		<section id="id60d17bb6-e413-4064-a488-ace549610722" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>False Claims Act Clarification Act of
			 2009</short-title></quote>.</text>
		</section><section id="idCAC2D24CCE794777BE8FCDD5F02B464D"><enum>2.</enum><header>False claims
			 generally</header><text display-inline="no-display-inline">Section 3729 of
			 title 31, United States Code, is amended—</text>
			<paragraph id="id7d241678-b45f-42ee-886d-f9d74acbb93b"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (a) and inserting
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="id8bb50f4f-b55e-4cb1-af54-c405bcc2c88c" style="USC">
					<subsection id="id9db1b0f6-f38e-4900-aaa7-48cc955061d6"><enum>(a)</enum><header>Liability
				for certain acts</header>
						<paragraph id="id50ac6189-0a14-4aa3-9659-211a19b0070e"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), any person who—</text>
							<subparagraph id="id6be11523-02f7-402a-9249-462e3851eeda"><enum>(A)</enum><text>knowingly
				presents, or causes to be presented, a false or fraudulent claim for payment or
				approval;</text>
							</subparagraph><subparagraph id="idd823038d-ac89-4ccf-ad2f-6780f53107c7"><enum>(B)</enum><text>knowingly
				makes, uses, or causes to be made or used, a false record or statement to get a
				false or fraudulent claim paid or approved;</text>
							</subparagraph><subparagraph id="idc838c2f0-fad1-4725-9b1c-05c7a9280484"><enum>(C)</enum><text>conspires to
				commit a violation of subparagraph (A), (B), (D), (E), (F), or (G) or otherwise
				to get a false or fraudulent claim paid or approved;</text>
							</subparagraph><subparagraph id="idcab6e4fb-1836-4002-8836-577f596cc099"><enum>(D)</enum><text>has
				possession, custody, or control of property or money used, or to be used, by
				the Government and knowingly delivers, or causes to be delivered, less than all
				of that money or property;</text>
							</subparagraph><subparagraph id="idc9a97734-9006-489a-b349-86493c73cfcc"><enum>(E)</enum><text>is authorized
				to make or deliver a document certifying receipt of property used, or to be
				used, by the Government and, intending to defraud the Government, makes or
				delivers the receipt without completely knowing that the information on the
				receipt is true;</text>
							</subparagraph><subparagraph id="idd394553a-b37c-42c6-bfef-c8a490e4a94e"><enum>(F)</enum><text>knowingly
				buys, or receives as a pledge of an obligation or debt, public property from an
				officer or employee of the Government, or a member of the Armed Forces, who
				lawfully may not sell or pledge the property; or</text>
							</subparagraph><subparagraph id="id5fd078f5-3f27-4174-bcf6-173e917ab9cf"><enum>(G)</enum><text>knowingly
				makes, uses, or causes to be made or used, a false record or statement to
				conceal, avoid, or decrease an obligation to pay or transmit money or property
				to the Government, or knowingly conceals, avoids, or decreases an obligation to
				pay or transmit money or property to the Government,</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">is liable
				to the United States Government for a civil penalty of not less than $5,000 and
				not more than $10,000, as adjusted by the Federal Civil Penalties Inflation
				Adjustment Act of 1990 (28 U.S.C. 2461 note; Public Law 104–410), plus 3 times
				the amount of damages which the Government sustains because of the act of that
				person.</continuation-text></paragraph><paragraph id="id578eb0ae-d287-4a0d-ad2e-fe266286749b"><enum>(2)</enum><header>Reduced
				damages</header><text>If the court finds that—</text>
							<subparagraph id="idc47546cf-4e5a-4b88-819a-5244456f6afc"><enum>(A)</enum><text>the person
				committing the violation of this subsection furnished officials of the United
				States responsible for investigating false claims violations with all
				information known to such person about the violation within 30 days after the
				date on which the defendant first obtained the information;</text>
							</subparagraph><subparagraph id="id1584b061-6b7e-464a-aa5b-c8055a9bc219"><enum>(B)</enum><text>such person
				fully cooperated with any Government investigation of such violation;
				and</text>
							</subparagraph><subparagraph id="idb997e450-8008-447b-a54f-3098b87fad1e"><enum>(C)</enum><text>at the time
				such person furnished the United States with the information about the
				violation, no criminal prosecution, civil action, or administrative action had
				commenced under this title with respect to such violation, and the person did
				not have actual knowledge of the existence of an investigation into such
				violation,</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">the court
				may assess not less than 2 times the amount of damages which the Government
				sustains because of the act of that person.</continuation-text></paragraph><paragraph id="id1f31e438-4604-4eee-8aea-881d777f7e2e"><enum>(3)</enum><header>Costs of
				civil actions</header><text>A person violating this subsection shall also be
				liable to the United States Government for the costs of a civil action brought
				to recover any such penalty or
