			<paragraph id="id6E86426AC7AA4F4681CC9F50F74D4721"><enum>(1)</enum><text>the safety of the
			 food supply of the United States is vital to—</text>
				<subparagraph id="id6F80F8EEF1DC4537B884730671CF2809"><enum>(A)</enum><text>the health of the
			 citizens of the United States;</text>
				</subparagraph><subparagraph id="id67EA92324E5D4AF298E583F2E0088D8A"><enum>(B)</enum><text>the preservation
			 of the confidence of those citizens in the food supply of the United States;
			 and</text>
				</subparagraph><subparagraph id="idAA64A623E09E4FEBA4A6FF062A7DE1CB"><enum>(C)</enum><text>the success of
			 the food sector of the United States economy;</text>
				</subparagraph></paragraph><paragraph id="idABD93ADA553D4945B72EA899BDAC4A6D"><enum>(2)</enum><text>the United States
			 has the safest food supply in the world, and maintaining a secure domestic food
			 supply is imperative for the national security of the United States;</text>
			</paragraph><paragraph id="idD3F1BA95C3484B4F8DAACC34F33FBC8E"><enum>(3)</enum><text>in a report
			 published by the Government Accountability Office in January 2007, the
			 Comptroller General of the United States described food safety oversight as 1
			 of the 29 high-risk program areas of the Federal Government; and</text>
			</paragraph><paragraph id="id6F4D289A3B6E4CA183988A5218F18A38"><enum>(4)</enum><text>the task of
			 preserving the safety of the food supply of the United States is complicated by
			 pressures relating to—</text>
				<subparagraph id="idAEAC69DE9344497E808BBE4BD54D1399"><enum>(A)</enum><text>food products
			 that are smuggled or imported into the United States without being screened,
			 monitored, or inspected as required by law; and</text>
				</subparagraph><subparagraph id="idBA6018DDF65C433B96A289A565B8D2ED"><enum>(B)</enum><text>the need to
			 improve the enforcement of the United States in reducing the quantity of food
			 products that are—</text>
					<clause id="id8E9E12722DBA498DA8193A3E93CE9719"><enum>(i)</enum><text>smuggled into the
			 United States; and</text>
					</clause><clause id="id1BF34BEF100C4F29A22B602DDEF6C26C"><enum>(ii)</enum><text>imported into
			 the United States without being screened, monitored, or inspected as required
			 by law.</text>
					</clause></subparagraph></paragraph></section><section id="id8FD5EDE323FF42E8B4EA0270D8BF6691"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id9808C6CA60F0488C8393401A638E4123"><enum>(1)</enum><header>Administration</header><text>The
			 term <term>Administration</term> means the Food and Drug Administration.</text>
			</paragraph><paragraph id="id5290DDB7AC9B4B1897BA8AA918A875D2"><enum>(2)</enum><header>Administrator</header><text>The
			 term <term>Administrator</term> means the Administrator of the Animal and Plant
			 Health Inspection Service.</text>
			</paragraph><paragraph id="idAC744F2CCD244CBA923341BD9842482C"><enum>(3)</enum><header>Department</header><text>The
			 term <term>Department</term> means the Department of Agriculture.</text>
			</paragraph><paragraph id="ID0eca2530469a48ebbbb29f401e941972"><enum>(4)</enum><header>Food defense
			 threat</header><text>The term <term>food defense threat</term> means any
			 intentional contamination, including any disease, pest, or poisonous agent,
			 that could adversely affect the safety of human or animal food products.</text>
			</paragraph><paragraph id="id0D94275AC5144C9D9E6F39415C45B15B"><enum>(5)</enum><header>Smuggled food
			 product</header><text>The term <quote>smuggled food product</quote> means a
			 prohibited human or animal food product that a person fraudulently brings into
			 the United States.</text>
			</paragraph><paragraph id="idC547D32AB81540C49F04D68B40B363A8"><enum>(6)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Agriculture.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="idE5604147AC07493FA1C1C0DB6E8883E1"><enum>4.</enum><header>Food safety
			 training, personnel, and coordination</header>
			<subsection commented="no" display-inline="no-display-inline" id="id8297F0EE05714327B884D1542253AD14"><enum>(a)</enum><header>Department</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id4F8F455B8667435C87D2E431A90BCF5A"><enum>(1)</enum><header>Training
			 programs</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id4BFF6BF7D0DD44AF87BEB6C41E284814"><enum>(A)</enum><header>Agricultural
			 specialists</header>
						<clause commented="no" display-inline="no-display-inline" id="id3D355F61247744ABB54CD9BEE9EBB9A4"><enum>(i)</enum><header>Establishment</header><text>The
