicidal lamps, or light fixtures for marine use or for use in hazardous
				locations (as those terms are defined in ANSI/NFPA 70 of the National
				Electrical Code); or</text>
							</clause><clause id="idBD223D2C424D4C548340C2B5A38BF1AA"><enum>(ii)</enum><text>decorative
				lighting strings, decorative lighting outfits, or electric candles or
				candelabra without lamp shades that are covered by Underwriter Laboratories
				(UL) standard 588, <quote>Seasonal and Holiday Decorative
				Products</quote>.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID8ff1778a12254dd492876d463a1ceb32"><enum>(b)</enum><header>Coverage</header>
				<paragraph id="idB515EAD44E4642198DE22B9DAEE0AF9B"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 322(a) of the
			 Energy Policy and Conservation Act (42 U.S.C. 6292(a)) is amended—</text>

			 (21)</quote>.</text>
				</paragraph></subsection><subsection id="idFE750C8ED78940109627D456FC977ECC"><enum>(c)</enum><header>Test
			 procedures</header><text>Section 323(b) of the Energy Policy and Conservation
			 Act (42 U.S.C. 6293(b)) is amended by adding at the end the following:</text>

				light engines shall be based on Illuminating Engineering Society of North
				America test procedure LM–79, Approved Method for Electrical and Photometric
				Testing of Solid-State Lighting
				Devices.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID4143636bb3bf4256ade6fd250f7299db"><enum>(d)</enum><header>Standards</header><text>Section
			 325 of the Energy Policy and Conservation Act (42 U.S.C. 6295) is
			 amended—</text>
				<paragraph id="IDcb7866f8a0d54abe9480de5c450ce622"><enum>(1)</enum><text>by redesignating
			 subsection (ii) as subsection (kk); and</text>
				</paragraph><paragraph id="IDbb679bab0153434881a8106f289ac148"><enum>(2)</enum><text>by inserting
			 after subsection (hh) the following:</text>

				fixtures</header>

				general</header><text>Subject to paragraphs (2) and (3), portable light
				fixtures manufactured on or after January 1, 2012, shall meet 1 or more of the
				following requirements:</text>
								<subparagraph id="ID184240ade5c34e79ba121427ba8bc162"><enum>(A)</enum><text>Be a fluorescent
				light fixture that meets the requirements of the Energy Star Program for
				Residential Light Fixtures, Version 4.2.</text>
								</subparagraph><subparagraph id="ID70a79e23af98489ca49a0e6f0fe00bdb"><enum>(B)</enum><text>Be equipped with
				only 1 or more GU–24 line-voltage sockets and not be rated for use with
				incandescent lamps of any type, as defined in ANSI standards.</text>
								</subparagraph><subparagraph id="IDf60e72aeb3dc40378350322076f63331"><enum>(C)</enum><text>Be an LED light
				fixture or a light fixture with an LED light engine and comply with the
				following minimum requirements:</text>
									<clause id="IDd024745ad9f74977be1198bd7f881a18"><enum>(i)</enum><text>Minimum light
				output: 200 lumens (initial).</text>
									</clause><clause id="ID795747fe16be47329da9f3d6836efb8f"><enum>(ii)</enum><text>Minimum LED
				light engine efficacy: 40 lumens/watt installed in fixtures that meet the
				minimum light fixture efficacy of 29 lumens/watt or, alternatively, a minimum
				LED light engine efficacy of 60 lumens/watt for fixtures that do not meet the
				minimum light fixture efficacy of 29 lumens/watt.</text>
									</clause><clause id="IDba170ee77a77420891cdde3f16bc8240"><enum>(iii)</enum><text>All portable
				fixtures shall have a minimum LED light fixture efficacy of 29 lumens/watt and
				a minimum LED light engine efficacy of 60 lumens/watt by January 1,
				2016.</text>
									</clause><clause id="ID7194c8b1b3564b12b413e97ab1474643"><enum>(iv)</enum><text>Color Correlated
				Temperature (CCT): 2700K through 4200K.</text>
