		  cultural resources, to facilitate the efficient extraction of mineral resources

		<section changed="deleted" committee-id="SSEG00" id="S1" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Southeast Arizona Land Exchange and
			 Conservation Act of 2009</short-title></quote>.</text>
		</section><section changed="deleted" committee-id="SSEG00" id="idF1A5E520B7B7412989383158C4ECA8C1" reported-display-style="strikethrough"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are—</text>
			<paragraph id="IDa094ede36baf48069c8bfe3a19fa5172"><enum>(1)</enum><text>to authorize,
			 direct, facilitate, and expedite the conveyance and exchange of land between
			 the United States and Resolution Copper;</text>
			</paragraph><paragraph id="IDf9a4fbcc5f7342de9f22b09c0376a1cc"><enum>(2)</enum><text>to provide for the
			 permanent protection of cultural resources and uses of the Apache Leap
			 escarpment located near the town of Superior, Arizona; and</text>
			</paragraph><paragraph id="id66F24542572049AB91E3AECFFDCFA5DB"><enum>(3)</enum><text>to secure Federal
			 ownership and protection of land with significant natural, scenic,
			 recreational, water, riparian, cultural and other resources.</text>
			</paragraph></section><section changed="deleted" committee-id="SSEG00" id="ID5636b21713394dd0a0444596501e3de8" reported-display-style="strikethrough"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID9cf6150c7ee34fbb9dc4809427e4c74f"><enum>(1)</enum><header>Apache
			 Leap</header><text>The term <term>Apache Leap</term> means the approximately
			 822 acres of land (including the approximately 110 acres of land of Resolution
			 Copper described in section 4(c)(1)(G)), as depicted on the map entitled
			 <quote>Apache Leap</quote> and dated January 2009.</text>
			</paragraph><paragraph id="IDa431894747cd47e8a6442705555c2a4f"><enum>(2)</enum><header>Federal
			 land</header><text>The term <term>Federal land</term> means the approximately
			 2,406 acres of land located in Pinal County, Arizona, depicted on the map
			 entitled <quote>Southeast Arizona Land Exchange and Conservation Act of
			 2009–Federal Parcel–Oak Flat</quote> and dated January 2009.</text>
			</paragraph><paragraph id="IDb6e22298d0e243ad9a4a0874147b2337"><enum>(3)</enum><header>Non-Federal
			 land</header><text>The term <term>non-Federal land</term> means each parcel of
			 land described in section 4(c).</text>
			</paragraph><paragraph id="ID7920a5e65c7d483fa40a37697e4eec40"><enum>(4)</enum><header>Oak Flat
			 Campground</header><text>The term <term>Oak Flat Campground</term> means the
			 campground that is—</text>
				<subparagraph id="id6FE63E97255D4B18ABFD0B6152E1B8F1"><enum>(A)</enum><text>comprised of
			 approximately 16 developed campsites and adjacent acreage at a total of
			 approximately 50 acres; and</text>
				</subparagraph><subparagraph id="id590DD99CCA844F39BDB981B4A23ECE0B"><enum>(B)</enum><text>depicted on the
			 map entitled <quote>Oak Flat Campground</quote> and dated January 2009.</text>
				</subparagraph></paragraph><paragraph id="ID309253dba13748868f8fc5610b6f0eee"><enum>(5)</enum><header>Oak Flat
			 Withdrawal Area</header><text>The term <term>Oak Flat Withdrawal Area</term>
			 means the approximately 760 acres of land depicted on the map entitled
			 <quote>Oak Flat Withdrawal Area</quote> and dated January 2009.</text>
			</paragraph><paragraph id="ID77cebc00c4c64b32be5ea9380c397ca0"><enum>(6)</enum><header>Resolution
			 Copper</header><text>The term <term>Resolution Copper</term> means—</text>
				<subparagraph id="IDa6a7b1f8264a4bca8a1663165152e08c"><enum>(A)</enum><text>Resolution Copper
			 Mining, LLC, a Delaware limited liability company; and</text>
				</subparagraph><subparagraph id="IDe6dac97be7bd411fb382765eecf1240e"><enum>(B)</enum><text>any successor,
			 assign, affiliate, member, or joint venturer of Resolution Copper Mining,
			 LLC.</text>
				</subparagraph></paragraph><paragraph id="id08C41B6774624F94B60D381D86AEE778"><enum>(7)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Agriculture.</text>
			</paragraph><paragraph id="IDd50395e6f7284c86b483a2a75216bcc5"><enum>(8)</enum><header>Secretary
			 concerned</header><text>The term <term>Secretary concerned</term> means the
			 Secretary of Agriculture or the Secretary of the Interior, as
			 applicable.</text>
			</paragraph><paragraph id="ID044aa8628771443cacd3da86c3f72088"><enum>(9)</enum><header>Town</header><text>The
			 term <term>Town</term> means the Town of Superior, Arizona, an incorporated
			 municipality.</text>
			</paragraph></section><section changed="deleted" committee-id="SSEG00" id="IDb6ee63272b264f22929d6fc94ca4864e" reported-display-style="strikethrough"><enum>4.</enum><header>Land conveyances
			 and exchanges</header>
			<subsection id="IDaa334feaa86c44dcacc26766beec4f39"><enum>(a)</enum><header>Purposes</header><text>The
			 purposes of the land conveyances and exchanges under this section are—</text>
				<paragraph id="id8CD6CFF10A3E48AA9F23220953237E9C"><enum>(1)</enum><text>to secure Federal
			 ownership and protection of significant natural, scenic, and recreational
			 resources; and</text>
				</paragraph><paragraph id="idDB55E057977B4AFBA28CD41AC7ACF0C4"><enum>(2)</enum><text>to facilitate
			 efficient extraction of mineral resources.</text>
				</paragraph></subsection><subsection id="idEEF0A51DC2254185BA75F255FE861CE7"><enum>(b)</enum><header>Offer by
			 Resolution Copper</header>
				<paragraph id="idA4609F3389C44201A3914629F1C2F921"><enum>(1)</enum><header>In
			 general</header><text>Subject to section 9(b)(1), if Resolution Copper submits
			 to the Secretary of Agriculture a written offer, in accordance with paragraph
			 (2), to convey to the United States all right, title, and interest of
			 Resolution Copper in and to the non-Federal land, the Secretary shall—</text>
					<subparagraph id="id4D8CBC29C13A4ED7A992030AA8B5ECE1"><enum>(A)</enum><text>accept the offer;
			 and</text>
					</subparagraph><subparagraph id="id0DC009B5F21547E0B0566C3250A3F00A"><enum>(B)</enum><text>convey to
			 Resolution Copper all right, title, and interest of the United States in and to
			 the Federal land, subject to—</text>
						<clause id="id7261CD11333745CEBD69F0C9739F8905"><enum>(i)</enum><text>section 10(c);
			 and</text>
						</clause><clause id="idA6E41AC61B1E46CBA3960C8A2803E06A"><enum>(ii)</enum><text>any valid
			 existing right or title reservation, easement, or other exception required by
			 law or agreed to by the Secretary concerned and Resolution Copper.</text>
						</clause></subparagraph></paragraph><paragraph id="id08093F1F2CC64CE0A291768558E05E50"><enum>(2)</enum><header>Requirements</header><text>Title
			 to any non-Federal land conveyed by Resolution Copper to the United States
			 under paragraph (1) shall—</text>
					<subparagraph id="id19779B62FCFE4B2EA3A484762FCBA893"><enum>(A)</enum><text>be in a form that
			 is acceptable to the Secretary concerned; and</text>
					</subparagraph><subparagraph id="id0C0F8AA6C4794FB1953FC7B1E0A1A777"><enum>(B)</enum><text>conform to the
			 title approval standards of the Attorney General of the United States
			 applicable to land acquisitions by the Federal Government.</text>
					</subparagraph></paragraph></subsection><subsection id="IDe8139d2bc5bb4623920ee852ba54eb6b"><enum>(c)</enum><header>Resolution
			 Copper land exchange</header><text>On receipt of title to the Federal land
			 under subsection (b)(1)(B), Resolution Copper shall simultaneously
			 convey—</text>
				<paragraph id="ID321c277fcad7427a959004dc93eaa43a"><enum>(1)</enum><text>to the Secretary
			 of Agriculture, all right, title, and interest that the Secretary determines to
			 be acceptable in and to—</text>
					<subparagraph id="ID0a8e0f4b4553492b88326b4403ffc48d"><enum>(A)</enum><text>the approximately
			 147 acres of land located in Gila County, Arizona, depicted on the map entitled
			 <quote>Southeast Arizona Land Exchange and Conservation Act of 2009–Non-Federal
			 Parcel–Turkey Creek</quote> and dated January 2009;</text>
					</subparagraph><subparagraph id="ID1fce7dca52f844d283487c532b6c1b5f"><enum>(B)</enum><text>the approximately
			 148 acres of land located in Yavapai County Arizona, depicted on the map
			 entitled <quote>Southeast Arizona Land Exchange and Conservation Act of
			 2009–Non-Federal Parcel–Tangle Creek</quote> and dated January 2009;</text>
					</subparagraph><subparagraph id="ID19ffa22921e4460bb1f4cc404f5093d8"><enum>(C)</enum><text>the approximately
			 149 acres of land located in Maricopa County, Arizona, depicted on the map
			 entitled <quote>Southeast Arizona Land Exchange and Conservation Act of
			 2009–Non-Federal Parcel–Cave Creek</quote> and dated January 2009;</text>
					</subparagraph><subparagraph id="ID71e33d19217f4b24b2dfacd6751e9f43"><enum>(D)</enum><text>the approximately
			 88 acres of land located in Pinal County, Arizona, depicted on the map entitled
			 <quote>Southeast Arizona Land Exchange and Conservation Act of 2009–Non-Federal
			 Parcel–J-I Ranch</quote> and dated January 2009;</text>
					</subparagraph><subparagraph id="ID37e45a09321740cfa894b36a3041f5ac"><enum>(E)</enum><text>the approximately
			 640 acres of land located in Coconino County, Arizona, depicted on the map
			 entitled <quote>Southeast Arizona Land Exchange and Conservation Act of
			 2009–Non-Federal Parcel–East Clear Creek</quote> and dated January 2009;</text>
					</subparagraph><subparagraph id="ID284a3fdd56a04111b79b02b888ae57cf"><enum>(F)</enum><text>the approximately
			 95 acres of land located in Pinal County, Arizona, depicted on the map entitled
			 <quote>Southeast Arizona Land Exchange and Conservation Act of 2009–Non-Federal
			 Parcel–The Pond</quote> and dated January 2009; and</text>
					</subparagraph><subparagraph id="ID00cd519071ed497fb6ace3b68a75110f"><enum>(G)</enum><text>subject to the
			 retained rights under subsection (d)(2), the approximately 110 acres of land
			 located in Pinal County, Arizona, depicted on the map entitled <quote>Southeast
			 Arizona Land Exchange and Conservation Act of 2009–Non-Federal Parcel–Apache
			 Leap South End</quote> and dated January 2009; and</text>
					</subparagraph></paragraph><paragraph id="ID567ce6e1f98b4e67ab73c9ed700058dc"><enum>(2)</enum><text>to the Secretary
			 of the Interior, all right, title, and interest that the Secretary of the
			 Interior determines to be acceptable in and to—</text>
					<subparagraph id="IDeda0e839aca44a0db56700b7af75fb3e"><enum>(A)</enum><text>the approximately
			 3,073 acres of land located in Pinal County, Arizona, depicted on the map
			 entitled <quote>Southeast Arizona Land Exchange and Conservation Act of
			 2009–Non-Federal Parcel–Lower San Pedro River</quote> and dated January
			 2009;</text>
					</subparagraph><subparagraph id="IDd951cf11a6bc48d49baee36854e8a53d"><enum>(B)</enum><text>the approximately
			 160 acres of land located in Gila and Pinal Counties, Arizona, depicted on the
			 map entitled <quote>Southeast Arizona Land Exchange and Conservation Act of
			 2009–Non-Federal Parcel–Dripping Springs</quote> and dated January 2009;
			 and</text>
					</subparagraph><subparagraph id="ID5ebba674dc9740d58c66330f87671f8f"><enum>(C)</enum><text>the approximately
			 956 acres of land located in Santa Cruz County, Arizona, depicted on the map
			 entitled <quote>Southeast Arizona Land Exchange and Conservation Act of
			 2009–Non-Federal Parcel–Appleton Ranch</quote> and dated January 2009.</text>
					</subparagraph></paragraph></subsection><subsection id="IDc95b9020d99c4845959bbfc54c642491"><enum>(d)</enum><header>Additional
			 consideration to United States</header>
				<paragraph id="IDfef1fe9194c34ba79ea9d12eadd8a557"><enum>(1)</enum><header>Surrender of
			 rights</header><text>Subject to paragraph (2), in addition to the non-Federal
			 land to be conveyed to the United States under subsection (c), and as a
			 condition of the land exchange under this section, Resolution Copper shall
			 surrender to the United States, without compensation, the rights held by
			 Resolution Copper under mining and other laws of the United States—</text>
					<subparagraph id="ID802a4c4b1b3b407993f5233e269b8cb9"><enum>(A)</enum><text>to commercially
			 extract minerals under—</text>
						<clause id="idC3D6A9584D914838A4D53C9069BE3A51"><enum>(i)</enum><text>Apache Leap;
			 or</text>
						</clause><clause id="idF72AAD2F6708481DAAF72A87C6AD5078"><enum>(ii)</enum><text>the parcel
			 identified in subsection (c)(1)(F); and</text>
						</clause></subparagraph><subparagraph id="ID3dee12df9ed44cccbaab1da5ebbd45ff"><enum>(B)</enum><text>to disturb the
			 surface of Apache Leap, except with respect to such fences, signs, monitoring
			 wells, and other devices, instruments, or improvements as are necessary to
			 monitor the public health and safety or achieve other appropriate
			 administrative purposes, as determined by the Secretary, in consultation with
			 Resolution Copper.</text>
					</subparagraph></paragraph><paragraph id="IDecbdfece5bfa44cf8b194666e8e41217"><enum>(2)</enum><header>Exploration
			 activities</header><text>Nothing in this Act prohibits Resolution Copper from
			 using any existing mining claim held by Resolution Copper on Apache Leap, or
			 from retaining any right held by Resolution Copper to the parcel described in
			 subsection (c)(1)(G), to carry out any underground activities under Apache Leap
			 in a manner that the Secretary determines will not adversely impact the surface
			 of Apache Leap (including drilling or locating any tunnels, shafts, or other
			 facilities relating to mining, monitoring, or collecting geological or
			 hydrological information) that do not involve commercial mineral extraction
			 under Apache Leap.</text>
				</paragraph></subsection><subsection id="ID5bb03f95faeb4a8f8af86793f7ec71cc"><enum>(e)</enum><header>Use of
			 equalization payment</header>
				<paragraph id="IDeffd6a3a496f4e1b8b22eed089e440fa"><enum>(1)</enum><header>Payment</header><text>Resolution
			 Copper shall pay into the Federal Land Disposal Account established by section
			 206(a) of the Federal Land Transaction Facilitation Act (43 U.S.C. 2305(a)) (or
			 any successor account) any cash equalization funds owed by Resolution Copper to
			 the United States under section 7(b)(1), to remain available until expended,
			 without further appropriation, to the Secretary and the Secretary of the
			 Interior, as the Secretaries jointly determine to be appropriate, for—</text>
					<subparagraph id="ID37b70b8a66d84c74b7342e6dcc7986ab"><enum>(A)</enum><text>the acquisition
			 from willing sellers of land or interests in land within the hydrographic
			 boundary of the San Pedro River and tributaries in the State of Arizona;
			 and</text>
					</subparagraph><subparagraph id="IDff8e095561a8454f8f6b07bd324d14f1"><enum>(B)</enum><text>the management and
			 protection of endangered species and other sensitive environmental values and
			 land within the San Pedro Riparian National Conservation Area established by
			 section 101(a) of the Arizona-Idaho Conservation Act of 1988 (16 U.S.C.