			 Secretary shall establish training programs to educate each Federal employee
			 who is employed in a position described in section 421(g) of the Homeland
			 Security Act of 2002 (6 U.S.C. 231(g)) on issues relating to food safety and
			 agroterrorism.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idF34935304C1F4966AA27069D56AC836E"><enum>(ii)</enum><header>Authorization
			 of appropriations</header><text>There is authorized to be appropriated to carry
			 out this subparagraph $1,700,000.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id214C97B2FCDA4BA8ADFC51FE475B8916"><enum>(B)</enum><header>Cross-training
			 of employees of United States Customs and Border Protection</header>
						<clause commented="no" display-inline="no-display-inline" id="id1D734AF02F2E48E9AE9B91131AD8EEB6"><enum>(i)</enum><header>Establishment</header><text>The
			 Secretary shall establish training programs to educate border patrol agents
			 employed by the United States Customs and Border Protection of the Department
			 of Homeland Security about identifying human, animal, and plant health threats
			 and referring the threats to the appropriate agencies.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id0441B110044543A5AECADEFB33AF3657"><enum>(ii)</enum><header>Authorization
			 of appropriations</header><text>There is authorized to be appropriated to carry
			 out this subparagraph $4,800,000.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBD34509E04FF441BABEBBED43A7607C8"><enum>(2)</enum><header>Illegal import
			 detection personnel</header><text>Subtitle G of the Department of Agriculture
			 Reorganization Act of 1994 (7 U.S.C. 6981 et seq.) is amended by adding at the
			 end the following:</text>

						<section commented="no" display-inline="no-display-inline" id="id45A97FD401E14569A269F5A3CC3BF084"><enum>263.</enum><header>Food safety
				personnel and training</header>
							<subsection commented="no" display-inline="no-display-inline" id="id6FEE28DCC98F4830BF9064970F859E69"><enum>(a)</enum><header>Additional
				employees</header><text display-inline="yes-display-inline">Not later than 2
				years after the date of enactment of the <short-title>Ending Agricultural Threats: Safeguarding America's Food
				for Everyone (EAT SAFE) Act of 2009</short-title>, the Secretary shall hire a
				sufficient number of employees to increase the number of full-time field
				investigators, import surveillance officers, support staff, analysts, and
				compliance and enforcement experts employed by the Food Safety and Inspection
				Service as of October 1, 2007, by 100 employees, in order to—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id30C718B42D5C47B2B191B56B9AD1016C"><enum>(1)</enum><text display-inline="yes-display-inline">provide additional detection of food
				defense threats;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id89517196408A4993A977C87DF53995EE"><enum>(2)</enum><text display-inline="yes-display-inline">detect, track, and remove smuggled human
				food products from commerce; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE8CCE0CBBD164FC2883F62817C321FAC"><enum>(3)</enum><text display-inline="yes-display-inline">impose penalties on persons or
				organizations that threaten the food supply.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id60F40524BE214E8AA0EFF7797A56C730"><enum>(b)</enum><header>Authorization
				of appropriations</header><text>There is authorized to be appropriated to carry
				out this section
				$10,000,000.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id341C6D2711C3473285B7A3357955336C"><enum>(b)</enum><header>Administration</header><text>Chapter
			 IV of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 341 et seq.) is
			 amended by adding at the end the following:</text>

					<section commented="no" display-inline="no-display-inline" id="id5F14C09DEDED46FCBE41BB8E035E7CFC"><enum>418.</enum><header>Food safety
				personnel and training</header>
						<subsection commented="no" display-inline="no-display-inline" id="idAF287541A5204470A87C8A9E708D0D83"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Not later than 2
				years after the date of enactment of the <short-title>Ending Agricultural Threats: Safeguarding America's Food
				for Everyone (EAT SAFE) Act of 2009</short-title>, the Secretary shall hire a
				sufficient number of employees to increase the number of full-time field
				investigators, import surveillance officers, support staff, analysts, and
