		<official-title>To ensure public access to Federal land and to the
		  airspace over Federal land.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Backcountry Landing Strip Access
			 Act</short-title></quote>.</text>
		</section><section id="IDcf75d45fd87f42f795cce159f1b7242d"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that aircraft landing
			 strips—</text>
			<paragraph id="IDc994dc78461447789df615465a87a116"><enum>(1)</enum><text>serve an
			 essential safety function as emergency landing areas;</text>
			</paragraph><paragraph id="ID28a6ad1b1a804d4bbe7d27e1d2f03b03"><enum>(2)</enum><text>serve as
			 trailhead access points for—</text>
				<subparagraph id="id8F817233626E49A7B47D74E53301706F"><enum>(A)</enum><text>outdoor
			 enthusiasts and their activities, including hiking, fishing, and
			 hunting;</text>
				</subparagraph><subparagraph id="idADAEE21F7E2C410B8E2249CEA4182399"><enum>(B)</enum><text>land management
			 activities, including forest management and firefighting; and</text>
				</subparagraph><subparagraph id="id90D1795E41D145F09433CF8545EC57F6"><enum>(C)</enum><text>inholdings,
			 including mining, ranching, scientific research, and tourism;</text>
				</subparagraph></paragraph><paragraph id="ID1f07b92ba9cc473eb13ee548b6437379"><enum>(3)</enum><text>provide access to
			 national parks, national forests, wilderness areas, and other Federal land for
			 people who would otherwise be physically unable to enjoy such places;</text>
			</paragraph><paragraph id="ID9aa7fc26709d414d84c22e50aca56707"><enum>(4)</enum><text>support the
			 economies of the surrounding communities by providing efficient access for
			 visitors seeking recreational activities; and</text>
			</paragraph><paragraph id="IDc40e3f067bc643efbf49b179ddd619d2"><enum>(5)</enum><text>serve an
			 essential role in search and rescue, forest and ecological management,
			 research, wildlife management, aerial mapping, firefighting, and disaster
			 relief.</text>
			</paragraph></section><section id="ID21d45817597c4470919cbd532e0f598b"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID49de3509cc96436fb797f1d1fb712c4e"><enum>(1)</enum><header>Administrator</header><text>The
			 term <term>Administrator</term> means the Administrator of the Federal Aviation
			 Administration.</text>
			</paragraph><paragraph id="ID2a6ed2ab34174434b09b3f92c8346a36"><enum>(2)</enum><header>Aircraft
			 landing strip</header><text>The term <term>aircraft landing strip</term> means
			 an established aircraft landing strip located on Federal land under the
			 administrative jurisdiction of the Secretary that is for aircraft landing and
			 departure activities.</text>
			</paragraph><paragraph id="ID206e26cadd0544f2898c0c99c0f1cbb9"><enum>(3)</enum><header>Permanently
			 close</header><text>The term <term>permanently close</term> means any closure
			 lasting more than 30 consecutive days in any calendar year.</text>
			</paragraph><paragraph id="ID2bfa70cfdb3048cfbc85083a373bff62"><enum>(4)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means—</text>
				<subparagraph id="ID495b4e1705484040bb236044b77ce06b"><enum>(A)</enum><text>with respect to
			 land under the jurisdiction of the Department of the Interior, the Secretary of
			 the Interior; and</text>
				</subparagraph><subparagraph id="IDf517d65789054d83a9d9d3371497373a"><enum>(B)</enum><text>with respect to
			 land under the jurisdiction of the Department of Agriculture, the Secretary of
			 Agriculture.</text>
				</subparagraph></paragraph></section><section id="ID485a4b5d832e44dd847548451e1a610d"><enum>4.</enum><header>Procedure for
			 consideration of actions affecting certain aircraft landing strips</header>
			<subsection id="IDdcb835b82f9e4cb8a57b05e7feac4850"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall not take any action that would
			 permanently close, restrict, or render or declare as unserviceable any aircraft
			 landing strip unless—</text>
				<paragraph id="IDd9eb63ff1c1d4f0abf05fdb9c73d8981"><enum>(1)</enum><text>the action has
			 been approved by the head of the aviation department of the State in which the
			 aircraft landing strip is located;</text>
				</paragraph><paragraph id="ID40167045831e4be98711d520f0289183"><enum>(2)</enum><text>the Secretary
			 publishes notice of the proposed action in the Federal Register, including
			 notice that the action would permanently close, restrict, or render or declare
			 as unserviceable the aircraft landing strip;</text>
				</paragraph><paragraph id="ID21ff207c62e742d68b6489fc4c29624d"><enum>(3)</enum><text>the Secretary
			 provides for a 90-day public comment period beginning on the date on which the
			 notice under paragraph (2) is published; and</text>