			 460xx(a)) (including any additions to the area), including management under any
			 cooperative management agreement entered into by the Secretary of the Interior
			 and a State or local agency under section 103(c) of that Act (16 U.S.C.
			 460xx–2(c)).</text>
					</subparagraph></paragraph><paragraph id="IDfe0b369b34b24409977e08e2ff0b3b32"><enum>(2)</enum><header>Period of
			 use</header><text>To the maximum extent feasible, the amount paid into the
			 Federal Land Disposal Account by Resolution Copper under paragraph (1) shall be
			 used by the Secretary and the Secretary of the Interior during the 2-year
			 period beginning on the date of payment.</text>
				</paragraph><paragraph id="idB2C17AF6F6C4487AA5554352E51C50FC"><enum>(3)</enum><header>Cooperative
			 management agreements</header><text>The Secretary of the Interior may enter
			 into such cooperative management agreements with qualified organizations (as
			 defined in section 170(h) of the Internal Revenue Code of 1986) as the
			 Secretary of the Interior determines to be appropriate to administer portions
			 of the San Pedro Riparian National Conservation Area.</text>
				</paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="ID11e3e0b6f0704d57aadf94e0c22cc989" reported-display-style="strikethrough"><enum>5.</enum><header>Timing and
			 processing of exchange</header>
			<subsection id="ID55f1f812eee24a25867851c2c92aa5c6"><enum>(a)</enum><header>Sense of
			 Congress regarding timing of exchange</header><text>It is the sense of Congress
			 that the land exchange directed by section 4 should be consummated by not later
			 than 1 year after the date of enactment of this Act.</text>
			</subsection><subsection id="ID9806d98f08e74a0797335e007bac8c05"><enum>(b)</enum><header>Exchange
			 processing</header><text>Before the date of consummation of the exchange under
			 section 4, the Secretary concerned shall complete any necessary land surveys
			 and required preexchange clearances, reviews, mitigation activities, and
			 approvals relating to—</text>
				<paragraph id="id24A4FF24CEF3442BB65F4B981FC74BF9"><enum>(1)</enum><text>threatened or
			 endangered species;</text>
				</paragraph><paragraph id="idD03CCC31AE8D471CA848A343D272925C"><enum>(2)</enum><text>cultural or
			 historic resources;</text>
				</paragraph><paragraph id="idF30A57B8084140BEB478C49C0B1E7A07"><enum>(3)</enum><text>wetland or
			 floodplains; or</text>
				</paragraph><paragraph id="id3EAF32ABF4844DEDAF3630E7947D3706"><enum>(4)</enum><text>hazardous
			 materials.</text>
				</paragraph></subsection><subsection id="ID1d3cab8661074011a46179cfbcd95dc7"><enum>(c)</enum><header>Post-exchange
			 processing</header><text>Before commencing production in commercial quantities
			 of any valuable mineral from the Federal land conveyed to Resolution Copper
			 under section 4(b)(1)(B) (except for any such production from any exploration
			 and mine development shafts, adits, and tunnels needed to determine feasibility
			 and pilot plant testing of commercial production or to access the ore body and
			 tailings deposition areas), the Secretary shall publish an environmental impact
			 statement in accordance with section 102(2)(C) of the National Environmental
			 Policy Act of 1969 (42 U.S.C. 4322(2)(C)) regarding any Federal agency action
			 carried out relating to the commercial production, including an analysis of the
			 impacts of the production.</text>
			</subsection><subsection id="ID2b0b01317e3a4174afba33bdd9f97e7d"><enum>(d)</enum><header>Oak Flat
			 Withdrawal Area restriction</header>
				<paragraph id="ID4b0bd5a233ab468e983820b22594b1d0"><enum>(1)</enum><header>Mineral
			 exploration</header><text>To ensure the collection and consideration of
			 adequate information to analyze possible commercial production of minerals by
			 Resolution Copper from the Oak Flat Withdrawal Area, notwithstanding any other
			 provision of law, Resolution Copper may carry out mineral exploration
			 activities under the Oak Flat Withdrawal Area during the period beginning on
			 the date of enactment of this Act and ending on the date of conveyance of the
			 Oak Flat Withdrawal Area to Resolution Copper under section 4(b)(1)(B) by
			 directional drilling or any other method that will not disturb the surface of
			 the land.</text>
				</paragraph><paragraph id="IDf1df0e12825342b58eb8bdf9057a78dc"><enum>(2)</enum><header>Sense of
			 Congress regarding permit</header><text>It is the sense of Congress that the
			 Secretary should issue to Resolution Copper a permit to conduct appropriate
			 directional drilling or other nonsurface-disturbing exploration in the Oak Flat
			 Withdrawal Area as soon as practicable after the date of enactment of this
			 Act.</text>
				</paragraph></subsection><subsection id="ID46c41921a9f24bb1be8f1f6838256aab"><enum>(e)</enum><header>Exchange and
			 post-exchange costs</header><text>In accordance with sections 254.4 and 254.7
			 of title 36, Code of Federal Regulations (or successor regulations), Resolution
			 Copper shall assume responsibility for—</text>
				<paragraph id="ID6382a38dfc0b42dab7b8de2eccb7a5aa"><enum>(1)</enum><text>hiring such
			 contractors as are necessary for carrying out any exchange or conveyance of
			 land under this Act; and</text>
				</paragraph><paragraph id="ID4ddd8a232085407e873ff2b37bdfe5d5"><enum>(2)</enum><text>paying, without
			 compensation under section 254.7 of title 36, Code of Federal Regulations (or a
			 successor regulation)—</text>
					<subparagraph id="ID97c71f9fcd2f4088aed2707ba0b7b9cc"><enum>(A)</enum><text>the costs of any
			 appraisal relating to an exchange or conveyance under this Act, including any
			 reasonable reimbursements to the Secretary on request of the Secretary for the
			 cost of reviewing and approving an appraisal;</text>
					</subparagraph><subparagraph id="IDc99540fd3a3048c6b9ff6ad87874e60a"><enum>(B)</enum><text>the costs of any
			 clearances, reviews, mitigation activities, and approvals under subsection (b),
			 including any necessary land surveys conducted by the Bureau of Land Management
			 Cadastral Survey program;</text>
					</subparagraph><subparagraph id="ID078f9a167a214648a2698ac4585ffc75"><enum>(C)</enum><text>the costs of
			 achieving compliance with the National Environmental Policy Act of 1969 (42
			 U.S.C. 4321 et seq.) under subsection (c); and</text>
					</subparagraph><subparagraph id="ID7ee520cc64e9405d937a9423a0554142"><enum>(D)</enum><text>any other cost
			 agreed to by Resolution Copper and the Secretary concerned.</text>
					</subparagraph></paragraph></subsection><subsection id="ID470510e599a94f6c97abb631f4652c8b"><enum>(f)</enum><header>Contractor work
			 and approvals</header>
				<paragraph id="ID8869ad8ee6414f7a8e0bb12741420c08"><enum>(1)</enum><header>In
			 general</header><text>Any work relating to the exchange or conveyance of land
			 under this Act that is performed by a contractor shall be subject to the mutual
			 agreement of the Secretary concerned and Resolution Copper, including any
			 agreement with respect to—</text>
					<subparagraph id="ID8424e51484f446b0a4318ff8af3d09e1"><enum>(A)</enum><text>the selection of
			 the contractor; and</text>
					</subparagraph><subparagraph id="ID4cdd504c4e8744178ab503d2a1818611"><enum>(B)</enum><text>the scope of work
			 performed by the contractor.</text>
					</subparagraph></paragraph><paragraph id="IDf37d34b2860f43b18a0380822ac436e1"><enum>(2)</enum><header>Review and
			 approval</header><text>Any required review and approval of work by a contractor
			 shall be performed by the Secretary concerned, in accordance with applicable
			 law (including regulations).</text>
				</paragraph><paragraph id="ID28c138ac5d3c4dd997fde4d275667893"><enum>(3)</enum><header>Lead actor
			 agreement</header><text>The Secretary of Agriculture and the Secretary of the
			 Interior may mutually agree to designate the Secretary of Agriculture as the
			 lead actor for any action under this subsection.</text>
				</paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="IDe4d19cac0a8549dc99361bfda77102b3" reported-display-style="strikethrough"><enum>6.</enum><header>Conveyance of
			 land to Town</header>
			<subsection id="ID47aa4fd7b5d1435c9ebede7fe995efc9"><enum>(a)</enum><header>Conveyance
			 requirements</header>
				<paragraph id="id84E3874EE896496793EB3EE02C2F16EB"><enum>(1)</enum><header>In
			 general</header><text>On receipt of a request from the Town described in
			 paragraph (2), the Secretary shall convey to the Town each parcel
			 requested.</text>
				</paragraph><paragraph id="id1EFA6ECEE7AC4AE683B54FE18BEC5A20"><enum>(2)</enum><header>Description of
			 request</header><text>A request referred to in paragraph (1) is a request by
			 the Town—</text>
					<subparagraph id="id909564A843EB4A378A0172246A808936"><enum>(A)</enum><text>for the conveyance
			 of 1 or more of the parcels identified in subsection (b); and</text>
					</subparagraph><subparagraph id="id4A4C23FDCB0F44659D0B32AE7280FA4C"><enum>(B)</enum><text>that is submitted
			 to the Secretary by not later than 90 days after the date of consummation of
			 the land exchange under section 4.</text>
					</subparagraph></paragraph><paragraph id="id3F3997EDAFF44E809B264B03080476A3"><enum>(3)</enum><header>Price</header><text>The
			 Town shall pay to the Secretary a price equal to the market value of any land
			 conveyed under this subsection, as appraised under section 7, less the amount
			 of any credit under section 7(b)(3).</text>
				</paragraph></subsection><subsection id="ID31045d2bc2f84d7498f1e490700a45c4"><enum>(b)</enum><header>Identification
			 of parcels</header><text>The Town may request conveyance of any of—</text>
				<paragraph id="IDe4d0586821494a7fbc71ffe2424e3aab"><enum>(1)</enum><text>the approximately
			 30 acres of land located in Pinal County, Arizona, occupied on the date of
			 enactment of this Act by the Fairview Cemetery and depicted on the map entitled
			 <quote>Southeast Arizona Land Exchange and Conservation Act of 2009–Federal
			 Parcel–Fairview Cemetery</quote> and dated January 2009;</text>
				</paragraph><paragraph id="ID7ac89b9dfc674b619cd331ba9a53ab16"><enum>(2)</enum><text>the reversionary
			 interest, and any reserved mineral interest, of the United States in the
			 approximately 265 acres of land located in Pinal County, Arizona, depicted on
			 the map entitled <quote>Southeast Arizona Land Exchange and Conservation Act of