				compliance and enforcement experts employed by the Food and Drug Administration
				as of October 1, 2007, by 150 employees, in order to—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id89FC44390007465180D5FFCF5A052E31"><enum>(1)</enum><text display-inline="yes-display-inline">provide additional detection of food
				defense threats;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id907454195804443FA1BA67ABD357DC01"><enum>(2)</enum><text display-inline="yes-display-inline">detect, track, and remove smuggled food
				products from commerce; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4831953F83354B7384B3181C9EE29C0C"><enum>(3)</enum><text display-inline="yes-display-inline">impose penalties on persons or
				organizations that threaten the food supply.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5154E2ED708F41938E7841328C9C8667"><enum>(b)</enum><header>Authorization
				of appropriations</header><text display-inline="yes-display-inline">There is
				authorized to be appropriated to carry out this section
				$15,000,000.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id64238D6B93A64EA4A6A9EA5DB9CCE697"><enum>(c)</enum><header>Coordination of
			 Federal agencies</header><text>Section 411(b) of the Homeland Security Act of
			 2002 (6 U.S.C. 211(b)) is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idEAAE290FEE594121B7EB6A19DAA3E5E0" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="id78E9B34AAABE44299E1FE409133E85B4"><enum>(4)</enum><header>Coordination of
				Federal agencies</header><text>The Commissioner of United States Customs and
				Border Protection, in coordination with the Secretary of Agriculture and the
				Commissioner of Food and Drugs, shall conduct activities to target, track, and
				inspect shipments that—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="idD3AED25020E2422190CE3D19C78E714C"><enum>(A)</enum><text>contain human and
				animal food products; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9DABDF1CC3584E299E0836D4E34F1AA4"><enum>(B)</enum><text>are imported into
				the United
				States.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id03BB84D81B724EFBA4710707D2810D5D"><enum>5.</enum><header>Reporting of
			 smuggled food products</header>
			<subsection commented="no" display-inline="no-display-inline" id="id01D2A0E3FA6F4DCA87DC8CAD1D695EF6"><enum>(a)</enum><header>Department</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id1C3A6D16732E4839BC07C1B670987AA0"><enum>(1)</enum><header>Public
			 notification</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="idEB1601EA8B9B4D619CA63ADC3D28D95A"><enum>(A)</enum><header>In
			 general</header><text>Not later than 3 days after the date on which the
			 Department identifies a smuggled food product, the Secretary shall provide to
			 the public notification describing the food product identified by the
			 Department and, if available, the individual or entity that smuggled the food
			 product.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB55CBF5638FE493DB45898BEDF85421B"><enum>(B)</enum><header>Required forms
			 of notification</header><text>The Secretary shall provide public notification
			 under subparagraph (A) through—</text>
						<clause commented="no" display-inline="no-display-inline" id="id562B35400FE64213B3AD96ABF75DE760"><enum>(i)</enum><text>a news release of
			 the Department for each smuggled food product identified by the
			 Department;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idDB4E8342DC9A4D72901BCBB6AA88F2AC"><enum>(ii)</enum><text>a description of
			 each smuggled food product on the website of the Department;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id71FFFB3523424D738CF2DCD270934439"><enum>(iii)</enum><text>the management
			 of a periodically updated list that contains a description of each individual
			 or entity that smuggled the food product identified by the Secretary under
			 subparagraph (A); and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idA48802F385D540A3B0235B10D79DD26C"><enum>(iv)</enum><text>any other
			 appropriate means, as determined by the Secretary.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8ACC68FAAC744D65B2EE2E880B7CC94C"><enum>(2)</enum><header>Notification to
			 Department of Homeland Security</header><text>Not later than 30 days after the
			 date on which the Department identifies a smuggled food product, the Secretary
			 shall provide to the Department of Homeland Security notification of the