				damages.</text>
						</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="idaca5abf2-4d81-460b-9f2e-0d68a46f8cac"><enum>(2)</enum><text>by striking
			 subsections (b) and (c) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idc9f897c2-999c-45ef-807a-51bd08b38b9d" style="USC">
					<subsection id="idefcdf36f-c820-4e9f-aa98-c86bc8fc5737"><enum>(b)</enum><header>Definitions</header><text>For
				purposes of this section—</text>
						<paragraph id="id2aa9f22c-da20-469e-8506-3c3500d6e4ed"><enum>(1)</enum><text>the terms
				<term>knowing</term> and <term>knowingly</term> mean that a person, with
				respect to information—</text>
							<subparagraph id="id71105788-8b81-48e0-a86b-4775a2ef7177"><enum>(A)</enum><text>has actual
				knowledge of the information;</text>
							</subparagraph><subparagraph id="idF78A3F0FB0F14603B391F2F90A8AF27B"><enum>(B)</enum><text>acts in
				deliberate ignorance of the truth or falsity of the information; or</text>
							</subparagraph><subparagraph id="id0eb24c0d-9cd9-46af-912b-91cbb0509e45"><enum>(C)</enum><text>acts in
				reckless disregard of the truth or falsity of the information,</text>
							</subparagraph><continuation-text continuation-text-level="paragraph">and no
				proof of specific intent to defraud is required;</continuation-text></paragraph><paragraph id="id7afb77de-318b-4da0-b90a-56cbbf1ed3a9"><enum>(2)</enum><text>the term
				<term>claim</term>—</text>
							<subparagraph id="id64DFF033B5E2472EAAA1BB9148D1B5C1"><enum>(A)</enum><text>means any request
				or demand, whether under a contract or otherwise, for money or property and
				whether or not the United States has title to the money or property,
				that—</text>
								<clause id="id5707236E218D466F8A5E37EDBB7AD63C"><enum>(i)</enum><text>is presented to
				an officer, employee, or agent of the United States; or</text>
								</clause><clause id="id4B43ECEE2AF94073A0527E8EDD92EDFF"><enum>(ii)</enum><text>is made to a
				contractor, grantee, or other recipient if the United States Government—</text>
									<subclause id="id50DCB8B66F584D878BB3E2B0DDB11A99"><enum>(I)</enum><text>provides or has
				provided any portion of the money or property requested or demanded; or</text>
									</subclause><subclause id="id8C19AD2C651048F2B3CE541E81DC35F7"><enum>(II)</enum><text>will reimburse
				such contractor, grantee, or other recipient for any portion of the money or
				property which is requested or demanded; and</text>
									</subclause></clause></subparagraph><subparagraph id="idA6FB151DFFEC4D5A8CCA3CDEFF4FC981"><enum>(B)</enum><text>does not include
				requests or demands for money or property that the Government has paid to an
				individual as compensation for Federal employment or as an income subsidy with
				no restrictions on that individual’s use of the money or property; and</text>
							</subparagraph></paragraph><paragraph id="ida903eb60-f8ea-4b71-87e5-c1c3a69d24fc"><enum>(3)</enum><text>the term
				<term>obligation</term> means a fixed duty, or a contingent duty arising from
				an express or implied contractual, quasi-contractual, grantor-grantee,
				licensor-licensee, fee-based, or similar relationship, and the retention of any
				overpayment.</text>
						</paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id28f58f73-5f3b-4204-b454-73f9b5a84dc6"><enum>(3)</enum><text>by
			 redesignating subsections (d) and (e) as subsections (c) and (d), respectively;
			 and</text>
			</paragraph><paragraph id="id97497ea4-f206-45c2-8754-53fbf2b50f42"><enum>(4)</enum><text>in subsection
			 (c), as redesignated, by striking <quote>subparagraphs (A) through (C) of
			 subsection (a)</quote> and inserting <quote>subsection (a)(2)</quote>.</text>
			</paragraph></section><section id="ida5812b20-aa77-481f-8d21-71dd29388ab2"><enum>3.</enum><header>Government
			 right to dismiss certain actions</header><text display-inline="no-display-inline">Section 3730(b) of title 31, United States
			 Code, is amended—</text>
			<paragraph id="id99234189C1EA4036BDB12B9BB12DB31A"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>Rule
			 4(d)(4)</quote> and inserting <quote>rule 4</quote>; and</text>
			</paragraph><paragraph id="idE6C2B9B108CF4C1E91BBD9AA23E7A861"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block id="id2afa400b-8164-4bbb-a679-034912115685" style="OLC">
					<paragraph id="id4e6c95e8-4d32-4a54-ac4d-480d96d53c06"><enum>(6)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id97b429c3-caf1-45b7-a71c-d6a2a0661e47"><enum>(A)</enum><text>Not later than 120
				days after the date of service under paragraph (2), the Government may move to
				dismiss from the action a qui tam relator that is an employee of the Federal
				Government, or that is an immediate family member of an employee of the Federal
				Government, if—</text>
							<clause id="id148b09e0-d911-4460-a10f-5f97c9df94b4" indent="up1"><enum>(i)</enum><text>the necessary and specific material
				allegations contained in such action were derived from a filed criminal
				indictment or information or an open and active criminal, civil, or
				administrative investigation or audit by the Government into substantially the
