			 approved</header>
				<subsection commented="no" display-inline="no-display-inline" id="id6939C62465454732A21586918372CE2B"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Draft Proposed Outer Continental Shelf
			 Oil and Gas Leasing Program 2010–2015 issued by the Secretary of the Interior
			 (referred to in this section as the <quote>Secretary</quote>) under section 18
			 of the Outer Continental Shelf Lands Act (43 U.S.C. 1344) is considered to have
			 been approved by the Secretary as a final oil and gas leasing program under
			 that section.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id3976DF4A5BA6481F9816BF403F210251"><enum>(b)</enum><header display-inline="yes-display-inline">Final environmental impact
			 statement</header><text display-inline="yes-display-inline">The Secretary is
			 considered to have issued a final environmental impact statement for the
			 program described in subsection (a) in accordance with all requirements under
			 section 102(2)(C) of the National Environmental Policy Act of 1969 (42 U.S.C.
			 4332(2)(C)).</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id9F008F949DD042B28F148507F43AB0F4" section-type="subsequent-section"><enum>102.</enum><header display-inline="yes-display-inline">Lease sales</header>
				<subsection commented="no" display-inline="no-display-inline" id="id5F5EC512F6E4420FA59583504DB793CE"><enum>(a)</enum><header display-inline="yes-display-inline">Outer Continental Shelf</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id5F6ECC0885C54EE7A549F289D1EE36E3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in paragraph (2), not
			 later than 30 days after the date of enactment of this Act and every 270 days
			 thereafter, the Secretary of the Interior (referred to in this section as the
			 <quote>Secretary</quote>) shall conduct a lease sale in each outer Continental
			 Shelf planning area for which the Secretary determines that there is a
			 commercial interest in purchasing Federal oil and gas leases for production on
			 the outer Continental Shelf.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDF36D959B0294423B4C301F7476EF6B0"><enum>(2)</enum><header display-inline="yes-display-inline">Subsequent determinations and
			 sales</header><text display-inline="yes-display-inline">If the Secretary
			 determines that there is not a commercial interest in purchasing Federal oil
			 and gas leases for production on the outer Continental Shelf in a planning area
			 under this subsection, not later than 2 years after the date of enactment of
			 the determination and every 2 years thereafter, the Secretary shall—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id8A0D9703C22D4463B4393B6A2AD3D81C"><enum>(A)</enum><text display-inline="yes-display-inline">determine whether there is a commercial
			 interest in purchasing Federal oil and gas leases for production on the outer
			 Continental Shelf in the planning area; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1E510B218E3E4E54A7E4370B789F0EC5"><enum>(B)</enum><text display-inline="yes-display-inline">if the Secretary determines that there is a
			 commercial interest described in subparagraph (A), conduct a lease sale in the
			 planning area.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc3b5493320d54e3684ce516540af43b8"><enum>(b)</enum><header display-inline="yes-display-inline">Renewable energy and
			 mariculture</header><text display-inline="yes-display-inline">The Secretary may
			 conduct commercial lease sales of resources owned by United States—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idD6471F621C5B4768B99949BCA34DBF48"><enum>(1)</enum><text display-inline="yes-display-inline">to produce renewable energy (as defined in
			 section 203(b) of the Energy Policy Act of 2005 (42 U.S.C. 15852(b)));
			 or</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0FE740FA13724ED9AF9AE0366CA443CF"><enum>(2)</enum><text display-inline="yes-display-inline">to cultivate marine organisms in the
			 natural habitat of the organisms.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id602478151091484A87BEE9E6879417E6" section-type="subsequent-section"><enum>103.</enum><header display-inline="yes-display-inline">Coastal Impact assistance program
			 amendments</header><text display-inline="no-display-inline">Section 31 of the
			 Outer Continental Shelf Lands Act (43 U.S.C. 1356a) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idE3A7E9D472BE47239BB2595925CDED72"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (c), by adding at the end the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id5F99EC74FC1D448596444D532AA1A4DF" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="id3563167E9A9D4C7188BF570486F9692B"><enum>(5)</enum><header display-inline="yes-display-inline">Application requirements; availability of
				funding</header><text display-inline="yes-display-inline">On approval of a plan
				by the Secretary under this section, the producing State shall—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idEB500AB69DCE458E8BA63C5CF1448335"><enum>(A)</enum><text display-inline="yes-display-inline">not be subject to any additional
				application or other requirements (other than notifying the Secretary of which
				projects are being carried out under the plan) to receive the payments;
				and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5F9E948B947D4C5D9646E6703F71E414"><enum>(B)</enum><text display-inline="yes-display-inline">be immediately eligible to receive payments
				under this section.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id482BF1991D7C4F54943A455F2AA104B8"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id8E5F1F561E2B4A78855045C68BEB4480" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="id7C2DD3ACECD2469D92C567F4CDF94735"><enum>(e)</enum><header display-inline="yes-display-inline">Funding</header>
							<paragraph commented="no" display-inline="no-display-inline" id="idB57E7310476E4BCBA0DB37AF3B080A34"><enum>(1)</enum><header display-inline="yes-display-inline">Streamlining</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="id5D5229F96F3B464F9B4A18C2A370F5D6"><enum>(A)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
				enactment of this subsection, the Secretary of the Interior (acting through the
				Director of the Minerals Management Service) (referred to in this subsection as
				the <quote>Secretary</quote>) shall develop a plan that addresses streamlining
				the process by which payments are made under this section, including
				recommendations for—</text>
									<clause commented="no" display-inline="no-display-inline" id="id7C09C097D4DA48EA9F761E645E5D1CE2"><enum>(i)</enum><text display-inline="yes-display-inline">decreasing the time required to approve
				plans submitted under subsection (c)(1);</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id8CB3E4FB96D54C69BFFD69A7C6572837"><enum>(ii)</enum><text display-inline="yes-display-inline">ensuring that allocations to producing
				States under subsection (b) are adequately funded; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id473DA2BC398E4C32A26DC66B9B00C69C"><enum>(iii)</enum><text display-inline="yes-display-inline">any modifications to the authorized uses
				for payments under subsection (d).</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9C3BFCEA3BE844BD8B9518E0C26DEDA1"><enum>(B)</enum><header display-inline="yes-display-inline">Clean water</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
				enactment of this subsection, the Secretary and the Administrator of the
				Environmental Protection Agency shall jointly develop procedures for
				streamlining the permit process required under the
				<act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name>
				(33 U.S.C. 1251 et seq.) and State laws for restoration projects that are
				included in an approved plan under subsection (c).</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id93B1C75A8D8B43259B6437769F39DDB7"><enum>(C)</enum><header display-inline="yes-display-inline">Environmental requirements</header><text display-inline="yes-display-inline">A project funded under this section that
				does not involve wetlands shall not be subject to environmental review
				requirements under Federal law.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7f375346ae0146699d1656bb9c3b4c6d"><enum>(2)</enum><header display-inline="yes-display-inline">Cost-sharing requirements</header><text display-inline="yes-display-inline">Any amounts made available to producing
				States under this section may be used to meet the cost-sharing requirements of
				other Federal grant programs, including grant programs that support coastal
				wetland protection and restoration.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8b367a1acd414f9c835b0ac0e436d99f"><enum>(3)</enum><header display-inline="yes-display-inline">Expedited funding</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
				enactment of this subsection, the Secretary shall develop a procedure to
				provide expedited funding to projects under this section based on estimated
				revenues to ensure that the projects may—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idDB53DF6308BF484786BE4EF0B71F15BC"><enum>(A)</enum><text display-inline="yes-display-inline">secure additional funds from other sources;
				and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9589B247E6B844C3980890F75E103CBE"><enum>(B)</enum><text display-inline="yes-display-inline">use the amounts made available under this
				section on
				receipt.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="idE7A5DD0D671D4F11AC7296A60BFA3BDA" section-type="subsequent-section"><enum>104.</enum><header display-inline="yes-display-inline">Seaward boundaries of States</header>