			 smuggled food product.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idDBE28AE343F94D4CB2356B3A76033411"><enum>(b)</enum><header>Administration</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id2A210440DE5E4CF7B78D07F1D0834EDB"><enum>(1)</enum><header>Public
			 notification</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="idE11BFBDC7DE8419D8B887A8A45D137FC"><enum>(A)</enum><header>In
			 general</header><text>Not later than 3 days after the date on which the
			 Administration identifies a smuggled food product, the Secretary of Health and
			 Human Services shall provide to the public notification describing the smuggled
			 food product identified by the Administration and, if available, the individual
			 or entity that smuggled the food product.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id31A75453B9064A7499143484B6B4F051"><enum>(B)</enum><header>Required forms
			 of notification</header><text>The Secretary of Health and Human Services shall
			 provide public notification under subparagraph (A) through—</text>
						<clause commented="no" display-inline="no-display-inline" id="id1C93550D556F4DB4BA0F633996EEB4DD"><enum>(i)</enum><text>a press release
			 of the Administration for each smuggled food product identified by the
			 Administration;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id5F792FCEAC1242268D99078C2CA8551D"><enum>(ii)</enum><text>a description of
			 each smuggled food product on the website of the Administration;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id03DF27DA737A4FB6B8E560E44F4C69EF"><enum>(iii)</enum><text>the management
			 of a periodically updated list that contains a description of each individual
			 or entity that smuggled the food product identified by the Secretary of Health
			 and Human Services under subparagraph (A); and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id04FFEE3BA02B4A1DB90225F6AD220C36"><enum>(iv)</enum><text>any other
			 appropriate means, as determined by the Secretary of Health and Human
			 Services.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id339327002E034B37812AD30345852A31"><enum>(2)</enum><header>Notification to
			 Department of Homeland Security</header><text>Not later than 30 days after the
			 date on which the Administration identifies a smuggled food product, the
			 Secretary of Health and Human Services shall provide to the Department of
			 Homeland Security notification of the smuggled food product.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id9D684D37B45342E38F97367118428272"><enum>6.</enum><header>Civil penalties
			 relating to illegally imported meat and poultry products</header>
			<subsection commented="no" display-inline="no-display-inline" id="idD2691A17E35C43D0AB91A310FFA6D8E0"><enum>(a)</enum><header>Meat
			 products</header><text>Section 20(b) of the Federal Meat Inspection Act (21
			 U.S.C. 620(b)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="idBB4E83E4EA8D4A36B52870B1AE64A72D"><enum>(1)</enum><text>by striking
			 <quote>(b) The Secretary</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idA1C11EAF6D174C65923E61C6044571E5" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="idE509D9FD79D14D0495E0AB8F19C54E9C"><enum>(b)</enum><header>Destruction;
				civil penalties</header>

				Secretary</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id480DB195B22E44BABB9C191C963B862C"><enum>(2)</enum><text>by adding at the
			 end the following:</text>

						<paragraph commented="no" display-inline="no-display-inline" id="id5F67DB2324A6496B9A2143FEEB881699"><enum>(2)</enum><header>Civil
				penalties</header><text>Each individual or entity that fails to present each
				meat article that is the subject of the importation of the individual or entity
				to an inspection facility approved by the Secretary shall be liable for a civil
				penalty assessed by the Secretary in an amount not to exceed $25,000 for each
				meat article that the individual or entity fails to present to the inspection
				facility.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id973DDC448A2C4F43915AC03537EA8262"><enum>(b)</enum><header>Poultry
			 products</header><text>Section 12 of the Poultry Products Inspection Act (21
			 U.S.C. 461) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id6798D4B6A15D4B5DB4FDB23E03615599"><enum>(1)</enum><text>by striking the
			 section heading and all that follows through <quote>(a) Any person</quote> and
			 inserting the following:</text>

			 food safety labs; submission of test results</header>
