		<official-title>To provide for the voluntary development by States of
		  qualifying best practices for health care and to encourage such voluntary
		  development by amending titles XVIII and XIX of the Social Security Act to
		  provide differential rates of payment favoring treatment provided consistent
		  with qualifying best practices under the Medicare and Medicaid programs, and
		  for other purposes.</official-title>

		<section id="idCBCFFDE7BE374E29A770D2CDC4AC0467" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Improved Medical Decision Incentive
			 Act of 2009</short-title></quote>.</text>
		</section><section id="idF569F57CD4B947688F6E3FFFBF6D5A5E" section-type="subsequent-section"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following
			 findings:</text>
			<paragraph id="ID100e2e1cd93745829b082466889d0db0"><enum>(1)</enum><text>The United States
			 spends more per capita on health care than any other nation, and yet it has
			 mediocre health outcomes, including the second-highest infant mortality rate of
			 all industrialized nations.</text>
			</paragraph><paragraph id="ID5a55d59736424b5190dce1a759d249b6"><enum>(2)</enum><text>The efficacy of
			 best practices guidelines in improving health care delivery and patient
			 outcomes is well established.</text>
			</paragraph><paragraph id="ID92e76ffbbaee437c8c88d1b7f6df93b8"><enum>(3)</enum><text>Existing payment
			 systems compensate physicians without adequate attention to the appropriateness
			 or quality of care delivered and often without reference to established best
			 practices.</text>
			</paragraph><paragraph id="ID57c29a4b0f1b49bb850231932bb84b35"><enum>(4)</enum><text>Identification of
			 and adherence to best practices can improve the quality of health care while
			 reducing overall costs to the health care system.</text>
			</paragraph><paragraph id="ID42349fb48ed14a7db04b2bc5a6950b50"><enum>(5)</enum><text>Orderly
			 administrative proceedings involving knowledgeable professionals will enhance
			 best practices for health care.</text>
			</paragraph><paragraph id="idE831BBF42029449E861435C4C5FFDF5C"><enum>(6)</enum><text>Control of
			 medical practices through denial of claims by insurance companies has proven
			 wasteful and confusing, and has failed to motivate adequate development and use
			 of best practices for health care.</text>
			</paragraph></section><section id="ID77ab8d25e5cb4a1283bc37d0c47473a1"><enum>3.</enum><header>Voluntary state
			 development and approval of qualifying best practices; incentives for private
			 insurers</header>
			<subsection id="id2D6AB49BE5AE46A38B96857DC7CE5388"><enum>(a)</enum><header>State approval
			 of best practices</header>
				<paragraph id="id59A3B532EF3A4F3FA00B971F261A58E9"><enum>(1)</enum><header>In
			 general</header><text>A State health department may approve best practices in a
			 course of, or as a means of treatment for, a particular condition, illness, or
			 procedure, as the qualifying standard of care for the State in order to take
			 advantage of the differential rates of payment implemented under sections 1899
			 and 1902(dd) of the Social Security Act (as added by sections 4 and 5,
			 respectively) and the private insurance incentive under subsection (b).</text>
				</paragraph><paragraph id="id1A202961DEC44D1C9BCEDC266F72C66D"><enum>(2)</enum><header>Qualifying
			 process for State approval</header><text display-inline="yes-display-inline">In
			 order for best practices approved by a State under paragraph (1) to qualify as
			 best practices for purposes of implementing such differential rates of payment
			 and for purposes of such private insurance incentive, a State health department
			 shall—</text>
					<subparagraph id="id6EB2D9E876E947238C784B8CBE84740F"><enum>(A)</enum><text>allow any duly
			 constituted State medical society, medical specialty group, or medical
			 specialty board to file with the State health department a course or means of
			 treatment representing best practices for a particular condition, illness, or
			 procedure to be applicable in the State, including cost-effective prevention
			 and management measures;</text>
					</subparagraph><subparagraph id="id05124A017AF44BDD8BC2E2DCA1839EA4"><enum>(B)</enum><text>provide for
			 notice and hearing with respect to the approval of best practices for a
			 particular condition, illness, or procedure consistent with—</text>
						<clause id="id30E1C1728D444172A26DFFE43341A938"><enum>(i)</enum><text>section 552b of
			 title 5, United States Code (relating to open meetings), or, if applicable,
			 equivalent State law; and</text>
						</clause><clause id="idC1DD066D24AC4BB4BDBEBD2E47F3BF8C"><enum>(ii)</enum><text>the
			 administrative procedures of the State;</text>
						</clause></subparagraph><subparagraph id="id8F470CF1196242558E1F94255A975EA3"><enum>(C)</enum><text>permit any health
			 insurer described in subsection (b)(1), including any individual authorized by
			 the Secretary of Health and Human Services to act as a representative of the