				<subsection commented="no" display-inline="no-display-inline" id="id11F0408F00D044C3B365ADC808FDF04B"><enum>(a)</enum><header display-inline="yes-display-inline">Seaward boundaries</header><text display-inline="yes-display-inline">Section 4 of the Submerged Lands Act (43
			 U.S.C. 1312) is amended by striking <quote>three geographical miles</quote>
			 each place it appears and inserting <quote>12 nautical miles</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id8F4950F4DDF243BAA990DD63B05E8323"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendments</header><text display-inline="yes-display-inline">Section 2 of the Submerged Lands Act (43
			 U.S.C. 1301) is amended—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id9D16FF85217D4056ADD7E769215EB0FA"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(2), by striking
			 <quote>three geographical miles</quote> and inserting <quote>12 nautical
			 miles</quote>; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5A1E519C07C5406A8ACBB94FA08482F3"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (b)—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idF7D98586776649CDA62AC225D815BECF"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>three geographical
			 miles</quote> and inserting <quote>12 nautical miles</quote>; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id272A38538B254375BB2DFF34307D633C"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>three marine
			 leagues</quote> and inserting <quote>12 nautical miles</quote>.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID708a3ed81d424cf38dc556e90d305ffd"><enum>(c)</enum><header display-inline="yes-display-inline">Effect of amendments</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idA0681D41BE774863B84EF733B275CEAB"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraphs (2) through (4), the
			 amendments made by this section shall not effect Federal oil and gas mineral
			 rights.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEE9D59030BEC47F2B9D04E8DC0797E5E"><enum>(2)</enum><header display-inline="yes-display-inline">Submerged
			 land</header><text display-inline="yes-display-inline">Submerged land within
			 the seaward boundaries of States shall be—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idEED94EE2EDED418591A546910554AE6E"><enum>(A)</enum><text display-inline="yes-display-inline">subject to Federal oil and gas mineral
			 rights to the extent provided by law;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1E14D9362D904B17BE6C159E4A08FAF9"><enum>(B)</enum><text display-inline="yes-display-inline">considered to be part of the Federal outer
			 Continental Shelf for purposes of the Outer Continental Shelf Lands Act (43
			 U.S.C. 1331 et seq.); and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id768E9916E95D475D80A787E5D05ABE73"><enum>(C)</enum><text display-inline="yes-display-inline">subject to leasing under the authority of
			 that Act and to laws applicable to the leasing of the oil and gas resources of
			 the Federal outer Continental Shelf.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD368230B533E40D7803C7DB601C73306"><enum>(3)</enum><header display-inline="yes-display-inline">Existing leases</header><text display-inline="yes-display-inline">The amendments made by this section shall
			 not affect any Federal oil and gas lease in effect on the date of enactment of
			 this Act.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFE9140DA8FCD4409B8D2D3368DDB3017"><enum>(4)</enum><header display-inline="yes-display-inline">Taxation</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="idDBEBC1C29D4F46A3B35F70B887653442"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), a State may
			 exercise all of the sovereign powers of taxation of the State within the entire
			 extent of the seaward boundaries of the State (as extended by the amendments
			 made by this section).</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAA92EA2FF771400C8BC0D30FF58105AF"><enum>(B)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">Nothing in this paragraph affects the
			 authority of a State to tax any Federal oil and gas lease in effect on the date
			 of enactment of this Act.</text>
						</subparagraph></paragraph></subsection></section></title><title commented="no" id="id32DD3202C77B4A798C322E939EECEE9B" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Leasing program for land within Coastal
			 Plain</header>
			<section commented="no" display-inline="no-display-inline" id="idCADB227FC64440FCAAFD0AC769170EF4" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this title:</text>

			 that area identified as the <quote>1002 Coastal Plain Area</quote> on the
			 map.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3B849A80BA414F34801DAE37309A6E7C"><enum>(2)</enum><header display-inline="yes-display-inline">Federal agreement</header><text display-inline="yes-display-inline">The term <term>Federal Agreement</term>
			 means the Federal Agreement and Grant Right-of-Way for the Trans-Alaska
			 Pipeline issued on January 23, 1974, in accordance with section 28 of the
			 Mineral Leasing Act (30 U.S.C. 185) and the Trans-Alaska Pipeline Authorization
			 Act (43 U.S.C. 1651 et seq.).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC89E92C5464749478E6D196DA201F91D"><enum>(3)</enum><header display-inline="yes-display-inline">Final statement</header><text display-inline="yes-display-inline">The term <term>Final Statement</term> means
			 the final legislative environmental impact statement on the Coastal Plain,
			 dated April 1987, and prepared pursuant to section 1002 of the Alaska National
			 Interest Lands Conservation Act (16 U.S.C. 3142) and section 102(2)(C) of the
			 National Environmental Policy Act of 1969 (42 U.S.C. 4332(2)(C)).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4A90AA1D15804830873597B8597F9985"><enum>(4)</enum><header display-inline="yes-display-inline">Map</header><text display-inline="yes-display-inline">The term <term>map</term> means the map
			 entitled <quote>Arctic National Wildlife Refuge</quote>, dated September 2005,
			 and prepared by the United States Geological Survey.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0981944349BC471FB0E176FC3632E82A"><enum>(5)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of the Interior (or the designee of the Secretary), acting through
			 the Director of the Bureau of Land Management, in consultation with the
			 Director of the United States Fish and Wildlife Service.</text>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="idB5ED892177BB477BBDB0CAA953E879C2" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Leasing program for land within the Coastal
			 Plain</header>
				<subsection commented="no" display-inline="no-display-inline" id="id447C66D7D8F4424484E5FC0EEBBCE5F0"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall take such actions as
			 are necessary—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id01DA9E728D7C4EA0A71EFDB54B4D12B5"><enum>(1)</enum><text display-inline="yes-display-inline">to establish and implement, in accordance
			 with this title, a competitive oil and gas leasing program that will result in
			 an environmentally sound program for the exploration, development, and
			 production of the oil and gas resources of the Coastal Plain; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8D0D4CD42DC84F6CB7B227B05B333CBC"><enum>(2)</enum><text display-inline="yes-display-inline">to administer this title through
			 regulations, lease terms, conditions, restrictions, prohibitions, stipulations,
			 and other provisions that—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id9884F6B2F32C4BDD817D1DC25DD11A47"><enum>(A)</enum><text display-inline="yes-display-inline">ensure the oil and gas exploration,
			 development, and production activities on the Coastal Plain will result in no
			 significant adverse effect on fish and wildlife, their habitat, subsistence
			 resources, and the environment; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBBE659ED6D1343608DBFB28C24C6259B"><enum>(B)</enum><text display-inline="yes-display-inline">require the application of the best
			 commercially available technology for oil and gas exploration, development, and
			 production to all exploration, development, and production operations under
			 this title in a manner that ensures the receipt of fair market value by the
			 public for the mineral resources to be leased.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id57DB881AEACE40FCB2BF606AB027D594"><enum>(b)</enum><header display-inline="yes-display-inline">Repeal</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idFB56FE056CF04CD984419B7535E3C724"><enum>(1)</enum><header display-inline="yes-display-inline">Repeal</header><text display-inline="yes-display-inline">Section 1003 of the Alaska National
			 Interest Lands Conservation Act of 1980 (16 U.S.C. 3143) is repealed.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4F3B5E6E12254312AC1F3E221CA14922"><enum>(2)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">The table of contents contained in section
			 1 of that Act (16 U.S.C. 3101 note) is amended by striking the item relating to
			 section 1003.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id75650561677C4A4BA9386AD8FB0644F2"><enum>(3)</enum><header display-inline="yes-display-inline">Compliance with NEPA for other
			 actions</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="idB436B291FE624412B583CD936C6106A6"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Before conducting the first lease sale
			 under this title, the Secretary shall prepare an environmental impact statement
			 in accordance with the National Environmental Policy Act of 1969 (42 U.S.C.