			 2009–Federal Reversionary Interest–Superior Airport</quote> and dated January
			 2009; and</text>
				</paragraph><paragraph id="ID62c69e7fa52447b7bb80b3e204c141e9"><enum>(3)</enum><text>all or any portion
			 of the approximately 250 acres of land located in Pinal County, Arizona,
			 depicted on the map entitled <quote>Southeast Arizona Land Exchange and
			 Conservation Act of 2009–Federal Parcel–Superior Airport Contiguous
			 Parcels</quote> and dated January 2009.</text>
				</paragraph></subsection><subsection id="ID58f9c806d0cd4c61a716623358ae42e6"><enum>(c)</enum><header>Condition of
			 conveyance</header><text>A conveyance of land under this section shall be
			 carried out in a manner that provides the United States manageable boundaries
			 on any parcel retained by the Secretary, to the maximum extent
			 practicable.</text>
			</subsection></section><section changed="deleted" committee-id="SSEG00" id="ID3dfc7049bb314bd89c77f2b725ba7da8" reported-display-style="strikethrough"><enum>7.</enum><header>Valuation of land
			 exchanged or conveyed</header>
			<subsection id="ID2633bc714a0d4c32a66392f8a4654216"><enum>(a)</enum><header>Exchange
			 valuation</header>
				<paragraph id="IDf2a7129f080d4057bfb84da3cc52458f"><enum>(1)</enum><header>In
			 general</header><text>The value of the land to be exchanged under section 4 or
			 conveyed to the Town under section 6 shall be determined by the Secretary
			 through concurrent appraisals conducted in accordance with paragraph
			 (2).</text>
				</paragraph><paragraph id="ID6ff33ed7725248f6b34fc5025a52b7d5"><enum>(2)</enum><header>Appraisals</header>
					<subparagraph id="ID0b8bbe5bcf814948bd5606b928d34fce"><enum>(A)</enum><header>In
			 general</header><text>An appraisal under this section shall be—</text>
						<clause id="ID636a3e5e0689497cb479c34bc8719ab4"><enum>(i)</enum><text>performed by an
			 appraiser mutually agreed to by the Secretary and Resolution Copper;</text>
						</clause><clause id="IDda263cf150fa46aa8eba8d893f2e59f8"><enum>(ii)</enum><text>performed in
			 accordance with—</text>
							<subclause id="ID9427f7a3e902425398b188d6eb2cc114"><enum>(I)</enum><text>the Uniform
			 Appraisal Standards for Federal Land Acquisitions (Department of Justice, 5th
			 Edition, December 20, 2000);</text>
							</subclause><subclause id="ID116d57b251d145c29de58bfe66b9f023"><enum>(II)</enum><text>the Uniform
			 Standards of Professional Appraisal Practice; and</text>
							</subclause><subclause id="ID7b14fd21a88c477e9c392d0b7e3cc44f"><enum>(III)</enum><text>Forest Service
			 appraisal instructions; and</text>
							</subclause></clause><clause id="ID1a1e3b514e1a4a5e9c5dc0718d0b573b"><enum>(iii)</enum><text>submitted to the
			 Secretary for review and approval.</text>
						</clause></subparagraph><subparagraph id="ID0f4e9c46423740c28b227018b6793a81"><enum>(B)</enum><header>Reappraisals and
			 updated appraised values</header><text>After the final appraised value of a
			 parcel is determined and approved under subparagraph (A), the Secretary shall
			 not be required to reappraise or update the final appraised value—</text>
						<clause id="ID870276ab4ee740d4a9cbb69063e162b5"><enum>(i)</enum><text>for a period of 3
			 years after the approval by the Secretary of the final appraised value under
			 subparagraph (A)(iii); or</text>
						</clause><clause id="ID838234ad56db4faaae256ff7c085b1c1"><enum>(ii)</enum><text>at all, in
			 accordance with section 254.14 of title 36, Code of Federal Regulations (or a
			 successor regulation), after an exchange agreement is entered into by
			 Resolution Copper and the Secretary.</text>
						</clause></subparagraph><subparagraph id="ID720a32ce2774414c8ddba8dbb379dd8c"><enum>(C)</enum><header>Public
			 review</header><text>Before consummating the land exchange under section 4, the
			 Secretary shall make available for public review a summary of the appraisals of
			 the land to be exchanged.</text>
					</subparagraph></paragraph><paragraph id="IDaf58c324e9594cc2b51fcdca75263866"><enum>(3)</enum><header>Failure to
			 agree</header><text>If the Secretary and Resolution Copper fail to agree on the
			 value of a parcel to be exchanged, the final value of the parcel shall be
			 determined in accordance with section 206(d) of the Federal Land Policy and
			 Management Act of 1976 (43 U.S.C. 1716(d)).</text>
				</paragraph><paragraph id="ID1373a6f1faf1409ebef3f1650dcf2349"><enum>(4)</enum><header>Federal land
			 appraisal</header>
					<subparagraph id="idE3A6B3D4D4A74A38BD705247556D7B65"><enum>(A)</enum><header>In
			 general</header><text>The Federal land shall be appraised in accordance with
			 the standards and instructions referred to in paragraph (2)(A)(ii) and other
			 applicable requirements of this section.</text>
					</subparagraph><subparagraph id="ID6dbb2a40449843e38644201a7f3c35df"><enum>(B)</enum><header>Treatment as
			 unencumbered</header><text>The value of the Federal land outside the Oak Flat
			 Withdrawal Area shall be determined as if the land is unencumbered by any
			 unpatented mining claims of Resolution Copper.</text>
					</subparagraph><subparagraph id="ID0595fef8e01941aeb2d8d62a4f572bfc"><enum>(C)</enum><header>Effect</header><text>Nothing
			 in this Act affects the validity of any unpatented mining claim or right of
			 Resolution Copper.</text>
					</subparagraph><subparagraph id="IDa323f5038fc54723acc4d679f3e6d3c9"><enum>(D)</enum><header>Additional
			 appraisal information</header><text>To provide information necessary to
			 calculate a value adjustment payment for purposes of section 12, the appraiser
			 under this paragraph shall include in the appraisal report a detailed royalty
			 income approach analysis, in accordance with the Uniform Appraisal Standards
			 for Federal Land Acquisition, of the market value of the Federal land, even if
			 the royalty income approach analysis is not the appraisal approach relied on by
			 the appraiser to determine the final market value of the Federal land.</text>
					</subparagraph></paragraph></subsection><subsection id="ID8f27aac2db4642059715e8a3f6654414"><enum>(b)</enum><header>Equalization of
			 value</header>
				<paragraph id="ID41f8e35132e247218bc15818e60ab37d"><enum>(1)</enum><header>Surplus of
			 Federal land value</header>
					<subparagraph id="ID38ad2fad186145c48314130a7a28f262"><enum>(A)</enum><header>In
			 general</header><text>If the final appraised value of the Federal land exceeds
			 the value of the non-Federal land involved in the exchange under section 4,
			 Resolution Copper shall make a cash equalization payment into the Federal Land
			 Disposal Account (as provided in subsection (e)) to equalize the values of the
			 Federal land and non-Federal land.</text>
					</subparagraph><subparagraph id="IDbcc302c9f91342fca8562972e948c481"><enum>(B)</enum><header>Amount of
			 payment</header><text>Notwithstanding section 206(b) of the Federal Land Policy
			 and Management Act of 1976 (43 U.S.C. 1716(b)), the United States may accept a
			 cash equalization payment under subparagraph (A) in an amount that is greater
			 than 25 percent of the value of the Federal land.</text>
					</subparagraph></paragraph><paragraph id="ID8500224f43ad4ef099c1c3e6666bba9e"><enum>(2)</enum><header>Surplus of
			 non-Federal land value</header><text>If the final appraised value of the
			 non-Federal land exceeds the value of the Federal land involved in the exchange
			 under section 4—</text>
					<subparagraph id="ID288f6393c39a4a1fb6ffcd16753eabb7"><enum>(A)</enum><text>the United States
			 shall not make a payment to Resolution Copper to equalize the values of the
			 land; and</text>
					</subparagraph><subparagraph id="ID15ac406404fd425d93f37c3f897c7941"><enum>(B)</enum><text>the surplus value
			 of the non-Federal land shall be considered to be a donation by Resolution
			 Copper to the United States.</text>
					</subparagraph></paragraph><paragraph id="IDec22bd637fc84e10a1dec981bc43c257"><enum>(3)</enum><header>Payment for land
			 conveyed to Town</header>
					<subparagraph id="IDf98f12c40f8e4dc99a92158ea7d5a694"><enum>(A)</enum><header>In
			 general</header><text>The Town shall pay the Secretary market value for any
			 land acquired by the Town from the Secretary under section 6, as determined by
			 the Secretary through an appraisal conducted in accordance with subsection
			 (a)(2).</text>
					</subparagraph><subparagraph id="IDf71c21be6a2a4f61a697faa79947fd2e"><enum>(B)</enum><header>Credit</header><text>If
			 the final appraised value of the non-Federal land exceeds the value of the
			 Federal land in the exchange under section 4, the obligation of the Town to pay
			 the United States under subparagraph (A) shall be reduced by an amount equal to
			 the excess value of the non-Federal land conveyed to the United States.</text>
					</subparagraph></paragraph><paragraph id="ID63e5bb0a9de749da953f8658bf350732"><enum>(4)</enum><header>Disposition and
			 use of proceeds</header>
					<subparagraph id="IDf53ae5c5bb7540b78a1e13e3c9bb9d23"><enum>(A)</enum><header>Cash
			 equalization payments</header><text>Any cash equalization payment under
			 paragraph (1)(A) shall be deposited, without further appropriation, in the
			 Federal Land Disposal Account for use in accordance with section 4(e).</text>
					</subparagraph><subparagraph id="ID0ff38e99726f4c22a2158928244cbe08"><enum>(B)</enum><header>Payment for land
			 conveyed to Town</header><text>Any payment received by the Secretary from the
			 Town under paragraph (3)(A) shall be—</text>
						<clause id="idD6861ED6B9FA4BC9A4E62116AF4073E0"><enum>(i)</enum><text>deposited in the
			 fund established under Public Law 90–171 (commonly known as the <quote>Sisk
			 Act</quote>) (16 U.S.C. 484a); and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idA796BF8C9E7843A4ADC292DC6278A934"><enum>(ii)</enum><text>made available to
			 the Secretary, without further appropriation, for the acquisition of land for
			 addition to the National Forest System in the State of Arizona.</text>
						</clause></subparagraph></paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="ID1f86020b695545f0a86ad88df2937ff9" reported-display-style="strikethrough"><enum>8.</enum><header>Apache Leap
			 protection and management</header>
			<subsection id="IDe7515caf61474e15b71aaba61ae2d0e7"><enum>(a)</enum><header>Apache Leap
			 protection and management</header>
