		<legis-type>A BILL</legis-type>
		<official-title>To amend title XVIII of the Social Security Act to
		  provide continued entitlement to coverage for immunosuppressive drugs furnished
		  to beneficiaries under the Medicare Program that have received a kidney
		  transplant and whose entitlement to coverage would otherwise expire, and for
		  other purposes.</official-title>

		<section display-inline="no-display-inline" id="H35E27A2AD2F54C9C94B0AAFA9B07094F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Comprehensive Immunosuppressive Drug
			 Coverage for Kidney Transplant Patients Act of
			 2009</short-title></quote>.</text>
		</section><section id="H373B3A93774548D0A6E9542D36198991"><enum>2.</enum><header>Provision of
			 appropriate coverage of immunosuppressive drugs under the Medicare Program for
			 kidney transplant recipients</header>
			<subsection id="H851A58255E174E54B7DB43EEBA67C04E"><enum>(a)</enum><header>Continued
			 entitlement to immunosuppressive drugs</header>
				<paragraph id="HE783DEC2135645F48B35E6025508B200"><enum>(1)</enum><header>Kidney
			 transplant recipients</header><text>Section 226A(b)(2) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 426–1(b)(2)) is amended by inserting <quote>(except for coverage of
			 immunosuppressive drugs under section 1861(s)(2)(J))</quote> after <quote>shall
			 end</quote>.</text>
				</paragraph><paragraph id="H0B80A59412D24DD300403C00E7E7C3DB"><enum>(2)</enum><header>Application</header><text>Section
			 1836 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42
			 U.S.C. 1395o) is amended—</text>
					<subparagraph id="HC703945510484D4780DB8C1922DF7903"><enum>(A)</enum><text>by striking
			 <quote>Every individual who</quote> and inserting <quote>(a)
			 <header-in-text level="subsection" style="OLC">In
			 General</header-in-text>.—Every individual who</quote>; and</text>
					</subparagraph><subparagraph id="H76A3C11DAE2C4CEBAB332FAFEF86D89F"><enum>(B)</enum><text>by adding at the
			 end the following new subsection:</text>
						<quoted-block id="H124705341DFE49DCBE9B57AC9CCA4F8">
							<subsection id="HA73EB30623804A85BE5F5E10B9DB17E7"><enum>(b)</enum><header>Special rules
				applicable to individuals eligible only for coverage of immunosuppressive
				drugs</header>
								<paragraph id="H9F0ADFBA03C34885A52DAA3465548923"><enum>(1)</enum><header>In
				General</header><text>In the case of an individual whose eligibility for
				benefits under this title has ended except for the coverage of
				immunosuppressive drugs by reason of section 226A(b)(2), the following rules
				shall apply:</text>
									<subparagraph id="H91818962FD5B467D85CE5F3900DD9121"><enum>(A)</enum><text>The individual
				shall be deemed to be enrolled under this part for purposes of receiving
				coverage of such drugs.</text>
									</subparagraph><subparagraph id="H17EC506B3D7C4FCE9FF8EF1E7FBD4300"><enum>(B)</enum><text>The individual
				shall be responsible for the full amount of the premium under section 1839 in
				order to receive such coverage.</text>
									</subparagraph><subparagraph id="HF58D13C4329C4F65A76D5F51BB698031"><enum>(C)</enum><text>The provision of
				such drugs shall be subject to the application of—</text>
										<clause id="HC69CB29B4D77403FAF9EF4571E675551"><enum>(i)</enum><text>the deductible
				under section 1833(b); and</text>
										</clause><clause id="HD07CF40035154EB19B7972FEEEA514F7"><enum>(ii)</enum><text>the coinsurance
				amount applicable for such drugs (as determined under this part).</text>
										</clause></subparagraph><subparagraph id="HEB7E8B23EB6B4DE08509B79237429747"><enum>(D)</enum><text>If the individual
				is an inpatient of a hospital or other entity, the individual is entitled to
				receive coverage of such drugs under this part.</text>
									</subparagraph></paragraph><paragraph id="H70E78CB35C7A4624BF86F95DF75DE04E"><enum>(2)</enum><header>Establishment of
				procedures in order to implement coverage</header><text>The Secretary shall
				establish procedures for—</text>
									<subparagraph id="H1D46C987A293428EB096E5285573E241"><enum>(A)</enum><text>identifying
				beneficiaries that are entitled to coverage of immunosuppressive drugs by
				reason of section 226A(b)(2); and</text>
									</subparagraph><subparagraph id="HD76E5D20A0544AC795E5124D1AA233C"><enum>(B)</enum><text>distinguishing such
				beneficiaries from beneficiaries that are enrolled under this part for the
				complete package of benefits under this
				part.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="HC455FBB572D24960B728219D5E9E9376"><enum>(3)</enum><header>Technical
			 amendment</header><text>Subsection (c) of section 226A of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/426-1">42 U.S.C. 426–1</external-xref>),
			 as added by section 201(a)(3)(D)(ii) of the Social Security Independence and
			 Program Improvements Act of 1994 (<external-xref legal-doc="public-law" parsable-cite="pl/103/296">Public Law 103–296</external-xref>; 108 Stat. 1497),
			 is redesignated as subsection (d).</text>
				</paragraph></subsection><subsection id="H39C73618679A4B87BD7206DF56DAE929"><enum>(b)</enum><header>Extension of
			 secondary payer requirements for ESRD beneficiaries</header><text>Section
			 1862(b)(1)(C) of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395y">42
			 U.S.C. 1395y(b)(1)(C)</external-xref>) is amended by adding at the end the
			 following new sentence: <quote>With regard to immunosuppressive drugs furnished
			 on or after the date of enactment of the <short-title>Comprehensive Immunosuppressive Drug Coverage for Kidney
			 Transplant Patients Act of 2009</short-title>, this subparagraph shall be
			 applied without regard to any time limitation.</quote>.</text>
			</subsection><subsection id="HFDA24A2738E944828CBCB734BF1000EE"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to drugs
			 furnished on or after the date of enactment of this Act.</text>
			</subsection></section><section id="H8E7E0E8D35EB49CDB05D007342589400"><enum>3.</enum><header>Plans required to
			 maintain coverage of immunosuppressive drugs for kidney transplant
			 recipients</header>
			<subsection id="HA03A22F992DE4973A49E29A94B8BEEBF"><enum>(a)</enum><header>Application to
			 certain health insurance coverage</header>
				<paragraph id="H4DC4A9F5D5324C7B00485DFE00346137"><enum>(1)</enum><header>In
			 General</header><text>Subpart 2 of part A of title XXVII of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
			 300gg–4 et seq.) is amended by adding at the end the following:</text>
					<quoted-block act-name="Public Health Service Act" id="H78F3211CAF45480E95B69014A0A96F26">
						<section id="H3674C40EC2EC49EFBDCD689E3935414D"><enum>2708.</enum><header>Coverage of
				immunosuppressive drugs for kidney transplant recipients</header><text display-inline="no-display-inline">A group health plan (and a health insurance
				issuer offering health insurance coverage in connection with a group health
				plan) shall provide coverage of immunosuppressive drugs in connection with a
				kidney transplant that is at least as comprehensive as the coverage provided by
				such plan or issuer on the day before the date of enactment of the
				<short-title>Comprehensive Immunosuppressive Drug Coverage
				for Kidney Transplant Patients Act of 2009</short-title>, and such requirement
				shall be deemed to be incorporated into this
				section.</text>
						</section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HA9DF57F9EE594C17B81891F99B12F6B"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 2721(b)(2)(A) of the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
			 300gg–21(b)(2)(A)) is amended by inserting <quote>(other than section
			 2708)</quote> after <quote>requirements of such subparts</quote>.</text>
				</paragraph></subsection><subsection id="HE6775CC27D974722AD374EE694BD0075"><enum>(b)</enum><header>Application to
			 group health plans and group health insurance coverage under the
			 <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of
			 1974</act-name></header>
				<paragraph id="H194D14B1049540B1005E58C00678773"><enum>(1)</enum><header>In
			 General</header><text>Subpart B of part 7 of subtitle B of title I of the
			 <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of
			 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/29/1185">29
			 U.S.C. 1185 et seq.</external-xref>) is amended by adding at the end the
			 following new section:</text>

