		  imposed by health plans.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Health Insurance Coverage
			 Protection Act</short-title></quote>.</text>
		</section><section id="IDE7FDC970C93A493788A5806BC4E27A18"><enum>2.</enum><header>Amendments to
			 the <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of
			 1974</act-name></header>
			<subsection id="ID377445CA390949AA846F353BC447B772"><enum>(a)</enum><header>In
			 General</header><text>Subpart B of part 7 of subtitle B of title I of the
			 <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of
			 1974</act-name> (29 U.S.C. 1185 et seq.) is amended by adding at the end the
			 following:</text>
				<quoted-block act-name="Employee Retirement Income Security Act of 1974" id="ID32369AF19F2846C0844868105D5814F1" style="OLC">
					<section id="ID52451A3EDAC249B49EAA620EA8EFF9D1"><enum>714.</enum><header>Limitation on
				lifetime aggregate limits</header>
						<subsection id="ID3D94AD78541948A6AB6E95EE6BF88FCC"><enum>(a)</enum><header>In
				General</header><text>A group health plan and a health insurance issuer
				providing health insurance coverage in connection with a group health plan, may
				not impose an aggregate dollar lifetime limit of less than—</text>
							<paragraph id="IDC3C8A292A605418CA4C6E81B58522391"><enum>(1)</enum><text>with respect to
				the first 2 plan years after the effective date of this section,
				$5,000,000;</text>
							</paragraph><paragraph id="ID18205F269A0945229545C2D4BA59908D"><enum>(2)</enum><text>with respect to
				the third and fourth plan years after such date, $10,000,000; and</text>
							</paragraph><paragraph id="id4B739E4F2E0A4518B1A9320D10F79449"><enum>(3)</enum><text>with respect to
				each subsequent year, the amount for the previous year adjusted by the
				percentage increase in the consumer price index (for all urban consumers) for
				such year;</text>
							</paragraph><continuation-text continuation-text-level="subsection">with
				respect to benefits payable under the plan or coverage.</continuation-text></subsection><subsection id="ID0A505E1FCDA148EE9E83C31DF8E6E370"><enum>(b)</enum><header>Small
				Employers</header>
							<paragraph id="ID3056F973F4D24031AB75AF202A9FCCEC"><enum>(1)</enum><header>In
				general</header><text>Subsection (a) shall not apply to any group health plan
				(and group health insurance coverage offered in connection with a group health
				plan) offered to or maintained for employees of a small employer, except that
				upon the request of such a small employer, the plan involved shall provide for
				the application of an aggregate dollar lifetime limit that is consistent with
				the limit required under such subsection.</text>
							</paragraph><paragraph id="IDC1F215FCDF0F426480549C31FBCE9E12"><enum>(2)</enum><header>Small
				employer</header><text>For purposes of paragraph (1), the term <term>small
				employer</term> means an employer who normally employed fewer than 20 employees
				on a typical business day during the preceding calendar year and who employs
				fewer than 20 employees on the first day of the plan year.</text>
							</paragraph><paragraph id="IDC0C47B8BCDD94C719CD6E33252F0924D"><enum>(3)</enum><header>Application of
				certain rules in determination of employer size</header><text>For purposes of
				this subsection—</text>
								<subparagraph id="ID10181E3BE5AD4BB98D740FBC40DBE3AC"><enum>(A)</enum><header>Application of
				aggregation rule for employers</header><text>Rules similar to the rules under
				subsections (b), (c), (m), and (o) of section 414 of the Internal Revenue Code
				of 1986 shall apply for purposes of treating persons as a single
				employer.</text>
								</subparagraph><subparagraph id="ID8C54C47FE20A405A9752E5F67B745381"><enum>(B)</enum><header>Employers not
				in existence in preceding year</header><text>In the case of an employer which
				was not in existence throughout the preceding calendar year, the determination
				of whether such employer is a small employer shall be based on the number of
				employees that it is reasonably expected such employer will normally employ on
				a typical business day in the current calendar year.</text>
								</subparagraph><subparagraph id="ID028B3BE0B4AA4B64B0C420EC7FEB392C"><enum>(C)</enum><header>Predecessors</header><text>Any
				reference in this subsection to an employer shall include a reference to any
				predecessor of such employer.</text>
								</subparagraph></paragraph></subsection><subsection id="IDE95AC1A1267142E28F13949701CC7C66"><enum>(c)</enum><header>Definition</header><text>In
				this section, the term <term>aggregate dollar lifetime limit</term> means, with
				respect to benefits under a group health plan or health insurance coverage, a
				dollar limitation on the total amount that may be paid with respect to such
				benefits under the plan or health insurance coverage with respect to an
				individual or other coverage
				unit.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="ID0F6DC8D4E5404002A8697BB6FD4744AA"><enum>(b)</enum><header>Clerical
			 Amendment</header><text>The table of contents in section 1 of such Act, is
			 amended by inserting after the item relating to section 713 the following new
			 item:</text>

