			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Morris K. Udall Scholarship and
			 Excellence in National Environmental Policy Amendments Act of
			 2009</short-title></quote>.</text>
		</section><section id="id564C1032939C4F0C80B42B409C76306A"><enum>2.</enum><header>Short
			 title</header><text display-inline="no-display-inline">Section 1 of the Morris
			 K. Udall Scholarship and Excellence in National Environmental and Native
			 American Public Policy Act of 1992 (20 U.S.C. 5601 note; Public Law 102–259) is
			 amended to read as follows:</text>

				title</header><text display-inline="no-display-inline">This Act may be cited as
				the <quote>Morris K. Udall and Stewart L. Udall Foundation
				Act</quote>.</text>
				</section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idAF91A2B15CA94E99B21D8A2A0918BF77" section-type="subsequent-section"><enum>3.</enum><header>Findings</header><text display-inline="no-display-inline">Section 3 of the Morris K. Udall and Stewart
			 L. Udall Foundation Act (20 U.S.C. 5601) is amended—</text>
			<paragraph id="IDca9a54b84f934652b42113cb419003f1"><enum>(1)</enum><text>in paragraph (3),
			 by striking <quote>and</quote> at the end;</text>
			</paragraph><paragraph id="IDf46a4c2d7a2844dd984340101f52e4b2"><enum>(2)</enum><text>in paragraph (4),
			 by striking the period at the end and inserting a semicolon; and</text>
			</paragraph><paragraph id="IDecd284cc35004e2bbe76ce2f36cbcf61"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id00E70D19629648A794FC9B6A21D78168" style="OLC">
					<paragraph id="ID93ba390a7f7442ae986e596589407c14"><enum>(5)</enum><text>the
				Foundation—</text>
						<subparagraph id="idFFB2513B6260435188A147D087201B51"><enum>(A)</enum><text>since 1995, has
				operated exceptional scholarship, internship, and fellowship programs for areas
				of study related to the environment and Native American tribal policy and
				health care;</text>
						</subparagraph><subparagraph id="id2FBD7C5461AA48BDA6442FDAFCDD3BFE"><enum>(B)</enum><text>since 1999, has
				provided valuable environmental conflict resolution services and leadership
				through the United States Institute for Environmental Conflict Resolution;
				and</text>
						</subparagraph><subparagraph id="IDf25a5cc60479492d9f7da156e231471a"><enum>(C)</enum><text>is committed to
				continue making a substantial contribution toward public policy in the future
				by—</text>
							<clause id="id15111C48FF584244AFFE10159C935832"><enum>(i)</enum><text>playing a
				significant role in developing the next generation of environmental and Native
				American leaders; and</text>
							</clause><clause id="id813058E08855449D80F0A8F5D0657434"><enum>(ii)</enum><text>working with
				current leaders to improve decisionmaking on—</text>
								<subclause id="idD1DA17256A134E9F89493241F153459E"><enum>(I)</enum><text>challenging
				environmental, energy, and related economic problems; and</text>
								</subclause><subclause id="id104EB4D63A534BFA96665B24ADFD4079"><enum>(II)</enum><text>tribal
				governance and economic issues;</text>
								</subclause></clause></subparagraph></paragraph><paragraph id="ID6ffe5891808644aa8b6ed4835d7a9f64"><enum>(6)</enum><text>Stewart L. Udall,
				as a member of Congress, Secretary of the Interior, environmental lawyer, and
				author, has provided distinguished national leadership in environmental and
				Native American policy for more than 50 years;</text>
					</paragraph><paragraph id="ID32ea4448f5da4aa5a99a78453c172064"><enum>(7)</enum><text>as Secretary of
				the Interior from 1961 to 1969, Stewart L. Udall oversaw the creation of 4
				national parks, 6 national monuments, 8 national seashores and lakeshores, 9
				recreation areas, 20 historic sites, and 56 wildlife refuges; and</text>
					</paragraph><paragraph id="IDeba38cc5288e4eefa74705956b85095a"><enum>(8)</enum><text>it is fitting
				that the leadership and vision of Stewart L. Udall in the areas of
				environmental and Native American policy be jointly honored with that of Morris
				K. Udall through the foundation bearing the Udall
				name.</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id8845EDF66F30479E89D6A33BD55ECE91"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 4 of the Morris K. Udall and Stewart
			 L. Udall Foundation Act (20 U.S.C. 5602) is amended—</text>
			<paragraph id="idE6A18BF12CEB4150B4D5F65E4280E17B"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>Morris K. Udall Scholarship and Excellence in National
			 Environmental Policy</quote>;</text>
			</paragraph><paragraph id="id51D76AE62B48462E989E46799837332B"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (5), by striking
			 <quote>Scholarship and Excellence in National Environmental Policy</quote> and
			 inserting <quote>and Stewart L. Udall</quote>; and</text>
			</paragraph><paragraph id="idDF919E30285E4053B6F45E659A0FDF4D"><enum>(3)</enum><text>in paragraph (9),
			 by striking <quote>Scholarship and Excellence in National Environmental