			<subsection id="id10626D4420BD45B9BDB69A5B6F6FCC0E"><enum>(a)</enum><header>In
			 general</header><text>Chapter IV of the Federal Food, Drug, and Cosmetic Act
			 (21 U.S.C. 341 et seq.), as amended by section 4(b), is amended by adding at
			 the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idB904CAECA4F9452FB4DFF8995237B572" style="OLC">
					<section id="id58C2AE6D17544F3EB85F06DE804E711B"><enum>419.</enum><header>Certification
				of food safety labs; submission of test results</header>
						<subsection id="idE543C91D2C4A4F5082FDAAC3F7ECFF63"><enum>(a)</enum><header>Definition of
				food safety lab</header><text>In this section, the term <term>food safety
				lab</term> means an establishment that conducts testing, on behalf of an
				importer through a contract or other arrangement, to ensure the safety of
				articles of food.</text>
						</subsection><subsection id="id9C2CF941358442AC822BB50B838389FC"><enum>(b)</enum><header>Certification
				requirement</header>
							<paragraph id="idC434C1E669B646C4B343A8B195A88106"><enum>(1)</enum><header>In
				general</header><text>A food safety lab shall submit to the Secretary an
				application for certification. Upon review, the Secretary may grant or deny
				certification to the food safety lab.</text>
							</paragraph><paragraph id="idD960250C603C407B8C33083B220FEEC6"><enum>(2)</enum><header>Certification
				standards</header><text>The Secretary shall establish criteria and
				methodologies for the evaluation of applications for certification submitted
				under paragraph (1). Such criteria shall include the requirements that a food
				safety lab—</text>
								<subparagraph id="idA243F3F904744259AACDE81998D66EA9"><enum>(A)</enum><text>be accredited as
				being in compliance with standards set by the International Organization for
				Standardization;</text>
								</subparagraph><subparagraph id="id684EF6E6D3204F93BA0FB589EA840D05"><enum>(B)</enum><text>agree to permit
				the Secretary to conduct an inspection of the facilities of the food safety lab
				and the procedures of such lab before making a certification
				determination;</text>
								</subparagraph><subparagraph id="id32659DE465A7468A8B18D84B3A8AF442"><enum>(C)</enum><text>agree to permit
				the Secretary to conduct routine audits of the facilities of the food safety
				lab to ensure ongoing compliance with accreditation and certification
				requirements;</text>
								</subparagraph><subparagraph id="idC1E5E496668B430CA4E03ED7BB505784"><enum>(D)</enum><text>submit with such
				application a fee established by the Secretary in an amount sufficient to cover
				the cost of application review, including inspection under subparagraph (B);
				and</text>
								</subparagraph><subparagraph id="id7F518CE75C5B4C2689AA62C31D394772"><enum>(E)</enum><text>agree to submit
				to the Secretary, in accordance with the process established under subsection
				(c), the results of tests conducted by such food safety lab on behalf of an
				importer.</text>
								</subparagraph></paragraph></subsection><subsection id="idB3F00CDCD41145249FE406B2341B0C0D"><enum>(c)</enum><header>Submission of
				test results</header><text>The Secretary shall establish a process by which a
				food safety lab certified under this section shall submit to the Secretary the
				results of all tests conducted by such food safety lab on behalf of an
				importer.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="idE4B1C141BD8642CEAC75FF179D81FB3E"><enum>(b)</enum><header>Enforcement</header><text>Section
			 303(f) of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 333(f)) is
			 amended—</text>
				<paragraph id="ID7ff8a00475b14477bcb5a076c4c29322"><enum>(1)</enum><text>by redesignating
			 paragraphs (5), (6), and (7) as paragraphs (7), (8), and (9),
			 respectively;</text>
				</paragraph><paragraph id="IDf4f35553312a4c4897bb8b64a17c7434"><enum>(2)</enum><text>by inserting
			 after paragraph (4) the following:</text>
					<quoted-block display-inline="no-display-inline" id="idD822DF806DC84500A7CB1E73ACE45AA2" style="OLC">
						<paragraph commented="no" id="IDbeca4d71eea14812b85709fb50e12317" indent="up1"><enum>(5)</enum><text>An importer (as such term is used in
				section 419) shall be subject to a civil penalty in an amount not to exceed
				$25,000 if such importer knowingly engages in the falsification of test results
				submitted to the Secretary by a food safety lab certified under section
				419.</text>