				<paragraph id="IDacc0627db136425e945759db2c37e4b4"><enum>(1)</enum><header>In
			 general</header><text>To permanently protect the cultural, historic,
			 educational, and natural resource values of Apache Leap, effective beginning on
			 the date of enactment of this Act, the Secretary shall—</text>
					<subparagraph id="idD361F27F0BF84CC8AD17D366E21413DA"><enum>(A)</enum><text>manage Apache Leap
			 in accordance with the laws (including regulations) applicable to the National
			 Forest System; and</text>
					</subparagraph><subparagraph id="idA5C22F135C2748A9A085CD35622FE51F"><enum>(B)</enum><text>place special
			 emphasis on preserving the natural character of Apache Leap.</text>
					</subparagraph></paragraph><paragraph id="ID08684ad701df4edb827f71ad9fd27cd6"><enum>(2)</enum><header>Withdrawal</header><text>Subject
			 to the valid existing rights of Resolution Copper under section 4(d)(2),
			 effective beginning on the date of enactment of this Act, Apache Leap shall be
			 permanently withdrawn from all forms of entry and appropriation under—</text>
					<subparagraph id="ID40e7ea93995d42a599a1559e4569f5a2"><enum>(A)</enum><text>the public land
			 laws (including the mining and mineral leasing laws); and</text>
					</subparagraph><subparagraph id="ID582fb43c14a74f268f635c2d91d26ab9"><enum>(B)</enum><text>the Geothermal
			 Steam Act of 1970 (30 U.S.C. 1001 et seq.).</text>
					</subparagraph></paragraph></subsection><subsection id="IDebb00e608fc4446c96e7562e2b6a1c73"><enum>(b)</enum><header>Additional
			 protections, analysis, and plan</header>
				<paragraph id="IDe47a1c3a5d8d41e99109679e4611520d"><enum>(1)</enum><header>Management
			 plan</header><text>Not later than 4 years after the date of enactment of this
			 Act, the Secretary, in consultation with the Town, Resolution Copper, the
			 Yavapai and Apache Indian tribes, and other interested members of the public,
			 shall solicit public comment regarding, and initiate implementation of, a
			 management plan for Apache Leap.</text>
				</paragraph><paragraph id="IDa53fd59b37f5427c816a6b97fac88dbb"><enum>(2)</enum><header>Planning
			 considerations</header><text>The plan described in paragraph (1) shall examine,
			 among other matters, whether Apache Leap should be managed to establish—</text>
					<subparagraph id="ID2187964bd6ec472eb5585aa223860813"><enum>(A)</enum><text>additional
			 cultural and historical resource protections or measures, including permanent
			 or seasonal closures of any portion of Apache Leap to protect cultural or
			 archeological resources;</text>
					</subparagraph><subparagraph id="IDd518e06225454deaad16a29b4ddbea96"><enum>(B)</enum><text>additional or
			 alternative public access routes, trails, and trailheads to Apache Leap;
			 or</text>
					</subparagraph><subparagraph id="ID3445d7d047ab4975897e8249ae451b31"><enum>(C)</enum><text>additional
			 opportunities (including appropriate access) for rock climbing, with special
			 emphasis on improved rock climbing access to Apache Leap from the west.</text>
					</subparagraph></paragraph></subsection><subsection id="IDb601d690b56b47a3b2ae24f3fcc272a1"><enum>(c)</enum><header>Mining
			 activities</header><text>Nothing in this section imposes any restriction on any
			 exploration or mining activity carried out by Resolution Copper outside of
			 Apache Leap after the date of enactment of this Act.</text>
			</subsection></section><section changed="deleted" committee-id="SSEG00" id="IDb54ffe2092ab48848450c53ddb6be690" reported-display-style="strikethrough"><enum>9.</enum><header>Incorporation,
			 management, and status of acquired land</header>
			<subsection id="IDccb1518cf15e491784143fe9c16d44fb"><enum>(a)</enum><header>Land acquired by
			 Secretary</header>
				<paragraph id="IDca98166b670944b28c41343e529243fb"><enum>(1)</enum><header>In
			 general</header><text>Land acquired by the Secretary under this Act
			 shall—</text>
					<subparagraph id="ID8eaf2ab332a14f85959be055da210351"><enum>(A)</enum><text>become part of the
			 National Forest within which the land is located; and</text>
					</subparagraph><subparagraph id="ID88a5bfe43ecf411b879aeb403c2e70e3"><enum>(B)</enum><text>be administered in
			 accordance with the laws (including regulations) applicable to the National
			 Forest System.</text>
					</subparagraph></paragraph><paragraph id="ID585f805599534d8dafcb40c654794764"><enum>(2)</enum><header>Boundaries</header><text>For
			 purposes of section 7 of the Land and Water Conservation Fund Act of 1965 (16
			 U.S.C. 4601 et seq.), the boundaries of a National Forest in which land
			 acquired by the Secretary is located shall be deemed to be the boundaries of
			 that forest as in existence on January 1, 1965.</text>
				</paragraph><paragraph id="IDfcff18df4bc44d0295ae5242d23730a3"><enum>(3)</enum><header>Management of
			 J–I Ranch</header>
					<subparagraph id="IDb14bec8920e043afa92b99e3da7edac0"><enum>(A)</enum><header>In
			 general</header><text>On the date on which the Secretary acquires the J–I Ranch
			 parcel described in section 4(c)(1)(D), the Secretary shall manage the land to
			 allow Yavapai and Apache Indian tribes—</text>
						<clause id="IDde437dcbd1b44efab7d18445ad59504d"><enum>(i)</enum><text>to access the
			 land; and</text>
						</clause><clause id="ID7a67dd63add64b04a0b0bb45811a5016"><enum>(ii)</enum><text>to undertake
			 traditional activities relating to the gathering of acorns.</text>
						</clause></subparagraph><subparagraph id="ID8fdb50bd1aeb4233ab1ce924c6486879"><enum>(B)</enum><header>Authority of
			 Secretary</header><text>On receipt of a request from the Yavapai or Apache
			 Indian tribe, the Secretary may temporarily or seasonally close to the public
			 any portion of the J–I Ranch during the period in which the Yavapai or Apache
			 Indian tribe carries out any activity described in subparagraph (A)(ii).</text>
					</subparagraph></paragraph></subsection><subsection id="IDe58dcd9896f94abd9947eaba142d6eb1"><enum>(b)</enum><header>Rock
			 climbing</header>
				<paragraph id="ID9f23619b4b044b71b8c4c780886d295d"><enum>(1)</enum><header>In
			 general</header><text>Before consummating the land exchange under section 4,
			 Resolution Copper shall pay to the Secretary $1,250,000.</text>
				</paragraph><paragraph id="idBF1E85D7CC6043D7A442F0D973407123"><enum>(2)</enum><header>Use of
			 funds</header><text>The Secretary shall use the amount described in paragraph
			 (1), without further appropriation, to construct or improve road access,
			 turnouts, trails, camping, parking areas, or other facilities to promote and
			 enhance rock climbing, bouldering, and such other outdoor recreational
			 opportunities as the Secretary determines to be appropriate—</text>
					<subparagraph id="IDcd61c27d31a4435e85d361e55098fbea"><enum>(A)</enum><text>in the general
			 area north of Arizona State Highway 60 encompassing the parcel described in
			 section 4(c)(1)(F) and adjacent National Forest land to the north of that
			 parcel (commonly known as the <quote>upper Pond area</quote>); or</text>
					</subparagraph><subparagraph id="IDbe3e03bf79a64180bf1b203f2ce97b65"><enum>(B)</enum><text>in the areas
			 commonly known as <quote>Inconceivables</quote> and <quote>Chill Hill</quote>
			 located in or adjacent to secs. 26, 35, and 36, T. 2 S., R. 12 E., Gila and
			 Salt River Meridian.</text>
					</subparagraph></paragraph><paragraph id="IDc7a0897af25048b58e5b7cba0c786da1"><enum>(3)</enum><header>Timing</header><text>To
			 the maximum extent practicable, the Secretary shall use the amount described in
			 paragraph (1) during the 2-year period beginning on the date of consummation of
			 the land exchange under section 4.</text>
				</paragraph><paragraph id="IDe443f7a695794ef99ea1913aee76d406"><enum>(4)</enum><header>The Pond parcel
			 work</header>
					<subparagraph id="idFEC305FF47C745FEB7D74773C18300D6"><enum>(A)</enum><header>In
			 general</header><text>To improve rock climbing opportunities in the parcel
			 described in section 4(c)(1)(F) and the upper Pond area, Resolution Copper, in
			 consultation with the Secretary and rock climbing interests, may construct
			 roads or improve road access to, construct trails, camping, parking areas, or
			 other facilities on, or provide other access to, the Pond parcel described in
			 section 4(c)(1)(F) before the date of the conveyance under section 4(c).</text>
					</subparagraph><subparagraph id="IDedd51de7bc174847940d489628ea285d"><enum>(B)</enum><header>Costs</header><text>Resolution
			 Copper shall pay the cost of any activity carried out under subparagraph (A),
			 in addition to the amount specified in paragraph (1).</text>
					</subparagraph></paragraph></subsection><subsection id="ID16d00bd82fec4d59908cffadf3270f6e"><enum>(c)</enum><header>Land acquired by
			 Secretary of Interior</header>
				<paragraph id="IDf6eefc5172c248b4b9bdc9588efd63b7"><enum>(1)</enum><header>In
			 general</header><text>Land acquired by the Secretary of the Interior under this
			 Act shall—</text>
					<subparagraph id="ID109ece709f4449d29959b3571f4482af"><enum>(A)</enum><text>become part of the
			 Federal administrative area (including the Las Cienegas National Conservation
			 Area or other national conservation area, if applicable) within which the land
			 is located or to which the land is adjacent; and</text>
					</subparagraph><subparagraph id="IDf9a2321820d64f5399e88c440cbbff8b"><enum>(B)</enum><text>be managed in
			 accordance with the laws (including regulations) applicable to the Federal
			 administrative area or national conservation area within which the land is
			 located or to which the land is adjacent.</text>
					</subparagraph></paragraph><paragraph id="ID2e35891f179049b7acfa6becc8070201"><enum>(2)</enum><header>Lower San Pedro
			 River land</header><text>To preserve and enhance the natural character and
			 conservation value of the lower San Pedro River land described in section
			 4(c)(2)(A), on acquisition of the land by the Secretary of the Interior, the
			 land shall be automatically incorporated in, and administered as part of, the
			 San Pedro Riparian National Conservation Area.</text>
				</paragraph></subsection><subsection id="ID892110b525f34ca19170cf9eba5ed1db"><enum>(d)</enum><header>Withdrawal</header><text>On
			 acquisition by the United States of any land under this Act, subject to valid
			 existing rights and without further action by the Secretary concerned, the