			</subsection><subsection id="ID51F6A291DAC846ADA6CE7B64125B1A24"><enum>(c)</enum><header>Effective
			 Date</header><text>The amendments made by this section shall apply with respect
			 to plan years beginning on or after the date that is 1 year after the date of
			 enactment of this Act.</text>
			</subsection></section><section id="IDA57D773A080F41A2821DB00E2877617F"><enum>3.</enum><header>Amendment to the
			 <act-name parsable-cite="PHSA">Public Health Service Act</act-name> relating to
			 the group market</header>
			<subsection id="ID47AAC60601B347D8A70AFEB81772B5E0"><enum>(a)</enum><header>In
			 General</header><text>Subpart 2 of part A of title XXVII of the Public Health
			 Service Act (42 U.S.C. 300gg–4 et seq.) is amended by adding at the end the
			 following:</text>

					<section id="ID9270B132D2244F29B78CBD690322A379"><enum>2707.</enum><header>Limitation on
				lifetime aggregate limits</header>
						<subsection id="IDEF3F67A32D1B499C8A1BB1E76FBA0ACB"><enum>(a)</enum><header>In
				General</header><text>A group health plan and a health insurance issuer
				providing health insurance coverage in connection with a group health plan, may
				not impose an aggregate dollar lifetime limit of less than—</text>
							<paragraph id="IDD2572DB33E8B4CB6878CF955B2DA7F34"><enum>(1)</enum><text>with respect to
				the first 2 plan years after the effective date of this section,
				$5,000,000;</text>
							</paragraph><paragraph id="id1FA634AC677D45D9B8B3310B0EE96AA8"><enum>(2)</enum><text>with respect to
				the third and fourth plan years after such date, $10,000,000; and</text>
							</paragraph><paragraph id="idB1CCB02EA321479FAC03E9F4A1BAD1BC"><enum>(3)</enum><text>with respect to
				each subsequent year, the amount for the previous year adjusted by the
				percentage increase in the consumer price index (for all urban consumers) for
				such year;</text>
							</paragraph><continuation-text continuation-text-level="subsection">with
				respect to benefits payable under the plan or coverage.</continuation-text></subsection><subsection id="ID6CC3716D16F44421B9F93FB95913E2E9"><enum>(b)</enum><header>Small
				Employers</header>
							<paragraph id="ID6834C91A947746ECB7B018AEC33879DA"><enum>(1)</enum><header>In
				general</header><text>Subsection (a) shall not apply to any group health plan
				(and group health insurance coverage offered in connection with a group health
				plan) offered to or maintained for employees of a small employer, except that
				upon the request of such a small employer, the plan involved shall provide for
				the application of an aggregate dollar lifetime limit that is consistent with
				the limit required under such subsection.</text>
							</paragraph><paragraph id="ID6F593047955B44B7978A5C03DB803BEE"><enum>(2)</enum><header>Small
				employer</header><text>For purposes of paragraph (1), the term <term>small
				employer</term> means an employer who normally employed fewer than 20 employees
				on a typical business day during the preceding calendar year and who employs
				fewer than 20 employees on the first day of the plan year.</text>
							</paragraph><paragraph id="ID871EC53D202C41338C4748E4D951036F"><enum>(3)</enum><header>Application of

				this subsection—</text>

								</subparagraph><subparagraph id="ID406AB7E374D94B99A003E34BA08948E1"><enum>(B)</enum><header>Employers not
				in existence in preceding year</header><text>In the case of an employer which
				was not in existence throughout the preceding calendar year, the determination
				of whether such employer is a small employer shall be based on the number of
				employees that it is reasonably expected such employer will normally employ on
				a typical business day in the current calendar year.</text>
								</subparagraph><subparagraph id="ID2A965A7D7EF947B980DAFCB47D33BF9E"><enum>(C)</enum><header>Predecessors</header><text>Any
				reference in this subsection to an employer shall include a reference to any
				predecessor of such employer.</text>
								</subparagraph></paragraph></subsection><subsection id="ID6D973D5C35E946C8B039331DD43B626C"><enum>(c)</enum><header>Definition</header><text>In
				this section, the term <term>aggregate dollar lifetime limit</term> means, with
				respect to benefits under a group health plan or health insurance coverage, a
				dollar limitation on the total amount that may be paid with respect to such
				benefits under the plan or health insurance coverage with respect to an
				individual or other coverage
				unit.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDAD739FC7453F47BFA7B7674404D8128F"><enum>(b)</enum><header>Effective
			 Date</header><text>The amendment made by this section shall apply with respect
			 to plan years beginning on or after the date that is 1 year after the date of
			 enactment of this Act.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="idD7B1BEEBEE6E41CDAEDE641C10F7BDF6"><enum>4.</enum><header>Study by the
			 Institute of Medicine</header><text display-inline="no-display-inline">The
			 Secretary of Health and Human Services shall enter into a contract with the
			 Institute of Medicine for the conduct of a study to determine the number of
			 individuals who have reached the lifetime limitations set forth in the
			 amendments made by this Act beginning in the third plan year for which such
			 amendments apply. Not later than 1 year after the date on which the study is
			 conducted under the previous sentence, the Institute of Medicine shall submit
			 to the Secretary and the appropriate committees of Congress a report concerning
			 the results of the study.</text>