			 Medicare and Medicaid programs under titles XVIII and XIX, respectively, of the
			 Social Security Act (42 U.S.C. 1395 et seq.; 1396 et seq.), to intervene in any
			 administrative proceeding to approve such best practices;</text>
					</subparagraph><subparagraph id="id00C60710BD5B4F489393CD51EFAA01FE"><enum>(D)</enum><text>provide
			 appropriate notice of any such administrative proceeding to established
			 advocacy groups concerned with the condition or illness involved in the
			 proceeding; and</text>
					</subparagraph><subparagraph id="id851D4BDC388F476CA07091BC4ADF23B4"><enum>(E)</enum><text>in the case where
			 the State health department determines that a course of treatment filed in
			 accordance with subparagraph (A) would lower system costs and improve quality
			 of care, approve that best practices course of treatment within its
			 jurisdiction as the qualifying standard of care under this subsection for that
			 condition, illness, or procedure.</text>
					</subparagraph></paragraph><paragraph id="idCFC99574F59F4150AFA44E408642CF76"><enum>(3)</enum><header>Priority of
			 approvals</header><text>State health departments are encouraged to prioritize
			 approval of best practices that address conditions, illnesses, or procedures
			 where those best practices are reasonably anticipated to result in the greatest
			 overall cost savings and quality improvements.</text>
				</paragraph><paragraph id="ID68e555f450554fc18de1e382e84a6013"><enum>(4)</enum><header>Approval of
			 qualifying best practices</header><text>If, at the conclusion of a process that
			 meets the requirements of paragraph (2), the State health department approves
			 best practices (as described in paragraph (1)), those best practices shall
			 be—</text>
					<subparagraph id="id5FC73AF97D044D9AB216FA729F648749"><enum>(A)</enum><text>deemed qualifying
			 best practices;</text>
					</subparagraph><subparagraph id="idF57825E38639458B890A4B3A9091AC9C"><enum>(B)</enum><text>the basis for
			 differential rates of payment under sections 1899 and 1902(dd) of the Social
			 Security Act (as added by sections 4 and 5, respectively); and</text>
					</subparagraph><subparagraph id="id0DF7D2D45CFB4787B9190B407F9772CA"><enum>(C)</enum><text>eligible for the
			 private insurance incentive under subsection (b).</text>
					</subparagraph></paragraph><paragraph id="id007AA4222DF245828456DF219286BC88"><enum>(5)</enum><header>Definition of
			 state</header><text>In this subsection the term <term>State</term> includes
			 such regional or local areas as the State health department determines
			 appropriate.</text>
				</paragraph></subsection><subsection id="ID8702c137eb0f4933b2c288d8147b93ad"><enum>(b)</enum><header>Incentive for
			 private insurers To provide timely payment for services provided in accordance
			 with best practices</header>
				<paragraph id="id6C27FD530751444DAEFCAAC20F9B2DDF"><enum>(1)</enum><header>In
			 general</header><text>Notwithstanding any other provision of law, in the case
			 where qualifying best practices have been approved by a State health department
			 in accordance with subsection (a), any health insurer doing business in
			 interstate commerce and providing health care coverage within the State shall
			 pay all provider charges for any service provided in accordance with such best
			 practices not later than 30 days after the date on which such service is
			 provided and, absent fraud, without regard for the insurer’s internal
			 utilization review or claims denial procedure.</text>
				</paragraph><paragraph id="IDb51efcb1a21f4c45a26dd96d45b57c5e"><enum>(2)</enum><header>Standing to
			 enforce</header><text>Any provider or specialty group that does business in a
			 State where the State health department has approved qualifying best practices
			 in accordance with subsection (a) may bring a civil action in an appropriate
			 United States district court to enjoin efforts by any health insurer to
			 challenge or delay payment for services provided by the provider or a member of
			 the specialty group in accordance with such best practices approved in the
			 State. The district court shall award a provider or specialty group costs and
			 attorney’s fees in such a civil action if the court finds that the challenge or
			 delay was a willful violation of this Act.</text>
				</paragraph></subsection></section><section id="ID778c193e0ae84bc89c94e70448c29aee"><enum>4.</enum><header>Implementation
			 of differential rates of payment for qualifying best practices under the
			 Medicare program</header>
			<subsection id="idD3E78D2040A749749718C38C1754ACE7"><enum>(a)</enum><header>Differential
			 rates of payment for qualifying best practices</header><text>Title XVIII of the
			 Social Security Act (42 U.S.C. 1395 et seq.) is amended by adding at the end
			 the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="id73EAB9D117A34B75B6E37C9872E6B1FD" style="traditional">