			 acquired land is permanently withdrawn from all forms of entry and
			 appropriation under—</text>
				<paragraph id="IDe6098c739b4146d4a36192352c7deffb"><enum>(1)</enum><text>the public land
			 laws (including the mining and mineral leasing laws); and</text>
				</paragraph><paragraph id="IDf18d6e54baf64d1c995e848bb4c3e957"><enum>(2)</enum><text>the Geothermal
			 Steam Act of 1970 (30 U.S.C. 1001 et seq.).</text>
				</paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="ID5c74b8692c4a461ea5c6bb2c84a728da" reported-display-style="strikethrough"><enum>10.</enum><header>Oak Flat
			 Campground</header>
			<subsection id="IDb0aa1ece47794de5aeb93dd6913c7401"><enum>(a)</enum><header>Replacement
			 campgrounds</header>
				<paragraph id="ID488567c05c544aee8a741587b7686406"><enum>(1)</enum><header>In
			 general</header><text>Not later than 4 years after the date of enactment of
			 this Act, the Secretary, in consultation with Resolution Copper, the Town, and
			 other interested parties, shall design and construct in the Globe Ranger
			 District of the Tonto National Forest 1 or more replacement campgrounds for the
			 Oak Flat Campground (including appropriate access routes to any replacement
			 campgrounds).</text>
				</paragraph><paragraph id="ID9ecc873c5e954a13af7239c8b4f3ddfa"><enum>(2)</enum><header>Public
			 facilities</header><text>Any replacement campgrounds under this subsection
			 shall be designed and constructed in a manner that adequately (as determined in
			 the sole discretion of the Secretary) replaces, or improves on, the facilities,
			 functions, and amenities available to the public at the Oak Flat
			 Campground.</text>
				</paragraph></subsection><subsection id="IDe31f173647234d73917b5b4bb288a748"><enum>(b)</enum><header>Costs of
			 replacement</header><text>Resolution Copper shall pay the actual cost of
			 designing, constructing, and providing access to any replacement campgrounds
			 under this subsection, not to exceed $1,000,000.</text>
			</subsection><subsection id="ID074b7f0b43b2422f958f3736b2a9ffed"><enum>(c)</enum><header>Interim Oak Flat
			 Campground access</header><text>The document conveying the Federal land to
			 Resolution Copper under section 4(b) shall specify that—</text>
				<paragraph id="idB4F73D2934C7485B937FF2CB8CAF8527"><enum>(1)</enum><text>during the 4-year
			 period beginning on the date of enactment of this Act, the Secretary shall
			 retain title to, operate, and maintain the Oak Flat Campground; and</text>
				</paragraph><paragraph id="id1EDD0F88AA1B4EB7AE116E06F06192A7"><enum>(2)</enum><text>at the end of that
			 4-year period—</text>
					<subparagraph id="id8D305CDD0A2D426EBB89EBBB5CB1E4BA"><enum>(A)</enum><text>the withdrawal of
			 the Oak Flat Campground shall be revoked; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idD7DAB0405F7041879967B16B749CC1EA"><enum>(B)</enum><text>title to the Oak
			 Flat Campground shall be simultaneously conveyed to Resolution Copper.</text>
					</subparagraph></paragraph></subsection><subsection id="IDcfb26e8b4cc7436daab552adfe93a64e"><enum>(d)</enum><header>BoulderBlast
			 competition</header><text>During the 5-year period beginning on the date of
			 enactment of this Act, the Secretary, in consultation with Resolution Copper,
			 may issue not more than 1 special use permit per calendar year to provide
			 public access to the bouldering area on the Federal land for purposes of the
			 annual <quote>BoulderBlast</quote> competition.</text>
			</subsection></section><section changed="deleted" committee-id="SSEG00" id="ID69156f3cfa5d4fe9a3cea924e2152dda" reported-display-style="strikethrough"><enum>11.</enum><header>Traditional
			 acorn gathering and related activities in and around Oak Flat
			 Campground</header>
			<subsection id="IDe95444b6383c4f59a1357c04c9830d19"><enum>(a)</enum><header>Sense of
			 Congress regarding acorn gathering</header><text>In addition to the acorn
			 gathering opportunities described in section 9(a)(3)(A)(ii), it is the sense of
			 Congress that, on receipt of a request from the Apache or Yavapai Indian tribe
			 or any other Indian tribe during the 180-day period beginning on the date of
			 conveyance of the Federal land to Resolution Copper under section 4, Resolution
			 Copper should endeavor to negotiate and execute a revocable authorization to
			 each applicable Indian tribe to use an area in and around the Oak Flat
			 Campground for traditional acorn gathering and related activities.</text>
			</subsection><subsection id="IDc30007ed233f4790ad03dc83d8d49b8f"><enum>(b)</enum><header>Area and
			 terms</header><text>The precise area and terms of use described in subsection
			 (a)—</text>
				<paragraph id="idDF2094F741E34F83A328201A6F82190D"><enum>(1)</enum><text>shall be agreed to
			 by Resolution Copper and the applicable Indian tribes; and</text>
				</paragraph><paragraph id="id7754CC85D02F409880853B5134974DFD"><enum>(2)</enum><text>may be modified or
			 revoked by Resolution Copper if Resolution Copper, in consultation with the
			 Indian tribes, determines that all or a portion of the authorized use area
			 needs to be closed on a temporary or permanent basis—</text>
					<subparagraph id="ID8a8dd9b440bb4c2db3d9d8f2dadc6acc"><enum>(A)</enum><text>to protect the
			 health or safety of users; or</text>
					</subparagraph><subparagraph id="IDd369a0b8b0404cc4979c6216724a9e2d"><enum>(B)</enum><text>to accommodate an
			 exploration or mining plan of Resolution Copper.</text>
					</subparagraph></paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="ID6163427e148545b081115b2af78c33e9" reported-display-style="strikethrough"><enum>12.</enum><header>Value adjustment
			 payment to United States</header>
			<subsection id="ID2132fce434f944d480a23c530d28c178"><enum>(a)</enum><header>Annual
			 production reporting</header>
				<paragraph id="ID0da9371262314c3089328672f3857f92"><enum>(1)</enum><header>In
			 general</header><text>Beginning on February 15 of the first calendar year
			 beginning after the date of commencement of production of valuable locatable
			 minerals in commercial quantities (as defined by applicable Federal laws
			 (including regulations)) from the Federal land conveyed to Resolution Copper
			 under section 4(b), and annually thereafter, Resolution Copper shall file with
			 the Secretary of the Interior a report indicating the quantity of locatable
			 minerals in commercial quantities produced from the Federal land during the
			 preceding calendar year.</text>
				</paragraph><paragraph id="ID711974e01e31475f986d66a30859b528"><enum>(2)</enum><header>Report
			 contents</header><text>The reports under paragraph (1) shall comply with all
			 recordkeeping and reporting requirements of applicable Federal laws (including
			 regulations) in effect at the time of production relating to the production of
			 valuable locatable minerals in commercial quantities on any federally owned
			 land.</text>
				</paragraph></subsection><subsection id="ID5b9ee8bd77eb4cc9863a7749a8c06d96"><enum>(b)</enum><header>Payment on
			 production</header><text>If the cumulative production of valuable locatable
			 minerals in commercial quantities produced from the Federal land conveyed to
			 Resolution Copper under section 4(b) exceeds the quantity of production of
			 locatable minerals from the Federal land used in the royalty income approach
			 analysis under the Uniform Appraisal Standards for Federal Land Acquisitions
			 prepared under section 7(a)(4)(D), Resolution Copper shall pay to the United
			 States, by not later than March 15 of each applicable calendar year, a value
			 adjustment payment for the quantity of excess production at a rate equal
			 to—</text>
				<paragraph id="ID1240b41a85c04a169c51c88e8ee241bb"><enum>(1)</enum><text>the Federal
			 royalty rate in effect for the production of valuable locatable minerals from
			 federally owned land, if such a rate is enacted before December 31, 2012;
			 or</text>
				</paragraph><paragraph id="ID566a0389fd514abd8d416c613b65cc9a"><enum>(2)</enum><text>if no Federal
			 royalty rate is enacted by the date described in paragraph (1), the royalty
			 rate used for purposes of the royalty income approach analysis prepared under
			 section 7(a)(4)(D).</text>
				</paragraph></subsection><subsection id="ID98f191380ba541578064dde3bbdf6ea5"><enum>(c)</enum><header>State law
			 unaffected</header><text>Nothing in this Act modifies, expands, diminishes,
			 amends, or otherwise affects any State law (including regulations) relating to
			 the imposition, application, timing, or collection of a State excise or
			 severance tax under Arizona Revised Statutes 42–5201–5206.</text>
			</subsection><subsection id="IDcc87351aa534470eae25e1f36c43afc2"><enum>(d)</enum><header>Use of
			 funds</header><text>The funds paid to the United States under this section
			 shall—</text>
				<paragraph id="id313D1E75906E4F49983E4A5420138B7F"><enum>(1)</enum><text>be deposited in a
			 special account of the Treasury; and</text>
				</paragraph><paragraph id="id17C98CB226554BFDB0B662863AF02E80"><enum>(2)</enum><text>remain available,
			 without further appropriation, to the Secretary and the Secretary of the
			 Interior, as the Secretaries jointly determine to be appropriate, for the
			 acquisition of land or interests in land from willing sellers in the State of
			 Arizona.</text>
				</paragraph></subsection></section><section changed="deleted" committee-id="SSEG00" id="ID3c45a2eb78d34cbaa47ad955849419d3" reported-display-style="strikethrough"><enum>13.</enum><header>Miscellaneous
			 provisions</header>
			<subsection id="ID5078e7dbaef64d178b09480b1a167719"><enum>(a)</enum><header>Revocation of
			 orders; withdrawal</header>
				<paragraph id="ID2e870a1054f849a4ad6fec62444258e2"><enum>(1)</enum><header>Revocation of
			 orders</header><text>Any public land order that withdraws the Federal land from
			 appropriation or disposal under a public land law shall be revoked to the
			 extent necessary to permit disposal of the land.</text>
				</paragraph><paragraph id="ID5d016413027a44c5becc6d813e0203ad"><enum>(2)</enum><header>Withdrawal</header><text>On
			 the date of enactment of this Act, if the Federal land or any Federal interest
			 in the non-Federal land to be exchanged under section 4 is not withdrawn or
			 segregated from entry and appropriation under a public land law (including
			 mining and mineral leasing laws and the Geothermal Steam Act of l970 (30 U.S.C.
