		<official-title>To amend the Federal Insecticide, Fungicide, and
		  Rodenticide Act to implement pesticide-related obligations of the United States
		  under the international conventions or protocols known as the PIC Convention,
		  the POPs Convention, and the LRTAP POPs Protocol.</official-title>

		<section id="ID322A84B0AE654A329EE4B6FC135652AF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>POPs, LRTAP POPs, and PIC
			 Implementation Act of 2009</short-title></quote>.</text>
		</section><section id="IDDF2C0212EA4B48228EE6A72CA62261E8"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 2 of the
			 <act-name parsable-cite="FIFRA">Federal Insecticide, Fungicide, and Rodenticide
			 Act</act-name> (7 U.S.C. 136) is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="ID8968F55C6DB645DCBD812C1A87141951" style="OLC">
				<subsection id="id7A72505D72444B179154A690F9C71BE3"><enum>(pp)</enum><header>Conference</header><text>The
				term <term>Conference</term> means the Conference of the Parties established by
				paragraph 1 of Article 19 of the POPs Convention.</text>
				</subsection><subsection id="id4B27A9E43EE64F75B6DC3333C2FC54AC"><enum>(qq)</enum><header>Conference
				listing decision</header><text>The term <term>Conference listing
				decision</term> means a decision by the Conference to approve an amendment to
				list a pesticide in Annex A or B to the POPs Convention.</text>
				</subsection><subsection id="idB0363BA7DF4B4DCC99F55E1D08001CF5"><enum>(rr)</enum><header>Designated
				national authority</header><text>The term <term>designated national
				authority</term> means 1 or more authorities that a government has designated
				in a notification to the Secretariat of the PIC Convention in accordance with
				Article 4 of the PIC Convention.</text>
				</subsection><subsection id="id9D496258BACD40B38F09D295D8293C82"><enum>(ss)</enum><header>Executive
				body</header><text>The term <term>Executive Body</term> means the Executive
				Body established by Article 10 of the LRTAP Convention.</text>
				</subsection><subsection id="id808B5067CA1241C0A9872475E66BD82D"><enum>(tt)</enum><header>Executive body
				decision 1998/2</header><text>The term <term>Executive Body Decision
				1998/2</term> means the decision of the Executive Body titled <quote>Executive
				Body Decision 1998/2 on Information to Be Submitted and the Procedure for
				Adding Substances to Annexes I, II, or III to the Protocol on Persistent
				Organic Pollutants</quote> and any other Executive Body decision done pursuant
				to Article 14 of the LRTAP POPs Protocol.</text>
				</subsection><subsection id="idB30146D580D8490DB1AE565CA7B552E5"><enum>(uu)</enum><header>LRTAP
				convention</header><text>The term <term>LRTAP Convention</term> means the
				Convention on Long-Range Transboundary Air Pollution, done at Geneva on
				November 13, 1979 (TIAS 10541), and any subsequent amendments to which the
				United States is a party.</text>
				</subsection><subsection id="id807530AA30E94A679F9BB3C114BD68F2"><enum>(vv)</enum><header>LRTAP POPs
				pesticide</header><text>The term <term>LRTAP POPs pesticide</term>
				means—</text>
					<paragraph id="ID64B7C097C0C14C47AE90E3A8908AB192"><enum>(1)</enum><text>aldrin;</text>
					</paragraph><paragraph id="ID26B71216AFF748E69EB714064E217518"><enum>(2)</enum><text>chlordane;</text>
					</paragraph><paragraph id="ID0294AFB1943444BFA085608BF3CBE9DC"><enum>(3)</enum><text>chlordecone;</text>
					</paragraph><paragraph id="ID4EA2DECAB89F4744AC9739E3A3751B21"><enum>(4)</enum><text>dichlorodiphenyltrichloroethane
				(DDT);</text>
					</paragraph><paragraph id="ID1471B477D35B4090B72B1D6FA0027EC5"><enum>(5)</enum><text>dieldrin;</text>
					</paragraph><paragraph id="IDF8F20308A4654590BB1EDD62BFA967F5"><enum>(6)</enum><text>endrin;</text>
					</paragraph><paragraph id="IDC4C253CF069D4B299E9722A286BFADF2"><enum>(7)</enum><text>hexachlorocyclohexane
				(HCH);</text>
					</paragraph><paragraph id="ID063830D49D9D4B02ABC93F02BD89788F"><enum>(8)</enum><text>heptachlor;</text>
					</paragraph><paragraph id="IDE6B0658B083C4193A5D0FEA6B003FA28"><enum>(9)</enum><text>hexachlorobenzene;</text>
					</paragraph><paragraph id="ID18A6CDB682E748E9A3D8EE3A9CC61540"><enum>(10)</enum><text>hexabromobiphenyl;</text>
					</paragraph><paragraph id="ID3E97F590F720475F8387C12A97173BDC"><enum>(11)</enum><text>mirex;</text>
					</paragraph><paragraph id="ID9572C230B7D548DFB4F2F18EBF127C6B"><enum>(12)</enum><text>polychlorinated
				biphenyls (PCBs);</text>
					</paragraph><paragraph id="IDFF52CE6FB58A4730B6D2ED6A35D8471D"><enum>(13)</enum><text>toxaphene;
				and</text>
					</paragraph><paragraph id="IDE66A6026999F43A2AB60169BA016AB65"><enum>(14)</enum><text>any other
				pesticide—</text>
						<subparagraph id="ID05BBEBC1D5B24512938E62F5B9CE9021"><enum>(A)</enum><text>that is listed on
				Annex I or II of the LRTAP POPs Protocol;</text>
						</subparagraph><subparagraph id="ID9BF7888BA740452097D8D4FF34938892"><enum>(B)</enum><text>that has no
				existing United States registrations that would prevent the United States from
				complying with its obligations under the LRTAP POPs Protocol if the United
				States were to become a party to the LRTAP POPs Protocol for that pesticide;
				and</text>
						</subparagraph><subparagraph id="ID627459B75EB54CF0B11CC749CF48F0A8"><enum>(C)</enum><text>for which an
				amendment listing the pesticide on Annex I or II of the LRTAP POPs Protocol has
				entered into force for the United States.</text>
						</subparagraph></paragraph></subsection><subsection id="id8B6FBA8FAFDA4C6CA0063A5159930349"><enum>(ww)</enum><header>LRTAP POPs
				protocol</header><text>The term <term>LRTAP POPs Protocol</term> means the
				Protocol on Persistent Organic Pollutants to the LRTAP Convention, done at
				Aarhus on June 24, 1998, and any subsequent amendment to which the United
				States is a party.</text>
				</subsection><subsection id="id02CC8AC46A7C40F787732DEE642E2452"><enum>(xx)</enum><header>PIC
				convention</header><text>The term <term>PIC Convention</term> means the
				Rotterdam Convention on the Prior Informed Consent Procedure for Certain
				Hazardous Chemicals and Pesticides in International Trade, done at Rotterdam on
				September 10, 1998, and any subsequent amendment to which the United States is
				a party.</text>
				</subsection><subsection id="idA3B19137708B4AC38E6584662ADDADCF"><enum>(yy)</enum><header>POPs
				convention</header><text>The term <term>POPs Convention</term> means the
				Stockholm Convention on Persistent Organic Pollutants, done at Stockholm on May
				22, 2001, and any subsequent amendment to which the United States is a
				party.</text>
				</subsection><subsection id="id7841296BECC2492BB0F82C09022E86C5"><enum>(zz)</enum><header>POPs
				pesticide</header><text>The term <term>POPs pesticide</term> means—</text>
					<paragraph id="IDBF63DBFEA18B40B092554E7261BA2DDC"><enum>(1)</enum><text>aldrin;</text>
					</paragraph><paragraph id="IDDD581FB2ECE446BFACF4277FFE4BDD7B"><enum>(2)</enum><text>chlordane;</text>
					</paragraph><paragraph id="IDB50245637CA54CAD91A357FE1285C157"><enum>(3)</enum><text>dichlorodiphenyltrichloroethane
				(DDT);</text>
					</paragraph><paragraph id="IDCFB5381A7DE941239ECD0D19C786797E"><enum>(4)</enum><text>dieldrin;</text>
					</paragraph><paragraph id="IDDF78FBAE9FD34B68AD1FEFFF7ABA12A4"><enum>(5)</enum><text>endrin;</text>
					</paragraph><paragraph id="IDB7659A68B0234222AF4EBC53E0795C9B"><enum>(6)</enum><text>heptachlor;</text>
					</paragraph><paragraph id="ID017529DD46D54098BC276C30857CA92D"><enum>(7)</enum><text>hexachlorobenzene;</text>
					</paragraph><paragraph id="ID67BC5BD949A84B4C9B30868135CED5C4"><enum>(8)</enum><text>mirex;</text>
					</paragraph><paragraph id="ID6B8F81615BBC4732B0D59F0A4C25BB01"><enum>(9)</enum><text>polychlorinated
				biphenyls (PCBs);</text>
					</paragraph><paragraph id="ID548FF4695C5C475094D2CC5DF909AC4E"><enum>(10)</enum><text>toxaphene;
				and</text>
					</paragraph><paragraph id="IDB064201A7B944E1CA273214A381219AC"><enum>(11)</enum><text>any other
				pesticide—</text>
						<subparagraph id="IDD5282E7357BD4B7993EF22D6B132480B"><enum>(A)</enum><text>that is listed on
				Annex A or B of the POPs Convention;</text>
