		<official-title display="yes">To amend the Education Sciences Reform Act
		  of 2002 to require the Statistics Commissioner to collect information from
		  coeducational secondary schools on such schools’ athletic programs, and for
		  other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="IDA444EE1743254B4B97952C50EBD500FD" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>High School Sports Information
			 Collection Act of 2009</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="ID57BF8ABFF58E4671AFFE2BB79DCCC826" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Statistics on equality in athletic
			 programs</header><text display-inline="no-display-inline">Section 153 of the
			 Education Sciences Reform Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/20/9543">20 U.S.C. 9543</external-xref>) is amended by
			 adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="IDD51F0470B09241C900DD1CF25B859C8C" style="OLC">
				<subsection commented="no" display-inline="no-display-inline" id="ID1CB5A5315B4D4887853E8C48AFEF042C"><enum>(c)</enum><header display-inline="yes-display-inline">Equality in athletic programs</header>
					<paragraph commented="no" display-inline="no-display-inline" id="id68B3E8D56DFA4EB393BD2AE2B8CDA59C"><enum>(1)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Statistics
				Commissioner shall collect, annually, for the immediately preceding academic
				year, from each coeducational secondary school that receives Federal financial
				assistance that has an athletic program, the following information:</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID4FB76230CFEA419DBAE0BFC65F8CF0E1"><enum>(A)</enum><text display-inline="yes-display-inline">The number of male and female students that
				attended the school and for each student an identification of such
				student's—</text>
							<clause id="IDffe80f51540f4887a5c349f95faee419"><enum>(i)</enum><text>race; and</text>
							</clause><clause id="ID3d08b81fe78245e99c5eba9f48ef884a"><enum>(ii)</enum><text>ethnicity.</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC546332E71B44F54A300CF5796F5AA4B"><enum>(B)</enum><text display-inline="yes-display-inline">A listing of the teams that competed in
				athletic competition and for each such team the following data:</text>
							<clause commented="no" display-inline="no-display-inline" id="IDA431CFE69F3D4A2CBED4936312497637"><enum>(i)</enum><text display-inline="yes-display-inline">The season in which the team
				competed.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDA5D026CCDCD64374BE304F00322C7C54"><enum>(ii)</enum><text display-inline="yes-display-inline">The total number of participants as of the
				day of the first scheduled contest for the team, and for each participant an
				identification of such participant’s—</text>
								<subclause commented="no" display-inline="no-display-inline" id="IDE8C9740FA51E424C9DE9EEEEBF5CF200"><enum>(I)</enum><text display-inline="yes-display-inline">gender;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="ID36C6F5289FFD47868CAB41EBE9B943D3"><enum>(II)</enum><text display-inline="yes-display-inline">race; and</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="IDA523B7489ECC4961BBD7666497FD115D"><enum>(III)</enum><text display-inline="yes-display-inline">ethnicity.</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDB745EA851CE34B5D8C459B2621F7564F"><enum>(iii)</enum><text display-inline="yes-display-inline">The total expenditures for the team,
				including the following data:</text>
								<subclause commented="no" display-inline="no-display-inline" id="IDB06FE505A9794535B24EC974A7A8D0ED"><enum>(I)</enum><text display-inline="yes-display-inline">The travel expenditures.</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="ID62F708ADA4AA4909001DBB4B74E44CA1"><enum>(II)</enum><text display-inline="yes-display-inline">The equipment expenditures (including any
				equipment replacement schedule).</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="IDBC950E8A6283493E833CFF2B74E281D6"><enum>(III)</enum><text display-inline="yes-display-inline">The uniform expenditures (including any
				uniform replacement schedule).</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="ID34F27D94D46040B6BBCD331969A63108"><enum>(IV)</enum><text display-inline="yes-display-inline">The expenditures for facilities, including
				medical facilities, locker rooms, fields, and gymnasiums.</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="IDC7D08808D0334F01A06BB8A206F98B67"><enum>(V)</enum><text display-inline="yes-display-inline">The total number of trainers and medical
				personnel, and for each trainer or medical personnel an identification of such
				person’s—</text>
									<item id="HC0BC6D58DB904E2F9EFB42DDBB4106F"><enum>(aa)</enum><text>gender;</text>