			 1001 et seq.)), the land or interest shall be withdrawn, without further action
			 required by the Secretary concerned, from entry and appropriation, subject to
			 the valid existing rights of Resolution Copper, until the date of the
			 conveyance of Federal land under section 4(b).</text>
				</paragraph></subsection><subsection id="ID39c5378260d94faca0512f0aa597f1be"><enum>(b)</enum><header>Maps, estimates,
			 and descriptions</header>
				<paragraph id="IDa9383fea48d24d9c888ee1486b63fe5b"><enum>(1)</enum><header>Minor
			 errors</header><text>The Secretary concerned and Resolution Copper, may
			 correct, by mutual agreement, any minor errors in any map, acreage estimate, or
			 description of any land conveyed or exchanged under this Act.</text>
				</paragraph><paragraph id="ID212fca709cf94f9588791cca1d2eb358"><enum>(2)</enum><header>Conflict</header><text>If
			 there is a conflict between a map, an acreage estimate, or a description of
			 land under this Act, the map shall control unless the Secretary concerned and
			 Resolution Copper mutually agree otherwise.</text>
				</paragraph><paragraph id="ID22460104cef04441a9374e75c8551344"><enum>(3)</enum><header>Availability</header><text>On
			 the date of enactment of this Act, the Secretary shall file and make available
			 for public inspection in the Office of the Supervisor, Tonto National Forest,
			 each map referred to in this Act.</text>
				</paragraph></subsection></section></legis-body>
	<legis-body display-enacting-clause="no-display-enacting-clause">
		<section changed="added" committee-id="SSEG00" id="id896DB0ECF27D4242BDF43201B00779A5" reported-display-style="italic" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Southeast Arizona Land Exchange and
			 Conservation Act of 2009</short-title></quote>.</text>
		</section><section changed="added" committee-id="SSEG00" id="IDa83f3bd3d4eb48d69deabf02d374eb80" reported-display-style="italic"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="IDa44efad7061e43e684f11092568eb0d5"><enum>(1)</enum><header>Apache
			 leap</header><text>The term <term>Apache Leap</term> means the approximately
			 822 acres of land depicted on the map entitled <quote>Apache Leap</quote> and
			 dated January 2009.</text>
			</paragraph><paragraph id="IDaee32da5205e45bc8ad1314212c56151"><enum>(2)</enum><header>Federal
			 land</header><text>The term <term>Federal land</term> means the approximately
			 2,406 acres of land located in Pinal County, Arizona, depicted on the map
			 entitled <quote>Southeast Arizona Land Exchange and Conservation Act of
			 2009–Federal Parcel–Oak Flat</quote> and dated January 2009.</text>
			</paragraph><paragraph id="ID85fc88b664504bc6a95a61d8674f0eae"><enum>(3)</enum><header>Indian
			 tribe</header><text>The term <term>Indian tribe</term> has the meaning given
			 the term in section 4 of the Indian Self-Determination and Education Assistance
			 Act (25 U.S.C. 450b).</text>
			</paragraph><paragraph id="IDb3b8761fb48a4fbaa7e06bfb9994d1b8"><enum>(4)</enum><header> Non-Federal
			 land</header><text>The term <term>non-Federal land</term> means the parcels of
			 land owned by Resolution Copper that are described in section 4(a).</text>
			</paragraph><paragraph id="ID32ede44b314e4bf2881717d17459f3f8"><enum>(5)</enum><header>Oak flat withdrawal
			 area</header><text>The term <term>Oak Flat Withdrawal Area</term> means the
			 approximately 760 acres of land depicted on the map entitled <quote>Oak Flat
			 Withdrawal Area</quote> and dated January 2009.</text>
			</paragraph><paragraph id="ID4b5b98df68e444939150e8a615722ffd"><enum>(6)</enum><header>Resolution
			 copper</header><text>The term <term>Resolution Copper</term> means Resolution
			 Copper Mining, LLC, a Delaware limited liability company, including any
			 successor, assign, affiliate, member, or joint venturer of Resolution Copper
			 Mining, LLC.</text>
			</paragraph><paragraph id="IDe4dc3fd4ff044f59a3ab795fa0206410"><enum>(7)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of Agriculture.</text>
			</paragraph><paragraph id="id25ADF4A1ADF146A1B43A660218FAA7ED"><enum>(8)</enum><header>State</header><text>The
			 term <quote>State</quote> means the State of Arizona.</text>
			</paragraph><paragraph id="IDa7e29d78a51a4a2a9f74e5d1a3d40ddc"><enum>(9)</enum><header>Town</header><text>The
			 term <term>Town</term> means the town of Superior, Arizona.</text>
			</paragraph></section><section changed="added" committee-id="SSEG00" id="IDd860f28a78c04d60ab54af643718025f" reported-display-style="italic"><enum>3.</enum><header>Land exchange</header>
			<subsection id="ID7d9226d34e204c50a68345a0bdd5efc2"><enum>(a)</enum><header>In
			 general</header><text>Subject to the provisions of this Act, if Resolution
			 Copper offers to convey to the United States all right, title, and interest of
			 Resolution Copper in and to the non-Federal land, and if the Secretary
			 determines that the public interest would be well served by making the
			 exchange, the Secretary shall convey to Resolution Copper, all right, title,
			 and interest of the United States in and to the Federal land.</text>
			</subsection><subsection id="ID3f60f65c7a78494ab12bf8f2da9232ff"><enum>(b)</enum><header>Compliance with
			 applicable law</header>
				<paragraph id="idD458197739F642A58B0F20E0941F5A63"><enum>(1)</enum><header>In
			 general</header><text>Except as otherwise provided in this Act, the Secretary
			 shall carry out the land exchange under this section in accordance with section
			 206 of the Federal Land Policy and Management Act of 1976 (43 U.S.C. 1716) and
			 other applicable laws, including the National Environmental Policy Act of 1969
			 (42 U.S.C. 4321 et seq.).</text>
				</paragraph><paragraph id="idF35589DF31A14C06BA101F6CA904B086"><enum>(2)</enum><header>Environmental review
			 document</header>
					<subparagraph id="id85FDD9A5140A49AF97AEB38F9860EC13"><enum>(A)</enum><header>In
			 general</header><text>To the maximum extent practicable under the National
			 Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) and Council on
			 Environmental Quality regulations, the Secretary, in consultation with the
			 Secretary of the Interior and other affected Federal agencies, shall prepare a
			 single environmental review document, which shall be used as the basis for all
			 decisions under Federal law related to the land exchange and connected agency
			 decisions related to the proposed mine on the Federal land.</text>
					</subparagraph><subparagraph id="ID5d1e499dfadc49639e46082036edc07a"><enum>(B)</enum><header>Effect of
			 paragraph</header><text>Nothing in this paragraph precludes the Secretary from
			 using separate environmental review documents prepared in accordance with the
			 National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) or other
			 applicable laws for exploration or other activities not involving—</text>
						<clause id="id0CB2C52FE0CE435B89292879C61B1F93"><enum>(i)</enum><text>the land exchange;
			 or</text>
						</clause><clause id="id32655A0AC1FD4671BFEBA15F0C4EAC6F"><enum>(ii)</enum><text>the extraction of
			 minerals in commercial quantities by Resolution Copper on or under the Federal
			 land.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="IDcccd6066a51e4533a208c2df3d848fc8"><enum>(c)</enum><header>Conditions on
			 acceptance</header>
				<paragraph id="IDbaef2a8e89d04778823517c52557c5d2"><enum>(1)</enum><header>Title</header><text>Title
			 to any non-Federal land conveyed by Resolution Copper to the United States
			 under this Act shall be in a form that is acceptable to—</text>
					<subparagraph id="IDb3025a90a72b4bedbace29ea89201c40"><enum>(A)</enum><text>the Secretary, for land
			 to be administered by the Forest Service; and</text>
					</subparagraph><subparagraph id="ID66afee7ec801487eb7a327b60e26b116"><enum>(B)</enum><text>the Secretary of the
			 Interior, for land to be administered by the Bureau of Land Management.</text>
					</subparagraph></paragraph><paragraph id="IDff1c5eea2d214771b909d38e36670a4b"><enum>(2)</enum><header>Terms and
			 conditions</header><text>The conveyance of the Federal land and non-Federal
			 land under this Act shall be subject to such terms and conditions as the
			 Secretary and the Secretary of the Interior may require.</text>
				</paragraph></subsection><subsection id="ID9264c5734ad249d6bdebaf56c9b9fb06"><enum>(d)</enum><header>Consultation with
			 indian tribes</header><text>Prior to making a public interest determination
			 under subsection (a), the Secretary shall engage in government-to-government
			 consultation with affected Indian tribes concerning issues related to the
			 exchange, in accordance with applicable laws (including regulations).</text>
			</subsection><subsection id="IDa786f08035aa4c5c8e612b9fe18b7901"><enum>(e)</enum><header>Appraisals</header>
				<paragraph id="IDbee293c98bcf4c309d7285c35efb17cf"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary and Resolution Copper shall select an appraiser to
			 conduct appraisals of the Federal land and non-Federal land.</text>
				</paragraph><paragraph id="ID9898098155b347aaa8d0398d5ee0eb4c"><enum>(2)</enum><header>Requirements</header>
					<subparagraph id="IDd91af1c191364076b76a4bdfb6690f81"><enum>(A)</enum><header>In
			 general</header><text>Except as provided in subparagraph (B), an appraisal
			 prepared under paragraph (1) shall be conducted in accordance with nationally
			 recognized appraisal standards, including—</text>
						<clause id="IDb57ffab7779b404cb0ff6718aff67772"><enum>(i)</enum><text>the Uniform Appraisal
			 Standards for Federal Land Acquisitions; and</text>
						</clause><clause id="ID6f1d7aaff48d4ae2a7dcd104c68efde2"><enum>(ii)</enum><text>the Uniform Standards of
			 Professional Appraisal Practice.</text>
						</clause></subparagraph><subparagraph id="idC1D3626BDC6D4BD289002E5A6DBA3EF1"><enum>(B)</enum><header>Final appraised
			 value</header>
						<clause id="id69E48340D10249CAA90A034B04616EC4"><enum>(i)</enum><header>In
			 general</header><text>After the final appraised value is determined and
			 approved by the Secretary, the Secretary shall not be required to reappraise or
			 update the final appraised value for a period of 3 years beginning on the date
			 of the approval by the Secretary of the final appraised value.</text>
						</clause><clause id="id27E24204B0234B349083E2CEB6C7D328"><enum>(ii)</enum><header>Reappraisal</header><text>Nothing
			 in this subparagraph precludes the Secretary, prior to entering into an
			 exchange agreement with Resolution Copper, from requiring a reappraisal or
			 update of the final appraisal if the Secretary determines that such reappraisal
			 or update is necessary.</text>
						</clause><clause id="id0F58D4AF6C864D9AAEA94EFCF7F3F6D5"><enum>(iii)</enum><header>Improvements</header><text>Any
			 improvements made by Resolution Copper prior to entering into an exchange
			 agreement shall not be included in the appraised value of the Federal
			 land.</text>
						</clause></subparagraph><subparagraph id="ID88398e26ef0849b4a817538e96647783"><enum>(C)</enum><header>Public
			 review</header><text>Before implementing the land exchange under this Act, the
			 Secretary shall make the appraisals of the land to be exchanged (or a summary
			 thereof) available for public review.</text>
					</subparagraph></paragraph><paragraph id="ID4d78be0d116942dfb987133bd2bb23f7"><enum>(3)</enum><header>Additional appraisal
			 information</header>
					<subparagraph id="idD18A29CC4BB1435094D115554BE2C2F8"><enum>(A)</enum><header>In
			 general</header><text>The appraiser selected under this subsection shall
			 prepare a detailed income capitalization approach analysis, in accordance with
			 the appraisal requirements referred to in paragraph (2)(A), of the market value
			 of the Federal land, even if the income capitalization approach analysis is not
			 the appraisal approach relied on by the appraiser to determine the market value
			 of the Federal land.</text>
					</subparagraph><subparagraph id="idD517B43F9EF24064BAC1C46A3019050E"><enum>(B)</enum><header>Inclusion in final
			 appraisal report</header><text>The income capitalization approach analysis
			 under subparagraph (A) shall be included in the final appraisal report of the
			 Federal land.</text>
					</subparagraph></paragraph></subsection><subsection id="ID82ab5b35470d4967b90126ad09516201"><enum>(f)</enum><header>Equal value land
			 exchange</header>
				<paragraph id="idA2A096885F8C40628F9F354AE835B03C"><enum>(1)</enum><header>In
			 general</header><text>The value of the Federal land and non-Federal land to be
			 exchanged under this Act shall be equal or shall be equalized in accordance
			 with this subsection.</text>
				</paragraph><paragraph id="ID1eee87b76ece458686b90a9313ec375b"><enum>(2)</enum><header>Surplus of federal land
			 value</header>
					<subparagraph id="id2B56CD8FEA994A91B9AD09F78D75A3BD"><enum>(A)</enum><header>In
			 general</header><text>If the final appraised value of the Federal land exceeds
			 the value of the non-Federal land, Resolution Copper shall—</text>
						<clause id="id7B60C4D482E3485ABACE8F83AF200B46"><enum>(i)</enum><text>convey additional
			 non-Federal land in the State to the Secretary or the Secretary of the
			 Interior, consistent with the requirements of this Act and subject to the
			 approval of the applicable Secretary;</text>
						</clause><clause id="id664B466D21074DFF8DDCCDF260CED0F7"><enum>(ii)</enum><text>make a cash payment to
			 the United States; or</text>
						</clause><clause id="idE648D24B1EA14F44AF5ECE7220192233"><enum>(iii)</enum><text>use a combination of
			 the methods described in clauses (i) and (ii), as agreed to by Resolution
			 Copper, the Secretary, and the Secretary of the Interior.</text>
						</clause></subparagraph><subparagraph id="id723DEB71EE7443AFBE777FBD6BB91FCF"><enum>(B)</enum><header>Amount of
			 payment</header><text>The Secretary may accept a payment in excess of 25
			 percent of the total value of the land or interests conveyed, notwithstanding
			 section 206(b) of the Federal Land Policy and Management Act of 1976 (43 U.S.C.