						</subparagraph><subparagraph id="ID2FFC1BE1DFD14B2E874AE22C329D9EE4"><enum>(B)</enum><text>that has no
				existing United States registrations that would prevent the United States from
				complying with its obligations under the POPs Convention if the United States
				were to become a party to the POPs Convention for that pesticide; and</text>
						</subparagraph><subparagraph id="IDA6DFD8B7C1254ABB8917C8DD6FE782CA"><enum>(C)</enum><text>for which an
				amendment listing the pesticide on Annex A or B of the POPs Convention has
				entered into force for the United States.</text>
						</subparagraph></paragraph></subsection><subsection id="id9665EC2019DB4833B1B943BC824F32F5"><enum>(aaa)</enum><header>POPs review
				committee</header><text>The term <term>POPs Review Committee</term> means the
				Persistent Organic Pollutants Review Committee established under paragraph 6 of
				Article 19 of the POPs
				Convention.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="ID8D73C633C6954E4BA87F03B65037E7A9"><enum>3.</enum><header>POPs Convention,
			 LRTAP POPs Protocol, and PIC Convention</header><text display-inline="no-display-inline">Section 17 of the
			 <act-name parsable-cite="FIFRA">Federal Insecticide, Fungicide, and Rodenticide
			 Act</act-name> (7 U.S.C. 136o) is amended—</text>
			<paragraph id="IDD89F63BDD03343FD924BCD1C09CB599D"><enum>(1)</enum><text>in the section
			 heading, by striking <quote><header-in-text level="section">imports and
			 exports.</header-in-text></quote> and inserting <quote><header-in-text level="section">imports, exports, and international
			 conventions.</header-in-text></quote>;</text>
			</paragraph><paragraph id="ID9764453D28FF4354A1BB2C8B60B6CC21"><enum>(2)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="IDE220AC1495FA46F19361045C4259364E"><enum>(A)</enum><text>in the matter
			 preceding paragraph (1), by striking <quote>this Act—</quote> and inserting
			 <quote>this Act, if—</quote>;</text>
				</subparagraph><subparagraph id="IDDBFC5C1520F34115812DAADE758691F1"><enum>(B)</enum><text>in paragraph
			 (1)—</text>
					<clause id="ID7482E2678334403E824FE4EC8EE66E9E"><enum>(i)</enum><text>by
			 striking <quote>when</quote> and inserting <quote>the pesticide or device or
			 active ingredient used in producing a pesticide is</quote>; and</text>
					</clause><clause id="ID1F165B04DDA74365966B906D1E7C6512"><enum>(ii)</enum><text>by
			 striking <quote>and</quote> after the semicolon; and</text>
					</clause></subparagraph><subparagraph id="ID472F8A502B1A4C80958F661EDD77C2F8"><enum>(C)</enum><text>by striking
			 paragraph (2) and all that follows and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="ID340677CF94E745C590CD86DC6854F2BD" style="OLC">
						<paragraph id="ID713C4A5A46654854B8978825D998CEDD"><enum>(2)</enum><text>in the case of
				any pesticide other than a pesticide registered under section 3 or sold under
				section 6(a)(1), the foreign purchaser has, prior to export, signed a statement
				acknowledging that the purchaser understands that the pesticide is not
				registered for use in the United States and cannot be sold in the United States
				under this Act; and</text>
						</paragraph><paragraph id="ID336D5BDD3B1D4BE1AA1962A2F50DC112"><enum>(3)</enum><text>the export is in
				compliance with all of the applicable provisions of this section.</text>
						</paragraph><quoted-block-continuation-text quoted-block-continuation-text-level="subsection">A copy of
				the statement under paragraph (2) shall be transmitted to an appropriate
				official of the government of the importing
				country.</quoted-block-continuation-text><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="IDAC9D3D18075F4F7A98CD7427B3FE7E5B"><enum>(3)</enum><text>in subsection
			 (c)—</text>
				<subparagraph id="ID101E67C38DE342DDB5FD4BFE71B15057"><enum>(A)</enum><text>by redesignating
			 the first through fourth sentences as paragraphs (1) through (4), respectively;
			 and</text>
				</subparagraph><subparagraph id="ID86254E0011904C13938557EAAAC93570"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="ID368C9327485347278B360348D8D259C5" style="OLC">
						<paragraph id="ID28BE4FBDB22B41AB86FCEBAB8C324998"><enum>(5)</enum><header>Prohibited
				imports</header><text>Nothing in this subsection permits the importation of any
				POPs pesticide or LRTAP POPs pesticide that otherwise is prohibited under
				subsection
				(e).</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="ID3566B4FF0F25459988A21C31AA1E7039"><enum>(4)</enum><text>in the subsection
			 heading of subsection (d), by inserting <quote><header-in-text level="section">Generally</header-in-text></quote> after <quote><header-in-text level="section">Efforts</header-in-text></quote>; and</text>
			</paragraph><paragraph id="IDA28B21CDFD2740C995147EBB19DB7641"><enum>(5)</enum><text>by striking
			 subsection (e) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="ID4F6A8DA64C774E67B04C880AE85666F7" style="OLC">
					<subsection id="IDAAE5373EBC7B491091C6A138DE1C2DAF"><enum>(e)</enum><header>Pops
				convention, lrtap pops protocol, and pic convention</header>
						<paragraph id="ID90FE56C499E04E978A6E1DC402D6A37C"><enum>(1)</enum><header>In
				general</header><text>The Administrator shall, in cooperation with the
				Department of State and any other appropriate Federal agency, participate in
				technical cooperation and capacity building activities designed to support
				implementation of the POPs Convention, the LRTAP POPs Protocol, and the PIC
				Convention.</text>
						</paragraph><paragraph id="IDAF776EC456C34D68AFBE31D8C5C1421F"><enum>(2)</enum><header>Prohibitions</header><text>No
				person may sell, distribute, use, produce, or dispose of a POPs pesticide or
				LRTAP POPs pesticide in a manner inconsistent with obligations of the United
				States under the POPs Convention or LRTAP POPs Protocol.</text>
						</paragraph><paragraph id="ID6E8DA68271FE4B5087287F1EBF4B400D"><enum>(3)</enum><header>Notice and
				report after decision that screening criteria are met under pops convention or
				after risk profile submitted under lrtap pops protocol</header>
							<subparagraph id="ID86DECC2E722846C9AADBF5E66D60165B"><enum>(A)</enum><header>Applicability</header><text>This
				paragraph applies if—</text>
								<clause id="ID70FFC2F1F8D6423AA53F4DD989D4FD1A"><enum>(i)</enum><text>the POPs Review
				Committee or Conference decides—</text>
									<subclause id="IDFBF61EF79C82427C862C0859C15D882A"><enum>(I)</enum><text>under paragraph
				4(a) of Article 8 of the POPs Convention, that a proposal for listing a
				pesticide in Annex A, B, or C to the POPs Convention fulfills the screening
				criteria specified in Annex D to the POPs Convention; or</text>
									</subclause><subclause id="ID6B1CFF4F41464A48BE19E85401B874E0"><enum>(II)</enum><text>under paragraph
				5 of Article 8 of the POPs Convention, that such a proposal shall proceed;
				or</text>
									</subclause></clause><clause id="IDE23FAA6390724BA18E48E204D5BC9FB9"><enum>(ii)</enum><text>a party to the
				LRTAP POPs Protocol submits to the Executive Body a risk profile in support of
				a proposal to list a pesticide in Annex I, II, or III to the LRTAP POPs
				Protocol.</text>
								</clause></subparagraph><subparagraph id="ID75ABEABFC8B54CDBB6DE49A0649AEDB5"><enum>(B)</enum><header>Notice</header><text>Not
				later than 45 days after the date of the POPs Review Committee or Conference
				decision on a proposal or the submission of a risk profile in support of a
				proposal under the LRTAP POPs Protocol described in clause (i) or (ii) of
				subparagraph (A), respectively, the Administrator shall—</text>
								<clause id="ID99AF2BF943CF4CFFA4241B5C29735603"><enum>(i)</enum><text>publish in the
				Federal Register a notice of the proposal; and</text>
								</clause><clause id="IDE56B6C8D66A6442F836CEA3B1A6466AF"><enum>(ii)</enum><text>provide
				opportunity for comment on the proposal.</text>
								</clause></subparagraph><subparagraph id="IDE2E15061B0214386A490B9684DD5F139"><enum>(C)</enum><header>Required
				elements of notice</header><text>A notice under subparagraph (B) shall—</text>
								<clause id="ID8EF4ABCF202A436A889E65DC87C07A95"><enum>(i)</enum><text>identify the
				pesticide that is the subject of the proposal;</text>