			 4321 et seq.) with respect to the actions authorized by this title that are not
			 referred to in paragraph (2).</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idDE9341C0034C4794AF298889678AC076"><enum>(B)</enum><header display-inline="yes-display-inline">Identification and analysis</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 in carrying out this paragraph, the Secretary shall not be required—</text>
							<clause commented="no" display-inline="no-display-inline" id="id53B01CA665AB453F9C98A9A025B94DE8"><enum>(i)</enum><text display-inline="yes-display-inline">to identify nonleasing alternative courses
			 of action; or</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id8C9F436824154B8DB3ECE3C25E1912E6"><enum>(ii)</enum><text display-inline="yes-display-inline">to analyze the environmental effects of
			 those courses of action.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAE4EB39E59654430991A1F86A6A80211"><enum>(C)</enum><header display-inline="yes-display-inline">Identification of preferred
			 action</header><text display-inline="yes-display-inline">Not later than 18
			 months after the date of enactment of this Act, the Secretary shall—</text>
							<clause commented="no" display-inline="no-display-inline" id="idB16A806F87D248E5B5412BD67C6BAA95"><enum>(i)</enum><text display-inline="yes-display-inline">identify only a preferred action and a
			 single leasing alternative for the first lease sale authorized under this
			 title; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idACAFD3FB01DE47F7BA899DD04939CE14"><enum>(ii)</enum><text display-inline="yes-display-inline">analyze the environmental effects and
			 potential mitigation measures for those 2 alternatives.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id540AC44933DD4D2C9F22075FB3F4B366"><enum>(D)</enum><header display-inline="yes-display-inline">Public comments</header><text display-inline="yes-display-inline">In carrying out this paragraph, the
			 Secretary shall consider only public comments that are filed not later than 20
			 days after the date of publication of a draft environmental impact
			 statement.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id96F84E475302442A98D4D8DE5E923346"><enum>(E)</enum><header display-inline="yes-display-inline">Effect of compliance</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 compliance with this paragraph shall be considered to satisfy all requirements
			 for the analysis and consideration of the environmental effects of proposed
			 leasing under this title.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7E2E61A3B9AA43569D247B613C682E25"><enum>(c)</enum><header display-inline="yes-display-inline">Relationship to State and local
			 authority</header><text display-inline="yes-display-inline">Nothing in this
			 title expands or limits any State or local regulatory authority.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id21F4372F73D34EB39195F0FC1E65F4CB"><enum>(d)</enum><header display-inline="yes-display-inline">Special areas</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id9196B2E7C5E2429880B37B1DF73CF1ED"><enum>(1)</enum><header display-inline="yes-display-inline">Designation</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="id1F8226B68D5E401EA2202E26A66A6606"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary, after consultation with the
			 State of Alaska, the North Slope Borough, Alaska, and the City of Kaktovik,
			 Alaska, may designate not more than 45,000 acres of the Coastal Plain as a
			 special area if the Secretary determines that the special area would be of such
			 unique character and interest as to require special management and regulatory
			 protection.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id645D5D70E5734F4EBF89A1A5BDBF1F0D"><enum>(B)</enum><header display-inline="yes-display-inline">Sadlerochit spring area</header><text display-inline="yes-display-inline">The Secretary shall designate as a special
			 area in accordance with subparagraph (A) the Sadlerochit Spring area,
			 comprising approximately 4,000 acres as depicted on the map.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0FF345C91E9E4AA4A5680F6DF05B603D"><enum>(2)</enum><header display-inline="yes-display-inline">Management</header><text display-inline="yes-display-inline">The Secretary shall manage each special
			 area designated under this subsection in a manner that preserves the unique and
			 diverse character of the area, including fish, wildlife, subsistence resources,
			 and cultural values of the area.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id28048AB3A93443DFA940A0D5228F86BE"><enum>(3)</enum><header display-inline="yes-display-inline">Exclusion from leasing or surface
			 occupancy</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="id2AEEEA80FE42476CB0C163372BD5A4CE"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may exclude any special area
			 designated under this subsection from leasing.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2677AE33AB4C4B6A90AEE21F38C86022"><enum>(B)</enum><header display-inline="yes-display-inline">No surface occupancy</header><text display-inline="yes-display-inline">If the Secretary leases all or a portion of
			 a special area for the purposes of oil and gas exploration, development,
			 production, and related activities, there shall be no surface occupancy of the
			 land comprising the special area.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id19FBFCE2B53A462193AEE3EECC247984"><enum>(4)</enum><header display-inline="yes-display-inline">Directional drilling</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
			 subsection, the Secretary may lease all or a portion of a special area under
			 terms that permit the use of horizontal drilling technology from sites on
			 leases located outside the special area.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id1032572C18104062ACB9A322C538282A"><enum>(e)</enum><header display-inline="yes-display-inline">Limitation on closed areas</header><text display-inline="yes-display-inline">The Secretary may not close land within the
			 Coastal Plain to oil and gas leasing or to exploration, development, or
			 production except in accordance with this title.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id8867EA21F0F148DCA712E5845FF2ACDE"><enum>(f)</enum><header display-inline="yes-display-inline">Regulations</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id9AEED4E8648F4EF1BE5CCBB03E346535"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 15 months after the date of
			 enactment of this Act, the Secretary shall promulgate such regulations as are
			 necessary to carry out this title, including rules and regulations relating to
			 protection of the fish and wildlife, fish and wildlife habitat, subsistence
			 resources, and environment of the Coastal Plain.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id840FCF8E3A4C427684DECD291A9239B1"><enum>(2)</enum><header display-inline="yes-display-inline">Revision of regulations</header><text display-inline="yes-display-inline">The Secretary shall periodically review
			 and, as appropriate, revise the rules and regulations issued under paragraph
			 (1) to reflect any significant biological, environmental, scientific or
			 engineering data that come to the attention of the Secretary.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idD41171CACFFD4026A524F7B982BC068F" section-type="subsequent-section"><enum>203.</enum><header display-inline="yes-display-inline">Lease sales</header>
				<subsection commented="no" display-inline="no-display-inline" id="id2E5260849FAC4F92AC2B4F80503E555B"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Land may be leased pursuant to this title
			 to any person qualified to obtain a lease for deposits of oil and gas under the
			 Mineral Leasing Act (30 U.S.C. 181 et seq.).</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idB1790E41E43C4A6284720FBFA9170855"><enum>(b)</enum><header display-inline="yes-display-inline">Procedures</header><text display-inline="yes-display-inline">The Secretary shall, by regulation,
			 establish procedures for—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id91ADC6E250F44426B06D2F242DCA5A54"><enum>(1)</enum><text display-inline="yes-display-inline">receipt and consideration of sealed
			 nominations for any area in the Coastal Plain for inclusion in, or exclusion
			 (as provided in subsection (c)) from, a lease sale;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD4FCC9A70F1C4E198018ED109E9ACB25"><enum>(2)</enum><text display-inline="yes-display-inline">the holding of lease sales after that
			 nomination process; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6EF1C456DC484A38B12D37603FDBC85A"><enum>(3)</enum><text display-inline="yes-display-inline">public notice of and comment on designation
			 of areas to be included in, or excluded from, a lease sale.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id165D94D3C80849F98D813847AB813544"><enum>(c)</enum><header display-inline="yes-display-inline">Lease sale bids</header><text display-inline="yes-display-inline">Bidding for leases under this title shall
			 be by sealed competitive cash bonus bids.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id5ECCB75F79BE44B8A15D03EC3893EE5F"><enum>(d)</enum><header display-inline="yes-display-inline">Acreage minimum in first sale</header><text display-inline="yes-display-inline">For the first lease sale under this title,
			 the Secretary shall offer for lease those tracts the Secretary considers to
			 have the greatest potential for the discovery of hydrocarbons, taking into
			 consideration nominations received pursuant to subsection (b)(1), but in no
			 case less than 200,000 acres.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idC60626D590924879912A14B2E32FBE02"><enum>(e)</enum><header display-inline="yes-display-inline">Timing of lease sales</header><text display-inline="yes-display-inline">The Secretary shall—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id551A22CE9CEB44F48E2484CC18B353FE"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 22 months after the date of
			 enactment of this Act, conduct the first lease sale under this title;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id568102B8AB254A2FA44E2893DC5B2AD6"><enum>(2)</enum><text display-inline="yes-display-inline">not later than 90 days after the date of