				same fraud alleged in the action;</text>
							</clause><clause id="id1A64131B98DD4B09A15F117BD0D37995" indent="up1"><enum>(ii)</enum><text>the duties of the employee's
				position specifically include uncovering and reporting the particular type of
				fraud that is alleged in the action, and the employee, as part of the duties of
				that employee's position, is participating in or has knowledge of an open and
				active criminal, civil, or administrative investigation or audit by the
				Government of the alleged fraud;</text>
							</clause><clause id="idc74fe6b3-26ba-440d-ae6c-743f3bf575de" indent="up1"><enum>(iii)</enum><text>the person bringing the action
				learned of the information that underlies the alleged violation of section 3729
				that is the basis of the action in the course of the person’s employment by the
				United States, and either—</text>
								<subclause id="id6a0fd40a-45bf-436e-b320-833317029f4f"><enum>(I)</enum><text>in a case in which the employing agency
				has an inspector general, such person, before bringing the action has
				not—</text>
									<item id="id6af8e6f6-4c70-4ae2-ae57-8e133a9da744"><enum>(aa)</enum><text>disclosed in writing substantially
				all material evidence and information that relates to the alleged violation
				that the person possessed to such inspector general; and</text>
									</item><item id="id25a2c2db-27c9-43d6-ba02-b22ced42ff6f"><enum>(bb)</enum><text>notified in writing the person’s
				supervisor and the Attorney General of the disclosure under division (aa);
				or</text>
									</item></subclause><subclause id="id355d5694-dc62-4049-8352-90b69cddee75"><enum>(II)</enum><text>in a case in which the employing agency
				does not have an inspector general, such person, before bringing the action has
				not—</text>
									<item id="id6e96e57b-1044-4e35-96ff-77bae5e9edf6"><enum>(aa)</enum><text>disclosed in writing substantially
				all material evidence and information that relates to the alleged violation
				that the person possessed, to the Attorney General; and</text>
									</item><item id="id73297dd9-b959-4d2e-94f4-af9b69477690"><enum>(bb)</enum><text>notified in writing the person’s
				supervisor of the disclosure under division (aa); or</text>
									</item></subclause></clause><clause id="id1AECA3B77D4B4427A92F32EE6A86637B" indent="up1"><enum>(iv)</enum><text>the person bringing the action
				learned of the information that underlies the alleged violation of section 3729
				that is the basis of the action in the course of the person's employment by the
				United States, made the required disclosures and notifications under clause
				(iii), and—</text>
								<subclause id="idAAF9111B5D6F4E9AB42A719FC840EC5A"><enum>(I)</enum><text>less than 18 months (and any period of
				extension as provided for under subparagraph (B)) have elapsed since the
				disclosures of information and notification under clause (iii) were made;
				or</text>
								</subclause><subclause id="id1AAB6BC314C34D8188A392D30A8B68A7"><enum>(II)</enum><text>within 18 months (and any period of
				extension as provided for under subparagraph (B)) after the disclosures of
				information and notification under clause (iii) were made, the Attorney General
				has filed an action based on such information.</text>
								</subclause></clause></subparagraph><subparagraph id="id32b01e82-c200-481f-a984-b151aa88859b" indent="up1"><enum>(B)</enum><text>Prior to the expiration of the
				18-month period described under subparagraph (A)(iv)(II) and upon notice to the
				person who has disclosed information and provided notice under subparagraph
				(A)(iii), the Attorney General may extend such 18-month period by 1 additional
				12-month period.</text>
						</subparagraph><subparagraph id="id3d977d23-b02d-4bf6-ac1a-5abaac8cdd03" indent="up1"><enum>(C)</enum><text>For purposes of subparagraph (A), a
				person’s supervisor is the officer or employee who—</text>
							<clause id="id591bb2f0-6a0a-4f21-8a21-9e66330c5693"><enum>(i)</enum><text>is in a position of the next
				highest classification to the position of such person;</text>
							</clause><clause id="id52006b03-8b2c-4210-b78e-a18a06de1a5f"><enum>(ii)</enum><text>has supervisory authority over
				such person; and</text>
							</clause><clause id="idad3d3280-cb65-4649-b12f-e139d752ef3a"><enum>(iii)</enum><text>such person believes is not
				culpable of the violation upon which the action under this subsection is
				brought by such person.</text>
							</clause></subparagraph><subparagraph id="id8ce09ea0-e244-400e-9342-0d9a6bb29795" indent="up1"><enum>(D)</enum><text>A motion to dismiss under this
				paragraph shall set forth documentation of the allegations, evidence, and
				information in support of the motion.</text>
						</subparagraph><subparagraph id="id71a84c07-beb9-4c73-ab83-508c7f6ddac9" indent="up1"><enum>(E)</enum><text>Any person against whom the Government
				has filed a motion to dismiss under subparagraph (A) shall be provided an
				opportunity to contest a motion to dismiss under this paragraph. The court may
				restrict access to the evidentiary materials filed in support of the motion to