			 foundation</header><text display-inline="no-display-inline">Section 5 of the
			 Morris K. Udall and Stewart L. Udall Foundation Act (20 U.S.C. 5603) is
			 amended—</text>

			 heading, by striking <quote><header-in-text level="section" style="OLC">Scholarship and Excellence in National Environmental
			 Policy</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">and Stewart L.
			 Udall</header-in-text></quote>;</text>
			</paragraph><paragraph id="IDaab73ed3e90f4345996036beee179155"><enum>(2)</enum><text>in subsection
			 (a), by striking <quote>Scholarship and Excellence in National Environmental
			 Policy</quote> and inserting <quote>and Stewart L. Udall</quote>; and</text>

			 (a)(5)—</text>
				<subparagraph id="ID5613a15c4bfd42dfb5a7a4e7601bf157"><enum>(A)</enum><text>in subparagraph
			 (C), by striking <quote>and</quote> at the end;</text>
				</subparagraph><subparagraph id="id37BAC1A54C1447D0992A37AF50B84951"><enum>(B)</enum><text>in subparagraph
			 (D), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>

				under this Act shall be known as <quote>Udall Scholars</quote>, <quote>Udall
				Fellows</quote>, and <quote>Udall Interns</quote>,
				respectively.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="id2FF35676C8584D6FA4F711E5BE6E34CA"><enum>7.</enum><header>Establishment of
			 trust fund</header><text display-inline="no-display-inline">Section 8 of the
			 Morris K. Udall and Stewart L. Udall Foundation Act (20 U.S.C. 5606) is
			 amended—</text>
			<paragraph id="id2B59449044594B23BDCB322D5CD8509F"><enum>(1)</enum><text>in the section
			 heading, by striking <quote><header-in-text level="section" style="OLC">Scholarship and Excellence in National Environmental
			 Policy</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">and Stewart L. Udall</header-in-text></quote>;
			 and</text>
			</paragraph><paragraph id="idD199CA95D6534E1E85A917412E7B4E1C"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (a), by striking
			 <quote>Scholarship and Excellence in National Environmental Policy</quote> and

