		<official-title>To amend the Richard B. Russell National School Lunch Act
		  and the Child Nutrition Act of 1966 to require the exclusion of combat pay from
		  income for purposes of determining eligibility for child nutrition programs and
		  the special supplemental nutrition program for women, infants, and children.

		<section id="id4A30223F2DBA4BFDB6B9D715831C17F1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Military Family Nutrition Protection
			 Act of 2009</short-title></quote>.</text>
		</section><section id="id377F36DED741483BBC647747CC71A7E2"><enum>2.</enum><header>Income
			 eligibility</header>
			<subsection id="id2744306FA111453081DEB1D34C157D23"><enum>(a)</enum><header>Child nutrition
			 programs</header><text>Section 9(b) of the Richard B. Russell National School
			 Lunch Act (42 U.S.C. 1758(b)) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="idF28BB4055F6D42AEB9D32D20CDD1CA13" style="OLC">
					<paragraph id="id5015D32B99C94FDAA845C4A95CD91028"><enum>(14)</enum><header>Combat
				pay</header>
						<subparagraph id="idEF8BBF827C6846F69386CA690E503871"><enum>(A)</enum><header>Definition of
				combat pay</header><text>In this paragraph, the term <quote>combat pay</quote>
				means any additional payment under chapter 5 of title 37, United States Code,
				or otherwise designated by the Secretary to be appropriate for exclusion under
				this paragraph, that is received by or from a member of the United States Armed
				Forces deployed to a designated combat zone, if the additional pay—</text>
							<clause id="idDAEEFDFE0A6A4BF782C5789EB78BAAA6"><enum>(i)</enum><text>is the result of
				deployment to or service in a combat zone; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idF4230AC512BA4CF583B6E3134207A613"><enum>(ii)</enum><text>was not received
				immediately prior to serving in a combat zone.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id86B5160CA5DA49CDAD6229B31B145157"><enum>(B)</enum><header>Exclusion</header><text>Combat
				pay shall not be considered to be income for the purpose of determining the
				eligibility for free or reduced price meals of a child who is a member of the
				household of a member of the United States Armed
				Forces.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idC02B10670762456B9493A5B40662880C"><enum>(b)</enum><header>Special
			 supplemental nutrition program for women, infants, and children</header><text display-inline="yes-display-inline">Section 17(d)(2) of the Child Nutrition Act
			 of 1966 (42 U.S.C. 1786(d)(2)) is amended—</text>
				<paragraph id="id9625481741C4489097E5B1F33AB05891"><enum>(1)</enum><text>by redesignating
			 subparagraph (C) as subparagraph (D); and</text>
				</paragraph><paragraph id="id1506166BE8AE41A184B1B76D50D20EE4"><enum>(2)</enum><text>by inserting
			 after subparagraph (B) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id5BEEBABB57D9478A8F14F38304729D39" style="OLC">
						<subparagraph id="idE4BBC288285F4D969E7690768352D18C"><enum>(C)</enum><header>Combat
				pay</header><text>For the purpose of determining income eligibility under this
				section, a State agency shall exclude from income any additional payment under
				chapter 5 of title 37, United States Code, or otherwise designated by the
				Secretary to be appropriate for exclusion under this subparagraph, that is
				received by or from a member of the United States Armed Forces deployed to a
				designated combat zone, if the additional pay—</text>
							<clause id="idE8552D5DC27D4817AFD428777ED95FAF"><enum>(i)</enum><text>is the result of
				deployment to or service in a combat zone; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id253EC7E1775A4BDABD44F91A579909DE"><enum>(ii)</enum><text>was not received
				immediately prior to serving in a combat
				zone.</text>