									</clause><clause id="ID931f3c7581704f2686e090aed2d965e1"><enum>(v)</enum><text>Minimum Color
				Rendering Index (CRI): 75.</text>
									</clause><clause id="IDd61fc873afca4617b6f4fba818bc1ee6"><enum>(vi)</enum><text>Power factor
				equal to or greater than 0.70.</text>
									</clause><clause id="IDef526747f7614657af00a8e081400c5f"><enum>(vii)</enum><text>Portable
				luminaries that have internal power supplies shall have zero standby power when
				the luminaire is turned off.</text>
									</clause><clause id="IDafb8dba0bb0742cfb1cd2432b54e2c27"><enum>(viii)</enum><text>LED light
				sources shall deliver at least 70 percent of initial lumens for at least 25,000
				hours.</text>
									</clause></subparagraph><subparagraph id="IDa661bd64fbd24914935f6f43ae58a4c8"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="idC6661655FB02414F8930AC8C6C2E711E"><enum>(i)</enum><text>Be equipped with an
				ANSI-designated E12, E17, or E26 screw-based socket and be prepackaged and sold
				together with 1 screw-based compact fluorescent lamp or screw-based LED lamp
				for each screw-based socket on the portable light fixture.</text>
									</clause><clause id="ID4dc054124bb243d88c4dd4aa542f2beb" indent="up1"><enum>(ii)</enum><text>The compact fluorescent or LED
				lamps prepackaged with the light fixture shall be fully compatible with any
				light fixture controls incorporated into the light fixture (for example, light
				fixtures with dimmers shall be packed with dimmable lamps).</text>
									</clause><clause id="ID7a8e38de2e1541e0b94ccc50e68aebb5" indent="up1"><enum>(iii)</enum><text>Compact fluorescent lamps
				prepackaged with light fixtures shall meet the requirements of the Energy Star
				Program for CFLs Version 4.0.</text>
									</clause><clause id="idAD6D038ED31E451EA5A1972A917D4FD4" indent="up1"><enum>(iv)</enum><text>Screw-based LED lamps shall comply
				with the minimum requirements described in subparagraph (C).</text>
									</clause></subparagraph><subparagraph id="ID4ab13eb96de0459f9d84820cecf33ea7"><enum>(E)</enum><text>Be equipped with
				1 or more single-ended, non-screw based halogen lamp sockets (line or low
				voltage), a dimmer control or high-low control, and be rated for a maximum of
				100 watts.</text>
								</subparagraph></paragraph><paragraph id="ID3fed2d99d0fe434083afe72b1c8d37a9"><enum>(2)</enum><header>Review</header>
								<subparagraph id="idFCD1AB868E3D42DC80DDFB5B690FB541"><enum>(A)</enum><header>Review</header><text>The
				Secretary shall review the criteria and standards established under paragraph
				(1) to determine if revised standards are technologically feasible and
				economically justified.</text>
								</subparagraph><subparagraph id="id261D67D154034106865A7B2B470AEE08"><enum>(B)</enum><header>Components</header><text>The
				review shall include consideration of whether—</text>
									<clause id="ID44389c6fb43547f6acc281b63622cdf2"><enum>(i)</enum><text>a
				separate compliance procedure is still needed for halogen fixtures described in
				subparagraph (E) and, if necessary, what an appropriate standard for halogen
				fixtures shall be;</text>
									</clause><clause id="IDcbfa0d9ec09845adb950cd6e193a3453"><enum>(ii)</enum><text>the specific
				technical criteria described in subparagraphs (A), (C), and (D)(iii) should be
				modified; and</text>
									</clause><clause id="ID301846a935f74f2ebc8db40b38e5b35c"><enum>(iii)</enum><text>certain
				fixtures should be exempted from the light fixture efficacy standard as of
				January 1, 2016, because the fixtures are primarily decorative in nature (as
				defined by the Secretary) and, even if exempted, are likely to be sold in