			</paragraph></section><section id="IDd12bd5bbbf174b19b8c644cabfdb5ac0"><enum>8.</enum><header>Expenditures and
			 audit of trust fund</header><text display-inline="no-display-inline">Section
			 9(a) of the Morris K. Udall and Stewart L. Udall Foundation Act (20 U.S.C.
			 5607(a)) is amended by inserting before the period at the end the following:
			 <quote>, including a reasonable amount for official reception and
			 representation expenses, as determined by the Board, not to exceed $5,000 for a
			 fiscal year</quote>.</text>
		</section><section id="IDa7ad194a87d9485f9883c0792705a8b9"><enum>9.</enum><header>Use of institute
			 by Federal agency or other entity</header><text display-inline="no-display-inline">Section 11 of the Morris K. Udall and
			 Stewart L. Udall Foundation Act (20 U.S.C. 5607b) is amended by adding at the
			 end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id312379381E5746D898554276FCFD8338" style="OLC">
				<subsection id="ID7baa386cc42a40f9b0691c76e0996743"><enum>(f)</enum><header>Agency
				management or control</header><text>Use of the Foundation or Institute to
				provide independent and impartial assessment, mediation, or other dispute or
				conflict resolution under this section shall not be considered to be the
				establishment or use of an advisory committee within the meaning of the
				<act-name parsable-cite="FACA">Federal Advisory Committee Act</act-name> (5
				U.S.C.
				App.).</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="IDe26f1985b3874ca5a8d426c3665fee35"><enum>10.</enum><header>Administrative
			 provisions</header><text display-inline="no-display-inline">Section 12(a) of
			 the Morris K. Udall and Stewart L. Udall Foundation Act (20 U.S.C. 5608(a)) is
			 amended—</text>
			<paragraph id="IDd04587bfa8534f4bba9570a63712564b"><enum>(1)</enum><text>by striking
			 paragraph (1) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="id951E5FDCCF2E485C86E163E8776ADC0B" style="OLC">
					<paragraph id="id0250DC1F74E3432898815AB47D718794"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idF89E7138A6194C399A91E72A24CDF633"><enum>(A)</enum><text>appoint such personnel
				as may be necessary to carry out the provisions of this Act, without regard to
				the provisions of title 5, United States Code, governing appointments in the
				competitive service; and</text>
						</subparagraph><subparagraph id="id29B61457221546BCBDCF2EF76A47C9E7" indent="up1"><enum>(B)</enum><text>fix the compensation of the personnel
				appointed under subparagraph (A) at a rate not to exceed the maximum rate for
				employees in grade GS–15 of the General Schedule under section 5332 of title 5,
				United States Code, except that up to 4 employees (in addition to the Executive
				Director under section 5(f)(2)) may be paid at a rate determined by the Board
				in accordance with section 5383 of that
				title.</text>
						</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
			</paragraph><paragraph id="ID281bedcae58d47c3886a5a3af4753f5c"><enum>(2)</enum><text>in paragraph (6),
			 by striking <quote>and</quote> at the end;</text>
			</paragraph><paragraph id="ID2de201a1cd0d421ea46a466c392c6755"><enum>(3)</enum><text>by redesignating
			 paragraph (7) as paragraph (8); and</text>
			</paragraph><paragraph id="ID105eb9b3bf094330863b671da8683854"><enum>(4)</enum><text>by inserting
			 after paragraph (6) the following:</text>

			</paragraph></section><section id="ID4b2654d1d63b48aabc8cfea9fe555f79"><enum>11.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">Section 13
			 of the Morris K. Udall and Stewart L. Udall Foundation Act (20 U.S.C. 5609) is
			 amended—</text>
			<paragraph id="ID56f7ec358d6e43a68d9c5a5f57cf3554"><enum>(1)</enum><text>in subsection
			 (a), by striking <quote>is authorized to be appropriated to the Trust Fund
			 $40,000,000</quote> and inserting <quote>are authorized to be appropriated to
			 the Trust Fund such sums as are necessary</quote>; and</text>
			</paragraph><paragraph id="IDd6931ed699f74d698c390c18bd40bb85"><enum>(2)</enum><text>by striking
			 subsection (b) and inserting the following:</text>
				<quoted-block display-inline="no-display-inline" id="idB56C50E331E54EFBB116F00A903E83E5" style="OLC">
					<subsection id="IDd52bc61554314c3f81a1ddace90940fd"><enum>(b)</enum><header>Environmental

				to the Environmental Dispute Resolution Fund established under section 10(a)
				such sums as are necessary for the operating costs of the
				Institute.</text>