			 1716(b)).</text>
					</subparagraph><subparagraph id="id22EB5FA5EF4B4E78A5C85D729F6E9146"><enum>(C)</enum><header>Disposition and use of
			 proceeds</header><text>Any amounts received by the United States under this
			 paragraph shall be deposited in the fund established under Public Law 90-171
			 (commonly known as the <quote>Sisk Act</quote>) (16 U.S.C. 484a) and shall be
			 made available to the Secretary, without further appropriation, for the
			 acquisition of land for addition to the National Forest System in the
			 State.</text>
					</subparagraph></paragraph><paragraph id="ID0629008bd745498a87c4d84eaf623f1a"><enum>(3)</enum><header>Surplus of non-federal
			 land</header><text>If the final appraised value of the non-Federal land exceeds
			 the value of the Federal land—</text>
					<subparagraph id="idBD0D6E23109849AE880ED1F60FEBF8A1"><enum>(A)</enum><text>the United States shall
			 not make a payment to Resolution Copper to equalize the value; and</text>
					</subparagraph><subparagraph id="idAF27F2F377E64C158B6C27D4150E9569"><enum>(B)</enum><text>except as provided in
			 section 9, the surplus value of the non-Federal land shall be considered to be
			 a donation by Resolution Copper to the United States.</text>
					</subparagraph></paragraph></subsection><subsection id="IDd4c539d69bb54f019a93e3aa198a99e5"><enum>(g)</enum><header>Oak flat withdrawal
			 area</header>
				<paragraph id="idB534B2E84F9B441188E7F4070F84FB79"><enum>(1)</enum><header>In
			 general</header><text>Subject to the provisions of this subsection and
			 notwithstanding any withdrawal of the Oak Flat Withdrawal Area from the mining,
			 mineral leasing, or public land laws, the Secretary may authorize Resolution
			 Copper to carry out mineral exploration activities—</text>
					<subparagraph id="id6D6605A320464D23B15CDD5F8AD67060"><enum>(A)</enum><text>under the Oak Flat
			 Withdrawal Area, so long as such activities would not disturb the surface of
			 the area; and</text>
					</subparagraph><subparagraph id="ID88f51cffd1b04f8b9213d1761caed928"><enum>(B)</enum><text>on the Oak Flat
			 Withdrawal Area (but not within the Oak Flat Campground), so long as such
			 activities are conducted from a single exploratory drill pad.</text>
					</subparagraph></paragraph><paragraph id="idB8A8927C5AD344FDB4D3F283F5A4A948"><enum>(2)</enum><header>Conditions</header><text>Any
			 activities undertaken in accordance with this subsection shall be subject to
			 such terms and conditions as the Secretary may require.</text>
				</paragraph><paragraph id="id7A0074965B4F42FD9C8202BF3597731D"><enum>(3)</enum><header>Termination</header><text>The
			 authorization for Resolution Copper to undertake mineral exploration activities
			 under this subsection shall terminate on the earlier of—</text>
					<subparagraph id="id95C562BEBBCD49B6A8A7722D97ADDEEE"><enum>(A)</enum><text>the date the land is
			 conveyed to Resolution Copper in accordance with this Act; or</text>
					</subparagraph><subparagraph id="idCFCEE531E1D5415DBBED60FEDA3949EB"><enum>(B)</enum><text>the date that is 3 years
			 after the date a special use permit is issued in accordance with this
			 subsection.</text>
					</subparagraph></paragraph></subsection><subsection id="IDba6c1632369e4afba624c45ac2303080"><enum>(h)</enum><header>Costs</header><text>As
			 a condition of the land exchange, Resolution Copper shall agree to pay, without
			 compensation, any costs that are—</text>
				<paragraph id="ID9b6afbb2ff4e4626ad828cceb8e66e50"><enum>(1)</enum><text>associated with the land
			 exchange; and</text>
				</paragraph><paragraph id="ID2155951f2b0d41429cbbeda84e4a04f2"><enum>(2)</enum><text>agreed to by the
			 Secretary.</text>
				</paragraph></subsection><subsection id="ID8900b767d0014c79a206cabf2e975441"><enum>(i)</enum><header>Intent of
			 Congress</header>
				<paragraph id="id0D6237D6CDC24D968F518B16B69D578D"><enum>(1)</enum><header>In
			 general</header><text>It is the intent of Congress that the Secretary shall
			 complete any necessary environmental reviews and public interest determination
			 on the land exchange not later than 3 years after the date Resolution Copper
			 submits a mining plan of operation to the Secretary.</text>
				</paragraph><paragraph id="id04C44D522BF9447B88A57266612B31AE"><enum>(2)</enum><header>Agreement</header><text>If
			 the Secretary determines that the public interest would be well served by
			 making the land exchange, it is the intent of Congress that the Secretary seek
			 to enter into an exchange agreement not later than 90 days after the date of
			 the public interest determination.</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSEG00" id="ID83057eeb54954984ae541505bb5152fe" reported-display-style="italic"><enum>4.</enum><header>Conveyance and
			 management of non-Federal land</header>
			<subsection id="ID21041a5960d94d5297558d7439177375"><enum>(a)</enum><header>Conveyance</header><text>On
			 receipt of title to the Federal land, Resolution Copper shall simultaneously
			 convey—</text>
				<paragraph id="ID622cced3fba3446482c31782c6454439"><enum>(1)</enum><text>to the Secretary of
			 Agriculture, all right, title, and interest that the Secretary determines to be
			 acceptable in and to—</text>
					<subparagraph id="ID23acf842ba7748f5bc145d00b1b7d282"><enum>(A)</enum><text>the approximately 147
			 acres of land located in Gila County, Arizona, depicted on the map entitled
			 <quote>Southeast Arizona Land Conservation Act of 2009–Non-Federal
			 Parcel–Turkey Creek</quote> and dated January 2009;</text>
					</subparagraph><subparagraph id="ID9446cf7908b644758330a27672372c59"><enum>(B)</enum><text>the approximately 148
			 acres of land located in Yavapai County, Arizona, depicted on the map entitled
			 <quote>Southeast Arizona Land Conservation Act of 2009–Non-Federal
			 Parcel–Tangle Creek</quote> and dated January 2009;</text>
					</subparagraph><subparagraph id="ID23994dfe2c99426c85c49ef7e3752f62"><enum>(C)</enum><text>the approximately 149
			 acres of land located in Maricopa County, Arizona, depicted on the map entitled
			 <quote>Southeast Arizona Land Conservation Act of 2009–Non-Federal Parcel–Cave
			 Creek</quote> and dated January 2009;</text>
					</subparagraph><subparagraph id="ID2f6b2104ae454da090b04a917af4b410"><enum>(D)</enum><text>the approximately 640
			 acres of land located in Coconino County, Arizona, depicted on the map entitled
			 <quote>Southeast Arizona Land Exchange and Conservation Act of 2009–Non-Federal
			 Parcel–East Clear Creek</quote> and dated January 2009;</text>
					</subparagraph><subparagraph id="IDa85c0802800e439382b8ebfa1f211dcc"><enum>(E)</enum><text>the approximately 95
			 acres of land located in Pinal County, Arizona, depicted on the map entitled
			 <quote>Southeast Arizona Land Conservation Act of 2009–Non-Federal Parcel–The
			 Pond</quote> and dated January 2009; and</text>
					</subparagraph><subparagraph id="ID543fc3551cdb469e857c9025e185b99c"><enum>(F)</enum><text>the approximately 110
			 acres of land located in Pinal County, Arizona, depicted on the map entitled
			 <quote>Southeast Arizona Land Conservation Act of 2009–Non-Federal
			 Parcel–Apache Leap South End</quote> and dated January 2009, subject to the
			 retained right of Resolution Copper to conduct underground activities
			 that—</text>
						<clause id="IDf1fdc3e6628640e69fc32aa8a5ae78cc"><enum>(i)</enum><text>the Secretary determines
			 would not disturb the surface of Apache Leap; and</text>
						</clause><clause id="IDf17751586310436faa10c980424a5766"><enum>(ii)</enum><text>do not involve
			 commercial mineral extraction under Apache Leap; and</text>
						</clause></subparagraph></paragraph><paragraph id="IDd221b7898f3840a5b21823eeda536129"><enum>(2)</enum><text>to the Secretary of the
			 Interior, all right, title, and interest that the Secretary of the Interior
			 determines to be acceptable in and to—</text>
					<subparagraph id="ID7883abc6d8b241dc8b9328cafd5a91e9"><enum>(A)</enum><text>the approximately 3,050
			 acres of land located in Pinal County, Arizona, identified as <quote>Lands to
			 DOI</quote> as generally depicted on the map entitled <quote>Lower San Pedro
			 River</quote> and dated June 3, 2009;</text>
					</subparagraph><subparagraph id="ID445339dcc2ad4db084e18d6644456131"><enum>(B)</enum><text>the approximately 160
			 acres of land located in Gila and Pinal Counties, Arizona, identified as
			 <quote>Lands to DOI</quote> as generally depicted on the map entitled
			 <quote>Dripping Springs</quote> and dated June 3, 2009; and</text>
					</subparagraph><subparagraph id="IDe2c07947be1c4e098a38a138320e2d6f"><enum>(C)</enum><text>the approximately 940
			 acres of land located in Santa Cruz County, Arizona, identified as <quote>Lands
			 to DOI</quote> as generally depicted on the map entitled <quote>Appleton
			 Ranch</quote> and dated June 3, 2009.</text>
					</subparagraph></paragraph></subsection><subsection id="ID719ad1f11d8d458a838fac4678651a79"><enum>(b)</enum><header>Management of acquired
			 land</header>
				<paragraph id="IDd5b8149b6f7e44b282b84167d7abb4f5"><enum>(1)</enum><header>Land acquired by the
			 Secretary</header>
					<subparagraph id="id77A0AACB740343C3B85618C16DA13B8F"><enum>(A)</enum><header>In
			 general</header><text>Land acquired by the Secretary under this Act
			 shall—</text>
						<clause id="idC459E686504F47A9A1EDE8D32045192A"><enum>(i)</enum><text>become part of the
			 national forest in which the land is located; and</text>
						</clause><clause id="id9B671508C48B4914864811219327602F"><enum>(ii)</enum><text>be administered in
			 accordance with the laws applicable to the National Forest System.</text>
						</clause></subparagraph><subparagraph id="idB4392818B0004C8AA8494F36F2B8A0D4"><enum>(B)</enum><header>Boundary
			 revision</header><text>On acquisition of land by the Secretary under this Act,
			 the boundaries of the national forest shall be modified to reflect the
			 inclusion of the acquired land.</text>
					</subparagraph><subparagraph id="id4432787690B840CBBA1A17AE78E79D37"><enum>(C)</enum><header>Land and water
			 conservation fund</header><text>For purposes of section 7 of the Land and Water
			 Conservation Fund Act of 1965 (16 U.S.C. 460l–9), the boundaries of a national
			 forest in which land acquired by the Secretary is located shall be deemed to be
			 the boundaries of that forest as in existence on January 1, 1965.</text>
					</subparagraph></paragraph><paragraph id="ID7b4bc699e2be45e59377faea99d3b670"><enum>(2)</enum><header>Land acquired by the
			 Secretary of the interior</header>
					<subparagraph id="ID56e4147c6a874904bd8ebb19a08d52bb"><enum>(A)</enum><header>San pedro riparian
			 national conservation area</header>
						<clause id="id50B6E5868ACF488EB16870E6A0FA505A"><enum>(i)</enum><header>In
			 general</header><text>The following land shall be added to, and administered as
			 part of, the San Pedro Riparian National Conservation Area in accordance with
			 the laws (including regulations) applicable to the Conservation Area:</text>
							<subclause id="id366191C1AAA24A45AC9928C918876924"><enum>(I)</enum><text>The land acquired by the
			 Secretary of the Interior under subsection (a)(2)(A).</text>
							</subclause><subclause id="id5B1B1604EA764BFEA010EFABD6B887E4"><enum>(II)</enum><text>Any land acquired by the
			 Secretary of the Interior which is adjacent to the San Pedro Riparian National
			 Conservation Area.</text>
							</subclause></clause><clause id="id5A36BEAC755142839B4127644720C8B5"><enum>(ii)</enum><header>Management
			 plan</header><text>Not later than 2 years after the date on which the land is
			 acquired, the Secretary of the Interior shall update the management plan for
			 the San Pedro Riparian National Conservation Area to reflect the management
			 requirements of the acquired land.</text>
						</clause></subparagraph><subparagraph id="IDf82fe18e59044edbab3a291ec043d995"><enum>(B)</enum><header>Dripping
			 springs</header><text>Land acquired by the Secretary of the Interior under
			 subsection (a)(2)(B) shall be managed in accordance with the Federal Land
			 Policy and Management Act of 1976 (43 U.S.C. 1701 et seq.) and applicable land
			 use plans.</text>
					</subparagraph><subparagraph id="ID147b30e65f204f9592b5e4063dbf4737"><enum>(C)</enum><header>Las cienegas national
			 conservation area</header><text>Land acquired by the Secretary of the Interior
			 under subsection (a)(2)(C) shall be added to, and administered as part of, the
			 Las Cienegas National Conservation Area in accordance with the laws (including
			 regulations) applicable to the Conservation Area.</text>
					</subparagraph></paragraph></subsection><subsection id="ID1ff5b1eacc9a4313a97d980304523ac0"><enum>(c)</enum><header>Surrender of