						</paragraph><paragraph commented="no" id="id7F6E9C6394FD40AB90D91C2A35AE4189" indent="up1"><enum>(6)</enum><text>A food safety lab certified under
				section 419 shall be subject to a civil penalty in an amount not to exceed
				$25,000 for knowingly submitting to the Secretary false test results under
				section
				419.</text>
						</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID3e6713b2454f4c0aada5f6eb9252d96e"><enum>(3)</enum><text>in paragraph
			 (2)(C), by striking <quote>paragraph (5)(A)</quote> and inserting
			 <quote>paragraph (7)(A)</quote>;</text>

				</paragraph></subsection></section><section id="idD2801D3E9CCB4929A47F1D988A84FDFA"><enum>8.</enum><header>Data
			 sharing</header>
			<subsection id="idF813CC5283994535880CC3CBB98BE65A"><enum>(a)</enum><header>Department of
			 Agriculture memoranda of understanding</header><text display-inline="yes-display-inline">The Secretary shall ensure that the
			 agencies within the Department of Agriculture, including the Food Safety and
			 Inspection Service, the Agricultural Research Service, and the Animal and Plant
			 Health Inspection Service, enter into a memorandum of understanding to ensure
			 the timely and efficient sharing of all information collected by such agencies
			 related to foodborne pathogens, contaminants, and illnesses.</text>
			</subsection><subsection id="idD28FB39F354D4881A2A501C742C5E6FB"><enum>(b)</enum><header>Interagency
			 memorandum of understanding</header><text>The Secretary, in collaboration with
			 the Secretary of Health and Human Services, shall enter into a memorandum of
			 understanding between the agencies within the Department of Agriculture,
			 including those described in subsection (a), and the agencies within the
			 Department of Health and Human Services, including the Centers for Disease
			 Control and Prevention and the Food and Drug Administration, to ensure the
			 timely and efficient sharing of all information collected by such agencies
			 related to foodborne pathogens, contaminants, and illnesses.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="idA5B3A7174A8F4EFE9E5B34D3EB19AFAC"><enum>9.</enum><header>Public notice
			 regarding recalled food products</header>
			<subsection commented="no" display-inline="no-display-inline" id="id008D02DE873B4CB8883CBB2B7EDA0BE3"><enum>(a)</enum><header>Department</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idEA6B33E959B9440F993E74EE751DFBAB"><enum>(1)</enum><header>News releases
			 regarding recalled food products</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id6DABE623D91B41E4860413013C45C8A1"><enum>(A)</enum><header>In
			 general</header><text>On the date on which a human or animal food product
			 regulated by the Department is voluntarily recalled, the Secretary shall
			 provide to the public a news release describing the human or animal food
			 product.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id88146B3DA358487ABFACE9EA0E9C5B64"><enum>(B)</enum><header>Contents</header><text>Each
			 news release described in subparagraph (A) shall contain a comprehensive list
			 of each human and animal food product regulated by the Department that is
			 voluntarily recalled.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id71A8FF4628444E089291E7153E35C4D6"><enum>(2)</enum><header>Website</header><text>The
			 Secretary shall modify the website of the Department to contain—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id3BFABD926BFA480AAC17AD069CB2B610"><enum>(A)</enum><text>not later than 1
			 business day after the date on which a human or animal food product regulated
			 by the Department is voluntarily recalled, a news release describing the human
			 or animal food product;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id10FA38C4E2D84FA28F7BC8260F5E3293"><enum>(B)</enum><text>if available, an
			 image of each human and animal food product that is the subject of a news
			 release described in subparagraph (A); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1B23525DCE044D7B89972F1511BA37A6"><enum>(C)</enum><text>not later than 90
			 days after the date of enactment of this Act, a search engine that—</text>
						<clause commented="no" display-inline="no-display-inline" id="id93E62F39228B46C388E38A8FA5FCEFBA"><enum>(i)</enum><text>is
			 consumer-friendly, as determined by the Secretary; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id3825363F866A4BA7A5B42E2FBEC2C6F1"><enum>(ii)</enum><text>provides a means
			 by which an individual could locate each human and animal food product