									</item><item id="H8ABEF5168B45416A93938410C867C95B"><enum>(bb)</enum><text>employment status
				(including whether such person is employed full-time or part-time, and whether
				such person is a head or assistant trainer or medical services provider) and
				duties other than providing training or medical services; and</text>
									</item><item id="H108C2803D0544A4B8B9ECF1867AE2282"><enum>(cc)</enum><text>qualifications,
				including whether the person is a professional or student.</text>
									</item></subclause><subclause commented="no" display-inline="no-display-inline" id="IDD67A239F579648CEB636A173255600C0"><enum>(VI)</enum><text display-inline="yes-display-inline">The expenditures for publicity for
				competitions.</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDC449002E11A64D17BAF268FCAE063324"><enum>(iv)</enum><text display-inline="yes-display-inline">The total number of coaches, and for each
				coach an identification of such coach’s—</text>
								<subclause id="H80BF603DB5D94F50AE331FC0CA3B98DC"><enum>(I)</enum><text>gender;</text>
								</subclause><subclause id="H096BEFEEB48C422AB951C62939135E48"><enum>(II)</enum><text>employment status
				(including whether such coach is employed full-time or part-time, and whether
				such coach is a head or assistant coach) and duties other than coaching;
				and</text>
								</subclause><subclause id="H05720DF61F8F4D3AB5A472177828B65"><enum>(III)</enum><text>qualifications,
				including whether the person is a professional or student.</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDD44521B9E7F7433BBFF118F3AEEFD3B3"><enum>(v)</enum><text display-inline="yes-display-inline">The total number of competitions scheduled,
				and for each scheduled competition an indication of what day of the week and
				time the competition was scheduled.</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID866053808FC1426C94F66000ECC1C0FF"><enum>(vi)</enum><text display-inline="yes-display-inline">Whether such team participated in
				postseason competition, and the success of such team in any postseason
				competition.</text>
							</clause><clause id="IDf99fcb2ce1494a24aef4b2df859f90b6"><enum>(vii)</enum><text>The total
				number of practices scheduled, and for each scheduled practice an indication of
				what day of the week and time the practice was scheduled.</text>
							</clause></subparagraph></paragraph><paragraph id="H2EEC5036F4B9484CA4D853C53D3F8C54"><enum>(2)</enum><header>Disclosure of
				information to students and public</header><text>A coeducational secondary
				school described in paragraph (1) shall—</text>
						<subparagraph id="H1BE43832219F464797DCAC25AE6F5009"><enum>(A)</enum><text>make available to
				students and potential students, upon request, and to the public, the
				information contained in reports by the school under this subsection by October
				15 of each school year; and</text>
						</subparagraph><subparagraph id="HBA96AC4F4CF742A9898B2349992B7FFE"><enum>(B)</enum><text>ensure that all
				students at the school are informed of their right to request such
				information.</text>
						</subparagraph></paragraph><paragraph id="H35A5CA5A0CD141A2B301FCF1A4D2A151"><enum>(3)</enum><header>Submission;
				information availability</header><text>On an annual basis, each coeducational
				secondary school described in paragraph (1) shall provide the information
				contained in each report by the school under this subsection to the Statistics
				Commissioner not later than 15 days after the date that the school makes such
				information available under paragraph (2).</text>
					</paragraph><paragraph id="H71DB891E7AE74C5998CE001200A48CA"><enum>(4)</enum><header>Duties of
				Commissioner for Education Statistics</header><text>The Statistics Commissioner
				shall—</text>
						<subparagraph id="H51610DA4322646F2BCEEE9E50063BF8C"><enum>(A)</enum><text>ensure that
				reports under this subsection are posted on the Department of Education's
				website within a reasonable period of time; and</text>
						</subparagraph><subparagraph id="H9519E86BC6D34C3BB676846CB138F61C"><enum>(B)</enum><text>not later than 180
				days after the date of enactment of the <short-title>High
				School Sports Information Collection Act of 2009</short-title>—</text>
							<clause id="id1633FDB6D12D4BEA856D686179CA5306"><enum>(i)</enum><text>notify all
				secondary schools in all States regarding the availability of information under
				paragraph (2); and</text>
							</clause><clause id="id169B753D7FF04CFB97C619F7E658EA47"><enum>(ii)</enum><text>issue guidance
				to all schools on how to collect and report the information required under this
				subsection.</text>
							</clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