						<section id="H0355C5E5D7814A12855C19E50043D300"><enum>715.</enum><header>Coverage of
				immunosuppressive drugs for kidney transplant recipients</header><text display-inline="no-display-inline">A group health plan (and a health insurance
				issuer offering health insurance coverage in connection with a group health
				plan) shall provide coverage of immunosuppressive drugs in connection with a
				kidney transplant that is at least as comprehensive as the coverage provided by
				such plan or issuer on the day before the date of enactment of the
				<short-title>Comprehensive Immunosuppressive Drug Coverage
				for Kidney Transplant Patients Act of 2009</short-title>, and such requirement
				shall be deemed to be incorporated into this
				section.</text>
						</section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H7786ACEA95744CC0A123FFA2DB256976"><enum>(2)</enum><header>Conforming
			 amendments</header>
					<subparagraph id="HBFF1A02CADD445A190FD4368000680E2"><enum>(A)</enum><text>Section 732(a) of
			 the <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of
			 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/29/1185">29
			 U.S.C. 1191a(a)</external-xref>) is amended by striking <quote>section
			 711</quote> and inserting <quote>sections 711 and 715</quote>.</text>
					</subparagraph><subparagraph id="H9B25B6ADD3FC4C4792CEB94800C37263"><enum>(B)</enum><text>The table of
			 contents in section 1 of the <act-name parsable-cite="ERISA">Employee
			 Retirement Income Security Act of 1974</act-name> is amended by inserting after
			 the item relating to section 714 the following new item:</text>

					</subparagraph></paragraph></subsection><subsection id="HE748D2AA78F145019B26D874EA75093B"><enum>(c)</enum><header>Application to
			 group health plans under the Internal Revenue Code of
			 1986</header><text>Subchapter B of chapter 100 of the Internal Revenue Code of
			 1986 is amended—</text>
				<paragraph id="H961F70CB42A74BB6BA9E2EF32036843D"><enum>(1)</enum><text>in the table of
			 sections, by inserting after the item relating to section 9813 the following
			 new item:</text>

							<toc-entry level="section">Sec. 9814. Coverage of immunosuppressive
				drugs for kidney transplant
				recipients.</toc-entry>

					<continuation-text continuation-text-level="paragraph">and</continuation-text></paragraph><paragraph id="H3F4CA00985A143B9BD3F6E13715B0000"><enum>(2)</enum><text>by inserting after
			 section 9813 the following:</text>

						<section id="H393B86142F2842BF8115AB5420E7CE6"><enum>9814.</enum><header>Coverage of
				immunosuppressive drugs for kidney transplant recipients</header><text display-inline="no-display-inline">A group health plan shall provide coverage
				of immunosuppressive drugs in connection with a kidney transplant that is at
				least as comprehensive as the coverage provided by such plan on the day before
				the date of enactment of the <short-title>Comprehensive
				Immunosuppressive Drug Coverage for Kidney Transplant Patients Act of
				2009</short-title>, and such requirement shall be deemed to be incorporated
				into this
				section.</text>
						</section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H93655E28D109445BB6133EF248B87074"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply to plan
			 years beginning on or after January 1, 2010.</text>