			 regulated by the Department that is voluntarily recalled.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idECD1A4C1F53E41ABAC8F4F56A5769C4D"><enum>(3)</enum><header>State-issued
			 and industry press releases</header><text>To meet the requirement under
			 paragraph (1)(A), the Secretary—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id721362E9CEA64D2BAD09590AEEAFCA72"><enum>(A)</enum><text>may provide to
			 the public a press release issued by a State; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB34B1C5DBA17416CABE32FB88DA4E87C"><enum>(B)</enum><text>shall not provide
			 to the public a press release issued by a private industry entity in lieu of a
			 press release issued by the Federal Government or a State.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1D25A093571E4CCC915262164A79F126"><enum>(4)</enum><header>Prohibition on
			 delegation of duty</header><text>The Secretary may not delegate, by contract or
			 otherwise, the duty of the Secretary—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idAE98396726614020891553699603A872"><enum>(A)</enum><text>to provide to the
			 public a news release under paragraph (1); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id20BDDB3F087A4719B24540201239EAB4"><enum>(B)</enum><text>to make any
			 required modification to the website of the Department under paragraph
			 (2).</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id11A233901DA648ABB81C71C5257BD5DF"><enum>(b)</enum><header>Administration</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id9BF1092710E64BC1BCB8035A47A14FF9"><enum>(1)</enum><header>Press releases
			 regarding recalled food products</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id392F23D3C3E6448690B190AA5023C155"><enum>(A)</enum><header>In
			 general</header><text>On the date on which a human or animal food product
			 regulated by the Administration is voluntarily recalled, the Secretary of
			 Health and Human Services shall provide to the public a press release
			 describing the human or animal food product.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id28B6329A416E4C92A0BFA15DCA28B86A"><enum>(B)</enum><header>Contents</header><text>Each
			 press release described in subparagraph (A) shall contain a comprehensive list
			 of each human and animal food product regulated by the Administration that is
			 voluntarily recalled.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id53295048873C4ECC96B8C68BC5999077"><enum>(2)</enum><header>Website</header><text>The
			 Secretary of Health and Human Services shall modify the website of the
			 Administration to contain—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idBA65F9431FFA4F71B444B8C667AED38A"><enum>(A)</enum><text>not later than 1
			 business day after the date on which a human or animal food product regulated
			 by the Administration is voluntarily recalled a press release describing the
			 human or animal food product;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id3E7AECFE4B4946CA8B4D9A5DD22E5994"><enum>(B)</enum><text>if available, an
			 image of each human and animal food product that is the subject of a press
			 release described in subparagraph (A); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCA85ECAFF6374D9591AC93FA2441AEE6"><enum>(C)</enum><text>not later than 90
			 days after the date of enactment of this Act, a search engine that—</text>
						<clause commented="no" display-inline="no-display-inline" id="idBAFDCC5495B3467AB143265B4B597CF4"><enum>(i)</enum><text>is
			 consumer-friendly, as determined by the Secretary of Health and Human Services;
			 and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idA1CA0B6DE2314CDC96D57B77FCBE0486"><enum>(ii)</enum><text>provides a means
			 by which an individual could locate each human and animal food product
			 regulated by the Administration that is voluntarily recalled.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id80C780B180FE42F8B0AFD1A53E82130F"><enum>(3)</enum><header>State-issued
			 and industry press releases</header><text>For purposes of meeting the
			 requirement under paragraph (1)(A), the Secretary of Health and Human
			 Services—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id6BB6DC6EA36E4CF6BD82B954D4C1BFE4"><enum>(A)</enum><text>may provide to
			 the public a press release issued by a State; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD079CE7AF899495D94FD79659B23297D"><enum>(B)</enum><text>may not provide
			 to the public a press release issued by a private industry entity in lieu of a