				limited quantities.</text>
									</clause></subparagraph><subparagraph id="ID6642fa3f12fb4f1486feb7b4805f187c"><enum>(C)</enum><header>Timing</header>
									<clause id="id79BFF21688EA465AB62503443463852B"><enum>(i)</enum><header>Determination</header><text>Not
				later than January 1, 2014, the Secretary shall publish amended standards, or a
				determination that no amended standards are justified, under this
				subsection.</text>
									</clause><clause id="id8B0659AC71A44425B8EE1A9DAD267E4B"><enum>(ii)</enum><header>Standards</header><text>Any
				standards under this subsection take effect on January 1, 2016.</text>
									</clause></subparagraph></paragraph><paragraph id="ID5cc09a845ac84ad6906901bebfa5e9f2"><enum>(3)</enum><header>Art work light
				fixtures</header><text>Art work light fixtures manufactured on or after January
				1, 2012, shall—</text>
								<subparagraph id="IDb7f0868ae9ac4946aac64eae1a65a824"><enum>(A)</enum><text>comply with
				paragraph (1); or</text>
								</subparagraph><subparagraph id="ID951b25cb2ff843b2b73a8b59a5b4c4f3"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id73230E64355C4BC58295657A9FCFEBE4"><enum>(i)</enum><text>contain only
				ANSI-designated E12 screw-based line-voltage sockets;</text>
									</clause><clause id="ID333eaa4354d949d79cfc2080734d0def" indent="up1"><enum>(ii)</enum><text>have not more than 3
				sockets;</text>
									</clause><clause id="ID17cad45e215448aa90da8fc01917a20a" indent="up1"><enum>(iii)</enum><text>be controlled with an integral
				high/low switch;</text>
									</clause><clause id="ID09d6591908b548efb76cd842c21f2319" indent="up1"><enum>(iv)</enum><text>be rated for not more than 25
				watts if fitted with 1 socket; and</text>
									</clause><clause id="ID49779e5a9f02433fb1b17950f64e31c9" indent="up1"><enum>(v)</enum><text>be rated for not more than 15 watts
				per socket if fitted with 2 or 3 sockets.</text>
									</clause></subparagraph></paragraph><paragraph id="ID563a277ba2b54b90bddb0ff216150c29"><enum>(4)</enum><header>Exception from
				preemption</header><text>Notwithstanding section 327, Federal preemption shall
				not apply to a regulation concerning portable light fixtures adopted by the
				California Energy Commission on or before January 1,
				2014.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="ID9d8a221b1ebb42ec9c07def13c9136bc"><enum>6.</enum><header>GU–24 base
			 lamps</header>
			<subsection id="IDc7214182b80f42099dd7180ab1a0576d"><enum>(a)</enum><header>Definitions</header><text>Section
			 321 of the Energy Policy and Conservation Act (42 U.S.C. 6291) (as amended by
			 section 5(a)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id5F51648C56634168BF74E8210DC100B2" style="OLC">
					<paragraph id="ID0abecea6d6574c2192dbd192b3108fd0"><enum>(72)</enum><header>GU–<enum-in-header>24</enum-in-header></header><text>The
				term <term>GU–24</term>” means the designation of a lamp socket, based on a
				coding system by the International Electrotechnical Commission, under
				which—</text>
						<subparagraph id="idF5563D7028514F0ABF2103A4C6C1B790"><enum>(A)</enum><text><quote>G</quote>
				indicates a holder and socket type with 2 or more projecting contacts, such as
				pins or posts;</text>
						</subparagraph><subparagraph id="id209CCD64D90B46BCAB9E589150B5F71D"><enum>(B)</enum><text><quote>U</quote>
				distinguishes between lamp and holder designs of similar type that are not
				interchangeable due to electrical or mechanical requirements; and</text>
						</subparagraph><subparagraph id="id6A8182CA08914CCD9B3116A99534C82B"><enum>(C)</enum><text>24 indicates the