					<section id="id58C0A68E832142FCAD4D381C2AAC7E81"><enum>1899.</enum><header>Differential rates of payment for qualifying best
		  practices</header><subsection commented="no" display-inline="yes-display-inline" id="id628C29BE21BE4118A7F2CA130D015266"><enum>(a)</enum><header>In general</header>
							<paragraph id="id8963FD302DD1405497787279AB118837"><enum>(1)</enum><header>Differential
				rates of payment</header><text>Notwithstanding any other provision of law,
				subject to paragraph (4), the Secretary shall establish procedures to provide
				differential rates of payment for items and services covered under the program
				under this title that favor treatment provided consistent with qualifying best
				practices approved by a State in accordance with section 3(a) of the
				<short-title>Improved Medical Decision Incentive Act of
				2009</short-title>.</text>
							</paragraph><paragraph id="id8775DB221F254FB78C6A4108E22267DB"><enum>(2)</enum><header>Regulations</header><text>Not
				later than March 31, 2010, the Secretary shall promulgate regulations to carry
				out this subsection.</text>
							</paragraph><paragraph id="id552980058CC342B382B078783A37B485"><enum>(3)</enum><header>Budget
				neutrality</header><text>The Secretary shall ensure that the procedures
				established under paragraph (1) do not result in overall expenditures for any
				year under this title that are more than the expenditures which would have been
				made if such procedures had not been established, taking into account—</text>
								<subparagraph id="id8780FC24A3144303811BEC3784719F5C"><enum>(A)</enum><text>any savings
				anticipated as a result of the application of best practices to items and
				services covered under the program under this title; and</text>
								</subparagraph><subparagraph id="id4B7192BAAB1249F68D1CC895131E504A"><enum>(B)</enum><text>the net effects
				of reimbursement increases and decreases as a result of the differential in
				rates of payment established under such program.</text>
								</subparagraph></paragraph><paragraph id="id48F455697A794D1ABD0062BC61C05337"><enum>(4)</enum><header>Exception for
				certain items and services</header><text>Such procedures shall not apply to
				payment for items and services which the Secretary determines are
				provided—</text>
								<subparagraph id="id6637FA827F27425BA14B99806E12E43F"><enum>(A)</enum><text>as part of a
				clinical trial or study; or</text>
								</subparagraph><subparagraph id="id14846B81117342469690BE606E447ECE"><enum>(B)</enum><text>in exceptional
				circumstances that require non-standard care.</text>
								</subparagraph></paragraph></subsection><subsection id="IDafb210e1113f4cfcacc27ef6d654cf31"><enum>(b)</enum><header>Adoption of
				national best practices</header>
							<paragraph id="idF479622C61F74C0DB63481D7E286FC34"><enum>(1)</enum><header>In
				general</header><text>Such procedures shall specify that, in any case where the
				Secretary finds a national standard for best practices to be appropriate, the
				Secretary may adopt national best practices. Subject to paragraph (2), such
				national best practices shall be applicable within a State as a qualifying best
				practice in accordance with section 3(a) of the
				<short-title>Improved Medical Decision Incentive Act of
				2009</short-title> and the basis for the establishment of differential rates of
				payment under the program under this title.</text>
							</paragraph><paragraph id="id1262230110E04349837F5F23A4D2BCB1"><enum>(2)</enum><header>Limitation</header><text>In
				any case where the State health department has approved qualifying best
				practices in the State for a condition, illness, or procedure in accordance
				with such section 3(a), national best practices adopted under paragraph (1)
				shall only be applicable within such State as a qualifying best practice and
				the basis for the establishment of such differential rates of payment if the
				Secretary finds, after a hearing in the State that meets the procedural
				requirements under paragraph (2) of such section 3(a), that the national best
				practices will improve health care outcomes and lower health care costs in the
				State to a greater extent than the qualifying best practices approved by the
				State health department for that condition, illness, or procedure in accordance
				with such section
				3(a).</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="id1F6C36628370483CA4A80AD290C7FEC1"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by this section shall apply to items and
			 services furnished on or after March 31, 2010.</text>
			</subsection></section><section id="id360DF75DA4124C019544EFB67FC564F1"><enum>5.</enum><header>Implementation
			 of differential rates of payment for qualifying best practices under the
			 Medicaid program</header>
			<subsection id="idF4B3B726A0A04D61800345663B3CCC10"><enum>(a)</enum><header>State plan
			 amendment</header><text>Section 1902(a) of the Social Security Act (42 U.S.C.