			 the completion of the sale, evaluate the bids in the sale and issue leases
			 resulting from the sale; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD5F47FEFE74642F88FCA6357C976267C"><enum>(3)</enum><text display-inline="yes-display-inline">conduct additional sales at appropriate
			 intervals if sufficient interest in exploration or development exists to
			 warrant the conduct of the additional sales.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id06EFA5E8198E48E59E92A6AB0BFC2D79" section-type="subsequent-section"><enum>204.</enum><header display-inline="yes-display-inline">Grant of leases by the Secretary</header>
				<subsection commented="no" display-inline="no-display-inline" id="id81E6C2F050CB40AE97B02FCC0056A36A"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">On payment by a lessee of such bonus as may
			 be accepted by the Secretary, the Secretary may grant to the highest
			 responsible qualified bidder in a lease sale conducted pursuant to section 203
			 a lease for any land on the Coastal Plain.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id0BAE1AA3FE224DA3A90A6B9FEA0098A2"><enum>(b)</enum><header display-inline="yes-display-inline">Subsequent transfers</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id307ED30B857741DFA3C943C42B6B1F74"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">No lease issued under this title may be
			 sold, exchanged, assigned, sublet, or otherwise transferred except with the
			 approval of the Secretary.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE251E5A0F8644EBA80EE46558E24E1B3"><enum>(2)</enum><header display-inline="yes-display-inline">Condition for approval</header><text display-inline="yes-display-inline">Before granting any approval described in
			 paragraph (1), the Secretary shall consult with and give due consideration to
			 the opinion of the Attorney General.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idB0627BFD175147ACAA8275ED9E2770F7" section-type="subsequent-section"><enum>205.</enum><header display-inline="yes-display-inline">Lease terms and conditions</header><text display-inline="no-display-inline">An oil or gas lease issued pursuant to this
			 title shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id785F82C060FB49A2AC033A09590D2322"><enum>(1)</enum><text display-inline="yes-display-inline">provide for the payment of a royalty of not
			 less than 12<fraction>1/2</fraction> percent of the amount or value of the
			 production removed or sold from the lease, as determined by the Secretary in
			 accordance with regulations applicable to other Federal oil and gas
			 leases;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id615C3E1839A64F69A0BF02DE3EBA2321"><enum>(2)</enum><text display-inline="yes-display-inline">provide that the Secretary may close, on a
			 seasonal basis, such portions of the Coastal Plain to exploratory drilling
			 activities as are necessary to protect caribou calving areas and other species
			 of fish and wildlife;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id276EF7BC660E474ABD9DE3F31E8C6583"><enum>(3)</enum><text display-inline="yes-display-inline">require that each lessee of land within the
			 Coastal Plain shall be fully responsible and liable for the reclamation of land
			 within the Coastal Plain and any other Federal land that is adversely affected
			 in connection with exploration, development, production, or transportation
			 activities within the Coastal Plain conducted by the lessee or by any of the
			 subcontractors or agents of the lessee;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF0EFDFB1F8994870B895DEC5AA34387F"><enum>(4)</enum><text display-inline="yes-display-inline">provide that the lessee may not delegate or
			 convey, by contract or otherwise, that reclamation responsibility and liability
			 to another person without the express written approval of the Secretary;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDE935587D6ED4BE1A782544B9A14C4AF"><enum>(5)</enum><text display-inline="yes-display-inline">provide that the standard of reclamation
			 for land required to be reclaimed under this title shall be, to the maximum
			 extent practicable—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idDE1E14DC08014715AEA97C1C473107F7"><enum>(A)</enum><text display-inline="yes-display-inline">a condition capable of supporting the uses
			 that the land was capable of supporting prior to any exploration, development,
			 or production activities; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFF1A775E9FD845FFA484AC3902699299"><enum>(B)</enum><text display-inline="yes-display-inline">on application by the lessee, to a higher
			 or better standard, as approved by the Secretary;</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD85FBBEB589449008D1CDB90476180DB"><enum>(6)</enum><text display-inline="yes-display-inline">contain terms and conditions relating to
			 protection of fish and wildlife, fish and wildlife habitat, subsistence
			 resources, and the environment as required under section 202(a)(2);</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id623E12A50A3342829BCA196A7903D009"><enum>(7)</enum><text display-inline="yes-display-inline">provide that each lessee, and each agent
			 and contractor of a lessee, use their best efforts to provide a fair share of
			 employment and contracting for Alaska Natives and Alaska Native Corporations
			 from throughout the State of Alaska, as determined by the level of obligation
			 previously agreed to in the Federal Agreement; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id81337DFCD9354C11B0F1612F91445F40"><enum>(8)</enum><text display-inline="yes-display-inline">contain such other provisions as the
			 Secretary determines to be necessary to ensure compliance with this title and
			 the regulations promulgated under this title.</text>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="id98A5615E3D934AB280F86158DE2C65B9" section-type="subsequent-section"><enum>206.</enum><header display-inline="yes-display-inline">Coastal plain environmental
			 protection</header>
				<subsection commented="no" display-inline="no-display-inline" id="id4332E4F54FD64EE8B83BCF4CB2B26ACD"><enum>(a)</enum><header display-inline="yes-display-inline">No significant adverse effect standard To
			 govern authorized coastal plain activities</header><text display-inline="yes-display-inline">In accordance with section 202, the
			 Secretary shall administer this title through regulations, lease terms,
			 conditions, restrictions, prohibitions, stipulations, or other provisions
			 that—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id14B65589E9FC4A28A329A0A8F7A992E1"><enum>(1)</enum><text display-inline="yes-display-inline">ensure, to the maximum extent practicable,
			 that oil and gas exploration, development, and production activities on the
			 Coastal Plain will result in no significant adverse effect on fish and
			 wildlife, fish and wildlife habitat, and the environment;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id665268F9063141718E106938DF4F4063"><enum>(2)</enum><text display-inline="yes-display-inline">require the application of the best
			 commercially available technology for oil and gas exploration, development, and
			 production on all new exploration, development, and production operations;
			 and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD3ED3522716F4ED1B2BA433E27DD8702"><enum>(3)</enum><text display-inline="yes-display-inline">ensure that the maximum surface acreage
			 covered in connection with the leasing program by production and support
			 facilities, including airstrips and any areas covered by gravel berms or piers
			 for support of pipelines, does not exceed 2,000 acres on the Coastal
			 Plain.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idD9344C104D1346E78B898373A8BAE61E"><enum>(b)</enum><header display-inline="yes-display-inline">Site-specific assessment and
			 mitigation</header><text display-inline="yes-display-inline">The Secretary
			 shall require, with respect to any proposed drilling and related activities on
			 the Coastal Plain, that—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id674A2DE3EB694DD0B76F8C7FA0E3DDE2"><enum>(1)</enum><text display-inline="yes-display-inline">a site-specific analysis be made of the
			 probable effects, if any, that the drilling or related activities will have on
			 fish and wildlife, fish and wildlife habitat, subsistence resources,
			 subsistence uses, and the environment;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB6ADE11095F04BC3B7C26A69A0D54728"><enum>(2)</enum><text display-inline="yes-display-inline">a plan be implemented to avoid, minimize,
			 and mitigate (in that order and to the maximum extent practicable) any
			 significant adverse effect identified under paragraph (1); and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0377A8366CC84C8A974D823391C0BE09"><enum>(3)</enum><text display-inline="yes-display-inline">the development of the plan shall occur
			 after consultation with the 1 or more agencies having jurisdiction over matters
			 mitigated by the plan.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idCE452C3F5A5E4898ACFB114967466A06"><enum>(c)</enum><header display-inline="yes-display-inline">Regulations To protect coastal plain fish
			 and wildlife resources, subsistence users, and the environment</header><text display-inline="yes-display-inline">Before implementing the leasing program
			 authorized by this title, the Secretary shall prepare and issue regulations,
			 lease terms, conditions, restrictions, prohibitions, stipulations, or other
			 measures designed to ensure, to the maximum extent practicable, that the
			 activities carried out on the Coastal Plain under this title are conducted in a
			 manner consistent with the purposes and environmental requirements of this
			 title.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id5340B76C91444A41B2B5DEB5CADE21C9"><enum>(d)</enum><header display-inline="yes-display-inline">Compliance with Federal and State
			 environmental laws and other requirements</header><text display-inline="yes-display-inline">The proposed regulations, lease terms,
			 conditions, restrictions, prohibitions, and stipulations for the leasing
