		  relating to protective orders, sealing of cases, disclosures of discovery
		  information in civil actions, and for other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Sunshine in Litigation Act of
			 2009</short-title></quote>.</text>
		</section><section id="ide34ba5e0-ae61-4f11-8b9c-d8fc4d434503"><enum>2.</enum><header>Restrictions
			 on protective orders and sealing of cases and settlements</header>
			<subsection commented="no" display-inline="no-display-inline" id="id77fd14e8-07a6-4c54-bc01-e863c7ee175c"><enum>(a)</enum><header>In
			 general</header><text>Chapter 111 of title 28, United States Code, is amended
			 by adding at the end the following:</text>
				<quoted-block id="id017151b3-5aa6-47c9-8e7d-44ef91f04e4f" style="USC">
					<section id="id2e46da06-190a-419f-b99c-60d62ea0c8a0"><enum>1660.</enum><header>Restrictions
				on protective orders and sealing of cases and settlements</header>
						<subsection id="id262b117f-5341-4c4c-b9fa-d177a3cf3bd8"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id390bd736-857b-45b8-aa16-d13f406afeba"><enum>(1)</enum><text>A court shall not
				enter an order under rule 26(c) of the Federal Rules of Civil Procedure
				restricting the disclosure of information obtained through discovery, an order
				approving a settlement agreement that would restrict the disclosure of such
				information, or an order restricting access to court records in a civil case
				unless the court has made findings of fact that—</text>
								<subparagraph id="id1625a9ef-7acb-4c71-82cc-716628dd2b6b" indent="up1"><enum>(A)</enum><text>such order would not restrict the
				disclosure of information which is relevant to the protection of public health
				or safety; or</text>
								</subparagraph><subparagraph id="id5df9a1ab-77c1-4c9f-941e-74c3e0e8cd5b" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="idb534095f-181c-45fd-82ae-7c239bdcb5c2"><enum>(i)</enum><text>the public interest
				in the disclosure of potential health or safety hazards is outweighed by a
				specific and substantial interest in maintaining the confidentiality of the
				information or records in question; and</text>
									</clause><clause id="id73573b70-4614-445d-961c-2a4124e374df" indent="up1"><enum>(ii)</enum><text>the requested protective order is no
				broader than necessary to protect the privacy interest asserted.</text>
									</clause></subparagraph></paragraph><paragraph id="iddeca0d08-db55-4a31-8ff6-908362d33d5d" indent="up1"><enum>(2)</enum><text>No order entered in accordance with
				paragraph (1), other than an order approving a settlement agreement, shall
				continue in effect after the entry of final judgment, unless at the time of, or
				after, such entry the court makes a separate finding of fact that the
				requirements of paragraph (1) have been met.</text>
							</paragraph><paragraph id="idb9a13b57-ad7d-4a17-becc-3ac6a363bad2" indent="up1"><enum>(3)</enum><text>The party who is the proponent for
				the entry of an order, as provided under this section, shall have the burden of
				proof in obtaining such an order.</text>
							</paragraph><paragraph id="id0c4335f8-af91-4f5b-b57d-497cac906f78" indent="up1"><enum>(4)</enum><text>This section shall apply even if an
				order under paragraph (1) is requested—</text>
								<subparagraph id="id611d07dd-df89-4739-a1b8-4aeee3f69835"><enum>(A)</enum><text>by motion pursuant to rule 26(c) of
				the Federal Rules of Civil Procedure; or</text>
								</subparagraph><subparagraph id="id5ed8a846-e51d-40e7-ae11-f69b7527c832"><enum>(B)</enum><text>by application pursuant to the
				stipulation of the parties.</text>
								</subparagraph></paragraph><paragraph id="idb8e15699-d99b-4ddc-926c-653d2edb9989" indent="up1"><enum>(5)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id8732e85c-cbe2-4665-9878-138170c55317"><enum>(A)</enum><text>The provisions of
				this section shall not constitute grounds for the withholding of information in
				discovery that is otherwise discoverable under rule 26 of the Federal Rules of
				Civil Procedure.</text>