								</clause><clause id="ID6CBCC75300F348C78C495C4A2305EE74"><enum>(ii)</enum><text>include a
				summary of the process under the POPs Convention or the LRTAP POPs Protocol for
				the submission of a proposal and listing of a pesticide that is the subject of
				a proposal (including criteria applied in that process);</text>
								</clause><clause id="ID3AE33C8DE1D8412AB2ABF8993088BFF1"><enum>(iii)</enum><text>include—</text>
									<subclause id="ID1D0C4A608269436E950365972E7F1997"><enum>(I)</enum><text>a summary of the
				POPs Review Committee or Conference decision and the basis for the decision;
				or</text>
									</subclause><subclause id="ID453E982A87964AE4AAAB08E141512007"><enum>(II)</enum><text>a summary of the
				risk profile that a party to the LRTAP POPs Protocol submitted to the Executive
				Body;</text>
									</subclause></clause><clause id="ID81401D247713432D8FF21EA6627E8C6B"><enum>(iv)</enum><text>request
				information relevant to and comment on—</text>
									<subclause id="ID905DA3008C9B431BBCC38DA70DB2E074"><enum>(I)</enum><text>in the case of a
				pesticide proposed for listing in an Annex to the POPs Convention, the
				information requirements and screening criteria elements covered under Annex D
				to the POPs Convention; or</text>
									</subclause><subclause id="IDCAC097B13258499E8A9B073182FE9C1C"><enum>(II)</enum><text>in the case of a
				pesticide proposed for listing in an Annex to the LRTAP POPs Protocol, the
				information referenced in paragraph 6(a) of Article 14 of the LRTAP POPs
				Protocol;</text>
									</subclause></clause><clause id="ID0D5CC80926E8498C918E63FBD11FC710"><enum>(v)</enum><text>request
				information described in subparagraph (D);</text>
								</clause><clause id="IDE6CD38BFD93B4BD1ADFF8F1DEDEEF07F"><enum>(vi)</enum><text>include any
				other information that the Administrator considers to be relevant to the
				proposal;</text>
								</clause><clause id="ID0200938005EA4707BF58461EF4CF82CE"><enum>(vii)</enum><text>request
				information and comment on—</text>
									<subclause id="ID4B594874F6A74D16AC169919CEDF7821"><enum>(I)</enum><text>information
				relevant to the risk profile of the POPs Review Committee covered under Annex E
				to the POPs Convention; and</text>
									</subclause><subclause id="IDA1E874D471D84309A6420D096A0817D0"><enum>(II)</enum><text>information
				relevant to any technical review conducted under paragraph 2 of Executive Body
				Decision 1998/2; and</text>
									</subclause></clause><clause id="ID76140DA98778474CBEBCA1BA5FF196F3"><enum>(viii)</enum><text>include a
				statement that any information submitted may be part of the record of any
				cancellation proceeding related to the pesticide that the Administrator may
				undertake under section 6.</text>
								</clause></subparagraph><subparagraph id="ID2734BD7CCAD04CD5BB999595B245F3C1"><enum>(D)</enum><header>Provision of
				information</header>
								<clause id="IDBEA4903018864B30940A4D3DA0B0EF95"><enum>(i)</enum><header>Provision of
				information under pops convention</header><text>Not later than 60 days after
				the date of publication of the notice under subparagraph (B) regarding a
				proposal to list a pesticide on an Annex to the POPs Convention, or not later
				than a later date as determined by the Administrator, any interested person may
				provide to the Administrator information or comment on—</text>
									<subclause id="IDF2A779DAD76F4144BA58E40F3C46C385"><enum>(I)</enum><text>the annual
				quantity of the pesticide manufactured and the 1 or more locations of the
				manufacture;</text>
									</subclause><subclause id="ID46992B0F34684D8D96EEE4842EC4D24D"><enum>(II)</enum><text>the uses of the
				pesticide;</text>
									</subclause><subclause id="ID38CC9FA7FE9E407BA63F48BC245E2DC7"><enum>(III)</enum><text>the approximate
				annual quantity of the pesticide that is released into the environment;
				and</text>
									</subclause><subclause id="ID255DCB8AC2E447FE9C659F25AAEF3B46"><enum>(IV)</enum><text>other
				information or monitoring data relating to the pesticide that is consistent
				with the information specified in paragraph 1 of Annex D, and subsections (b)
				through (e) of Annex E, to the POPs Convention.</text>
									</subclause></clause><clause id="IDC1E9833508B446438A00424F6C1EE71A"><enum>(ii)</enum><header>Provision of
				information under lrtap pops protocol</header><text>Not later than 60 days
				after the date of publication of the notice under subparagraph (B) regarding a
				proposal to list a pesticide on an Annex of the LRTAP POPs Protocol, or not
				later than a later date as determined by the Administrator, any interested
				person may provide to the Administrator information on—</text>
									<subclause id="IDEACDAF86334542F699172C4231ECA991"><enum>(I)</enum><text>the potential for
				long-range transboundary atmospheric transport of the pesticide;</text>
									</subclause><subclause id="IDE33F78BBEDAA4064BC80459E27E2FFD3"><enum>(II)</enum><text>the toxicity of
				the pesticide;</text>
									</subclause><subclause id="ID131C962FDB38444B86B3D50A34B49872"><enum>(III)</enum><text>the persistence
				of the pesticide, including biotic degradation process and rates of degradation
				products;</text>
									</subclause><subclause id="ID9ECBB32848A34416A1F1FD03419F7568"><enum>(IV)</enum><text>the
				bioaccumulation of the pesticide, including bioavailability;</text>
									</subclause><subclause id="IDA5B64589C201477688104A4502A79441"><enum>(V)</enum><text>the annual
				quantity of the pesticide manufactured and the 1 or more locations of the
				manufacture;</text>
									</subclause><subclause id="IDEC3E0FFEB8CD463DB349D38943F62AA9"><enum>(VI)</enum><text>the uses of the
				pesticide;</text>
									</subclause><subclause id="ID66A2B0D4F5CE461D9A62EA44C9596ECE"><enum>(VII)</enum><text>the approximate
				annual quantity of the pesticide released into the environment;</text>
									</subclause><subclause id="ID9F24357958B64DEA953B6C421DE63DC6"><enum>(VIII)</enum><text>environmental
				monitoring data relating to the pesticide (in areas distant from
				sources);</text>
									</subclause><subclause id="ID2A1803BE0FD34102B8A0D8EC3981F708"><enum>(IX)</enum><text>information
				on—</text>
										<item id="IDC1F26B1C1F024393A45D647960276D89"><enum>(aa)</enum><text>alternatives to
				the uses of the pesticide and the efficacy of each alternative; and</text>
										</item><item id="ID5B60A19ADD5C44F29C0EEFC648911E78"><enum>(bb)</enum><text>known adverse
				environmental or human health effects associated with each alternative;</text>
										</item></subclause><subclause id="IDA7F702C034F448088020278F3270B146"><enum>(X)</enum><text>information
				on—</text>
										<item id="ID4ABE39CA6BC5489CA32500A31F0EFAC4"><enum>(aa)</enum><text>process changes,
				control technologies, operating practices, and other pollution prevention
				techniques that can be used to reduce the emissions of the pesticide;
				and</text>
										</item><item id="ID05F0CE10824548DCAFAFC9725310D54C"><enum>(bb)</enum><text>the
				applicability and effectiveness of each technique describe in item (aa);
				and</text>
										</item></subclause><subclause id="ID4FF4295171DB4F6A96615043C290C461"><enum>(XI)</enum><text>information on
				nonmonetary costs and benefits and the quantifiable costs and benefits
				associated with the use of each alternative described in subclause (IX) or
				technique described in subclause (X)(aa).</text>
									</subclause></clause></subparagraph><subparagraph id="IDEF1DD5062FE6470F9C0F00A431370CE6"><enum>(E)</enum><header>Report by the
				administrator</header><text>Not later than 240 days after the date of
				publication of a notice under subparagraph (B), based on information received
				under this paragraph and any other relevant information available to the
				Administrator, the Administrator, after consulting with the Secretary of
				Agriculture or, for public health pesticides, with the Secretary of Health and
				Human Services, shall issue for public comment and peer review a report that
				contains, at a minimum—</text>
								<clause id="ID76A80674DCEA40EBADD924AE972CB8B4"><enum>(i)</enum><text>information on