			 program under this title shall require—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id1BF3184CE58B4E259A73877B071C0DE9"><enum>(1)</enum><text display-inline="yes-display-inline">compliance with all applicable provisions
			 of Federal and State environmental law (including regulations);</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9031E67AB9A5433EB23311F8B55F6344"><enum>(2)</enum><text display-inline="yes-display-inline">implementation of and compliance
			 with—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idDE1366E9D4324086A922CAEB856BECA2"><enum>(A)</enum><text display-inline="yes-display-inline">standards that are at least as effective as
			 the safety and environmental mitigation measures, as described in items 1
			 through 29 on pages 167 through 169 of the Final Statement, on the Coastal
			 Plain;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idBB1DC9F59D8545EDAD803E101057A424"><enum>(B)</enum><text display-inline="yes-display-inline">seasonal limitations on exploration,
			 development, and related activities, as necessary, to avoid significant adverse
			 effects during periods of concentrated fish and wildlife breeding, denning,
			 nesting, spawning, and migration;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idEDA7DEF819944943AE69FD1FAA20825F"><enum>(C)</enum><text display-inline="yes-display-inline">design safety and construction standards
			 for all pipelines and any access and service roads that minimize, to the
			 maximum extent practicable, adverse effects on—</text>
							<clause commented="no" display-inline="no-display-inline" id="id26B45DF447384AA5A8B36E1FB0AC13F7"><enum>(i)</enum><text display-inline="yes-display-inline">the passage of migratory species (such as
			 caribou); and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id803E199EFE7B4ECEA9B730CFFDC7A4B0"><enum>(ii)</enum><text display-inline="yes-display-inline">the flow of surface water by requiring the
			 use of culverts, bridges, or other structural devices;</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1BAEE5746C5848DEB9F20D610BA57FC3"><enum>(D)</enum><text display-inline="yes-display-inline">prohibitions on general public access to,
			 and use of, all pipeline access and service roads;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4F15C5762DDA457AAD4107CDE35D239D"><enum>(E)</enum><text display-inline="yes-display-inline">stringent reclamation and rehabilitation
			 requirements in accordance with this title for the removal from the Coastal
			 Plain of all oil and gas development and production facilities, structures, and
			 equipment on completion of oil and gas production operations, except in a case
			 in which the Secretary determines that those facilities, structures, or
			 equipment—</text>
							<clause commented="no" display-inline="no-display-inline" id="idF66946EE41AF4DDCAF426E1476995F68"><enum>(i)</enum><text display-inline="yes-display-inline">would assist in the management of the
			 Arctic National Wildlife Refuge; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id6EEE6169EB564BB7964D7E86FFBAC8AF"><enum>(ii)</enum><text display-inline="yes-display-inline">are donated to the United States for that
			 purpose;</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id78747534C9CE4BC098EC314ACA88771C"><enum>(F)</enum><text display-inline="yes-display-inline">appropriate prohibitions or restrictions
			 on—</text>
							<clause commented="no" display-inline="no-display-inline" id="idB5EADC42813F4B29AC6825FDBEBD839A"><enum>(i)</enum><text display-inline="yes-display-inline">access by all modes of
			 transportation;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id3ECC833184174AA5B4BB8A8570CAAB0B"><enum>(ii)</enum><text display-inline="yes-display-inline">sand and gravel extraction; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="idE975CE8366DD4DBE951F6404C87022B5"><enum>(iii)</enum><text display-inline="yes-display-inline">use of explosives;</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id6612084567734F37BE1E6E48D0304AB5"><enum>(G)</enum><text display-inline="yes-display-inline">reasonable stipulations for protection of
			 cultural and archaeological resources;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id2B884640558A4422AE19A8767B42114D"><enum>(H)</enum><text display-inline="yes-display-inline">measures to protect groundwater and surface
			 water, including—</text>
							<clause commented="no" display-inline="no-display-inline" id="id5B0A2926A3BC40DC9ADC54B4A08496C4"><enum>(i)</enum><text display-inline="yes-display-inline">avoidance, to the maximum extent
			 practicable, of springs, streams, and river systems;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id69CC2020BB4E45FBA94CE93D79768276"><enum>(ii)</enum><text display-inline="yes-display-inline">the protection of natural surface drainage
			 patterns and wetland and riparian habitats; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id9B4C748CAC3A4DF6B105D3271FE722D1"><enum>(iii)</enum><text display-inline="yes-display-inline">the regulation of methods or techniques for
			 developing or transporting adequate supplies of water for exploratory drilling;
			 and</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7E3C67E93D444AD6A9AAB81BBDE9A64F"><enum>(I)</enum><text display-inline="yes-display-inline">research, monitoring, and reporting
			 requirements.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id68936EB70AFC4552AD1B7FAD7EEB08B9"><enum>(3)</enum><text display-inline="yes-display-inline">that exploration activities (except surface
			 geological studies) be limited to the period between approximately November 1
			 and May 1 of each year and be supported, if necessary, by ice roads, winter
			 trails with adequate snow cover, ice pads, ice airstrips, and air transport
			 methods (except that those exploration activities may be permitted at other
			 times if the Secretary determines that the exploration will have no significant
			 adverse effect on fish and wildlife, fish and wildlife habitat, and the
			 environment of the Coastal Plain);</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id994C84F532DF4DBCBA615FCF969BB627"><enum>(4)</enum><text display-inline="yes-display-inline">consolidation of facility siting;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id889A7B4B88214723A00C4623D3AF6925"><enum>(5)</enum><text display-inline="yes-display-inline">avoidance or reduction of air
			 traffic-related disturbance to fish and wildlife;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF60FF6FC652844298C54530C46B5BC6D"><enum>(6)</enum><text display-inline="yes-display-inline">treatment and disposal of hazardous and
			 toxic wastes, solid wastes, reserve pit fluids, drilling muds and cuttings, and
			 domestic wastewater, including, in accordance with applicable Federal and State
			 environmental laws (including regulations)—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id50701C659D274E07AD1B845F851D085B"><enum>(A)</enum><text display-inline="yes-display-inline">preparation of an annual waste management
			 report;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id17A4D34A24964045BBCDFE34FBE95EC0"><enum>(B)</enum><text display-inline="yes-display-inline">development and implementation of a
			 hazardous materials tracking system; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCFEE21DA6EEA4C75B85D85D8D8079F4D"><enum>(C)</enum><text display-inline="yes-display-inline">prohibition on the use of chlorinated
			 solvents;</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4AF5F9BFD6374674BC970FE2891895D4"><enum>(7)</enum><text display-inline="yes-display-inline">fuel storage and oil spill contingency
			 planning;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE9056E66742F404BAB94DE5F3C2C4F49"><enum>(8)</enum><text display-inline="yes-display-inline">conduct of periodic field crew
			 environmental briefings;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id37BA3713010D4822A452C266A020FA78"><enum>(9)</enum><text display-inline="yes-display-inline">avoidance of significant adverse effects on
			 subsistence hunting, fishing, and trapping;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id13907AF73C234CC2A063934DC46E1673"><enum>(10)</enum><text display-inline="yes-display-inline">compliance with applicable air and water
			 quality standards;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5D9E803192064EB4BE2FA3092A1D3765"><enum>(11)</enum><text display-inline="yes-display-inline">appropriate seasonal and safety zone
			 designations around well sites, within which subsistence hunting and trapping
			 shall be limited; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB90C6640AA4C4E5DA78CD77490368441"><enum>(12)</enum><text display-inline="yes-display-inline">development and implementation of such
			 other protective environmental requirements, restrictions, terms, or conditions
			 as the Secretary determines to be necessary.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idD2D7AAF57D1C445986D4AD90ABBE123D"><enum>(e)</enum><header display-inline="yes-display-inline">Considerations</header><text display-inline="yes-display-inline">In preparing and issuing regulations, lease
			 terms, conditions, restrictions, prohibitions, or stipulations under this
			 section, the Secretary shall take into consideration—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id760FC320B4A049209182344B88A216E7"><enum>(1)</enum><text display-inline="yes-display-inline">the stipulations and conditions that govern
			 the National Petroleum Reserve-Alaska leasing program, as set forth in the 1999
			 Northeast National Petroleum Reserve-Alaska Final Integrated Activity
			 Plan/Environmental Impact Statement;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF3CC6F1F6A5E440DB8B50071F1AD244D"><enum>(2)</enum><text display-inline="yes-display-inline">the environmental protection standards that
			 governed the initial Coastal Plain seismic exploration program under parts
			 37.31 through 37.33 of title 50, Code of Federal Regulations (or successor
			 regulations); and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCBEEA090DA6A4B92BF68DE4968A0F094"><enum>(3)</enum><text display-inline="yes-display-inline">the land use stipulations for exploratory
			 drilling on the KIC–ASRC private land described in Appendix 2 of the agreement
			 between Arctic Slope Regional Corporation and the United States dated August 9,