				dismiss, as the interests of justice require. A motion to dismiss and
				evidentiary material filed in support or opposition of such motion shall not
				be—</text>
							<clause id="iddac1cea3-0f68-45ec-aaf8-a14296b0934e"><enum>(i)</enum><text>made public without the prior
				written consent of the person bringing the civil action; and</text>
							</clause><clause id="idaf4e41da-d60c-4f62-8f62-7f7797f018a9"><enum>(ii)</enum><text>subject to discovery by the
				defendant.</text>
							</clause></subparagraph><subparagraph id="idD58B1B10412541A9A41AE9782EDED1F1" indent="up1"><enum>(F)</enum><text>Upon granting a motion filed under
				subparagraph (A), the court shall dismiss the qui tam relator from the
				action.</text>
						</subparagraph><subparagraph id="iddf89aa35-e2b3-4a51-836e-f45577d30e8e" indent="up1"><enum>(G)</enum><text>If the motion to dismiss under this
				paragraph is granted, the matter shall remain under seal.</text>
						</subparagraph><subparagraph id="id6e13644d-9506-43ac-817b-1be95b43cb9a" indent="up1"><enum>(H)</enum><text>Not later than 12 months after the
				date of the enactment of this paragraph, and every 12 months thereafter, the
				Department of Justice shall submit a report to the Committee on the Judiciary
				of the Senate and the Committee on the Judiciary of the House of
				Representatives relating to—</text>
							<clause id="id5c6a84c6-811d-46d2-8a8f-0f66e6e2c457"><enum>(i)</enum><text>the cases in which the Department
				of Justice has filed a motion to dismiss under this paragraph;</text>
							</clause><clause id="idb58e6921-36ab-4842-badb-77c8cbcd6f46"><enum>(ii)</enum><text>the outcome of such motions;
				and</text>
							</clause><clause id="id70e2abd2-6052-4791-a035-12bb2eef59c5"><enum>(iii)</enum><text>the status of false claims civil
				actions in which such motions were filed.</text>
							</clause></subparagraph><subparagraph id="idD4D0990DFC804EA6A7BC77900C73534F" indent="up1"><enum>(I)</enum><text>Nothing in this paragraph shall be
				construed to limit the authority of the Government to dismiss an action or
				claim, or a person who brings an action or claim, under this subsection for any
				reason other than the grant of a motion filed under subparagraph
				(A).</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="idf5d24720-1701-4022-bc55-a5ccf6c17541"><enum>4.</enum><header>Barred
			 actions</header>
			<subsection id="id6336a5e4-7619-4c08-b270-160d8fb8c0dd"><enum>(a)</enum><header>Provisions
			 relating to actions barred</header><text display-inline="yes-display-inline">Section 3730(b)(1) of title 31, United
			 States Code, is amended by adding at the end the following: <quote>No claim for
			 a violation of section 3729 may be waived or released by any action of any
			 person who brings an action under this subsection, except insofar as such
			 action is part of a court approved settlement of a false claim civil action
			 brought under this section. Nothing in this paragraph shall be construed to
			 limit the ability of the United States to decline to pursue any claim brought
			 under this subsection, or to require court approval of a settlement by the
			 Government with a defendant of an action brought under subsection (a), or under
			 this subsection, unless the person bringing the action objects to the
			 settlement under subsection (c)(2)(B).</quote>.</text>
			</subsection><subsection id="ide16d39cc-c2f0-45e4-b649-2d9443dec680"><enum>(b)</enum><header>Dismissal</header><text>Section
			 3730(e)(4) of title 31, United States Code, is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="id7e6f3d0c-9118-4074-9a85-4ed7dc6ca4e4" style="OLC">
					<paragraph id="IDd5248df62ab542d98a72ffb6bbe946f4"><enum>(4)</enum><text>A court shall
				dismiss an action or claim or the person bringing the action or claim under
				subsection (b), upon a motion by the Government filed on or before service of a
				complaint on the defendant under subsection (b), or thereafter for good cause
				shown if—</text>
						<subparagraph id="ID0dd65ad70908422d811214ba41cfadb5"><enum>(A)</enum><text>on the date the
				action or claim was filed, substantially the same matters, involving the same
				wrongdoer, as alleged in the action or claim were contained in, or the subject
				of—</text>
							<clause id="id099D2BEB8FCC4603A08A03B14F4A5D64"><enum>(i)</enum><text>a
				filed criminal indictment or information, or an open and active criminal,
				civil, or administrative investigation or audit; or</text>
							</clause><clause id="id85347DCE142E4A5F8BC9B916B659F52A"><enum>(ii)</enum><text>a news media
				report, or public congressional hearing, report, or investigation, if within 90
				days after the issuance or completion of such news media report or
				congressional hearing, report, or investigation, the Department of Justice or
				an Office of Inspector General opened a fraud investigation or audit of the
				facts contained in such news media report or congressional hearing, report, or
				investigation as a result of learning about the public report, hearing, or
				investigation;</text>