				</paragraph><paragraph id="ID3dfc00557d1440e7b000fa9bc433e32a"><enum>(4)</enum><text>the Secretary and
			 the head of the aviation department of the State in which the affected aircraft
			 landing strip is located have taken into consideration any comments received
			 during the comment period described in paragraph (3).</text>
				</paragraph></subsection><subsection id="ID3cc7a3619f1e401e90fafedc116ac408"><enum>(b)</enum><header>Policies</header>
				<paragraph id="ID6255f4794c8e4593b854892bd2c9fe7b"><enum>(1)</enum><header>Backcountry
			 aviation policies</header><text>Not later than 2 years after the date of the
			 enactment of this Act, the Secretary of the Interior and the Secretary of
			 Agriculture shall jointly—</text>
					<subparagraph id="ID90505d1ef1fc4ae6a0a173bfbac09137"><enum>(A)</enum><text>establish a
			 national policy for governing backcountry aviation issues relating to the
			 management of Federal land under the jurisdiction of the Department of the
			 Interior and the Department of Agriculture; and</text>
					</subparagraph><subparagraph id="ID0b6303becf1d4bf79373e31dbf6abe15"><enum>(B)</enum><text>require officials
			 with jurisdiction over the land described in subparagraph (A) to adhere to the
			 policy established pursuant to such subparagraph.</text>
					</subparagraph></paragraph><paragraph id="IDf402a5171f88470084d251c61c243d6e"><enum>(2)</enum><header>Requirements</header><text>Any
			 policy affecting air access to an aircraft landing strip, including the policy
			 established under paragraph (1), shall not take effect unless the
			 policy—</text>
					<subparagraph id="IDb17e0208f3a3467fa8cdebf32b6f9d29"><enum>(A)</enum><text>acknowledges that
			 the Administrator has the sole authority to control aviation and airspace over
			 the United States; and</text>
					</subparagraph><subparagraph id="ID985fc14972d040c7bab2efca9cc6f9c5"><enum>(B)</enum><text>was developed
			 after seeking and considering comments from State governments and the
			 public.</text>
					</subparagraph></paragraph></subsection><subsection id="IDbcd9f900402d4fb1b7ee7a193de75e0f"><enum>(c)</enum><header>Maintenance of
			 airstrips</header>
				<paragraph id="IDa1d9faaaf87f43ab8d817be48a062eca"><enum>(1)</enum><header>In
			 general</header><text>To ensure that aircraft landing strips are maintained in
			 a manner that is consistent with the resource values of any adjacent area, the
			 Secretary shall consult with—</text>
					<subparagraph id="ID757131ee707e48cc82907d84f59071fe"><enum>(A)</enum><text>the head of the
			 aviation department of each State in which an aircraft landing strip is
			 located; and</text>
					</subparagraph><subparagraph id="IDd05b4a6888bd4af3855e471ee0ad6fd0"><enum>(B)</enum><text>any other
			 interested parties.</text>
					</subparagraph></paragraph><paragraph id="ID6bd670459f7b4f668f22dda0a2d46152"><enum>(2)</enum><header>Cooperative
			 agreements</header><text>The Secretary may enter into cooperative agreements
			 with interested parties for the maintenance of aircraft landing strips.</text>
				</paragraph><paragraph id="IDcf9740334fc346689c92ca27972aec7a"><enum>(3)</enum><header>Maintenance
			 standards</header><text>State aircraft landing strip maintenance standards
			 shall be used as the minimum standard when such standards are available.</text>
				</paragraph></subsection><subsection id="IDd3eb1f775b9741df87f0a2dce24bd78c"><enum>(d)</enum><header>Exchanges or
			 acquisitions</header>
				<paragraph id="ID89a85b62cd684b2ca62426c3c82f70d9"><enum>(1)</enum><header>Conditions</header><text>If
			 the Federal Government acquires private or public property on which an aircraft
			 landing strip is located, the acquisition may not require—</text>
					<subparagraph id="ID1af22422331b467b93c13f2518e0fc1d"><enum>(A)</enum><text>the closure or
			 purposeful neglect of the aircraft landing strip; or</text>
					</subparagraph><subparagraph id="IDf315c882c4e9437fb09c9121ce888513"><enum>(B)</enum><text>any other action
			 that would restrict the use of any aircraft landing strip.</text>
					</subparagraph></paragraph><paragraph id="ID6f05aa80ddf44ff68ce125c09781261c"><enum>(2)</enum><header>Availability</header><text>Each
			 private or publicly-owned aircraft landing strip acquired by the Federal
			 Government shall be made available to the general public for unrestricted
			 use.</text>
				</paragraph></subsection><subsection id="IDffe74ed2feae414499e15760c7817d1a"><enum>(e)</enum><header>Effect on
			 Federal Aviation Administration authority</header><text>Nothing in this Act may
			 be construed to affect the authority of the Administrator over aviation or
			 airspace.</text>