			 1983.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7B3A1FC4BE9D48ACB4C7AE071FE26073"><enum>(f)</enum><header display-inline="yes-display-inline">Facility consolidation planning</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idE78333BD7C694B6DBFF53A6E55A3D0AB"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">After providing for public notice and
			 comment, the Secretary shall prepare and periodically update a plan to govern,
			 guide, and direct the siting and construction of facilities for the
			 exploration, development, production, and transportation of oil and gas
			 resources from the Coastal Plain.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id93962D7BCA154888B533B26D1076CE7B"><enum>(2)</enum><header display-inline="yes-display-inline">Objectives</header><text display-inline="yes-display-inline">The objectives of the plan shall be—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idDCB1E536186A42F79D64DDC209FA24B5"><enum>(A)</enum><text display-inline="yes-display-inline">the avoidance of unnecessary duplication of
			 facilities and activities;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC1B69879E02E48C6AA7928FC5513121D"><enum>(B)</enum><text display-inline="yes-display-inline">the encouragement of consolidation of
			 common facilities and activities;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAD80459D8D63459194571D9162E9244B"><enum>(C)</enum><text display-inline="yes-display-inline">the location or confinement of facilities
			 and activities to areas that will minimize impact on fish and wildlife, fish
			 and wildlife habitat, subsistence resources, and the environment;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id582E091B649943FCBF9C9F0395DF3860"><enum>(D)</enum><text display-inline="yes-display-inline">the use of existing facilities, to the
			 maximum extent practicable; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8AAFBD8006C345F9BC5C5DB0FAE3BE63"><enum>(E)</enum><text display-inline="yes-display-inline">the enhancement of compatibility between
			 wildlife values and development activities.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id05038FB1A2064D888D9F88C0A375BFA6"><enum>(g)</enum><header display-inline="yes-display-inline">Access to public land</header><text display-inline="yes-display-inline">The Secretary shall—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id359BA28A333F4D3E9AB64C82BF86046B"><enum>(1)</enum><text display-inline="yes-display-inline">manage public land in the Coastal Plain in
			 accordance with subsections (a) and (b) of section 811 of the Alaska National
			 Interest Lands Conservation Act (16 U.S.C. 3121); and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF9E215582CC441D6AC80BFA832A36E92"><enum>(2)</enum><text display-inline="yes-display-inline">ensure that local residents shall have
			 reasonable access to public land in the Coastal Plain for traditional
			 uses.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idE1E20FAF7D6B43ECA53558A7E530A1D3" section-type="subsequent-section"><enum>207.</enum><header display-inline="yes-display-inline">Expedited judicial review</header>
				<subsection commented="no" display-inline="no-display-inline" id="id45387012ED2E4313B45C4CD7DF0D0E7C"><enum>(a)</enum><header display-inline="yes-display-inline">Filing of complaints</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id9706251F05684D26A45C0C4B51EA4E2A"><enum>(1)</enum><header display-inline="yes-display-inline">Deadline</header><text display-inline="yes-display-inline">A complaint seeking judicial review of a
			 provision of this title or an action of the Secretary under this title shall be
			 filed—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idB3D64C4F04B34E8DB8BE88CA17D091DC"><enum>(A)</enum><text display-inline="yes-display-inline">except as provided in subparagraph (B),
			 during the 90-day period beginning on the date on which the action being
			 challenged was carried out; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id48D6DDA5DFD8468D883676BE443EBEBD"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a complaint based solely on
			 grounds arising after the 90-day period described in subparagraph (A), by not
			 later than 90 days after the date on which the complainant knew or reasonably
			 should have known about the grounds for the complaint.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id46C9E838D16D4FBAA573A9D0FFE87BF5"><enum>(2)</enum><header display-inline="yes-display-inline">Venue</header><text display-inline="yes-display-inline">A complaint seeking judicial review of a
			 provision of this title or an action of the Secretary under this title shall be
			 filed in the United States Court of Appeals for the District of Columbia
			 Circuit.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id22579B0EEBC747FA87536354F5CD601C"><enum>(3)</enum><header display-inline="yes-display-inline">Scope</header>
						<subparagraph commented="no" display-inline="no-display-inline" id="id5F60BC01AF544F3D84869468F1A528A2"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Judicial review of a decision of the
			 Secretary relating to a lease sale under this title (including an environmental
			 analysis of such a lease sale) shall be—</text>
							<clause commented="no" display-inline="no-display-inline" id="idBC1E265F697C4694A0FA79C842673CCF"><enum>(i)</enum><text display-inline="yes-display-inline">limited to a review of whether the decision
			 is in accordance with this title; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="id9B3E27CB7377455D841C4DE8EA096B81"><enum>(ii)</enum><text display-inline="yes-display-inline">based on the administrative record of the
			 decision.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE0E23B48494C41779DFA1F6514EDCF51"><enum>(B)</enum><header display-inline="yes-display-inline">Presumptions</header><text display-inline="yes-display-inline">Any identification by the Secretary of a
			 preferred course of action relating to a lease sale, and any analysis by the
			 Secretary of environmental effects, under this title shall be presumed to be
			 correct unless proven otherwise by clear and convincing evidence.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id7D4871B47A5B452DAA6528DF45F02E2F"><enum>(b)</enum><header display-inline="yes-display-inline">Limitation on other review</header><text display-inline="yes-display-inline">Any action of the Secretary that is subject
			 to judicial review under this section shall not be subject to judicial review
			 in any civil or criminal proceeding for enforcement.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idC04204EAF91D423DBEA2453AD419CD5D" section-type="subsequent-section"><enum>208.</enum><header display-inline="yes-display-inline">Federal and State distribution of
			 revenues</header>
				<subsection commented="no" display-inline="no-display-inline" id="idC738896634BC4F04AA46397080CCEB47"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 of the amount of adjusted bonus, rental, and royalty revenues from Federal oil
			 and gas leasing and operations authorized under this title for each fiscal
			 year—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id7C745C696EB24127BF7447A3B7E1274A"><enum>(1)</enum><text display-inline="yes-display-inline">50 percent shall be paid to the State of
			 Alaska; and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3B445E23CE7A4C02B13B557893AFB510"><enum>(2)</enum><text display-inline="yes-display-inline">except as provided in section 211(d), the
			 balance shall be—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idCE92813FC099401B96E29258A1F075F3"><enum>(A)</enum><text display-inline="yes-display-inline">used to offset the provisions of this Act;
			 and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0F85833B05DC47B0B772AFC36D57699D"><enum>(B)</enum><text display-inline="yes-display-inline">after making the offsets under subparagraph
			 (A), transferred to the ANWR Alternative Energy Trust Fund established by
			 section 212.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idB180638962C64585A650AC6F461E7E07"><enum>(b)</enum><header display-inline="yes-display-inline">Payments to Alaska</header><text display-inline="yes-display-inline">Payments to the State of Alaska under this
			 section shall be made semiannually.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id7E40B02734FE4DAFB1DB11CDB1B300F0" section-type="subsequent-section"><enum>209.</enum><header display-inline="yes-display-inline">Rights-of-way across the Coastal
			 plain</header>
				<subsection commented="no" display-inline="no-display-inline" id="idC63457461F664A32BF865601AF09A315"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall issue rights-of-way and
			 easements across the Coastal Plain for the transportation of oil and
			 gas—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="id841E176DC8AC4EE69E8AB26F0B8B322C"><enum>(1)</enum><text display-inline="yes-display-inline">except as provided in paragraph (2), under
			 section 28 of the Mineral Leasing Act (30 U.S.C. 185), without regard to title
			 XI of the Alaska National Interest Lands Conservation Act (16 U.S.C. 3161 et
			 seq.); and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0074E6AA2813416AA333CCD4A90FA2D9"><enum>(2)</enum><text display-inline="yes-display-inline">under title XI of the Alaska National
			 Interest Lands Conservation Act (16 U.S.C. 3161 et seq.), for access authorized
			 by sections 1110 and 1111 of that Act (16 U.S.C. 3170, 3171).</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id07240BE51399415E81FB7E289A599249"><enum>(b)</enum><header display-inline="yes-display-inline">Terms and conditions</header><text display-inline="yes-display-inline">The Secretary shall include in any
			 right-of-way or easement issued under subsection (a) such terms and conditions
			 as may be necessary to ensure that transportation of oil and gas does not
			 result in a significant adverse effect on the fish and wildlife, subsistence
			 resources, their habitat, and the environment of the Coastal Plain, including
			 requirements that facilities be sited or designed so as to avoid unnecessary
			 duplication of roads and pipelines.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="idBABE8F7DB96C40658C179A0E1D9EEDCC"><enum>(c)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The Secretary shall include in regulations