							</clause></subparagraph><subparagraph id="ID9acde6481a474eb68e3d52d05af4dbf8"><enum>(B)</enum><text>any new
				information provided by the person does not add substantial grounds for
				additional recovery beyond those encompassed within the Government’s existing
				criminal indictment or information, or an open and active criminal, civil, or
				administrative investigation or audit; and</text>
						</subparagraph><subparagraph id="IDc891332839c546a7926609d4ae35a1e6"><enum>(C)</enum><text>the Government’s
				existing criminal indictment or information, or an open and active criminal,
				civil, or administrative investigation or audit, or the news media report, or
				congressional hearing, report, or investigation was not initiated or published
				after the Government’s receipt of information about substantially the same
				matters voluntarily brought by the person to the
				Government.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id310b5457-1d0c-476f-80fc-b95a5d6a6cb6"><enum>(c)</enum><header>Qui tam
			 awards</header><text>Section 3730(d) of title 31, United States Code, is
			 amended—</text>
				<paragraph id="idB72CE8CF111742FA98997AED80D6F510"><enum>(1)</enum><text>in paragraph (1),
			 by striking the second sentence and inserting <quote>If the person bringing the
			 action is not dismissed under subsection (e)(4) because the person provided new
			 information that adds substantial grounds for additional recovery beyond those
			 encompassed within the Government’s existing indictment, information,
			 investigation, or audit, then such person shall be entitled to receive a share
			 only of proceeds of the action or settlement that are attributable to the new
			 basis for recovery that is stated in the action brought by that
			 person.</quote>; and</text>
				</paragraph><paragraph id="idD784DBF5478F4482B8DDD641B7470A4F"><enum>(2)</enum><text>by striking
			 paragraph (3) and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idc091df29-f45d-493d-a9fd-1ee475632942" style="OLC">
						<paragraph id="idad630dd4-1cf2-4326-8e78-9fc8cb8afedd" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id8204790d-c7d1-4e3d-bfee-d6be863a489d"><enum>(A)</enum><text>Whether or not the
				Government proceeds with the action, the court may, to the extent the court
				considers appropriate, reduce the share of the proceeds of the action which a
				person would otherwise receive under paragraph (1) or (2) of this subsection
				(taking into account the role of that person in advancing the case to
				litigation and any relevant circumstances pertaining to the violation), if the
				court finds that person—</text>
								<clause id="idfb97f30f-d6a0-4070-91a7-0a45804dcb1e" indent="up1"><enum>(i)</enum><text>planned and initiated the violation of
				section 3729 upon which the action was brought; or</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="id2f1a13be-1e50-4302-8fc6-2c3966196d45" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">derived the knowledge of the claims in the
				action primarily from specific information relating to allegations or
				transactions (other than information provided by the person bringing the
				action) that the Government publicly disclosed, as that term is defined in
				subsection (e)(4)(A), or that the Government disclosed privately to the person
				bringing the action in the course of its investigation into potential
				violations of this subchapter.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ide136f5c3-547f-42eb-b0f0-7807d110446b" indent="up1"><enum>(B)</enum><text>If the person bringing the action is
				convicted of criminal conduct arising from the role of that person in the
				violation of section 3729, that person shall be dismissed from the civil action
				and shall not receive any share of the proceeds of the action. Such dismissal
				shall not prejudice the right of the United States to continue the action,
				represented by the Department of
				Justice.</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection></section><section id="idb8509f8f-df63-410b-827a-642d3d2e1023"><enum>5.</enum><header>Relief from
			 retaliatory actions</header><text display-inline="no-display-inline">Section
			 3730(h) of title 31, United States Code, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="ide186844c-cb7b-47f4-9ec0-c2193451f41e" style="OLC">
				<subsection id="ida1f74577-5a51-4c98-a691-b3a12049367c"><enum>(h)</enum><header>Relief from
				retaliatory actions</header>
					<paragraph id="id9f31c71b-b5ac-448c-862d-19e7dc76d80d"><enum>(1)</enum><header>In
				general</header><text>Any employee, government contractor, or agent shall be
				entitled to all relief necessary to make that employee, government contractor,
				or agent whole, if that employee, government contractor, or agent is
				discharged, demoted, suspended, threatened, harassed, or in any other manner
				discriminated against in the terms and conditions of employment because of
				lawful acts done by the employee, government contractor, or agent on behalf of
				the employee, government contractor, or agent or associated others in