			 1396a(a)) is amended—</text>
				<paragraph id="id320962343E1743EEB58DE98CC353151B"><enum>(1)</enum><text>in paragraph
			 (70)(B)(iv), by striking <quote>and</quote> at the end;</text>
				</paragraph><paragraph id="id9006FBBD1A904F02A71AA7C3D051D6D1"><enum>(2)</enum><text>in paragraph
			 (71), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
				</paragraph><paragraph id="id3B179D6F24BD4975B9F30D113CFC7245"><enum>(3)</enum><text>by inserting
			 after paragraph (71) the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="id11F4BD45B01949268CACA48E80B9E20A" style="OLC">
						<paragraph id="idCE4551023FF0427091A6550121641D49"><enum>(72)</enum><text>provide, in
				accordance with procedures established by the Secretary under subsection (dd)
				and after consultation with and upon the recommendation of the State health
				department (and the approval of the Secretary), for differential rates of
				payment for medical assistance under the plan that favor treatment provided
				consistent with qualifying best practices approved by the State health
				department in accordance with section 3(a) of the
				<short-title>Improved Medical Decision Incentive Act of
				2009</short-title>, except that in establishing such payment rates, the State
				shall ensure that the amounts paid under such rates do not exceed the amount
				the State would have paid for such medical assistance under the plan if such
				differential rates of payment had not been made, taking into account any annual
				increases in population and
				inflation.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id14A1EAC9449943169BB6DC2FD8FBA68D"><enum>(b)</enum><header>Establishment
			 of procedures</header><text>Section 1902 of the Social Security Act (42 U.S.C.
			 1396a) is amended by adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="id0574003DB610464EA7B473289C327840" style="OLC">
					<subsection id="id6238D4F2329E4312ACA6FB4BBE3EC559"><enum>(dd)</enum><header>Differential
				rates of payment for qualifying best practices and adoption of national best
				practices</header>
						<paragraph id="idF7182D00D0A446B6AF92FDEB6C700D1A"><enum>(1)</enum><header>Differential
				rates of payment for qualifying best practices</header>
							<subparagraph id="id8672DB60448645088FE2A095AAB73A9B"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding any other provision of law, subject to
				subparagraph (D), the Secretary shall establish procedures to provide
				differential rates of payment for medical assistance provided consistent with
				qualifying best practices approved by a State in accordance with section 3(a)
				of the <short-title>Improved Medical Decision Incentive
				Act of 2009</short-title>.</text>
							</subparagraph><subparagraph id="id3D5250128E9B4D12B59AF9D642F31653"><enum>(B)</enum><header>Regulations</header><text>Not
				later than March 31, 2010, the Secretary shall promulgate regulations to carry
				out this subsection.</text>
							</subparagraph><subparagraph id="id2CE173239322444E999F1811F5FA92EE"><enum>(C)</enum><header>Budget
				neutrality</header><text>The Secretary shall ensure that the procedures
				established under subparagraph (A) do not result in overall expenditures for
				any year under a State plan that are more than the expenditures which would
				have been made if such procedures had not been established, taking into
				account—</text>
								<clause id="id92A2B2DFFD4743FB93492642E9AB2444"><enum>(i)</enum><text>any savings
				anticipated as a result of the application of best practices to medical
				assistance provided under the State plan; and</text>
								</clause><clause id="idF992D80E5EF04AB989B1334DEA8E626E"><enum>(ii)</enum><text>the net effects
				of reimbursement increases and decreases as a result of the differential rates
				of payment established under such plan.</text>
								</clause></subparagraph><subparagraph id="id3B6433552A084D3193F98F0EF0EC15E4"><enum>(D)</enum><header>Exception for
				certain items and services</header><text>Such procedures shall not apply to
				payment for medical assistance which the Secretary determines is
				provided—</text>
								<clause id="idC3384FB93C414309B94F913718F8E983"><enum>(i)</enum><text>as part of a
				clinical trial or study; or</text>
								</clause><clause id="id236C145D20064CEEBDE24DC3B10F8F6A"><enum>(ii)</enum><text>in exceptional
				circumstances that require non-standard care.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" id="id6A72D53ADA584709A44923E6522925CB"><enum>(2)</enum><header>Adoption of
				national best practices</header><text>Such procedures shall specify that, in
				any case where the Secretary adopts national best practices in accordance with
				section 1899(b), subject to the limitation under paragraph (2) of such section,
				such national best practices shall be—</text>
							<subparagraph commented="no" id="idA2D41BCA58FA4B16A225482460D506BF"><enum>(A)</enum><text>applicable within