				the production and uses in the United States of the pesticide; and</text>
								</clause><clause id="IDFC3B8719E30A4B53873B71B70594B4C5"><enum>(ii)</enum><text>a review of the
				benefits and risks in the United States and internationally associated with the
				production and uses in the United States and internationally of the
				pesticide.</text>
								</clause></subparagraph></paragraph><paragraph id="ID630CFAE0E9604DC9950083564401DC9A"><enum>(4)</enum><header>Notice and
				report after decision that global action warranted under pops convention or
				that further consideration of pesticides warranted under lrtap pops
				protocol</header>
							<subparagraph id="IDC6207172D0C842DB8B44DCB083A21544"><enum>(A)</enum><header>Applicability</header><text>This
				paragraph applies if—</text>
								<clause id="IDDD76A623A29F44B084F02668971D75FE"><enum>(i)</enum><text>the POPs Review
				Committee decides, under paragraph 7(a) of Article 8 of the POPs Convention,
				that global action is warranted with respect to a pesticide that is the subject
				of a proposal, or the Conference decides, under paragraph 8 of that Article,
				that the proposal shall proceed; or</text>
								</clause><clause id="ID0A233FCE39D54ECCB56EE899AB35E91E"><enum>(ii)</enum><text>the Executive
				Body determines pursuant to paragraph 2 of Executive Body Decision 1998/2 that
				further consideration of a pesticide is warranted and therefore requires 1 or
				more technical reviews of a proposal.</text>
								</clause></subparagraph><subparagraph id="ID0A4B1EC136844263A6A55E1008B69B45"><enum>(B)</enum><header>Notice</header><text>Not
				later than 45 days after the date of the decision or determination under
				subparagraph (A), the Administrator shall—</text>
								<clause id="IDCF0BF2C474E340FBA65D4769D3768762"><enum>(i)</enum><text>publish in the
				Federal Register a notice of the decision or determination; and</text>
								</clause><clause id="IDDC9F1972FF31488C9201194E0C5BA470"><enum>(ii)</enum><text>provide an
				opportunity for comment on the decision or determination.</text>
								</clause></subparagraph><subparagraph id="IDC4F38F1A98064B8A97BB2DD08314E688"><enum>(C)</enum><header>Required
				elements of notice</header><text>A notice under subparagraph (B) shall—</text>
								<clause id="ID2E1025093D8B4E90B7434F38B4F3ACF4"><enum>(i)</enum><text>identify the
				pesticide that is the subject of the proposal;</text>
								</clause><clause id="IDE26322400A4441B992919AA07DBA8638"><enum>(ii)</enum><text>include a
				summary of—</text>
									<subclause id="IDBA6F0666C17E4472B3CF382D4953883B"><enum>(I)</enum><text>the POPs Review
				Committee or Conference decision and the basis for the decision; or</text>
									</subclause><subclause id="IDA40AD3E8ADBB4F5FAB10445010E96614"><enum>(II)</enum><text>the Executive
				Body determination and the basis for the determination;</text>
									</subclause></clause><clause id="ID359690D340DF44E58482EA4D4E45AC10"><enum>(iii)</enum><text>request
				information and comment—</text>
									<subclause id="ID5C1A9EABA58C4617871FBE0926AD0561"><enum>(I)</enum><text>in the case of a
				pesticide proposed for addition to an Annex of the POPs Convention, on
				socioeconomic considerations covered under Annex F of the POPs Convention,
				including on the technical feasibility and costs and benefits of the range of
				possible prohibitions described pursuant to clause (vi);</text>
									</subclause><subclause id="IDC2FC3AFD83CB44DBA187ABF445BA2CBD"><enum>(II)</enum><text>in the case of a
				pesticide proposed for listing on an Annex to the LRTAP POPs Protocol,
				on—</text>
										<item id="ID152507C1DDF743F1B5F5797373EE7170"><enum>(aa)</enum><text>any additional
				measures not described pursuant to clause (vi) that may exist to reduce the
				risks of adverse health effects on human health or the environment that result
				from the long-range transboundary atmospheric transport of the
				pesticide;</text>
										</item><item id="ID3EFCDE2EB37E44FD94DC83601B4C5D4C"><enum>(bb)</enum><text>the technical
				feasibility of any of the additional measures or the measures described
				pursuant to clause (vi); and</text>
										</item><item id="ID4184BB998686402D98388D6BE6CB7C80"><enum>(cc)</enum><text>the associated
				costs and benefits of the additional measures and the measures described
				pursuant to clause (vi);</text>
										</item></subclause></clause><clause id="ID9515C1D2DC5C4EBDA791FD19B26B44E4"><enum>(iv)</enum><text>request
				information on any current or anticipated production or use of the pesticide
				that is the subject of the proposal for which the United States may wish
				to—</text>
									<subclause id="ID975A48E5C483475E831A131515A4FFF5"><enum>(I)</enum><text>seek an exemption
				or acceptable purpose under the POPs Convention; or</text>
									</subclause><subclause id="IDB7FB092C91EB4283882C239A24FA0A65"><enum>(II)</enum><text>allow a
				restricted use or condition under the LRTAP POPs Protocol;</text>
									</subclause></clause><clause id="IDD472B2898B6E406EB0BD9A6F1C2E51BF"><enum>(v)</enum><text>request
				information described in subparagraph (D);</text>
								</clause><clause id="IDC33C9BE9171947809BD68D705C33A538"><enum>(vi)</enum><text>outline a broad
				range of possible actions that the United States could take to address any
				risks that the pesticide may pose;</text>
								</clause><clause id="ID755518978C8846C5871A023CC4BB06D1"><enum>(vii)</enum><text>specify what
				changes, if any, to registrations of or tolerances for the pesticide have been
				made since the date of publication of the notice under paragraph (3);
				and</text>
								</clause><clause id="ID4D32EA4D36F54D119082EDA548EA5868"><enum>(viii)</enum><text>include a
				statement that any information submitted may be included as part of the record
				of any cancellation proceeding related to the pesticide that the Administrator
				may undertake under section 6.</text>
								</clause></subparagraph><subparagraph id="ID9E1460F2343A4B7DB39A8FFF55690435"><enum>(D)</enum><header>Provision of
				information</header><text>Not later than 60 days after the date of publication
				of the notice under subparagraph (B), or not later than a later date as
				determined by the Administrator, any interested person may provide to the
				Administrator—</text>
								<clause id="ID9C3427ADBEF64983BD56BBD83DABA1EC"><enum>(i)</enum><text>consistent with
				the information needs described in Annex F to the POPs Convention, any
				information that the person believes is relevant to—</text>
									<subclause id="ID85DF367F197C4B8DB0D3F7620AFF1DF8"><enum>(I)</enum><text>a risk management
				evaluation carried out under paragraph 7 of Article 8 of the POPs Convention;
				or</text>
									</subclause><subclause id="IDAAE8D3F18F7A47FCAE96CC54692F431D"><enum>(II)</enum><text>a decision by
				the Conference under paragraph 9 of Article 8 of the POPs Convention;</text>
									</subclause></clause><clause id="ID8C3E5CC2D62B4AE991DDD1D8E7814D94"><enum>(ii)</enum><text>consistent with
				the information needs for the technical review described in paragraph 2 of
				Executive Body Decision 1998/2, any information the person believes is relevant
				to the technical review or to an Executive Body decision made under paragraph 3
				of Article 14 of the LRTAP POPs Protocol;</text>
								</clause><clause id="ID578EBE91F3B64C3C972D1580DA6A5AAA"><enum>(iii)</enum><text>any information
				that the person believes is relevant to an action under this subsection;
				and</text>
								</clause><clause id="IDE38D15FC5CD04AC5871A516832D35019"><enum>(iv)</enum><text>information on
				any article in use that consists of, contains, or is contaminated with the
				pesticide.</text>
								</clause></subparagraph><subparagraph id="ID4CE89D4185F845709CB922514C644601"><enum>(E)</enum><header>Report by
				administrator</header><text>Not later than 240 days after the date of
				publication of the notice under subparagraph (B), based on information received
				under this paragraph and any other information available to the Administrator,
				the Administrator, after consultation with the Secretary of Agriculture or, for
				public health pesticides, with the Secretary of Health and Human Services,