				distance in millimeters between the electrical contact posts.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6288A1939EC94C99A29C35E99218BB9F"><enum>(73)</enum><header display-inline="yes-display-inline">GU–24 adaptor</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="id32A70F3AB815427FA1BFC1D38B14B753"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The term <term>GU–24
				Adaptor</term> means a 1-piece device, pig-tail, wiring harness, or other such
				socket or base attachment that—</text>
							<clause commented="no" display-inline="no-display-inline" id="idDCC95EF793AA4839A71BE88F5BD8C09C"><enum>(i)</enum><text display-inline="yes-display-inline">connects to a GU–24 socket on 1 end and
				provides a different type of socket or connection on the other end; and</text>

							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4876942292164177A608FA0DC0765D89"><enum>(B)</enum><header>Exclusion</header><text display-inline="yes-display-inline">The term <term>GU–24 Adaptor</term> does
				not include a fluorescent ballast with a GU–24 base.</text>
						</subparagraph></paragraph><paragraph id="IDe2d94cf1bfca4f1cb1b2b287482d11e0"><enum>(74)</enum><header>GU–24 base
				lamp</header><text><term>GU–24 base lamp</term> means a light bulb designed to
				fit in a GU–24
				socket.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID16a0111860c245fc8d0eb706c48b5e90"><enum>(b)</enum><header>Standards</header><text>Section
			 325 of the Energy Policy and Conservation Act (42 U.S.C. 6295) (as amended by
			 section 5(d)) is amended by inserting after subsection (ii) the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idF5544C4A5A7047C398A2CCD012D4E980" style="OLC">
					<subsection id="ID2d9d49d27f6f4c3288466fbc7f11ed3f"><enum>(jj)</enum><header>GU–24 base

				general</header><text>A GU–24 base lamp shall not be an incandescent lamp as
				defined by ANSI.</text>
						</paragraph><paragraph id="id84A91648930D45AC811E04D3707BD908"><enum>(2)</enum><header>GU–24
				adaptors</header><text>GU–24 adaptors shall not adapt a GU–24 socket to any
				other line voltage socket.</text>
						</paragraph></subsection><after-quoted-block>.
				</after-quoted-block></quoted-block>
			</subsection></section><section id="idED1D677BF9AB4A1A823D78F69EB8FC4C"><enum>7.</enum><header>Study of
			 compliance with energy standards for appliances</header>
			<subsection id="idEE8A2968C93240FA801A3E7B2950E248"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of Energy shall conduct a study of the
			 degree of compliance with energy standards for appliances, including an
			 investigation of compliance rates and options for improving compliance,
			 including enforcement.</text>
			</subsection><subsection id="id7D2B7CE036174286B24C0D3A4BCE086E"><enum>(b)</enum><header>Report</header><text>Not
			 later than 18 months after the date of enactment of this Act, the Secretary
			 shall submit to the appropriate committees of Congress a report describing the
			 results of the study, including any recommendations.</text>
			</subsection></section><section id="id641E4F2115A5413EA97CD07AB55509E1"><enum>8.</enum><header>Study of direct
			 current electricity supply in certain buildings</header>
			<subsection id="id24D84EEEA4554EC4BBFAD873026FDBF1"><enum>(a)</enum><header>In
			 general</header><text>The Secretary of Energy shall conduct a study—</text>
				<paragraph id="id738B1D17DA544AC7A92EB1FBC512195F"><enum>(1)</enum><text>of the costs and
			 benefits (including significant energy efficiency, power quality, and other
			 power grid, safety, and environmental benefits) of requiring high-quality,
			 direct current electricity supply in certain buildings; and</text>
				</paragraph><paragraph id="ID3dd0bb81124542c18a8cccd5efd674cd"><enum>(2)</enum><text>to determine, if