			 rights</header><text>In addition to the conveyance of the non-Federal land
			 conveyed to the United States under this Act, and as a condition of the land
			 exchange, Resolution Copper shall surrender to the United States, without
			 compensation, the rights held by Resolution Copper under the mining laws and
			 other laws of the United States to commercially extract minerals under—</text>
				<paragraph id="IDf3fcf6c097dc43c78457ca7838410013"><enum>(1)</enum><text>Apache Leap; and</text>
				</paragraph><paragraph id="ID784e4b86f2b245d9bf58033a5815130a"><enum>(2)</enum><text>the property described in
			 subsection (a)(1)(E) (commonly known as <quote>The Pond</quote>).</text>
				</paragraph></subsection></section><section changed="added" committee-id="SSEG00" id="ID80f7b74e163b4413912f4509b307ead3" reported-display-style="italic"><enum>5.</enum><header>Recreational access and
			 improvements</header>
			<subsection id="IDeae1086f551e4a10940ca6b2e83680a2"><enum>(a)</enum><header>Recreational access and
			 facilities</header>
				<paragraph id="IDee9d2e39852946cea189b1d4b603f6ba"><enum>(1)</enum><header>In
			 general</header><text>As a condition of the land exchange under this Act,
			 Resolution Copper shall pay to the Secretary $1,250,000, to improve access and
			 facilities for dispersed recreation and other outdoor recreational activities
			 as provided in paragraph (2).</text>
				</paragraph><paragraph id="ID2d786b89418e415e86a2575e4dc18e40"><enum>(2)</enum><header>Use of
			 amounts</header><text>The Secretary shall use the amount paid in accordance
			 with paragraph (1), without further appropriation, to construct or improve road
			 access, turnouts, trails, parking areas, or facilities for dispersed recreation
			 and other outdoor recreational activities as the Secretary determines to be
			 appropriate.</text>
				</paragraph><paragraph id="ID6879efdf1eec4f5f92a165684c48e424"><enum>(3)</enum><header>Preferred
			 locations</header><text>To the maximum extent practicable, the funds made
			 available under this subsection shall be used by the Secretary on national
			 forest land—</text>
					<subparagraph id="ID8c48f17874f94ad28b1043fad24efda5"><enum>(A)</enum><text>in the general area north
			 of Arizona State Highway 60; or</text>
					</subparagraph><subparagraph id="IDe104bdabc1714861965b1caa57aa32b3"><enum>(B)</enum><text>in the general area along
			 Arizona State Highway 177.</text>
					</subparagraph></paragraph></subsection><subsection id="IDb93759dc2ae04a86ad0397225250f926"><enum>(b)</enum><header>Determination of
			 value</header><text>Amounts paid by Resolution Copper under this section shall
			 not be considered in determining the value of the Federal and non-Federal land
			 under section 3(f).</text>
			</subsection></section><section changed="added" committee-id="SSEG00" id="IDa8053106b8df4893a0e6fe65485fae36" reported-display-style="italic"><enum>6.</enum><header>Value adjustment payment
			 to United States</header>
			<subsection id="ID7b13878c30d04ba79e07193714263211"><enum>(a)</enum><header>Annual production
			 reporting</header>
				<paragraph id="ID5f998ad5581443308f853eb4bf0638e1"><enum>(1)</enum><header>In
			 general</header><text>As a condition of the exchange, beginning on February 15
			 of the first calendar year beginning after the date of commencement of
			 production of valuable locatable minerals in commercial quantities from the
			 Federal land conveyed to Resolution Copper under section 3, and annually
			 thereafter, Resolution Copper shall file with the Secretary of the Interior a
			 report indicating the quantity of locatable minerals produced in commercial
			 quantities from the Federal land during the preceding calendar year.</text>
				</paragraph><paragraph id="IDe60dabe3422941ac851c7f696bc65908"><enum>(2)</enum><header>Report
			 contents</header><text>The reports under paragraph (1) shall comply with any
			 recordkeeping and reporting requirements prescribed by the Secretary or
			 required by applicable Federal laws in effect at the time of production.</text>
				</paragraph></subsection><subsection id="ID423c1c26becb4919ad33529941a0b499"><enum>(b)</enum><header>Payment on
			 production</header><text>If the cumulative production of valuable locatable
			 minerals produced in commercial quantities from the Federal land conveyed to
			 Resolution Copper under section 3 exceeds the quantity of production of
			 locatable minerals from the Federal land used in the income capitalization
			 approach analysis prepared under section 3(e)(3), Resolution Copper shall pay
			 to the United States, by not later than March 15 of each applicable calendar
			 year, a value adjustment payment for the quantity of excess production at the
			 same rate assumed for the income capitalization approach analysis prepared
			 under section 3(e)(3).</text>
			</subsection><subsection id="ID2eb001c552aa4ad29b403c4a694f9f31"><enum>(c)</enum><header>State law
			 unaffected</header><text>Nothing in this section modifies, expands, diminishes,
			 amends, or otherwise affects any State law relating to the imposition,
			 application, timing, or collection of a State excise or severance tax.</text>
			</subsection><subsection id="IDf2d0be54ce634e3aae18556be524f18f"><enum>(d)</enum><header>Use of
			 funds</header><text>The funds paid to the United States under this section
			 shall be deposited in the fund established under Public Law 90-171 (commonly
			 known as the <quote>Sisk Act</quote>) (16 U.S.C. 484a) and shall be made
			 available to the Secretary, without further appropriation, for the acquisition
			 of land for addition to the National Forest System in the State.</text>
			</subsection></section><section changed="added" committee-id="SSEG00" id="ID3ae8a88011fc4de58ca5634e4afbfe43" reported-display-style="italic"><enum>7.</enum><header>Withdrawal</header><text display-inline="no-display-inline">Subject to valid existing rights, Apache
			 Leap and any land acquired by the United States under this Act is withdrawn
			 from all forms of—</text>
			<paragraph id="ID221f2f4ae78e4652bcfc8fadbc9a2062"><enum>(1)</enum><text>entry, appropriation, or
			 disposal under the public land laws;</text>
			</paragraph><paragraph id="ID40b1c7bdd1fa4aa9a34631914aaa8a3b"><enum>(2)</enum><text>location, entry, and
			 patent under the mining laws; and</text>
			</paragraph><paragraph id="IDa36468e83c7e4ed88bdfabb2c6e9a821"><enum>(3)</enum><text>disposition under the
			 mineral leasing, mineral materials, and geothermal leasing laws.</text>
			</paragraph></section><section changed="added" committee-id="SSEG00" id="ID58dfcc61ceb84fa2a97ffea27395291b" reported-display-style="italic"><enum>8.</enum><header>Apache leap</header>
			<subsection id="ID8ff4636969974f1eba896f2885048fa9"><enum>(a)</enum><header>Management</header>
				<paragraph id="id2396B5CE76F640B9BA12B451517006C2"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall manage Apache Leap to preserve the
			 natural character of Apache Leap and to protect archeological and cultural
			 resources located on Apache Leap.</text>
				</paragraph><paragraph id="idE3CF30B4AF724922A04541846ACC9234"><enum>(2)</enum><header>Special use
			 permits</header><text>The Secretary may issue to Resolution Copper special use
			 permits allowing Resolution Copper to carry out underground activities (other
			 than the commercial extraction of minerals) under the surface of Apache Leap
			 that the Secretary determines would not disturb the surface of the land,
			 subject to any terms and conditions that the Secretary may require.</text>
				</paragraph><paragraph id="idA5A7553D4D694435B8CE58B85DB81CF1"><enum>(3)</enum><header>Fences;
			 signage</header><text>The Secretary may allow use of the surface of Apache Leap
			 for installation of fences, signs, or other measures necessary to protect the
			 health and safety of the public, protect resources located on Apache Leap, or
			 to ensure that activities conducted under paragraph (2) do not affect the
			 surface of Apache Leap.</text>
				</paragraph></subsection><subsection id="ID32a1a647ff354a53994740be47326b03"><enum>(b)</enum><header>Plan</header>
				<paragraph id="id63E5AFB9D93B4633BCA336C305981B18"><enum>(1)</enum><header>In
			 general</header><text>Not later than 3 years after the date of enactment of
			 this Act, the Secretary, in consultation with applicable Indian tribes, the
			 Town, Resolution Copper, and other interested members of the public, shall
			 prepare a management plan for Apache Leap.</text>
				</paragraph><paragraph id="idB9EA00B82E9840219A46CB0FF7C05AE1"><enum>(2)</enum><header>Considerations</header><text>In
			 preparing the plan under paragraph (1), the Secretary shall consider whether
			 additional measures are necessary to—</text>
					<subparagraph id="id84BA3A6BF0574EDBB585CC7B66704331"><enum>(A)</enum><text>protect the cultural,
			 archaeological, or historical resources of Apache Leap, including permanent or
			 seasonal closures of all or a portion of Apache Leap; and</text>
					</subparagraph><subparagraph id="id1D49C3A0D0384BCF8AAAC141125A1753"><enum>(B)</enum><text>provide access for
			 recreation.</text>
					</subparagraph></paragraph></subsection></section><section changed="added" committee-id="SSEG00" id="IDef858589ddfb419b9776f0ea4688a708" reported-display-style="italic"><enum>9.</enum><header>Conveyances to town of
			 superior, Arizona</header>
			<subsection id="IDcaff03e0be314825b572703a50e3d634"><enum>(a)</enum><header>Conveyances</header>
				<paragraph id="id6FA341D087E1496ABE224EA64E005566"><enum>(1)</enum><header>In
			 general</header><text>On request from the Town and subject to the provisions of
			 this section, the Secretary shall convey to the Town the following:</text>
					<subparagraph id="IDda8d491f5308447a8e3ae50d87c9d6a4"><enum>(A)</enum><text>Approximately 30 acres of
			 land as depicted on the map entitled <quote>Southeast Arizona Land Exchange and
			 Conservation Act of 2009–Federal Parcel–Fairview Cemetery</quote> and dated
			 January 2009.</text>
					</subparagraph><subparagraph id="ID0ac297bfd3dd475dbb54c6b63ffddfc2"><enum>(B)</enum><text>The reversionary interest
			 and any reserved mineral interest of the United States in the approximately 265
			 acre of land located in Pinal County, Arizona, as depicted on the map entitled
			 <quote>Southeast Arizona Land Exchange and Conservation Act of 2009–Federal
			 Reversionary Interest–Superior Airport</quote> and dated January 2009.</text>
					</subparagraph><subparagraph id="IDc9f7c5a86a0a441dbae6c877cbca6707"><enum>(C)</enum><text>The approximately 250
			 acres of land located in Pinal County, Arizona, as depicted on the map entitled
			 <quote>Southeast Arizona Land Exchange and Conservation Act of 2009–Federal
			 Parcel–Superior Airport Contiguous Parcels</quote> and dated January
			 2009.</text>
					</subparagraph></paragraph></subsection><subsection id="ID595c304777b24615bed35a5cbbee837b"><enum>(b)</enum><header>Payment</header>
				<paragraph id="id41892626AD404F1CB411C53632E9083E"><enum>(1)</enum><header>In
			 general</header><text>The Town shall pay to the Secretary the fair market value
			 for each parcel of land or interest in land acquired under this section, as
			 determined by appraisals conducted in accordance with section 3(e).</text>
				</paragraph><paragraph id="idE1C0EB3AD7904E21A71DA608A68D1B12"><enum>(2)</enum><header>Reduction</header><text>If
			 the final appraised value of the non-Federal land exceeds the value of the
			 Federal land under section 3—</text>
					<subparagraph id="id6CB6C5E266D847F0BC3254C42906BD62"><enum>(A)</enum><text>the obligation of the
			 Town to pay the United States shall be reduced by an amount not to exceed the
			 excess value of the non-Federal land conveyed to the United States; and</text>
					</subparagraph><subparagraph id="idCEB2FBC33EEF417F8F6E72B11944BC18"><enum>(B)</enum><text>the amount donated by
			 Resolution Copper to the United States shall be reduced accordingly.</text>
					</subparagraph></paragraph></subsection><subsection id="IDedde8ca196324d91bda3603f063b8e86"><enum>(c)</enum><header>Sisk
			 Act</header><text>Any payment received by the Secretary from the Town under
			 this section shall be deposited in the fund established under Public Law 90-171
			 (commonly known as the <quote>Sisk Act</quote>) (16 U.S.C. 484a) and shall be
			 made available to the Secretary, without further appropriation, for the
			 acquisition of land for addition to the National Forest System in the
			 State.</text>
			</subsection><subsection id="ID8cbc9a9ac0b84183b246e5bccc9e8cdc"><enum>(d)</enum><header>Terms and
			 conditions</header><text>The conveyances under this section shall be subject to
			 such terms and conditions as the Secretary may require.</text>