				shall issue a report for public comment and peer review that includes, at a
				minimum, information relating to the costs and benefits of the prohibitions or
				restrictions described in response to subparagraph (C)(vi) that could be placed
				on the sale, distribution, production, use, or disposal of the pesticide
				(including the possible consequences of using alternative products or
				processes).</text>
							</subparagraph></paragraph><paragraph id="IDEF41F73141A84F5FBEC31DEE77D8E13B"><enum>(5)</enum><header>Notice after
				recommendation that conference consider listing or after completion of
				technical review</header>
							<subparagraph id="ID8AA75A8791754A97AAFF3B9B41E56A1F"><enum>(A)</enum><header>Applicability</header><text>This
				paragraph applies—</text>
								<clause id="ID019341C8135C466EACE55571ADDF71FC"><enum>(i)</enum><text>if the POPs
				Review Committee recommends, under paragraph 9 of Article 8 of the POPs
				Convention, that the Conference consider making a Conference listing decision
				with respect to the pesticide in accordance with the proposal; or</text>
								</clause><clause id="IDBEA7CBBD684B410EB3F0F263132D3F7B"><enum>(ii)</enum><text>after completion
				of a technical review of a proposal to list a pesticide on an Annex to the
				LRTAP POPs Protocol.</text>
								</clause></subparagraph><subparagraph id="ID4D2F79BBEAB446588F60B2173F66D258"><enum>(B)</enum><header>Notice</header><text>Not
				later than 45 days after the date of the POPs Review Committee recommendation
				or completion of a technical review described in clause (i) or (ii) of
				subparagraph (A), respectively, the Administrator shall—</text>
								<clause id="IDD6B123DEF20E4FBAB730C874B1DD47E9"><enum>(i)</enum><text>publish in the
				Federal Register a notice of the recommendation or completion of the technical
				review; and</text>
								</clause><clause id="IDEC2520ABCB604F05853D12D35795FA35"><enum>(ii)</enum><text>provide
				opportunity for comment on the recommendation or the technical review.</text>
								</clause></subparagraph><subparagraph id="ID048CFA4AF1DC49C4B62F24F76596C8FD"><enum>(C)</enum><header>Required
				elements of notice</header><text>A notice under subparagraph (B) shall—</text>
								<clause id="ID9382958F6766400C89B53A6DE2501282"><enum>(i)</enum><text>include a summary
				of the POPs Review Committee recommendation and the basis for the
				recommendation or a summary of the technical review;</text>
								</clause><clause id="IDBA8984ED39A14591BF24620F8A9E3378"><enum>(ii)</enum><text>summarize any
				control measures for the pesticide that are—</text>
									<subclause id="ID3C7EF5FBE10B4C7D9BD2D28471316424"><enum>(I)</enum><text>identified by the
				POPs Review Committee; or</text>
									</subclause><subclause id="ID2D230360C974463B838EE1CD8474AE1A"><enum>(II)</enum><text>covered by the
				technical review; and</text>
									</subclause></clause><clause id="IDA7370E62F52145DDA6E140EC05FA7ACC"><enum>(iii)</enum><text>include a
				statement that any information submitted may be included as part of the record
				of any cancellation proceeding related to the pesticide that the Administrator
				may undertake under section 6.</text>
								</clause></subparagraph></paragraph><paragraph id="IDF07D302FC604495698E86DA69E6CE6B2"><enum>(6)</enum><header>Consideration
				of information in cancellation of registration</header><text>In a cancellation
				proceeding under section 6 for a pesticide listed on Annex A or B of the POPs
				Convention or Annex I or II of the LRTAP POPs Protocol, the Administrator may
				consider—</text>
							<subparagraph id="ID42611294ADCD49F89E2F4E58CEA30F01"><enum>(A)</enum><text>the record
				compiled under paragraphs (3), (4), and (5);</text>
							</subparagraph><subparagraph id="ID87907B4796FB4CCDB813DC4D926F5279"><enum>(B)</enum><text>information
				related to domestic sale, distribution, production, export, and use of the
				pesticide;</text>
							</subparagraph><subparagraph id="ID786F2E25A67B4844A64348DA530C734F"><enum>(C)</enum><text>information
				related to national and international consequences that are likely to arise as
				a result of domestic regulatory actions (including the possible consequences of
				using alternative products or processes);</text>
							</subparagraph><subparagraph id="ID6A86BF0DE2174048A60ADCD3A2FB60F9"><enum>(D)</enum><text>for pesticides
				listed on Annex A or B of the POPs Convention—</text>
								<clause id="IDA266ADE0F70C497AAB4CF9881AB69356"><enum>(i)</enum><text>the POPs Review
				Committee recommendation under paragraph 9 of Article 8 of the POPs
				Convention;</text>
								</clause><clause id="ID6EDA5C28D7F443D0AE75B8EB8413FF77"><enum>(ii)</enum><text>the Conference
				listing decision; and</text>
								</clause><clause id="ID0E1296FF62A04C9F924E4F1D59856313"><enum>(iii)</enum><text>information
				that the United States submits to the POPs Review Committee or to the
				Conference pursuant to Article 8 of the POPs Convention;</text>
								</clause></subparagraph><subparagraph id="IDB88B753980694003A69AE36EF89123F8"><enum>(E)</enum><text>for pesticides
				listed on Annex I or II of the LRTAP POPs Protocol—</text>
								<clause id="ID963815947F4446FA9E9E2FEFED67C077"><enum>(i)</enum><text>any technical
				review conducted pursuant to paragraph 2 of Executive Body Decision
				1998/2;</text>
								</clause><clause id="IDFCBFCC3B85A14120A3FE6594A12D8795"><enum>(ii)</enum><text>the LRTAP POPs
				Protocol listing decision; and</text>
								</clause><clause id="ID5C82CF16991941F5BCF5C2D18A66D0D2"><enum>(iii)</enum><text>information
				that the United States submitted to the Executive Body, or a subsidiary of the
				Executive Body, in relation to a technical review or listing decision;
				and</text>
								</clause></subparagraph><subparagraph id="ID61C1A31DE2DF417FBCA443AA0AD29C33"><enum>(F)</enum><text>scientific
				information included in or used to develop or support the items listed in
				subparagraphs (A) through (E).</text>
							</subparagraph></paragraph><paragraph id="ID960C55C856CB4B7AB2C14C169E3FE2F6"><enum>(7)</enum><header>No effect on
				other provisions</header>
							<subparagraph id="IDA08A8E40A03D47A5BB5FDD2BCD525A1A"><enum>(A)</enum><header>In
				general</header><text>Nothing in this subsection authorizes any sale,
				distribution, use, production, or disposal of any POPs pesticide or LRTAP POPs
				pesticide that is prohibited under any other provision of law.</text>
							</subparagraph><subparagraph id="ID6A3AA41AEBE24D21A14F3E78772ECB6F"><enum>(B)</enum><header>Action by the
				administrator</header><text>Except to the extent necessary to comply with the
				PIC Convention, the POPs Convention, or the LRTAP POPs Protocol, nothing in
				this subsection interferes with or is a prerequisite to the Administrator
				taking any action authorized under this Act.</text>
							</subparagraph></paragraph><paragraph id="IDFD1930D6F5374FF2BAA2160A0C21C6D6"><enum>(8)</enum><header>Requirements
				for exports</header><text>In the case of a pesticide or active ingredient used
				in producing a pesticide identified by the Administrator as listed on Annex III
				of the PIC Convention in a notice issued under paragraph (11)(C), any person
				that distributes in commerce the pesticide or active ingredient used in
				producing a pesticide for export shall comply with any export conditions or
				restrictions identified by the Administrator in the notice.</text>
						</paragraph><paragraph id="ID9A2697374A184BCA915E06C2CBAA1FAD"><enum>(9)</enum><header>Pre-export
				notices</header>
							<subparagraph id="IDAD96EFF88F984C299628AE6577045DBE"><enum>(A)</enum><header>In
				general</header>
								<clause id="ID139B0A6622534D008189D1CA53A458B4"><enum>(i)</enum><header>Requirement</header><text>In
				the case of—</text>
									<subclause id="ID36F3EB7E649D44189D265E16C6020535"><enum>(I)</enum><text>a pesticide or
				active ingredient used in producing a pesticide that the Administrator
				determines to be banned or severely restricted under paragraph (11)(A);</text>
									</subclause><subclause id="IDCBAF3F10C14A437E8E5A53BEC9612401"><enum>(II)</enum><text>a pesticide or