			 the requirement described in paragraph (1) is imposed, what the policy and role
			 of the Federal Government should be in realizing those benefits.</text>
				</paragraph></subsection><subsection id="id463C35F051024D32818CD7E39D599E19"><enum>(b)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, the Secretary shall
			 submit to the appropriate committees of Congress a report describing the
			 results of the study, including any recommendations.</text>
			</subsection></section><section id="ID736e128c76ea43efa04e00b09ce3e026"><enum>9.</enum><header>Motor market
			 assessment and commercial awareness program</header>
			<subsection id="id1717A08008174581AE14881D5489F888"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="ID493ab7d061334dc889a9430b01dc6c3b"><enum>(1)</enum><text>electric motor
			 systems account for about half of the electricity used in the United
			 States;</text>
				</paragraph><paragraph id="IDec575dbbaa7c49188336f42e8c422db1"><enum>(2)</enum><text>electric motor
			 energy use is determined by both the efficiency of the motor and the system in
			 which the motor operates;</text>
				</paragraph><paragraph id="ID1edc7180cafb424d95f8e32a0f1f49b7"><enum>(3)</enum><text>Federal
			 Government research on motor end use and efficiency opportunities is more than
			 a decade old; and</text>
				</paragraph><paragraph id="IDd80f6f935fa64a568d28911b35830b2b"><enum>(4)</enum><text>the Census Bureau
			 has discontinued collection of data on motor and generator importation,
			 manufacture, shipment, and sales.</text>
				</paragraph></subsection><subsection id="id1B4082CE1A5041489A88AE8EA8685A93"><enum>(b)</enum><header>Definitions</header><text>In
			 this section:</text>
				<paragraph id="id2AE02B64E8DB4B838934488EF32B0523"><enum>(1)</enum><header>Department</header><text>The
			 term <term>Department</term> means the Department of Energy.</text>
				</paragraph><paragraph id="id56AAD5AFDCF2405E9E85145D61B12FA6"><enum>(2)</enum><header>Interested
			 parties</header><text>The term <term>interested parties</term> includes—</text>
					<subparagraph id="id72E402E09DAD4666A18C95401C232085"><enum>(A)</enum><text>trade
			 associations;</text>
					</subparagraph><subparagraph id="id38981D2BE5914717BB389A503778E3C4"><enum>(B)</enum><text>motor
			 manufacturers;</text>
					</subparagraph><subparagraph id="id57D92AB4F2B44F91A3F91E5BBC4730AF"><enum>(C)</enum><text>motor end
			 users;</text>
					</subparagraph><subparagraph id="id2A5AE2ED27CA4046A187ADB580AC3FAA"><enum>(D)</enum><text>electric
			 utilities; and</text>
					</subparagraph><subparagraph id="idB7656961582B4CD7BF32E720D9EBC3D0"><enum>(E)</enum><text>individuals and
			 entities that conduct energy efficiency programs.</text>
					</subparagraph></paragraph><paragraph id="id243CC428E4074A8E89A97568D2F82507"><enum>(3)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Energy, in consultation with
			 interested parties.</text>
				</paragraph></subsection><subsection id="ID9beaeb7fdb434d9592556713eb838ea2"><enum>(c)</enum><header>Assessment</header><text>The
			 Secretary shall conduct an assessment of electric motors and the electric motor
			 market in the United States that shall—</text>
				<paragraph id="IDb6f882981a9348e58a138355a3c8cf4b"><enum>(1)</enum><text>include important
			 subsectors of the industrial and commercial electric motor market (as
			 determined by the Secretary), including—</text>
					<subparagraph id="IDc06115b4ed78426288da13808c78594a"><enum>(A)</enum><text>the stock of
			 motors and motor-driven equipment;</text>
					</subparagraph><subparagraph id="ID85972da07cba401b8bbb2543c5c401aa"><enum>(B)</enum><text>efficiency
			 categories of the motor population; and</text>
					</subparagraph><subparagraph id="ID7668070612aa435b8df40550368cdf1e"><enum>(C)</enum><text>motor systems