				furtherance of other efforts to stop 1 or more violations of this
				subchapter.</text>
					</paragraph><paragraph id="idba88f2ba-cb28-4739-b130-a6cc6b4bc2ee"><enum>(2)</enum><header>Relief</header><text>Relief
				under paragraph (1) shall include reinstatement with the same seniority status
				that employee, government contractor, or agent would have had but for the
				discrimination, 2 times the amount of back pay, interest on the back pay, and
				compensation for any special damages sustained as a result of the
				discrimination, including litigation costs and reasonable attorneys' fees. An
				action under this subsection may be brought in the appropriate district court
				of the United States for the relief provided in this
				subsection.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id0a32f95d-6893-4eec-b220-ece18648b8aa"><enum>6.</enum><header>Statute of
			 limitations</header><text display-inline="no-display-inline">Section 3731(b) of
			 title 31, United States Code, is amended to read as follows:</text>
			<quoted-block display-inline="no-display-inline" id="idd89913c3-f4ba-4991-ab91-6567c898116c" style="OLC">
				<subsection id="idbc57ccf5-8427-4891-a819-5b8c3776626e"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id5b33c638-4290-4db7-bc00-d59e47e35f1f"><enum>(1)</enum><text>A civil action
				under section 3730 may not be brought more than 10 years after the date on
				which the violation of section 3729 or 3730 is committed.</text>
					</paragraph><paragraph id="idf023536b-a0f9-44cb-877b-4cb9aba7ada3" indent="up1"><enum>(2)</enum><text>Upon intervention, the Government may
				file its own complaint in intervention or amend the complaint of a person who
				has brought an action under section 3730(b) to clarify or add detail to the
				claims in which the Government is intervening and to add any additional claims
				with respect to which the Government contends it is entitled to relief. For
				statute of limitations purposes, any such Government pleading shall relate back
				to the filing date of the complaint of the person who originally brought the
				action, to the extent that the claim of the Government arises out of the
				conduct, transactions, or occurrences set forth, or attempted to be set forth,
				in the prior complaint of that
				person.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idd0fd7269-915c-46fd-bfb9-ee5373d327ab"><enum>7.</enum><header>Civil
			 investigative demands</header><text display-inline="no-display-inline">Section
			 3733 of title 31, United States Code, is amended—</text>
			<paragraph id="id7DC8EDB1698F46B29CD37C0960A76793"><enum>(1)</enum><text>in subsection
			 (a)—</text>
				<subparagraph id="id70B4517ED2154AC3BD9506F69E88551F"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
					<clause id="ida843bd28-c669-4e55-9592-c519c7e3f70a"><enum>(i)</enum><text>in the matter
			 preceding subparagraph (A)—</text>
						<subclause commented="no" id="id7EEE3B16F9E84677BA61E3305061CDD0"><enum>(I)</enum><text>by inserting
			 <quote>, or a designee (for purposes of this section),</quote> after
			 <quote>Whenever the Attorney General</quote>; and</text>
						</subclause><subclause commented="no" id="id81EE747841654A348E58B57D109C2B88"><enum>(II)</enum><text>by striking
			 <quote>the Attorney General may, before commencing a civil proceeding under
			 section 3730 or other false claims law,</quote> and inserting <quote>the
			 Attorney General, or a designee, may, before commencing a civil proceeding
			 under section 3730(a) or other false claims law, or electing under section
			 3730(b),</quote>; and</text>
						</subclause></clause><clause id="id5343b41c-36ba-4cca-96f5-4c010b05ba6e"><enum>(ii)</enum><text>in the
			 matter following subparagraph (D)—</text>
						<subclause id="id4778efb1-27c6-452b-aa98-06434b509539"><enum>(I)</enum><text>by striking
			 <quote>may not delegate</quote> and inserting <quote>may delegate</quote>;
			 and</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="id936673ce-8b68-45a3-a75f-7d5bf59c1087"><enum>(II)</enum><text>by adding at
			 the end the following: <quote>Any information obtained by the Attorney General
			 or a designee of the Attorney General under this section may be shared with any
			 qui tam relator if the Attorney General or designee determine it is necessary
			 as part of any false claims act investigation.</quote>; and</text>
						</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7FC5C43935BA4C59AEA9CE1399807D3D"><enum>(B)</enum><text>in paragraph
			 (2)(G), by striking the second sentence;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAE2C1314D24D46E58A4518C83928875B"><enum>(2)</enum><text>in
			 subsection(i)(2)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="idC5AE104E27C64BF3BA88C6BCB9772B19"><enum>(A)</enum><text>in subparagraph
			 (B), by striking<linebreak></linebreak><quote>, who is authorized for such use under
			 regulations which the Attorney General shall issue</quote>; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAD0868873EC24A66BF1EDA46F2FE52B3"><enum>(B)</enum><text>in subparagraph
			 (C), by striking <quote>Disclosure of information to any such other agency