			 under section 202(f) provisions granting rights-of-way and easements described
			 in subsection (a).</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="idC4AB5E078CE04707A931F36250029E20" section-type="subsequent-section"><enum>210.</enum><header display-inline="yes-display-inline">Conveyance</header><text display-inline="no-display-inline">Notwithstanding section 1302(h)(2) of the
			 Alaska National Interest Lands Conservation Act (16 U.S.C. 3192(h)(2)), to
			 remove any cloud on title to land, and to clarify land ownership patterns in
			 the Coastal Plain, the Secretary shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id570F0A280D4A48B8A45BDD323A197D1A"><enum>(1)</enum><text display-inline="yes-display-inline">to the extent necessary to fulfill the
			 entitlement of the Kaktovik Inupiat Corporation under sections 12 and 14 of the
			 Alaska Native Claims Settlement Act (43 U.S.C. 1611, 1613), as determined by
			 the Secretary, convey to that Corporation the surface estate of the land
			 described in paragraph (1) of Public Land Order 6959, in accordance with the
			 terms and conditions of the agreement between the Secretary, the United States
			 Fish and Wildlife Service, the Bureau of Land Management, and the Kaktovik
			 Inupiat Corporation, dated January 22, 1993; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFE33D1CB3331419DA32D04E4822340C3"><enum>(2)</enum><text display-inline="yes-display-inline">convey to the Arctic Slope Regional
			 Corporation the remaining subsurface estate to which that Corporation is
			 entitled under the agreement between that corporation and the United States,
			 dated August 9, 1983.</text>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="id40AC5A9E50BE41F8A3A779D583A0216E" section-type="subsequent-section"><enum>211.</enum><header display-inline="yes-display-inline"> Local government impact aid and community
			 service assistance</header>
				<subsection commented="no" display-inline="no-display-inline" id="id459EF43C5D884D69A8D48A6940D8A192"><enum>(a)</enum><header display-inline="yes-display-inline">Financial assistance authorized</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id22CD8943DACB461FB573AB4BC5621DFE"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary may use amounts available
			 from the Coastal Plain Local Government Impact Aid Assistance Fund established
			 by subsection (d) to provide timely financial assistance to entities that are
			 eligible under paragraph (2).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id82601559C97749E8B772E6075F7096EE"><enum>(2)</enum><header display-inline="yes-display-inline">Eligible entities</header><text display-inline="yes-display-inline">The North Slope Borough, the City of
			 Kaktovik, and any other borough, municipal subdivision, village, or other
			 community in the State of Alaska that is directly impacted by exploration for,
			 or the production of, oil or gas on the Coastal Plain under this title, as
			 determined by the Secretary, shall be eligible for financial assistance under
			 this section.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8DF37F9B32204B5493E7ED9A14621B3C"><enum>(b)</enum><header display-inline="yes-display-inline">Use of assistance</header><text display-inline="yes-display-inline">Financial assistance under this section may
			 be used only—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="idBF85A20175934A1F9306C573439FEA44"><enum>(1)</enum><text display-inline="yes-display-inline">to plan for mitigation, implement a
			 mitigation plan, or maintain a mitigation project to address the potential
			 effects of oil and gas exploration and development on environmental, social,
			 cultural, recreational, and subsistence resources of the community;</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id71EFBB2EE79F4E2898081268B6CB17EC"><enum>(2)</enum><text display-inline="yes-display-inline">to develop, carry out, and maintain—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idCD13CDAC4A54420691E31CFB643E6BC1"><enum>(A)</enum><text display-inline="yes-display-inline">a project to provide new or expanded public
			 facilities; or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id71292A896CE445BC8BDFF9E729FA3FBB"><enum>(B)</enum><text display-inline="yes-display-inline">services to address the needs and problems
			 associated with the effects described in paragraph (1), including firefighting,
			 police, water and waste treatment, first responder, and other medical services;
			 and</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC7D4C91039694CB4AC38F441139D2F4E"><enum>(3)</enum><text display-inline="yes-display-inline">to establish a local coordination office,
			 to be managed by the Mayor of the North Slope Borough, in coordination with the
			 City of Kaktovik, Alaska—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id8E6F1D690B36423F93FB25D1A2B8941E"><enum>(A)</enum><text display-inline="yes-display-inline">to coordinate with and advise developers on
			 local conditions and the history of areas affected by development; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAF86E3CFF90846CE84573A29DE985293"><enum>(B)</enum><text display-inline="yes-display-inline">to provide to the Committee on Resources of
			 the House of Representatives and the Committee on Energy and Natural Resources
			 of the Senate annual reports on the status of the coordination between
			 developers and communities affected by development.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idCFFBB2DECF1C494186B63C46BEE31D32"><enum>(c)</enum><header display-inline="yes-display-inline">Application</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idD3DD6897C48E4DA5A05D70FE3AE8EE4E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Any community that is eligible for
			 assistance under this section may submit an application for such assistance to
			 the Secretary, in such form and under such procedures as the Secretary may
			 prescribe by regulation.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDA5ED7D00EB64AEAAD8DF8FE1A2B05D3"><enum>(2)</enum><header display-inline="yes-display-inline">North Slope Borough
			 communities</header><text display-inline="yes-display-inline">A community
			 located in the North Slope Borough may apply for assistance under this section
			 either directly to the Secretary or through the North Slope Borough.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id27B94388B619414CA380142E0B4398C2"><enum>(3)</enum><header display-inline="yes-display-inline">Application assistance</header><text display-inline="yes-display-inline">The Secretary shall work closely with and
			 assist the North Slope Borough and other communities eligible for assistance
			 under this section in developing and submitting applications for assistance
			 under this section.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA48275D32D94434E9B87767A6982C701"><enum>(d)</enum><header display-inline="yes-display-inline">Establishment of Fund</header>
					<paragraph commented="no" display-inline="no-display-inline" id="idBE92BCB665444CCEBB777BE3CD956211"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There is established in the Treasury the
			 <quote>Coastal Plain Local Government Impact Aid Assistance Fund</quote>
			 (referred to in this section as the <quote>Fund</quote>).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id62376B5D0FC346A286025D009B3F747F"><enum>(2)</enum><header display-inline="yes-display-inline">Use</header><text display-inline="yes-display-inline">Amounts in the Fund may be used only for
			 providing financial assistance under this section.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6B6F844E9FFF44CEBF920D8CAF64F593"><enum>(3)</enum><header display-inline="yes-display-inline">Deposits</header><text display-inline="yes-display-inline">Subject to paragraph (4), there shall be
			 deposited into the Fund amounts received by the United States as revenues
			 derived from rents, bonuses, and royalties from Federal leases and lease sales
			 authorized under this title.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id788C6EEB668F464A895F81DD8DED5430"><enum>(4)</enum><header display-inline="yes-display-inline">Limitation on deposits</header><text display-inline="yes-display-inline">The total amount in the Fund may not exceed
			 $11,000,000.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id37DE0BAE36D9422B82022760C7DB97F6"><enum>(5)</enum><header display-inline="yes-display-inline">Investment of balances</header><text display-inline="yes-display-inline">The Secretary of the Treasury shall invest
			 amounts in the Fund in interest bearing government securities.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idBE407DC7981A4C269BC8F9AAFBE2E83A"><enum>(e)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to the Secretary from the Fund to provide
			 financial assistance under this section $5,000,000 for each fiscal year.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id31CF24C3607E429791A738D8BE15DF2A" section-type="subsequent-section"><enum>212.</enum><header display-inline="yes-display-inline">ANWR Alternative Energy Trust Fund</header>
				<subsection commented="no" display-inline="no-display-inline" id="id7479F258E10A48D99F3DF008AA0CC4C9"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment of Trust Fund</header><text display-inline="yes-display-inline">There is established in the Treasury of the
			 United States a trust fund to be known as the <quote>ANWR Alternative Energy
			 Trust Fund</quote>, consisting of such amounts as may be transferred to the
			 ANWR Alternative Energy Trust Fund as provided in section 208(a)(2).</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="id7C3CC635D0A64C9E9DF0C6660CCE6BDE"><enum>(b)</enum><header display-inline="yes-display-inline">Expenditures from ANWR Alternative Energy
			 Trust Fund</header>

						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id50FAC3DCF276432282FF97115B09B6E2"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>an operating
			 license</quote> and inserting <quote>a construction permit, an operating
			 license,</quote>.</text>
						</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idB10B335B78CE43D5B9A2C18584FEDFAD" section-type="subsequent-section"><enum>303.</enum><header display-inline="yes-display-inline">Jurisdiction over covered energy
			 projects</header>
