		<official-title>To amend the Food Security Act of 1985 to encourage
		  owners and operators of privately-held farm, ranch, and forest land to
		  voluntarily make their land available for access by the public for
		  maple-tapping activities under programs administered by States and tribal
		  governments.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Maple Tapping Access Program Act
			 of 2009</short-title></quote>.</text>
		</section><section id="ID359C3C52EAD9494FA13603D500DA6D7E"><enum>2.</enum><header>Maple tapping
			 access program</header><text display-inline="no-display-inline">Chapter 5 of
			 subtitle D of title XII of the Food Security Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/16/3839bb">16 U.S.C. 3839bb</external-xref>
			 et seq.) is amended by adding at the end the following:</text>

				<section id="IDAAF6E86597DC41FB988696F9F68EB3C3"><enum>1240S.</enum><header>Maple
				tapping access program</header>
					<subsection id="idC68137F747B347F6AAA0914706C723CB"><enum>(a)</enum><header>Definition of
				maple tapping</header><text>In this section, the term <term>maple
				tapping</term> means the collection of sap from any species of tree in the
				genus Acer for the purpose of boiling to produce food.</text>
					</subsection><subsection id="IDD40840337B1C41E6ADA67C40E34E50E2"><enum>(b)</enum><header>Program</header><text>The
				Secretary shall establish a voluntary public access program under which States
				and tribal governments may apply for grants to encourage owners and operators
				of privately-held farm, ranch, and forest land to voluntarily make that land
				available for access by the public for maple-tapping activities under programs
				administered by the States and tribal governments.</text>
					</subsection><subsection id="ID8C9B643C14554C6BA9E382AC677E7BAE"><enum>(c)</enum><header>Applications</header><text>In
				submitting applications for a grant under the program, a State or tribal
				government shall describe—</text>
						<paragraph id="ID56CE3BE0E4004682B790A42725004280"><enum>(1)</enum><text>the benefits that
				the State or tribal government intends to achieve by encouraging public access
				to private farm and ranch land for maple tapping; and</text>
						</paragraph><paragraph id="ID8A9CB7B553D64AF8B8804CD3C2D9C020"><enum>(2)</enum><text>the methods that
				will be used to achieve those benefits.</text>
						</paragraph></subsection><subsection id="ID805E4D814FDC4FFD86E03768E51190D4"><enum>(d)</enum><header>Priority</header><text>In
				approving applications and awarding grants under the program, the Secretary
				shall give priority to States and tribal governments that propose—</text>
						<paragraph id="IDBC0718F470E34B5C9E00A7026330E8B4"><enum>(1)</enum><text>to maximize
				participation by offering a program the terms of which are likely to meet with
				widespread acceptance among landowners;</text>
						</paragraph><paragraph id="ID95336623B8BE47DA844D004440D256E2"><enum>(2)</enum><text>to ensure that
				land enrolled under the State or tribal government program has an appropriate
				stock of trees suitable for maple tapping; and</text>
						</paragraph><paragraph id="ID684E1B0CEFF84ED5AAF81CD9861FE9C9"><enum>(3)</enum><text>to use additional
				Federal, State, tribal government, or private resources in carrying out the
				program.</text>
						</paragraph></subsection><subsection id="ID60AA819C58E44A11BF6E5B76EFB7CFE8"><enum>(e)</enum><header>Relationship to
				other laws</header><text>Nothing in this section preempts a State or tribal
				government law (including any State or tribal government liability law).</text>
					</subsection><subsection id="IDA470F6A5B236499DA1D0F5E8A98BD190"><enum>(f)</enum><header>Regulations</header><text>The
				Secretary shall promulgate such regulations as are necessary to carry out this
				section.</text>
					</subsection><subsection id="idAE77E635916F4334A9E434D2F46853C1"><enum>(g)</enum><header>Authorization
				of appropriations</header><text>There is authorized to be appropriated to carry
				out this section $20,000,000 for each of fiscal years 2010 through
				2013.</text>