				a State as a qualifying best practice in accordance with section 3(a) of the
				<short-title>Improved Medical Decision Incentive Act of
				2009</short-title>; and</text>
							</subparagraph><subparagraph commented="no" id="id865508D05A074772A09D7584B5AD4CCC"><enum>(B)</enum><text>the basis for the
				establishment of differential rates of payment under the State
				plan.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idC1686EC3A2744615AD22C64443220DA7"><enum>(c)</enum><header>Effective
			 date</header>
				<paragraph id="idD2A5AAA135B34F789D7F146D3791245D"><enum>(1)</enum><header>In
			 general</header><text>Except as provided in paragraph (2), the amendments made
			 by this section shall apply to medical assistance furnished on or after March
			 31, 2010.</text>
				</paragraph><paragraph id="id34B4CCCF2ACE4E0E91886DF97DBBCE34"><enum>(2)</enum><header>Extension of
			 effective date for state law amendment</header><text>In the case of a State
			 plan under title XIX of the Social Security Act (42 U.S.C. 1396 et seq.) which
			 the Secretary of Health and Human Services determines requires State
			 legislation in order for the plan to meet the additional requirements imposed
			 by the amendments made by this section, the State plan shall not be regarded as
			 failing to comply with the requirements of such title solely on the basis of
			 its failure to meet these additional requirements before the first day of the
			 first calendar quarter beginning after the close of the first regular session
			 of the State legislature that begins after the date of enactment of this Act.
			 For purposes of the previous sentence, in the case of a State that has a 2-year
			 legislative session, each year of the session is considered to be a separate
			 regular session of the State legislature.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID890f52b48d2f4b7aa94ada90ad8cf666"><enum>6.</enum><header>Oversight by the
			 Centers for Medicare &amp; Medicaid Services</header>
			<subsection commented="no" display-inline="no-display-inline" id="idD59246FD17744DF4961C24AB3D5FEE75"><enum>(a)</enum><header>Review and
			 report</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idC2691ECF1BEA4F669B8731DAD10DD300"><enum>(1)</enum><header>Review</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id634B993B5241402186D4C2A22C25B8F5"><enum>(A)</enum><header>In
			 general</header><text>The Secretary shall conduct an annual review of the
			 efficacy of all qualifying best practices approved pursuant to section 3(a)
			 and, if applicable, any national best practices adopted pursuant to section
			 1899(b) of the Social Security Act, as added by section 4(a).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9FB851909A384DFC8A9A98E7B16CA651"><enum>(B)</enum><header>Considerations</header><text>The
			 review conducted under subparagraph (A) shall consider—</text>
						<clause commented="no" display-inline="no-display-inline" id="id0881EA302DEA4115B4878F4E90BDCC65"><enum>(i)</enum><text>the effect of
			 such best practices with respect to improving outcomes and lowering the cost of
			 care; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id94C77C6F78FA45E29C021DF4A9E1EB23"><enum>(ii)</enum><text>the effect and
			 efficacy of differential rates of payment under the Medicare and Medicaid
			 programs under titles XVIII and XIX, respectively, of the Social Security Act
			 (42 U.S.C. 1395 et seq.; 1396 et seq.) under procedures established pursuant to
			 the amendments made by sections 4 and 5.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB242023481544C5BA951019062EE2290"><enum>(2)</enum><header>Report</header><text>The
			 Secretary shall submit an annual report to Congress containing the results of
			 the review conducted under paragraph (1)(A), together with recommendations for
			 such legislation and administrative actions as the Secretary determines
			 appropriate.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE3A56AA84FF14840AE5D73CE8E43A7F5"><enum>(b)</enum><header>Annual
			 conference</header><text>The Secretary shall host an annual conference of all
			 State health directors, and any State medical societies and medical specialty
			 groups that have filed best practices for approval with a State health
			 department in accordance with subparagraph (A) of section 3(a)(2) and any
			 health insurers and advocacy groups that have participated in any
			 administrative proceeding to approve best practices in accordance with
			 subparagraphs (C) and (D), respectively, of such section, to provide—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idE813E10F06834EB8AB16DEC0DD09747B"><enum>(1)</enum><text>for the exchange
			 of information; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id567ADFC9ACAE4BCCAE137D2C498AD57C"><enum>(2)</enum><text>an opportunity to
			 summarize the effects on health care costs, quality, and outcomes of qualifying
			 best practices approved in accordance with section 3(a) prior to the date on