				active ingredient used in producing a pesticide identified by the Administrator
				in a notice issued under paragraph (11)(C); or</text>
									</subclause><subclause id="IDA5EEA89C45D6433F81FE63699E31C76A"><enum>(III)</enum><text>a POPs
				pesticide the export of which is not prohibited under paragraph (2);</text>
									</subclause><continuation-text continuation-text-level="clause">the exporter
				of the pesticide or active ingredient used in producing the pesticide shall
				provide to the Administrator notice of the intent of the exporter to export the
				pesticide.</continuation-text></clause><clause id="ID9A22504F93A34C0E822E79224F929A97"><enum>(ii)</enum><header>Timing of
				notice for banned or severely restricted pesticides or active ingredients used
				in producing pesticides</header>
									<subclause id="IDD2E5AE78F1B047AE983D13C5BD284851"><enum>(I)</enum><header>First
				export</header><text>In the case of a first export of a pesticide or active
				ingredient described in paragraph (11)(A) that an exporter makes from the
				territory of the United States to each importing foreign state after the
				Administrator issues a notice under paragraph (11)(A), the exporter shall
				provide the notice so that the Administrator receives the notice not earlier
				than 45 nor later than 15 calendar days before the date of export.</text>
									</subclause><subclause id="IDDF00794F475E43DEB35B2FDAC0AEEEDA"><enum>(II)</enum><header>Subsequent
				exports</header><text>In the case of subsequent exports of a pesticide or
				active ingredient described in paragraph (11)(A) to the importing foreign state
				in calendar years subsequent to the notification provided under subclause (I),
				the exporter shall provide the notice so that the Administrator receives the
				notice not earlier than 45 nor later than 15 calendar days before the date of
				the first export in each calendar year.</text>
									</subclause></clause><clause id="ID14593BA3DD114AD3AF50FCF40A2C1F11"><enum>(iii)</enum><header>Timing of
				pre-export notice for pesticides listed on annex iii of pic convention</header>
									<subclause id="ID49228DB260F64E3A830EC4F0D8F2200B"><enum>(I)</enum><header>First
				export</header><text>In the case of a first export of a pesticide listed in
				Annex III to the PIC Convention that an exporter makes from the territory of
				the United States to each importing foreign state after the Administrator
				notifies the public under paragraph (11)(C), the exporter shall provide the
				notice so that the Administrator receives the notice not earlier than 45 nor
				later than 15 calendar days before the date of export.</text>
									</subclause><subclause id="ID47ED472C8F1A40DEA50CFE67D3ED8833"><enum>(II)</enum><header>Subsequent
				exports</header><text>In the case of subsequent exports of a pesticide listed
				in Annex III to the PIC Convention by the exporter to the importing foreign
				state in calendar years subsequent to the notification provided under subclause
				(I), the exporter shall provide the notice so that the Administrator receives
				the notice not earlier than 45 nor later than 15 calendar days before the date
				of the first such subsequent export in each calendar year.</text>
									</subclause><subclause id="IDFE53AD2D97B141CFAD95CEC0C03C8A0A"><enum>(III)</enum><header>Changed
				circumstances meriting new notice</header><text>If conditions or restrictions
				imposed by the importing foreign state change and the Administrator notifies
				the public of the change under paragraph (11)(C), or if an earlier pre-export
				notice no longer applies, the exporter shall provide the notice so that the
				Administrator receives the notice not earlier than 45 nor later than 15
				calendar days before the date of export.</text>
									</subclause></clause><clause id="ID9C8619933EDB456BB75D4DC54765D659"><enum>(iv)</enum><header>Timing of
				pre-export notice for pesticides the export of which is not prohibited</header>
									<subclause id="IDC209F58AA6BC48A6B8A17251A9D8F212"><enum>(I)</enum><header>First export of
				the calendar year</header><text>In the case of the first export of a pesticide
				not prohibited from being exported under paragraph (2) that an exporter makes
				from the territory of the United States to each importing foreign state, the
				exporter shall provide the notice so that the Administrator receives the notice
				not earlier than 45 nor later than 15 calendar days before the date of the
				first export.</text>
									</subclause><subclause id="ID500178D8275A4BC2B17729725083D7F8"><enum>(II)</enum><header>Subsequent
				exports</header><text>In the case of subsequent exports of a pesticide not
				prohibited from being exported under paragraph (2) that an exporter makes from
				the territory of the United States to each importing foreign state by the
				exporter to the importing foreign state in calendar years subsequent to the
				notification provided under subclause (I) to the importing foreign state, the
				exporter shall provide the notice so that the Administrator receives the notice
				not earlier than 45 nor later than 15 calendar days before the date of the
				first such subsequent export in each calendar year.</text>
									</subclause><subclause id="ID9F27B2911EB74801A6A6AB2094A4963B"><enum>(III)</enum><header>Changed
				circumstances meriting new notice</header><text>If the information provided in
				an earlier pre-export notice is no longer accurate, the exporter shall provide
				the notice so that the Administrator receives the notice not earlier than 45
				nor later than 15 calendar days before the date of export.</text>
									</subclause></clause></subparagraph><subparagraph id="ID3D255B2A8448455AB338BD0E0208DA7A"><enum>(B)</enum><header>Alternate time
				frame for notices</header>
								<clause id="ID581D35C9190E4457A1C2E571FC27AAAA"><enum>(i)</enum><header>Discretionary
				alternate time frames</header><text>Notwithstanding clauses (ii), (iii), and
				(iv) of subparagraph (A), the Administrator may set an alternate time frame for
				receipt of notices if the Administrator determines that such alternate time
				frame is appropriate and that the Administrator is able, within such alternate
				time frame, to administer notice activities in accordance with the PIC
				Convention and comply with the POPs Convention.</text>
								</clause><clause id="IDC337FCBE2AF04109A42761485D004B1E"><enum>(ii)</enum><header>Mandatory
				review of statutory time frames and processes</header>
									<subclause id="IDAE5BA5BE5767455F8D2E53FE3B471F6E"><enum>(I)</enum><header>In
				general</header><text>Not later than 18 months of entry into force for the
				United States of the PIC Convention and not later than 18 months of entry into
				force for the United States of the POPs Convention, the Administrator shall
				review the statutory time frames for receipt of pre-export notices and the
				processing of the notices by the Administrator.</text>
									</subclause><subclause id="ID78AD97F4DC474D8CBB98C44FDC80A660"><enum>(II)</enum><header>Consideration
				of appropriateness of amendments</header><text>In review of the time frames and
				processes, the Administrator, with the concurrence of the Secretary of State,
				shall consider whether amendments to the time frames and modifications to the
				processes would be appropriate to administer notice activities in accordance
				with the PIC Convention and to comply with the POPs Convention.</text>
									</subclause></clause></subparagraph><subparagraph id="ID39B7A298BD7B4BEABA1A0E91E3A8A010"><enum>(C)</enum><header>Content of
				pre-export notices</header>
								<clause id="IDCA908817BA7B4A489C8BDDABC75D299D"><enum>(i)</enum><header>Notices for
				banned or severely restricted pesticides or active ingredient used in producing
				pesticides</header><text>A notice under subparagraph (A)(ii) shall
				include—</text>
									<subclause id="ID2E2B6477495948B1B7B13D51454D2F1A"><enum>(I)</enum><text>the name and
				address of the exporter;</text>
									</subclause><subclause id="ID2E7CC741386A408090FB2197A75DE7CF"><enum>(II)</enum><text>the name and
				address of the appropriate designated national authority of the United
				States;</text>