			 press release issued by a State or the Federal Government.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFDEDB86CB7B740AD8F8F63BA1E08F087"><enum>(4)</enum><header>Prohibition on

			 illness education and outreach competitive grants program</header><text display-inline="no-display-inline">Title IV of the Agricultural Research,
			 Extension, and Education Reform Act of 1998 is amended by adding after section
			 412 (7 U.S.C. 7632) the following:</text>

				<section commented="no" display-inline="no-display-inline" id="id6B03F0069EA4434F93660A8802FD655C"><enum>413.</enum><header>Foodborne
				illness education and outreach competitive grants program</header>
					<subsection commented="no" display-inline="no-display-inline" id="idAA1F5B241B5F4BA7960E28F7C9474CB5"><enum>(a)</enum><header>Definitions</header><text>In
				this section:</text>
						<paragraph commented="no" display-inline="no-display-inline" id="idFC8B421CC88A4491B2F87A2D5ADBB117"><enum>(1)</enum><header>Administrator</header><text>The
				term <term>Administrator</term> means the Administrator of the Food Safety and
				Inspection Service.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1F509AE920C64335845E0AB931662E60"><enum>(2)</enum><header>Commissioner</header><text>The
				term <term>Commissioner</term> means the Commissioner of Food and Drugs.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0839BEC1385D49ACB627D9799E083CB3"><enum>(3)</enum><header>Eligible
				entity</header><text>The term <term>eligible entity</term> means—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idA73A4ECDBA7B43C9B1236C37F6DE55D9"><enum>(A)</enum><text>the government of
				a State (including a political subdivision of a State);</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFAB92D44C3234CAFAB2B7964282B8F71"><enum>(B)</enum><text>an educational
				institution;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0E29593318A048158F5496F3E7ECD13C"><enum>(C)</enum><text>a private
				for-profit organization;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9745ACFFB15D40909C7D02E2067003B3"><enum>(D)</enum><text>a private
				non-profit organization; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5BAEDBF9335F48D4BB01A926B9AC91C4"><enum>(E)</enum><text>any other
				appropriate individual or entity, as determined by the Secretary.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE291F2ECF6814397ACCC3B98F2627BCF"><enum>(b)</enum><header>Establishment</header><text>The
				Secretary (acting through the Administrator of the Cooperative State Research,
				Education, and Extension Service), in consultation with the Administrator and
				the Commissioner, shall establish and administer a competitive grant program to
				provide grants to eligible entities to enable the eligible entities to carry
				out educational outreach partnerships and programs to provide to health
				providers, patients, and consumers information to enable those individuals and
				entities—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="id8B84459BE7E54461A10280F53E401A78"><enum>(1)</enum><text>to
				recognize—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="id9515EE0BE0D240DEABF7DE73B7DAE7B7"><enum>(A)</enum><text>foodborne illness
				as a serious public health issue; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0E1D6BAF156F4870B4734CED98E37C20"><enum>(B)</enum><text>each symptom of
				foodborne illness to ensure the proper treatment of foodborne illness;</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idABCAB25CF5B042FBBD614A37AF119870"><enum>(2)</enum><text>to
				understand—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idA6ADADB51E14443BBD89DFC91DFAD8A3"><enum>(A)</enum><text>the potential for
				contamination of human and animal food products during each phase of the
				production of human and animal food products; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC6E2D59AD5284394AFA0229DD13EEE24"><enum>(B)</enum><text>the importance of
				using techniques that help ensure the safe handling of human and animal food
				products; and</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id092FB8377C6B48708E957310C4DFF5E1"><enum>(3)</enum><text>to assess the
				risk of foodborne illness to ensure the proper selection by consumers of human
				and animal food products.</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id67EDFDC07FCB454FA9CD4CE1C8D1377D"><enum>(c)</enum><header>Authorization
				of appropriations</header><text>There is authorized to be appropriated to carry