			 shall be allowed only upon application, made by the Attorney General to a
			 United States district court, showing substantial need for the use of the
			 information by such agency in furtherance of its statutory
			 responsibilities.</quote>; and</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC0CDD32FE1C144A0B604A3C9F972FD32"><enum>(3)</enum><text>in subsection
			 (l)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id9F30733FE46640DF8F95BA80678A5407"><enum>(A)</enum><text>in paragraph (6),
			 by striking <quote>and</quote> after the semicolon;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD2BBB98884B2418EB076F0517A8D064F"><enum>(B)</enum><text>in paragraph (7),
			 by striking the period and inserting <quote>; and</quote>; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9BCF22B2CD93439FAD0FDEDB573CB975"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idF85E934F6DD640E18CEE62854E1B42FB" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="id397633B1CE684981A229C1E980B8A66A"><enum>(8)</enum><text>the term
				<term>official use</term> means any use that is consistent with the law, and
				the regulations and policies of the Department of Justice, including use in
				connection with internal Department of Justice memoranda and reports;
				communications between the Department of Justice and a Federal, State, or local
				government agency, or a contractor of a Federal, State, or local government
				agency, undertaken in furtherance of a Department of Justice investigation or
				prosecution of a case; interviews of any qui tam relator or other witness; oral
				examinations; depositions; preparation for and response to civil discovery
				requests; introduction into the record of a case or proceeding; applications,
				motions, memoranda and briefs submitted to a court or other tribunal; and
				communications with Government investigators, auditors, consultants and
				experts, the counsel of other parties, arbitrators and mediators, concerning an
				investigation, case or
				proceeding.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="S1"><enum>8.</enum><header>False claims settlements</header>
			<subsection id="ID70426d770a464c678c971766567201f7"><enum>(a)</enum><header>Reports by
			 Attorney General</header><text>Not later than November 1 of each year, the
			 Attorney General shall submit a report to the Committee on the Judiciary of the
			 Senate and the Committee on the Judiciary of the House of Representatives that
			 describes each settlement or compromise of any claim, suit, or other action
			 entered into with the Department of Justice that—</text>
				<paragraph id="IDc51ca967d5394f7e8f20d42645d5e756"><enum>(1)</enum><text>relates to an
			 alleged violation of section 1031 of title 18, United States Code, or section
			 3729 of title 31, United States Code (including all settlements of alternative
			 remedies); and</text>
				</paragraph><paragraph id="IDc27df9eecee343d491c00f3c441d36e9"><enum>(2)</enum><text>results from a
			 claim of damages in excess of $100,000.</text>
				</paragraph></subsection><subsection id="IDd32e6f6a7c2b4ae8b58348d0b11e0e53"><enum>(b)</enum><header>Contents of
			 reports</header><text>The descriptions of each settlement or compromise
			 required to be included in the annual report under subsection (a) shall
			 include—</text>
				<paragraph id="IDdd6ca9db5a064a2d89e6864680806a38"><enum>(1)</enum><text>the overall
			 amount of the settlement or compromise and the portions of the settlement
			 attributed to various statutory authorities;</text>
				</paragraph><paragraph id="ID0f1ebf6cfccb490d86eb40d451db5503"><enum>(2)</enum><text>the amount of
			 actual damages, or in the event no actual amount is available a good faith
			 estimate of the damages, estimated to have been sustained and the minimum and
			 maximum potential civil penalties incurred as a consequence of the defendants
			 that is the subject of the settlement or compromise;</text>
				</paragraph><paragraph id="ID180cc99a383e49a5ac3d26616e105b75"><enum>(3)</enum><text>the basis for the
			 estimate of damages sustained and the potential civil penalties
			 incurred;</text>
				</paragraph><paragraph id="IDf19b20bdff5e4ae4af9d433dd07837a9"><enum>(4)</enum><text>the amount of the
			 settlement that represent damages and the multiplier or percentage of the
			 actual damages applied in the actual settlement or compromise;</text>
				</paragraph><paragraph id="IDa7b5aae859b949a1addf84ace5b3ff74"><enum>(5)</enum><text>the amount of the
			 settlement that represents civil penalties and the percentage of the potential
			 penalty liability captured by the settlement or compromise;</text>
				</paragraph><paragraph id="IDbf312a534bc6471e8d383622a9c6a9c5"><enum>(6)</enum><text>the amount of the
			 settlement that represents criminal fines and a statement of the basis for such
			 fines;</text>
				</paragraph><paragraph id="IDddf795ab558e4e0f95008f2dc9d41a4e"><enum>(7)</enum><text>the length of
			 time involved from the filing of the complaint until the finalization of the
			 settlement or compromise, including—</text>