									</subclause><subclause id="ID0E0018C9B8E647558DC50E5CF2B2C88F"><enum>(III)</enum><text>the name and
				address of the appropriate designated national authority of the importing
				foreign state, if available;</text>
									</subclause><subclause id="ID10D64A009FB048EC966D41C94541B4F2"><enum>(IV)</enum><text>the name and
				address of the importer;</text>
									</subclause><subclause id="IDBF6C97374FC44B6D89E8661C7DDE8129"><enum>(V)</enum><text>the name of the
				pesticide or active ingredient used in producing the pesticide for which the
				notice is required;</text>
									</subclause><subclause id="IDD01A66AC4E9C4DC5B3C408D016FCA231"><enum>(VI)</enum><text>the expected
				date of export;</text>
									</subclause><subclause id="ID4F63D3E8427C414297C5A6521E03E67D"><enum>(VII)</enum><text>information
				relating to the foreseen uses of the pesticide or active ingredient used in
				producing a pesticide, if known, in the importing foreign state;</text>
									</subclause><subclause id="ID03C9F48056AE490D8BDAA00392A8932B"><enum>(VIII)</enum><text>information on
				precautionary measures to reduce exposure to, and emission of, the pesticide or
				active ingredient used in producing a pesticide;</text>
									</subclause><subclause id="ID3A663BBB158A44CA9C27FE1ED8D346D3"><enum>(IX)</enum><text>information
				relating to the concentration of the pesticide or active ingredient used in
				producing a pesticide; and</text>
									</subclause><subclause id="ID2EBCBE1EB5D640FAB72DFE21ECD652D4"><enum>(X)</enum><text>any other
				information specified in Annex V to the PIC Convention.</text>
									</subclause></clause><clause id="ID2F644B612664419C8A2BAFD2E19D6D9F"><enum>(ii)</enum><header>Notices for
				pesticides listed on annex iii of the pic convention</header><text>A notice
				under subparagraph (A)(iii) shall include—</text>
									<subclause id="ID1812C232DD18481F8DDD60A184AE5D7F"><enum>(I)</enum><text>all of the
				information required to be included under clause (i);</text>
									</subclause><subclause id="IDF7C3FEA08FE44ADBB6B5E3096F5346AD"><enum>(II)</enum><text>any information
				relating to export conditions or restrictions identified by the Administrator
				in the notice issued under paragraph (11)(C) with respect to the
				pesticide;</text>
									</subclause><subclause id="ID2F6EF56929214D518C82E4711E7D253D"><enum>(III)</enum><text>a general
				description of the manner in which the export complies with those conditions;
				and</text>
									</subclause><subclause id="IDCF0C4766C6A14740AB5F05C0978AFA4C"><enum>(IV)</enum><text>any other
				information that the Administrator determines by order published in the Federal
				Register to be necessary for effective enforcement of the export conditions or
				restrictions applicable to the pesticide.</text>
									</subclause></clause><clause id="ID906EC6CC2B74440EA36E06B3EF4B5988"><enum>(iii)</enum><header>Notices for
				pesticides the export of which is not prohibited</header><text>A notice
				submitted to the Administrator under subparagraph (A)(iv) shall include—</text>
									<subclause id="ID2863F526D81F47DFB0B56178D9CC372E"><enum>(I)</enum><text>the name and
				address of the exporter;</text>
									</subclause><subclause id="IDD67055A5C63245EF9047AD7DC77D89A9"><enum>(II)</enum><text>the name and
				address of the importer;</text>
									</subclause><subclause id="ID013EAFB386EA4E309CACE700E74537D6"><enum>(III)</enum><text>a specification
				of the identity of the POPs pesticide;</text>
									</subclause><subclause id="ID80FD1CDE3DC545C18B1AAD118D8DE1F3"><enum>(IV)</enum><text>a general
				description of how the export complies with the provisions related to export in
				paragraph 2 of Article 3, or other applicable provisions, of the POPs
				Convention; and</text>
									</subclause><subclause id="IDE56B118EFC8049B48810B73EE46E5609"><enum>(V)</enum><text>such other
				information as the Administrator determines by order published in the Federal
				Register to be necessary for enforcement of the export-related obligations of
				the POPs Convention applicable to the pesticide.</text>
									</subclause></clause></subparagraph><subparagraph id="ID9E594383C793451B903F2E184D6641BA"><enum>(D)</enum><header>Pre-export
				notices accompanying each export</header><text>An exporter shall ensure that a
				copy of the most recent applicable pre-export notice accompanies each shipment
				for export and is available for inspection on export for—</text>
								<clause id="ID947CEFDB2FF44A5A84A49D2E27D094C4"><enum>(i)</enum><text>any pesticide or
				active ingredient used in producing a pesticide that the Administrator has
				identified under paragraph (11)(C) as being listed on Annex III of the PIC
				Convention; or</text>
								</clause><clause id="ID9FE5A341AB164070BD55042211356B7C"><enum>(ii)</enum><text>any POPs
				pesticide that is exported.</text>
								</clause></subparagraph><subparagraph id="IDC4B367791A4A4DEF8EF8BC4732EE39FB"><enum>(E)</enum><header>Retention of
				pre-export notices</header>
								<clause id="IDE36F16576FEB4357A3ADE4154D9311BA"><enum>(i)</enum><header>In
				general</header><text>An exporter required to provide a notice under clauses
				(iii) and (iv) of subparagraph (A) shall comply with sections 7 and 8 and any
				regulations promulgated under those sections with regard to maintenance of the
				notice and other documents used to generate the notice and with regard to their
				availability for inspection and copying.</text>
								</clause><clause id="IDFBD2A8F1C71641BA9BE74FE1208D377B"><enum>(ii)</enum><header>Time period
				for retention</header><text>Notwithstanding clause (i), an exporter required to
				provide a notice under clauses (iii) and (iv) of subparagraph (A) shall
				maintain a copy of the notice and other documents used to generate the notice
				for a period of not less than 3 years beginning on the date on which the notice
				is provided.</text>
								</clause></subparagraph></paragraph><paragraph id="IDD7540A5B84964B7F874BF42D84469667"><enum>(10)</enum><header>Labeling
				requirements</header>
							<subparagraph id="ID14F24F1863574D3296099BFE791CAD21"><enum>(A)</enum><header>In
				general</header><text>In the case of any pesticide or active ingredient used in
				producing a pesticide that is the subject of a notice issued under subparagraph
				(A) or (C) of paragraph (11) and that is sold, distributed, or produced, the
				pesticide or active ingredient used in producing a pesticide, shall, in
				accordance with the PIC Convention—</text>
								<clause id="ID67A9FA6DF8B843599AE7349A13509445"><enum>(i)</enum><text>bear labeling
				information relating to risks or hazards to human health or the environment;
				and</text>
								</clause><clause id="ID0B8E4D19346445D9B1E39AC570386216"><enum>(ii)</enum><text>be accompanied
				by shipping documents that include any relevant safety data sheets on the
				pesticide.</text>
								</clause></subparagraph><subparagraph id="IDE702253E936C4135BC5A15DA88FE1DF0"><enum>(B)</enum><header>Custom
				codes</header><text>A pesticide or active ingredient used in producing a
				pesticide that is the subject of a notice issued under paragraph (11)(C) and
				that is distributed or sold for export shall be accompanied by shipping
				documents that bear, at a minimum, any appropriate harmonized system customs
				codes assigned by the World Customs Organization.</text>
							</subparagraph></paragraph><paragraph id="IDAF3A4AE195764581B68E0607B31C15B8"><enum>(11)</enum><header>Notice
				requirements and exemption</header>
							<subparagraph id="ID1D06B741EEA84763858C3ACA1E860BF1"><enum>(A)</enum><header>Determination
				whether pesticides are banned or severely restricted</header>
								<clause id="IDA87094360AE844DEBC95EE07B0DE731D"><enum>(i)</enum><header>In
				general</header><text>The Administrator, with the concurrence of the Secretary
				of State, shall determine whether a pesticide or active ingredient used in
				producing a pesticide is banned or severely restricted within the United States
				(as those terms are defined by the PIC Convention).</text>
								</clause><clause id="ID76C31460869C4E25AA91D1443E989D52"><enum>(ii)</enum><header>Notice of
				determinations</header><text>Notwithstanding any other provision of law, the
