		<section commented="no" display-inline="no-display-inline" id="IDA19DF9CC6C3849B081188F75D591A497" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Taxpayer Abuse Prevention
			 Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="ID3282C27EE8204E8A81AA98306D60C761" section-type="subsequent-section"><enum>2.</enum><header>Prevention of
			 diversion of earned income tax credit benefits</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID58198238D15E4A35B864125AE3E859DE"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 32 of the
			 Internal Revenue Code of 1986 (relating to earned income tax credit) is amended
			 by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="ID8D3840BB0BBD496CAD1F66EBFA91E8A3" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="ID31F8A728F7D741F78BFB1063EB8CB47B"><enum>(n)</enum><header>Prevention of
				diversion of credit benefits</header><text display-inline="yes-display-inline">The right of any individual to any future
				payment of the credit under this section shall not be transferable or
				assignable, at law or in equity, and such right or any moneys paid or payable
				under this section shall not be subject to any execution, levy, attachment,
				garnishment, offset, or other legal process except for any outstanding Federal
				obligation. Any waiver of the protections of this subsection shall be deemed
				null, void, and of no
				effect.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0399F18889AB42EC991D9FB09DFEDF01"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 this section shall take effect on the date of the enactment of this Act.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDDF228CA538D84B35A68CFCF31D8D1A5F" section-type="subsequent-section"><enum>3.</enum><header>Prohibition on debt
			 collection offset</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID4320090673F64F0AB4620FEF5CA14329"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">No person shall,
			 directly or indirectly, individually or in conjunction or in cooperation with
			 another person, engage in the collection of an outstanding or delinquent debt
			 for any creditor or assignee by means of soliciting the execution of,
			 processing, receiving, or accepting an application or agreement for a refund
			 anticipation loan or refund anticipation check that contains a provision
			 permitting the creditor to repay, by offset or other means, an outstanding or
			 delinquent debt for that creditor from the proceeds of the debtor’s Federal tax
			 refund.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0E7838D6BDC847C6A705B64D6951E226"><enum>(b)</enum><header>Refund
			 anticipation loan</header><text display-inline="yes-display-inline">For
			 purposes of subsection (a), the term <term>refund anticipation loan</term>
			 means a loan of money or of any other thing of value to a taxpayer because of
			 the taxpayer’s anticipated receipt of a Federal tax refund.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID5D96F35480DF4818A9050AD8D763C05D"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">This section shall take
			 effect on the date of the enactment of this Act.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID7D07DB6A4DCE4DA9BB862F825DF706A5" section-type="subsequent-section"><enum>4.</enum><header>Prohibition of
			 mandatory arbitration</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID5339955AE78B486292D87BE3AC309EED"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Any person that
			 provides a loan to a taxpayer that is linked to or in anticipation of a Federal
			 tax refund for the taxpayer may not include mandatory arbitration of disputes
			 as a condition for providing such a loan.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4EC4EAB5BC814BE58817EC7C60A2C12D"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">This section shall apply
			 to loans made after the date of the enactment of this Act.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDDDDDD0B56C1648A791D3EF1DBD8C1612" section-type="subsequent-section"><enum>5.</enum><header>Termination of Debt
			 Indicator program</header><text display-inline="no-display-inline">The
			 Secretary of the Treasury shall terminate the Debt Indicator program announced
			 in Internal Revenue Service Notice 99–58.</text>
		</section><section commented="no" display-inline="no-display-inline" id="ID162EF8DAC46742FCB3A93E279D311926" section-type="subsequent-section"><enum>6.</enum><header>Expansion of
			 eligibility for electronic transfer accounts</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID33849DF6A41843CCBDFEBC3FCAA8CABB"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The last sentence of
			 section 3332(j) of title 31, United States Code, is amended by inserting
			 <quote>other than any payment under section 32 of such Code</quote> after
			 <quote>1986</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID83530F573079438A88ED999F4301E439"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 this section shall apply to payments made after the date of the enactment of
			 this Act.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDECC9B7D993DA408A9817FB97DA5AA35D" section-type="subsequent-section"><enum>7.</enum><header>Program to encourage
			 the use of the advance earned income tax credit</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDD4F2D0A05DD04D058CF25644300A4ED6"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Not later than 6
			 months after the date of the enactment of this Act, the Secretary of the
			 Treasury shall, after consultation with such private, nonprofit, and
			 governmental entities as the Secretary determines appropriate, develop and
			 implement a program to encourage the greater utilization of the advance earned
			 income tax credit.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDECC65BEB4C934EFEAD73D470B16326FD"><enum>(b)</enum><header>Reports</header><text display-inline="yes-display-inline">Not later than the date of the
			 implementation of the program described in subsection (a), and annually
			 thereafter, the Secretary of the Treasury shall report to the Committee on
			 Finance of the Senate and the Committee on Ways and Means of the House of
			 Representatives on the elements of such program and progress achieved under
			 such program.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDCEFD897910C04B7992F05F35CFD5FB09"><enum>(c)</enum><header>Authorization
			 of appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated such sums as are necessary to carry out the
			 program described in this section. Any sums so appropriated shall remain
			 available until expended.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDBEE0C2A0D7A7460BBB06FDD68BDA85A5" section-type="subsequent-section"><enum>8.</enum><header>Program to link
			 taxpayers with direct deposit accounts at federally insured depository
			 institutions</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID8C428F87BB4E42E6B6B335B8416D93F5"><enum>(a)</enum><header>Establishment
			 of program</header><text display-inline="yes-display-inline">Not later than 1
			 year after the date of the enactment of this Act, the Secretary of the Treasury
			 shall enter into cooperative agreements with federally insured depository
			 institutions to provide low- and moderate-income taxpayers with the option of
			 establishing low-cost direct deposit accounts through the use of appropriate
			 tax forms.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDE30272DCF2094C28AEAC80E6780E6796"><enum>(b)</enum><header>Federally
			 insured depository institution</header><text display-inline="yes-display-inline">For purposes of this section, the term
			 <term>federally insured depository institution</term> means any insured
			 depository institution (as defined in section 3 of the
			 <act-name parsable-cite="FDIA">Federal Deposit Insurance Act</act-name>
			 (<external-xref legal-doc="usc" parsable-cite="usc/12/1813">12 U.S.C.
			 1813</external-xref>)) and any insured credit union (as defined in
			 <external-xref legal-doc="act" parsable-cite="FCUA/101">section
			 101</external-xref> of the <act-name parsable-cite="FCUA">Federal Credit Union
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/12/1752">12
			 U.S.C. 1752</external-xref>)).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDD8A8AFCABEC84C58955B7B6C728D4C7F"><enum>(c)</enum><header>Operation of
			 program</header><text display-inline="yes-display-inline">In providing for the
			 operation of the program described in subsection (a), the Secretary of the
			 Treasury is authorized—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID507DD45974F347B7BBC56FBC4D5BEE00"><enum>(1)</enum><text display-inline="yes-display-inline">to consult with such private and nonprofit
			 organizations and Federal, State, and local agencies as determined appropriate
			 by the Secretary, and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9FB42D284D524AAF99838D2521D9EE20"><enum>(2)</enum><text display-inline="yes-display-inline">to promulgate such regulations as necessary
			 to administer such program.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDB96274C708F54F53AD04598FFE1F5C96"><enum>(d)</enum><header>Authorization
			 of appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated such sums as are necessary to carry out the
			 program described in this section. Any sums so appropriated shall remain
			 available until expended.</text>