				<subsection commented="no" display-inline="no-display-inline" id="H528CD0FD1BFA41FE8E584B0841EA42B6"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of covered energy
			 project</header><text display-inline="yes-display-inline">In this section, the
			 term <term>covered energy project</term> means any action or decision by a
			 Federal official regarding—</text>
					<paragraph commented="no" display-inline="no-display-inline" id="HE8AC154ED48D4CD4BB4CFB00BA6046EE"><enum>(1)</enum><text display-inline="yes-display-inline">the leasing of Federal land (including
			 submerged land) for the exploration, development, production, processing, or
			 transmission of oil, natural gas, or any other source or form of energy,
			 including actions and decisions regarding the selection or offering of Federal
			 land for such leasing; or</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H87CDB2AEDB874855818DE4AF007F584F"><enum>(2)</enum><text display-inline="yes-display-inline">any action under such a lease, except that
			 this section and Act shall not apply to a dispute between the parties to a
			 lease entered into a provision of law authorizing the lease regarding
			 obligations under the lease or the alleged breach of the lease.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HA0250A52E1C04B3CB8EA00A57F770682"><enum>(b)</enum><header display-inline="yes-display-inline">Exclusive jurisdiction over causes and
			 claims relating to covered energy projects</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
			 the United States District Court for the District of Columbia shall have
			 exclusive jurisdiction to hear all causes and claims under this section or any
			 other Act that arise from any covered energy project.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H707B55454E8A47DA9FE74E4F9309AE43"><enum>(c)</enum><header display-inline="yes-display-inline">Time for filing complaint</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id05D296F33C354D338CF28706D3EF3B88"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each case or claim described in subsection
			 (b) shall be filed not later than the end of the 60-day period beginning on the
			 date of the action or decision by a Federal official that constitutes the
			 covered energy project concerned.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA7E5D624E9B14CCFBF08BA6AB859EFDA"><enum>(2)</enum><header display-inline="yes-display-inline">Prohibition</header><text display-inline="yes-display-inline">Any cause or claim described in subsection
			 (b) that is not filed within the time period described in paragraph (1) shall
			 be barred.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H07AD64FE27DB40A2BFCD3EC46CDF1E71"><enum>(d)</enum><header display-inline="yes-display-inline">District court for the District of Columbia
			 deadline</header>
					<paragraph commented="no" display-inline="no-display-inline" id="H4D82D0960A454DA8B1147997ACDF5199"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each proceeding that is subject to
			 subsection (b) shall—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="H9FDB8051285B49C49E27204CE7B12F59"><enum>(A)</enum><text display-inline="yes-display-inline">be resolved as expeditiously as practicable
			 and in any event not more than 180 days after the cause or claim is filed;
			 and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HFA0355C2CA0C433000C3ADEADC003452"><enum>(B)</enum><text display-inline="yes-display-inline">take precedence over all other pending
			 matters before the district court.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H633E5876F7034D019930E4C212BF13FD"><enum>(2)</enum><header display-inline="yes-display-inline">Failure to comply with
			 deadline</header><text display-inline="yes-display-inline">If an interlocutory
			 or final judgment, decree, or order has not been issued by the district court
			 by the deadline required under this section, the cause or claim shall be
			 dismissed with prejudice and all rights relating to the cause or claim shall be
			 terminated.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HB2B06A9169E24C5E9C74E59988D0A788"><enum>(e)</enum><header display-inline="yes-display-inline">Ability To seek appellate
			 review</header><text display-inline="yes-display-inline">An interlocutory or
			 final judgment, decree, or order of the district court under this section may
			 be reviewed by no other court except the Supreme Court.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H0EEA85A9152843AE88CD249E47A140CF"><enum>(f)</enum><header display-inline="yes-display-inline">Deadline for appeal to the Supreme
			 Court</header><text display-inline="yes-display-inline">If a writ of certiorari
			 has been granted by the Supreme Court pursuant to subsection (e), the
			 interlocutory or final judgment, decree, or order of the district court shall
			 be resolved as expeditiously as practicable and in any event not more than 180
			 days after the interlocutory or final judgment, decree, order of the district
			 court is issued.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="id2D1A308D3FE649EBAA3BD1101F03CBCA" section-type="subsequent-section"><enum>304.</enum><header display-inline="yes-display-inline">Environmental impact
			 statements</header><text display-inline="no-display-inline">Title I of the
			 National Environmental Policy Act of 1969 (42 U.S.C. 4331 et seq.) is amended
			 by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id657C730525234E61A0A5E3DE65CF4DA3" style="OLC">
					<section commented="no" display-inline="no-display-inline" id="id9759527ADB1447A0AACEE0D1E4E807C6" section-type="subsequent-section"><enum>106.</enum><header display-inline="yes-display-inline">Completion and review of environmental
				impact statements</header>
						<subsection commented="no" display-inline="no-display-inline" id="id8FDF013E24E44B969EC6BF67F37483FD"><enum>(a)</enum><header display-inline="yes-display-inline">Completion</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id927138ECD49D42E989E321BA14E32915"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law,
				each review carried out under section 102(2)(C) with respect to any action
				taken under any provision of law, or for which funds are made available under
				any provision of law, shall be completed not later than the date that is 270
				days after the commencement of the review.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB2C8F9B64968409C875536C056194705"><enum>(2)</enum><header display-inline="yes-display-inline">Failure to complete review</header><text display-inline="yes-display-inline">If a review described in paragraph (1) has
				not been completed for an action subject to section 102(2)(C) by the date
				specified in paragraph (1)—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idD577766154ED451788EB9BE24628B1D8"><enum>(A)</enum><text display-inline="yes-display-inline">the action shall be considered to have no
				significant impact described in section 102(2)(C); and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0CA27DA9CB8B42C394B5A50397FF7FF9"><enum>(B)</enum><text display-inline="yes-display-inline">that classification shall be considered to
				be a final agency action.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDe456610a312f4061b88729e0edf74779"><enum>(b)</enum><header display-inline="yes-display-inline">Lead agency</header><text display-inline="yes-display-inline">The lead agency for a review of an action
				under this section shall be the Federal agency to which funds are made
				available for the action.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2e78f0b4937c4e25aabd15689dd9f1c6"><enum>(c)</enum><header display-inline="yes-display-inline">Review</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id4D767552E089442BA5B38ABBBA6525BE"><enum>(1)</enum><header display-inline="yes-display-inline">Administrative appeals</header><text display-inline="yes-display-inline">There shall be a single administrative
				appeal for each review carried out pursuant to section 102(2)(C).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5B74F119A8F74909B09B83ECD2495DEF"><enum>(2)</enum><header display-inline="yes-display-inline">Judicial review</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="id3D9045C90E58461DB2736FF9C38AC54D"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">On resolution of the administrative appeal,
				judicial review of the final agency decision after exhaustion of administrative
				remedies shall lie with the United States Court of Appeals for the District of
				Columbia Circuit.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id019ECDA8DEC64B0E8BEBE37265631690"><enum>(B)</enum><header display-inline="yes-display-inline">Administrative record</header><text display-inline="yes-display-inline">An appeal to the court described in
				subparagraph (A) shall be based only on the administrative record.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD15C7CE7FFAE4CA498B746A54E41D0F9"><enum>(C)</enum><header display-inline="yes-display-inline">Pendency of judicial review</header><text display-inline="yes-display-inline">After an agency has made a final decision
				with respect to a review carried out under this subsection, the decision shall
				be effective during the course of any subsequent appeal to a court described in
				subparagraph (A).</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB4455E7089DC4410A728B68C8D0E14BA"><enum>(3)</enum><header display-inline="yes-display-inline">Civil action</header><text display-inline="yes-display-inline">Each civil action covered by this section
				shall be considered to arise under the laws of the United
				States.</text>

			 7543(b)) for preemption under that Act for any regulation of the State to
			 control greenhouse gas emissions from motor vehicles.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="HA17E6BA9ED744E62A0A56C9105C2C3A5" section-type="subsequent-section"><enum>306.</enum><header display-inline="yes-display-inline">Endangered species</header>
				<subsection commented="no" display-inline="no-display-inline" id="idAA75B56304744124B15B1964D925A9C4"><enum>(a)</enum><header display-inline="yes-display-inline">Emergencies</header><text display-inline="yes-display-inline">Section 10 of the Endangered Species Act of
			 1973 (16 U.S.C. 1539) is amended by adding at the end the following:</text>