				Administrator shall issue to the Secretariat of the PIC Convention and the
				public a notice of each determination under clause (i) that includes—</text>
									<subclause id="ID689AB371C3534745ACA1D3EDA306A1C6"><enum>(I)</enum><text>in the case of a
				notice to the Secretariat of the PIC Convention, the information specified in
				Annex I to the PIC Convention; and</text>
									</subclause><subclause id="ID51DAEB7A60124A148F525D6D99D92A99"><enum>(II)</enum><text>in the case of a
				notice to the public, at a minimum, a summary of that information.</text>
									</subclause></clause></subparagraph><subparagraph id="IDC00C63E6DBFD44728F310D3E0C1A540A"><enum>(B)</enum><header>Notice to
				foreign countries</header>
								<clause id="IDFACFF6862FC644B79C2F1D25FF0214F0"><enum>(i)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, on receipt of
				a notice of intent to export under paragraph (9)(A)(ii), the Administrator
				shall provide a copy of the notice to the designated national authority of the
				importing foreign state.</text>
								</clause><clause id="ID2C995873EACF4C07A1D8CFEDBFBA4004"><enum>(ii)</enum><header>Nonidentified
				designated national authority</header><text>In a case in which a designated
				national authority has not been identified, the Administrator shall provide the
				notice of intent to export to any other appropriate official of the importing
				foreign state, as identified by the Administrator.</text>
								</clause></subparagraph><subparagraph id="ID7B5D826D521A4514A5CA4AF23A5873AF"><enum>(C)</enum><header>Notice to
				public</header>
								<clause id="ID0CCFEAE025CC413AA7AB98D60B914040"><enum>(i)</enum><header>In
				general</header><text>The Administrator, with the concurrence of the Secretary
				of State, shall issue a notice to inform the public of—</text>
									<subclause id="ID9D222C898F3B42CE841E820F580A36A6"><enum>(I)</enum><text>any pesticide
				that is listed on Annex III to the PIC Convention; and</text>
									</subclause><subclause id="ID924D33F6AB944FC19128B754AAF1298E"><enum>(II)</enum><text>any condition or
				restriction of an importing foreign state that is applicable to the import, in
				accordance with the PIC Convention, of the pesticide.</text>
									</subclause></clause><clause id="ID1F6FADD2A1C94889A7A7DD96C89548BA"><enum>(ii)</enum><header>Timing</header><text>A
				notice required under clause (i) shall be issued not later than 90 days after,
				and any conditions or restrictions described in clause (i)(II) shall take
				effect not later than 180 days after, the date of receipt of a notice from the
				Secretariat of the PIC Convention who—</text>
									<subclause id="ID941F7A7A888043D0A2DF8AB206E3BD13"><enum>(I)</enum><text>transmits import
				decisions of the parties to the PIC Convention; or</text>
									</subclause><subclause id="ID1B083C2ADA8E4D78AC4193D865C4D35A"><enum>(II)</enum><text>provides notice
				of the failure of the parties to provide import decisions.</text>
									</subclause></clause><clause id="IDAF577F8506E64B04AF414A56806C82A8"><enum>(iii)</enum><header>Treatment of
				conditions and restrictions</header><text>A condition or restriction identified
				by a notice required under clause (i) shall be considered to be an export
				condition or restriction for the purpose of paragraph (8).</text>
								</clause></subparagraph><subparagraph id="IDB246DD54BAD745F79B9C37C7358A1E62"><enum>(D)</enum><header>Notice of
				exemption</header><text>The Administrator may issue a notice exempting any
				pesticide or active ingredient used in producing a pesticide from the
				requirements of paragraphs (8) through (10) if the Administrator determines,
				with the concurrence of the Secretary of State, that the exemption would be
				consistent with the PIC Convention or POPs Convention.</text>
							</subparagraph></paragraph><paragraph id="IDE429E48B6B93492EAFAB332495B6C607"><enum>(12)</enum><header>Harmonization
				of pops convention and lrtap pops protocol</header>
							<subparagraph id="ID936DFE0EC293429FBDB2B59AA6CF8636"><enum>(A)</enum><header>In
				general</header><text>If a pesticide is both a POPs pesticide and a LRTAP POPs
				pesticide, in the case of a conflict between a provision of this subsection
				applicable to a POPs pesticide and a provision of this subsection applicable to
				a LRTAP POPs pesticide, the more stringent provision shall apply, as determined
				by the Administrator, with the concurrence of the Secretary of State.</text>
							</subparagraph><subparagraph id="IDFF4286A295DC4EC293731DF138A527A6"><enum>(B)</enum><header>Application</header><text>In
				the case of a pesticide described in subparagraph (A), this paragraph shall be
				applied in such a manner as to ensure that the United States is in compliance
				with its obligations under the POPs Convention and the LRTAP POPs Protocol with
				respect to the pesticide.</text>
							</subparagraph></paragraph><paragraph id="ID853BD28535C346768FD6CC9D0945B17C"><enum>(13)</enum><header>Harmonization
				of pops convention and pic convention</header>
							<subparagraph id="IDA762C729D15F41B59B5F32A9D0443BA5"><enum>(A)</enum><header>In
				general</header><text>If the export of a pesticide is addressed or restricted
				under paragraphs (2) through (6) and paragraphs (8) through (11), all of those
				paragraphs shall apply to the pesticide.</text>
							</subparagraph><subparagraph id="ID5E4414EE94194AD2AE039F91593CC867"><enum>(B)</enum><header>Conflict</header><text>In
				the case of a conflict between paragraphs (2) through (6) and paragraphs (8)
				through (11) with respect to a pesticide, the more stringent provision shall
				apply.</text>
							</subparagraph><subparagraph id="ID82737691694A43B2AE2BE372AA335119"><enum>(C)</enum><header>Application</header><text>With
				respect to a pesticide, paragraphs (2) through (11) shall be applied in manner
				as to ensure that the United States is in compliance with its obligations under
				both the POPs Convention and the PIC Convention with respect to the
				pesticide.</text>
							</subparagraph></paragraph></subsection><subsection id="IDA5E1B7770F084E928EE70504F13B041F"><enum>(f)</enum><header>Regulations</header>
						<paragraph id="ID5D766FF269974BE0802E7D2EACA0A112"><enum>(1)</enum><header>In
				general</header><text>The Administrator may promulgate such regulations as the
				Administrator determines, with the concurrence of the Secretary of State and
				after providing notice to any other interested Federal agency, to be
				necessary—</text>
							<subparagraph id="ID9386A3DBF19945FE905E457B35DF2C90"><enum>(A)</enum><text>to implement this
				section;</text>
							</subparagraph><subparagraph id="ID61A6BD2360774A2EB6ED9308D40AC149"><enum>(B)</enum><text>to allow the
				pre-export notice requirement under this section and any pre-export notice
				requirement in other provisions of this Act or in any other Federal law to be
				satisfied by a single notice; and</text>
							</subparagraph><subparagraph id="ID8D2D31D43B754543B57979629460161F"><enum>(C)</enum><text>to ensure
				compliance with the PIC Convention, the POPs Convention, and the LRTAP POPs
				Protocol.</text>
							</subparagraph></paragraph><paragraph id="IDC22F773656EA4D57868495909F5BEF17"><enum>(2)</enum><header>Importation of
				pesticides and devices</header><text>The Secretary of the Treasury, in
				consultation with the Administrator, shall promulgate regulations for the
				enforcement of subsection
				(c).</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="ID97CB6E0DE36B472D83FFA12807647776"><enum>4.</enum><header>Conforming
			 amendments</header>
			<subsection id="ID742A0A4005744F8D8D5E57409EF4D24B"><enum>(a)</enum><text>Section 3(b) of
			 the <act-name parsable-cite="FIFRA">Federal Insecticide, Fungicide, and
			 Rodenticide Act</act-name> (7 U.S.C. 136a(b)) is amended in the matter
			 preceding paragraph (1) by striking <quote>A pesticide</quote> and inserting
			 <quote>Except as provided in section 17, a pesticide</quote>.</text>
			</subsection><subsection id="ID3183723CD6304C7F87260E1652448FBF"><enum>(b)</enum><text>Section 12(a)(2)
			 of the <act-name parsable-cite="FIFRA">Federal Insecticide, Fungicide, and
