		  eligibility for reimbursement by the Secretary of Veterans Affairs for
		  emergency treatment furnished in a non-Department facility, and for other

		<section id="id9A59BFB02D5A4E22B0DCB76DBCFE2AD7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Veterans' Emergency Care Fairness Act
			 of 2009</short-title></quote>.</text>
		</section><section id="H4552C8BA9A1E4C0CB01C81BD0409BF00" section-type="subsequent-section"><enum>2.</enum><header>Expansion of veteran
			 eligibility for reimbursement by Secretary of Veterans Affairs for emergency
			 treatment furnished in a non-Department facility</header>
			<subsection id="HB54775BAC0F5492EADB56D625EA43679"><enum>(a)</enum><header>Expansion of
			 eligibility</header><text display-inline="yes-display-inline">Subsection
			 (b)(3)(C) of section 1725 of title 38, United States Code, is amended by
			 striking <quote>, in whole or in part,</quote>.</text>
			</subsection><subsection id="ID9d585ac42d2340319b0ab05b21ba0e76"><enum>(b)</enum><header>Limitations on
			 reimbursement</header><text>Such section 1725 is further amended—</text>
				<paragraph id="ID2a3dfeaa28154839a5404a69eca52f63"><enum>(1)</enum><text>in subsection
			 (c), by adding at the end the following new paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="idED2DF4CAF02A4D6AA668E950280E1AC9" style="OLC">
						<paragraph id="ID910c1deb29434d9e8ee1c810091dbbde" indent="up1"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id0F57FD7F64FA43F1A69EDB080A1996BD"><enum>(A)</enum><text>If the veteran has
				contractual or legal recourse against a third party that would, in part,
				extinguish the veteran’s liability to the provider of the emergency treatment
				and payment for the treatment may be made both under subsection (a) and by the
				third party, the amount payable for such treatment under such subsection shall
				be the amount by which the costs for the emergency treatment exceed the amount
				payable or paid by the third party, except that the amount payable may not
				exceed the maximum amount payable established under paragraph (1)(A).</text>
							</subparagraph><subparagraph id="idC2DE52F951554EA19DEF09E7C94E38BE" indent="up1"><enum>(B)</enum><text>In any case in which a third party is
				financially responsible for part of the veteran’s emergency treatment expenses,
				the Secretary shall be the secondary payer.</text>
							</subparagraph><subparagraph id="idFB7A208218C94943B117E492A6746006" indent="up1"><enum>(C)</enum><text>A payment in the amount payable under
				subparagraph (A) shall be considered payment in full and shall extinguish the
				veteran’s liability to the provider.</text>
							</subparagraph><subparagraph id="idB48D6A75A4244BA7B7ADAC98080EADA6" indent="up1"><enum>(D)</enum><text>The Secretary may not reimburse a
				veteran under this section for any copayment or similar payment that the
				veteran owes the third party or for which the veteran is responsible under a
				health-plan contract.</text>
							</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="ID4861e31e50fa46c7a61b033349a1df8d"><enum>(2)</enum><text>in subsection
			 (f)(3)—</text>
					<subparagraph id="id91664962210145BF9F2C79C726881891"><enum>(A)</enum><text>in subparagraph
			 (A), by inserting before the period at the end the following: <quote>,
			 including the Secretary of Health and Human Services with respect to the
			 Medicare program under title XVIII of the Social Security Act (42 U.S.C. 1395
			 et seq.) and the Medicaid program under title XIX of such Act (42 U.S.C. 1396
			 et seq.)</quote>; and</text>
					</subparagraph><subparagraph id="id94CC1E210F244C3AAB5EB9D1B1846F77"><enum>(B)</enum><text>in subparagraph
			 (B), by inserting before the period at the end the following: <quote>,
			 including a State Medicaid agency with respect to payments made under a State
			 plan for medical assistance approved under title XIX of such Act (42 U.S.C.
			 1396 et seq.)</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H3B82CB1C0B4E4911B0CA7CE0FEC546AA"><enum>(c)</enum><header>Effective
			 date</header>
				<paragraph id="idAF0F0489A3FA499F8CACA6B47DE2B49C"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The amendments made
			 by subsections (a) and (b) shall take effect on the date of the enactment of
			 this Act, and shall apply with respect to emergency treatment furnished on or
			 after the date of the enactment of this Act.</text>
				</paragraph><paragraph id="id103847CDAB0E457DB7454916AAAB68CD"><enum>(2)</enum><header>Reimbursement
			 for treatment before effective date</header><text>The Secretary may provide
			 reimbursement under section 1725 of title 38, United States Code, as amended by
			 subsection (a) and (b) for emergency treatment furnished before the date of the
			 enactment of this Act if the Secretary determines that, under the circumstances
			 applicable with respect to the veteran, it is appropriate to do so.</text>
				</paragraph></subsection></section></legis-body>