					<subparagraph id="ID6c695a5318624189bc4377ac146173c8"><enum>(A)</enum><text>the date of the
			 original filing of the complaint;</text>
					</subparagraph><subparagraph id="IDc52a07d1477e48fbb8d4d3d1ef89fed2"><enum>(B)</enum><text>the time the case
			 remained under seal;</text>
					</subparagraph><subparagraph id="IDda51e351e9f54958a88ddec65fe79488"><enum>(C)</enum><text>the date upon
			 which the Department of Justice determined whether or not to intervene in the
			 case; and</text>
					</subparagraph><subparagraph id="IDe5e8c2b4f9b6444ea7709fa357016079"><enum>(D)</enum><text>the date of
			 settlement or compromise;</text>
					</subparagraph></paragraph><paragraph id="ID9fad1fa7b27443b68e7ef9f433822a23"><enum>(8)</enum><text>whether any of
			 the defendants, or any divisions, subsidiaries, affiliates, or related
			 entities, had previously entered into 1 or more settlements or compromises
			 relating to section 1031 of title 18, United States Code, or section 3730(b) of
			 title 31, United States Code, and if so, the dates and monetary size of such
			 settlements or compromises;</text>
				</paragraph><paragraph id="ID5cf4e6ddf97840e8adb2d09e2fd7875d"><enum>(9)</enum><text>whether the
			 defendant or any of its divisions, subsidiaries, affiliates, or related
			 entities—</text>
					<subparagraph id="ID6ff082ec07e948c684e8596d2c5a29ee"><enum>(A)</enum><text>entered into a
			 corporate integrity agreement relating to the settlement or compromise;</text>
					</subparagraph><subparagraph id="IDec298ececb0547f599ef1ada89d69c96"><enum>(B)</enum><text>entered into a
			 deferred prosecution agreement relating to the settlement or compromise;
			 and</text>
					</subparagraph><subparagraph id="ID8e383f52ea504a6d901e68a1116c511f"><enum>(C)</enum><text>had previously
			 entered into 1 or more corporate integrity agreements relating to section
			 3730(b) of title 31, United States Code, or a deferred prosecution agreement
			 relating to section 1031 of title 18, United States Code, and if so, whether
			 the previous corporate integrity agreements covered the conduct that is the
			 subject of the settlement or compromise being reported on or similar
			 conduct;</text>
					</subparagraph></paragraph><paragraph id="ID002143a87157404986e5dae349ea8a5b"><enum>(10)</enum><text>in the case of
			 settlements involving Medicaid, the amounts paid to the Federal Government and
			 to each of the States participating in the settlement or compromise;</text>
				</paragraph><paragraph id="ID7eab3c430a744d7fbacf5de6ef198cf1"><enum>(11)</enum><text>whether civil
			 investigative demands were issued in process of investigating the case;</text>
				</paragraph><paragraph id="IDf79959ac3cc445aca2063abbe3026344"><enum>(12)</enum><text>in qui tam
			 actions, the percentage of the settlement amount awarded to the relator, and
			 whether or not the relator requested a fairness hearing pertaining to the
			 percentage received by the relator or the overall amount of the
			 settlement;</text>
				</paragraph><paragraph id="ID849f568ae863418da241e9a6b945c6ac"><enum>(13)</enum><text>the extent to
			 which officers of the department or agency that was the victim of the loss
			 resolved by the settlement or compromise participated in the settlement
			 negotiations; and</text>
				</paragraph><paragraph id="ID085d074883d141ccb49a9b14c692d387"><enum>(14)</enum><text>the extent to
			 which relators and their counsel participated in the settlement
			 negotiations.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idF66A5B3631C8406EBCE56ADFFABEDF58"><enum>9.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision or application of this Act
			 is held invalid, the invalidity shall not affect other provisions or
			 applications of this Act which can be given effect without regard to the
			 invalid provision or application, and to this end the provisions or
			 applications of this Act are severable.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idF157610882CA42E593F71644F7368113"><enum>10.</enum><header>Effective date
			 and application</header>
			<subsection commented="no" display-inline="no-display-inline" id="id107524497F4B4D6788F347031BD4AD7F"><enum>(a)</enum><header>In
			 General</header><text display-inline="yes-display-inline">Except as provided
			 under subsections (b) and (c), the amendments made by this Act shall take
			 effect on the date of enactment of this Act and shall apply to all civil
			 actions filed before, on, or after that date.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id349F386685BB40558BE41851A89D0613"><enum>(b)</enum><header>False
			 claims</header><text>The amendments made by section 2 shall take effect on the
			 date of enactment of this Act and shall apply to conduct occurring after that
			 date of enactment.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id0742548A0BFF4F6F8EB0B43414FAC983"><enum>(c)</enum><header>Statute of
			 limitation</header><text>The amendment made to section 3731(b)(1) of title 31,
			 United States Code, by section 6 of this Act shall take effect on the date of
			 enactment of this Act and shall apply to civil actions filed after that date of
			 enactment.</text>