								</subparagraph><subparagraph id="idd1816cef-0430-4873-a8b9-fa8541941fea" indent="up1"><enum>(B)</enum><text>No party shall request, as a
				condition for the production of discovery, that another party stipulate to an
				order that would violate this section.</text>
								</subparagraph></paragraph></subsection><subsection id="idbaeb4f3c-333d-457e-b7c9-a0a48a5c3d70"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id4f0273e1-f6ff-4a9e-bfc8-1de0d2d3805e"><enum>(1)</enum><text>A court shall not
				approve or enforce any provision of an agreement between or among parties to a
				civil action, or approve or enforce an order subject to subsection (a)(1), that
				prohibits or otherwise restricts a party from disclosing any information
				relevant to such civil action to any Federal or State agency with authority to
				enforce laws regulating an activity relating to such information.</text>
							</paragraph><paragraph id="id129fc54a-9f61-4568-8bfc-f17e9e8f983f" indent="up1"><enum>(2)</enum><text>Any such information disclosed to a
				Federal or State agency shall be confidential to the extent provided by
				law.</text>
							</paragraph></subsection><subsection id="id58465900-ae84-4fac-acbc-bdbd58b8195e"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id334640b4-7249-4991-9713-d627bec0e298"><enum>(1)</enum><text>Subject to
				paragraph (2), a court shall not enforce any provision of a settlement
				agreement described under subsection (a)(1) between or among parties that
				prohibits 1 or more parties from—</text>
								<subparagraph id="id7c448895-b53e-4764-8682-dfee3b314f95" indent="up1"><enum>(A)</enum><text>disclosing that a settlement was
				reached or the terms of such settlement, other than the amount of money paid;
				or</text>
								</subparagraph><subparagraph id="id38ba930f-9b0a-4dc0-a6be-1f50784a1055" indent="up1"><enum>(B)</enum><text>discussing a case, or evidence
				produced in the case, that involves matters related to public health or
				safety.</text>
								</subparagraph></paragraph><paragraph id="id54c9c6a5-caa4-4c28-8f4e-8c019609c4f1" indent="up1"><enum>(2)</enum><text>Paragraph (1) does not apply if the
				court has made findings of fact that the public interest in the disclosure of
				potential health or safety hazards is outweighed by a specific and substantial
				interest in maintaining the confidentiality of the information.</text>
							</paragraph></subsection><subsection id="idA5561587BF7249B0BAA9735AEF26783C"><enum>(d)</enum><text>When weighing the
				interest in maintaining confidentiality under this section, there shall be a
				rebuttable presumption that the interest in protecting personally identifiable
				information relating to financial, health or other similar information of an
				individual outweighs the public interest in disclosure.</text>
						</subsection><subsection id="idD6FF0D9AC7F547599C3B8802B157505E"><enum>(e)</enum><text>Nothing in this
				section shall be construed to permit, require, or authorize the disclosure of
				classified information (as defined under section 1 of the Classified
				Information Procedures Act (18 U.S.C.
				App.)).</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idc6a60dc6-ac67-4828-90d3-48d3b467060d"><enum>(b)</enum><header>Technical
			 and conforming amendment</header><text>The table of sections for chapter 111 of
			 title 28, United States Code, is amended by adding after the item relating to
			 section 1659 the following:</text>

			</subsection></section><section id="idaa1d99ca-f201-4e80-aaf3-a63230ccfca0"><enum>3.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">The amendments made by
			 this Act shall—</text>
			<paragraph id="id166b7325-78ec-4e70-9cd5-1bf476367ed2"><enum>(1)</enum><text>take effect
			 30 days after the date of enactment of this Act; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idc2629257-3255-4860-bd0f-61d0bd41cbae"><enum>(2)</enum><text>apply only to
			 orders entered in civil actions or agreements entered into on or after such
			 date.</text>