			 that use drives, servos, and other control technologies;</text>
					</subparagraph></paragraph><paragraph id="ID08572e82ee834bd5960c1d3b830ecdeb"><enum>(2)</enum><text>characterize and
			 estimate the opportunities for improvement in the energy efficiency of motor
			 systems by market segment, including opportunities for—</text>
					<subparagraph id="IDcb4fbb5c44554516a7f1b79681736ba9"><enum>(A)</enum><text>expanded use of
			 drives, servos, and other control technologies;</text>
					</subparagraph><subparagraph id="ID608bd1b7a08140999d2b06321b5db4e5"><enum>(B)</enum><text>expanded use of
			 process control, pumps, compressors, fans or blowers, and material handling
			 components; and</text>
					</subparagraph><subparagraph id="IDf8ac8bba14f74fe78fce724d962f6162"><enum>(C)</enum><text>substitution of
			 existing motor designs with existing and future advanced motor designs,
			 including electronically commutated permanent magnet, interior permanent
			 magnet, and switched reluctance motors; and</text>
					</subparagraph></paragraph><paragraph id="IDad41f2069086403ab4d6cd9a8f058fc0"><enum>(3)</enum><text>develop an
			 updated profile of motor system purchase and maintenance practices, including
			 surveying the number of companies that have motor purchase and repair
			 specifications, by company size, number of employees, and sales.</text>
				</paragraph></subsection><subsection id="ID187855ebf6284d908b449a921216ba72"><enum>(d)</enum><header>Recommendations;
			 update</header><text>Based on the assessment conducted under subsection (c),
			 the Secretary shall—</text>
				<paragraph id="ID5e87134e036d4566af4a9d24db762452"><enum>(1)</enum><text>develop—</text>
					<subparagraph id="idC1FB535912514AD1BA5A830E756D54FA"><enum>(A)</enum><text>recommendations
			 to update the detailed motor profile on a periodic basis;</text>
					</subparagraph><subparagraph id="ID122a09f962e241fab15aa17f51f54a17"><enum>(B)</enum><text>methods to
			 estimate the energy savings and market penetration that is attributable to the
			 Save Energy Now Program of the Department; and</text>
					</subparagraph><subparagraph id="ID77831c7f70bf4382aee66e84f96e48d1"><enum>(C)</enum><text>recommendations
			 for the Director of the Census Bureau on market surveys that should be
			 undertaken in support of the motor system activities of the Department;
			 and</text>
					</subparagraph></paragraph><paragraph id="ID6e11df45a90a4c25952dd22263e6276f"><enum>(2)</enum><text>prepare an update
			 to the Motor Master+ program of the Department.</text>
				</paragraph></subsection><subsection id="IDaa8340f174d34168ace523ca809a7208"><enum>(e)</enum><header>Program</header><text>Based
			 on the assessment, recommendations, and update required under subsections (c)
			 and (d), the Secretary shall establish a proactive, national program targeted
			 at motor end-users and delivered in cooperation with interested parties to
			 increase awareness of—</text>
				<paragraph id="ID52c1674b9085418a8a30d1d1871504b4"><enum>(1)</enum><text>the energy and
			 cost-saving opportunities in commercial and industrial facilities using higher
			 efficiency electric motors;</text>
				</paragraph><paragraph id="IDe162a45db2a64dd38d3c721ba9a117d9"><enum>(2)</enum><text>improvements in
			 motor system procurement and management procedures in the selection of higher
			 efficiency electric motors and motor-system components, including drives,
			 controls, and driven equipment; and</text>
				</paragraph><paragraph id="IDdbb2e9c29c57494a82350b4edc79b08e"><enum>(3)</enum><text>criteria for
			 making decisions for new, replacement, or repair motor and motor system
			 components.</text>
